about that were on at 11:00 that couldn't even fit into laura's show. steve: there is so much going on. on this very busy wednesday. we know one of the reasons president trump was elected president was his promise to build the wall on our southern border. because a lot of people feel we simply are not safe. well, now as it turns out, the very latest on those two border patrol agents who were, it sounds like they were ambushed on saturday into sunday. it sounds like after they were notified by their border patrol agents handling them in the big ben sector of texas there is activity going on over there with illegals. they fount footprints and they started following them. and then apparently they were ambushed. ainsley: let me tell you about this individual who ultimately gave his life for our country. his dad said i would tell him, son-in-law, that job is too dangerous. but he would say dad, it's the job i like. i want to defend my country from terrorists. i want to prevent terrorists and drugs from coming into the country. he loved his job and his dad said he died serving our country. he had an 11-year-old son. he was engaged to be married. he was assigned to the big ben sector and he was a border patrol agent for four years. brian: we don't know the name of the other border patrol agent struggling for his life right now. steve: absolutely. brian: we do know martinez, he goes by roger. we do know he was beaten with rocks. here's the president. he has more details than we have. but he is angered, horrified, and saddened. >> you heard we lost a border patrol officer just yesterday and another one brutally beaten and badden, badly hurt. looks like he'll make it. but very, very badly hurt. and we talk about the wall. we're going to have the wall. it's part of what we're doing. we need it. that's rough territory. that's where the drugs are coming in. brian: they say that's the area that the landscape makes it -- you don't want to build a wall in that area. only 1%. very mountainous. only 1% of people crossing there get through. only 1% of the crossings come through there man, someone tell these guys they can't get through because of natural boundaries. ainsley: vanhorn area known for drug activities. they would found in like n. a ravine 14-foot culvert both of these individuals. the guy who survived says he doesn't remember anything. they both had offered a $20,000 reward. brian: we have been telling you about uranium one and this has been the story. democrats come out and say it's no big deal it's a distraction because of the mueller investigation. that's what the trump people are putting out. republicans say this has been a big deal for two years you have just been ignoring it. so far push and pull. canadian company who licensed the russians to be able to dig for uranium in our country. had to be approved by a bunch of people, including attorney general eric holder. now it turns out there is more to this story that leads one to believe that the russians had a master plan. and that is get as much uranium out of this country as possible. steve: the whole idea was for the russians to corner the markets of american uranium to make us reliant on the russians. and john solomon and jeff carter both great investigative reporters. got information about this of it fbi informant. his name is william campbell. he saved thousands of memos and so now what they are able to do is put the story together. here is sara last night on the channel. >> there is over 5,000 documents which include emails, briefs, other documentation, memorandum is that true informant had turned over to the fbi and justice department. and within these documents it's very evident of russia's intentions to enter the american market, energy market. and their intentions to acquire uranium one. brian: got to hear from this informant. i guess he hasn't been feeling well. he is going to decide, his information, where this story goes. steve: he has got a lot of it. some of the things that have been revealed in their reportage over the last 24 hours, "the washington post" got it wrong. uranium one actually has exported uranium from this country. actually, the fbi had evidence of corruption before the obama administration approved the sale. and then when the fbi informant heard about that he said, wait a minute, i have got the goods on this. there was a lot of bribery involved. how could the government let that go through? he was told by his fbi handler, politics. ainsley: russia would do anything to corner the american market on uranium. brian: now let's go to politics and sports and keep it in politics. lavar ball has been traumatizing the sports world really since his son emerged prominent basketball player first round draft pick of the los angeles lakers. so now his other sons are at ucla and one of which was caught shoplifting with two others. and you know detained in china. lavar ball is a clown. and he is absolutely somebody that, yeah, he seems to have done a great job with his sons, but every time he hops in front of the microphone i don't understand if he is this really insane or just pretending to be insane to get more attention on himself. yesterday, we saw lavar ball bring his act to another news network when asked why he went after the president and would not thank the president for helping his son avoid thought process. okay? >> all right. >> what we are talking about right now is a lot of stuff about my son just because his last name is ball. we are not even talking about the other two kids. i don't have no doubts about what he did. i got doubts of what he didn't do. how's that? i would have said thank you if he would have put them on his plane and took them home. i would have said thank you, mr. trump, for taking my boys out of china and bringing them back to the u.s. there is a lot of room on that plane. i would have said thank you kindly for that. steve: he would have thanked the president of the united states had the president said hey, come on, guys, who i just sprung hop on air force one and i will take you home. apparently during the additional when the president was with the president of china, the president of china had not heard about it. and the president then said explained the story about how these guys each stole $2,000 pair of louie vitton sunglasses the president it sends a bad message. think about if this were you. my dad would have gone on national television and said thank you to the president first of all for allowing my daughter to come home. i would have allowed anyone to thank that happened so she didn't have to stay over there and do hard labor and god knows what would have happened to those individuals, those boys. that dad need to be grateful for anyone that helped him. he did thank the president of china and didn't thank our president. even his own son came out. my dad said if you ever get caught in jail don't call me. it was our fault. he said you have to take responsibility for your actions. the dad should say my son, by the way, their tennis shoes cost how much, $500? steve: 700 bucks apiece. why is he stealing louie vitton. the steve: jillian, thank you. new york city college sparking outrage after making it known they don't want police using their campus bathrooms all in an effort to keep the cops out of sight from the students. this as a petition is in the works by brooklyn college students to ban the police from the campus all together. some students saying to the "new york post," quote: we do not want the new york city police department on campus in any respect, even if it's just to take breaks and use the bathroom. students don't feel comfortable around cops. it makes safe spaces feel not so safe. your firsyour your first instins to be scared. here to weigh in on the sergeant's benevolent association ed mullins. good morning. >> good morning. steve: the first inclination of some of these students when they see a police officer is to be scared. >> that's only on campus. as soon as not in their travels to and from school. it's not in the neighborhoods where we live and not when they call 911. there is clearly a little bit of an agenda going on. steve: apparently, according to these articles that have been written so far, when they see a police officer, some of these students, at brooklyn college, they see the police officer and rather than somebody there to protect them, at triggers something bad inside where they are afraid. >> i personally don't believe that i just think that what we have is students looking to make a name for themselves, so to speak, to create an issue. ultimately i blame the administration of brooklyn college there is a question of right and wrong here. i think it's pretty clear across the country that the police are not the enemy. they are basically the good guy. what's occurring now is just total lunancy with lunatics running the asylum all over again. steve: there was one police officer quoted in the "new york post" article. that protester culture is quote warping their f g minds. what we are seeing culture of protest. antipolice sentiment going across the country. we have police officers being assassinated. this all stems from weak leadership, weak politicians that help enforce this inenvironment. everything that occurs now is about political correctness. somewhere along the line you have to push back and say enough, this is how we live in this country. without law enforcement and law and order we have total chaos. ultimately without the police you wouldn't even be able to go to school. >> steve: it's interesting. apparently the student body president for brooklyn college h said one of the reasons she did not like the police that in fact apparently there was undercover new york city police department counter terrorism investigation. and they wound up arresting two women who were trying to pull off an isis inspired plot to blow up propane tanks in new york city. >> that statement alone should discredit this whole issue. the fact we have an individual that feels uncomfortable over that incident which basically tells me you would rather sit with people involved in terrorism in your classroom than to see police officers walking about your campus and protecting and keeping a safe campus. we see active shooters. we see acts of terrorism all over the country. who is responding to it? todd: good morning, steve, ainsley and brian, we are having so much fun this morning. we are here for a reason and we are here to talk taxes. in a nutshell there is argument out there from many of the high tax states. they pay a lot of state. they pay a lot of local taxes. they want to deduct those taxes from their federal income taxes. they say with tax reform if they are not allowed to do that their federal taxes are actually going to go up when tax reform happens. we are talking to the people here in the not high tax states to find out what they think about that argument. we begin with pat. pat used to work in risk management for seinfeld throughout she is he a george castanza. she says kansas and states like kansas shouldn't have to subsidize for high tax states. why do you say that? >> say that i because there is three or four high tax states and there are many more nontax states. why should we have to subsidize three or four states. todd: understood. we will go over to karen. karen used to work in mortgage lenging. she, too, like pat is required. we were talking about peter king's argument look, we pay in these high tax states so much money into the federal system, we don't get that same money back. you say that's not a good argument. why do you say that? >> because you can't expect to get everything back. who is going to pay for the federal stuff and military and national parks and everything that the federal government owns? you expect that for free? >> this judge is a politician. he is a bundler for obama. he has made contributions before he was on the bench. he actually worked in the justice department handling immigration. and he said in his hearings he wasn't going to rule on decisions he worked on while at the department of justice. the problem with, this brian, it's all about politics. it's all about scaring people. it's all about arousing anger from some people and fear in others. and it's demagoguery and it's got to stop. i'm a businessman looking to turn california around. and, you know, in the business world, you got to search for solutions. the solution here would be to make sure that people understand that the police are there to help them and secure their environment and make sure that they can put criminals in jail. i mean, this sends absolute wrong message about going after criminals. brian: right. this is protecting the people that are here. you have a choice. you have a certain amount of tax dollars going to your community. i don't want to give it to people who pay taxes or illegals here some of which are criminals in their midst. it's sanctuary. john, true or false. a sanctuary city often functions as a magnet for illegals. >> the message that's being sent by politicians like the one i'm running against gavin newsom we have to have sanctuary cities because nurses and teacher also turn their students into ice. you know, there are no teachers and nurses in california turning their students over to ice. i mean, it's all about scaring people and he is a demagogue and that's the problem with this. brian: this is what you do if you are here illegally. wake up to an officer and say if somebody is here not breaking the law illegally, and you see them, will you toss them out? the answer is no. they will still go in and report an ms-13 or a criminal in their midst drug dealer here illegally. they just don't have the manpower to throw out anybody who is here illegally or was brought here as a 3 or 4-year-old. next, i want to talk about what's happening also in california and they are talking about taking out our national anthem again. not kneeling during it the third verse, they say, is racist. let's take a look at what that third versus and excerpt that's causing the controversy. let's put that up if we can it says. this many of these sanctuary -- can we see it right now? no one could ever get over those bike reaction. ainsley: the parade goes right down sixth avenue right out here. steve: avenues of america. brian: president trump doubling down vowing to build the wall after a deadly ambush of a border patrol agent. in fact, two of them. ainsley: the hunt for the killer now intensifying as the slain agent's partner remains hospitalized. steve: a lot of details are not known. griff jenkins right now in our nation's capital with brand new details of what we do know so far. griff, it looks like they were ambushed. >> it does. the hunt is on governor abbott in texas announcing a $20,000 reward, guys, asking for the public's help catching this killer. he says. now the fbi isn't saying exactly what happened near the border in west texas. it took agent martinez's life and left his partner critically injured. in a statement that's thin on details, the fbi says, quote: the agent substained traumatic head injuries along with other miscellaneous physical injuries such as broken dow jones. this as president trump reacting to the tragic news offering condolences to the agents' families and vowing to secure that border. >> as you heard, we lost a border patrol officer, we're going to have the wall. it's part of what we're doing. we need it. it's rough territory. that's where the drugs are coming in. a lot of things are happening along the border. the southern border. and we're going to straighten it out. >> while the fbi isn't detailing the incident. border patrol union officials and other agents were ambushed and attacked by illegals or drug traffickers while responding to a call. >> we believe that border patrol agent martinez was ambushed by individuals. he was then violently beaten. and thank god his partner survived who was also gravely badly injured. but it's a very, very violent environment on the border. and i think americans have had enough. >> agent martinez 36 years old and had been an agent for four years. he leaves behind a grieving father, fiance an 11-year-old son. he is actually a native of el paso. he is the 39th agent killed in the line of duty since 2003. i covered el paso and the border sector quite a bit, guys, some years ago and been on the phone this morning. if the fbi officials don't come out and i have something more to say today about what happened there, it is going to be quite a situation. but, we expect some word later today on exactly what happened and whether or not, steve, it was, indeed, an ambush and an attack. steve: it does look like what it was. griff, thank you very much. joining us is jason chaffetz. fox news contributor, former utah congressman and chairman of the house oversight committee. it looks like the guy who died did die from blunt force trauma to the head. they surmised probably someone hit him with a rock. >> i have spoken with some people who actually work that area. i have gone down to the border patrol lots of times. these guys do amazing jobs. this just makes you mad. this should not happen. this idea that he is out there with his partner. i want to tell you, most of the time when these agents go out, they are going out by themselves. it's in the wee hours of the morning. an alarm goes off. he is following some tracks and ambushed and killed. don't let anybody fool to you think that oh, everybody that's coming across the border, just wants to make their life better. no, come on. these people are -- they are running drugs and doing other nefarious things. these are really bad actors out there. i want somebody to go down on that border and actually film, actually look at what that border looks like. because my guess is, i'm just guessing right in this area, it's probably like barbed wire. maybe not even a fence at all. i'm totally on board with the president. build that wall. and i think homeland security is doing a great deal of injustice when they put out that statement and said we blanketed the area. no, they didn't. they didn't catch these perpetrators. they didn't put a noos around that and tighten it and catch these perpetrators. they didn't do that they delayed that statement. i think congress needs to dive into that one as well. steve: you are one of the few people calling them out. >> i love what the men and women do down there, but the management, the desk jockeys in washington, d.c. who sit back and hold this press release, they didn't let the public know immediately hey look for these guys. they didn't call in everybody right away to put thatthat noose and go find those perpetrators. it's so easy to walk across the border. ainsley: there is a federal judge wants to protect all those people coming over illegally in sanctuary cities. our president signed an executive order saying if you have a sanctuary city, and you continue to live as a sanctuary, i'm not giving you federal funds. this judge, this -- certain federal funds. this judge in the northern area of california, shocker. >> yeah. ainsley: given millions of dollars to the democrats and the dnc, he blocked that from happening: this judge is, let me see, northern district of california, nominated by president obama. 2015 he raised $200,000 at least for president obama. donated $30,000 to groups supporting him. and $51,000 to the dnc. i counted 26 donations all to democrats. >> the way to actually solve this is actually december 8th. there's a way to actually solve this problem because if you are saying that congress is not giving congress proper authorization. guess what the reauthorization for the federal government moving forward has to happen by december 8th. one or two sentences placed into that funding bill which will pass will solve this problem, give the president the authority. but this person is a clear partisan. he has no desire to help the president or whatnot. but, congress has a responsibility to give the president this option. and they can do it week after next. brian: jason, i hate to tell you, most of the population there in california probably agrees with this judge. that's the issue. it's what right. >> that's why a lot of people are moving out of california. brian: that's why taxes are through the roof paying for illegals and people seem okay with that we will see if the people of california speak up. yesterday, this story moved and that's uranium one story it seems like democrats say this is a nonstory, a distraction. to side track the mueller investigation. but now we have five new revelations. one that russia saw its purchase of uranium one, canadian company digging in america as part of the strategy to dominate global uranium markets. uranium one did export some of the u.s. uranium which they said they didn't. the fbi did have evidence that these officials were engaged in criminality along the way. keep in mind, too, they have informant looming about to come forward we're about to find another 5,000 pages that existed of top secret information that shows some type of linkage. >> i want some democrat or some person who says don't look over here, i want them to come on television or write an op-ed and tell us why giving up access to uranium in the united states, why is that a good idea to give anybody else, other than the united states control of it? let alone russia? you know? give me an excuse as to why. brian: you knew nothing about this until peter schweizer's book come out. >> schweizer did a great job. when i was still a chairman we did issue letters. we did put out subpoenas. we did try to get these documents. i'll telling you that deep state, they just lock down. they will not cough it up. even to this day, even with all the press and attention, you have people like ron dee dee san tis and trey gowdy trying to get these documents and they still won't cough them up. we are still fighting from getting documents from fast and furious, the irs. just because the administration changed does not mean that the bureaucracy changed. steve: this particular. >> we started this investigation a long time ago. even when i was back as chairman. steve: the deal was approved in 2010. >> um-huh. steve: this guy, the confidential fbi informant was telling the fbi what was going on at least a year earlier. there are a number of media outlets and john solomon calls them out and says there is misinformation out there that obviously has been put right in front of certain reporters to get a certain angle out on the story. >> and when the department of justice says oh, we gave congress this many documents, you know, gave them 20,000 of this or 30,000. ask them what percentage. that was the thing that drove me nuts. trey gowdy would say this a lot. you want to know the truth? tell me what percentage of the truth you. if you are only going to give me 70% of the documents you will only get 70% of the truth. brian: your years in congress did you know about a slush fund available for 20 years in congress to provide 264 sexual assault settlements to the tune of $17 million use ouring our taxpayer dollar. >> know never heard of that. i never tapped into it. brian: john coal years did it seems. >> there is no reason why the american taxpayers should have to pay for some member of congress who breaks the law. why should they have to pay that? that should be a personal responsibility of the member of "the washington post" citing will female employees accusing the anchor of unwanted sexual advances including lewd phone calls and groping. in a statement to the post rose apologized saying he, quote, behaved insensitively at times. how about this? >> ted: yeah, hi, guys. in the last 30 minutes chief brian dugan, the chief of the tampa police department himself has come by this crime scene. he is dedicated to reresolving this murder. early i got a chance to interview chief dugan. let's take a look. >> this is a wonderful neighborhood from what i have been told here in seminole heights. and have you got a lot of good, wonderful people here. and from what i have been told in the fell ton murder, that took place down, that that murder along with the other murders were all within a one-mile radius of each other. and does that tell you that this may very well be someone who was familiar with this neighborhood? >> yeah. it certainly, it's a very tight knit community here that does not have these type of crimes. and whoever is doing this is very familiar. they are able to vanish under the cover of darkness. the murders are very close in proximity. and that is one of the frustrating things is how are these things able to happen so close to each other. we have had a strong police presence and it is still taking place. and it makes me wonder does someone know something and maybe they just don't realize it. >> chief, do you believe that this killer or killers will strike again? >> well, when you look at the history, you know, that's a fair question. when you look at the history what's going on, our job is to make sure that that doesn't happen. we are doing everything we can. but, is that a fear of mine? certainly. there is no doubt that is my biggest fear. when the phone rings, the first thing that goes through my mind is i'm hoping that they got the name and they got whoever is doing this. the second thing that goes through my mind is do we have another one? possibly be so damaging in those deposition tapes? here to weigh in is former national coordinator and co-founder of the tea party patriots and current president of citizens for self-governance mark meckler. mark, good morning to you. >> good morning. >> okay. so she says that if the public finds out what she said in this court proceeding, she fears for her life. do you believe her? >> i don't believe her. and the implication is really outrageous. what she is saying is that what she said in that deposition about what she did to tea partiers and other constitutionally minded folks around the country is so bad that people will be outraged to. me that leads us towards we have a right to know and we certainly ought to know. steve: sure. accord ghtaccording to the "wasn times" the government admits not only -- she didn't stop the targeting, contradicting obama claims but also hid it from her superiors in washington, d.c. clearly, she did things that she does not want the public to know. >> yeah, clearly. and the thing that i find so outrageous is from what you just read, we already know on the public record that she did these things. we just don't know all the details. and the american people, when their own government, when the irs targets them, they certainly have a right to know what their employees did. steve: i think we all want to know who told her to go ahead and do that if this remains redacted, there is no chance for us to find out, is there? >> there isn't. and to mee this is the most important part of this case. this was a class action that was recently settled. we are waiting for the judge to approve that settlement. most important part is that the american people have a right to know. the only way that you stop this sort of thing from happening again in the future, is if we know exactly what happened. that is precisely what lois learner and holly paz are trying to prevent from happening. steve: here is the problem for you they blame you one of the reasons you are a troublemaker stirring stuff up, amongst other things, you called irs agents criminal thugs and because of things you have said, they're in danger. >> well, i mean, first of all, did i call them criminal thugs. i want to admit that on the record. i don't support harassment or abuse or threats dense anybody. even government officials who act like criminal thugs. i did say those things. it's funny if you watch the videotape where i said them i'm wearing a cowboy hat speaking in front of the tea party hardly the thing that seems threatening. steve: the cincinnati enquirer where these are happening. they trying to get through the freedom of information act all sorts of the testimony so that they can know what exactly was said. so maybe if she is not successful, then in turn, the local newspaper out there can find out what she told people about this thing. >> well, we are serigne hoping. so this seems like a basic issue of common sense and transparency. the american people have a right to know. the irs has admitted that they were targeting american citizens for their political points of view. jeff sessions, the attorney general said that this is outrageous and shouldn't be allowed to happen. the irs owes the american people an apology. more important than an apology to me is just the nomination of what actually happened. we know some of the details but obviously lois learner is still hiding a lot more of them. steve: mark, didn't you think because of the things he had said out on the campaign trail as a candidate, when donald trump became president of the united states, didn't you think we were going to find out more about what happened at the irs and, you know, he would probably get there and fire the irs commissioner koskinen? none of that stuff happened. >> yeah. and i can tell you there are a lot of folks out there that are really frustrated by that. koskinen gets to serve out his term. there really isn't much reform at the irs. certainly the doj was helpful in settling this case in the end. would not have settled under hillary administration. but, we still have the right to know. and it is time to blow this thing wide open and honestly, it is up to president trump, secretary mnuchin to get this done. steve: there are no statute of limitations regarding this stuff. the government can open the books and tell us what happened. right? >> they can. and, again, this should be the legacy of this whole targeting scandal. not just a settlement of the case. i'm glad that the case has settled. the plaintiffs are glad that its settled. the most important part again is this knowledge. daylight is a disinfectant. we know some really bad things happened. it's time for the american people to know all of them. steve: i president trump doubling down on the promise to build that wall after the deadly ambush of a border patrol agent. brian: the hunt for the killer is still on, and they say it's intensifying as the partner remains hospitalized expected to stay alive. ainsley: griff jenkins is live in our nation's capital. >> good morning, guys. i just got off the phone moments ago with special agent in charge of jannett of the fbi, and she tells me that they're still not seeing exactly what happened in west texas that took agents lives. but referred me to a statement that's thin on details and said quote both sustained traumatic brain injuries along with miscellaneous broken injuries and broken bones. this offering condolences to victims' families and vowing to secure the border. >> as you heard, we lost a border patrol officer. we're going to have the wall. it's part of what we're doing. we need it. it's rough territory. that's where the drugs are coming in. a lot of things are happening along the border. the southern border, and we're going to straighten it out. >> now, agent harper told me that the fbi is planning on a press conference around 1:00 to 2:00 p.m. local to learn more of what happened as they investigate. but border patrol union officials and others are saying that these agents were ambushed or attacked by drug traffickers while responding to a call. martinez was 36 years old. he leaves behind a grieving father, a fiancé, and an 11-year-old son. he has been on the force for four years, and this is the 39th border patrol agent killed in the line of duty since 2003. guys. steve: all right. griff jenkins live in our nation's capitol. we will take that press conference live this afternoon because everyone has the question what exactly happened. it does sound like somebody was ambushed and somebody took a big rock and bashed both of them in the head. charles: i can't imagine his dad being so emotional when talking to reporters, as one would be. but knowing that's how your son took his last breath. steve: doing his job. ainsley: he said, son, this job is too dangerous for you. and he said dad, it is a job i like. i want to defend my country from terrorists. i want to prevent drugs and terrorists from coming into the country, and his dad said he loved his job. brian: so right there when he said the first thing i'm going to build a wall because a lot of bad things are happening down there. and building the wall will begin to show other countries that america is furious about this. not only do the wall, but get underneath so the burrowing and tunneling could come to a close. robert hire is brian terry's cousin. and among the people that the president would have been elected of brian terry, the border alerting people to the problem is steve bannon. just said that recently. he was on, was brian terry's cousin with laura ingram last night. >> you know, it's a violent, violent environment. very kinetic, just as we saw with brian terry. those armed rip crews were professional criminals that came in and went back across the border time and time again to do one thing, and that was create violence on the american side of the border. it's a very, very violent environment on the border, and i think americans have had enough. they elected a president to secure the border. steve: and, of course, in addition to the border patrol agent being killed, he is partner is in serious condition right now. ainsley: yeah. steve: so stand by for that press conference earlier this afternoon. ainsley: we interviewed one mom. she had a perfectly, beautiful, healthy child. was severely injured, head injury. and he was hit by a drunk driver who had been deported 15 times. steve: unbelievable. ainsley: kate steinle. the guy who shot her, he had been deported five times. something has to be done and why these sanctuary cities, why these governors or individuals, these liberal judges are supporting to have illegal criminals stay in our country so taxpayers can pay for them and innocent little kids, their lives are changed forever, it's just beyond me. i don't understand it. brian: the attorney general jeff sessions on the president's order says, listen, if you told everyone sanctuary cities are now history. in fact, if you do not stop the sanctuary city policy, unsaid policy within your town, within your county, within your city, you're going to be denied federal funds. well, that has been rocketing around and bouncing around the courts. the latest judge to say, no, that is unconstitutional or it's just not going to land he claims personally. now, this judge said it is not allowed or you cannot denied funding to cities already promised. this guy has a rich history on the left. nominated by president obama 2013. he has actually bundled money to the tune of $200,000 to obama campaign. he is not going to allow this policy to go through. ainsley: read that last. we just had a full screen up of what he did. planned parenthood. steve: look at that part right there. 200,000 for president obama. clearly, not a fair and balanced kind of judge. he clearly tilts to the political left. but what's interesting is so you've got these two california counties, they both sued the federal government and said you can't tell us what to do. your language department of justice is too broad. going forward. and it's not all federal money. it's just regarding the burn grants, which is, you know, 100,000 in each of those counties, something like that. we had jason chaffetz on the couch right next to brian just about an hour ago, and what he made clear was the fact that it looks like congress could actually do something about that. the first week in december they could change the law to make it very specific when it comes to funding the government. budget time. ainsley: this is the same judge that when i was mentioning planned parenthood. remember all of those videos that came out of what planned parenthood was doing with the body parts? he's the one that said he put a restraining order on that organization that was releasing all of those to the public so that we would actually know what's happening behind closed doors there. he put a restraining order to those there to 26 democrats and not one republican. clearly, political. brian: the district court, doj, department of justice. the district court exceeds its authority today when instructing its cabinet members to enforce existing law. the justice department will vindicate the lawful authorities to direct the executive branch. steve: right now, it is being >> way back when i was doing the oprah show. we saw ads that oprah and i were were selling, and we started looking at these things and said how can we get our names out there? and i was on fox and friends and watched a commercial and had my name, i would have to call you up and you take it down. that's not the rule on the internet. the rule on the internet is i have to find out who they are, they don't tell you who you are. steve: you have to do leg work. >> you can't do the leg work. they hide who they are. fake ads led to fake news led to fake campaign pieces, which now, of course, they can't find out who -- brian: you were upset before this. >> i was upset a decade ago. when you tolerate fake tig, which we've now done for ten years leads to fake news, which is rampant and only about the money. and it's a little bit of hacking from russia. but the real problem is fake news, and one of the most notorious fake news creators on my show. he was the one that wrote the ads, the pieces with hillary clinton about ohio. he's a democrat. he was a democrat hurting a democratic candidate. steve: it just clicks. ainsley: how do you fight google? how do you fight all of these big advertisers? >> well, first of all, you get the ftc on your side. when the federal trade commission said there's a $175 million settlement, somebody busted in their offices in san diego and you see these guys are con artists at every level. well, when the ftc, god bless them for doing this, you take down one of the most notorious ones, other people might watch now and pay attention. but the bigger story is we have to force the major companies that serve these ads, the google and facebooks of the world to disclose who these people are. i should at least be able to defend myself. >>: so what happened? >> these guys were bad apples. i went after them for a couple of weeks after the embarrassment because, you know, i -- by the barrel, so i could make a lot of noise. but after a couple months, they came back like whack-a-mole. so the ftc said you can never advertise again in the way you've done it. $175million settlement. ainsley: who gets the money? you? >> i don't want the money. the government gets it. a lot of people whose opinion seems to matter are the ones who are targeted. and we have a break down in the law and order. and the purpose for the op-ed piece to about applaud the ftc but also to get these major companies who their sources are. and if we don't shut down the money trickling into fake news and fake advertising, we're not going to stop the process. steve: so if you're saying some congressional lawmaker is watching right now, this would be a good thing to neuron a law. >> it would be a very wise move to make, and we're going to have to do it at some point. let's do it early enough that we stop the pro version in the system. we have to clean the neighborhood up. i'm surprised that companies haven't done this themselves. brian: especially dr. oz. celebrity is one thing, but you're a doctor, so they feel as though you've cleared it. >> and the products they're buying are not are not only fake but dangerous at times. steve: no standards. >> obviously, they're going to lie name and involved, they're going to lie about what they put in there. and they just charge it and charge it and charge it. and this is an example i think of how the law has been used wrongly. we've protected these large companies for 20 years treating internet companies like they're fax machines. not responsible for the content on them. we have to change that and there is no excuse in america anymore, and i would rather happen to a private solution because i don't think the government is very good at making these rules but at some point, there's enough pressure put on for answers. brian: thanks for getting up early and telling everyone. your show doesn't start until a little while longer; right? does your mom know latin? >> she raised me in latin. it's english i have a problem with. brian: fantastic. ainsley: we want to talk to you about some news of the day. you've got this judge in california, northern california, liberal judge giving lots of money to democrats, including president obama. he has blocked the president. president trump's executive order to -- that was going to prevent sanctuary cities from getting some federal funding. >> yeah. and i'm -- i think this is ridiculous, and i don't really understand why americans put up with it. the idea that every little district court judge is a legislature. and i get sued more than i would like, so i find myself appearing before judges more than i would like. steve: what do you get sued for? >> oh, you know, this and that, climate change and all kinds of things. and i don't generally have a high regard for the quality of judges. and the idea that every judge is a one-man legislature is absolutely repugnant to the principles of self government. and it's nothing to do with constitutional principles. we now have judges who basically strike down highly specific pieces of legislation just because they're politically -- brian: by the way, this is to make illegal people not have a place to go snuck in here illegal. this is no big leap to stretch the law. this is a black-and-white issue. >> yeah. and i may say someone who is a legal immigrant, boy, i would never make that mistake again to this country. if you're a legal immigrant, you're obliged to have your green card on you at all times. it doesn't matter if you're flying new york for a big time morning tv show or if you're strolling in your backyard, you can be pulled over and it's for your children. your children in theory, in law are meant to have their green cards with you when they go to kindergarten or 1st grade. and so this difference between one group of people who get to treat the laws with impunity and the others who are microregulated is not tangible in a free society. steve: well, i tell you what. it does not sound as if the people who killed one border patrol agent over the weekend and seriously injured another were in this country illegally. because what we've heard so far is that yes? officer martinez. he was killed. he was a father, he was a brother. apparently he died of blunt force trauma. apparently they were tracking some trail with footprints and somebody apparently ambushed him, and they feel they took a great big rock and broke the guy's head. >> and this is actually -- this is a terrible tragedy. but it is also why we need the wall. we're often told you can do it with sensors. these guys, they went to investigate. they couldn't secure the crime scene. these guys got away. the fellas who did this. we may never catch them. and the reality is that you actually do need to -- the -- if you go south of, say, tucson, arizona. there are signs on the highway saying proceed further at your own peril. in other words, the united states government, the most powerful government on the planet does not run on its own territory. ainsley: don't you feel like the liberals are saying you hear when all of these democrats are running for office, they're saying this president or republicans want to separate families. no, it is about getting the criminals out. kate steinle's guy was deported five times. this other mom who was hit by a drunk driver was deported 15 times. >> right. but it's the stupid mentallization. obviously, immigrants are like any body of people. they include all kinds of characters. but, again, it's the difference between people who get to break the law and people who are micromanaged on the southern border you can watch in, you can kill u.s. government officials, you can run drugs, you can terrorize people. on the northern border, if you're a bagpiper in montreal who wants to play in a bagpipe competition in new hampshire or vermont, the u.s. department of agriculture will sees your bagpipe at the border. so a bagpiper to everyone south of the rio grande, we would have no problems with drugs, terrorism, anything. bagpipes, they can get. brian: it's hard to imagine bagpipes really catching on in central and south america, but that's just me. >> have you never heard of bagpipe mariachi band? brian: i had it on my turntables, but my turntables don't work anymore. i need a new needle. another controversy, the president has brought into the sports world. this is one of the most bizarre people you will ever meet. did a great job raising his three kids. the president did not get a thank you from him, and he tweeted out maybe i should have just left the kids there. so hopped on television to try to explain why he wasn't thanking the president for getting his son out of china after he shop lidded. try to make sense of this. >> how do you know i wasn't involved before i even knew that? he didn't even know he was over there like that. okay? what was the reason for him going over there in the first place? >> what are you trying to say? >> it wasn't like he was in the u.s. to say. okay. there's three kids in china. i need to go over there and get them. that wasn't the thought process. >> all right. right. >> what we're talking about right now is a lot of stuff about my son just because his last name is ball. we're not even talking about the other two kids. i don't have no doubts of what he did. i have doubts of what he didn't do. how about that? i would say thank you if he would have put him on his plane. i would have said thank you, mr. trump for taking my boy out of china and back to the u.s. there's a lot of room on that plane. i would have said thank you for that. brian: the problem was the president wasn't going straight home. >> so why didn't he take three shoplifters on a tour to asia with him? the first thing they tell you when they give you a passport is that you're subject to the law of that jurisdiction. when you're a bagpiper, and they take you to gitmo, then tough. and the idea that this -- these three petty criminals which in china, that can ruin your life. steve: ten years. >> yeah. and the idea that somehow didn't -- should have had -- he should have taken them on air force one and should have been riding up front with -- brian: i actually think it might have been an act, it was so bizarre. >> well, it might be twitter trolling. but the thing is, brian, and i know this kind of gets close to your turf. it comes at a time when professional sports is not held in highest e-mail by th by the american people. these guys who are handsome no longer seem to represent the sporting virtues. and that is a good example of it. steve: you know what? his son, though, did apologize to the president of the united states and thanked him as well. brian: by the way, this guy wedging brown, he had a bar fight in china, he's been in jail for 13 months, he can't even get a day in court. that could have easily happened to these kids. >> no. no. they're serious about that stuff there. you do something you can do in a sanctuary city or whatever, and it doesn't matter. you do it elsewhere on the planet, your life's wrecked. ainsley: isn't this guy really controversial, though? [applause] brian: all right. here's the key campaign promise like that to help president trump win the state of west virginia. ainsley: and now he's following through on those promises denouncing a game-changing deal with china worth 80 billion with a b, $80 billion to create energy products in the state of west virginia. steve: well, west virginia's governor jim justice joins us right now live from charleston. governor, tell us about the project and when you find out about it. >> well, we've been working on it for a good little while. it's been months in the process and everything. but no question whatsoever president trump has kept another one of his campaign promises and that to some way straighten up this terrible trade imbalance, and it just so happens that west virginia bounds the natural resources and natural gas is really important for china for the chemicals standpoint. low and behold, we've got some real wonderful things going on today in west virginia and through our commerce department and through the president and a lot of different channels and everything, we've got some real hope of unbelievable growth within the state of west virginia. brian: so it's $84 billion. it's china energy that's going to do it. are they going to hire west virginiaians to work? >> absolutely. absolutely. you know, they'll be investing dollars here -- and that's what, you know, the president said all long, you know? create a better balance of trade, and they'll be investing dollars here, building structures, building manufacturing, building crackers, and all of the things that tieback to natural gas and to tieback into the petrochemistry and everything. so we're really excited. i could tease and say we were really hoping for 100 billion. but in all honesty, $84 billion within the state of west virginia is more money than any of us can think about and more job opportunity for great west virginiaians. ainsley: is this what you hoped for in west virginia when you left the democratic party and became a republican? ainsley: well, ainsley, listen, in all honestly when i came to the party just like president trump in a lot of different ways, we had a 500 million-dollar hole in the bucket, and nowhere really to turn. we really revamped education, we passed a referendum, a $3 billion bond within our state to do infrastructure projects. and we got a lot of, a lot of interest. a lot of different things going on for people that are coming to west virginia. and now the china deal, which will set us really on fire. but, you know, west virginia's economy grew in the first quarter of the second highest growth of any state. and the bottom line is just this: we've got great people. we've got great seasons, we're within a rock's throw of two-thirds of the population of the country, and we have natural resources just beyond belief. this place has always been the hidden jewel, but we just didn't have the job component to be able to really drive everything here. so this will do it. west virginia is a wonderful place. we want everybody to come. steve: well, there he is making his pitch for other businesses to relocate in west virginia. governor jim justice, thank you so much. ainsley: thanks, governor. steve: coming up on this tuesday, todd is having breakfast with friends in topeka, kansas. what do the voters think about what's going on in washington? stick around.
