Here was the president yesterday around 2 00 in the afternoon. Watch. Over the next 21 days i expect that both democrats and republicans cooperate in good faith. This is an opportunity for all parties to Work Together for the benefit of our whole beautiful, wonderful nation. If we make a fair deal, the American People will be proud of their government for proving that we can put country before party. We can show all americans and people all around the world that both Political Parties are united when it comes to protecting our country and protecting our people. The only outstanding question is whether the democrats want something or nothing. Pete that is the question. They want to talk about Border Security without acknowledging that thats required. Do you have any confidence at all that they will actually come to the table and negotiate . No, i really dont. I think that Speaker Pelosi in the last 24 hours, not just i mean in the last month but even in the last 24 hours has shown her true colors. She has made it very clear she is not willing to negotiate as far as a border wall or physical barrier, whatever you want to call it, what President Trump has promised, she is not willing to negotiate on that. She is gloating. She is spiking the ball. She is more interested in defeating the president , thats what she is focused on, than an our nations security. So, we have seen that. We see her true colors right now. The president has been willing to negotiate. He has been willing to go further than some people may even want him to do who are his supporters, but they understand they are trying to give him the leeway to negotiate. The government has always been corrupt but i think that its really hard to find a noncorrupt government anywhere in the world. And so that was no exception. But they did follow the constitution. We need Additional Technology at the ports and in between the ports. The experts will tell you and they have been telling and they have been telling congress for a long time thats party of the multilayer strategy, infrastructure, technology and personnel and the president yesterday laid all that out. We need to do it all including the wall. The additional thing that i will say that we need to do and the president has been asking for this is for congress to get together do their job they have been elected to do broken asylum call and case precedent like flores to remove the incentive for immigrants to come here and take this perilous trek and risk their lives and get here and overwhelm our system. In fact, across the last six months, he has been getting ready you know, as a matter of fact, that most of these charges, if not all of these charges, have been aired out in the media and as you know, roger aggressively pushed back on all the media stories about these charges so he has got every email, every text, all the metadata chapter and verse to prove this false. If anybody tells you that roger stone was surprised yesterday and didnt expect to have a knock on his door, just notice, roger stone was cleanshaven. So, where are we going to be with these negotiations over the next couple of weeks . Well, Speaker Pelosi said in the famous meeting in the situation room that she would never discuss funding a wall. And now we are in a position where they have indicated that they will talk about that over the course of the next 15 days. She is not going to be for a wall. She is going to be okay with she is going to be okay with a fence or a barrier as you know, katie, these are synonyms and the Border Patrol has said steel slats are better. Here is the final piece thats really important here. Some people say why did we go through all of this if the president is going to use his emergency powers. What lawyers tell me is these case also go to the court and it has to look like you exhausted absolutely every alternative before you use these emergency powers. He did. He said the government will reopen and, of course, last night the house and Senate Passed it. The president signed it. The government is officially open. It was a partial shutdown. That part is now open. Three weeks they now have to find a solution to the border crisis. Democrats say they want to talk about it, but they still want no money for the wall. The president went up to that podium and said we will negotiate. At the end of those three weeks, if we cant get there by february 15th, i have constitutional powers and prongives that i will use. People reading into that thinking that might be a National Emergency. Katie President Trump also receiving some criticism because he reopened the federal government without any funding right now for his wall. So he tweeted to clarify. He said i wish people would read or listen to my words on the border wall. This was in no way a concession. It was taking care of millions of people who were getting badly hurt by the shutdown with the understanding that in 21 days if no deal is done, its off to the races. Dean, it was interesting he mentioned millions of people. He wasnt just mentioning the 800,000 federal workers. Talking about the broader economy. Especially after yesterday, seeing those flights getting delayed and other things happening. Dean smart thing to do if he is going to declare a National Emergency. He will challenge in court. He will say i did everything possible. Which he did. Putting the largest Government Shutdown in history. Pete nancy pelosi did everything she could to not negotiate. Only chip was i wont talk to you. Let you have the state of the union. I will go to hawaii and try to go on a foreign trip until you open the government. In some sense the president has called her bluff. The experts will tell you and they have been telling congress for a long time thats part of the multilayer strategy and the president yesterday laid all that out. We need to do it all including the wall. The reason why i know the president is listening to the experts. I provided the same information that the president is talking to the Previous Administration and it was ignored. Pete easy to instantly react and be frustrated the shutdown was about the wall and wall funding. The more i think about it be careful what you wish for moment for democrats. They will dont have a solution. They said well talk once you reopen the government. So they have lost their leverage there now they have to talk. They say they want Border Security but all the border experts say that includes a physical barrier. They only have three weeks to do it. At which point the president has proven through lawyers and others he has the constitutional prerogative to declare a National Emergency which is a lot more of the emergency than the 58 states of emergency declared since 1976. Katie take a listen to democrats in their own words promising to necessary United States on the border wall if trump reopened the government. Its much harder to achieve a good negotiation while the government is shutdown. We will continue to negotiate. The first order of business open up the government. The president proposed yesterday increasing Border Security. I will use that as a starting point, but you have got to start by opening the government. Open government and then give us a short period of time, three weeks has been suggested. In order to come up with a Homeland Security Border Security plan. We all agree to work in good faith once government is open. We are very firm in our support on how we secure our borders lets have that discussion after we open up government. Dean government is open. Lets have a discussion. Katie what did they have to say yesterday . Dean yesterday they totally said we are going to have a full conversation or is that exactly what they said . Lets take a look. Have i not been clear on a wall . Okay. I have been very clear on the wall our values unify us. Im sure its the same in the senate. And the fact is that our diversity is our strength, differences in so many different ways including differences of opinion. Thats our strength. But our unity is our power. I mean, there have been since 1976, and i think we have a scrolling list of them. 58 states of emergency have been declared. 31 of those emergencies are still in effect. And these are just the National Emergencies declared by the last four president s. Carter had two. Reagan 6. Hw 5. Clinton 17. Bush 13. Obama 12. Trump three so far. And when you look at them. But this is a very radical separation from the catholic communion in the way that he presents this not only as something which is a matter of law but also which actually distances him from one of the basic moral teachings of our church and that is the sanctity of all human life. My hope is that since his faith is important to him, he will consider reconsider the importance of maintaining that communion and not continue to distance himself. One can put themselves in a position whereby morally they cannot receive communion at the altar rail and governor is in that situation right now. When we open the government to actually build barriers along the southern border to protect the American People, and when we heard that, we realized the dam was beginning to break on the democrat side, and we could get something accomplished. Thats why the president decided to open the government and pay those hard working federal employees, 800,000 plus. The governments now open, and now its time to secure the border. Dean hogan, after this all happened yesterday, 17 days, three weeks to make a deal. But minority leader Chuck Schumer says he hopes yesterday, he said he hopes that the president learned his lesson. Listen to this. Working people throughout america empathize with the federal workers and were aghast at a what the president was doing to them. Hopefully now the president has learned his lesson. Katie so, hogan, if this is the attitude of democrats, do we actually expect them to do anything especially since schumer said, look, we agree with a lot of things on Border Security, we do not agree with the wall. The democrats cant just not negotiate. They cant offer anything offer nothing and expect something to get done. Listen, while the government was shut down democrats, talk about tone deaf. Nancy pelosi hauled off and went to hawaii, democrats partied in puerto rico, and then they took fourday weekends. So they werent doing anything on behalf of the American People. They used these federal workers as pawns. Regardless of what they try and say and the tears that stream down their cheeks, they did nothing to protect the American People, and they did nothing to open the government, they did nothing for these 800,000 federal employees. We think we can get something done because weve had newlyelected democrats come to us and say we are not going to stand with the leadership who is completely tone deaf to the needs of safety and security for the American People. We think we can work with them. We had conversations with our highest level of staffers on our side plus newlyelected congressmen and Congress Women who said, listen, we need to come to the table and offer an agreement. Their constituents demand it. And, listen, they have minds of their own. Their not beholden to chuck and nancy like so many others are. Pete critics of the president will say you know who else got nothing . The president. The government reopened, which is what the democrats wanted. Youre giving a lot of good faith to the democrats, which ive yet to see. And i dont know who these unicorn, moderate democrats are, sounds nice, but count me as skeptical. If you get to the end of three weeks and theres no magical deal, is the president declared to prepare a National Emergency or another measure to make sure the wall gets built . All those options remain on the table. The president has taken nothing off the table. And the fact that he made that point yesterday in the rose garden, listen, we are facing a National Emergency, hes prepared to announce that and do everything necessary to protect the American People. So i think thats an important point here. But, listen, we are where we are because with democrats refused to negotiate, as you just said. There arent as many unions as you think out there. Plenty of folks have actually said they want to negotiate, so hopefully that happens. Katie do you see that caucus, the moderate democrat caucus, putting pete unicorn caucus. Katie on nancy pelosi given the lack of any negotiation and coming to the table with any kind of deal over the last 35 days . I sure hope so. And, look, im optimistic. We pointed out over the course of this shutdown that democrats have voted for border fencing in the past, 2006, 2013. But here is the dirty pete correct and true, but it was before President Trump. And you know how much they hate him. And for any democrat to work with him, enable him or legitimize him, frankly, they will be primaried and shouted down by the left wing no, thats correct. Pete is it really not Wishful Thinking that they will now work with him and give him his signature Campaign Promise . But listen, matt schlapp touched on it last hour, i just wanted to clarify. They actually just voted for Border Security yesterday with, because the wall fundings there pete thats a talking point, but its not no, my point is democrats can no longer say, nancy pelosi cannot hide behind the fact that she will never vote for any type of border fencing or Border Security even though shes done it in the past. The fact is the president not only took his message directly to the American People, but a lot of those new democrats elected to the house were feeling that at home, because they ran in trump districts. And it was a close margin of victory for them. And their people, when they went back home, came to them and said, listen, we think Border Security is necessary. We think a wall is necessary. And is so they want to work with us regardless of chuck and nancy. We have seen the levels of tone deafness they have, but the new ones dont. And theyre wideeyed and ready to work with us, and we think we can do that to get something done for the American People. Only 28 said they were in favor. Thats what this is about. Plus, 75 in june told us its unfair that they allow illegals to jump the line on the millions of people waiting to get into this country legally. So Public Opinions on the president s side. Personnel, technology and infrastructure. Infrastructure means a physical barrier. Do you believe democrats should acknowledge that a physical barrier is necessary . I dont think its necessary along pete im going to build it all the way across winding down the river if i could. Use Eminent Domain and seize lands from private citizens . You cant. Pete in order to build the new jersey turnpike, im sure they used plenty of Eminent Domain. You are in favor of seizing land from private citizens . Pete theres plenty of precedent for Eminent Domain to be used for National Security. It doesnt sound very conservative. You have to use eminent doma domain. You have to have walls. I work in two other democracies in israel and hungary. They have security fences. They are absolutely necessary to keep people out that are illegal. Pete why are you shaking your head by the way, you need to go to the border and talk to some of the ranchers on the border in arizona and texas. To them, theres people crossing their properties with guns and some of them get killed. So the fact of the matter is, and the other part is most of them are coming here for jobs. Just because you seek asylum and you say you should come here, jump the line on the millions of legal immigrants waiting here, thats wrong. Thats an open borders policy. If thats what the democrats stand for, thats open borders. At the end of the day, we just reopened the government from a partial Government Shutdown. We are now at the end of that shutdown, where we were at the beginning of the shutdown. The shutdown never should have happened. Katie our next guest says stones indictment follows a concerning pattern in muellers investigation. Pete here to explain, Harvard Law School emeritus professor, the esteemed professor Alan Dershowitz. Professor dershowitz, first of all, why hit roger stone with a heavy duty s. W. A. T. Brigade and cnn cameras, why do it that way . Obviously to put pressure on him, tell him they mean business and to say look, if youre not on our side, we will go after you. We will go after you in every possible way, maybe we will go after your family and friends, thats what prosecutors do. But if you join our team, if you cooperate, if you sing and of course, when people sing, sometimes they compose, then we will be on your side. There was no reason for that arrest yesterday. They should have simply sent his lawyer a notice saying please show up to the federal court. Government admitted he was not a flight risk. They consented to very, very low bail, basically released on his own, and it was just a show, and how cnn learned about the arrest and was there at the time also raises some serious questions. Look, as judge ellis, who presided over the manafort case, said about manafort, mueller isnt interested in going after this guy for his bank fraud. Theyre interested in squeezing him. Theyre interested in getting information from him about the real target and thats donald trump. Thats a very disturbing way of using the criminal justice process. Also, this shows another disturbing trend and that is mueller has hardly indicted anybody for crimes that occurred before he started the investigation. Almost all of these crimes, like this one, occurred during the investigation. They are process crimes. Theyre not crimes of substance. Now, in the indictment, mueller tells an interesting story about wikileaks but he doesnt charge him with anything like that. He cant defend himself against that at trial. At trial, hes only charged with lying and tampering with witnesses and obstruction with justice, all of which occurred after mueller was appointed. So far, mueller has come up relatively empty on crimes that occurred before he was appointed, which was his mandate. Dean so ultimately, what does this tell you about whatever picture muellers trying to put together . Its going to be very circumstantial picture. He will not have, at least on the basis of what we now know, hard evidence of any illegal conspiracy between the Trump Campaign, certainly not involving President Trump himself, and the russians. But there will be a circumstantial case that he will build, this obstruction of justice, this lying to congress, this call, and it will be a very critical report and thats why i think it would be fair to allow the trump team to come up with its own report based on the mueller report, a conflicting report, a rebuttal report, before they release either report. They should release both reports simultaneously so that the American Public can judge for itself. Remember that mueller is conducting a onesided prosecutorial investigation. He isnt looking for exculpatory evidence, hes looking only for evidence of guilt. The defense, on the other hand, looks only for evidence of innocence. Its an adversarial system.
