why are they allowed to serve and we're not, brian? brian: i had outs running our state on almost every level. politicians who don't know thousand run a business and don't care. they are doing it in our best interest. here is daniel presty th and his lawyer with tucker. >> we had a meeting inside yesterday. did have some guests in there sheriffs, came in. seems like a whole lot of them. we were really good with. they really cordial. after a while just wanted to take me out, a whole big ordeal. >> we're peacefully protesting no. rioting, no looting. peaceful protest. protesting and supporting business owners, local business owners. and danny and keith. and the actions they took to stand up for themselves and staten island and business owners everywhere. brian: he said i'm not going to be able to come back from. this what he said is i'm going to open up my doors and i'm not going to charge anyone. if you want to donate money to my place, about 40 bucks you can get food and get a drink. so they took his liquor license. the nypd he doesn't have a problem with. he says they have been great. the sheriff's office on the mandate you from the state. i'm sure these men and women wouldn't be doing this on their own go there in plain clothes and stop their business. these guys don't want to party. they actually just want to live and make a living. believe me, staten island is the canary in the coal mine. people looking around this country in california and texas and places like austin and looking around and seeing the oppressive way in which politicians are shutting them down, even though they have complied with their plexy glass and their spacing and their masks is way going over the limit. 37 states got mask mandates. everybody is complying the best they can. guess what in the numbers are still going up. so our economy tanks, businesses are destroyed. livelihoods trashed. and we're doing everything they want and the numbers are still going up. why can't we at least go down with a fight? steve: here is mike rowe last night on "the story." >> something amazing is going on right now. and you know, i think what's happening in staten island is sort of indicative of the old expression you can forgive people for being wrong or even for being stupid. but hypocrisy is a hard thing to get over. it's impacting people. people who would normally not say anything about it are shaking their head and saying jeesh, what is going on? they are leaving because something feels fundamentally wrong and the level of hypocrisy is rank and it stinks to high heaven. steve: we will speak to ian smith as ainsley mentioned a moment ago. he's the guy that runs the gym in new jersey, atill liz gym who has defied restrictions of governor murphy in new jersey. and, in fact, was at the mack's place in staten island last night. is he going to be with us in about an hour. speaking of hypocrisy, how about this i want to play you a mayor, the mayor of austin, texas, he is very clear this was on his facebook november 9th. it was so important to him he future out on his facebook page about staying home and not traveling. watch this. >> we need to, you know, stay home if you can. do everything you can to try to keep the numbers down. this is not the time to relax. we may have to close things down if we are not careful. steve: so he is very clear, steve adler is, the mayor of austin, don't travel. we have got to shut everything down. what we didn't realize until just last 48 hours is apparently he actually taped that when he was at his daughter's wedding in cabo san lucas in mexico after flying on a private jet with 8 people not all of them from his immediate bubble. and that particular image was of him at a timeshare in mexico telling the people of texas not to travel. ainsley: well, after he got caught by the local newspaper. they got a tip that he had the wedding and then they went as a family down to mexico. he does this video. you can't tell is he in cabo. there is a tv and fireplace in the background. you don't know that he is there at the beach and having a vacation. steve: maybe if there was a mexican. ainsley: or maybe a frozen drink in his hand on the beach he didn't want you to know. he got caught and now he has released a statement. he said i regret this travel. my fear this travel even having happened during a safer period could be used as some as justification for risky behavior. in hindsight and even though it violated no order it set a bad example for which i apologize. what makes people mad is that they are going on television and saying stay at home, gavin newsom, don't go unless it's essential. and then they are getting busted for doing the very thing they are telling you thought to do. that's why these bar owners down over in staten island. all over the place are upset. because what's good for me is not good for you what these politicians feel like are saying that bar in staten island, i wanted to add one more thing. they do have a go fund me page because they are getting fined thousands of dollars. brian: they lost their liquor license. ainsley: go fund me page. last check 45, $50,000. brian: they will need more than that if you feel as though his fight is your fight. i don't accept the apology from the governor, the from the mayor you have. i don't accept it from the mayor of san jose. you know exactly what you are doing. you didn't stumble into going the wrong way on juanway street that's a mistake. you knew exactly what you are doing. you got caught so you feel as though you can explain your way out of it. the other thing that they have even if they didn't make these transcription. they are still getting paid. when you give up your salary, your livelihood. when you got to call your bank and say i can't make that mortgage payment, and whether you have got to tell your lease holder i'm sorry i can't pay the rent, please don't gut my building and sell off my equipment. when you do that, then maybe i'll accept your apology. but you are not suffering at all. do you know who is suffering in the people in new york and business people in california when they have these oppressive mandates, huge taxes. you get almost no infrastructure. people are picking up and they are moving out. hp moved out yesterday. joe rogan who is almost as valuable moved out three months ago. out of california. chuck devore did the same thing. he used to be an assemblyman in california. he moved to texas. he weighed in. >> spectacular contempt for the voters. my understanding is that mayor adler's broadcast was actually broadcast from cabo san lucas in mexico where he was partying. he is saying have you got to stay at home but never mind the marge rita that's being served to me here at the resort in cabo. it's like are you kidding me? it's to my son brenton j. raffensperger who passed away two years ago. brian: launching investigation into voter groups trying to register deceased or out of state voters ahead of the senate run off takes place january 5th. one of the groups under investigation the new georgia project stacey abrams is a key person in and chaired by the senate candidate raphael warnock. here with more is alanna goodman senior investigative reporter for the washington free beacon. now the secretary of state, who is a republican, is interested in voting fraud in his state. >> yeah. i think that he has been under a lot of pressure georgia voters are very concerned about voter fraud the powell rally when many georgians showed up. they have been voicing their concerns. and so the governor has to do something. his secretary of state announced earlier this week that they're looking into four groups. one of these is the new georgia project for voter registration irregularities and potential legal violations. this group the new georgia project was where raphael warnock who is running for the senate, was ceo until earlier this year. this could pose a big problem for raphael warnock in a state where voter fraud is a major concern. brian: yeah, i guess so. it's a major colonel now and there was a problem during the governor's race obviously. stacey abrams still hasn't admitted that she did lose. there is three organizations they're looking into. the new georgia project founded by abrams. the america votes and vote forward. there are 23 investigators working on 250 open investigations. and they could be looking at a felony or $100,000 fine. where do you think this is going to go or is this just a brush back pitch. >> i think that the campaign administration does have to answer allegations what specifically they're looking into on this and when these -- when the new georgia project was registering these voters out of state illegally which could rise to the level of the felony in the state. because warnock was there until earlier this year. i mean, he was serving as ceo from 2017 until this past february. so was he there when these incidents took place? i think that the secretary of state's office should definitely step up and respond to that. we have reached out to them for more information. and so far they have not wanted to comment further than what they have already said on this publicly. i also this new georgia project were under investigation back in 2014 for alleging filing over 200 fraud length ballots. and so this is not the first time that the group has had these issues and warnock has been involved with this group since 2014. so, i think that he does have to answer for this with georgian voters. brian: until somebody goes to jail. and it doesn't seem real. the threat isn't real. why not take the risk. here's a statement from the new georgia project goes like this. as georgians, we are turning out in record numbers to have their voices heard at the polls. the secretary of state is resorting to desperate attempts to smear law abiding organizations and scare eligible georgians from registering to vote in upcoming critical elections. we will not be deterred. so game on. we will see what happens. we know that the governor will be on with laura ingraham and i imagine the secretary of state is going to be on the guest list, too. thanks so steve. how are you today? steve: doing okay. something like only 42% of the country dry say they will not take the vaccine. and, yesterday, former presidents obama, bush and clinton all said they would get the shot on tv if that helped convince people to get it. we know that these millions of doses are coming. let's say i got it on december 15th. i'm still going to have to another shot at what point after the second shot will i be protected? >> that's a great question, steve. first of all, i think you will get some protection from the first shot. we don't know how much but a significant amount. after the second shot, you should be fully protected and we are talking about 95% protected within a couple weeks after the second shot. and what's really excited about how they are rolling this out, steve, they are going to try to protect nursing homes and healthcare workers. i will tell you why i like both of those decisions. steve, 6% of the cases of covid-19 are in nursing homes in this country. but 40% of the deaths are in nursing homes. and you know how the media spins that. so i'm very, very interested in protecting nursing homes. healthcare workers if i get the shot i will go on tv and say it's safe. it worked for me. i feel good now you get it and also healthcare workers taking carol of people at higher risk and we are getting a shortage of healthcare workers across the country taking care you have covid. very important two groups to get this right off the bat. steve: absolutely. in the meantime, you know, they told us don't travel for thanksgiving and now they're saying don't travel for christmas if you can help it. they -- the cdc has also changed the quarantine rules. now they say you can end your quarantine on day 10 without testing. or and on day seven after receiving a negative test. you know, the things they are saying now are different than what they were saying in the beginning, but then again, dr. siegel, we know so much more now than we did in the beginning. >> well, that's true, steve. as i write in my book, all of these reversals and the flip-flopping, specifically on the part of the centers for disease control, has spread a lot of fear here. and i don't really think that 14 days -- remember, if you are exposed to covid how long before you got sick it. never really made sense for 14 days when you consider the other recommendation which is if you actually have covid, you can go back into circulation after 10 days. so, i'm glad that they are changing the recommendations, but they flip flopped on masks, on schools, and now on this. we need a consistency here to get trust and confidence in our leaders. and the other point about gatherings is, you know, the biggest problem with traveling is not planes. study from the department of defense shows that planes seem to be pretty safe if you distance on planes. it's in the airport. it's coming to and from. if you are careful there is no reason you can't be very careful and still celebrate christmas which is hugely important to the american psyche as you know. i made one of your dishes by the way. steve: i hope so there is a whole holiday chapter. i saw something in the news this morning. it concerns your business. they're referring to it as the peamplpandemic effect. so many people are locked down. they have got more time. they are thinking about their futures. they're thinking about becoming doctors. in fact, applications to medical schools up something like 20% year over year. >> i'm very, very, very gratified to hear that. that's what happened after the hiv epidemic, too. it's so great. it's showing courage. they know full well that being on the front lines against covid a risk. it requires full equipment at all times. a lot of healthcare workers getting sick. this is showing the best part of america that we see this problem and we want to help. and people want to help. that's how i feel. that's how my brethren feel and nurses are an overlooked group, steve. nurses and nurse practitioners have been unbelievable at the fight against covid. steve: you are right about that. dr. siegel, thank you very much for making a are not the person this country needs to fight for freedom or do what's right or stand in the gap while the rest of us are looking for you to lead or anything of that nature. i really don't understand. this i think this is more cannon fodder for the partisan side of things than reality. and i just couldn't imagine any one of sound mind thinking the american flag doesn't stand for them because of who the president is. brian: right. here's the headline. recall reclaiming the flag from "the washington post. for years trump and the right hijacked the american flag. refinery 29 the american flag can be reclaimed from trump. it's complicated. that's the big question. looking at one quote from chris told politico he took his flag down a year into the trump administration because he didn't want anyone in his neighborhood to associate him with president trump's racial rhetoric or anti-immigrant policies. >> yeah. if you read through this article, they lightly points out that most of these people they talk to live in places like seattle or, think one of them was georgetown, d.c. or something like that. if you associate the personal flag with donald trump. if donald trump has become synonymous with the american flag that's because his political foes have literal little burned it, turned it upside down, taken it down. knelt in front of it rather than honored it and completely disassociated themselves from it. this isn't like donald trump has hijacked the american flag when only one political party still understands the necessity of patriotism. that's not up to republicans or conservatives to fix that problem for them. but, i will tell you this. you know, if you think that the american flag divisive. you are the radical. not whomever you think that flag is associated with. steve: i just see the american flag. if i see somebody wearing a maga hat. okay that person supports donald trump. when i see the flag, i just see the flag, joey. >> yeah. listen, old glory doesn't care what your politics are. i have got news for you. old glory cares that you do your part that you fight for freedom and justice and that you take on your shared responsibility in keeping this country free and what it means for everyone. and that means fighting for what you believe in, even if i don't agree with that it certainly doesn't mean cowering, giving up, taking it down and walking away. i don't know what that is, but that's not american. listen, if that's who you are, be thankful your birth right guarantees you more than your nerve will. and that's a piece of this brian: all right. thanks so much, griff. the president wants to preserve his legacy the best thing for him would be to get a republican senate and that would be in his hands because there is two open seats. that's griff jenkins the latest there meanwhile, let's bring in governor mike huckabee, fox news tributer, former g.o.p. presidential canada. author of the three cs that made america great christianity, capitalism and the constitution. a lot of people come forward and a lot of affidavits signed. it doesn't seem to be the number that would overturn the election according to the department of justice. today it all shifts to nevada where joe biden won the six electoral college delegates before certification. how is this whole process going because, governor, when it comes to wins and losses, the president seems to be getting a lot of losses. >> well, he does. but in many cases, brian, it's because, you know, i keep hearing people say there is notified. yet, they have hundreds and hundreds of affidavits of people sworn to tell the truth under penalty of perjury which means if they're proven to be liars about this, they go to prison. they are coming forward. is it enough to change the election? i don't know. frankly, nobody knows because nobody is being willing to get into the details of how many votes actually could have been changed by the voting machine irregularities. the mathematical anomalies. there are just a lot of questions. so, i don't know that it would change it. i just don't know. but the fact is we can't know unless someone digs in to how many ballots were lost in the chain of possession. that's a big issue. how many different pieces of software were used. we have a number of people with sworn affidavits and i hear people say there is no evidence. it's unsubstantiated. well, then somebody is lying. because there is some evidence out there. i don't know how we get to the boss of it, no. steve: we did hear from bill barr when he said the other day to the associated press. he said there was no -- they had not seen systemic widespread fraud that would have overturned the election. but they did -- he also said that the department of justice did look to see if there had been systemic fraud and looked into the allegation that some machine somehow flipped votes. and they said there was no evidence of that. but, moving on, and brian touched on this a moment ago. part of the president's legacy will be to make sure that a democrat senate does not tear apart the things he has got in place right now. in fact, the president tweeted i will be going to georgia for a big trump rally in support of our two great republican senators, david and kelly. they are fantastic people who love their country and love their state, we must work hard and be sure they win. so, he is all in on going down on saturday night. how much can he help them, given the fact that, you know, his race, he feelings, is unsettled but he would like to help them with theirs? >> well it, shows a great unselfness on his support. an understanding that his role is not over. even if the election is. you will i think it also shows that he recognizes that his duty to the country is to make sure that chuck schumer, nancy pelosi, and joe biden don't just run ram shot over the process of our whole country. they have said they don't agree with the america' america presis view of america first. i wish they would tell us which country they would put first if it's not the united states. let us know which one is better than us? which one do they have a greater level of responsibility for? many of us have appreciated the president saying america first. it's put people back to work. it's grown our economy. retired people have better 401(k)s because of it. i just like to know if these two senate candidates in georgia don't want to put america first, who do they want to put first? brian: joe biden wants to use that line now. is he using it. >> good for joe. ainsley: tough watch this sunday night because at 6:45 eastern we are going to have special coverage of that georgia run off debate between senator kelly loeffler and raphael warnock. so stay tuned for that let's move on to another topic we wanted to you ask you about. this is the austin mayor telling people on november 9th to stay at home, if they can. watch this. >> and we need to, you know, stay home, if you can. do everything you can to try to keep the numbers down. this is not the time to relax. we may have close things down if we're not careful. ainsley: turns out governor though he made that announcement from mexico. he was on a family vacation. his daughter got married. the whole family takes a private plane down to mexico and is he telling his constituents. his people in austin to stay at home. he says after he got caught i regret this travel. my fear is that this travel, even having happened during a safer period, could be used by some as justification for risky behavior in hindsight and ingeg though it violated no order it set a bad example for which i apologize. you were governor, i have heard you talk about it before who said i was working at christmas. he came in and was working at christmas too. he said why are you here? he said i'm never going to do something i'm asking you to do. your thoughts? >> as i just said and you mentioned, leaders never ask others to do what they are unwilling to do. this guy was asking the people of austin to do something that he wasn't willing to do. he's not a leader. and i will tell you, he is ordered to stay home. i've got news what he should do is resign and then he can stay home. can he stay home for the rest of his life. but anyone who has done this to the people of austin and shut them down but he doesn't shut himself down, he ought to do the honorable thing, the right thing, he should resign and let someone be mayor who won't tell people to do what he didn't do. his message to them was basically let them eat cake. and in his case it was wedding cake. brian: governor, i know there is a lot of responsibility when you are the governor of a state. when you say to these leaders these mayors and governors that have owe preserve restrictions on while they get paid. governor newsom, the mayor in san francisco, the assembly woman in santa monica. this austin mayor. i mean, you have tough decisions when you are in charge, i get it. but, at this point, why should the american people listen to these politicians? >> well, they shouldn't. they ought to listen to their own good common sense and take precautions and be careful. covid is real. it's killing people. i lost a dear friend of mine, a former staff member with me at the governor's office monday night who died of covid. it's serious. and people are being injured by it. but what i would say is that when people shut down businesses and entire economies, the government officials who make the decision should not take a paycheck until the people that they have shut down are allowed to take theirs. that will give a much different perspective to the people who are making these decisions and, again, that's lead by example. go be the first person out there on the battlefield and the last one to put your feet up from that ground of battle. that's what leaders do. and these guys aren't leaders. and, if they were, they would be managing this very differently. steve: all right. governor mike huckabee joining us from his location, i believe, in the panhandle of florida. governor, thank you very much. >> yes. thank you. steve: it is a dozen minutes now after the top of the hour. and jillian joins us with news from florida. jillian: a florida police officer is expected to recover after being shot in a gun battle. >> frankly very strong case out here in nevada. where do i start, brian? we had over 42,000 duplicate addressed individuals who actually obviously voted more than once numerous things had taken place. one of the things i wanted to talk about here we have evidence of actual numerous instances of fraud. when we are able to match up the data, birth and address and voter registration number there are numerous different cases of issues that have transpired and one i want to talk about. we actually have a whistleblower who worked united states postal service who unfortunately not able to testify because of usps did not allow him to do so, this individual, excuse me, and actual instances of them being told not to do certain things, obviously from the postmaster, you know, from the local postmaster, these are top i we are talking about. i want to focus on the actual hard evidence, brian, because i want to be exact with these papers. we have 19218 nevada voters who have non-nevada mailing addresses. there is another 42,284 voters who voted twice. i want to be specific on that number because these were individuals who have multiple voter registration numbers associated with substantially the same name, birth date and address. we. brian: so you are presenting this today, chris, duplicate ballots. >> yes. brian: the wrong address, and having said that you are down by about 35,000 votes. is this going to make up the difference? >> look, it certainly can. we certainly have enough astrong enough case to be able to certainly turn this thing around in nevada. we have hard evidence of that between cash for votes. between the duplicate votes, between actual physical evidence of individuals voting with coming to fake addresses. with coming to addresses that really don't address. we have tons of data and information that substantialically support that information. brian: chris, you will be in courts today you earlier brought up the signature verifications too loose. nevada was one of these battle ground states that just mailed out ballots unsolicited to everybody because it was too dangerous, according to the democratic governor, for people to actually show up and vote in person. like new jersey. so, this is a stated the president was hoping to win. >> yes, 8 times more. brian: you will have your hearing today, right? >> absolutely right. we have a great team here. [chanting open up] steve: hundreds, perhaps more, rally in staten island overnight to support a bar owner who was arrested for keeping his business open. laura ingle joins us live with the backlash from staten island. hey, laura. >> hey there, you know, here at mac's public house, all things are quiet here. it's very early in the morning. man, it was very large and loud. crowds here last night with a large group of protesters here to protest what happened here on tuesday night when the bar's owner was taken away in handcuffs and the business was closed down with sheriff's deputies saying that the bar had to close because they were violating coronavirus restrictions. and we have some video to show you of what the seen looked like here last night as hundreds swarmed the staten island street to show their support for the owners of mac's pub with one of the owners as you see being led away in cuffs under arrest for providing indoor service in defiance of the restrictions here which has been designated an orange zone in this particular area of staten island because of spiking covid cases. the owners declared their bar an amazon sayautonomous zone. the owner explains what went down tuesday. >> we were peaceful, quiet, respectful. they gave us $50,000 in fines throughout the building. and wind up arresting danny and putting him in handcuffs and charging him with disorderly conduct when he never raised his voice. steve: laura, thank you very much for that live report from staten island. well, our next guest was actually at that rally last night. he was one of the faces in that crowd. and he knows first hand about defying state restrictions to save his business. atilis gym co-owner ian smith has had his gym shut down and boarded up by local officials. and he has also been arrested for trying to keep his business open and alive. and ian smith joins us right now from atill liz gym in belmar, new jersey, ian, good morning to you. >> good morning. steve: why were you there and what were people saying about the guy who was trying to keep his business afloat? >> i was there because frank and i received an overwhelming amount of love and support and that really helped us stay strong and it helped us stay open. you know, we have been open ever since. so it's my duty to return the favor and encourage every other small business owner. it's a scary thing to open up against the government. and i wanted to be there to much support and input for danny and his partner. and just encourage him that he is doing the right thing. the crowd was amazing. they are supportive. they were there and everybody is just sick and tired of these lockdowns that are nonsensical that are hit or miss for some people and people are just getting getting very, very fed up. you will start to see a lot of that in the coming days and weeks. steve: your story came to us from belmar at the height of the lockdown because we're all worried about coronavirus. it can impact impact and in fact has impacted most families. somebody knows somebody in their family or friends who have contracted covid. it's serious. at the same time, these across the board lockdowns that locked you down, you know, you didn't wind -- you wound up with zero money coming in for how long? >> we have -- we haven't charged any of our members since april 1st. we still don't charge because governor murphy took our business license from us. and the new jersey court system so we are still in the process. we rely strictly on donations at this point. you know, and it's -- the lock junes have been proven not to work. they didn't work the first time around. cases are up because test something up. deaths are down. they keep singing the same song over and over again. it's less believable and credible every time. and people are just -- people are done with it. i encourage every single small business in america to do exactly what danny did. do exactly what frank and i did. do exactly what all these other businesses who are standing up and saying enough is enough. because the reality is, once we hit a critical point of businesses that open and a certain amount of them open, there is not enough health departments. there is not enough schiffs, there is not enough police officers to come and arrest us all. this thing will be over overnight. we can get back to life in a sensible manner. i'm not saying just open with no procedures. follow a plan and open safely and get back to life the way it's supposed to be. steve: ultd matsly, ian, what you and the folks there at atilis did was, you know, despite the lockdown, you are trying to figure out how can we open our business and be safe about it to keep everybody safe you have had something like 75,000 people come back since you reopened not one case of covid heeble traced back to the atilis gym. guesses need to be problem solvers. they look at the restrictions the government puts on them as long as they don't shut them down okay this is how can i safely operate my business so i don't go under. >> yeah. it's about common sense. you know, if you look at the fact that amazon and walmart and all these places are still running, do you think there is not cases linked back to that? i will start with you. >> democrats did forget rural america but they don't have policies that resonate with rural america. ainsley. under donald trump rural america was doing great. we had opportunity higher wages under the trump era than at any time in recent history. that's really important. they want to make sure they have a president that's going to fight for them for better trade deals. we are sick of our jobs going over to foreign countries not because people do things better or cheaper than us. they beat us because they cheat us. and donald trump fought to make sure we were going to be treated fairly. that really resonates with rural voters. i look at the gun issue. we love guns. and it's a culture of communities that have guns and respect guns. fathers teach sons, mothers teach daughters. when you want to take away our guns that shows that you didn't just forget us, you don't have any respect for us and our culture and way of life. brian: they are taking your ammo. that's how they are stopping you from having guns. everyone has been quite aware of that joe biden did in his interview with thomas freidman one thing he says i'm so proud of myself. i feel like i have done something good for the country by, guess what? as we roll the prompter forward i haven't memorized the column. by making sure that donald trump is not going to be president for four more years. but there has been no moment of elation. it's just one of those moments. there is a lot of work to do. i'm just focused on getting some things done as quickly as i can. if he can't get it done, guess who he blames? and i wanted their self-talk to be 4 to 6. which is the length of play of relentless focus and effort. that means don't worry about mistakes. all that matters is 4 to 6 second window. ainsley: some parts are out on the field and some are behind the scenes. what did you learn? what was the favorite thing you learned with him, dan, when you stood up with him in that interview? >> my favorite thing, ainsley, you look at this bolder and all you see is the success. what coach and i would say everybody else that i interviewed their resilient spirit and what they do when it doesn't go their way is ultimately is what defines them and defines all of us. and to be able to share this real life advice from heroic people to help every day folks overcome their challenges, chase and hopefully catch their dreams was such a blessing. and just their mindset toward adversity, i think, is their greatest strength and as coach said faith and family and our freedoms are a huge part of this show. ainsley: yes. coach, tell the folks at home that story about being at florida when tim tebow was with you and how you felt lost and how you overcame that. >> i think what happens billy donovan was my neighbor in florida he won the national title i believe it was 2006. and we followed up with it national champs right behind. and what happens a lot of people worked so hard. you put your whole life on a 10 year sprint, 20 year sprint to win it. and life is supposed to get easier. it's not. as a matter of fact, it gets more complicated when you do reach the top of the mountain. then comes the expectation. it takes a little bit of the joy away from the every day of the grind that to climb the mountain is a grind. it takes energy and passion to sustain it's just fatigue. ainsley: what was the highlight of your career? >> oh, there has been so many. i think the highlight of my career might have been the last national championship i such a strong family man. a lot of times they won't let your family on stage because there is no room. i made sure that family was there and we all got to hold that trophy together representing our home state. ainsley: it's so powerful. i hope everyone goes home and watches it. dan you have your book fox nation, folds of honor. you served our country and still continue to do that. i will let you have the last word. >> i would just say that we're all struggling. right? reporter: good morning, guys well it is the early morning quiet here on staten island as businesses are about to open, but the one here behind me, max public house, as we've been talking about will not be one of them after one of the co-owners of the bar was arrested tuesday the business shutdown after violating coronavirus restrictions. we've been talking about what happened here last night on the street. take a look at what went down last night as hundreds swarmed the staten island street to show their support for the owners of max pub after new york city sheriff's deputies made an unannounced last call for all one of the co-owners was placed under arrest for providing indoor service in defiance of the restrictions here which has been designated an orange zone because of speaking covid cases. the owners declared their bar an autonomous zone so they could keep serving customers indoors by not charging for food or drinks and instead asking for donations. he addressed the crowd last night. >> in every city, in every town in america, this is how we make the change. >> [open up] reporter: well that crowd here last night chanting "usa" carrying signs supporting and singing the national anthem and demanding this business be allowed to reopen and this particular area where we are on staten island has been designated an orange zone. there are huge spike in cases here which is why local official s are so concerned but when you go down a few blocks into the yellow zone, there are other restaurants that are allowed to stay open, so that's why a lot of people are up in arms today. back to you. steve: that's exactly right. all right, laura thank you very much for the live report from staten island. let's go to washington d.c., and he represents the great state of florida, senator marco rubio, he's the chairman of the senate small business and entrepreneurship committee. senator good morning to you. >> good morning. thanks for having me on. steve: great to have you. you know, you represent florida which is wide open. the schools are open. the businesses are open. can you understand the frustration of business owners and parents, in fact, where their children are not allowed to go to school, in states like new york, where there is so much frustration and it seems like, you know, the restrictions to try to prevent people from getting the covid seems to be keeping people from making a living. >> yes, there's a couple things in play. number one i think the overall majority of people understand this virus is a problem, there's things we have to do to be careful about it and try to mitigate against the risk and there's things that we're going to have to restriction and be not be able to do. that said there are some things you're going to have to be able to do no matter what the risk is and one of those is make a living. people have to make a living. they have to work, provide for their families and to do that they need their kids to be in school, and their kid, by the way, also need to be learning. they can't afford, we can't afford to take a year off until we get a vaccine and not learn, so, our job, and public service whether it's in local, state, or federal, is to provide the resources and the pathway so we can do those things. now, the second problem here is the hypocrisy. okay? the hypocrisy of during the campaign, when trump had a rally with a bunch of people, after the campaign, when people took to the streets dancing, in the crowds, tightly-packed crowds celebrating because of biden, nobody said a word, and it's the same with the stuff now we've got these people that own a business, that put their whole live's work into it and you got some guy behind a zoom camera on television who gets paid to work from home, lecturing them about how they need to close their business, and not work and not employ people until they tell them it's okay to do it, so it's an enormous amount of hypocrisy and people are tired of it. ainsley: the denver mayor told people don't travel for thanksgiving and then he flies to mississippi to see his family. you got governor gavin newsom, you know what happened there, the austin mayor told people to stay-at-home on aideo, turns out that video was recorded down in mexico when he was on a vacation. so you're right about the hypocrisy. and i've heard it said every paycheck is essential. how do you pay your house payment? how do you pay for food for your kids or college without a paycheck? it's all essential. >> the biggest hypocrisy here and in places like new york is they arrest someone for trying to work, but then they raise thousands of dollars and ask others to give money to bail out people who are committing arson and burning police cars and vandalizing cities, so think about that. you've going to demonize people because they decide they are going to work but you're going to help bail out the heroic arsonists and looters. it's ridiculous and crazy stuff and that's what people are tired of. ainsley: yeah. brian, you take the next question. brian: so a couple of things. you were in charge of the ppp program you started it where people are told you got to stay home to stay safe so you'll get a paycheck anyway. number one, is there more money coming? why isn't all the money been spent? and number three is, the word of a bipartisan $900 billion stimulus package was signed off by chuck schumer and nancy pelosi yesterday with marco rubio also get behind that? >> well let me start with you the money, it's not that it wasn't all spent. every business that was eligible to apply was able to apply and there was money allocated left over. that means we didn't spend all the money which is good because we're able to take part of that money and use it for something else we don't have to do new spending which be deficit spending. in terms of the 900 billion, look i think it's a great start and we can build on it. i think on the ppp portion of it that goes a long way but it's missing, you know, it's missing some money and we're going to find ourselves if we don't put enough money to set aside enough money in the ppp program then by february or march we'll have a situation where you have small businesses who need it but can't get it because the money ran out so we want to avoid that sort of cliff that we faced the last time. brian: so you want more than 900 billion? >> no, no, 900 billion is for the total package. the ppp portion was about 200 they put in there. we really need closer to 259 billion. now, it may not all get spent because understand the only businesses that were qualified this time around are ones that can demonstrate a 25% revenue reduction. they've lost 25% or more of their revenue, so we've limited who can get it to the ones who really need it but, you know, a lot of businesses now either they aren't allowing you to operate or you're at the mercy of market conditions. you've basically got political leaders telling people don't go out, don't go shopping, don't eat at restaurants don't travel and don't go here or there so even if they allow you to stay open no one is coming, so you'll have a lot of small businesses go out of business forever and we should have done it a long time ago and the democrats play political games with it. steve: do you know what, senator , you just perfectly setup the sound bite with your governor. >> all businesses are open, we've had things like theme parks, beaches open for months and months. we have schools open, we have sporting events, and i think that for me, i think as you alluded to, a lot of these lockdowns have been very in effective. they have huge negative consequences and my view is that everybody is essential. who is government to say that your job is not essential? i think some of the stuff in march and april didn't work. i think you have to let people earn a living, and it's really not even government's role to say who could pick and choose. steve: but that's the problem. in some localities, the people in charge, whether it's a city or a state, they are figuring out who gets to win and lose. >> yeah and look, it's part they like the power and the ability to step in and tell people you can't do this or you can't do that and part of it is if you don't do it as a leader you get beat up and look, i think the perfect example is new york and florida. governor desantis in the state of florida is often characteriz ing the legacy media as some sort of covid disaster but new york has less people than florida, more cases, more deaths and nonetheless their governor wins an emmy because of his press conferences, i mean this is stupid and the kind of hypocrisy, again people see this stuff and they realize it. ainsley: all right, so, we want to ask you about the joe biden interview with the new york times. he hasn't even been sworn in yet and he's already blaming republicans for what he's not going to be able to get done. he says exactly how much he will get done will depend to a large degree on two things, biden noted. one is how republicans in the senate and house behave once trump is truly gone from power and the other is how mcconnell behaves if he continues to control the senate. your reaction? >> well, i think a lot of it will depend on how biden behaves is he going to fall in line with the radicals and the democratic party that are already insisting that right out of the gate we do the green new deal and all this other stuff, or is he going to try to get things done that both sides can agree on so it really depends on what he seeks to prioritize and what he wants to do. look i want to be clear with you guys and maybe some people watching won't like it. i'm not just going to be against stuff because joe biden is for it. if it's something i'm for and he's for my job is to do what's best for the country but we have to understand there are a lot of things he's for that i'm against and that's why i support donald trump and that's why i'm a republican and he has a lot of people around him far left that will push us in that direction. i'll tell you upfront. i've never told anybody i'm a liberal democrat. brian: you're not going to be happy what he does with iran he wants that deal back and to extend it so he says i want to go right back to the deal and removal of the trump sanctions. that sounds like a scary proposition. >> yeah, again, he's surrounded by people and people on his side of the aisle that the first thing they do is criticize his. listen over the weekend we had three democratic members of congress attend an event put on by an organization linked to hamas, and you heard cricket, nothing no reporting on it whatsoever. brian: who was it? always great to see you out of the nearly 250 wins in your career and the championships, where does this rank in terms of honors in your life? >> oh, brian, this is the highest honor in an award you could possibly receive, and i receive it with mixed emotions first of all, i'm humbled. there are many more people far worthy than me but i can assure you nobody is more appreciative than me so i'm excited to have this opportunity, but at the same time, i'm excited to receive it from president trump. a president i admire, respect, i think he did a tremendous job, i'm sad he's not going to be with us for another four years because he's done so much for this country and he genuinely cares about so i stand here very proudly to accept this award from president trump. brian: so your wife passed away about five months ago. what do you think she be saying today? >> well i wasn't aware that i was being nominated for this but my wife was. her comment from my secretary, please don't tell lou, i don't want him to be disappointed when he doesn't get it but you know, brian, this award does not define who i am. as prestigious as it is, as humbled as i am to receive it but it's my family and my friends that really define who you are and what your values are , what you stand for. you know, when the presidential medal of freedom, my father had a third grade education, was on welfare, food stamps, i was born in the cellar, but just i was born into this country and given the opportunity to believe and try to make a difference in people's lives and i think mark twain said it best. he said the two most important days in your life is one is the day you're born and the other is the day you discover why you're born and discover basically we're born to help other people because everybodies got problems, and still trying to get over the after-effects of covid and people having all kind of problems medically but also financially, employment, everybody needs some help and a kind word it's time we reached out to one another, and stop all of the bickering and blaming everybody else. i am humbled to receive this from president trump. brian: and you know, it's not all wins. you've had losses in your life. did you learn in times in which the jobs didn't work out like with the jets? did you learn along the way? >> brian that's part of life. we're going to get knocked down. when you get knocked down you got two choices. you stay down or you pick yourself up that's all part of it. life isn't going to go where it's easy for you but you have to learn that i just can't quit. quit is a permanent solution to a temporary problem. yeah, you get knocked down and you get back up and figure out why you didn't succeed and what changes you have to make, what do you have to do and redesign your plan. that's all part of life. nothing goes easy, that's one of the problems with people today. everybody gets a trophy, everybody is happy, and that's not life. life is getting up off the ground and overcoming obstacles, it doesn't matter what you achieve, it's what you had to overcome in order to do so. brian: coach, don't you think the people that allow them to play sports are actually showing that? finding out a way to overcome the testing, okay, your star player tested positive, put the next person in, right? >> absolutely, brian. i'd tell you, i learned more on the football field than i ever learned in a college class, you learn about sacrifice, working with other people, and your welfare for the overall welfare and good of the group, et cetera and the accomplishment you feel when you help somebody else be successful, and people say well i don't want my son to play football it's too dangerous i'm going to go buy him a motorcycle and oh, that's nice how did that work out? but i'll tell you it's all part of life, getting knocked down and adversity is part of life, and the minute you understand that, and accept it as i would tell the team every year we're going to have three crisis this year. i don't know when we're going to have three and then when we had one i'd say good news we only have two more to go because you react positively. you know you're going to have adversity. brian: coach i think that another thing that stands out about you reportedly, because i was stuck in soccer i don't know what i was thinking is that you cared as much for the last person on the roster than you did your heisman trophy contender. where does that come from? is it because you weren't the outstanding middle linebacker? >> you summed up that up, brian i wasn't a great football player but i was a great teammate. players come and go. teammates last a lifetime and i learned what it was like to not be the star and not be and get special treatment but care about everybody that is on that football team in a way and we had one rule for everybody and that was be the best you can be. brian: president's fighting pretty hard to make sure that this election came out in a justified way and he really feels as though it was taken from him. what's your message to the president about if it doesn't go his way? are you encouraging him to come back in four years? >> oh, absolutely, brian. i think we need him. you know, it's unbelievable what he went through for four years, overall the miss characterizations and russia russia russia, and the impeachment, et cetera. he fought it for four years and what he did for this country is fantastic. he, what he did i think is nothing short of amazing and i think he definitely goes down as one of the great presidents in my lifetime. brian: right so the family had the chance to enjoy the day and now you'll enjoy the morning and get the medal of freedom it's a lifetime achievement award not for a great football coach but for a great american who also served in the army. coach its been a pleasure having you contribute to the show. this is your last interview before you get the medal and we appreciate you being with us and please tell the president we said hello. >> i certainly will, brian and thank you for having me. i enjoy being with you so many times, your entire crew you're the best, thank you. brian: you were talking about me you like me better than the other two, is that right? i'm sorry, i know you're a high school student, you're a senior, 18 years old so i know sports extremely is important to you for scholarship purposes as well as many other things. what sports do you play? >> first two years in high school football, basketball and track, last i focused on just basketball and track and this year i was hopefully trying to do football and track and all three. ainsley: all right so sports on hold in california how does that affect you? >> yeah, it's extremely disappointing. i've had the opportunity to speak with multiple superintendents all up and down the state of california and they really spoke on the mental illness toll that it's giving on students all across the state. sadly, they brought up suicides in their own districts and it's a real thing that's happening right now. for myself, i know multiple teammates, myself, are finding little motivation in school right now and sports are really what keep us connected and engaged and into our schools and it's hurting right now. i know students that definitely wouldn't be in school right now if it weren't for sports. ainsley: wow so why is the school federation and these 10 commissioners why have they decided to do this because you have to weigh out all the risks. i understand the risk of covid but like you're saying suicide, scholarships, what about those risks why are they doing this? >> one thing that i need, that they should do, what i think they should do is take a look at the 40-plus other states that have allowed some high school activities to go on. if we take a deep dive into that we can find that we have the ability to do this safely. we can follow protocols and sadly, its become such an equity issue in the whole state. families that had the ability to get out of state before the school year started did so. they did it so their students can play their sports that they love. families that have the ability to send their students to different states every weekend, i mean, there's hundreds of travel teams leaving the state every week just to play their sport, and why not have that be through a proven school system that has the ability to follow plot o protocols where otherwise they wouldn't be there if we just continue to let the au teams travel teams, and even teams at the park happening and if we let schools take care of it, little-to-no transmission will occur. ainsley: i know your dad is a superintendent for a school district in california and you all talked about this a lot at the kitchen table, and what is he saying the reason is? >> one big thing that i want to make sure that's clear is that school districts want us to play. they aren't against us playing, but there's a fear of being sued , and one thing that i want to make sure that comes up in this interview is that there should be a waiver that's backed by the governor of california to protect school districts, protect cis. ainsley: yeah the parents cosign it right? and say i'm not going to sue you if my child gets covid playing football. >> exactly. ainsley: what is the governor saying about that, have you heard from him? >> no i actually plan on reaching out to the governor after this interview today. hopefully, to speak with him, really. i think there's a great possibility that will happen. ainsley: all right, thank you so much, you are so mature. well-above your years to do this and care about all your friends that want to get out there and play and their families. god bless you with your future and thank you. well we did reach out to the governor's office, gavin newsom 's office and we have not heard back. speaker pelosi taking heat accused of prioritizing pot legalization over covid relief. house minority leader kevin mccarthy is going to sound off on that, coming up, next. >> ♪ ♪ b republicans including our next guest accuse speaker pelosi of prioritizing marijuana over coronavirus relief, as democrats push a bill to legalize pot while millions of americans devastated by the pandemic wait for a deal. steve: all right house minority leader kevin mccarthy joins us right now, i believe from our nation's capitol. thank you very much, leader, for joining us. >> thank you, good morning. steve: it's all about priorities you may want to help people who are, you know, they don't have any money because of the pandemic but nancy pelosi wants to work on cannabis and cats as you tweeted. >> well that is so true, you know, 38 times since the summer the democrats have voted against any covid relief. with all the challenges america has right now, we think covid relief should be on the floor, but instead, the democrats put cats and cannabis this week. they are going to out law big tigers, and then they are going to legalize cannabis. they're picking weed over the workers. they're picking marijuana over helping the much-needed money we need to go forward. the small businesses that are closing. we look at what's happening to max public, maybe if they were named french laundry it be okay. steve: [laughter] >> i don't understand the double standards of what we see from these democratic leader s. how many times did speaker pelosi tell us we would not leave congress until we got some covid relief bill. that was months ago. there is a discharge petition on the floor that democrats can sign that they said they would and they haven't that would bring money to the small business workers. there is a number of times, but now they schedule the floor and they put cats and cannabis but not covid. ainsley: it's just unbelievable how do they not have a heart for these people that can't pay their bills right now and people are worried about losing their jobs. where do you stand when it comes to the stimulus package because i know pelosi and schumer are saying 908 billion, that bipartisan deal and mcconnell and mnuchin 500 billion, what do you say? >> i stand with mitch mcconnell and mnuchin because think about what we're doing here. it's even more. there's 138 billion that's already appropriated that is sitting there for small business workers, but pelosi won't let that go forward. there's more than 100 billion that's already been appropriated that would go to states that help them with their schools and the unemployment and others. we can do this in a systematic way to help those who need it without adding more money because we already have the money the democrats won't allow it to be spent. brian: yeah, i hope it's a bipartisan situation, she came down off 2.4, down to 1.8 and now she'll take 900 billion democrats and republicans work ing on it kevin i hope you guys get something done this week because they obviously feel the pressure to move and you're about to get even more power because the majority right now, the majority when you start in january, it could be from you told me the numbers 222 to 213 so they are going to be democrat s already deflecting from them and she's going to need republicans to pass anything, so maybe you guys can get together and lay the ground work for something bipartisan but something else is going on in california that is significant. your two-faced politicians are telling the people to do one thing and they are doing the exact other. here is bill mcgluan, from kttv over in california. he broke this story. >> i was tipped off about this by several people in the restaurant industry who were less than pleased because they say this is yet another glaring example of hypocrisy from our local politicians, so we've been trying to get an interview with supervisor all day long today, and they've been telling us, her campus has been telling us she's too busy in meetings all day long. it turns out that's not true because she just had an interview with another affiliate in la where she is playing the victim and essentially said she's getting death threats and she came here because she wanted to personally deliver the news to the restaurant that she was going to put them out of business. strange explanation. brian: she's talking about people going to outdoor dining and then go do outdoor dining like your. >> governor: after fond your mayor. what's your reaction to your state having -- steve: double standard. brian: it is. >> these double standards are despicable. if every restaurant in california would just change their name to the french laundry i guess it be okay because you have them, the mayor of san francisco, she was at the french laundry. the governor, he's at the french laundry with no masks sitting next to the medical lobbyists. it's okay if you're one of these elite democrats that dictate what you can do in your life, but not within their own, they can do whatever they want or maybe the mayor of austin that films that you should not while sitting in cancun. this is what makes america so mad. these are democratic leaders that think they are above everyone else and can tell us what to do, but again, they could do whatever they want. and in these socialist countries , these elitists and what do the workers need? what about those children who can't be in school that we can have resources to protect them, to help those who are unemployed , to help those small businesses? i was a small business owner. i know what it's like to have a dream, but to have government crush you in every aspect? [ muffled scream ] stop living with at&t. xfinity can deliver gig to the most homes. ainsley: american airlines completes its first test flight of the updated 737 max jet. the move hoping to boost confidence in the planes after they were grounded last year over two deadly crashes. grady trim bell from our sister network fox business is live at the dallas fort worth airport with a look at the new plane. reporter: good morning, ainsley. american will be the first major u.s. airline to fly passengers on the 737 max again later this month but before they do that they are offering demo flights to employees and that's what we took yesterday. we flew to tulsa, oklahoma, to the hanger where american is storing its 737 max, and that flight essentially felt like any other flight, that's what american, boeing and all of the airlines want people to see. the aircraft of course, has had wiring fixes and most notably, boeing updated the flight control system that was partially to blame for those two crashes in 2018 and 2019. the pilots of those planes will also receive several hours of training. at the tulsa airport where the max has been stored for the last several months, boeing or rather american has been doing regular maintenance on those planes. the coo of american tells us that this plane is safe and it's ready to fly again. >> i wouldn't get on this if the flight attendants and the mechanics said it wasn't safe, i'd tell my friends and family, i'd tell anybody it's a safe airplane to fly. reporter: united will reintroduce the plane in the first three months of next year. southwest, the largest u.s. operator of the max plane will do so in the second quarter of next year, and all of the airlines, ainsley, will let customers who don't feel comfortable flying on am just yet rebook to another flight. ainsley: all right well that's good news at least thank you so much, grady. steve over to you. steve: ainsley, thank you. grab your popcorn and buckle up because dukes of has and star john schneider is back on the big screen paying homage to the burt reynolds classic "smoky and the bandit." >> you can't drive to austin and pick up 400 cases of local and have it all back here within 24 hours. >> that was in the movie. it was 28 hours. steve: john's project it is streaming now and it is out on d vd, the film's director and star john schneider joins us right now, next to a vehicle, in a total stranger's driveway. what are you doing there? steve: i only have to buy for my wife because the kids get -- she buys for everybody. i took took care of her three weeks ago. brian: what's the budget limit? steve: with my wife unlimited. brian: good answer. steve: about 200. thanks for joining us on this thursday. anxiously, you are right. the week is flying by. listen, the coronavirus thing, you know, the highest death toll since the pandemic started, it was at 2733 yesterday. they say cancel everything. the mayor of los angeles does. he says unless it is essential don't do it right through christmas. here in the new york city area we have been telling you about a place called mac's public house pub in staten island. they have been defying governor cuomo's restriction us. in fact, a couple of days ago, daniel pretty was arrested. he is the guy runs the place, charged with obstructing duration city and state he has been operating. he referred to it, ainsley, he was operating in an autonomous zone which sounds familiar. he didn't have a license to selleck core which he was doing. and they busted him. look at the big protest last night. people supporting him. ainsley: about 2,000 people they say were out there on the streets. we interview him a lot the owner of atilis gym in new jersey. they did the same thing to him during the pandemic when they were closing down his shop. they were throughout protesting. they are really mad at cuomo. they were screaming out different words for him. they were saying defund the sheriff because they say that new york sheriff's department went in and arrested danny pressie. his attorney and danny were on with tucker last night. the attorney made an excellent point they divided staten island into two different sides the orange zonal and the yellow zone. this happens to be in the orange zone so you can't go indoors and dine. look, i have got to feed my family and pay for my workers. we can't keep going on like this. you go up the hill and a block and a half up the hill to another restaurant and can you go inside and eat. he says does the pandemic stop right there at the top of the hill? why are they allowed to serve and we're not, brian? brian: i had outs running our state on almost every level. politicians who don't know thousand run a business and don't care. they are doing it in our best interest. here is daniel presty th and his lawyer with tucker. >> we had a meeting inside yesterday. did have some guests in there sheriffs, came in. seems like a whole lot of them. we were really good with. they really cordial. after a while just wanted to take me out, a whole big ordeal. >> we're peacefully protesting no. rioting, no looting. peaceful protest. protesting and supporting business owners, local business owners. and danny and keith. and the actions they took to stand up for themselves and staten island and business owners everywhere. brian: he said i'm not going to be able to come back from. this what he said is i'm going to open up my doors and i'm not going to charge anyone. if you want to donate money to my place, about 40 bucks you can get food and get a drink. so they took his liquor license. the nypd he doesn't have a problem with. he says they have been great. the sheriff's office on the mandate you from the state. i'm sure these men and women wouldn't be doing this on their own go there in plain clothes and stop their business. these guys don't want to party. they actually just want to live and make a living. believe me, staten island is the canary in the coal mine. people looking around this country in california and texas and places like austin and looking around and seeing the oppressive way in which politicians are shutting them down, even though they have complied with their plexy glass and their spacing and their masks is way going over the limit. 37 states got mask mandates. everybody is complying the best they can. guess what in the numbers are still going up. so our economy tanks, businesses are destroyed. livelihoods trashed. and we're doing everything they want and the numbers are still going up. why can't we at least go down with a fight? steve: here is mike rowe last night on "the story." >> something amazing is going on right now. and you know, i think what's happening in staten island is sort of indicative of the old expression you can forgive people for being wrong or even for being stupid. but hypocrisy is a hard thing to get over. it's impacting people. people who would normally not say anything about it are shaking their head and saying jeesh, what is going on? they are leaving because something feels fundamentally wrong and the level of hypocrisy is rank and it stinks to high heaven. steve: we will speak to ian smith as ainsley mentioned a moment ago. he's the guy that runs the gym in new jersey, atill liz gym who has defied restrictions of governor murphy in new jersey. and, in fact, was at the mack's place in staten island last night. is he going to be with us in about an hour. speaking of hypocrisy, how about this i want to play you a mayor, the mayor of austin, texas, he is very clear this was on his facebook november 9th. it was so important to him he future out on his facebook page about staying home and not traveling. watch this. >> we need to, you know, stay home if you can. do everything you can to try to keep the numbers down. this is not the time to relax. we may have to close things down if we are not careful. steve: so he is very clear, steve adler is, the mayor of austin, don't travel. we have got to shut everything down. what we didn't realize until just last 48 hours is apparently he actually taped that when he was at his daughter's wedding in cabo san lucas in mexico after flying on a private jet with 8 people not all of them from his immediate bubble. and that particular image was of him at a timeshare in mexico telling the people of texas not to travel. ainsley: well, after he got caught by the local newspaper. they got a tip that he had the wedding and then they went as a family down to mexico. he does this video. you can't tell is he in cabo. there is a tv and fireplace in the background. you don't know that he is there at the beach and having a vacation. steve: maybe if there was a mexican. ainsley: or maybe a frozen drink in his hand on the beach he didn't want you to know. he got caught and now he has released a statement. he said i regret this travel. my fear this travel even having happened during a safer period could be used as some as justification for risky behavior. in hindsight and even though it violated no order it set a bad example for which i apologize. what makes people mad is that they are going on television and saying stay at home, gavin newsom, don't go unless it's essential. and then they are getting busted for doing the very thing they are telling you thought to do. that's why these bar owners down over in staten island. all over the place are upset. because what's good for me is not good for you what these politicians feel like are saying that bar in staten island, i wanted to add one more thing. they do have a go fund me page because they are getting fined thousands of dollars. brian: they lost their liquor license. ainsley: go fund me page. last check 45, $50,000. brian: they will need more than that if you feel as though his fight is your fight. i don't accept the apology from the governor, the from the mayor you have. i don't accept it from the mayor of san jose. you know exactly what you are doing. you didn't stumble into going the wrong way on juanway street that's a mistake. you knew exactly what you are doing. you got caught so you feel as though you can explain your way out of it. the other thing that they have even if they didn't make these transcription. they are still getting paid. when you give up your salary, your livelihood. when you got to call your bank and say i can't make that mortgage payment, and whether you have got to tell your lease holder i'm sorry i can't pay the rent, please don't gut my building and sell off my equipment. when you do that, then maybe i'll accept your apology. but you are not suffering at all. do you know who is suffering in the people in new york and business people in california when they have these oppressive mandates, huge taxes. you get almost no infrastructure. people are picking up and they are moving out. hp moved out yesterday. joe rogan who is almost as valuable moved out three months ago. out of california. chuck devore did the same thing. he used to be an assemblyman in california. he moved to texas. he weighed in. >> spectacular contempt for the voters. my understanding is that mayor adler's broadcast was actually broadcast from cabo san lucas in mexico where he was partying. he is saying have you got to stay at home but never mind the marge rita that's being served to me here at the resort in cabo. it's like are you kidding me? where do you get these people. brian: where do you get governors like in new york writes a book and international emmy i don't have enough money to hand out a vaccine. until the money gives me money even if i get a vaccine i'm thought handing it out. what about the mayor who says i'm shutting down schools and gave you 45 minutes notice. be patient, i don't really know how i'm going to reopen the schools which the cdc says shouldn't have been closed to begin with we are living amongst idiots and sadly they are in control and many people, not us, put them in power. steve: and ultimately it comes down to the people and if you don't like them, vote them out. that's what it always comes down to because that pretty much is the way they work for us and if we don't like what they're doing, goodbye. ainsley: the problem is some people don't trust the election system. steve: i have heard that. that's your point right here. griff jenkins is live in washington, d.c. and griff, the president was -- he didn't do a live event. he actually was on facebook and he was talking about the things ainsley was alluding. to say. griff: that's right. steve, ainsley and brian good morning. halder to believe just 11 days until the electoral college meets. two days after attorney general barr found no evidence of fraud to change the outcome of the election. but the president keeps on fighting. and it was a 46-minute video the white house released to social media. made without any members of the press present. but the president was repeating many of the unsubstantiated claims of voter fraud saying ultimately the election was stolen. geenchts right about the frawfd joe biden can't be president. we are talking about hundreds of thousands of votes. we are talking about numbers like nobody has ever seen before. just as an example in certain states. griff: meanwhile in michigan the president's legal team led by rudy giuliani and jenna ellis presented more witnesses with allegations of wrongdoing. >> i was standing by the tab buoy later machines and i could tell right away that most of those people didn't know what to do when the ballot gets tamped. >> double counting on the jams. i saw that several times take the ballots just scanned and scan them again. griff: some democrats are growing weary of the continuing legal battles. >> republican local leaders and clerks stood up and they certified their election. they stood by their work. and they are still having folks come in over their heads trying to pressure them. i give them a lot of credit. if you have a credible allegation, put up or shut up. griff: speaking of putting up in nevada the trump campaign in a court hearing today will contest the state certification alleging widespread voter fraud. steve, ainsley, brian? ainsley: all right. the president you are going to see him -- thanks so much, griff. you will see the president on saturday. he is going to georgia. the rnc is having that big rally and he is going to be speaking there to try to push these two republicans over the line. steve: i think 7:00 at night. ainsley: set your alarm. steve: i have a feeling you will be able to watch it right here on fox. the people down in georgia are -- the republicans are happy he is coming. they know that he's going to stand behind the two republicans who are running in the runoff election. buff they are apparently concerned about what else he might say. and so it will be interesting. and i bet you will see it right here on fox. brian: one thing pretty clear the president of the united states and lou holtz have really gotten along there is something like bobby hall and lou holtz the president is going to resip united states. started at william merry in 1969 nc state, went to the jets, went to arkansas and university of minnesota and then this place called notre dame and south carolina. together he has made a huge impact. great personality as a player and early on in his life and as a personality on espn and other places. here's a little look at lou holtz on our show. >> the main thing we have to decide as a country as a family, where do we want to go? it's to my son brenton j. raffensperger who passed away two years ago. brian: launching investigation into voter groups trying to register deceased or out of state voters ahead of the senate run off takes place january 5th. one of the groups under investigation the new georgia project stacey abrams is a key person in and chaired by the senate candidate raphael warnock. here with more is alanna goodman senior investigative reporter for the washington free beacon. now the secretary of state, who is a republican, is interested in voting fraud in his state. >> yeah. i think that he has been under a lot of pressure georgia voters are very concerned about voter fraud the powell rally when many georgians showed up. they have been voicing their concerns. and so the governor has to do something. his secretary of state announced earlier this week that they're looking into four groups. one of these is the new georgia project for voter registration irregularities and potential legal violations. this group the new georgia project was where raphael warnock who is running for the senate, was ceo until earlier this year. this could pose a big problem for raphael warnock in a state where voter fraud is a major concern. brian: yeah, i guess so. it's a major colonel now and there was a problem during the governor's race obviously. stacey abrams still hasn't admitted that she did lose. there is three organizations they're looking into. the new georgia project founded by abrams. the america votes and vote forward. there are 23 investigators working on 250 open investigations. and they could be looking at a felony or $100,000 fine. where do you think this is going to go or is this just a brush back pitch. >> i think that the campaign administration does have to answer allegations what specifically they're looking into on this and when these -- when the new georgia project was registering these voters out of state illegally which could rise to the level of the felony in the state. because warnock was there until earlier this year. i mean, he was serving as ceo from 2017 until this past february. so was he there when these incidents took place? i think that the secretary of state's office should definitely step up and respond to that. we have reached out to them for more information. and so far they have not wanted to comment further than what they have already said on this publicly. i also this new georgia project were under investigation back in 2014 for alleging filing over 200 fraud length ballots. and so this is not the first time that the group has had these issues and warnock has been involved with this group since 2014. so, i think that he does have to answer for this with georgian voters. brian: until somebody goes to jail. and it doesn't seem real. the threat isn't real. why not take the risk. here's a statement from the new georgia project goes like this. as georgians, we are turning out in record numbers to have their voices heard at the polls. the secretary of state is resorting to desperate attempts to smear law abiding organizations and scare eligible georgians from registering to vote in upcoming critical elections. we will not be deterred. so game on. we will see what happens. we know that the governor will be on with laura ingraham and i imagine the secretary of state is going to be on the guest list, too. thanks so evacuations are underway after two southern california brush fires explode overnight. deputies going door to door as the willow fire, dangerously grows near a san diego neighborhood. high winds steve. how are you today? steve: doing okay. something like only 42% of the country dry say they will not take the vaccine. and, yesterday, former presidents obama, bush and clinton all said they would get the shot on tv if that helped convince people to get it. we know that these millions of doses are coming. let's say i got it on december 15th. i'm still going to have to another shot at what point after the second shot will i be protected? >> that's a great question, steve. first of all, i think you will get some protection from the first shot. we don't know how much but a significant amount. after the second shot, you should be fully protected and we are talking about 95% protected within a couple weeks after the second shot. and what's really excited about how they are rolling this out, steve, they are going to try to protect nursing homes and healthcare workers. i will tell you why i like both of those decisions. steve, 6% of the cases of covid-19 are in nursing homes in this country. but 40% of the deaths are in nursing homes. and you know how the media spins that. so i'm very, very interested in protecting nursing homes. healthcare workers if i get the shot i will go on tv and say it's safe. it worked for me. i feel good now you get it and also healthcare workers taking carol of people at higher risk and we are getting a shortage of healthcare workers across the country taking care you have covid. very important two groups to get this right off the bat. steve: absolutely. in the meantime, you know, they told us don't travel for thanksgiving and now they're saying don't travel for christmas if you can help it. they -- the cdc has also changed the quarantine rules. now they say you can end your quarantine on day 10 without testing. or and on day seven after receiving a negative test. you know, the things they are saying now are different than what they were saying in the beginning, but then again, dr. siegel, we know so much more now than we did in the beginning. >> well, that's true, steve. as i write in my book, all of these reversals and the flip-flopping, specifically on the part of the centers for disease control, has spread a lot of fear here. and i don't really think that 14 days -- remember, if you are exposed to covid how long before you got sick it. never really made sense for 14 days when you consider the other recommendation which is if you actually have covid, you can go back into circulation after 10 days. so, i'm glad that they are changing the recommendations, but they flip flopped on masks, on schools, and now on this. we need a consistency here to get trust and confidence in our leaders. and the other point about gatherings is, you know, the biggest problem with traveling is not planes. study from the department of defense shows that planes seem to be pretty safe if you distance on planes. it's in the airport. it's coming to and from. if you are careful there is no reason you can't be very careful and still celebrate christmas which is hugely important to the american psyche as you know. i made one of your dishes by the way. steve: i hope so there is a whole holiday chapter. i saw something in the news this morning. it concerns your business. they're referring to it as the peamplpandemic effect. so many people are locked down. they have got more time. they are thinking about their futures. they're thinking about becoming doctors. in fact, applications to medical schools up something like 20% year over year. >> i'm very, very, very gratified to hear that. that's what happened after the hiv epidemic, too. it's so great. it's showing courage. they know full well that being on the front lines against covid a risk. it requires full equipment at all times. a lot of healthcare workers getting sick. this is showing the best part of america that we see this problem and we want to help. and people want to help. that's how i feel. that's how my brethren feel and more divided than they found it. but neither one of them inspired me to disassociate myself for this love for my country. i think this is a ridiculous premise if you are so weak minded and fragile heart that you can't love this country because of hot president is, you need to sit down, because if that -- if you are so scared to stand up for what you believe in when you are not winning, then you are not the person this country needs to fight for freedom or do what's right or stand in the gap while the rest of us are looking for you to lead or anything of that nature. i really don't understand. this i think this is more cannon fodder for the partisan side of things than reality. and i just couldn't imagine any one of sound mind thinking the american flag doesn't stand for them american flag can be reclaimed from trump. it's complicated. that's the big question. looking at one quote from chris told politico he took his flag down a year into the trump administration because he didn't want anyone in his neighborhood to associate him with president trump's racial rhetoric or anti-immigrant policies. >> yeah. if you read through this article, they lightly points out that most of these people they talk to live in places like seattle or, think one of them was georgetown, d.c. or something like that. if you associate the personal flag with donald trump. if donald trump has become synonymous with the american flag that's because his political foes have literal little burned it, turned it upside down, taken it down. knelt in front of it rather than honored it and completely disassociated themselves from it. this isn't like donald trump has hijacked the american flag when only one political party still understands the necessity of patriotism. that's not up to republicans or conservatives to fix that problem for them. but, i will tell you this. you know, if you think that the american flag divisive. you are the radical. not whomever you think that flag is associated with. steve: i just see the american flag. if i see somebody wearing a maga hat. okay that person supports donald trump. when i see the flag, i just see the flag, joey. >> yeah. listen, old glory doesn't care what your politics are. i have got news for you. old glory cares that you do your part that you fight for freedom and justice and that you take on your shared responsibility in keeping this country free and what it means for everyone. and that means fighting for what you believe in, even if i don't agree with that it certainly doesn't mean cowering, giving up, taking it down [chanting u.s.a.] >> voter groups with ties to prominent democrats under investigation. >> they were under investigation previously, too, back in 2014 for allegedly filing over 200 fraud lentsd ballots. >> today president trump will award the medal of freedom to former college football coach lou holtz best known for leading notre dame to a national championship win. >> jingle bell, jingle bell, jingle bell rock brian: threw are looking at our great tree. it's red, white, and blue and means it's safe to celebrate christmas and thanksgiving in our rear view mirror. i do have some news though. the marine corps is asking for the public to help because toys for tots is down on donations. and there is a huge demand because of the economic dire straits that we are in right now for kids to get presents so somehow we have got to spur into action and help out the marines who always help out the kids in this country. steve: absolutely. ainsley: can you send something through amazon. >> toys for tots.org. you select an age range and drag your favorite gift into the virtual box. they will take care of it. a little challenge now getting around. steve: not just that but for years businesses like this one included, have had great big big boxes at the front of the building so that you could drop the toys off. they don't want you to touch the toys this year. they don't want you to bring them. in and that's wide it's all virtual and that's why they need your help. ainsley: something good to do for your children. have your kids pick something out online and drag it into the basket they have made it pretty easy for you. thanks, brian, for that suggestion. griff jenkins is in washington as the president delivers a fiery white house address. he posted it on facebook 46 minutes long. is he alleging mask voter fraud tell us more about it. griff: good morning. the president keeping on fighting even in the wake of his own attorney general bill barr finding no evidence of fraud that would change the outcome of the election. this 46-minute video was made without any members of the press present but released to social media. the president repeated many of the same unsubstantiated claims of widespread voter fraud and he hopes at this point that the supreme court will intervene. watch. >> what a disaster this election was. a total catastrophe. but we're going to show it and hopefully the courts in particular, the supreme court of the united states will see it. and respectfully, hopefully they will do what's right for our country. griff: meanwhile in michigan the president's legal team led lie rudy giuliani and jenna ellis presented more witnesses with more allegations of voter fraud. >> i was standing by the tabulator machines and i could tell most o right away most of e people didn't know what to do when a ballot gets jammed. >> the tabulators did see the double counting on the jams. i saw that seller times. they would take the ballots that were just scanned and scan them again. griff: as the legal battles continue, some members of congress, democrats are getting weary of the continued fight. watch. >> republican local leaders and clerks stood up and they certified their election. they stood by their work and they are still having folks come in over their heads trying to pressure them. so i have given them a lot of credit. if you have a credible allegation, put up or shut up. griff: the trump campaign is putting up in nevada today. the court hearing they will be presenting some 15 witnesses and lots more allegations of voter fraud. we will see where that goes. of course, w we will hear from e president by saturday and you can expect to hear more of the continued fight. brian, ainsley, steve? brian: all right. thanks so much, griff. the president wants to preserve his legacy the best thing for him would be to get a republican senate and that would be in his hands because there is two open seats. that's griff jenkins the latest there meanwhile, let's bring in governor mike huckabee, fox news tributer, former g.o.p. presidential canada. author of the three cs that made america great christianity, capitalism and the constitution. a lot of people come forward and a lot of affidavits signed. it doesn't seem to be the number that would overturn the election according to the department of justice. today it all shifts to nevada where joe biden won the six electoral college delegates before certification. how is this whole process going because, governor, when it comes to wins and losses, the president seems to be getting a lot of losses. >> well, he does. but in many cases, brian, it's because, you know, i keep hearing people say there is notified. yet, they have hundreds and hundreds of affidavits of people sworn to tell the truth under penalty of perjury which means if they're proven to be liars about this, they go to prison. they are coming forward. is it enough to change the election? i don't know. frankly, nobody knows because nobody is being willing to get into the details of how many votes actually could have been changed by the voting machine irregularities. the mathematical anomalies. there are just a lot of questions. so, i don't know that it would change it. i just don't know. but the fact is we can't know unless someone digs in to how many ballots were lost in the chain of possession. that's a big issue. how many different pieces of software were used. we have a number of people with sworn affidavits and i hear people say there is no evidence. it's unsubstantiated. well, then somebody is lying. because there is some evidence out there. i don't know how we get to the boss of it, no. steve: we did hear from bill barr when he said the other day to the associated press. he said there was no -- they had not seen systemic widespread fraud that would have overturned the election. but they did -- he also said that the department of justice did look to see if there had been systemic fraud and looked into the allegation that some machine somehow flipped votes. and they said there was no evidence of that. but, moving on, and brian touched on this a moment ago. part of the president's legacy will be to make sure that a democrat senate does not tear apart the things he has got in place right now. in fact, the president tweeted i will be going to georgia for a big trump rally in support of our two great republican senators, david and kelly. they are fantastic people who love their country and love their state, we must work hard and be sure they win. so, he is all in on going down on saturday night. how much can he help them, given the fact that, you know, his race, he feelings, is unsettled but he would like to help them with theirs? >> well it, shows a great unselfness on his support. an understanding that his role is not over. even if the election is. you will i think it also shows that he recognizes that his duty to the country is to make sure that chuck schumer, nancy pelosi, and joe biden don't just run ram shot over the process of our whole country. they have said they don't agree with the america' america presis view of america first. i wish they would tell us which country they would put first if it's not the united states. let us know which one is better than us? which one do they have a greater level of responsibility for? many of us have appreciated the president saying america first. it's put people back to work. it's grown our economy. retired people have better 401(k)s because of it. i just like to know if these two senate candidates in georgia don't want to put america first, who do they want to put first? brian: joe biden wants to use that line now. is he using it. >> good for joe. ainsley: tough watch this sunday night because at 6:45 eastern we are going to have special coverage of that georgia run off debate between senator kelly loeffler and raphael warnock. so stay tuned for that let's move on to another topic we wanted to you ask you about. this is the austin mayor telling people on november 9th to stay at home, if they can. watch this. >> and we need to, you know, stay home, if you can. do everything you can to try to keep the numbers down. this is not the time to relax. we may have close things down if we're not careful. ainsley: turns out governor though he made that announcement from mexico. he was on a family vacation. his daughter got married. the whole family takes a private plane down to mexico and is he telling his constituents. his people in austin to stay at home. he says after he got caught i regret this travel. my fear is that this travel, even having happened during a safer period, could be used by some as justification for risky behavior in hindsight and ingeg though it violated no order it set a bad example for which i apologize. you were governor, i have heard you talk about it before who said i was working at christmas. he came in and was working at christmas too. he said why are you here? he said i'm never going to do something i'm asking you to do. your thoughts? >> as i just said and you mentioned, leaders never ask others to do what they are unwilling to do. this guy was asking the people of austin to do something that he wasn't willing to do. he's not a leader. and i will tell you, he is ordered to stay home. i've got news what he should do is resign and then he can stay home. can he stay home for the rest of his life. but anyone who has done this to the people of austin and shut them down but he doesn't shut himself down, he ought to do the honorable thing, the right thing, he should resign and let someone be mayor who won't tell people to do what he didn't do. his message to them was basically let them eat cake. and in his case it was wedding cake. brian: governor, i know there is a lot of responsibility when you are the governor of a state. when you say to these leaders these mayors and governors that have owe preserve restrictions on while they get paid. governor newsom, the mayor in san francisco, the assembly woman in santa monica. this austin mayor. i mean, you have tough decisions when you are in charge, i get it. but, at this point, why should the american people listen to these politicians? >> well, they shouldn't. they ought to listen to their own good common sense and take precautions and be careful. covid is real. it's killing people. i lost a dear friend of mine, a former staff member with me at the governor's office monday night who died of covid. it's serious. and people are being injured by it. but what i would say is that when people shut down businesses and entire economies, the government officials who make the decision should not take a paycheck until the people that they have shut down are allowed to take theirs. that will give a much different perspective to the people who are making these decisions and, again, that's lead by example. go be the first person out there on the battlefield and the last one to put your feet up from that ground of battle. that's what leaders do. and these guys aren't leaders. and, if they were, they would be managing this very differently. steve: all right. governor mike huckabee joining us from his location, i believe, in the panhandle of florida. governor, thank you very much. >> yes. thank you. steve: it is a dozen minutes now after the top of the hour. and jillian joins us with news from florida. jillian: a florida police officer is expected to recover after being shot in a gun battle. >> frankly very strong case out here in nevada. where do i start, brian? we had over 42,000 duplicate addressed individuals who actually obviously voted more than once numerous things had taken place. one of the things i wanted to talk about here we have evidence of actual numerous instances of fraud. when we are able to match up the data, birth and address and voter registration number there are numerous different cases of issues that have transpired and one i want to talk about. we actually have a whistleblower who worked united states postal service who unfortunately not able to testify because of usps did not allow him to do so, this individual, excuse me, and actual instances of them being told not to do certain things, obviously from the postmaster, you know, from the local postmaster, these are top i we are talking about. i want to focus on the actual hard evidence, brian, because i want to be exact with these papers. we have 19218 nevada voters who have non-nevada mailing addresses. there is another 42,284 voters who voted twice. i want to be specific on that number because these were individuals who have multiple voter registration numbers associated with substantially the same name, birth date and address. we. brian: so you are presenting this today, chris, duplicate ballots. >> yes. brian: the wrong address, and having said that you are down by about 35,000 votes. is this going to make up the difference? >> look, it certainly can. we certainly have enough astrong enough case to be able to certainly turn this thing around in nevada. we have hard evidence of that between cash for votes. between the duplicate votes, between actual physical evidence of individuals voting with coming to fake addresses. with coming to addresses that really don't address. we have tons of data and information that substantialically support that information. brian: chris, you will be in courts today you earlier brought up the signature verifications too loose. nevada was one of these battle ground states that just mailed out ballots unsolicited to everybody because it was too dangerous, according to the democratic governor, for people to actually show up and vote in person. like new jersey. so, this is a stated the president was hoping to win. >> yes, 8 times more. brian: you will have your hearing today, right? >> absolutely right. we have a great team here. [chanting open up] steve: hundreds, perhaps more, rally in staten island overnight to support a bar owner who was arrested for keeping his business open. laura ingle joins us live with the backlash from staten island. hey, laura. >> hey there, you know, here at mac's public house, all things are quiet here. it's very early in the morning. man, it was very large and loud. crowds here last night with a large group of protesters here to protest what happened here on tuesday night when the bar's owner was taken away in handcuffs and the business was closed down with sheriff's deputies saying that the bar had to close because they were violating coronavirus restrictions. and we have some video to show you of what the seen looked like here last night as hundreds swarmed the staten island street to show their support for the owners of mac's pub with one of the owners as you see being led away in cuffs under arrest for providing indoor service in defiance of the restrictions here which has been designated an orange zone in this particular area of staten island because of spiking covid cases. the owners declared their bar an amazon sayautonomous zone. the owner explains what went down tuesday. >> we were peaceful, quiet, respectful. they gave us $50,000 in fines throughout the building. and wind up arresting danny and putting him in handcuffs and charging him with disorderly conduct when he never raised his voice. steve: laura, thank you very much for that live report from staten island. well, our next guest was actually at that rally last night. he was one of the faces in that crowd. and he knows first hand about defying state restrictions to save his business. atilis gym co-owner ian smith has had his gym shut down and boarded up by local officials. and he has also been arrested for trying to keep his business open and alive. and ian smith joins us right now from atill liz gym in belmar, new jersey, ian, good morning to you. >> good morning. steve: why were you there and what were people saying about the guy who was trying to keep his business afloat? >> i was there because frank and i received an overwhelming amount of love and support and that really helped us stay strong and it helped us stay open. you know, we have been open ever since. so it's my duty to return the favor and encourage every other small business owner. it's a scary thing to open up against the government. and i wanted to be there to much support and input for danny and his partner. and just encourage him that he is doing the right thing. the crowd was amazing. they are supportive. they were there and everybody is just sick and tired of these lockdowns that are nonsensical that are hit or miss for some people and people are just getting getting very, very fed up. you will start to see a lot of that in the coming days and weeks. steve: your story came to us from belmar at the height of the lockdown because we're all worried about coronavirus. it can impact impact and in fact has impacted most families. somebody knows somebody in their family or friends who have contracted covid. it's serious. at the same time, these across the board lockdowns that locked you down, you know, you didn't wind -- you wound up with zero money coming in for how long? >> we have -- we haven't charged any of our members since april 1st. we still don't charge because governor murphy took our business license from us. and the new jersey court system so we are still in the process. we rely strictly on donations at this point. you know, and it's -- the lock junes have been proven not to work. they didn't work the first time around. cases are up because test something up. deaths are down. they keep singing the same song over and over again. it's less believable and credible every time. and people are just -- people are done with it. i encourage every single small business in america to do exactly what danny did. do exactly what frank and i did. do exactly what all these other businesses who are standing up and saying enough is enough. because the reality is, once we hit a critical point of businesses that open and a certain amount of them open, there is not enough health departments. there is not enough schiffs, there is not enough police officers to come and arrest us all. this thing will be over overnight. we can get back to life in a sensible manner. i'm not saying just open with no procedures. follow a plan and open safely and get back to life the way it's supposed to be. steve: ultd matsly, ian, what you and the folks there at atilis did was, you know, despite the lockdown, you are trying to figure out how can we open our business and be safe about it to keep everybody safe you have had something like 75,000 people come back since you reopened not one case of covid heeble traced back to the atilis gym. guesses need to be problem solvers. they look at the restrictions the government puts on them as long as they don't shut them down okay this is how can i safely operate my business so i don't go under. >> yeah. it's about common sense. you know, if you look at the fact that amazon and walmart and all these places are still running, do you think there is not cases linked back to that? i will start with you. >> democrats did forget rural america but they don't have policies that resonate with rural america. ainsley. under donald trump rural america was doing great. we had opportunity higher wages under the trump era than at any time in recent history. that's really important. they want to make sure they have a president that's going to fight for them for better trade deals. we are sick of our jobs going over to foreign countries not because people do things better or cheaper than us. they beat us because they cheat us. and donald trump fought to make sure we were going to be treated fairly. that really resonates with rural voters. i look at the gun issue. we love guns. and it's a culture of communities that have guns and respect guns. fathers teach sons, mothers teach daughters. when you want to take away our guns that shows that you didn't just forget us, you don't have any respect for us and our culture and way of life. brian: they are taking your ammo. that's how they are stopping you from having guns. everyone has been quite aware of that joe biden did in his interview with thomas freidman one thing he says i'm so proud of myself. i feel like i have done something good for the country by, guess what? as we roll the prompter forward i haven't memorized the column. by making sure that donald trump is not going to be president for four more years. but there has been no moment of elation. it's just one of those moments. there is a lot of work to do. i'm just focused on getting some things done as quickly as i can. if he can't get it done, guess who he blames? and i wanted their self-talk to be 4 to 6. which is the length of play of relentless focus and effort. that means don't worry about mistakes. all that matters is 4 to 6 second window. ainsley: some parts are out on the field and some are behind the scenes. what did you learn? what was the favorite thing you learned with him, dan, when you stood up with him in that interview? >> my favorite thing, ainsley, you look at this bolder and all you see is the success. what coach and i would say everybody else that i interviewed their resilient spirit and what they do when it doesn't go their way is ultimately is what defines them and defines all of us. and to be able to share this real life advice from heroic people to help every day folks overcome their challenges, chase and hopefully catch their dreams was such a blessing. and just their mindset toward adversity, i think, is their greatest strength and as coach said faith and family and our freedoms are a huge part of this show. ainsley: yes. coach, tell the folks at home that story about being at florida when tim tebow was with you and how you felt lost and how you overcame that. >> i think what happens billy donovan was my neighbor in florida he won the national title i believe it was 2006. and we followed up with it national champs right behind. and what happens a lot of people worked so hard. you put your whole life on a 10 year sprint, 20 year sprint to win it. and life is supposed to get easier. it's not. as a matter of fact, it gets more complicated when you do reach the top of the mountain. then comes the expectation. it takes a little bit of the joy away from the every day of the grind that to climb the mountain is a grind. it takes energy and passion to sustain it's just fatigue. ainsley: what was the highlight of your career? >> oh, there has been so many. i think the highlight of my career might have been the last national championship i such a strong family man. a lot of times they won't let your family on stage because there is no room. i made sure that family was there and we all got to hold that trophy together representing our home state. ainsley: it's so powerful. i hope everyone goes home and watches it. dan you have your book fox nation, folds of honor. you served our country and still continue to do that. i will let you have the last word. >> i would just say that we're all struggling. right? reporter: good morning, guys well it is the early morning quiet here on staten island as businesses are about to open, but the one here behind me, max public house, as we've been talking about will not be one of them after one of the co-owners of the bar was arrested tuesday the business shutdown after violating coronavirus restrictions. we've been talking about what happened here last night on the street. take a look at what went down last night as hundreds swarmed the staten island street to show their support for the owners of max pub after new york city sheriff's deputies made an unannounced last call for all one of the co-owners was placed under arrest for providing indoor service in defiance of the restrictions here which has been designated an orange zone because of speaking covid cases. the owners declared their bar an autonomous zone so they could keep serving customers indoors by not charging for food or drinks and instead asking for donations. he addressed the crowd last night. >> in every city, in every town in america, this is how we make the change. >> [open up] reporter: well that crowd here last night chanting "usa" carrying signs supporting and singing the national anthem and demanding this business be allowed to reopen and this particular area where we are on staten island has been designated an orange zone. there are huge spike in cases here which is why local official s are so concerned but when you go down a few blocks into the yellow zone, there are other restaurants that are allowed to stay open, so that's why a lot of people are up in arms today. back to you. steve: that's exactly right. all right, laura thank you very much for the live report from staten island. let's go to washington d.c., and he represents the great state of florida, senator marco rubio, he's the chairman of the senate small business and entrepreneurship committee. senator good morning to you. >> good morning. thanks for having me on. steve: great to have you. you know, you represent florida which is wide open. the schools are open. the businesses are open. can you understand the frustration of business owners and parents, in fact, where their children are not allowed to go to school, in states like new york, where there is so much frustration and it seems like, you know, the restrictions to try to prevent people from getting the covid seems to be keeping people from making a living. >> yes, there's a couple things in play. number one i think the overall majority of people understand this virus is a problem, there's things we have to do to be careful about it and try to mitigate against the risk and there's things that we're going to have to restriction and be not be able to do. that said there are some things you're going to have to be able to do no matter what the risk is and one of those is make a living. people have to make a living. they have to work, provide for their families and to do that they need their kids to be in school, and their kid, by the way, also need to be learning. they can't afford, we can't afford to take a year off until we get a vaccine and not learn, so, our job, and public service whether it's in local, state, or federal, is to provide the resources and the pathway so we can do those things. now, the second problem here is the hypocrisy. okay? the hypocrisy of during the campaign, when trump had a rally with a bunch of people, after the campaign, when people took to the streets dancing, in the crowds, tightly-packed crowds celebrating because of biden, nobody said a word, and it's the same with the stuff now we've got these people that own a business, that put their whole live's work into it and you got some guy behind a zoom camera on television who gets paid to work from home, lecturing them about how they need to close their business, and not work and not employ people until they tell them it's okay to do it, so it's an enormous amount of hypocrisy and people are tired of it. ainsley: the denver mayor told people don't travel for thanksgiving and then he flies to mississippi to see his family. you got governor gavin newsom, you know what happened there, the austin mayor told people to stay-at-home on aideo, turns out that video was recorded down in mexico when he was on a vacation. so you're right about the hypocrisy. and i've heard it said every paycheck is essential. how do you pay your house payment? how do you pay for food for your kids or college without a paycheck? it's all essential. >> the biggest hypocrisy here and in places like new york is they arrest someone for trying to work, but then they raise thousands of dollars and ask others to give money to bail out people who are committing arson and burning police cars and vandalizing cities, so think about that. you've going to demonize people because they decide they are going to work but you're going to help bail out the heroic arsonists and looters. it's ridiculous and crazy stuff and that's what people are tired of. ainsley: yeah. brian, you take the next question. brian: so a couple of things. you were in charge of the ppp program you started it where people are told you got to stay home to stay safe so you'll get a paycheck anyway. number one, is there more money coming? why isn't all the money been spent? and number three is, the word of a bipartisan $900 billion stimulus package was signed off by chuck schumer and nancy pelosi yesterday with marco rubio also get behind that? >> well let me start with you the money, it's not that it wasn't all spent. every business that was eligible to apply was able to apply and there was money allocated left over. that means we didn't spend all the money which is good because we're able to take part of that money and use it for something else we don't have to do new spending which be deficit spending. in terms of the 900 billion, look i think it's a great start and we can build on it. i think on the ppp portion of it that goes a long way but it's missing, you know, it's missing some money and we're going to find ourselves if we don't put enough money to set aside enough money in the ppp program then by february or march we'll have a situation where you have small businesses who need it but can't get it because the money ran out so we want to avoid that sort of cliff that we faced the last time. brian: so you want more than 900 billion? >> no, no, 900 billion is for the total package. the ppp portion was about 200 they put in there. we really need closer to 259 billion. now, it may not all get spent because understand the only businesses that were qualified this time around are ones that can demonstrate a 25% revenue reduction. they've lost 25% or more of their revenue, so we've limited who can get it to the ones who really need it but, you know, a lot of businesses now either they aren't allowing you to operate or you're at the mercy of market conditions. you've basically got political leaders telling people don't go out, don't go shopping, don't eat at restaurants don't travel and don't go here or there so even if they allow you to stay open no one is coming, so you'll have a lot of small businesses go out of business forever and we should have done it a long time ago and the democrats play political games with it. steve: do you know what, senator , you just perfectly setup the sound bite with your governor. >> all businesses are open, we've had things like theme parks, beaches open for months and months. we have schools open, we have sporting events, and i think that for me, i think as you alluded to, a lot of these lockdowns have been very in effective. they have huge negative consequences and my view is that everybody is essential. who is government to say that your job is not essential? i think some of the stuff in march and april didn't work. i think you have to let people earn a living, and it's really not even government's role to say who could pick and choose. steve: but that's the problem. in some localities, the people in charge, whether it's a city or a state, they are figuring out who gets to win and lose. >> yeah and look, it's part they like the power and the ability to step in and tell people you can't do this or you can't do that and part of it is if you don't do it as a leader you get beat up and look, i think the perfect example is new york and florida. governor desantis in the state of florida is often characteriz ing the legacy media as some sort of covid disaster but new york has less people than florida, more cases, more deaths and nonetheless their governor wins an emmy because of his press conferences, i mean this is stupid and the kind of hypocrisy, again people see this stuff and they realize it. ainsley: all right, so, we want to ask you about the joe biden interview with the new york times. he hasn't even been sworn in yet and he's already blaming republicans for what he's not going to be able to get done. he says exactly how much he will get done will depend to a large degree on two things, biden noted. one is how republicans in the senate and house behave once trump is truly gone from power and the other is how mcconnell behaves if he continues to control the senate. your reaction? >> well, i think a lot of it will depend on how biden behaves is he going to fall in line with the radicals and the democratic party that are already insisting that right out of the gate we do the green new deal and all this other stuff, or is he going to try to get things done that both sides can agree on so it really depends on what he seeks to prioritize and what he wants to do. look i want to be clear with you guys and maybe some people watching won't like it. i'm not just going to be against stuff because joe biden is for it. if it's something i'm for and he's for my job is to do what's best for the country but we have to understand there are a lot of things he's for that i'm against and that's why i support donald trump and that's why i'm a republican and he has a lot of people around him far left that will push us in that direction. i'll tell you upfront. i've never told anybody i'm a liberal democrat. brian: you're not going to be happy what he does with iran he wants that deal back and to extend it so he says i want to go right back to the deal and removal of the trump sanctions. that sounds like a scary proposition. >> yeah, again, he's surrounded by people and people on his side of the aisle that the first thing they do is criticize his. listen over the weekend we had three democratic members of congress attend an event put on by an organization linked to hamas, and you heard cricket, nothing no reporting on it whatsoever. brian: who was it? >> i don't know all three of their names, i guess talib, to be honest with you i read the article so i don't want to misstate who was there, but i forgot who the other two were, but talib it's widely-reported i think one of them, the one from minnesota both took down her twitter post about all of this. look, again, no reporting about it whatsoever. radical event, attendance at this radical event it's the kind of stuff all going off media reporting by the way and some outlets but not in the widespread media. these are elements within the democratic party that have a voice, and are going to push the democratic party in a certain direction, so if that's the kind of stuff we see from a biden administration, yeah, i'm going together against it. steve: well let's see what happens senator marco rubio joining us from washington. sir, thank you very much. >> thank you so much. steve: all right later on today, president trump is going to award legendary football coach l ou holtz with the presidential medal of freedom there they are together sharing a laugh out on the tarmac but first the coach brings us his h-game to fox & friends, he's been on the show a lot. introducing a revolution in the world of pain relief: new advil dual action. advil targets pain at the source. acetaminophen blocks pain signals. new advil dual action with acetaminophen. always great to see you out of the nearly 250 wins in your career and the championships, where does this rank in terms of honors in your life? >> oh, brian, this is the highest honor in an award you could possibly receive, and i receive it with mixed emotions first of all, i'm humbled. there are many more people far worthy than me but i can assure you nobody is more appreciative than me so i'm excited to have this opportunity, but at the same time, i'm excited to receive it from president trump. a president i admire, respect, i think he did a tremendous job, i'm sad he's not going to be with us for another four years because he's done so much for this country and he genuinely cares about so i stand here very proudly to accept this award from president trump. brian: so your wife passed away about five months ago. what do you think she be saying today? >> well i wasn't aware that i was being nominated for this but my wife was. her comment from my secretary, please don't tell lou, i don't want him to be disappointed when he doesn't get it but you know, brian, this award does not define who i am. as prestigious as it is, as humbled as i am to receive it but it's my family and my friends that really define who you are and what your values are , what you stand for. you know, when the presidential medal of freedom, my father had a third grade education, was on welfare, food stamps, i was born in the cellar, but just i was born into this country and given the opportunity to believe and try to make a difference in people's lives and i think mark twain said it best. he said the two most important days in your life is one is the day you're born and the other is the day you discover why you're born and discover basically we're born to help other people because everybodies got problems, and still trying to get over the after-effects of covid and people having all kind of problems medically but also financially, employment, everybody needs some help and a kind word it's time we reached out to one another, and stop all of the bickering and blaming everybody else. i am humbled to receive this from president trump. brian: and you know, it's not all wins. you've had losses in your life. did you learn in times in which the jobs didn't work out like with the jets? did you learn along the way? >> brian that's part of life. we're going to get knocked down. when you get knocked down you got two choices. you stay down or you pick yourself up that's all part of it. life isn't going to go where it's easy for you but you have to learn that i just can't quit. quit is a permanent solution to a temporary problem. yeah, you get knocked down and you get back up and figure out why you didn't succeed and what changes you have to make, what do you have to do and redesign your plan. that's all part of life. nothing goes easy, that's one of the problems with people today. everybody gets a trophy, everybody is happy, and that's not life. life is getting up off the ground and overcoming obstacles, it doesn't matter what you achieve, it's what you had to overcome in order to do so. brian: coach, don't you think the people that allow them to play sports are actually showing that? finding out a way to overcome the testing, okay, your star player tested positive, put the next person in, right? >> absolutely, brian. i'd tell you, i learned more on the football field than i ever learned in a college class, you learn about sacrifice, working with other people, and your welfare for the overall welfare and good of the group, et cetera and the accomplishment you feel when you help somebody else be successful, and people say well i don't want my son to play football it's too dangerous i'm going to go buy him a motorcycle and oh, that's nice how did that work out? but i'll tell you it's all part of life, getting knocked down and adversity is part of life, and the minute you understand that, and accept it as i would tell the team every year we're going to have three crisis this year. i don't know when we're going to have three and then when we had one i'd say good news we only have two more to go because you react positively. you know you're going to have adversity. brian: coach i think that another thing that stands out about you reportedly, because i was stuck in soccer i don't know what i was thinking is that you cared as much for the last person on the roster than you did your heisman trophy contender. where does that come from? is it because you weren't the outstanding middle linebacker? >> you summed up that up, brian i wasn't a great football player but i was a great teammate. players come and go. teammates last a lifetime and i learned what it was like to not be the star and not be and get special treatment but care about everybody that is on that football team in a way and we had one rule for everybody and that was be the best you can be. brian: president's fighting pretty hard to make sure that this election came out in a justified way and he really feels as though it was taken from him. what's your message to the president about if it doesn't go his way? are you encouraging him to come back in four years? >> oh, absolutely, brian. i think we need him. you know, it's unbelievable what he went through for four years, overall the miss characterizations and russia russia russia, and the impeachment, et cetera. he fought it for four years and what he did for this country is fantastic. he, what he did i think is nothing short of amazing and i think he definitely goes down as one of the great presidents in my lifetime. brian: right so the family had the chance to enjoy the day and now you'll enjoy the morning and get the medal of freedom it's a lifetime achievement award not for a great football coach but for a great american who also served in the army. coach its been a pleasure having you contribute to the show. this is your last interview before you get the medal and we appreciate you being with us and please tell the president we said hello. >> i certainly will, brian and thank you for having me. i enjoy being with you so many times, your entire crew you're the best, thank you. brian: you were talking about me you like me better than the other two, is that right? i'm sorry, i know you're a high school student, you're a senior, 18 years old so i know sports extremely is important to you for scholarship purposes as well as many other things. what sports do you play? >> first two years in high school football, basketball and track, last i focused on just basketball and track and this year i was hopefully trying to do football and track and all three. ainsley: all right so sports on hold in california how does that affect you? >> yeah, it's extremely disappointing. i've had the opportunity to speak with multiple superintendents all up and down the state of california and they really spoke on the mental illness toll that it's giving on students all across the state. sadly, they brought up suicides in their own districts and it's a real thing that's happening right now. for myself, i know multiple teammates, myself, are finding little motivation in school right now and sports are really what keep us connected and engaged and into our schools and it's hurting right now. i know students that definitely wouldn't be in school right now if it weren't for sports. ainsley: wow so why is the school federation and these 10 commissioners why have they decided to do this because you have to weigh out all the risks. i understand the risk of covid but like you're saying suicide, scholarships, what about those risks why are they doing this? >> one thing that i need, that they should do, what i think they should do is take a look at the 40-plus other states that have allowed some high school activities to go on. if we take a deep dive into that we can find that we have the ability to do this safely. we can follow protocols and sadly, its become such an equity issue in the whole state. families that had the ability to get out of state before the school year started did so. they did it so their students can play their sports that they love. families that have the ability to send their students to different states every weekend, i mean, there's hundreds of travel teams leaving the state every week just to play their sport, and why not have that be through a proven school system that has the ability to follow plot o protocols where otherwise they wouldn't be there if we just continue to let the au teams travel teams, and even teams at the park happening and if we let schools take care of it, little-to-no transmission will occur. ainsley: i know your dad is a superintendent for a school district in california and you all talked about this a lot at the kitchen table, and what is he saying the reason is? >> one big thing that i want to make sure that's clear is that school districts want us to play. they aren't against us playing, but there's a fear of being sued , and one thing that i want to make sure that comes up in this interview is that there should be a waiver that's backed by the governor of california to protect school districts, protect cis. ainsley: yeah the parents cosign it right? and say i'm not going to sue you if my child gets covid playing football. >> exactly. ainsley: what is the governor saying about that, have you heard from him? >> no i actually plan on reaching out to the governor after this interview today. hopefully, to speak with him, really. i think there's a great possibility that will happen. ainsley: all right, thank you so much, you are so mature. well-above your years to do this and care about all your friends that want to get out there and play and their families. god bless you with your future and thank you. well we did reach out to the governor's office, gavin newsom 's office and we have not heard back. speaker pelosi taking heat accused of prioritizing pot legalization over covid relief. house minority leader kevin mccarthy is going to sound off on that, coming up, next. >> ♪ ♪ b republicans including our next guest accuse speaker pelosi of prioritizing marijuana over coronavirus relief, as democrats push a bill to legalize pot while millions of americans devastated by the pandemic wait for a deal. steve: all right house minority leader kevin mccarthy joins us right now, i believe from our nation's capitol. thank you very much, leader, for joining us. >> thank you, good morning. steve: it's all about priorities you may want to help people who are, you know, they don't have any money because of the pandemic but nancy pelosi wants to work on cannabis and cats as you tweeted. >> well that is so true, you know, 38 times since the summer the democrats have voted against any covid relief. with all the challenges america has right now, we think covid relief should be on the floor, but instead, the democrats put cats and cannabis this week. they are going to out law big tigers, and then they are going to legalize cannabis. they're picking weed over the workers. they're picking marijuana over helping the much-needed money we need to go forward. the small businesses that are closing. we look at what's happening to max public, maybe if they were named french laundry it be okay. steve: [laughter] >> i don't understand the double standards of what we see from these democratic leader s. how many times did speaker pelosi tell us we would not leave congress until we got some covid relief bill. that was months ago. there is a discharge petition on the floor that democrats can sign that they said they would and they haven't that would bring money to the small business workers. there is a number of times, but now they schedule the floor and they put cats and cannabis but not covid. ainsley: it's just unbelievable how do they not have a heart for these people that can't pay their bills right now and people are worried about losing their jobs. where do you stand when it comes to the stimulus package because i know pelosi and schumer are saying 908 billion, that bipartisan deal and mcconnell and mnuchin 500 billion, what do you say? >> i stand with mitch mcconnell and mnuchin because think about what we're doing here. it's even more. there's 138 billion that's already appropriated that is sitting there for small business workers, but pelosi won't let that go forward. there's more than 100 billion that's already been appropriated that would go to states that help them with their schools and the unemployment and others. we can do this in a systematic way to help those who need it without adding more money because we already have the money the democrats won't allow it to be spent. brian: yeah, i hope it's a bipartisan situation, she came down off 2.4, down to 1.8 and now she'll take 900 billion democrats and republicans work ing on it kevin i hope you guys get something done this week because they obviously feel the pressure to move and you're about to get even more power because the majority right now, the majority when you start in january, it could be from you told me the numbers 222 to 213 so they are going to be democrat s already deflecting from them and she's going to need republicans to pass anything, so maybe you guys can get together and lay the ground work for something bipartisan but something else is going on in california that is significant. your two-faced politicians are telling the people to do one thing and they are doing the exact other. here is bill mcgluan, from kttv over in california. he broke this story. >> i was tipped off about this by several people in the restaurant industry who were less than pleased because they say this is yet another glaring example of hypocrisy from our local politicians, so we've been trying to get an interview with supervisor all day long today, and they've been telling us, her campus has been telling us she's too busy in meetings all day long. it turns out that's not true because she just had an interview with another affiliate in la where she is playing the victim and essentially said she's getting death threats and she came here because she wanted to personally deliver the news to the restaurant that she was going to put them out of business. strange explanation. brian: she's talking about people going to outdoor dining and then go do outdoor dining like your. >> governor: after fond your mayor. what's your reaction to your state having -- steve: double standard. brian: it is. >> these double standards are despicable. if every restaurant in california would just change their name to the french laundry i guess it be okay because you have them, the mayor of san francisco, she was at the french laundry. the governor, he's at the french laundry with no masks sitting next to the medical lobbyists. it's okay if you're one of these elite democrats that dictate what you can do in your life, but not within their own, they can do whatever they want or maybe the mayor of austin that films that you should not while sitting in cancun. this is what makes america so mad. these are democratic leaders that think they are above everyone else and can tell us what to do, but again, they could do whatever they want. and in these socialist countries , these elitists and what do the workers need? what about those children who can't be in school that we can have resources to protect them, to help those who are unemployed , to help those small businesses? i was a small business owner. i know what it's like to have a dream, but to have government crush you in every aspect? that's just despicable. steve: and you left out speaker nancy pelosi who when the salons were closed she went in, she got her hair done, no mask, and then she blamed the salon owner, salon owner set me up, i didn't do anything wrong. all right, leader mccarthy thank you very much for joining us live today. >> thank you. steve: 17 minutes before the top of the hour and janice dean joins us with the big blue map which means it's cold. >> janice: [laughter] it's cold enough for snow. it's beginning to look a lot like christmas across portions of the southern plains where we had over a foot of snow over parts of oklahoma, kansas, and the texas panhandle where it's below freezing. 20s and 30s this morning, so this system is going to continue to move over the mississippi river valley parts of the ohio valley. it's actually going to get stronger, as it moves its way towards the eastern seaboard on friday and saturday and we could have quite an event in terms of a coastal low for parts of the north east. we'll have to watch the trajectory of this storm because it brings the potential for heavy rain and strong winds and snow on the back side as well as the cold air so we'll be tweaking this over the next couple of days because there is the chance it's a really big deal, friday and saturday for the east coast. all right, speaking of big deal, wildfire danger to extremes across southern california, santa ana winds are ferocious and we already have reports of wildfires spreading very rapidly in southern california so that's a big deal today as well. we'll keep track of that. there's your forecast today, for the central u.s. , other than that big storm moving in, quiet and then we're going to see the potential for showers, thunderstorms, even some severe weather as we get into friday and saturday along the east coast so if traveling, just keep note of that and the winds in southern california we'll be talking about this unfortunately throughout the day today and tomorrow. steve, ainsley, brian? [ muffled scream ] stop living with at&t. xfinity can deliver gig to the most homes. ainsley: american airlines completes its first test flight of the updated 737 max jet. the move hoping to boost confidence in the planes after they were grounded last year over two deadly crashes. grady trim bell from our sister network fox business is live at the dallas fort worth airport with a look at the new plane. reporter: good morning, ainsley. american will be the first major u.s. airline to fly passengers on the 737 max again later this month but before they do that they are offering demo flights to employees and that's what we took yesterday. we flew to tulsa, oklahoma, to the hanger where american is storing its 737 max, and that flight essentially felt like any other flight, that's what american, boeing and all of the airlines want people to see. the aircraft of course, has had wiring fixes and most notably, boeing updated the flight control system that was partially to blame for those two crashes in 2018 and 2019. the pilots of those planes will also receive several hours of training. at the tulsa airport where the max has been stored for the last several months, boeing or rather american has been doing regular maintenance on those planes. the coo of american tells us that this plane is safe and it's ready to fly again. >> i wouldn't get on this if the flight attendants and the mechanics said it wasn't safe, i'd tell my friends and family, i'd tell anybody it's a safe airplane to fly. reporter: united will reintroduce the plane in the first three months of next year. southwest, the largest u.s. operator of the max plane will do so in the second quarter of next year, and all of the airlines, ainsley, will let customers who don't feel comfortable flying on am just yet rebook to another flight. ainsley: all right well that's good news at least thank you so much, grady. steve over to you. steve: ainsley, thank you. grab your popcorn and buckle up because dukes of has and star john schneider is back on the big screen paying homage to the burt reynolds classic "smoky and the bandit." >> you can't drive to austin and pick up 400 cases of local and have it all back here within 24 hours. >> that was in the movie. it was 28 hours. steve: john's project it is streaming now and it is out on d vd, the film's director and star john schneider joins us right now, next to a vehicle, in a total stranger's driveway. what are you doing there?
