>> emily: generally speakin speaking. ed: news is going to be fun today as well. a little bit of news, right? >> emily: yeah. pete: should we get to it. >> emily: yeah. pete: she approves. chaos breaking out of the border. massive caravan fighting to make it to the united states. ed: our border patrol already arresting a number of illegal immigrants trying to pour into this country. >> emily: griff general since is live in mcallen, texas, the most heavily area on our border. >> all eyes are on what is on that mexico, texas border. they had a mob reaction of crashing through the gate, rushing that bridge. it's a 500 plus mexican police officers. the officials here are paying very close attention. now, when secretary of state mike pompeo was talking about the tactics being used. women and children as shields, it's because they are worried about that coming to this border here in mcallen, texas, the heaviest as you mentioned trafficked area and the reason why that caravan and others are charging our borders are because of what they perceive as loopholes in the laws here. their ultimate destination is right where i'm standing. yesterday we spoke with a deputy chief here in this sector raúl ortiz. and he talked about the number of family units they are seeing and overall problem. >> we are definitely seeing a lot of family units. we have seen that increase over the last three or four months. certainly this month is the highest numbers of family units that we have experienced in a while. on average about 373 family units every day. and then we see about 75 unaccompanied children every day and so we have seen on average 641 individuals in south texas cross every single day. >> you look at yesterday. we had a tremendous traumatic morning, talking to you, ed. that was only -- the area i was in was only five of the 316 miles of the rio grande valley sector. that's just a tiny snapshot of the nearly 3,000 miles of u.s.-mexico border from california to where i'm standing here in south texas. and so when you look at that problem, 4 or 5,000 migrants charging that bridge down in the mexico, guatemala border and think about what it would bring to the already overwhelming problem here where there 300 percent in just family units alone since this time last year, you are talking about an issue that has to be addressed and addressed quickly. noble is watching the situation down in the mexico, guatemala border more closely than the officials here because they are going to have to have a plan when it comes. we will go out again this morning and take you there and show you just how bad the problem is. ed: griffen losing your voice a little bit. i was here on the couch as you mentioned yesterday. live on the air you were doing stellar reporting as always as we were watching unfold here on "fox & friends." people being apprehended. illegal immigrants trying to cross the border there in mcallen, texas. real quick, do they feel like the border patrol agents mexico seems to be approaching this differently in terms of trying to crack down much sooner in the process before these illegals get to the u.s. border because of the pressure from president trump? >> well, exactly you, that's correct. i would add that in talking to officials off camera, they said, you know, listen, we're going to be very cautiously optimistic, but encouraged by the fact that the mexican federals are getting engages trying to head it off at the pass. their border is more porous than ours is they have less experience cracking down than the way we do here. their borders are looser than ours. they are finally starting to address it they are encouraged by that but whether or not they at ultimately successful, that's another question. one thing is for sure, ed, what you saw down there yesterday will continue to see down there today. it's headed definitely for where i'm standing right now. ed: get back to you quickly for your reporting u. pete: caravan 2.0 -- not 2.0 because there have been many, many caravans. the president came out and said this is not what we want happening at our border. this is the seconds iteration thereof. you might think that maybe this time we are prepared to address it maybe thought. we will see u. ed: the saying he is exaggerating. this look what is happening not just at the u.s. mexico border but on the mexico border. >> emily: border security is actually only a small component of this when it gets to our borders. what's not being covered on this network is the fact that there is diplomacy issues happening. conversations and negotiation with the mexican government. there is a cartel chokehold on these migrants. the humanity aspect of an unsecured border which sheriffs and representatives down on that southern border keep talking about. but the left and unfortunately the left wing media isn't covering that part of the conversation. pete: absolutely right. because they are not covering, our president is. donald trump was in mesa, arizona last night, another border state, talking about the caravan. here's what he had to say. >> right now, as you know, mexico is on their southern border. their southern border. they are fighting. and they are fighting some bad people in this group. you see the people come up and you listen to the fake news back there and you think they are all. [crowd boos. >> you think they are all wonderful people. serious. you think they are all wonderful people. you got some bad people in those groupings. you got some tough people in those groups. and i will tell you what. this country doesn't want them. pete: until you have a wall and definitive policies, you are going to have this confusion. that's what it is confusion. how do you handle it and laws that are ambiguous. so this back and forth continues. ed: emily made a good point a moment ago about the diplomacy that is going on. if these migrants hadn't made it across the mexico southern border and then had made it to the u.s. border and we started processing them. what we understand from diplomats i can negotiations you mentioned, there is a new administration coming into mexico. they basically have agreed with the trump administration that if they turned out to not really be refugees and folks up to no good. and wants to be illegal in this country and are not here as refugees. that they would be sent back to mexico and mexico would accept them. that is new policy. that is different from before. it's because of pressure from president trump. and so you see him making the caravan and illegal immigration front and center in the midterms. he is also talking about the economy and some of the violence we have seen on the left. watch. >> the choice for every american could not be more clear than it is right now. democrats produce mobs. republicans produce jobs. this november, when you are voting, vote for the jobs, not for the mob. democrats wants to throw your borders wide open to deadly drugs and ruthless gangs. we don't want them. democrats have become the party of crime. it will be the election of kavanaugh, the caravan, law and order. tax cuts. pete: jobs not mobs. >> emily: what struck me about that actually when i heard it i thought he said they reduced jobs and republicans -- that's true, too. because of the regulation, right? really what struck me about that is the fact that the g.o.p. really is on message. absolutely on message here. from what we are seeing the democrats on the left are scattered and they are simply attacking what the g.o.p. is standing firm on. really as a central messaging going on which he was on point there at that rally. he was sticking to that message the entire time u. pete: good point. co-harnght message coming out of the republicans right now. from the left you are getting we're not them or we are angry about them. except jobs are booming, the economy is coming back. and, ed, it caught our eye. there is a new ad out from the republican national committee talking about -- well, frankly it's turned into violence against republicans. watch this ad. >> if there is some collateral damage for some others that don't share our view, well, so be it. >> a scary moment for senator susan collins and her family as a suspicious level believed to contain illegal substance was delivered to her home. >> adam lax salt. a man is accusing of grabbing her manage sorry hard it left bruises on his body. >> this after three weeks ago someone in the family set fire to it. >> colorado republican senator cory gardner somebody sent his wife a video of a bee heading. >> if there is some collateral damage, so be it. ed: i would argue that the democrats have a con sis tenths message as well. is that they are not really denouncing the violence. look, if you are in our way, have you got get out of the way, we saw this super charged when cory gardner's wife got that horrible message about a bee heading: on within sean hannity and basically calling the democrats out. >> they, on one hand want to deny what they have created. i think don't believe your lying eyes, right? we have seen what this is. we are past the days of the 70's and 80's where we are relying on one network to tell us what's happening. we have other options. we have fox news. we have the internet. we have our own neighborhoods. we can see that this is a mob. that word is chosen for a reason. it's not a talking points. it's a fact. and this is now what is separating the dynamic here. on one hand they wants to deny it on the other hand, they wants to excuse it and normalize it. pete: this whole idea of collateral damage is so indicative of the left. if you see the people as a collective, as a group, then a little collateral damage here no problem. if you see people as individuals then no collateral damage. pete. ed: is that the message from the left. >> i'm not hearing anything. ed: all right. congresswoman. i'm going to go through the polls while they try to deal with your audio right there. okay. you know what? i think we are going to try to -- okay. we are going to go right now to another report. there is obviously some breaking news out of saudi arabia. we will get back to the congresswoman. saudi arabia now saying that the missing "the washington post" columnist, jamal khashoggi died during a fight at saudi consulate at istanbul. everyone knew that already they confirmed it. 18 people under arrest. lawmakers in both parties are skeptical. gillian turner is live in washington with the president's response. good morning to you. >> good morning, ed. secretary of state pompeo returned to washington from saudi arabia late last night with no comment on the sawedy's latest explanation which is that jamal khashoggi got killed in impromptu brawl inside the turkish consulate. referred all journalists to the white house which put out a statement that reads in part quote we will continue to closely follow the international investigations into this tragic incident and advocate for justice that is timely, transparent and in accordance with all due process. now, lawmakers have roundly criticized the administration over the past 18 days since khashoggi was killed. the chairman of the senate foreign relations committee reacting with a statement of his own last night saying the stories the saudis have told about jamal khashoggi's disappearance continues to change with each passing day. so we should not assume their latest story holds water. they can undergo their own investigation but the u.s. administration must make its own independent credible determination of responsibility for khashoggi's murder. president trump though striking a different tone i think it's a good first step. a big step. a lookout of people involved. i think it's a great first step. saudi arabia has been a great ally but what happened is unacceptable. >> turkish authorities were initially denied access to the saudi consulate in istanbul for two weeks among reports of multiple cleaning crews traveling in and out of building, ed. ed: gill i can't believe turner appreciate your report. obviously we will get back to congresswoman comstock: what needs to happen now as they continue to inch closer to the u.s.? pete: thanks, ed. violent clashes erupting yesterday as a caravan of u.s. bound migrants attempted to cross from guatemala. this just coming just days after president trump warned of severe consequences of the mexican government fails to caravan before it hits the u.s. border. here to discuss president of the national border patrol counsel brandon judd antoine seawright and angel mom agnes who son was killed by illegal immigrant. brandon, i will start with you. give us out brass tacks where we are at right now. we saw this last year and we are back again with this caravan headed north. what are the options here? how do you see this playing out? >> the first thing we have to look at is having to look at the violence shall. these are asylum seekers, when they don't get what they want they create violence and havoc. what is going to do is going to let all of the voters in the united states know that this is what we face with illegal immigration. illegal immigration is a key issue in most of the states where the midterms are taking place u such as texas. and so when you look at this, we have to be prepared. but you have to look and say what president trump is doing is a good job. he broke up the first caravan. and now he is doing a good job putting requisite pressure on the mexican government tone sure we don't see the same things we saw last time. pete: agnes, when you see images like we are of this caravan. talk about immigration. whole another thing to talk about illegal immigration. a lot of these folks attempting to get asylum, claim to be refugees, but, agnes, what do you as someone who lost a son to an illegal, how does this make you feel? >> it makes me feel very angry. we need to shut our borders down. don't let any of them. in we don't know who they're. they are not vet you had. how many criminals are amongst them? we need to focus on the millions that are already here costing taxpayers millions and millions of dollars a year in housing and education. medical and everything else that they get. we need to focus on those illegals that are here in prison, draining our resources. and enough is enough. i think it's about time that mexico, honduras and guatemala take responsibility and step up to the plate and stop being so complicit. pete: antjuan, she used the word complicit. how does the left jawnsd to this? it looks lawless and we have borders and a country, yet it doesn't look like there is a process to be followed here antjuan. >> i don't want to make this a left versus a right issue. pete: it is though. >> it's not a left versus right issue. immigration is bipartisan issue that should be addressed in bipartisan way. this is unfortunately a familiar chapter we have -- we will continue to read called a broken immigration system in the united states of america. this is also yellow light time for the president, republicans and democrats to come to the table and address this issue in bipartisan way. we are going to continue to see this happen. now, i also want to note that most of these people who are trying to get into the united states. they are not all criminals. they are not all thugs. they are trying to get away because. pete: what if you are wrong 10% of the time or 20% of a time. >> country so terrible and come into the united states because they are seeking work and want a better quality of life. that also needs to keep in mind. we have a system in place. i think they need to do it the right way. pete: antjuan is talking about broken system. does this system not start with a wall? >> well, you will the wall, again, when they put that up there it allows to us vet these people properly. it allows to us give us the security that we want. when we look at the broken system. we can agree it's a broken system but whether you have violence and have people that that aren't following the law of mexico, why could wod they come to the united states and follow our laws. >> i'm not saying they won't. we will continue to see this problem if democrats and republicans in this country don't do what 70% of the americans want that's comprehensive immigration reform. tremendous opportunity to do that failure of leadership on their. pete: agoness, you heaagnes, yor comprehensive immigration reform. >> not a wall. >> that's not what antjuan is saying. pete: agnes, what do you hear when you hear comprehensive immigration reform. >> first of all we do have immigration laws. they need to be enforced. president trump has tried for over a year and a half trying to bring the two parties together the democrats are refusing to work with president trump on their. >> that's not true. >> they wants president trump to fail at whatever cost and this is not fair. it's not fair to put this burden on us citizens and to violate our rights. we come first. we don't owe these illegals and disrespectful people trying to evade our country. we have a law. we have process. everybody needs to follow. and i'm sorry things are so bad in their country. why don't they make their country better instead of coming to our country and making -- turning our country into the problem that their country is. that they are running from. enough is enough. pete: agnes, leave it right there. also plenty of places to seek asylum in mexico as well if you are fleeing your own country. >> that's right. pete: thank you for your time. appreciate it fired fbi director james comey donating to the democratic opponent of our next guest. we will get it right this time. virginia congresswoman barbarbarbara comstock. did you know emily loves muscle cars? >> i know that got the headlines this week and he lives in virginia so i guess he decided to get political. the bigger thing that did not get the hea headline over the past 48 hours democrats have now sunk over 3.5 million into this race and those poll numbers you showed are not accurate. i know, we have been in the field. we are, you know, narrowly ahead. i have always overperformed our polls. overperformed in these races. and we are out fighting hard. bloomberg has brought in half of this money, almost $2 million that he is putting in this race. so you have a billionaire who is helping my opponent to raise taxes on the middle class. she wants to get rid of the child tax credit of $2,000. 40% increase on business taxes. and we're out there talking to people every day. ed: we wanted to talk about comey and there is a bigger issue, this blue wave we have heard so much about. in your race. >> it's a green wave. >> we will see whether it's six points down or 2 points up. this is a close race. >> it is. ed: democrats believed they had this one in the bag and they were going to take you out. instead, it tells me if they are spending 3 million or more in the final hours, they are a little nervous that they are not necessarily going to beat you and maybe some of these races are going to stay red. >> sure. well, let me tell you, two years ago right now, of course, everybody thought it was going to be hillary clinton and tim kaine. and they were saying i was going to lose by five points and i won by six. we focused on the priorities of the district u which was having lower taxes which we have passed. that's why i have been endorsed by the businesses. i have also protected my federal employees and gotten them pay raises. i have been endorsed by the police who my opponent wouldn't even meet with because i have passed public safety legislation. we are out talking to voters on the bread and butter issues and i think you are seeing this around the country where they don't want resistance. they want results. ed: a lot of those federal employees you mentioned i live near your district not in it. lefts, government employees that don't like the president. 15 seconds. how do you navigate the fact that the republican president is not popular in your district? >> honestly, listen, the federal only employees decades, and, you know, i have national security folks. fbi, the cia is in my district. we have a lot of support there. i have been endorsed, supported by the employees pack because i fight for my federal employees. we focus on the priorities of the district that's why they are coming in. ed: appreciate it. >> barbara comstock for congress.com. ed: we knew this was going to be a bellwether. it might be closer than anyone thought, congresswoman. thanks for coming. >> in thank you. ed: polls may be showing democrats with a lead heading into the midterms. remember, polsters got it all wrong in 2016. the next guest weighs in on the polls. can we believe them? >> well, when you start digging into the background of candidates like andrew gillum, a lot of his experience comes from going to instiewtsd like the ruth ledge institute in california where they gain radical ideas and come back to the local communities and start building up the ground base support. and try to get into lower income communities and spread the lies and hate and create dissension between law enforcement. they start it between the political parties as well. almost like a big game for them. they don't realize that these are real lives that are on the line. pete: apparently jeff, the gillum campaign has a different approach. we asked for a statement and they gave us one. the mayor has been a strong ally of law enforcement in tallahassee, investing in additional officers to help reduce crime across the city as mayor gillum has previously said, he will invest in community policing, smart justice, and strategies that work with communities to reduce crime. emily: which is rich because now we are hearing that the tallahassee, the town that he is the mayor of, has the highest crime rate in the state of florida. and in that county. so how is that reconciled with the public and from where you are, boots on the ground, what are you hearing that the public cares about and how they reconcile that difference of what he says and what he is clearly doing in that town? on the kavanaugh issue there is an assumption in the mainstream media that kavanaugh was antiwoman because of allegations that were unproven. i have heard a lot of women interviewed by us and other networks saying wait a second, i backed justice kavanaugh and i think he was treated unfairly. >> right. well, i was one that dig d. back justice kavanaugh as a conservative woman. absolutely women are going to make a difference in this election. pew research center came out with has stated that women made up 55% of the electric tore rat in 2016. and at this point, i believe it's democrats are actually counting on us to vote. they want to flip congress. we actually do have an unprecedented amount of women that are running for congress. i believe there is 256. and out of that out of that number 197 are democratic women. it's clear that the democratic party has made this parted of their platform to run the women. ed: energy among women. >> they may. conservative women i think it's false. narrative feminism false narrative. ed: let dr. king jump. >> in really quickly, 49% of people did not vote in the 2016 elections. that translates into roughly 100 million people. this is correct. 55% of those were women. those people are going to vote this time. simple things like the violence against women act has not been passed. it's not been funded. it's not been ratified. pete: already on the books. >> it's on the books. and extended until december 7th. it could expire. it's not been ratified or funded. other things like healthcare extension obamacare being taken away from women. >> it has failed. ed: how was obamacare taken away from women. >> right now they are saying they are going to defund it. >> and it was failure. >> that's a talking point. and then beyond that in terms of women themselves, i was against brett kavanaugh being confirmed as a democrat and as a liberal woman. and i looked at dr. ford and i did believe her testimony. >> we don't need to reiterate that. >> just his countenance alone. just him slamming his fist. if that was me up there before the senate slamming my fist and crying. ed: want to reiterate. >> litigate that what we need to be asking ourselves, not just as women but as a nation, what are the policies of the nancy pelosi? ed: good morning, griff. griff: good morning, guys. we are actually in mission, texas right now neighboring mcallen area. actively working a group of illegals that came across the southern border two b. two miles to my south. they are in a new subdivision here. you see behind me houses being built and this is an area which just a few years ago was open field in a ripe, hot spot for illegals coming over. as we were here with the border patrol, searching for the illegal group right here, we came across a couple marvin and belinda, who are coming for an early morning walk to check on their home. this is your home behind you. wade, let you know, we are working a group of illegals. does it concern you with the border patrol and you are building a house so close to the border. >> no we see this as common. we have been down here for a year building a house. we do get illegals coming through here once or twice every two months. the border patrol presence here is very active. we always see on the way to town we always pass two or three border patrol trucks, highway patrol, mission police, so it's always -- and it's a safe area to be. in the border patrol's horse barn is located about a mile south of here. so their agents are there. so we are very -- feel perfectly safe. it's like living next door to a police department. you don't worry about living next door to a police station. griff: they have given you their direct dial. >> we have them on speed dial. we have two or three of their numbers. their main switch biewrd. we have the sergeant's desk up. they always answer, pick up and they respond usually within 1 to 2 minutes because there is always a vehicle very close by. griff: that's great. be linda, let me ask you, have you seen the news. when you see this caravan of my grants down on the mexico, guatemala border just bull rushing the bridges, does that concern you? >> not really. i do think there are forces in place and they would allow them to do their job, perfectly fine. griff: marvin, just lastly, we, yesterday, dealt with all of the activity in this area. this is just one small a we are seeing a real overwhelming spike in the numbers coming. are you concerned that the politicians in washington really need to get their act together, whether democrat or republican so that you don't have these numbers continuing to rise? >> yes. they do need to, you know, do something with that. the immigration policies and that and they need to support the border patrol. they are kind of like other things that get their hands tied and they can't do their job. they want them to secure the border. but they take all their -- the tools away from doing it. it's like building a house. cearpghts don't have saws and tools and wood, they can't do it. griff: all right. marvin and belinda, thank you very much. they were going for a morning walk. walked into a morning live shot. just a snapshot of what people on the border are dealing with guys. pete: well done, sir. appreciate it. ed: interesting. and he is talking on the pressure on the border patrol agents at the u.s. mexico border. the caravan we have been talking about coming largely from honduras. you see the pictures there. there was quite a clash not at the u.s. border but at the guatemala mall alan mexican border. mexico's southern border. and what i think is interesting is in contrast to months and months ago when we saw another large caravan, thousands of folks trying to get here to america, mexico was sort of on the sidelines last time. now they are taking that fight head on. they prevented most of those migrants from coming across the guatemala-mexico border. there is a smaller group. not thousands but dozens or. so they broke through and heading towards america. inching toward here. my broader points is you are not seeing thousands heading towards america anymore because of pressure from president trump who in contrast to what we saw in the previous administration saying no, no, no. we are not going to have this. if they get all the way to the u.s. border push them back. worked out a deal so they would take non-refugees back. anybody who was illegal immigrant did not have a clear refugee status. they were going to go back to mexico anyway. so this pressure from the president is having an impact. emily: that's such a great point. in reality, the border security of our southern border is a small component of the larger issue which is all of those things you just touched on. it's diplomacy and cartels and push factors driving multiple countries worth of migrants north essentially. it's harder, i think, to qualify and quantify when we stick to that border when there are so many other issues. humanitarian included that those on the border are facing. i thought that interview was really striking because those guy are at the border. their view is so clear. if you are trying to build a house without tools. pete: every day. forgotten men and women. there is two that was heard here today. the reason we are talking about this is because president trump has made it an issue from day one. he said, hey, some might be coming here for the right reasons, there is probably some bad hombres in the mix, too. listen to what he said in mesa, arizona last night at a rally. >> right now as you know, mexico is on their southern border. their southern burden. and they are fighting and they are fighting some bad people in that group. you know, you see the people come up and you listen to the fake news back there and you think they are all. [crowd boos. >> you think they are all wonderful people. right? no, no. you think -- i'm serious. you think they are all wonderful people. you got some bad people in those groups. you got some tough people in those groupings. i will tell you what. this country doesn't want them. pete: see some signs in the back crazy voters kyrsten sinema of course talked about her own voters calling them crazy. never a good idea. the president barn storming the country. going to arizona. key senate race there saying it's clear. do you want borders or do you want what's happening right now in the caravan and i think voters will have a chance to speak in about 17 day, 18 days? emily: such a cohesive message the fact that he is saying jobs not mobs, instead of becoming hysterical and reacting to everything. scattered shooting at the wall. on our side, the g.o.p. side we have a cohesive message we are sticking. to say policy, substance, not something that i think resonates as well. ed: he as a republican believe that and we as a journalist cover this and looking at this and trying to see who has the you were hand in these upcoming midterm elections. the narrative for a long time in the mainstream media had been look, there is going to be a blue wave. they were buying into what the democrats were selling. now, with the president out there as pete said day after day, hitting all of these battle ground states. is he pushing back and has a clear message which is about the strong economy compared to the violence on the left. watch. >> the choice for every american could not be more clear than it is right now. democrats produce mobs. republicans produce jobs. so this november, when you are voting, vote for the jobs not for the mobs. democrats want to throw your borders wide open to deadly drugs and ruthless gangs. we don't want them. democrats have become the party of crime it will be the election of kavanaugh, the caravan, law and order. tax cuts. pete: there is your terms for 2018. we had a polster on earlier ed goas. he does republican polling. he says 2016 looks a lot like 2018 because they still haven't figured out the trump factor. listen to what he had to say. >> generic ballots that they keep putting up there and talking about, they are talking about the national generic ballot. that can differ from district to district, first of all. second, there is about 60 to 70 congressional districts in the country that are minority districts that have an 80 point advantage for democrats. in terms of the vote. and that's being factored in there. you almost have to take them out and look district by district by district. pete: serious question. have they really thought corrected for what they got wrong? ed: i think what he is trying to say polls were right in 2016 on the national trending line in terms of the popular vote for hillary clinton, but they were not looking state by state. pete: state by state were also wrong. ed: some of them were. but he was saying they didn't catch the intensity the polls stopped and in the last few days donald trump got intensity in 2016 in wisconsin and pennsylvania. broader point why it is relevant now, emily, is this idea that heading into the midterms, coming out of kavanaugh and all these rallies where the president is whipping up his base is the intensity not being caught by the polsters just quite yet and maybe the blue wave is a more nuanced. is it a red wave as the president was claiming or more just kind of a red fire wall that holds the house barely and maybe republicans pick up a few seats in the senate. that's the way it's trending in some states. emily: exactly. 17 days ahead of us those polling didn't capture and sustain that wave. they didn't keep polling. the crucial time is ahead of us rather than what we have seen in the past. pete: as i learn every day on this show, averages are good until the last minute. real clear politics average. if you average for months. only poll that matters is election day. ed: who is going to show up. pete: the kavanaugh effect i don't think it's been properly accounted for yet. ed: going to rallies and whipping up his base. and the intensity may be there. emily: turning now to headlines. a man is under arrest accused of threatening to murder a senator for supporting justice brett kavanaugh. investigators say ronald from new york left disturbing voice mails for republicans chuck grassley and susan collins in an attempt to get them to pull their support ahead of the supreme court confirmation vote. former trump campaign manager paul manafort shows up in a wheelchair. lawyers say he has significant health issues stemming from confinement at virginia jail. a federal judge telling manafort he will be sentencesentenced in february fr fraud convictions. he also dropped 10 charges after a jury couldn't reach a verdict. those are your headlines. ed: a lot more coming up in the show former independent counsel ken starr is live and next. pete: if you just fol woke up, y to tell you did not win the mega millions jackpot. no one d the new general jantsd. jackpot. is skyrocketing. steve: close to new level. p3 snacks. the more interesting way to get your protein. should happen everydred five hundred years, right? ed: here to weigh in someone familiar with this type of investigation. the former independent counsel and author of contempt, a memoir of the clinton investigation, judge kenneth starr. good to see you, sir. >> good morning, ed, good morning, emily. ed: good to see you. what do you make of this political report. there are sort of different rules with mueller where really doesn't have to report to the american people, quote, unquote. as you did with the starr report. instead, he has to report back to rod rosen stein. >> exactly. ed: we don't know where those findings will go. >> exactly. regulations under which bob mueller was reported at are pretty unclear. report the reason for prosecution. you had the paul manafort story on. why did you go after paul manafort and prosecutions were declind. so it can be more in the nature of an executive summary. we don't know it doesn't have to be that highly detailed full some report that i talk about in the book to say to the american people and related to the people's house the howmps. why you need to have all this information, the regulations don't point in that direction. emily: moving forward, how do you balance and reconcile that need for transparency that the public deserves? do you see a shift moving forward where the public can expect to have full disclosure and these things that up until now there has been a level of ow opacity. >> there is going to be a huge tradeoff. prosecutors don't go filing reports. this is an unusual situation. special counsel regulations do contemplate the existence of a report. but, this is a huge justice department policy. that concerns the dignity, the reputation of individuals. if you come under investigation, which you are not charged, then, you should not have your name sullied, right? that's one of the reasons we have grand jury secrecy and so forth. so i know there is a great interest in transparency, but you know what? that's really not the function of the justice department. that's the function of the press and of congress. ed: judge, we have less than a minute. there is sort of a pause as you know tradition before the midterm election where we're unlikely to see any indictments or anything from bob mueller there has been speculation that there be new indictments after the mid terms pretty quickly. on the other hand, others saying this looks like it's winding down and people leaving the special counsel's office. last 45 seconds we have, where do you think we are with this investigation coming to a close? >> look, i know what happened. the eyewitnesses were there and wrote statements for the police know what happened. it was very traumatic experience. still shaken up today. anything else really with that, i mean, i will talk with my attorneys. they will advise me how to proceed and move forward and really was a traumatic experience. i have never experienced anything like that will my entire time in politics or doing this. even today, a few days later still shaken up about it. ed: the photos we have been showing on the screen are pretty nasty in terms of the bruising you faced and can you quickly summarize sort of what happened to lead to that? >> sure. sure. we were at a campaign event. the event had ended. we were speaking privately and this individual burst into the room, very aggressive and evading personal space with a camera in our faces, chased us down the hallway. we went into a private room. we had shut the door. the individual burst the door open. my leg was caught between the door. my arm was contorted behind my back. i kept trying to pull away and getting tighter and pulling me closer, hence the bruises. and, you know, i kept screaming let me go. help me. someone help me make this stop. frightening when the individual yelled to a candidate only can you make this stop which made me believe that i was going to keep getting hurt until it stopped. the whole thing was just absolutely uncalled for. we don't need this in society let alone in our system. and it was very, very disturbing and very uncomfortable. and, you know, shaken up. there was absolutely no need for it. it's kind of a bigger danger for anyone really in this business if that's the direction that people are going to go. emily: kristin, briefly, what do you want to hear from the democratic side, from democratic campaign in response to this to stop the rhetoric and stop the violence that we're seeing now against g.o.p. campaigners? >> yeah, it's absolutely absurd. whether you have former attorney general eric holder saying kick them when they are down and hillary clinton saying not to be civil to either side. it's not surprising that people are encouraged to act like this. to have this type of behavior opponents. i mean, you know, i think we can all agree everyone fighting for our candidate. it's upsetting. here in nevada. running a good campaign. good team. terrific candidate going to bring the state forward and the other side. the opponent doesn't have a record to run on. and focusing on intimidation. it's really, we need to get back to the issues and we need to focus on the campaign. today in nevada, people start voting, so right now, even though we are shaken up and very disturbing. we are focused on and moving forward. pete: whole other context we were told we should believe all women. the question here will they believe you? >> i'm outraged i think americans need to wake up and americans do not owe illegal aliens anything but we owe americans everything. this insanity needs to stop. how about protecting this country and how about protecting american jobs. we need to implement everify and stop giving any benefits to illegal aliens to give them any incentive to come to this country and stop the nonsense of giving them everything low housing income, free education, free everything. we need to focus on americans. we have enough poverty for millions of children that live in poverty. the veterans, elderly. we have a lot to fix in our own country we don't owe illegal aliens anything. pete: making a very important point. it's illegals receiving benefits and held up oftentimes higher than u.s. citizens. how do you react to that? >> i fundamentally disagree. look, what i said to you before, we have to do a better job in this country, democrats and republicans, of addressing this issue from a holistic point of view of comprehensive immigration reform. look, graham and durbin and a few other democrats, republicans came to the table with a bipartisan proposal that the president rejected. history has taught us that and i'm old enough to remember. what i think the president said a few days ago on friday was actually wrong. not everyone coming to the united states is a criminal or a thug. a lot of those people are just trying to come to the united states for a better quality of life. and that's what -- that's what is beautiful about america. we are the home of the free and land of the free. pete: home of the free but we also want to know who is coming to this free land. brandon, hold on, your response to this idea, conjuring up the gang of eight, comprehensive immigration reform, that's what's been said forever. what approach do we need now? >> i am close to the border and you see behind me a group, family units, this is what they talked about, 300% increase from this time last year in this area. on this side this group is 23, all specifically from guatemala. the side of the group, 7 unaccompanied children who left guatemala 15 to 20 days ago and traveled with the group and the agents tell me they are concerned about what they encountered. the other half of the group has been processed, loaded in a white van to be taken to detention or a processing center but holding centers where they would be, where they are put before are full here and they will be given summons and they have to come to a court appearance regarding their asylum request and they will be released to the public and this is the catch and release in action, the loophole the president and so many others in washington talked about needs to be fixed. they are not detention centers, they are holding facilities. if you broke the law, you have a criminal past and will be sent to a detention center and deported. if it is asylum as most of these agents tell me are doing at this moment, they are sent to holding center facilities for families to be held, their overflowing because of the surge, 5400 in the last two weeks of family units in this one station and given a few months court appearance but they will get loose into the fabric of the us. who knows where they will be this time tomorrow but if you look up this road, it is up a mile. they have been coming in droves for months and months as this problem exacerbates. the group tells me there are ten more crossing the border, agents are waiting for them to come down but this is going to play out all day long, we saw this yesterday as well and these people are going to be caught and released and that is part of the problem. >> stay with us, we may come back to you. we will bring in geraldo rivera, talking about a surge on the border and the caravan, 4000 honduran migrants on the southern border of mexico or near there. doesn't feel like a solution. the problem is getting bigger in our immigration policy while the president is focused on it still very confused. >> everything you said is true. pete is doing a good job on the border. people watching the segment should remember words like pity and compassion. the pictures of the folks we saw in griff's report, moms clutching their toddlers, these are not people who represent the next essential threat to the united states. we are the richest country on earth. we live next to some of the poorest countries and the most violent countries on it, honduras where many people in the caravan are from, guatemala, nicaragua, el salvador. >> look at these kids, these are not all women clutching babies. we have to be -- that in, walls, things like that, people are concerned about their safety, not just pity. >> i can tell you and ms 13 member is if you give me 30 seconds with them. they are very obvious. they have tattoos all over the place, you can tell the difference between a gangbanger murderer and someone desperate to feed their children. we just have to remember who we are as americans. compassion has to have something to say about this. looking at this time of on the border that is the mexico guatemala border because of the president's direct intervention and personal negotiation stepped up to the plate and they are doing their job keeping these -- this caravan from entering mexico where presumably they would make their thousand mile trek to our border. that is what we need, cooperation with local governments to alleviate some of this misery. what can we do? if we improve the plight of these people in their native land they wouldn't have the same incentive to make this perilous, emotional trek all the way across central america and mexico to our southern border. what i am suggesting is i understand most of the people watching disagree with my softer approach to illegal immigration, but i urge people to have a balanced approach. we want people to follow the rules. i mean even in favor of the wall, let's make people feel more secure. give the dreamers their green card for citizenship, build the wall, but have some sensibility that these our neighbors to the south, in desperate plight and if you are a mom or dad and have a child you want the best for your kids, they want the american dream. >> other things than the american dream as well. you are on the border. there are families but there are also unaccompanied minors, young men, young women. what is your sense of what is motivating folks to cross the border. are they all seeking asylum? what is the explanation? >> they are being driven by conditions in their countries, just a touch on geraldo's point, one of the children behind me is a very small 8-year-old girl from guatemala and she traveled by herself, 7 to 23 unaccompanied children and i asked her in spanish if she was afraid of the journey and she said she wasn't afraid at all. she has been traveling for 20 days at least by herself in this group with handlers that she doesn't know. but treacherous conditions from guatemala and they tell me these children are hardened by the conditions they live in so there is compassion. yesterday a moment of tremendous compassion, i posted it on my social media site, deputy chief terigo 2-year-old child on this very road, it speaks to this humanitarian is him, the compassion of the border patrol in a difficult decision therein having to force these laws because many of them were migrants or come from immigration families and understand how hard this is with these families but at the bottom they have to enforce laws in these groups and there are gang members, there's an element, a risk to this nation as well as many of them are breaking the law, all of them actually and entering the united states and they have to be dealt with under the current laws we have. >> in the national conversation as you discussed compromise and dreamers versus the wall, is the national conversation on the hill with their elected officials including this kind of push factor griff mentioned, the reality of the southern border at our border and the mexican southern border, the complexities even part of the conversation, compromise is reached towards? >> be in veneto to the program, delightful to have you, welcome aboard. i think the two parties particularly the democrats, have decided in their own machiavellian way that it is better to have this issue open, to have this issue with tumult and chaos and confusion and partisanship and fear mongering and the rest of it rather than working with the republicans to solve the problem. donald trump won the majority of electoral votes in states the count, he's the president of the united states and he ran largely on the platform that this wall gets built. i didn't like the wall, i still don't like the wall but elections have consequences, build the wall. if you build the wall it will have the effect of giving some order to this chaos and limit the crossing points to places where they can be regulated and normalized, where asylum can be sought and eliminate some of the stuff that is going on but give a compromise to those who have been in the united states for many years, give them a pass to normalization, get them out of the shadows but you need a balanced approach. two sides fighting, fighting, exacerbating tensions rather than trying to alleviate. >> as you speak about both parties want immigration as a political issue to keep it on the table rather than solve it reminds me of what you are saying about the brett kavanaugh battle, you can say it was about this or that but it was about keeping abortion is an issue on the table. >> that is right, but i will say this. i talked with sean hannity about it. we don't agree today is saturday but we love each other. my point about going forward, let's go forward together, let's be practical about it. let's be on the same page hopefully. let's be compassionate. >> there's nothing compassionate about lawlessness. if you don't have laws you can't be compassionate. >> of a 2-year-old is hungry -- >> sending 8-year-old by themselves to america, nothing compassionate about sending an 8-year-old by themselves to the border either. >> what must a parent feel to allow their 8-year-old -- >> democrats want to turn hours into one. >> less loving of their children than we are -- >> socialist -- >> into one. >> password from geraldo. >> these are our neighbors. >> i don't walk over my neighbor's fence and they are doing to be in your yard. >> if their 8-year-old is hungry, yes you do. >> back to your corner. gentlemen?
