>> absolutely. vice president pence is totally right. conservatives are deeply alarmed at this pattern of decisions that make chief justice roberts look much more like a politician than a judge. that is not his job. remember, roberts was appointed by bush and, you know, in a different era there was a filibuster, so, who knows, maybe he was the best justifiable who could have been confirmed under those circumstances but we live in a different world now. we have mitch mcconnell leading a strong republican senate. they have made sure there is not a filibuster to be blocking good nominees. and this is something that is going to be a hallmark of president trump's accomplishments. he has promised in 2016 and he has delivered with the help of the republican senate to over 200 great judges who were explicitly chosen not just obviously for their talent and for their experience but also for a history of standing up with courage when they were making decisions in their careers up to this point. and that's what we are seeing so much is a real key to having good judges. pete: carrie why is chief justice roberts siding with liberals on life and religion and religious expression? >> you would have to ask chief justice roberts that what's so disturbing is you see this pattern and even some of the dissents from his own colleagues suggesting that, perhaps pressure from outside the court is what is making him not want him to appear to conservatives. he seems to be trying to play both sides. some of the most recent reporting from the court suggests in cases he had flipped his decision again, maybe because he is concerned about the media backlash if the court rules certain ways. but, you know what? chief justice, that's not your job. your job isn't to look at the opinion pages and figure out what is going to make them put the court in the best light. your job is to follow the constitution and the law. pete: that's right. washington can actually be a bit of a install town and is roberts looking around at what happened to kavanaugh? is there a kavanaugh effect my legacy i want to be liked by the elites in washington? will we see more of this? one thing that's disturbing it does seem to be increasing pattern. we saw it in obamacare and saw it increasing in spate of decisions vice president pence alluded to this year. i'm not sure if that is sort of an anti part effect. he likes to say there is no trump or obama judges he seems to be anti-trump judge at this point. that could be parted of it. i think you are right, the surrounding community maybe is part of that are influence and there had been threats against justices like we saw during the kavanaugh nomination. and that attempt at intimidation could be playing some role. i think you have seen people suggest that in their opinions as well. pete: you make a good point with the filibuster gone presidents can choose justices are more faithful with their view of the constitution rather than having to make a deal that can get passed 60 votes. changes the game. carrie severino, thank you for your time, we appreciate it? >> look, every once in a while the beneath the veneer of top inclusivity slip and democrats let you know who they really are and how he had feel about black americans. joe biden saying black americans too stupid to have diversity of thought. is he saying community is not as diverse in thought than other communities. by the way, this comes a few months after he said that you ain't black if you don't vote for him this is what he truly thinkthink african-americans. it's offensive and gross. let me tell you something i have a chapter in my book always the soldier called the kanye effect why black americans are leaving democrats behind. this is why black americans are leaving democrats behind. we are tired of being manipulated and lied. to say by the way we are tired of being traded for illegal immigrants. he had another interview yesterday where he said that illegal immigrants should have the same rights as everybody else. and this proportionately effects the jobs and the skills and the wages of black americans so how i would respond to this is to tell joe biden that black americans do have diversity of thought. we have always had diversity of thought. and you need to stop hanging around these black liberal leftists ileftist and the msnbct you are hanging out with and get out in the free world and hang out with real african-americans that have very different viewpoints about a lot of different things. brian: told by char la main the god if you aren't voting for me you ain't black. char la main came back and said i wish joe biden would shut up blank forever and act like is he starring in the movie quiet place. he gets the african-american community worried because they didn't come out for hillary clinton the numbers they came out for barack obama. so you can sit there and wait for joe biden to screw up. but if you are president trump, you can't just say i funded black traditional black colleges. you can't just say i have empowerment zone enterprise zones. what could he do to show the black community he is a legitimate alternative? >> i think that this is the same -- what he can do to show the black community that he is the alternative is the same thing that he can do to show all americans that he is the person that is going to bring our economy back to at least something close to whether a it was before. we had the greatest economy in the history of this country before the coronavirus pandemic and this is something that benefited all americans and particularly african-americans. so, right now you have joe biden who people are not particularly thrilled with on the left, black americans in particular, i do not believe that they are going to show up for him, so what the president needs to do right now is to tell african-american community that i have done all of this stuff before with the economy, can i do it again. i am the one. and honestly, brian, he just needs to play those comments about joe biden talking about illegal immigrants. black americans are waking up to how we have been traded for illegal immigrants by the left. they realize it. they see it in their own communities. they need to underline that and if they do that if the president does that, if the republican party does that, then they have really put forward a very clear demarcation between president trump and joe biden. and i think that if if they do that effectively enough, then more black americans will go for trump. brian: rob smith it's interesting because joe biden seems to be making the black community rethink their allegiance to him because he keeps showing himself over and over again. rob smith, thanks so much. >> thank you. brian: meanwhile straight ahead overnight in portland an erltdly woman blocked from putting out a fire outside of a police precinct. another covered with paint in the 71st day of unrest. acting cbp commissioner mark morgan. trusted. it's got to be tide. among my patisensitivity as well tas gum issues. does it worry me? are we supposed to have anarchy in the streets constantly there was video that came out earlier of an elderly woman with a walker someone threw paint on her because she was out there talking to the protesters. stlt picture right there, mark. >> look at that i mean, i believe this in my heart. i have been doing this for 30 years in law enforcement, ainsley. i believe the majority of the american people regardless of what political aisle you stand on looks at that and says that is outrageous. that's unacceptable. we need leaders, local level national to stop that this administration and this president absolutely has committed that we have seen that i will tell what you i was just in portland on wednesday. i met with the leadership of the oregon state police and i saw they wanted to be there the professionals and working together to solve this problem at the federal building it's working. we need to do the same thing to stop the violence across the board. brian: all right. unbelievable what's happening. you pull back, the unrest happens at the same time your acting homeland security secretary has to clarify federal action on capitol hill as if these lawmakers have any clue what really have happening on the ground in portland. meanwhile, joe biden continues to make news of you who he is going to treat illegal immigrants, those people who jumped ahead of the line, got here and when he becomes president, they are going to have a pathway to citizenship and something else. let's listen. >> should undocumented immigrants also be able to get subsidized healthcare? ainsley: he just clarified. didn't apologize, by basically saying one race, they all think the same. lots of criticism online about this. the president said a great insult to the black community. joe concha, media doesn't talk about it because they are coverings for him. sarah sanders says that the media givers him a complete pass. we had rob space smith on brian interviewed him earlier with turning point u.s.a. and spokesperson says that biden's comments show that democrats are using black voters, listen to this. >> every once in a while the top layer of veneer slip and democrats let you know who they are and how they really feel about black americans. joe biden the same that black americans are too stupid to have diversity of thought. he is saying that our community is not as diverse in our thought as other communities. this is why black americans are leaving democrats behind. we are tired of being manipulated. we are tired of being lied. to say and, by the way, we are tired of being traited for illegal immigrants. ainsley: "new york times," even a reporter for the "new york times" jonathan martin he tweeted out that biden's stumbles have unsettled party officials and left them thrilled that there is no real public campaign. leave joe biden in the basement, basically because the gaffes will not be -- he won't have as many gaffes. brian: this is the most unique campaign because of the pandemic. and it's benefiting one candidate. one candidate's strengths are live events, endurance, ability to rally crowds and entertain and inform. the other one's biggest weakness is being covered by the pandemic so, therefore, he hopes the next time you see him will be on election day. joe biden has had a history of making his supporters nervous. the reason why he has been unsuccessful in the past when he ran for president because is he a terrible candidate. for example, watch. >> poor kids are just as bright and just as talented as white kids. >> you cannot go to a 7-eleven or a dunkin' donuts unless you have a slight indian accent. i'm not joking. >> what kind of a chance would a northeastern liberal like joe biden stand in the south? do you agree with those numbers that that's accurate? >> i think that the african-american community definitely wants police in their neighborhoods. the african-american community is under siege. they are not as monday list thick as what's being perceived by these far left groups that are touting the slogans of defunding police or quote, unquote, depolicing. these communities are being plagued by gun violence and homicides that are destroying these communities. so, as a result. we clearly need more police in these communities and not a defunding or less policing as beings portrayed by people such as congresswoman bass in california. ainsley: we are seeing crime go up. just staggering numbers here in the city, which is pretty scary. scary if you have children and some robberies in my community now there was an article recently in the paper about this. so, when you see these numbers going up, i think most people in america just want the bad apples out. they want the racist cops out. but the majority of them are not. the majority of law enforcement really good individuals, good hearted people and do it for not a lot of money. right? i think that's the majority of us believe that we don't necessarily want all police gone or a fewer police officers. >> we, as americans, want quintessential policing in the neighborhoods that we occupy or we inhabit, so to speak. so, as a result, we are all for police reform, however, it needs to be done smartly. sure, let's remove the bad apples but by and large police are there to provide a service and protecting the community in connection with the social contract. as a result of that we need police; therefore, we as a community need to coalesce around police to ensure that our communities are being protected. and the far left is driving a narrative that is inaccurate in connection with the silent majority. the silent majority wants police this their communities. >> so, congresswoman karen bass, she has recently said that it's not defunds the police. now she wants to call it refunding the community. listen to this. >> i would stay a little different. i say. [laughter] >> well, in one way as you know we americans dare to say we are one nation under god. so religion and faith and allegiance to a particular creed as always been a part of the american psyche and the american dynamic. and i'm glad it is because we are a god-driven people we are biblically based values. and election is a good time to revive those fundamental values of belief. i would like to see religion play a role of bringing us together not dividing us. so, i don't know. what was the group in the introduction you mentioned? pete: catholic vote. what's your take on is there anti-catholicism growing? >> i'm not familiar with that particular group, but, hey, thanks for your company. we catholics are very often accused of being way, way, way too meek when it comes to defending ourselves i know here in new york i'm blessed with a company and friendship of a lot of jewish rabbis and forever saying timothy, be careful, we jews have learned the hard way. when they start defacing your building and they start throwing molotov cocktails and when they start cutting down objects of devotion and burning your books of prayer you better be careful that's animosity and bigot infantry be you had inflamed. maybe this group has something. i'm more afraid, ainsley, brian, and peter of an anti religious sentiment, catholicism would be a subchapter of that. i'm kind of apprehensive about a rise in anti-semitism, a rise just in antireligion and faith in general. and, of course, the catholic faith is a big chunk of that. so i think there is reason for some trepidation here. ainsley: i have the same concerns. what do you want to say about parochial schools? are they going to reopen? are they leaning more toward inclassroom models? >> ainsley, we are raring to go and we are eager to get back. i was just with a group of people the other night, community leaders, parents, community organizers, police officers, politicians, teachers, healthcare experts and they all agreed that we got to -- we got to get on with life. we have got to continue to be extraordinarily precautious and safe. we have got to get on with life. the best thing to bring us back to a sense of normalcy is to get our kids back in school. one of the healthcare experts pointed out the cdc, the american pediatric association. there was a position an infectious disease physician from harvard the other night on the news who said that children can safely and securely return to school. it's better for them to be in school in a safe, secure, sanitized situation. let's get them back because parents can't go to work. transportation isn't going to get started. the routine and the blessed normal life that all of us miss ain't going to get back on tracks until we get our kids back to school. so let's do it. brian: absolutely. on top of that too. in maryland the governor came in and said those catholic schools can open in maryland and the local government says no. how do you feel about that when you can't make a decision about the schools in which you fund? >> one worries about that we obviously have to be very attentive to healthcare professionals. i think the plan that the leaders here in new york city unveiled is pretty good. they said, look, right now it is very safe. we will monitor it daily. if the rate of infection gets above 3%, right now it's justing to gling about 1% thank god. if that goes perlessly higher we will say oh, be careful. we want to be attentive to the healthcare experts but we still want to have liberty to say darn it we think we can make decisions that we can safely get back to the good of our kids. pete: real quick follow-up on that mayor de blasio schools open if closed would you seek to stay open? >> i think we would. we have a great spirit of cooperation here. and i would want to know the reasons and lord knows if my team of pros said you know, he has a point here we better not open. i would sadly and reluctantly have to agree. but, boy, right now, i want to go full speed ahead. i'm glad we are pulling to do so. pete: absolutely. you mentioned vandalism and one of the most powerful is saint st saint patrick's cathedral. without tourism and visitors it's having a big impact on the church. share. >> it is. thanks for having. that graffiti incident, you were kind enough to invite me on before to talk about that. there has been a rash of dozens and dozens of dozens of attacks on catholic churches, evangelical churches, synagogues, mosques, that goes back to what we were talking about earlier about kind of antireligious, antichurch, anti-faith dangerous sentiment. saint patrick's is suffering from this a great deal. see, most of our perishes in the united states are neighborhood based. they have residential people. saint patrick's doesn't. we are three blocks away. we are away from where you guys are now. we are heavily -- we are not residential. we are tourists. we are visitors. we get between 4 and 5 million people a year. i would say 95% of those are visitors. there aren't any now. so saint patrick's becomes a sanctuary, a temple of prayer. it's cavernness no cavern now. it takes its toll. we mourn that saint patrick's is a spiritual boost. to say see it empty people say missing in their life. the life and light that prayer brings. ainsley: you know, it saddens me when i see graffiti on the side of a church or when you see images of people burning the bibleg bible and maybe as christians we haven't done our part to teach them about christ. i would be too fearful to do that because i love the lord so much. what's your message. brian: i don't think antifa is open. ainsley: so how do we fix this? are we doing our part as christians? >> i don't think we are, ainsley. you bring up a good point. usually people of religion by their nature are kind of a little bit more humble and behind the scenes. jesus told us if they strike you on one cheek turn the other. so we know there is a nonviolent toleration to evil. of the question becomes not if we defend ourselves. you bet we have to. how we do it. we never want to return evil for evil. we never want to return rocks for rocks or molotov cocktails for molotov cocktails. pope francis keeps telling us that the way we convince people is through lives of joy and love. when people see us as happy, loving people, they are going to say what makes them like that? perhaps that one community is diverse and the one things the exact same way. what an insult realizing that he tweeted this out earlier today i made comments about diversity in the african american and latino communities that i want to clarify. in no way did i mean to suggest african american community is a monolith, not by identity or issues is he asking for forgiveness, geraldo? geraldo: well i think what he's trying to do is remake his answer, remake history in a more benign way. i think it was a blunder on his part, it was naive and it shows in some ways the superficial understanding of an entire racial group. i don't want to go overboard on it. i understand how he fell into the stereotype, but the whole move to make black is beautiful and all that from the 30s and 40 s, was to incorporate a race of people that over time had been used and abused and you had intermarriage and mixed marriage and you had different shades of color in both communities in fact in both the brown and black communities. that's where i remember as a young man, and the chairman of the co-chairman of the black and brown lawyer's caucus, we went overboard to say brown incorporated everybody. the latinos of the caribbean, the latinos of mexico and central america, the vast swath and the different ethnic groups that latinos in all of south america and the american southwest and the cities of the northeast. you have a potpourri where i would argue that black black and brown people are at least as racially diverse as white people so i don't exactly know what joe biden was talking about unless he was a freudian slip saying i've got the blacks in my pocket. they're all of a kind. i don't have to sort through the 50 or 60 countries of africa and the various 2,000 languages and the agrarian people, the urban people, et cetera et cetera. it was a very naive statement. i'm sure he didn't mean harm by it, but as a result, he's been embarrassed. pete: could have been very revealing though, geraldo you mentioned he does have a track record of that if you don't vote for him you ain't black. it feels like a freudian slip yet again but you did an interview with the president of the united states on your radio program congratulations on that. geraldo: i did. pete: you asked him about debate and here is a portion of what the president said about joe biden and the perspective of debate. geraldo: do you think joe biden will debate you? president trump: he would like not to. i know that for a fact because we're dealing with everybody. he would like not to. i think it's very hard for him not to. i actually think we have a public service that put it out this morning i think it's a public service to debate. people have to see what's going on, and where you're coming from pete: geraldo the president says he knows for a fact joe biden doesn't want to debate him and you look at the tee leaves. it seems here what advantage would biden get from standing on a stage and will he or could the biden campaign insist let's do this virtually. let's do this from delaware. geraldo: well i think personally that joe biden has everything to lose with the debate, if what we see , what we appear to see in terms of his fragility and his tendency to malafropt, he would have a hard time debating a force of nature like donald trump. it may be we're setting the bar so low for joe biden that if he came on stage and answered two or three sentences we'd say oh, wow he's a lot smarter than we thought he was but just in terms of look at the two. in terms of vivacity, in terms of energy, in terms of physical size, in terms of the command of the ability to answer spontaneous questions spontaneously, i think the president really is one for the decades. more than just against joe biden i think he's proven when remember that big field of the gop primary, 17 different candidates how in the world would he stand out? it turned out that without him on stage, they were a big bomb in terms of the ratings, so i think that joe biden has his hands full and he has a hard time ducking debate. i think they've tried. they've seen the success of the delaware basement strategy keeping him and carefully controlled conditions and when they set the vice president loose, he does have a tendency to play fast and loose with the stereotypes as we've seen. ainsley: so geraldo you have this great series on fox nation called "i am geraldo. reporter: pete, ainsley, brian, good morning. the lebanese people are demanding answers today as to why there were thousands of tons of explosive material sitting in the beirut port. right now there are more than 300,000 lebanese displaced internally and the government seems to have no answers and the people are demanding those answers. overnight we saw clashes in front of the lebanese parliament building in beirut. the extent of the damage is difficult to describe. here is a look at the scene at just one apartment building that was affected by this blast. >> the city of beirut is in pieces, in the immediate vicinity of the blast, it looks like a war zone. steel beams bent like they were paper clips, windows ripped from their frames. you could see the ports just a few hundred feet away from where we're standing. people were home at this time. they were preparing to have dinner on tuesday night. you can see survivors had a difficult time getting out of the building. the elevator shaft was heavily damaged in this explosion and there was a lot of debris blocking the stairwell. still, there are blood-stained footprints, a reminder of the true toll that this blast caused. >> people are emotionally destroyed, even if they're physically okay they're emotionally destroyed but coming to such areas where the explosion happened and see ing all these people helping was, it tears at the heart and makes us have a little bit of hope again. reporter: the lebanese people are proud that they can come together and try to clean up the city we're told by many that we talked today you could hear the emotion in that woman's voice that scene is familiar people trying to clean-up the destruction and the owner of that apartment building tragically died in the explosion earlier this week. lebanese people looking for a way forward today. back to you. ainsley: so, trey, this was a ship in the harbor that had explosives on it. do we think terrorists were involved do they know that? reporter: it's unclear right now what exactly caused this explosion. you see a lot of lebanese officials today trying to put the blame on others. no one wants to be responsible for the tragedy that unfolded. you also have pentagon officials saying they do not believe this was any sort of outside incident and it looks like an accident according to the pentagon officials that spoke to fox news earlier this week. pete: wow just looking at the devastation that building you were in, that's not close. i mean the expanse of that explosion unbelievable. thank you so much. ainsley: brian what's coming up? "we're at a very critical moment for our relations between the u.s. and china and in a way, we can say that it's unprecedented. other reports say does the u.s. really want another cold war? " what do we want? >> well, i think i'll take the president's words in terms of what we want. we want china to be a responsible member of the international community, and treat not just the united states but other nations of the world fairly, to protect their international boundaries, stop harassing them by air and maritime interdiction. stop cyber espionage stealing their intellectual property, recognize the sovereignty of nations. that is not the behavior of the chinese communist party since they took over and much moreso, with the most ambitious most aggressive and most maligne d leader that we have in president xi. that is what i think the international community wants as does the united states. brian: big report in the wall street journal how china has helped saudi arabia with their nuclear program and here is what the prince said back in 2018. without a doubt if i ran developed a nuclear bomb, we will follow suit as soon as possible, and then you got this report that the kingdom's nuclear program has been really coached through and supplied by china. wait a second. china just signed a trade deal with iran, the arch enemy of saudi arabia. are they playing both sides of this? >> yeah, certainly and here is the reason why. the chinese communist party of mainland china is dependent to the 62% of all of their oil comes out of the middle east. that's why they have a base in j abuti, and that's why their ships are in that area on a regular basis now and certainly the deal with iran is all about that and they would love to be able to build nuclear power plants in the middle east for the gulf state nations and the oil producing countries. what's happening in the middle east is that they cannot continue to depend on oil as a single commodities economy. they need to diversify and particularly when it comes to producing electricity, thus that is why many of them, the uae has just built the first nuclear power plant in the middle east and they've got three more under construction. that is why saudi arabia's considering it number one strategically, for diversification of its economy, but number two, why they are considering the possibility of eventually developing a nuclear weapon is because of iran's desire to have that. they're a long way from doing that, brian but this initial step with china gives us all concerns. brian: but general this is what you've been saying all along and so has the trump adminitration. if you let iran get a nuclear weapon, their enemies are going to want one too and when europe is slow to get off the mark and enforce anything, they helped seed this nuclear growth. >> yeah the most dangerous event that would ever take place since world war ii be the proliferation of nuclear weapons in the middle east because here we have i ran on one side, irs and then the arab states with nuclear weapons and everything that takes place in that part of the world and it's like lighting a match and you could have the first nuclear exchange ever in the history of mankind. that's what makes this such a dangerous situation and why we must never commit the iranians to have a nuclear weapon because that's what will start the nuclear proliferation. brian: i hear you thanks so much appreciate your insight. >> good talking to you brian. brian: is this a partisan political attack, because there's so much in the republican camp? >> well, you know, when i heard about this major announcement the night before this was actually announced and then about an hour before the attorney general has an announcement of national import, you knew she was desperate for some attention, but when she comes out and she says we are going to sue the nra and i'm thinking to myself, this has to be big. well it's a classic self-dealing allegations, you know, private travel, expensive meals, airplanes. it's classic, but what she decides to do and let me set the table here for a second. this leticia james is a trump- hating, nra- hating individual who made an essential campaign when she ran for attorney general in liberal new york state if i need to add that myself so she's coming through with her promise she's going to destroy the nra but look i've prosecuted organizations or individuals who cheated their organizations, okay? it happens all the time. it's no big deal, all right? but this is her conclusion. this is her conclusion. she says now, i'm going to move to dissolve the nra. you're going to what? you're going to dissolve the nra it is the biggest voice for gun owners in america. is this suddenly starting to sound political to you? especially so soon before an election, so close to an election, and now that we've got first-time gun owners across the country scared to death, police are being defunded, we've got antifa and everybody else burning buildings and just this morning on the show, guys i saw this woman a senior citizen, she had to be 80 and they're throwing paint on her? i mean and now you've got leticia james standing up for all those members of the nra who are you kidding? you're saying that you're going to protect the members of the nra by dissolving the biggest organization that speaks for gun owners in the country? this is ridiculous and by the way, nra got ready for this. they turned around and sued her for defamation. so, this is just what the left is doing. they're doing this and there's an a.g. in washington d.c. whose joining in saying i'm going to sue the nra too. well do you know what? this is just an indication of where they're going. the next thing is it's going to be guns. they limit our magazines they limb the number of bullets et cetera, and now it's going to be we're going to dissolve the number one organization that speaks for gun owners in the country and it is absurd. ainsley: scary times judge what's coming up on your show this weekend? >> well, this weekend, we've got defense secretary esper and we also have carmen best who is the police chief in seattle, we've heard a lot from her. i'm looking forward to that interview and of course, we've got steve scalise, jim jordan talking about what's going on in washington, leo terrell, we're all fired up and i'm going to do my open on this , because when the left tries to take down the nra but when they sue other organizations like planned parenthood, they decide they don't want to take down planned parenthood, this is as obvious and as dangerous as it sounds. people need to watch this kind of thing because this is what's coming with joe biden. pete: all right you can catch justice with judge jeanine tomorrow night at 9:00 p.m. eastern time. thank you, judge. really appreciate it. >> goodbye, guys. brian: all right, yeah, we just got word about the job numbers we expected two minutes ago and we got them. unemployment dropped to 10.2%. we did add 1.76 million jobs in july, which is a good number. it's not the 4.5 that we got in june, but it's a solid number and the unemployment does drop. pete: forecast i believe was 1.6 , so beat expectations up to 1.76 million jobs added. as you mentioned, brian, not what it was before but when you consider some of the closures, the continued closures to see jobs being added at that level, sort of the good news and ainsley the employment rate falling to 10.2. ainsley: i can't wait for that vaccine to come out and everyone can go back to work and we can hopefully get back to normal. brian: the market looks mildly happy with that so they aren't upset by that number it's not the 5. the question is and this is the questions trump officials all day, is it the recovery still in the cards come fall? >> well, besides writing songs we started in texas, went out to las vegas came back to tennessee ,zz top of course was working on a new release, and just wrapping up his new release and i was standing in the studio saying where's tim?
