question is whether the people who have already made up their mind are persuadable. that's what both sides are going to try to do tomorrow night from the campus of the cleveland clinic in case western reserve over in cleveland. ainsley: yeah, brian, you know what they say about statistics. can you find a statistic for everything. 20% of america knows that tomorrow a big night. huge week, all eyes watching that debate tomorrow. can you walch it here on fox at 9:00. our very own chris wallace is going to be hosting that, moderating that griff jenkins joins us live from cleveland with the presidential debate one day away. hey, griff. griff: hey, ainsley, brian and steve. get ready this is going to look different like anything we have ever seen. right away there will be no handshake from the candidates. no elbow bumping. socially distanced and not wearing masks. sadly when it's over there is no spin room. there will be a live audience. limited to 80 to 100 ticketed guests, media and security and health staff we know wallace's topics too. six of them. going to start with trump and biden's records. then it's going to be the supreme court. the coronavirus, the economy. race and violence in america. and the integrity of the election. best of your recollection over the weekend. the candidates were already trading jabs. watch. >> i'm willing to take a drug test. i think he should, too. he has had a very uneven -- i watched him with some -- when he he was debating pocahontas and harris who treated him so badly. i watched him and he was out of it. right? and then i watched him against bernie sanders and he was okay. griff: biden's spokeswoman kate bedingfield shot back saying vice president intends to deliver his debate answers in words. if the president thinks his best case is made in urine, he can have it. campaign on the offensive up with the "new york times" report that the president only paid $750 in taxes during his first year in office. the president vehemently disputing the report lashing out at the "times" saying his returns will show otherwise he cannot release them because he is under an irs audit. we will see how this plays tomorrow as it is sure to come up. we might hear more from the president when he has a rose garden event as he will today. our chris wallace getting ready for that and weighing in on what he is doing to prepare. take a listen to chris. >> chris: job is to be as invisible as possible. i'm trying to get them to engage, to focus on the key issues. to give people at home a sense of why i want to vote for one person. but, if i've done my job right at the end of the night people will say that was a great debate. who was the moderator? griff: get ready one day away. and there is going to be a lot on the table. who knows what might transpire today. brian, ainsley, steve? brian: griff, we are going it talk about your decision to put music under chris wallace's soundbite. but we have to move on. thank you very much. let's talk about the debate and strategies. the president has been working with chris christie even though he denied it three weeks ago and rudy giuliani as well. they both came out for his presser yesterday at 5:00. the president said i have tried a few things. we are reportedly according to axios, he has some lines they are trying to figure out why, what makes joe biden snap. and try to use some of those lines. and number two is the president is going to important issues, tough guy image. he has got the answers. what i thought was really interesting is the president is going, to if he precious joe biden, the word is joe biden will crack. and you saw it with his remarks a couple days ago. when he was giving a speech on his experience he says my 180 years in the senate. i'm pretty sure that doesn't add up and pretty impossible. but i was pretty amized too on cnn jake tapper asked joe biden who knows joe biden best perfect place to define why he gaffetastic how she pushed back and get away with this. >> your husband has been known to make the occasional gaffe. >> oh, you can't even go there. after donald trump, you cannot even say the word gaffe. >> i can't say word gaffe? >> no, done. it's gone. >> gaffe issue is over? >> over. so over. brian: okay. if i'm that distanced from somebody i'm interviewing even in the coronavirus ear remarks i need a bull horn. that's way too much. steve: she heard him fine. brian: that's overcompensation. it's hard to see that relationship shout. that is not okay. i know she was the former second lady and taught with respect. but for you to say i'm not going to go there because you don't agree with what donald trump says, i don't think what you call donald trump is gaffe-prone. you might not like what he says, but he is not coming up with things that aren't based new what he believes in. so, what joe biden is doing, i find it pretty amazing, guys, that she was allowed to get away with that. steve: well, he asked a question and she answered it the way she wanted. to say and you know, this morning people are ascertaining what that's all about. i think the interesting thing, brian, from the axios article that i read as well about how trump is preparing, is he preparing with flash cards. so that he knows exactly what -- a particular topic comes up because biden and company -- biden per se on tomorrow night is going to be hitting him on the coronavirus response. he knows exactly in his head what the three points are and is he going to make those probably going to launch us into mr. biden. you know, it's interesting given the fact that griff just mentioned the "new york times" article talking about how the president didn't pay taxes for the last 10 or 15 years. something like that. biden camp has responded. come out with a brand new ad. launched it last night on twitter and they say teachers pay $7,000. firefighters 5500. donald trump paid $750. so they are going to go back to that i would imagine. in addition to coronavirus. the taxes. joe biden has a lot to talk about. but, as karl rove said yesterday, you know, the stakes for joe, are very high. here's karl. >> it's one thing if joe biden tomorrow night says 200 million americans have died of coronavirus and mistakes iraq for iran or vice versa. it's another thing if we see him, you know, not being able to remember the words of the pledge of allegiance or stumbling off into the ether because we don't have the normal campaign. and as a result, we have not been conditioned by seven months of activity since he became the democratic nominee to have a good sense of who he is and come to the conclusion that he is up to the job. so it raises the stakes tomorrow night. we don't know as much about him as we know about president trump who has dominated the media for the last three and a half years for good or for ill. but if there there are big slip-ups it could be very problematic. steve: absolutely. one of the other things, ainsley, it sounds like the trump team is trying to figure a way to get joe biden to go on the attack against amy coney barrett. ainsley: that brings us to the rose garden ceremony on saturday when he officially announced that she was his pick for ruth bader ginsburg on the supreme court. she was there in the rose garden with her precious children talking about how she is not a policy maker. she is there to interpret the law. loves america, and she loves the united states constitution. but the media continues to attack her for her can a alcohol catholic.>> amy coney barrett, , like really catholic like speaking in tongues. >> catholic faith core value and how she would rule on issues like abortion. >> also under the microscope barrett's link to a small people of praise. fohandmaid for women. >> seen no until amy coney barrett talking about her catholic belief. i wonder why that might be. ainsley: she talks about how she is a constitutionalist. and she interprets the law. our country was founded on the freedom of religion. you can worship any god you want. you don't have to worship at all. that is the beauty of living in this country. a dictator doesn't tell us where we have to go to church or what we have to believe or we have to hide down in bunkers and, you know, have bible studies because we will get killed like they do in other countries. so the criticism of someone's faith is really difficult for anyone or should be difficult for anyone to swallow in our country. we were freed from all of that and the president was asked about it. and he says it's disgraceful. and he brought up a really good point. he takes us back to the 1960s and spoke to the 35th president. listen to this. >> we have noticed some comments made in the media about my incredibly qualified nominee, amen. the "new yoramy. she is catholic. that covers a lot of people. that's a very disgraceful thing to say. i thought we settled this 60 years ago with the election of john f. kennedy but seriously they are going after her catholicism. i will stand with her, fight with her. and we will make sure that these attacks stop because it's unprecedented. brian: one thing do that would phi republican strength. you go after religion, people like at that as a third rail. however, democrats play it straight the way they would do it and up to you amy coney barrett to have an answer to this is she will eliminate obamacare because that's coming up in the first -- second week in november. and she is also going to eradicate roe v. wade, 1973. if you wring bring up those two issues and stay out of her personally that is they say how the democrats should attack. this one thing to keep in mind, too. the democrats have already shown a little bit of their hand by not showing poll came out yesterday and showed that 56% of the country think the next president, whoever wins the election should make that choice. you have to wonder if it's going to effect people like cory gardner and thom tillis and joni ernst. tough elections. expect the hearings to start october 12th through 16th. steve: sounds right. a vote around october 26th. we should not be surprised that the democrats are using the affordable care act. that's exactly how they won back the house a couple years ago. that is a road map to success this time given the fact that there is a global pandemic. charged in connection with to the breonna taylor case will face a judge today. brett hankenson will be arraigned on wanton endangerment charges. accused of blindly firing into an apartment next to taylor's with three people inside, including a child. hankenson fired back in june. the hearing comes after a fifth day of protest in the city. the demonstrations mostly peaceful following a weekend >> steve, good morning. the attorney for kenneth walker, breonna taylor's boyfriend who police say fired the first shot that hit officer jonathan mattingly in the leg as police raided taylor's apartment says that a kentucky state police ballistic report said they could not conclude that that shot came from walker's gun. in fact, the attorney, steven row mines confirmed with fox news that the ballistic reports says, quote: due to limited markings of comparative value the 9-millimeter bullet that hit and exited mattingly was neither acquitted or eliminated from been fired from walker's gun. this in contrast daniel cammeron said the ballistics' report showed that that came from walker's gun. >> kenneth walker fired the shot that hit sergeant mattingly. there is no evidence to support that sergeant mattingly was hit by friendly fire from other officers. >> this revelation and discrepancy raises more questions for breonna taylor's family, which is now calling on all of the evidence to be released publicly because they do not have faith in the kentucky attorney general daniel cammeron. this as well, new police body camera footage released by vice news appears to show former officer brent hankerson walking in and around the apartment active crime scene moments after the shooting and this is against louisville metropolitan police department procedure. now, hankenson is set to be arraigned today. he faces three charges of within a done endangerment for firing indiscriminately into a neighbor's apartment. steve? steve steve all right. a busy day in louisville. thank you. ainsley? ainsley: thank you, steve. final preparations underway ahead of tomorrow's first presidential debate which will be moderated by our own chris wallace. here to break down the biggest dos and don'ts learned from past memorable debates is presidential debated coach brett o'donnell who has previously worked with george w. bush, mitt romney and others. good morning to you. >> good morning, ainsley. ainsley: great to have you on again. let's go through some of these memorable moments. the first one 1980, reagan vs. carter when reagan said there you go again. watch this. >> these are the kind of elements of a national health insurance important to the american people. governor reagan again, typically, is against such a proposal. >> there you go again. ainsley: brett, how did that help him? >> well, it was a memorable line that enabled ron reagan to turn back the argument that jimmy carter was making. up to that point in the campaign, first of all, this was the only debate that carter and reagan had in the 1980 election. and ronald reagan had been complaining about carter miss appropriating reagan's position on issues. so he used a very memorable library that highlighted the fact that carter was wrong on reagan's positions. it was what captured the imagination of the press in the debate and effectively allowed reagan to say you are mischaracterizing what i'm saying. ainsley: it went over so well that he did use that line in several debates in years to come as well. this in 2012 when romney was on stage with president obama or actually on a platform they had an audience. he used that phrase binders full of women. watch this. >> we took a concerted effort to go out and find women who had background that could be qualified to become members of our cabinet. i went to a number of women's groups and said can you help us find pokes and they brought us whole binders full of women. ainsley: that was about payee quality. guy that hurt him? >> because it was a gaffe. it was one of those negative moments in the debate that can sort of wipe out the rest of your performance. that's why you have to be very careful what you say on the stage it's important for both the candidates to be rehearsing how they are going to answer questions on positions. if you make that sort of mistake, it has the ability to sort of wipe out everything else that happens and causes the press to focus on a negative moment. it's the kind of moment that you don't want to have. it was a mischaracterization in the coming days after that debate. romney was% executed by the press for saying binders full of women it. looked out of touch. and so it was a negative moment that really hurt him. ainsley: it can make or break you. this is probably the most famous one from 1984 ronald flipped the switch on the mondale. he was talking about mondale's youth and inexperience, watch. this i will not age an issue of this campaign. i am not going to exploit for political purposes my opponent i was youth and inexperience. [laughter] ainsley: brett, even mondale is laughing. that was very good. >> mondale knew he had been had. at that moment it was game over not just for that debate but the campaign. the question of the campaign was whether or not ronald reagan was up to the task. he had had a poor performance in their first debate and everyone was questioning whether or not ronald reagan was too old for office. that one line made it effective argument. it was the moment of the debate. it was a -- the message that they wanted to push in the debate and so, reagan was able to capture both the message and the moment of the debate to drive what they needed to, which was he was very much up to the task and he went on to defeat mondale very handily in the 1984 election. ainsley: brett o'donnell, thank you so much for being with us. >> thank you. ainsley: we'll be back later in the week to discuss what happens tomorrow night. thank you. >> you are welcome. ainsley: andy mccabe both set to testify about the russia probe in two weeks. what questions does dan bongino want them to answer? we need clarification. >> only mine. steve: let's talk a little bit about james comey and andrew mccabe are going to be in the hot seat up on capitol hill. if you were a senator, what are the swlat one question you would ask each of those guys? >> well, the question for comey is transparently obvious. we know now for a fact. it's not speculation innuendo or anything else, that in january of 2017, that christopher steele's primary subsource, basically the only person of substance steele claimed to talk to giving him all the ridiculous information allegedly in the dossier. we know the fbi interviewed this person and the fbi during the interview found out that the person who supposedly told steele all this stuff said hey, i either didn't tell him that that was all rumor and nonsense or that's just a complete total fabrication i don't know where he got this from. so just to be clear, there were three more fisa warrants to spy on the trump team issued after that fact. so, steve, i don't know any other easier analogy than to say if you were a cop and had an investigation going into a bank robbery and the person who told you there was a bank robbery then said no, no. i made that up. not only did that guy not rob the bank but no bank was robbed at all, and then you go and get three more warrants to search a house nor a bank robbery that never happened, i mean, that's really it's no more difficult than that to understand. jim, you knew the case was fake and you went on three more times to sign the warrants. brian: can i ask one thing and talk out of turn for a second. if anyone is curious on where this is going and how right dan has been in his books and on this show, google william barnett. he came out and said there was a get trump attitude there they went and got personal insurance. this was explosive story that very few people are talking about. it look as if the "new york post" said it donald trump was right all along. they knew they had nothing. >> yeah. i mean, brian's right. brian: he is at the fbi and he said it. >> there is an fbi investigator by the name of barnett, brian is exactly right. who they have now is his texts and he is saying yeah, listen, i had to join the mueller team because i felt like there had to be some sane voices in here because they had this get trump attitude. they went out and is he right about the second part, too. they bought professional liability insurance, the investigators involved, because they were afraid of being sued. do you know how hard it is to get sued for your profession? i was a federal agent a gs 1811 you really is to do something stupid. these were not stupid people. they knew they had done something wrong. ainsley: well, the american people were fed up. they saw through this, too dan. let's talk about this topic. minneapolis city council you remember they voted to defund the police. they there were nine -- there are nine of them on that council. some of them say they regret it. one said he intended it to be in spirit. another said that it had created confusion. another said the language in the pledge was up for interpretation and had been understood differently by each counselor. your thoughts? >> listen, if there is like a stupid ideas or a hall of fame of dopey, then these guys are first time inductees like first time unanimous out of the chute. just to be clear, ainsley, this the most predictable crisis in human history. if we defund the police, what do you think will happen? well, let me guess? you're going to get a spike in crime as the bad guys figure it out apparently they didn't figure that out. i mean, this is insane. and now we are supposed to believe you have the responsibility to take on other issues in minneapolis like, you know, healthcare, schooling, education? let's talk to her pastor father kevin rousseau from st. joseph catholic church in indiana joins us now. father rousseau, good morning to you. >> good morning, steve. steve: what have you thought about these questions about her faith? >> well, amy is a very faith-filled person, which what kind of intrigued me is their criticism for the way she lives her faith. i think a lot of them come from a potential affiliation of a group called people of praise. but, one of the things i have noticed as a pastor is when people are affiliated with organizations they actually are able to live their faith more intentionally. so people organize with the will paul. organize with the knights of columbus. they organize with the people of praise. each of these groups help them to be intentional about the way that they live their faith out of just sunday worship saint vincent depaul feeds the poor and knights of columbus work with building the family. people of praise work on missionary work and community service and education. so i see these things as very positive. and what about what they don't know is the people of praise is actually a mainstream organization. ecumenical. it's evangelical. it's charismatic. the ecumenical piece means it's not just catholics, lie lieu ths and charismatic means open to the gifts of the holy spirit. called me movements grace. bishop as a people of praise member as a bishop in 2014, so, this is certainly a mainstream organization in the church. it's been around since i think 1960. probably here at notre dame i believe. steve: exactly right. when you first came to that particular parish, her parish in indiana. she was on a leadership role of some sort. and she actually asked you -- you asked her to stick around after her term ended because she was doing such a good job helping you get started in the job. >> that's right. 7 years ago when i came here as a pastor. amy was our pastoral council chair. lay people who gather to kind of oversee what the parish is doing. making sure we have the right ministries in place. making sure that we have the right resources. and amy art happened to be in her last term of the pastor council. even before i arrived to begin my term, i met her when i -- the advance visit i came to the parish one of leaders for the church. amy was so professional and so organized and so helpful in that role as pastoral council chair that i actually asked her to stay on for an additional year. i thought it would be good for the parish and good for me. and at the time, you know, we had just finished the capital campaign. we were about to start a building project for a gymnasium. and she was exactly the person that i needed at that time. steve: sure. well, it's great that you would tell us about her. i would imagine when she and her family comes in they take up a whole pew. she has all those kids. it's really nice talking to you today referenced kevin rousseau, pastor at st. joseph catholic church in south bend, sir, thank you very much. god bless you. >> thank you. god bless you. steve: there you go. all right. come up, white house press secretary kayleigh mcenany. we have the president's son, donald trump jr. and michigan senate candidate john james all here live on this monday fox and friends. ♪ i only want to be with you ♪ ♪ ♪ ♪ keeping your oysters growing while keeping your business growing has you swamped. steve: it should be ratings wise. griff, thank you very much. let's bring in somebody who has been on many a debate stage there he is screen right, mike huckabee fox news contributor, former arkansas governor and author of great new book the three cs that made america great. governor, good morning to you. ainsley: good morning. >> good morning. you know, you guys are so good i don't even know how are. i have no idea. steve: yeah, right. griff just ran the list of topics that came out last week. you got to figure they also said there was caveat. that depends on breaking news. i think this "new york times" thing where they said that president trump paid $750 in 2016 and 2017 for income taxes for 10 or 15 years. that's going to come up. what are you going to make of this story? >> first of all, it's the "new york times." what i make of it when the "new york times" says something about donald trump, i kind of blow it off as totally lacking in credibility. because how many hours i wonder have they spent? and what are their documents for this? they don't tell us. let me give you this. so what? in a big business operation like he run us there is a good likelihood with all of the various business losses that he had for running for president when he wasn't overseeing his business, maybe that's. so i don't know. frankly, i don't care. i didn't elect him to be my tax accountant. i elected him to be president. i'm really happy with the job that he is doing. and when the "new york times" blows this horn, you know, i just got a complete hearing loss for it. ainsley: so joe biden was asked about the photographic movement. he says he is not progressive. but the democratic party is divided into two. you have your moderates. you have your progressives. aoc was interviewed by axios. she said basic delay joe biden needs to pay attention to them and not forget them. she says we are working really hard to try to turn out young people and it's just thought helpful to decry people like myself or bernie sanders. how do you think is he going to handle this tomorrow night? >> ainsley, i think he is going to back ouwalk out on stage witt and raised fist and shout for the revolution. what does she want? she wants somebody as radical as her. let's hope biden goes there that's an absolute certain re-elect for the president. they will never be satisfied. they want this country to be upended from the inside, and turned into a socialist utopia. i just like to ask them can you show me one? can you show me one place on this planet where that has ever worked? it hasn't. so, if that's their goal, either they are going to divide their party if joe doesn't go that far, or if he does go that far. they absolutely create a landslide for president trump. brian: governor, i know i don't have to tell you this. underline this. that's why that statement is so important. she is saying don't put me down. don't put down bernie sanders. when you said i beat the socialist. that demoralizes. guess what happened last time. they stayed home. guess who lost? hillary clinton. so, if he does separate himself from them, just know this. they are going to have their voices heard if he gets the job. and he might not be able to prevent the steam roll from happening. and her agenda could be the country's agenda. and that's what the president has to do. you can't diminish her and say well she is a 30-year-old and what does she know? she has a lot of power as does bernie sanders or else joe biden wouldn't have this nomination. >> i think it's very important to note that joe biden essentially has leaned so far to the left he can barely stand up. he doesn't. brian: he doesn't know what say. sometimes he does and sometimes he doesn't. >> yeah. but that's the point. i have said this before. joe biden has more flip flops than miami beach on the fourth of july. whatever he needs to say on any given day, he will say it because he is just reading a script. it's not coming from his heart. he is just reading what's put in front of him on the teleprompter and i doubt on the next day he could tell you what he said the day before. and that's pretty abbas the story keeps changing. steve: i'm sure, governor you were watching 5:00 an saturday the president in the rose garden finally made it official asht is his pick for the next job on the supreme court. immediately, there have been a lot of headlines regarding the fact shah she is catholic. "newsweek" said this. their headline how charismatic catholic groups like amy coney barrett's people of praise inspire the handmaid's tale. asht extremist religious beliefs merritt examination. and heard people say evangelicals are disappointed it's amy coney barrett and not an evangelical. not on your life. we are ecstatic. ecstatic because she is a christian sister who lives her faith. but the truth is we didn't care as much about her religion. it could have been a jewish person. it would have been fine. we want somebody and i think most americans do, who loves the constitution and will take the role of justice not as a legislative role but as a judicial role. do the job. i don't care what you believe but i'm thrilled that she is a fellow believer and i have heard nothing but wonderful things about her faith and application and if you look at the way she and her family have lived their lives and adopted kids who need homes and loving people and being generous. what more do you want out of a person's faith? it's just a truex pressure of the love of christ. so i celebrate her faith and i think a lot of americans, if not most americans, will as well. ainsley: absolutely. the question is will her confirmation hearing be like kavanaugh's? watch this. remember how the senators grilled him? brian: hold on. >> in your yearbook you talked about drinking and sexual exploits. did you not? >> if you are worried about my yearbook, have at it, senator. >> let's look at beach week ralph club biggest contributor. what does the word a result of mean in that? >> that probably week. now the reason chairman graham has the current schedule is because you would normally allow time for the nominee to meet with the leadership and the members of the judiciary committee on both sides but schumer and almost all senate democrats have said they won't even meet with judge barrett. and so with them threatening to call procedural votes, potentially even impeach bill barr, call up a war powers resolution to try jam the calendar. we need to treat every day and every hour as an opportunity to tell the story of this great nominee and to advance her confirmation. brian: congressman, she has written how bad the obamacare punting it on the obama years. people were nervous in the coronavirus era. ed in the middle of losing healthcare. how do you battle that if you are a republican-- strike that just or a supreme court nominee? >> i think you reject the premise that obamacare is the best way to take care of folks during a pandemic. what we have seen in obamacare is a limit to the access of healthcare, rising premiums. a destruction of the individual market, and more challenges on the small businesses that we need to thrive in america's rebound following coronavirus. so i still don't think that running on the long term, you know, endurance and assistance of obamacare is going to be a great strategy for democrats. brian: also, good news for people of florida it's have at it. go out to eat. can you go to a bar. have some freedom there and see if your numbers continue to tick down because you could be the template for the rest of the country where are not going to shake hands chris wallace, once they are settled is going to do what. >> there is no opening statements from either candidate. wallace will just jump into the six topics. six of them over 90 minutes, 15 minutes each. here is how it works. wallace will ask a question. let's say they start with supreme court. he will ask a question. trump goes first, the president will go first. two minutes to answer. biden gets two minutes. and then that's where the fun begins. both candidates can respond to each other. maybe try to change the conversation. maybe try to attack each other and of course wallace can jump in when he wants to to redirect ask another question. but try to stay on the same topic. and, also, the commission said yesterday it's not the moderator's job in this debate or other debates to be a fact checker. if candidates want to call each other they can. if it's call each other a liar they can. not the moderator's job to do it. this should be fascinating tomorrow night. steve: i remember where a moderator did kind of fact check and it helped president obama greatly, ultimately. apparently joe biden over the last number of days has been practicing some of his lines just as the president has. one of them is that donald trump is a liar. he will do a little fact-checking but he doesn't want to go down that rabbit hole. remember a month or two ago when some people were saying you know what? they need to have live fact checking at the bottom of the screen. that's not going to happen. >> not going to happen. that's something the former vice president did bring up. yeah, a couple weeks back. that's not going to happen. it's up to the campaigns. it is up to the candidates themselves if they want -- if biden wants to call the president out, that's his prerogative. the same thing for the president if he wants to call biden out if there is a slip of the tongue by the former vice president. but, i think it's fair to say chris wallace picked six topics right now that are right on the forefront of topics that have definitely shaped this year dramatically. steve: at the top of the list would be the supreme court. apparently the trump team would love to have the president engage joe so that he attacks amy coney barrett. >> yep. and you know, this is what is fascinating. on this issue, this is the one issue where i guess you could say both candidates have flip flopped. if you go back four years ago to the merrick garland nomination. then vice president joe biden called for a vote. at the same time candidate trump, he was presidential candidate at that time back in march of that year right around the time when president obama was naming merrick garland as his nominee he said we should wait. so both candidates have actually changed their opinion on their. i'm not sure if this would be the first one to come up. combustible issue. former vice president just yesterday, once again urging the senate to wait until we have a new president. that's not going to happen obviously. steve: exactly right. the issue that impacts people all around the world is the global pandemic ultimately we know that joe biden is just going to say that the federal government response under the direction of donald trump is the reason that over 200,000 people have died at the same time donald trump is going to come back and say look, joe, you were very critical of me when i turned off people flying in from china and that actually worked. >> yep. both -- listen, biden consistently, since march, haslam bassed this president over first for what he says was, you know, down playing the severity of the coronavirus and then botching the federal response. you would expect he would continue to do that in this debate. he will also probably reemphasize his own plans, which he has laid out in the spring and summer of what he would do if he were president and what he will do in january if he is elected. you just mentioned the president will definitely mention, you know, the restricting of flights to china and europe. he will probably also bring up testing. the president defended his testing for this country on numerous times since the spring. something you would assume he would bring up again also ppe and few other things. people don't agree on their or any of the issues they will be debating tomorrow night. steve: i think they will agree they will each say they won at the end. 90 minutes which doesn't seem like enough time just saying. paul, thank you very much. >> thank you. steve: all right. meanwhile, straight ahead, york times" got last 20 years of the tax returns of the trump organization. one of the revelations according to the "new york times" the president only paid $750 in taxes. and one of the other things and it goes on and on for days. you guys' organization have $300 million in loans due nut next three years. what would you tell us about that story? >> listen, it's ridiculous. my father has paid tens of millions of dollars in daxss if he does things where you get depreciation and historical writeoffs like we did when we took on the river, of building the old post office in d.c. perfect example. government contract. we bid against every hotel company in the world. historical tax credits that you use to offset tax payments for taking the risk to build that was that done under the obama administration. it literally took an act of congress to get it done. so, with that comes historical tax credits. that's the reality. people don't understand what goes into a business. it doesn't include property taxes. it doesn't include payroll taxes it. doesn't include real estate taxes it. doesn't include some of the things that he has been paying taxes on forever as he is also putting thousands and thousands of people to work on an annual basis. but, of course, the "new york times" does this they put out a selective picture of all of these things a day before the debate to try to give someone like joe biden an attack library to come up with one or two catchy soundbites and that's the game. we have seen it. we saw it two weeks ago with the debunk claim about the military. we have seen it four years about the russia hoax. if only they spent as much time looking for maybe, i don't know, hunter biden's tax returns and the biden crime family issues where hunter is taking money from a known associate of vladimir putin. $3.5 million. and no one has any interest. money that's linked to human trafficking and prosecution ringprostitution ringsin easter. imagine if i did that. imagine the story it would be. the kremlin direct ties to vladimir putin has influence over hunter biden. you don't think that's the collusion that they were worried about with donald trump? you don't think it's right there with the biden family and we don't even have to get into ukraine and 1.5 billion from china. again, that's the problem. that's the lens by which the media looks at anything they can try to spin about donald trump who has actually created jobs. who has actually created a business. who hasn't just talked about it for 50 years like joe biden but not actually achieved anything. that's the difference. steve: no doubt the tax also come up tomorrow night at the debate. also, the president's pick for the next supreme court job, amy coney barrett, that's going to come up, sounds like october the 12th is going to be the first day for the senate judiciary hearing. you know, don, it sounds like some democrats aren't even willing to meet with her senators jill brand, hirono, blumenthal, they will not sit down with her at all because they feel that she is illegitimate. they are not even going to bother. >> well, there was a comicialg on your show that said the best way to honor ruth bader ginsburg were to follow her words. the words were the president is not the president of three years. he is the president of four years. it's his job to appoint someone for the supreme court. amy coney barrett is a great choice for that the notion that the democrats are now going to play hard ball and stack the court, guess what? they were talking about that a month ago. they were talking about before this ever happened. if you have been watching the you know there is nothing they won't do. no lie they won't perpetrate no. things off limits. look what they did to destroy him because he was a trump guy forever. not everyone can take that pressure all that well. i just hope he is okay. i wish the best for his family and everyone around him. ainsley: how is your dad feeling about tomorrow night? is he nervous? >> i don't think is he nervous. you know, the difference is, i guess, he has also got to run the country, right? he is out there campaigning, is out there running a country. is he dealing with a pandemic. he is achieving peace deals in the middle east. joe biden is calling lids at 8:00 in the morning and debate prep. joe biden has been debating for half a century. i'm worried about joe biden the other 22 hours of the day where he can't seem to leave the basement. i have seen my father. i have seen how he has dealt with this job. he get the call at 1:00 in the morning when he is still in the oval office sometimes. you can't do this job one hour a day, two hours a day every fourth day. it's a 24/7 job. i just don't know that job has the vitality to handle that and that seems to be apparent based on the way he is able to not campaign. again, we don't have the luxury of a mainstream media complex multi-billion-dollar complex pushing for us, covering for us preventing we are out there all over the place. joe biden goes to pennsylvania once every other week. why? because it's an hour drive. thought because he loves pennsylvania as possible. i'm trying to get them to engage, to focus on the key issues, to give people at home a sense of why i want to vote for one versus the other. but if i've done my job right at the end of the night, people will say that was a great debate. who was the moderator? griff: candidates trading jabs, here is the president. >> i'm willing to take a drug test. i think he should too because he has uneven -- i watched him with some of the -- when he was with, you know, debating pocahontas and harris who treated him so badly. but i watched him and he was out of it, right, and then i watched what do you make of the timing, the tax thing coming out a day before the debate and how is he preparing for the debate? kayleigh: we have seen this play out before just before debates, inaccurate one at that. this is the same playbook in 2016 and the same playbook that the american people rejected and will do so again. the president is focused on the issues and the american people right now, bringing back the economy, v-shape recovery, looks like super v, breaking through barriers as we aim to get a vaccine by tend to have rate, fastest rate in history. that's what the president is focused on and the results tell the story when you have accomplishments to share. brian: the president is vague on what hours he put in and what he was like. would you want to expand? have you been studying joe biden and brought the angle to the president? has the president focused on any category in particular from the virus to his own record, to race, the riots and the supreme court, have you been -- did you break it up in categories and approach it that way? kayleigh: well, the president went through a number of topics during preparation yesterday. as he has said vocally and publicly, his debate what happens each and every when he's at the podium taking questions, vicious questions at that, unfair questions from a media that's very bias and when he guess on the plane and gaggles on the way there and on the way back, he takes more questions than any president in history. he's very transparent unlike joe biden who has been hiding away. steve: well, we know from the democrats who were very effective in 2018 regaining the majority in the house that when you run on simply republicans are going to take your health care if they win, the democrats won, they are using the samebook with steve: you have to figure joe biden is going to say that and we know that during the debate prep the president according to axios has been using flash cards. what are like your 3 bullet points on answering that that if she's in so many people's health care is out? kayleigh: well, let me say this first and disentangle the issue, one the president would fever ask his nominee to prejudge a case, so he would never ask amy coney barrett or any of his nominees to look at a case and tell him how they would come down. that aside, what i can say about the president and health care is his record says it all. when you really dig into this and i understand the democrats may not be looking at the president's healthcare because they want to deny this is a health care president, they don't want to bring to light what happened with obamacare as facts bear out that under obamacare from 2013 to 2017 premiums were going up, drug costs were going up. president trump comes in, 2017 on premiums come down, drug costs come down for the first time in 50 years and you had health care monopolies, these exchanges with one single obamacare plan. president trump bringing us better, more affordable health care. ainsley: i want to ask you about writer of vanity fair. that is what she tweeted out, talking about amy coney barrett, she said i guess one of the things i don't understand about amy coney barrett is how a potential supreme court justice can also be a loving, mom to 7 kids, is this like kardashians stuffing nannies in the closet and pretending they have drawn their own baths for their own children. most of us work because we love our job and we have to and we have to provide roof over our heads of our children. kayleigh: what a disgusting attack on working moms all across the country. yes, you can do both, you have a career and be a mother. i was with my 10-month-old late last night and i showed up in the morning to work and there's no better example of being a work mom than amy coney barrett who has 7 kids, two of whom she adopted and has brilliant history of juries prudence at notre dame law school and on the bench. that's an attack not just on amy coney barrett, it's an attack of working moms, suburban moms across america. brian: all all of the mail-in ballots. we don't know how it's going to come out. it could be so close, it can be kicked to the house. this is what the speaker said to house democrats, quote, the constitution says that a candidate must receive a majority of state delegations to win. we must achieve that majority of delegations or keep the republicans from doing so. it's sad that we have to have to plan this way, but it's what we must do to ensure the election is not stolen. your reaction. kayleigh: yeah, that's ridiculous, of course, nancy pelosi wants to to play out. she knows it's the only way she can win by manipulating the election with the mail-in ballots because the president's records stand for itself and the american people recognize it. this is troubling when you find 7 ballots in a ditch, that was in pennsylvania. this is happening across the country and democrats need to get their act together in states that folks back here are falling behind. senator peters voted to increase taxes over 106 times and he's saying that medicare for all is a path forward. i disagree with that. brian: he says michiganders have started voting and deserve to have a say. i will vote against confirming amy coney barrett to a lifetime appointment on our nation's highest court. so that's where he stands on this seat, hearings start october 12 to 16. >> he's a politician that would pick his party over the people. this is exactly the opposite of what he said in 2016 when he said that president obama should have his election year nominee and exactly opposite of 2 weeks ago when he was complaining about president obama not having election year nominee. now he's changing his tune because chuck schumer told him to. i support the constitution of the united states and there's no small print that political convenience should override. i will do that for the next 6 years. brian: the president on one of the states he shocked in winning is michigan and biden in latest poll 52 to 44. what are you seeing on the ground? >> well, what we are seeing on the ground is real actual people. people are fired up and excited. people are -- recognize that what's been going on in washington isn't working. they are not believing the lies that they are being fed from the leftist media. right now as a result of senator peter's failures, homeland security. he failed to show up for meetings and he's been the invisible man and failed to protect us from the pandemic. he cannot open his mouth without talking about being ranking member and now he wants to point fingers in an election year. we need somebody that can be battle tested, someone you can trust, someone what has protected american lives and knows how to do it. stops 6-day extension to count absentee ballots. all ballots in the state are due by 8:00 p.m. on election night. state democrats and other groups called for the attention after primary saw long lines and shortage of workers. and that is some of the news, ainsley. ainsley: all right, thank you, steve. pete's supreme court nominee judge amy coney barrett has been -- has long been under scrutiny by democrats due to christian faith and in a op-ed brace for debate. new york post columnist michael goodwin joins us now. hey, michael. micheal: good morning, ainsley. ainsley: she should thank senator dianne feinstein, explain that. >> back in 2017 amy coney barrett was nominated for a seat on the federal court of appeals feinstein famously said to her that after reading her works she felt that the religious dogma lives loudly within you, and that -- that remark by -- by itself was an expression of catholic bigotry but it's worth remembering too that was the only real argument against barrett's confirmation and, yet, only 3 democratic -- democrats voted for her, 43 voted against her, and i think we are setting up for the same issue this time, that the democrats don't have a lot of ammunition against her except her faith and their fear that she will use her catholic faith instead of the constitution to guide in her rulings. there's no evidence of that. she said that she wouldn't but i think that it is a good example of how faith squeezed out of the public square. if you believe in socialism, your ideas are taken seriously but oppose a program based in god, second-class status, we can only have sector and we can't have debate. i hope the hearings reassure religious liberty but the right of people of faith to participate in public life. ainsley: you write about how some of the left are denouncing her and her husband for adopting two haitian children and you go to to how some feminist wonder how she has time since she's a working mother. what do you think about that? >> i think they are desperate and the stakes here are enormous, not only 6 to 3 conservative court but she would be replacing ruth bader ginsburg who became an icon to many on the left. she's -- barrett is very young, she's 48. he would be in the court for a very long time and -- and she would be a strong -- a strong change of tone. she would be the first real conservative woman on the court, the first with working -- with school-aged children, she adopted two children from haiti in addition to 5 that she and her husband had. she's a remarkable example of things that scare the democrats. ainsley: she says she's a donstitutionallist and and lost the constitution and she's there to interpret the law. do you think that she would be able to do that? micheal: i think she has done that on the court of appeals. there's been no substance of complaints about her in that regard. i think the issue is that democrats will throw everything they can at this battle because it is so important and if they can't defeat her, i think they'll try out every piece of mud they can find and the media will can, at least they will use the moment to try to rally their supporters to make them angrier and take the yesterday revealing how he's preparing for tomorrow night's debate with the help of rudy giuliani and chris christie and the press. former vice president joe biden taking the trail off a day. meanwhile ahead of big showdown moderated by chris wallace tomorrow in cleveland. here with the discussion on the debate fox flews contributor -- news contributor tammy bruce and senior strategy adviser steve cortés, good morning to all of you. >> good morning. tammy: good morning. steve: when you listen on how the president has been practiceing -- practicing and gets out in tangle with the press and apparently they are doing role-playing and things like that. you've been on the stage, what works best? >> thanks for having me on. i think that a combination of things may work depending on the candidate. president trump clearly enjoys the back and forth with he and the press so probably big element of truth to that that this is preparing him but the i think the larger issue and joe biden taking a day off is not unusual before debate. i think the bigger issue i think for both candidates, two things. one in wall street journal, 70% of americans say debate may not impact. i don't know if it's true, we will find out. for the candidates offering a future vision on how the country will conduct itself and how our economy can grow and how we will handle health care and i think are all the things that the country will be looking for. it's an hour and a half debate. best moderator doing the debate. i know the biden campaign has been concerned about truth, i'm sure the trump campaign has concerns as well. it would be curious to see how chris wallace manages that. i think it will be robust and confront one another with facts and the country will have a chance to hear from both of them, how they would lead the county in the next 4 years. steve: i'm sure chris will have follow-up questions. tammy, let me ask you about this, you know, tomorrow really is -- it's the super bowl season 1 essentially, the first of four debates with see with the president and vice presidential candidates and this is what people are focused in. there's joe biden and there's donald trump. one seems quieter and more calm, the other guy is much noisier and is a disrupter. for a lot of people this is the first time they'll be able to do the comparison shopping thing. tammy: yes, there's been kind of allow bar set for mr. biden and some are suggesting through social media that if he just strings the sentence together and performs halfway decently it would be a win, but that dismisses the impact of donald trump. i think it's impossible to rehearse and prepare with a stand-in. the president is unpredictable. we know he enjoys this and he's not afraid of it. i would also suggest that mr. biden has a history of saying things that have been surprising and we should perhaps expect some of that. it's going to be a reminder, i think, of who the two men are, but people also are looking forward to hearing something about policy from the former vice president. he was asked the other day about packing the court, he refused to answer that. they stayed away from the press. they have not answered random questions that come from a press gaggle. so this would be the first time and i believe mr. wallace, in fact, drill in and not let him get away with not answering questions. donald trump is answering questions every day and he knows policy. he has to deal with issues like health care, making those things clear but people know where he stands and we want to see -- look, the nature of the debates and the campaign is really about seeing how people perform under pressure and that is what americans are going to look for when it comes to mr. biden. what does he do with that kind of pressure. steve: steve cortés, you know better than anybody what the president will try to hit joe biden with tomorrow. give us a preview. >> steve: the number one topic for the debate because it's number one topic is going to be economy, economic opportunity for americans, the president has a compelling case to make both looking to the past, what he did pre pandemic and what he's doing right now as our economy woods is from the china virus. we will make the compelling case and contrast that with record of economic failure from joe biden, somebody who sold out american workers for decades in american swamp and exported american jobs all over the world especially to china, and by the way, regarding china, the president will make the case, what they did send us back, millions of dollars to his son. the president is going to certainly dive in the important issue. herald ford, jr., you're first up, regarding amy coney barrett, the president nominated her on saturday, apparently tomorrow night according to things we read in the press, it sounds like mr. trump is going to try to provoke mr. biden into attacking her because he feels that that would be good for trump, what do you think? >> joe biden won't attack judge barrett, he will raise questions about examining her record which the tradition of nominating a supreme court justice, no justice impressive on face of it. the question is where does she stands on big issues and she should be examined. steve: all right, tammy bruce. tammy: well, look, she was examined by the senate less than 3 years and she knows what what's to expect when it comes to hard questions. look, she accepted this appointment, this nomination, realizing what happened to judge kavanaugh and she's ready to do it. so there are very good questions that she should be asked, her answers and performance would impress the american people and we will see if, in fact, mr. biden can be provoked. that would be one of the tests tomorrow. steve: steve cortés, you get the final word. steve: the president was elected largely for this reason, judges, the open scalia seat was a driving force behind the election. he has more than fulfilled the promise to voters putting hundreds of constitutionalists, originalists judges on the bench and amy coney barrett both personally and professionally she's the closest that you can find to a legal profession super woman. she is -- she is the latest and perhaps greatest pick for judiciary and i challenge the democrats to vilify the woman. i think it will only work in our favor. steve: everybody will be watching and on wednesday we will know if ratings went through the roof. lady and gentlemen, thank you very much. it is 17 minutes before the top of the hours and jillian has news from texas. everyone goes to hunt. one of the biggest industries here. before we had a chance to be here we were out herding 1300 bison, they were herding the bison and i was just watching. south dakota believe in their governor but governor believes in the people of south doctoral, masters' and bachelors' degrees, let's take a look. >> they will turn around and back at you. >> one of the responsibilities as governor? >> this is the best day. >> there's nowhere else in america that an event like this happens. it was close to 20,000 people. i wonder if because of covid-19 people would stay home. what we found is people looking for an opportunity to stay normal. reporter: you as a governor are famous. >> south dakota noem, the reason she's a star in trump universe right now is because she's resistant to lockdowns. >> how has that worked out for you? >> i think it's working out well. i think the only reason people know that now because liberals went after me. i'm going give you all of the information that i have. i'm going lay it out for you and make recommendations and i'm going to let you have the flexibility to do what's right for your family. reporter: you posted video on social media and you said this is how we social distance. governor: the outdoors is where people have been able to enjoy parks and hunting and really not think about covid-19 for a little bit and the reality is it's pretty good social distancing too. i've never one taken the virus lightly and everybody knows that. if people said that, they are just trying to be critical. reporter: from what i understand you're working pretty hard to get president trump another 4 years. governor: i am. mr. president, welcome to south dakota. >> why that? governor: there's no other president that has done to our country. i don't want to go back to that because that's really what biden's platform is and he's even gone further. he's embraced the green new deal which in south dakota would devastate our way of life. reporter: the other 49 states, all the political division, what do they stand to learn from the people of south dakota? governor: i would tell them that people are happy and they get to make decisions for their families. i think what's happening here is resinating with america and if they love this country, if they want to live in freedom, we would welcome them with open arms. steve: brian. brian: joey, what were you expecting, what did you see out of the governor? >> listen, when you have 1300 bison around you, that was an amazing experience. speaking with the governor, she's so confident and understands the people in her state so well. we spent a day at mount rushmore after the herd, they talked about how much they enjoyed being there. the governor understands that and reflects it very well. steve: i know she's popular in south dakota but she's becoming more and more popular across the country. she's raised her profile and some are suggesting, you know what, she might be angling for a big federal job in another town in a couple of years. >> yeah, you know, let me tell you, watching her herd bison in the back of a horse, i think she's a natural-born leader. you can tell the people really appreciate and understand how good -- how unique it is to have a governor like this when you have people in new york and california who have governor wavering, coming back and forth with new restrictions, getting rid of old ones and bringing them back and have a governor that is so decisive. they are living freedom here. ainsley: very impressive. her stock many went up, many viewers, we are watching yellowstone. you did great job. what's the difference between buffalo -- i know it's called buffalo roundup but those are bison, right? >> antelope only in africa. we call the north american buffalo. buffalo were only in africa. these are bisons. it's the same animal, different name. ainsley: the bison has the beard. they say they are the hipsters.
