window as they walked. this is what we are seeing up and down the street even up and down the street for the last four hours or so. in fablg in the south shaw neighborhood 40 miles from here we had 35 looters not letting us go through an intersection but thank god they let us around them. you can see fire hydrants controlling the water from down below. this is a local business. this was a beauty shop and next door was a local cell phone store for people who lived in ferguson. >> show you some of the video from last night in a second. i want to show you a quick look. this is the main street back in august the ridoters were here. helicopters are coming in now. look down the street as far as you can see there are fire trucks. there are emergency personnel and buildings burn right now. show you the video last night where they were envelope oping this area. there were three main areas where the rioters were having their way where i am standing now and you are seeing the video of stores being looted windows being broken out, fires being started. down the street from me about a mile and a half there was a second area where there are major problems. my colleague mike tobin is over in the old ferguson area with two-miles from here near the police station and fire station where they had problems there. a large group of people started the evening there and things spread out. later on in the evening they had about 1,000 protestors in the shaw area. we went there around 12:30 last night. that's where we saw the end of thankfully some looting there. the police officers got in there had a chance to stop them before it got too bad and there were no fires there. this has definitely become quite a situation here. more than any one expected. at the same time we had issues with people questioning why the national guard wasn't here. we have seen five bus loads of national guard troops come in in an hour or two. >> we were all watching the coverage when steve was outside of the liquor steer steve is trying to interview them. >> we knew in advance this was a potential. they should have been called in early. >> we have a lot of interviews. we will ask that question. >> fox news on the ground covering the chaos. mike tobin caught in the fray when police unleashed the tear gas. (coughing) >> we had a big volley. there's another round that just went out of the tear gas coming out of the police vehicle in that direction. again intended to and very effective at dispersing these demonstrators for a short period of time. you can see one of the tear gas canisters on the street. we are just a couple hundred yards away. >> mike tobin in the throws of it there. >> the grand jury decision coming after 97 days of testimony over 60 witnesses, every piece of evidence carefully looked over including newly released photos of officer jerry wilson's face after the shooting. you can see that there. kelly wright is here with us and with with a closer look at what happened. >> good morning. the grand jury 25 separate days in the last three months. they listened to 70 hours of testimony and 60 witnesses and reviewed hours and hours of interviews. the prosecutor bob mccullough laid out how the grand jury reached the conclusion adding it was based on forensic scientific plus eyewitnesss from whites and african american witnesses to the moments before and after the shooting. they testified they never saw brown raise his hands in the air to surrender fwu say they saw him confront officer wilson. >> they saw the altercation in the car between officer grown and officer will on. it was described as wrestling and tug of war and movement. several other witnesses described mr. brown and bunching officer wilson while mr. brown was partially inside the vehicle. they heard a gun shot while mr. brown was still partially inside the vehicle. >> they released witnesses of officer wilson's face with bruising along his cheeks. they heard from brown about what happened when he got out of the car as well. >> mr. brown ran east off canfield and officer will begin gave chase. at the corner of copper creek he stopped and turned back toward officer wilson. as michael brown moved toward officer wilson several more shots were fired the officer and michael brown was fatally bound wounded. >> the jury of 9 whites 3 blacks they decided not to press charges against officer darren wilson because there wasn't enough evidence to show probable cause. the grand jury made its decision unanimously. >> kelly wright, thank you very much. brown family attorney general insists the judicial system failed here but rudy giuliani says the evidence came out. >> there will be answers in the couple days about the decisions that were made and the outcome we got. >> they came to the conclusion he came from self defense. the defense lawyer there said he should be given the benefit of the doubt. worst murderers are presumed innocent unless you are guilty beyond a reasonable doubt. this grand jury decided there wasn't probable cause to believe any crime was committed. >> brown's mother was inconsolable as the decision came down. >> less me mcfadden collapsing outside of the police sfatationn ferguson. the family said we are profoundly disappointed the killer of our child will not face the consequences of his actions. we respectfully ask that you keep the protests peaceful answering violence with violence is not the correappropriate rea. >> officer darren wilson breaking hissy lie breaking -- his silence. >> i would like to thank you all for standing up for me during the stressful times i wish i could attend and meet you hug you and personally thank you for all of your continued support. however do you to my and my family's safety i am unable to. please keep my family in your hearts and prayers. they have all made a sacrifice to their own lives in order to work excessive hours through the heat and rain to ensure the riots and ferguson were as safe as they could be. >> in a separate statement wilson's lawyer said he followed his training and followed the law. >> hundreds of people facing a peaceful protest outside of the white house. >> urging calm. a stark contrast to it playing out in ferguson. what is the message from the white house? were they prepared? how were they preparing for all of this? >> that's a good question. i was with steve and i was with adam. you are right. i was wondering where was the national guard. according to nixon the national guard was supposedly put into place days ago. i tell you i was there up until late yesterday evening. i didn't see one national guard truck. i don't think the city was prepared. clearly the governor has not handled this situation at all properly since the very beginning. >> you have been great. we appreciate all of your help on this story. >> the national guard was there they had to bring in more. >> here in new york city, demonstrators filling the street. one even attacking nypd commissioner bill gratton. we are live time's square. i understand there are still protestors there at this hour. >> that's exactly right. good morning to you, heather. the protests began here in new york city shortly after the grand jury's decision with brad and protests continue this morning. you can see the small group of demonstrators gathered in the center of times square. they are chanting things like hands up, don't shoot. you can seation right now. the announcement in ferguson last night said hundreds of people on the move in new york city. take a look at some of the video. demonstrators in union square holding signs saying things like black lives matter. they wanted no justice no peace. hundreds of people marched in time's square blocking the traffic. during that time police commissioner was sprayed with fake blood. the person who flew the fake flood and ran away has been arrested. back out here life there are a few dozen protestors out in the center of time's square. some say they plan to be out here through out the day. heather and ainsley i will send it back to you. >> 19 minutes after the top of the hour. an agency at the center of scandal for years. why irs employees are now cashing in on big bonus checks. >> and going into the history books? >> the latest update is there are more than 25 fires that were burning here. half an hour ago the one over here behind the mcdonalds was a local place that was a nail salon -- sorry a beauty store as well as a phone store. they have put down the ladder and it is going to smolder noup. it -- now. it is done. the street is completely shut down. this goes toward one of the neighborhoods it is shut down as well. the businesses who talked to the rioters were the protestors. they put up the boards the hands up sign yet still you look over here on the ground you see the glass. the rioters came in here and busted through the window. frl these businesses they had everything up pretty good so you couldn't get inside. for the business owners down the street they tore off the fly wood and broke through the glass and went inside and looted the glass. this is where all of the rioting took place. you can see emergency crews coming in right now. you can see the police officers this took place several hours ago. the firefighters coming out they were escorted out. you see him coming out with law enforcement. there were shots fired for them. some people suggesting and asking why didn't the firefighters stay? simple when you are trying to fight a fire they get out. firefighters are coming out now as they finish up some of the fire some of the locations. this is the main street. another law enforcement car coming here. all of the way down here it is hard to see in the night sky but there's still smoke for a mile and a half down the street. fire is burning on both sides. there are cars all through here as well. not far from here the national guard showed up about two or three hours ago. there were five bus clouds that came through. some police officers told us off camera where were they earlier. there were some national guard members here but why p weren't they hasnin here earlier. you can see more law enforcement coming down from the right. highway patrol coming in right now. firefighters leaving going out. they were trying to get some of the firefighters out here. they don't know the exact number of how many people were arrested. the last number was 29. we know that will be hire. we know there were a number of people injured including an elderly man that was car jacked. a lot of these people out here are very tired law enforcement wise they have been here since the announcement. the drones above us in the skies very tense, very tense. no one knows what to expect coming up tonight. summertime when we were here last summer three months ago the protests went on night after night. this year seems like they have a lot more people stationed in which they brought them in this morning. we know what happened last night it was not pretty. that's putting it lightly. you see the video with tear gas flying and bullets flying and firefighters having to leave. now basically rubble down the street which was home to a lot of businesses locally owned now it will no longer have a home. >> these looters are destroying local businesses. mom and dad pop shops, it is unbelievable to watch that. not sure how that advances their cause. adam housley live there on the ground. >> michael brown's mother inconsolable as the decision comes down. >> leslie mcfadden collapsing to the ground surrounded by supporters. they are profoundly disappointed they urged peaceful protests. they are considering a wrongful death lawsuit. they are saying it is not an issue of brace. >> i have always been very vocal about this not being a black-and-white thing. the mere fact that the news media introduces him as the young black teenager de humanizes him. that's why i think this case went the way it did. >> brown's parents joined by the reverend al sharpton expected to speak in a few hours in st. louis. >> darren wilson breaking the silence with a handwritten group of supporters. darren wilson group reading that letter. >> i would like to thank you all for standing up for me during the stressful time. i wish i could attend, meet you hug you and personally thank you for all of your continued support. however, due to my and my family's safety i am unable to. please keep my family in your hearts and prayers. they have made a sacrifice for your own lives in order to work excessive hours through the heat and rain to even sure the riots and protests were as safe as they could be. >> he followed his training and he followled the law. >> the grand jury in ferguson met for 25 days. her testimony of more than 50 that made conflicting witness statements. was justice served? is we are joined by heather hanson. first of all thank you for joining us at this hour. a lot of reaction there have been some conflicting reports as to whether or not this was a unanimous decision. how would we know that or will we not? >> we should never know that. >> this type of thing should never ever be made public. the prosecutor was questioned from that. he does not know and we should not know. if that has been reported it is not official and is not consistent with what this grand jury is supposed to report. >> in terms of the grand jury the evidence they looked at to determine this, what was that? >> the most important thing they looked at was testimony from numerous witnesses. on top of that the physical evidence. the physical ed can't lie. the physical ed can't be pros examined. it is what it is. you measure the physical evidence against the testimony to see whether or not the testimony is true. on top of that they also heard the law. before they heard testimony from officer wilson they were given the statue in front of them on paper that tells them what an officer can do. an officer is allowed to use force that is reasonably necessary to make an arrest. they were given all of that information as part of their consideration. >> in fear for their lives or if it is determined to be self defense. one of the witness testimonies that we heard that was presented said that he went full on at the officer. >> that's important but heather this is an important point. it doesn't have to be self dpeens. >> for a police officer the law is it is the amount of force necessary to make an arrest. everybody says black lives matter and they do but all lives matter. police officers have to protect not just themselves but other people. that statute was before this grand jury as they heard the testimony. that is the law they had to follow. >> we see the protestors hand up don't arrest but the evidence shows that is not what happened. >> and the inconsistent statements between the different witnesses is very important here. the inconsistencies between the things they said themselves and what they said in the physical evidence. the other important thing is the consistent statements. officer wilson gave more than one statement to various other members of the police officers to the fbi and then to the grand jury. his statement from what i have read. there are 70 hours of testimony. his statements are consistent. these are the things that the grand jury is looking at. >> we also see the pictures released from the officers. there are still a couple cases out there. >> there are a number of things that could happen. the doj is investigating this case both against officer wilson as a criminal case and civil case against the police department to determine whether there will be an injunction to change the way they do things. in my opinion both of those cases will not go very far. the standard for those cases is in some ways even higher than the standard for this case. that is an investigation that is going to take some time. the other possibility is a civil trial. that is where will family would sue for money damages. the standard is difficult. officer wilson has qualified immunity if he reacted reasonably he is immune from that, too. >> we will be talking about that through out the day. >> in washington president obama urging calm his words unheated by protestors in ferguson. doug luzader live in washington. what is the latest from the administration today? >> the president urging calm from the briefing room last night. did it really have much of an impact. take a look at this as we have seen this live last night. in split screen was the president on the right calling for peaceful protests. tear gas filling the air firies breaking out. >> michael brown's parents lost more than any one. we should be honoring their wishes. i also appeal to the law enforcement officials in ferguson and the region to show care and restraint and the peaceful protests that may occur. >> repeated calls for calm did little to ease tensions from missouri. they continued federal investigations into officer darren wilson and the entire ferguson police department. they suggested his department could reach a different decision. it has shared information the federal inquiry has been a local one from the start and remains so now. one of these federal investigations will look at the entire ferguson police department. it will take a long time but holder thinks he will wrap it up and it will be relatively soon. >> now look at who is talking former civil rights leader saying actions like these are a slap in the face to the entire civil rights movement. >> he has to be spinning in his grave if that's what justice looks like it tramples on the grave of the martyrs of the civil rights movements that struggled for real issues they were trying to over come. you got thugs and punks and hoodlums in the street. you have leadership but we are not it getting it from this administration people like holder and from obama. mike brown going to reappear again in the pantheon of civil rights groups. he will be installed right next to rosa parks and martin luther king and other grates. image that. >> let's keep talking about the grand jury decision was justice served? joining us at ktrs radio talk show mcgraw mill haven. thank you for joining us. >> you bet you. >> why did you think they decided to make the announcement at this time? >> let me say i don't know what the best time to release this kind of information was. let's look at the time line of events. yesterday mid morning by mid afternoon it was leaked to the "washington post" and it was leaked to another major outlet not in st. louis. that tells me that that came from the justice department in washington, d.c. i think that hits the happened of bob mccullough. he was planning on having some kiep of planned rollout. after it was leaked by the fitz and by the justice department i think the hand was forced by eric holder and justice department with these leaks. if those leaks didn't happen he probably would have been able to do it in a more orderly fashion. >> many people were saying they hope it happened on monday. monday morning would be best. they could have daylight. they could release them from rioting. does the timing really matter? the riders are still going rioters are going to riot anyway. >> hindsight is 20/20. we had months to debate. the looting was on sunday night. i also heard the family was upset they weren't night fied the januaried inju grand jury m decision. he was forced by the feds. if they don't release that information and don't leak it to the "washington post" eszable to get his ducks in a row. the reason why it took so long is they weren't ready. they had a number of hours to have the national guard ready to get a statement ready. when he didn't have that time he had to push. >> i have to ask you a follow up question. why would the justtis department leak this?
