following the trump campaign. first we go to mike emanuel he has the latest details from the fallout in the clinton campaign. what are you hearing? >> brief letter from fbi director james comey to relevant congressional committee chairman really set off a political earthquake at a critical stage in this presidential campaign. hillary clinton and her team were on their way to iowa yesterday when the news broke. federal law enforcement officials say they discovered emails deemed to be pertinent thought close investigation into hillary clinton's private email server. that less than two weeks before elections day left clinton and her team scrambling. last night clinton called on the fbi director to explain what caused him to take these investigative steps. >> the director himself has said he doesn't know whether the emails referenced in his letter are significant or not. i'm confident, whatever they are, will not change the conclusion reached in july. therefore, it's imperative that the bureau explain this issue and question whatever it is without any delay. >> director comey sent a letter to fbi employees writing, quote: we don't ordinarily tell congress about ongoing investigations but here i feel an obligation to do so given that i testified repeatedly in recent months that our investigation was completed. would be misleading to the american people were we not to supplement the record. fox has confirmed the emails were discovered in a probe of disgraced new york congressman anthony weiner, former new york congressman anthony weiner's alleged sexting of underaged girl. weiner is the estranged husband of clinton wants top aide huma abedin. fox has reported it is a significant number of emails and that this investigation will not be complete by election day. abby? >> separate investigation they were log into him obviously texting underaged girls. saga goes beyond. >> 15-year-old girls. >> multiple devices, too. they seized these laptops. the cell phone. so four different devices with tens of thousands of potential emails in this unrelated case from the fbi log into this. it's interesting though that she is calling for releasing of all of this information. she is saying, look, get it out there. i want to see all of the investigation related to my email. >> when you think transparency you think of hillary clinton and her campaign for president. get it all out there. >> that's what's weird about it. doing press conferences. we haven't seen this before. which is a very clear sign they are nervous about it as long as this is a headline and talking about the justice department, the fbi, and her emails this is bad news for hillary clinton and her campaign, she knows that. >> trey gowdy of course, is maybe the house judiciary committee and is he a republican and partisan and also a pretty thoughtful guy. he has a way of summing things up pretty crisply. here is his summation of what we saw yesterday, watch. >> this the same person who said i neither sent or received classified information. same person who said i turned over all my work-related emails. i only had one device. my lawyers went through everything. that's the same person that now wants all of this public disclosure, the same person who went to great lengths to make sure that these emails were private. now all of a sudden wants it all made public. it's just too rich. it's easy to ask people you know cannot disclose things to do so. that makes her look transparent. but if it's a day that ends in why you can be assured she has talked to huma be a don't and cheryl mills and knows exactly what's on those computers. >> that's the question has she talked to huma abedin and she was asked that directly yesterday and she refused to answer. >> now they are suggesting that maybe huma is going to have to resign. she has been her closest aide for years and years. this as we are talking about 10 days before this election. of the timing of it you cannot make up. in politics the timing is everything, clayton. >> comey was being praised by democrats. look, we are done here. this is all over with now. if you read john podesta's statement yesterday. campaign chair john podesta campaign chair at the center of all of this. he came out with a blistering statement saying it's extraordinary we would see something like this 11 days out from the presidential election. slamming james comey. >> the irony you have been hearing from democrats and a lot of republicans in washington character matters. it comes down to character. what happens if anthony weiner wins up in inner circle turns out character matters. section ago 15-year-old girl. >> wind up on the front page of the paper this morning with anthony weiner on the front page of the. >> and hillary clinton next to him. >> you wouldn't want to be anywhere near that after this all came out. love affair with james comby. now they are taking that back this is all political. here is what dianne feinstein. director comey's announcement played right into the political campaign of donald trump. the fbi has a history of extreme caution near election day so as not influence the results. today's break from that tradition is appalling. and you have to wonder, james comey making this decision to come out yesterday, just 10 days before this election. this was a tough decision for him to make. he knows if he came out with this two weeks, a month after the election had already been decided he would have been in a very, very tough situation. >> also, we're not going to get to know what's in these emails until after the election anyway. millions of people have already voted. tens of millions of people have already voted. their ballots have already been cast. it's an interesting question. would you change your vote if you knew that this information was out there? >> you know, i don't know how many vote this brings to the trump side of the equation, i do know there are a lot of people, i think most people are asking do i really want to vote for someone who is under fbi investigation? maybe you can say the fbi is totally crooked and in the pocket of the republicans. maybe you could indeed say that the system is rigged, which is what democrats are saying. talking about a role reversal. >> that's all donald trump has been talking about this entire election it's runs a gamed system. >> he jumped right out on this yesterday on the campaign trail. that's where we are headed now. the republican nominee is praising the fbi for its decision to reopen this case. >> that's where we find john roberts in golden, colorado. trump is calling this as bad or worse than the watergate scandal. >> abby, clayton, tucker good morning to you. what a difference a day makes. donald trump was excureiating the fbi until yesterday :00 in the afternoon and surprisingly he is praising them. we are in denver at the fairgrounds where he has a diehard event. fans came in all the way from nebraska. let me say to the fbi investigation announcement yesterday, the fbi could not have handed donald trump a bigger gift than if they had tied it up in a big red bow. they warned saying very concerned about anthony arena being in proximity to classified information. and where did the trail lead from hillary clinton's server to potentially going into his orbit? and it allows donald trump between now and november the 8th to absolutely hammer hillary clinton on this issue of corruption and bad judgment like he did yesterday in manchester, new hampshire. listen to this. >> this is bigger than watergate. this is bigger than watergate. in my opinion. this is bigger than watergate. hillary bleached and deleted 33,000 emails after receiving a congressional subpoena. that alone, to me, there were more serious things done. but how does it get much more? >> no. i think that's one of the frustrations about this whole thing is that you are talking about top secret information that i'm not allowed as a member of congress with a top secret clearance i'm an officer in the navy reserve. i'm not allowed to review some of these things because i don't have a right to know that that ends up on private servers and potential whether i anthony weiner. here's the thing. a military official, enlisted guy, officer, if they would have allowed that to happen, set up a parallel communication system with top secret information they would have faced court martial without question. >> what happens now for huma abedin? >> well, i think this whole thing say hillary does get elected there is a cloud overhead, her whole inner circle, potentially, she would want to be part of the white house, give security clearance. there will be a huge fight in congress over that i'm sorry, the average person who would have handled this information the way they did, they would not be entrusted with classified information in the future. >> four different devices that they seized from her that, you know, email communication, tens of thousands of emails between her, anthony weiner, all of this information on those devices, that's troubling. >> yeah, without question. you don't set up a parallel communication system knowing the type of information that you are dealing with on the state department. they made a conscience decision. that's why the comey initial findings were. there was classified information shouldn't have been there. should have none better. there was no real intent here. what are you talking about? [talking at the same time] >> at the fbi said these emails -- none of these emails are from hillary clinton. i think that's clear. >> the fbi has not said tharvelings no i said a reporter. >> some reporter on twitter said that. we don't know. >> number two, and most importantly, tucker, in this whole scenario whether you are democrat, republican, green party, independent, tea party, i really don't care, with 11 days before this election, i think the measure people deserve to know, the american voters deserve to know what are on these emails and i think it's time for the fbi to say what they have. >> okay. what the american people deserve to know is that justice is impartial and people are not treated differently because they are more famous or richer or powerful. that's the first thing they need to know. >> i agree. >> they second they deserve to know whose fault. is there a right wing conspiracy under loretta lynch and the justice department? is the media putting a thumb on the scale for donald trump? is there anyone who blame other than hillary clinton? >> no, i don't think there is a blame to go around. i think what we need to see here is the american voter deserves to see these emails. mike pence, the vice presidential candidate for donald trump said the same thing yesterday. the american voters deserve to see what this is because we know this is not going to end in 11 days. and people will be voting in 11 days can. they deserve to know. this. >> the timing, of course, is terrible. the most important thing, the reason people come to this country from other countries because they believe everyone who lives here is equal under the law. don't you think that calls on twitter and from the mob and from interested parties to hurry up this investigation are sort of the opposite of what we need? we need to know that justice is being meted out fairly regardless of the political timetable, don't we? >> that's a fair point, tucker. but, i think with people getting ready to vote in 11 days, right? and donald trump professed this -- yesterday the fbi was rigged, today the fbi is not rigged. i think we will figure that out at the end of the day. what the voters deserve to know here is what the fbi has. instead of saying we are going to open up investigations which they never do. we would have never known if anthony weiner is under investigation because the fbi never talks about their investigations. this sun precedented for the fbi to begin with. what needs to happen now is they need to shoat american people, the independent voters, the undecided voters what it is they have so these voters can make an educated decision about this election. >> yeah. i think they may be on a different timetable. their main goal may not be getting hillary elected. >> it's not about getting hillary clinton or donald trump elected it's about the truth. >> good to see you. >> >> good to see you, tucker. >> say voter fraud doesn't happen and in two key states it is happening. details ahead. huma abedin emails from personal account, is she in trouble? >> it is. he had two separate agents who were leaking, who will close to the investigation and going to present a real problem for him as this story developed. you know, look, this illustrates, by the way, the problem with early voting laws. think of all the people who have already cast their ballots for hillary making uninformed decisions. states shouldn't be voting a month in advance. look, this is a justice department-driven case. it always will be. i'm not sure the sequel is going to be any different than the original because ultimately it's the doj who presents to a grand jury. not the fbi. >> i think all of us in the journalism business have heard from fbi agents in the last three months the same story which is comey was in effect facing a revolt from within the fbi from agents who thought that his decision not to pursue this case was wrong, was politically motivated, they're mad at him is there any truth in that that you know of and did it play a role in this. >> no. absolutely, tucker. remember the story they destroyed all evidence, the laptops? we're learning that might not be true, that the agents refused to destroy the evidence in this case. >> good. >> and it still exists. that's very bad news for hillary clinton. but, look, this is still going to be a doj decision. if you listen to comey's testimony in july, tucker, he specifically said justice had grave concerns about the case. not comby. >> what about huma abedin in all of this that she sent classified emails to her personal account. now we know this morning, of course, that there are four different devices that were taken, communication with anthony weinerment some of this emails may have wound up in anthony weiner's hands. what kind of trouble is she in this morning? >> there salah that most folks don't know about it's 18 usc 1001. it is a law that if you tell any federal official anything false have you committed a federal keim crime. the justice department uses this all the time. they did an interview with hillary and huma and go back and look at documents including new documents on carlos danger's laptop and they can say did huma say anything to us that wasn't true? did hillary say anything to us that wasn't drew? that's a federal crime. >> here's the other problem with the timing of all of this, if she is, in fact, elected, the focus is not going to be this next president and her future plans for this country. most of the focus is going to be on this for quite a while it seems. >> it's already ruining the possible clinton presidency. it's delegitimizing her. obama can always pardon her. he is harr done her if she is not charged. we have had that happen before where a president pardons uncharged crimes. maybe that's the way you solve that delegitimate problem. >> do you think americans can rest easy knowing that potentially national security secretsy residing on anthony weiner's laptop? >> that's it. you have got to start moving the ball down the field yourself. that means winning a couple of key states that were won by barack obama four years ago. and that is great states of ohio and florida. these are must-win states for donald trump if he wants to win in the white house. now, ohio, trump is barely up. florida is he a little bit down. both campaigns have been in these states very active. if donald trump wins all the romney states and wins ohio and florida, that gets him to 253 electoral college votes. and you know what it's like in football. that means you're positioned to throw a hail mary pass. >> if you have tom brady in the fourth quarter can you pull this off. hail mary pass for donald trump is what? >> ron is a former assistant director of the fbi and he joins us now with more on this. good morning, sir, thanks for being here, an important morning. good morning, my pleasure. >> so you know what depose on behind closed doors at the fbi. you know what goes into their thinking when they are talking about reopening a case it seems like it had to be something quite serious for this to be reopened 11 days before the election. >> yeah, i think so. there is actually doj guidance that the fbi follows that direct you to avoid taking overt steps in doing things that would create the appearance of influencing an election. and and so you really do try to implement that guidance in every decision in a political case during a political season this is quite extraordinary. i would think what the fbi discovered and it's being reported that it's massive in scale that it is so significantly large that even with automation of what they already possess that they are not going to be able to get through it they think they have to, quite clearly, look in detail about what's in the take and evaluate it fresh and probably large enough that it moved the director to say i have to notify congress. >> do you think james comey needs to release new information though. because the democrats are upset about this saying it's totally unfair so close to the election to leave it so vague as he did. do you think he needs to give more info? >> you know, in a perfect world, he could do that. in a perfect world, he would get through whatever it is that they recovered and have a solid assessment of it in the next couple of days. but if we're talking about thousands and thousands of documents, some of which may have to be circulated through the intelligence community, if they are new documents to determine whether they were classified documents and what we should do about it, the notion, first, of putting it all out there in public is ridiculous. secondly, i think it could take a fair amount of time, like it did the first time, where the fbi is going to the other agencies and saying, what do you think about the classification of this document? >> now, ron, you have worked with james comey. and when all of these reports were coming out that this was sort of tanked politically, that this was why this was being reopened that fbi agents intermly were upset, do you understand by that? do you believe that? or is that erroneous reporting? >> i don't believe for a second that jim comey would take a call from the white house and act upon it. i don't believe the fbi or the director briefed the white house on the prior investigation and i think time and time again in his tenure comey has done things,made speeches that says he is his own man. is he not to say mother may i to the doj or white house. it's angered them in some cases not only do i just know the director. i know several of the other key executives who were involved in the chain i don't think for a second they are in the tank for hillary clinton are going to take a dive because somebody told them to, they quit. >> do you think other agents there pushed james comey to do what he did? >> what he said to me was and i will get to your in a little bit mom, i thought i stepped up to join the navy to serve my country but maybe this is how i'm serving my country is raising awareness of the double standard so all people like myself and others who proudly serve as well as other patriotic americans will be held to the same standard as those that should serve and protect us such as hillary clinton is attempting to do by running for president of the united states. we started a facebook page american patriots against double standards and it's all about other people and their story and i hope that people will get on that page and share it and like it and follow our story. we found out yesterday that -- i found out that my son will not be able to have any lessened sentence in federal prison because of the way the judge sentenced him he has to do the full year. we're disappointed in that but we expect and acknowledge that my son has -- my son has accepted responsibility for taking six photos when he was serving. he wahe is serving his time and i'm proud of him as an american. >> these are the photos that your son took in the submarine? what happened to him after this? what are these pictures of? did he ever share them? >> right. so i can't see them from where i'm at, but i'm expecting that you are putting up the photos that were disclosed during the sentencing hearing. so, he took photos, six of them in a classified area. one thing i want to state is in 2009 when those photos were taken, there was no cell phone ban on submarines during that time. many other sailors were taking photos as well. actually, two sailors were brought to light during the sentencing time, that they received a reduction in rank and a fine of $550. and one of them has now been recently promoted to an officer position. so there is obviously a double standard within the military as well. my son did not share those photos. >> he didn't share those photos and he also destroyed them. is what hillary clinton did in your mind worse than what your son did? >> mike emanuel for us this morning in west chester, new york. thanks, mike. >> outstanding. thank you, mike. there are a lot of legal questions about how this happens and what is going to happen next. i want to bring in appropriately judge andrew napolitano by phone this morning. judge, are you there. >> good morning, guys. >> good morning. put this in context for us. our assumption is it's gotta be big if comey is doing this 11 days out. is that a fair assumption? >> i think it is a fair assumption. remember, comey has been under tremendous, below the radar screen pressure from the younger fbi agents who actually worked on this case and from retired fbi agents who view the fbi sadly, very differently than the one for which they worked. to reexam evidence and to reopen the investigation. i would like to think that he made his decision on the basis that he announced yesterday, on the basis of true evidence that came before him and not on the basis of political pressure applied on him. but i can tell you from sources to whom -- from whom fox has communicated on a regular, consistent, systematic basis that the pressure has been relentless. now, having said that one of the more poignant statements of the past 24 hours has been our colleague geraldo rivera. how could huma abedin have permitted secret, top secret confidential, three categories of classified materials to be put on a laptop which was shared by her now estranged husband? >> right. >> so the question remains what are these things? has the fbi not seen them before? might this have been a shelter for emails that mrs. clinton and her it experts managed to get off of her server? or does the fbi not know yet because of the volume of these if they fit in to confidential secret or top secret categories? >> right. we don't know the content of these emails. could they be duplicate? could they be the ones that hillary clinton were deleted on her server? they are actually on huma abedin's laptop? i want to ask you the legal question about huma abedin. what is she facing this morning? >> well, she has -- we don't know if the fbi and the justice department, which was handing out what it called immunity. there were technically not immunity. they were promises not to prosecute on the basis of what the individuals told the fbi. we don't know if huma abedin received one of those, clayton. if she did, and if a court were to enforce it, that would carve out a great deal of charges available to the fbi. if she did not, then mrs. abedin would be facing similar charge that hillary clinton was facing. failure to secure state secrets that were repose to you for safe-keeping. when she was number one in mrs. clinton's office and number three in the state department, depending upon how you count the hierarchy, she, too, had a top security clearance. that imposed upon her the same burden that was imposed upon mrs. clinton to keep these secrets in a safe place. not share them with your spouse. particularly a spouse as reckless as anthony weiner. >> right. by coming out 11 days before this election. james comey has essentially gone against what loretta lynch and the protocol of the fbi and the justice department by coming out just a few days before this election. now you have democrats, judge, who are really upset about how this is being handled saying not only are they reopening this investigation, which they don't think is fair, but also there is really no information that james comey has given out to the public about why they have reopened it. do you think they have a point and that he should give more information at this point? >> well, i think they have a point. now, i'm chuckling a little bit because i have been on the record and i have been arguing for months that there is enough evidence here to charge, indict and convict. and i have been arguing since july 5th that the decision not to prosecute her was wrong. but i also think it was wrong for him to come out yesterday the way he did. he has no obligation to reveal to the congress or to the public the reopening of an investigation, particularly when he is not able to say what the evidence is or how grave it is or what she is going to be charged with if they had already done their homework, he can very well say we have decided to recommend to the justice department that she be charged with the following five charges and here is the evidence. but not having said that he has placed the country 11 days right before election day in a sort of walking on egg shells. is this stuff about huma abedin or is it about -- not running for president or is it about hillary clinton who is? >> right. so i mean the speculation at this point is, this was a prophylactic against charges he would expect, criticism he would expect if hillary was electedame out later that he knew about this ahead of time and didn't say anything about. >> it you know, you're right on the mark. he faced a damned if you do and damned if you don't. if she gets elected and turned out around thanksgiving that he knew about this in october and sat on it, he would be severely criticized. on the other hand now he is released it. he apparently himself doesn't each know what it is. and i is being credit sides? >> well, yes. it's not a question of legally can he do it. it's a question of should he do it? and in doing that he jeopardizing the entire investigation. if you remember, back during the ferguson investigation media was screaming and citizenry screaming the officer should release the statement and any evidence they had about the shooting happened. had they done that what would have happened would have been completely different. you remember that the forensic evidence eventually proved that the a lot of the evidence were flat out lying. the defendant wasn't holding his hands up or fleeing or surrendering at the time that he was shot. he had released the forensic evidence to prove that witnesses would have changed their testimony and it would have been a totally different outcome. that's why law enforcement should never release details about the investigation while it's ongoing until they pin down the statements of all the witnesses and button everything down. i would say even then they shouldn't release it. you know, donald trump is confidently criticizing the military for announcing all of its procedures and plans. i would criticize any law enforcement agency that opens up investigations for the public while they are ongoing? >> he was in a tough position because here you are less than two weeks before this election. obviously you learn things that were quite alarming and shocking to him. and he was, you know, under a situation where either release this after the election which could have been even worse in his position. so are you -- so what do you do? does hillary clinton fire her? >> well, you know, i have written about huma abedin at great length in my recent book "guilty as sin." there is no one closer to hillary clinton than huma abedin. they are literally never more than 3 feet apart at home, in chappaqua, on her plane wrrve she is, everything that hillary knows huma knows. huma often carries or carried when hillary was secretary of state her blackberry. huma actually did a lot of hillary's blackberry communications. so it is not unlikely that on huma's computer the anthony weiner home, you are going to find a lot of communications that have to do with hillary clinton as secretary of state, some of them maybe even top secret. >> are you shocked by any of this? i mean, you have been following this so closely. you have been writing about this. a lot of us are watching how can this happen right now? are you shocked? >> yeah. i think it's a complete mess. 10 days before the election? "washington times" columnist our old friend charlie hurt joins us now to weigh in. stripping aside all the spin and i'm not being partisan here. just as sincere as i can be, it can't be helpful if you are running for president two weeks out and find yourself under fbi investigation. that can't be a good thing, right? >> i don't think that's in the column of helpful things if you are running a presidential campaign. you know, remember, yesterday morning, hillary clinton was picking out her cabinet. joe biden was announced as her pick for secretary of state. they had this thing in the bag. and of course the fact that she came out and gave -- is that her second press conference if you want to call three questions a press conference? is that her second press conference in like 18 months or something? that's how you know how scared they are and how concerned they are about this the press, too. they didn't expect. this settled and happy about that. you saw immediate focus and not on hillary and how she got us here in this moment of chaos but on james comby. i mean, you saw over on cn think david gregory formerly of nbc this sun precedented comey would do this. >> the guy was such a statesman just couple of months ago when he gave that damning quote unquote exoneration of her in the first stage of the investigation. i think people are just -- they don't know they are just stun. as you say the press completely thought that they had this thing in the bag as well. >> he would seem like such a good guy when he was letting the hillary campaign proceed. not even partisan legal partisan questions but legal questions. for example, huma abedin was questioned by the fbi earlier. and presumably one of the question where a all the emails where are the devices might reside. presumably she didn't name her husband's laptop or they would have grabbed it then. does it put in jeopardy and others? >> i think it does or certainly it ought to. this is a big question that i have, tucker, how did they not -- i mean, her apartment should have been raided. the clinton's house should have been raided in the first investigation. and, of course, if anyone else had been charged or accused of these crimes, you can guarantee that everyone they know, everyone that they had close enough contact with to have shared huge tranches of emails with. they absolutely -- there would have been no oh we found this four months later because we opened an entirely separate sexting -- underaged sexting investigation. >> so you have covered washington for a long time for a million different publications. be the fact checker here. am i misremembering this or did they brag how they set up huma and anthony weiner they were like god parents to this marriage. >> bill clinton married the two expecting 11 days before the election. the fbi advised congressional leaders this new information has surfaced and they will review them to see if they contain classified investigation. the fbi said it wrapped it's clinton investigation months ago. huma abedin was sected to this new information. and last night clinton was asked if she had spoken to abedin by in the new revelation. >> we have heard these rumors and we don't know what to believe and i'm sure there will be more rumors, that is why it's incumbent on the fbi to tell us what they're talking about, jeff, because right now your the "new york times" is reporting that tens of thousands of abedin's e-mails are on wiener's lap top. given that we don't know the significance of this newly discovered collection of e-mails, i don't want to start -- i'm trying to strike a balance in a brief letter. but i wanted you to hear directly from me about it. clearly comey feels like what he did, this close to a presidential election would were pressing james comey to release this information. here was his take on their willingness to go to congress. >> this is really quite extraordinary, i would think that what the fbi discovered and it's being reported that it's massive in scale, that it is so significantly large, that they even with automation of what they already possess, that they're not going to be able to get through it. they think they have to quite clearly look in detail about what'ske. and then evaluate it fresh and it was probably large enough that it moved the director to say i have to notify congress. >> beat up by the republicans, now he's their hero and he's been beaten up by the left, by the democrats. i think he was in a tough spot, a very, very is tough spot. here you have these e-mails, what is he supposed to do? the bureau has these protocols where you don't get involved in an election, but there was just so many of them. and i can't believe that a preliminary read of this treasure trove hasn't revealed some very, very big questions that have to be resolved in director comey's mind. so here we are, and i think this has an historic impact. >> you can't come up with this kind of plot, soon we'll be aweek away from the election, are they parsing through this bundle of thousands, maybe tens of thousands of e-mails, and saying this one, this one, this one, are they really going to in any kind of responsible way abide by the requests of both the right and the left now. are they going to do it a week before the election? five days before the election? at what point does the bureau have to say trust us, we're investigating, don't vote based on this? i don't know how in the world at this stage of the game, having violated this unwritten pro ttol not getting vot ting involved i time? how far down the rabbit hole do we go here? >> i think you're jumping a couple of steps ahead. this is huma abedin's lap top, in some colossal misjudgment, shared with carlos danger. it's about specifically require intent. mens rea, really you have to intend to reveal america's secrets and then cavalierly violate that law and then reveal them, that's the difference between general cartwright and general petraeus and what happened to hillary clinton. cartwright admits or now he admits that he gave secrets to report ores, petraeus admits that he gave secrets to paula broad well, there's no allegation of intent here. so they're going to go through like this, all right, here's 10,000, is this one, is this one, do you think this says intent? i think that it's preposterous to think there's (announcer vo) only verizon gives you the best value. get the quality network you want and all the data you need without all the surprise overages and restrictions. switch now and get 20 gigs and four lines for 160. all on america's best network. new information rocking the clinton campaign, to relations from wikileaks that bill clinton raked in millions while his wife served as secretary of state, which scandal will have a bigger effect on her campaign? correspondent for yahoo news, michael isikoph. where does the story go from here potentially? >> well, look, it's so hard to say at this point, because we don't know what's in these e-mails, we don't know -- you know, even in comey's statement, he has not said whether they have been reviewed, whether they contain classified information, he said they're going to be reviewed to determine if they do. that's a huge question mark. around whether this is highly significant or not. it's worth pointing out that as far as we can tell, huma abedin had testified a couple of times, one during judicial watch and during the fbi review. she said she had three e-mail accounts. she had a state department.gov address. she had an address on the clinton, mail address that she used to communicate with secretary clinton, then she had a personal yahoo account and that is the one that is at issue because that's the one that her husband anthony weiner had access to. she said in her testimony to judicial watch that she forwarded state press clips to that yahoo account and if that's all it was and she testified truthfully in that judicial watch testimony. then it's hard to see how that would implicate anything for this larger investigation. what we don't know is whether the fbi agents reviewed that and saw whether that was the case or not. i think if huma abedin testified truthfully in that judicial watch deposition, then comey is going to face a even more criticism than he's already got on for why he raised this in the first place, why he didn't determine that was the case. >> but if this is in the press releases, he would be criticized by many, including me. but she was asked in those depositions where her e-mails resided. and if she had testified truthfully that they were on her husband's lap top, wouldn't the fbi have followed up on that? >> and fbi agents who were on the case may face some criticism as well for not pursuing on is t involved classified communications, state department business, other than press clips, were they forwarded to that lap top and we just don't know at this point. >> the other story that we have been following this week from wikileaks, it does seem like that there's evidence that others in their orbit were profiting personally from hillary clinton's job as secretary of state. is there a legal avenue that that goes down? does that potentially turn into an investigation itself, do you think? >> the clintons as part of their defense on the foundation was we didn't -- we didn't take any money from the foundation, and that's true, if you look at the 990s from the clinton foundation, they weren't being compensated but then you read that doug band memo, doug band would solicit contributions to the foundation and then solicit business for bill clinton personally, lining up speaking fees, so there was sort of an end run around the, you know, the clintons not profiting from the foundation. a, they weren't taking it directly, they were doing it sort of basically outsourcing it to doug band. it raises lots of questions, lots of people could -- undoubtedly could focus on that, but does it raise a legal issue? no. because if you're not using foundation money itself, foundation resources, they found a very clever way to get around that. >> not surprisingly. >> thank you for joining us this morning. a fox news alert, moments ago a brand-new batch of john podesta e-mails? and what impact will these e-mails have on the elections with just 10 days to go. we have a political panel to talk about how it will affect them. stay tuned. the trump campaign insists that things are evening up in new mexico and trump is only three points behind in michigan. sometimes that internal polling can be a little bit misleading, back in 2004, the bush campaign had some internal polling that showed maybe hawaii was up for grabs, they dispatched dick cheney over there. >> i vote hawaii for the first prime state. i think that all the candidates should have their election night watch parties there. i'm a big hawaii promoter. >> john roberts on the road. thanks a lot, john. >> let's go to our political panel. big question this morning, how will clinton's bombshell affect the election has the race been reset with just 10 days to go or is it all under wraps for hillary clinton. kathy lynne taylor is at the end and cliff young is in the middle and democratic strategist dan yell miller is here too. you think these e-mails, james comey simply had to do his duty to get those out there, that there's nothing to see. >> jason miller is saying this is a bombshell s but -- >> from the trump campaign? >> this is a technicality, what james comey did, he's reiterating -- these new e-mails came to light, which he's very careful to say may or may not be pertinent to this investigation. he was simply doing his job by letting congressional leaders know what was going on. >> nothing to see her, kathleen? >> we do know that he had information he felt he needed to share with an update. but what we do know is this, when we look back on this election, two weeks from now, we're going to say that one of the most under reported aspects was the number of undecided voters. and we're seeing that in the tightening of this new abc news poll that came out. when you have such a large pool of people, the people at the top of the hour saying that the young men and women they polled across the country are undecided. this is still relevant information. >> kathleen brings up a great point, that these undecided voters, these emotional moral voters, they think donald trump -- where do you see the undecideds shifting in the next few days? >> this election is unprecedented in the number of undecideds. stepping back again, looking at events like this generally, they typically don't have an impact. you have to have a smoking gun. if there's no smoking gun, this scandal riddled the clintonesque sort of -- it's all right baked into the voters rationale and calculus. >> we already know the clintons. >> that's what the polls suggest. >> what we also know now is that this investigation is still coming out. this investigation is not 100% complete and with just a few days to go to the elections, if you cast a vote for hillary clinton, you're casting a vote that this story will continue on far into the presidency if she were to ascend to it. so that's something that people will consider. >> we were hearing that james comey would never want us embroiled in a constitutional crisis, and if this unfolds in a really negative way for hillary clinton, this could unfold into a constitutional crisis, if she is elected on november 8 and then this investigation unfolds, we will have to wait to see whether she will actually be sworn into office. this could be a huge problem, something that we have never faced before. >> we have never seen anything like this on both sides. i think whether she's elected or not, we're going to see continuing investigations into her and it's partly because of anthony weiner and the things that are going on with him. but also because i suspect that congressional republicans not going to let this go, even though james comey didn't find enough ed to prosecute. i think what we should also look at is the reaction from donald trump, people are still making up their minds, we have 12.5 million people who have already voted. this is a man who before any information was in the public realm was calling this a criminal scheme. calling this worse than watergate. and this is the kind of trigger happy temperament that's really worrying. >> and what's trump's reaction to all this, when you're shooting yourself in the foot, you let them shoot themselves in the foot. what do you think about trump's response to all this. >> it probably won't have an impact. over the last week or so he's narrowed in the polls. and people are questioning why, he's energizing his base about maybe this is a rigged election. >> everything's rigged when it doesn't go his way and it's not rigged when it does. >> go on our facebook page, and you can weigh in on this. thank you for being here, great to see all of you. we have more coming up on fox and friends. podesta e-mails. wikileaks releasing a brand-new batch of his e-mails. plus hillary clinton back on the trail today, as controversy swirls around her campaign. >> we don't know the facts. which is why we are calling on the fbi to release all the information that it has. so let's get it out. now that karen's taking osteo bi-flex, she's noticing a real difference in her joint comfort...
