in this one he also wrote if we're seen as playing games, white house will be furious. protect our institution by not playing games. remember. flynn pleaded guilty to lying to the fbi. he has since been seeking to have his case thrown out. his attorney sidney powell is calling this an abuse of power accusing the fbi of quote take him out. no reaction from flynn yet only this tweet of the american flag flying in the wind. attorney general barr handling of the flynn case. and former u.s. attorney andy mccarthy had this reaction. >> for years a number of us have been arguing that this looked like a perjury trap. we are now seeing the paper trail start to catch up with what common sense has said for a long time. griff: the chairman of the senate judiciary committee lindsey graham said he wants to know more. >> general flynn deserved better from his government. he was willing to die for his country. the people who were involved in this i hope will be held to account. attorney general barr is beginning to right wrongs. there's a lot more coming. griff: we will see what's coming. sources tell fox news that more documents are expected to be released in the coming days. flynn's attorney says exculpatory attorney says it existst but hasn't been able to get ahold of it yet. not commenting on last development. lots to process this morning and certainly a big story and a lot more to come. brian: absolutely. griff has been in more war zones than most around the country. we got a chance to meet him just had his book come out he talked about after 33 years in the uniform one of the hallmark things he has done is work with general mccrystal to take out zarqawi. you read his book and see his ad verse feelings towards the russians it never added up that he would ever collude against this country. it took attorney general barr to fine out what the evidence actually is it took michael flynn to flip his attorney to a new team to realize how poorly he was being represented. look at this. they actually said him oh because you flipped your attorneys, instead of recommending probation and saying you are a model collaborator with us. we are going to recommend jail time because he wanted better representation. flynn responds with i want this whole case thrown out and then these documents emerge. i hear more damning documents about the comey crew of fbi agents are coming our way, steve. steve: well, brian, thank you attorney general barr for this because he ordered the review of the flynn case in january. what he did was ask the u.s. attorney for eastern missouri, a fellow by the name of jeffrey jensen to review and turn over the documents and that's how we wound up with this. this is one of the things where flynn's own attorney says essentially the government tried to set him up and he was framed. here's sidney powell. >> it's just absolutely appalling what these agents and then these special counsel operation did to general flynn. it's abuse of their authority at every turn. i can't thank attorney general barr and mr. jensen and mr. durham enough for having the integrity and fortitude to get to the bottom of this because that's what it takes. these documents weren't easily discovered. the emails have been in the fbi the whole time. but the handwritten notice notes as i understand it may not have been. they had only special violations of every protocol known for him because they were determined to take him out. steve: that is certainly how it does appear to his attorneys. when you read the two pages of emails and they are from lisa page and peter strzok and then there is a handwritten page from we don't know for sure from whom. large asked to clarify whether the fbi policy required them to inform flynn that he was flying to investigate the crime before he said anything or after he said anything and apparently then, ainsley, if he said something, that could have potentially -- it looks to some as if they were trying to entrap him. if he said something that they felt was a lie they would say okay. we think you are lying. here's the evidence that shows you are lying and then the thought was he would come clean. ainsley: right. then they will hand over that information to the doj and it will be up to them to decide. these are handwritten notes that were taken from the meeting. it was bill priestap's handwriting and he was the head of the former counterintelligence unit for the fbi worked for recall james comey and andrew mccabe. those three were meeting and had a plan on that very day. the notes were handwritten. they went over to the white house. the fbi does, and they send in these agents to go and talk to him and try to coerce him into lying so they would have something against him. the question for the experts, why? did they have a vendetta against flynn? is it because he didn't go along with barack obama? barack obama fired him. this is a three star general to your point, brian. this is a man who served our country. he has a family. his representation was tarnished. went through all of this and paid for all these attorney fees and this definitely looks like a set-up. at least that's what his attorney is saying this was an abuse of power. these leaders at the fbi. what a great organization that is. they have wonderful field offices that investigate, to keep all of us safe. and then you have these leaders that are taking advantage of their position it looks like. let's bring in gregg jarrett a legal analyst for fox news who has written books about. this greg, when you heard this yesterday, what were your thoughts? >> i thought this is the most unethical, dishonest and corrupt act i had ever seen. and i have been a lawyer for 40 years. i have never seen such misbehavior by government officials. the fbi and prosecutors for robert mueller knew that michael flynn was an innocent man. they hid the exculpatory evidence, they charged him, coerced him intimidated and bullied him. threatening to prosecute his son if he didn't cop a plea. and so, you know, they covered it all up in a perjury trap that actually failed when the two agents including peter strzok interviewed general flynn at the white house. they walked out. went over to the fbi building sat down and wrote a report. and in the report they said we don't think he lied. so, that invites the question. how in the world do you prosecute a man for lying to the fbi when the fbi agents themselves say he didn't lie? i mean, that should send chill down the spine of all americans. brian: yeah. i have so many different ways can i only imagine what's going through your head because you lived. this you went through the documents and you had your legal mind working towards it which is why everyone bought the book we wanted to see what was next. all of it is coming true. i think about what comey said to grassley and he said to him i don't think we are we are going to prosecute. i know is he a patriot. he told the president is he a good guy. go easy on flynn. he goes yeah he is a good guy. i want to go back to james comey. this guy is going to be, i believe a psychiatrist just a great future information for future psychotic approaches to his job. when you think about what he said and got caught with chris wallace when he came in sanctimonious as if he thought he did everything right and how he just got caught in that interview. and then think about james comey sitting down with nicolle wallace and confidently, braggadociously saying this. >> you look at this white house now and it's hard to imagine two fbi agents in the state room. how did that happen? >> i sent them. [laughter] something we -- i probably wouldn't have done or maybe gotten away with in a more organized investigation, a more organized administration, in the george w. bush administration for for example or the obama administration. it was process the fbi wanted to send agents into the white house itself to interview a senior official you would work through the white house counsel and discussion and approvals and be there. i thought it's early enough, let's just send a couple guys over. brian: and the crowd roars. greg, we are not talking about fat tony is a lear tony with th. he thinks it's funny and did a great thing. what am i missing and where is christopher wray in this to be equally outraged? >> well, i agree that christopher wray and others at the fbi have known about this for the better part of the last three years. chris wray has been the fbi director for two and a half years. why didn't he have the decency to divulge this information? no, christopher wray has been covering this up. and, yes, thanks to attorney general barr and u.s. attorney jeff jensen, wait a minute this stinks like 3-day old fish let's look at it. and lo and behold they discover the exculpatory documents. the key line in this one is what's our goal? to get him to lie so we can prosecute him or get him fired. sings when is the fbi in the business of getting people fired? steve: right. >> that shows you it was all political to damage donald trump. ainsley: good point. steve: it does appear, gregg, in the lisa page email to peter strzok they were trying to figure out what proper protocol was at the fbi. do we tell mr. flynn ahead of time if he lies to investigators that's a federal crime or do we wait until we think he lied and then say ah-ha we got you. it's pretty clear what the fbi protocol was. >> the emails back and forth are lisa page, top fbi lawyer confesses that she doesn't even know what the protocol and rules are. and then, you know, peter strzok responds well, i'm 90% sure we can do this. this is beavis and but th butt d with malice. these knuckle heads don't even know their own rules not that they would ever care about that. ainsley: can he change his plea now he was pleading guilty. steve: withdrawal. >> it's up to judge emit sullivan. given all these exculpatory documents it, seems inevitable to me that he must, in the interest of justice, allow flynn to withdraw his plea to order -- to vacate the plea. and then the department of justice has to dismiss the case against flynn. the moment that happens, i would predict that flynn would file a lawsuit against not just members of robert mueller's team but people like comey and mccabe and peter strzok and ladies ande for abuse of power and for, you know, things like obstruction of justice and so forth. they deprived him of his constitutional rights. brian: defamation. >> under color of law. ainsley: this is just the beginning. this is not over yet. thanks, greg. >> my and state parks will reopen on saturday that came just an hour or two after we had a golf course owner right here on "fox & friends" pleading with the governor to reopen them. he divided he would do that. one hour from right now governor murphy is going to be joining us live. there you go right there. you know, he has been very diplomatic during this but then again he was once upon a time the california we keep saying people can make up their own minds if they want to go out. people are smart enough to social distance. look at that video. they aren't doing that house party mom in trouble the hypocrisy of the now is evidence in what you just showed. to go after judge kavanaugh now justice kavanaugh democrats pulled out all the stops and attached no reason. we're not talking about a conviction of joe biden here. these are allegations that are serious. this wasn't a drunken a senate party a drunken staffer or a drunken senator. this was an allegation of joe biden probing tara reade with his fingers while they were both sober. that allegation deserves to be investigated and they are choosing to ignore it. you look at all the talk shows last week where potential nominees were on these shows with the various hosts and they were not asked about it. the media has chosen to ignore it. biden has chosen to deflect what the "new york times" story using it as talking points so he can say he was proven innocent. there has been no investigation. and hillary clinton is a flat out hypocrite. the woman who said you have the right to be heard and you should be believed, this is not about anything but protecting joe biden already a weak candidate. ainsley: "the washington post" is now calling on joe biden to address this issue. we did reach out to his campaign and have not heard back. he has denied the allegations. let's move on to diddy. we have watched his career change his family grow the death of his lifelong partner kim porter a few years ago in the fall two years ago. i recently watched an interview with him with fat joe and he took him on a tour of his backyard and showed this monument that he has build to honor her he talks about evolving and how she had a changed my life. and if you have a good woman out there hang on to her and make good decisions and don't hurt her which i thought was a beautiful message. he goes on to say that the black vote will not be free this year a message to joe biden. what did he mean by that. >> think for yourself, americans, regardless of the color of your skin. for too long the black has been bound to the. what has it gotten them? stop listening to the false promises and thinking for yourself whose policies will do for your community? look at black unemployment rates under donald trump. this novelty of coronavirus aside, what has happened in urban communities? look at the outreach i'm finally happy to see from the republican party by establishing offices in urban communities that i have called for for years? go out and talk to people about their economic future, their education future. their families show the example of a man taking care of his family when he loses his partner or a family, a seen before. what advice do you have? >> yeah, brian. it is a tough job market. we have had tough job markets in the past. that's one of the things to keep in mind as you try figure out what your next steps are the first thing have you got to do though is finish your semester well. we have a lot of the college seniors getting right to the end and when they hit the job market, one of the things that employers are going to ask them is how do you deal with adversity? how did you handle your last semester when everything was disrupted? you want to be able to tell a great story there that you thrived. that you finished well. that's going to give employers confidence that you are somebody who can work in this environment. that's step number one. step number 2 is build relationships. look, we can't get together for coffee the way that we used to. but you still have linked. in can you still jump on a zoom call with people. it's important to continue to pursue relationships and, remember, a lot of the people that you are going to be interviewing with came onto the job market after 9/11 or during the great recession. they have been through something like this. they have some sympathy there. use that to build relationships and make a connection that could translate to a job down the road. brian: you have major corporations like disney telling employees you are furloughed. the nfl might be furloughing their employees in a month. these are rock slild companies. so maybe offered, if you get that offer and before an employee calls you up to say hey, i have got to revoke the offer, listen, do you want to delay it? the economy is going to turn around unlike 2008. it's just a matter of us, you know, pulling the cord again and starting the engine up. >> i agree with that brian. look, see what you can imagine. maybe they don't want to do the internship. ask if you can delay and ask if you can come on and do some volunteer work or just get involved with the people that they would have been working with, continue to build those relationships. have you got to be creative here. you have got to take control of what you can control. you can't worry about the uncertainty. do the things that are within your control. brian: brian, real quick, high school seniors got accepted to college tomorrow is the day they have to make the decision. should they be writing that big check to start college when they don't know if they are going to start college in the fall because of the coronavirus? >> they need to ask some tough questions. what are you going to do in the n. the fall if we can't return? what's your plan for remote delivery of classes kick the tires. some have a good plan in place. others will throw you to online program. if that's the case maybe you want to defer a year. ask the tough questions. every school is different. don't assume what one school is doing is what your school is going to do. be a good consumer. if you don't think the value is there, then delay. it's not a big issue in the long term to delay for a year but you want to know what you are getting into. brian: if you go to a g.w. or ithaca college and writing $35,000 check as semester to sit in your room and do online work you might want to take a gap year or gap semester and we will see. very interesting times. there is no wrong or absolute right answer. but, brian, great to get your top officials approach this key white house interview and what their moatizations may have been. steve: joining us right now judge andrew napolitano. judge, you know, you look at this seemingly damning handwritten note from presumably bill prestep, we believe. and it appears to say what i think cops -- isn't that generally what the fbi does all the time? what is goal truth and admission or get him to lie so we can get him fired? tell the truth, admit to something or i'm going to camp you in a lie and i will get you that way the same way they got martha stewart? >> good morning, guys. nice to be with you no matter what we're discussing. anybody who believes in the rule of law, anybody who believes that the laws should be applied fairly should be utterly scandalized and outraged by. this this is a classic case of the fbi setting out to entrap someone and reducing it to writing. you know, early on in law school, law students are taught spirits don't agree in writing. you have to confer the agreement from their behavior. here you have in writing by a senior fbi official that their goal is to get him. whether they like him or not. whether they there he is guilty or not, that's not the goal. the goal must be justice. but they actually plotted to bring him in to a trap. so here's what i think should happen. the justice department should appear before judge sullivan in his courtroom. that's the judge before whom general flynn pleaded guilty. it should renounce and denounce this behavior. should look general flynn in the eyes and apologize to him. it should ask the judge to vacate the guilty plea. it should ask the judge to dismiss the indictment. if all of that doesn't happen, then the president should pardon general flynn within the next day or so because this type of behavior simply cannot be allowed to continue in america. ainsley: judge, if you read the transcript, if you read this handwritten note, is he asking questions. i'm wondering is he saying is this what you are getting at? you want him to lie? almost like he is questioning whether or not and why we write it down? is it because he thought maybe this was not the right thing to do? this is what he says on his note on january 24th. what is our goal question mark? truth? admission? or to get him to lie so we can prosecute him or get him fired? question mark. so, what do you gather by that? >> the author of the note might not be the bad guy. he might very well be saying here's what's going on here. why are we pursuing this? do we really just want to get him fired? do we really want to harm this person? why would the fbi want the president -- at that point the president-elect of the united states to fire his national security advisor. once the fbi was motivated by some political motivation. remember, president obama had fired general flynn as the head of the defense intelligence agency. that's the chief spy for all the military. that's an army general who commands army, navy, air force and marine spies. president obama fired him from that. why would the fbi want donald trump to fire him as well? and why would they do so using the criminal justifiable system? why would they trap him into something like this unless they had his motivation? brian: judge, let's take a step back? what were they were trying to trap him. is he in puerto rico and take as phone call from kislyak at which time reportedly he said don't overreact to the sanctions that the obama administration is putting forward at the u.n. we're going to be taking over soon. that's all he had to do. makes the call. few day respite after a long campaign and after getting this job that he knows is going to be a lot of responsibility and then he is asked did you get a call maybe he didn't remember exactly what happened. so in that moment he might have said yeah, i don't know. i don't remember talking to him about it. but a few days prior somehow this conversation leaked into the "the washington post." the fbi is not interested in who leaked the story. i'm wondering if there is something behind who leaked the story to the "the washington post" that brings us to this moment where flynn is confronted with this story that they're almost hoping he denies so they get him on the logan act or whatever they want to prosecute. brian: look, brian, that's a very interesting theory and probably what happened and the leakers are probably somebody in the fbi or some intermediary with which the fbi works on a regular basis. why did they do this to him? why did they want to get rid of him? why did they care that he had innocent, perfectly lawful conversation with ambassador kislyak and he forgot about it. a real agent would say general, don't you remember that you spoke to him on such and such a day from the transition offices rather than oh, we got you. and, in fact, the fbi agents who conducted the interview nut their notes that they thought he was being truthful. whether he remembered expertly or not he was not attempting to deceive them. this was part of a plot impair the presidency of donald trump before he was even inaugurated. now been discovered. now been revealed in writing and the courts is a politically motivated trap. these new documents are raising serious questions about the true motivation of the fbi's top officials. these are handwritten notes obtained by fox news made by the former fbi head of counterintelligence bill prestep after a meeting with then fbi director james comey and then deputy director andrew mccabe with michael flynn in 2018. what elsin 2017. what's what is our goal truth admission or to get him to lie so we can prosecute him or get him fired. if we're seen as playing games, with white house will be furious. protect our institution by not plays games. his attorney sidney powell is reacting. >> they are devastating evidence of the lengths they were willing to go to disregard all prior protocols. they had only special violations of every protocol that more documents are expected to be released in the coming days. flynn's attorney has said exculpatory evidence exists but she can't get ahold of it. the fbi has denied withholding evidence, but flynn's attorney also tells fox news that judge emit sullivan ordered the government to respond by may 4th stew flynn's request to have more documents unsealed much more to go on this. brian, ainsley, steve? ainsley: so much questions this morning, griff. thank you so much. we had judge napolitano on earlier, guys, as you all know. he said this cost him $6 million in attorney fees. the people who investigated him, those fbi agents that went into the white house to talk to him that day, when he didn't have an attorney present, they said they did believe him that he didn't remember having that conversation with ambassador kislyak. the reason that later he said oh, you know, i didn't tell the truth to the fbi. but he said i didn't remember having that conversation. is he a 3-star general. he is a father. his reputation has been tarnished. he got fired from barack obama. so why would these fbi agents, if this is true, why would they want to set him up? what is the vendetta that they have against him? those are the questions we have. if this is true, will they be held accountable? let's bring in -- well, actually, let's play a sound bite of senator sends is i graham about this very thing. listen. >> general flynn deserved better from his government. he was willing to die for his country. the people who are involved in this hope will be held to account, attorney general bar is let's bring in brett tollman former federal prosecutor. former counsel for the senate judiciary committee. he knows all about this stuff. he joining us from park city out in utah. bret, good morning to you. ainsley: good morning. >> good morning. steve: you know, when you read the notes, it does look to andy mccarthy's point like a trap. and it looks like going in they were trying to get him to admit that he had broken the logan act which that never happens. that never gets prosecuted or to catch him in a lie because ultimately, they weren't really interested in investigating his contact with the russians but, instead, they were looking for a referral to the department of justice. and get that guy out of his job. >> that's right. this activity is outrageous. everybody is saying it. but here is why it is. it's predatory. this is not an fbi -- group of fbi agents who are informed there may be a library of investigation they need to look into. instead, they are creating that investigation. and why are they doing it? they see him potentially in the role he was. in they saw him as a threat. perhaps he would be a threat to what they wanted to accomplish through fisa. whatever reason they targeted him. and you can see now it is starting to come out that it was target. brian: we know that originally they said they got him to cut a deal. part of the reason they got to cut a deal, bret. he didn't have a lot of money. he didn't have a huge job. he spent all his life in the military. just had a book out just to make some money in the civilian world. he takes his job again for not a lot of money. and they start charging you a lot. his legal fees start going up. all right. let me cut a deal and sort of limit my exposure. they recommended probation. but then when he switched attorneys he said we are now recommending jail time for him. thought prosecutor is saying we will go back for probation. what do you think does lieutenant general flynn now have some leverage to go for exoneration? >> yeah, a couple of things, very important there. people plead guilty when they're innocent. why do they do it in the federal system? because the federal system has what's referred to as the trial penalty. if you take them to trial, you are risking many, many more years in prison. decades, and they could do it. they could do it in this case. they could create a sentence that he would be facing, you know, decades in federal prison. so enormous pretty much. so he pleads guilty thinking it's going to be probation, he will get this behind him only to learn and realize that his lawyers didn't serve him well. there were conflicts of interest. he is now feeling that he is stuck. he hires a new lawyer. and she aims at one thing. one thing alone. she wants to see the underlying documentation that justified what they did. that's called exculpatory that they found. usually you find that kind of evidence and it suggests some sort of innocence. here it suggests innocence and misconduct by the fbi. it's outrageous. ainsley: it really is we are supposed to be able to trust the system. he tweeted out as griff was saying that picture of the american flag has been to say that the truth will set you free, finally justice in all of this. devin nunes was talking about what flynn should do next. listen to this. >> well, clearly, general flynn is going to have a civil rights case. and i think it's going to cost the government millions of dollars. secondly, hopefully there is going to be some prosecutions for this matter and the judge really has an opportunity here to step in and sanction these lawyers. the house republicans brought you just a snippet of this information back in 2018. we were mocked. we were told it was a joke. now, all of a sudden realized what we told you at that time not only was it true, we didn't even know the half of it. the evidence is continuing to pile up and general flynn's favor. ainsley: thankfully if this is true those handwritten notes were released and found. it could right a wrong here. what do you think will happen to the folks, if this is true, that were involved in that meeting, the handwritten note was from bill priestap and he wrote it all down with question marks. maybe he was wondering if this was the right thing to do. james comey was in that meeting allegedly and andrew mccabe the fbi deputy director. what will happen to them? >> so. a lot of people are lowing out the phrase obstruction of justice, that's not the only issue for these individuals. if they knew going into it that they were setting this up and creating this crime that wasn't actually there, then they made representations to the grand jury and then they made representations to the court, all of those can have criminal consequences. keep in mind, the supreme court in 1971 said that an individual like flynn can go after agents that do this kind of thing knowingly violate someone's constitutional rights. it's called the bivens action i'm pretty certain if this case gets dismissed, that will be the first thing he does. steve: all right. let's see what happens. breadtbreathbretttolman. steve: salons and recreational health facilities and gyms and stuff like that, brian. brian: restrictions also easing today over in alabama. retail stores will open one a maximum of 50% capacity. beaches are reopening. cracking down. gavin newsom closing all the beaches and state parks tomorrow after massive crowds last weekend. today, at the white house, president trump is going to meet with new jersey's governor phil murphy. the governor announcing that golf courses and state parks will reopen on saturday. brian i thought of you have yesterday when i saw that gavin newsom was going to close all the beaches. i know this is something that you have just been completely against because people -- you want people to make up their own minds. those people who were not social distancing, they hurt it for everyone else. now the beaches are going to be closed. brian: that's right. they can punish. steve: governor desantis set he was going to reopen most of the state but not palm beach county. he is not going to open miami-dade and he was not going to open broward. things like golf courses, parks, marines and pools will reopen. retail 25% and restaurants be able to seat people outside about 6 feet apart. regarding all these stay-at-home orders, and jillian touched on this a little while ago regarding what elon lusk said yesterday during his analyst call to investors wheres at the are a actually made a profit, he said of these four shutdowns he said, quote: if people want to stay in their house, great, they should not be compelled to leave. but to say they cannot leave and will be arrested if they do this is fascist. this is not democratic. this is not freedom. give people back their g.d. freedom. brian. brian: yeah, so each state is going to make their own decision. my fear is that democratic states and i hope it's wrong, are going to take their time because they don't want to restart donald trump's economy. they want to start joe biden's economy in november. my hope is that people understand the type of pressure and the amount of careers and stress people are under lifted as soon as possible. unlike when this was put in place in march. the president is going to lift restrictions. he is not going to extend the stay in place orders. we are educated with it. we should make our own decisions whether we are taking the subways or walking the streets. when people who are in law enforcement who are put in terrible positions. if they would walk the beach in newport beach and say hey, guys, can you separate here? you five together? do you understand? people will start policing each other and that would work its way out. but to go ahead and say i'm closing the beaches. i didn't like the way you acted last week when most of that state is perfectly fine just some congested areas aren't, this is the foundation for an overreach that i never thought was going to happen in this country as serious as as the coronavirus is so are people's mental health, drug abuse, alcohol abuse, domestic abuse all on the rise with this. not just a matter of showing discipline. people are watching their lives melt away and they can't -- they are at the breaking point. when they think the governors are overreaching, that's when people are going to snap. if politics are playing a role here, that is a bridge too far. ainsley: that beach was open and people could make the decision. the problem is though, brian, they started to seeing more people go to the hospitals after that weekend. after all those images were release new california with corona. i think the governors have to make tough decisions because they don't want a relapse of all of this. that wouldn't make them look good. their residents would be dying. then have you people like my mom is very sick and as much as i want to go out and i -- i still want everybody to play by the rules. when i finally do get to go home to visit her. brian: but is your mom going to the beach? ainsley: no. brian, eventually she will be around family again. i understand both sides. i really do. i just don't want a resurgence of this. i just don't want us to go through all of this. it's been hard for everyone at different levels. steve: ultimately from the very beginning with fauci and with birx and what the president have said the whole idea was to make sure that the hospitals are never overwhelmed. and that's why we had to flatten the curve. so the hospitals would never be overwhelmed. we are going down that hill. and that obviously is what newsom was referring to out there. that's also why desantis in florida did not reopen palm beach county, dade county and broward county yesterday. anyway. we will hear from governor phil murphy in two minutes. in the meantime go to jillian who joins us from for more, let's bring in the governor of new jersey, phil murphy. governor, good morning to you. >> good morning, steve. thanks for having me. steve: it's good to have you as well. i know you wanted to be on "fox & friends" early this morning because you're going to hop in a car and drive from trenton down to washington. what are you going to say to the president? what do you want? >> very much looking forward to sitting with him and appreciate the opportunity to do so. first of all, thank him and his administration. we have done a lot together in this awful pandemic of the past couple of months. jersey has been hit incredibly hard, 6770 lives lost. the president knows new jersey well. his team knows it well. got a lot of new jersey blood in his team. secondly, talk about the furthering the testing partnership that we have been endeavoring to get to. and that holds a lot of promise. thirdly, we are going to have to talk about financial assistance. not as some would say the legacy issues. that has nothing to do with it. this is to allow us to keep the front line workers, educators, firefighters, police, e.m.s. in their seats and their jobs. and then lastly, i think both of us i n our teams understand this is not going to be over and done tell end of may, for instance. this is a partnership that's going to have to continue through at least therapeutics or a vaccine is with us. a lot of thanks and a lot of looking in the crystal ball and figuring out where we can continue to work together. steve: well, you know, as your former job as ambassador to germany, you are a diplomat. and i know that you are a democrat. he is a republican. and i think he would appreciate what you just said where you said, you know, i'm not trying to fund legacy things like pensions, which here in new jersey has historically been a gigantic problem because it hasn't been funded. and it's just through the roof. so you are saying that what you want is just relating to the pandemic, specifically. and the fact that some local governments, state government as well could have a short fall in tax revenue and so you need a bailout just for the pandemic. >> yeah. i wouldn't call it -- the only thing, steve, you are largely right. i wouldn't call it a bailout. i would just say this is a war. we are at the front lines. we had come into office two and a half years ago. and had made enormous progress. historic pension payments. big surpluses. rainy day funds. everything was going well. and then as mike tyson reminds us, everybody has a plan until you get punched in the face. so we know what we have got to do with the old legacy stuff. we need help with the here and now, educators, police, fire, e.m.s. the front line stuff. we are bleeding resources. helping people whether they have lost their jobs. whether they are sick. small businesses, et cetera. that's where we need a big dose of federal cash. steve: yesterday, at about 6:50 we had golf course owner on and he made an appeal to you to open the golf courses of new jersey and you announced yesterday that you are going to do that effective it weekend. why did you have that out there -- out of curiosity, governor? because as sports go, you know, golf is one of those things where you are so socially distanced from the other players, unless you are in the same golf cart with them but they were not going to allow that. >> yeah. we had shut golf. we had shut state and county parks. we had done that together. and the curves as y'all mentioned have begun slowly but surely. even though the fatalities literally yesterday over 300 new fatalities of blessed souls. the curves have h. begun to get better for us. when you have add the mental health challenges that you and your colleagues were discussing in the last episode, we said, you know what? let's open them up this weekend but let's make sure everybody plays ball. so this is a real test case for us. you know, golfing at distance, no more than one person in the cart. lots of other golf pro-calls in. i would love to you wear a face covering. let's allow folks to take a little steam out of this but at the same time be responsible. if this weekend goes well, the weather is going to be good here. that could portend to other steps we could take not too far down the road. steve: right. well, i hope you were able to seat segment we did. it sounds like you did yesterday. in the meantime, let's talk about something else. we have got a letter from the recreational fishing alliance and united boat men of new jersey to the governor. you're busy. i don't know if you have seen it. i'm going to read part of it to you it. goes like this, governor murphy. the for hire businesses that make up infrastructure for new jersey's recreational fishing industry are essential and necessary to support recreational salt water fishing access. a continued closure jeopardizes the future of that segment of the industry and opportunity of a structured and tempered opening, however, could help save many of the those historic and traditional businesses. so would like to you help open them up. are you going to look at that? >> absolutely we will take something like that under consideration and take it seriously. by the way, i don't blame folks for writing a letter like that at all. we have one of the great shorelines in america. maybe the world. the fishing industry is really important to new jersey. we have allowed a certain amount of marine and boating activity to take place. something like that i would clearly take seriously. no promises about i absolutely will take that under consideration. steve: terrific. final exit question to you, governor, before you leave for d.c. everybody in my neighborhood up here in bergen county would like to get back to normal. specifically they would like to get back to work. how soon? >> yeah, listen, who could blame them? i don't have a crisp answer for you. bergen county as you know you lived it was ground zero for news new jersey. the six counties in the northeastern part of our state that are the big commuter counties into new york city are the ones that are been crushed and hit the hardest. as soon as we can responsibly get the health challenges under control, i put a 6 point plan out on monday, 4 points of those are healthcare related. that's why testing -- our testing discussion with the president, for instance, today will be really important. and i deeply appreciate their partnership on that. so, i hope sooner than later, steve, we are -- we have got to check through the healthcare, the curve has got to come down. the testing has got to get ramped up. we have got to be able to contact trace and isolate. i think when we have that in place and i hope that's sooner rather than later by the way. we can begin to take the steps that we all want to take. steve: governor, does your gut tell you it's going to be in may? >> you know i said the other day it's a matter of weeks and not months. i would leave it there. again, the most important thing we have to do is to keep the social distancing. new jersey has done an extraordinary job. by the way bergen county has led it because it was so severe there folks have really complied. in a state park ask folks to please stay atway from each other. don't congregate and god willing, this curve will continue to flatten. that's the best thing we could do to get businesses back up on their feet. steve: all right. governor phil murphy joining us from his office in trenton. governor, thank you very much. have better news story to talk about now. starting to reopen these restaurants. when you talk to the owners and the people that you have dealt with before -- that you have gotten to know, are they ready for this new era? >> you know, brian, there is a certain excitement out there believe it or not. we feel that we can do this. we feel that we're ready sure, we are implementing the spacing requirements but restaurants have god be masks and ppp equipment that they need. that's key to them opening. what i'm seeing in georgia is exciting. restaurants are implementing spacing procedures. mask procedures. new sanitary procedures. they are focused on how to keep everyone safe and how to get it done and we are seeing consumers react. and what's exciting to me, brian, is i think about a third of the population is going to come right back. i think the second third of the population is what i'm calling the reserve third. they are going to wait a week or two. they want to make sure the systems are in place that people aren't getting sick, then they will come back. the third element of society i'm calling the certain third. they are probably not going to come back until there is a vacce or some real level of comfort that they can't contaminate anything. the point is i'm seeing an initial reaction. i'm seeing some excitement in the marketplace, brian, for people to come back. kellyanne conway counselor to the president. kellyanne, good morning to you. >> good morning. ainsley: the president was hinting around he was going to flynn back in march. now it is reported after destroying the life and the life of his wonderful family and many others also the fbi working in conjunction with the justice department has lost the records of general michael flynn. how convenient. i'm strongly considering a full pardon. if this is true and we do have the records, we have a handwritten note with all of the things that they wanted to do, they were going to walk into the white house. they were going to force him to lie so they could prosecute him or get him fired. what's your reaction and what's the president's reaction this morning? >> ainsley, regardless of your political affiliation, even if you even care about voting whatsoever, every american should feel a chill today that federal government officials in high places can come to the white house four days into our presidency and come here to try to set up the national security advisor to the president and the fix was in, imagine if what was written in the margins of these notes should we get him to lie or get him fired. imagine if anything like that was in the mueller investigation two years. imagine in one of our handwriting in the margin is today collusion monday or russian tuesday? when one is it? they pecked around and hunted around at taxpayer funding for years to find absolutely nothing. this man was set up from the beginning. probably thought they were coming in to be helpful since we had been on the job for four days. the president had made clear for all three years that michael flynn was treated unfairly now we know it was probably criminal what was done to him. may i just add that the man had a three decade plus career in the united states military. and he came here ready to serve his country. was gone within days. and now we see the fix was in from the previous administration's people. steve: right. it is jaw-dropping to many, kellyanne conway. but here's the thing. while those notes were referring to a meeting they were going to have with mr. flynn before the president was inaugurated, for the last three-plus years, this has been donald trump's department of justice. there have been in the department of justice who have known. this they have seen that thing, and, yet, nobody has been held accountable. >> right. january 24th ended up being a very important date in all of the flynn interactions. and i think that sally yates came here on that day or talked to certain people here that day. now we have to go back in time to see what was going on. we were trying to put together a government. we were trying to form a government. we were being told by people in the previous administration we are here to help you. i was told that i came here for lunch one day during the transition to really have a peaceful transition of power which is what democracies have this i is a disgrace for government officials to abuse their power in this exact way. this is what the people fear about the federal government. i think that general flynn has probably phased millions of dollars in legal fees. three years of reputational scorn. and isolation. he obviously had to leave his job here. but the president won't make any decision -- the president will make an announcement like that. he feels clear that people around him were treated very unfairly and in this case worse. brian: so the president had a meeting with a few gosm governors. one republican. governor murphy today from new jersey. yesterday was governor edwards from louisiana. they are all pretty much on the same page. let's open and let's open responsibly. here is what governor murphy talked about when it comes to reopening new jersey which has been really hard hit. >> it's a war. we are at the front lines. we had come into office two and a half years ago and had made enormous progress, historic pension payments. big surpluses. rainy day funds. everything was going well and then as mike tyson everybody has got a plan until you get punched in the face. so we know what we have got to do with the old legacy stuff. we need help with the here and now, educators, police. fire, e.m.s., the front line stuff. we're bleeding resources, helping people whether they have lost their jobs. whether they are sick, small businesses, et cetera. that's where we need a big dose of federal cash. brian: that's what the governors are asking for. one of the things we understand they need direct state aid to spend the way they want. to say mitch mcconnell said yesterday you know what? maybe i will exchange that for providing liability insurance against these businesses reopening against lawsuits which are already coming forward. would that be an exchange the president would get on board with? >> cece what the leader is saying and obviously this fourth tranche will go to an negotiation like the previous three did. fortunately there was overwhelming bipartisan bicameral approval of relief packages. governor murphy makes a very important point on people's mind we want to make sure people have covid related relief. the federal government probably doesn't want to fund the big black hole deficits that many of these states incurred long before covid. i want to credit governor murphy and his team they have been fantastic to work with here at the white house. we have surged supplies to the state, obviously. the usnf comfort was open to new jersey patients as well. if new jersey were a country. it would be the top 10 or 15. some crazy statistic along with new york in terms of hardest hit and number of cases and the like. solve think they did a terrific job and you see back-to-back democratic governors here republican governors. nobody cares what political heart they are from when they sit in the oval office with the president of the united states. not only do they exchange pleasant trieprevent pleasantri. i think the governors super smarted to come to the white house and present their plans to the financial experts at the white house to look for guidance does this look like it's going in the right direction? what do you think about this mechanism? we know test something a big issue everywhere. that's why we surged our testing capacity. that's a work in progress. all great ideas. nothing resonated with my soul that would be adequate to somehow feel eve fill a little e void that kids are experiencing. i have been seeing prom dresses for six months. i know there were tuxedos rented and flowers about to be an the arms of beautiful young ladies. school was canceled before our students here got to even have their prom. i just knew i had to do something. i just began to just pray and seek what god wanted me to do here for our kids. and, you know, my husband was even kind of stressing like you need to do something. i said, look, i'm asking god. when he gives meet answer, i will get back to you. so one night, you know, i just went to sleep and i completely cried out to him and said god, i need to you show me how i can fill this void and hurt i see on social media with these students and with their parents. and what i woke up one morning and it was just as clear to me as it could be that our kids, their faces were lining the drive into our school and that, you know, their school colors were surrounding them. i told my husband he is like let's do it. so we immediately set a plan into action. ainsley: it's beautiful. you are being called america's principal now. tell me about this class. i know you have a heart for this class particularly. >> i do. i have a heart for our students most definitely. our school is a community treasure here. this is the best school have you ever seen because it is founded in what i like to think of is how america used to be. we are small town america here. that's where we live. i believe god is in this school because he comes here every day with the people who walk through these doors. god has not been removed from this school here at poplar springs. they were born amidst the turmoil of 9/11. how is that that that was the early days of their life now here they are again they are ending their high school career in the midst of unprecedented worldwide events like no generation has ever the documents? griff: the handwritten notes are made by the former fbi head of counterintelligence bill after meeting he had with then fbi director james comey and andrew mccabe discussing interviewing flynn. quote, what's our goal, truth, admission, to get him to lie so we can prosecute and get him fired and then, quote, as we have seen as playing games the white house would be furious and remember flynn pleaded guilty to lying to the fbi and since withdrawn the plea and seeking to have case thrown out. >> there's devastating evidence of links they were willing to go through, they had only special violations of every protocol for him because they were determined to take him out. it's abuse of their authority at every turn. griff: no reaction from flynn only tweet of american flag. unsealed documents also showing emails between special agent peter strzok and ex-fbi lawyer lisa page. they are talking about how to conduct the interview. attorney general barr currently overseeing investigation into the doj's handling of case. fox news judicial analyst judge napolitano had this to say earlier on "fox & friends". and and classic case of the fbi setting out to entrap someone whether they like him or not or guilty or not. that's not the goal, the goal must be justice. griff: sources tell fox news that more documents have coming in the next coming days and fbi denied withholding evidence. guys. steve: they have, indeed, griff, thank you very much. let's bring in columbus, ohio republican from that great state jim jordan, ranking member of house oversight reform committee. jim, good morning to you. >> jim: good morning. steve: you have been talking about this for a long time. looks like somebody at the fbi and department of justice was out to get flynn and entrap him, have him tell a lie, charge him on that, prosecute him on so that they could get rid of him and em be razz -- embarrass the trump administration, a gut punch just at the time of the inauguration. >> jim: just worst than we thought. for one of the citizens they go to fisa court, they take the now famous dossier, dossier they knew was salacious and unjustified and not true and basis to spy on one of the individuals. they don't tell the court that the dossier is russian disinformation and paid for by the clinton campaign and the guy that wrote it christopher steele told the justice department he was desperate to stop trump and now we learn they go after mike flynn and set him up. what i want to know why didn't bob mueller tell us this in remember when bob mueller was named special counsel, the greatest guy to come to washington, the most honest guy since george washington. why didn't he tell us this and more importantly where is christopher wray, why didn't we learn any of this from him? thank goodness from sidney powell and william barr, we would have never gotten the information. brian: true, let me ask you when you look at underlying documents that sidney powell requested that attorney general sessions didn't that barr, sessions, i don't know what he was doing, do you wonder, did mueller have the documents and he discovered that strzok was having an affair with page and said these guys got to go because of texts and others documents when they are actually working? >> jim: i have no idea. bob mueller 19 lawyers, 2 years to do this and we are just now learning this. thank bill barr and sidney powell pushing for this or we wouldn't get this information. again, i come back why didn't we learned from chris wray. you can all sleep well at night, we got it under control. guess what, we learned more information about general flynn and importantly mr. horowitz told us 4 weeks ago, he's looked at 29 fisa applications, random applications where american citizens have been spied on and he found that in every single one there were major problems. in four of 29 they couldn't find the woods file, the evidence that they take to fisa court and in four cases they couldn't find and the fbi director say, oh, we can all sleep well at night. again, if they can do that to a three-star general and the president of the united states, imagine what they can do to you and me and what they do to 75 million people and christopher wray needs to tell us what he's been up to as director of fbi. ainsley: this is a man who fought for our country for three decades, has two kids, has a family, this has cost him millions of dollars in attorneys' fees and tweeted out american flag as to say the truth finally justice in this. you mentioned that sidney powell and bill barr they are bringing light and this guy who wrote down the notes if he was asking questions like are they asking me to lie because why would you write that down and when you put question marks on the end of the sentences, is that what they're asking me to do, almost to say i'm sitting in a room with my boss, they're telling me that i have to go and do this and i want a paper trail. what do you think? >> the vast majority are fighting hard for the american people every day. the failure of leadership on the operation of the fbi. the greatest understatement ever. they are the ones that coordinated this thing. that's where the problem was and that's where we need to find out why didn't we learn this before. bob mueller spent taxpayer dollar and did-long investigation, why didn't we learn this before? this is -- this is so long -- wrong what they did to general flynn and so wrong what they did to the president of the united states and he's an interim. he hasn't done his report. this is a major problem. it's why we need a reform in the whole fisa process. steve: in the last 3 years this has been donald trump's department of justice and, you know, there's a new sheriff in town. we've got bill barr. he's been on the job replacing sessions ultimately and -- and in january he came out and said i'm going to appoint a fellow by the name of jeffrey jenson and that's where the documents came from ultimately. explain how this would be part of a bigger picture on how behind the scenes donald trump's department of justice is looking into this with the jenson guy to finally give the american people a picture of what happened in 2017? >> well said. if bill barr is not the attorney general, we don't get the information. that's plain and simple. i hope there's going to be a report. i look forward to that. i hear good things but we will know when that comes out. bottom line is what took place before him, what they did, they did to american citizens, what they did to a 3-star general and what they tried to do to the president of the united states, i keep coming back when the mueller report came out a year ago, he said we would all do well to remember. if they can do it to a president of the united states, imagine what they can do to you and i. and that is the -- that's why this has to get cleaned up and need reforms put in place so this doesn't happen again sew with can all sleep well at night which is what chris wray told us 2 months. doesn't look like that's the case but we want to get to that point. brian: james comey's book writes himself as hero, he continues to be -- has a lock of self-awareness like i've never seen before. here with nicole wallace at 92y reflecting on wonderful career and how he took down flynn. listen to this. >> you look at this white house now and it's hard to imagine two fbi agents in the room? how does that happen? >> i sent them. [laughter] >> something i probably wouldn't have done, maybe gotten away with in a more organized investigation, more organized administration, in the george w. bush administration or obama administration, there was process. so if the fbi wanted to send agents into the white house itself to interview a senior official you would work through the white house council and discussions and approvals and who would be there and i thought it's early enough, let's just send a couple of guys over. brian: those guys had no interest in the story of him talking, they we wanted to get the guy out of the white house. tell me what you make sense of this, jim. why would president obama bring up two things to president trump, look out for north korea and look out for michael flynn, what's going on there? >> jim: arrogance and ego of jim comey, the attitude he had, there was process, they should have notified the white house counsel that they were talking to michael flynn. they weren't square with general flynn, a guy who served our country, 3-star general, it's so hard what they did and the arrogance that comey had, the guy in charge and all of this happened under his watch, mccabe, all of the people in the fbi, this happened under jim comey and he's the guy responsible. so many americans are learning now that everything we have said for several years, the only thing we had wrong is it was worst than we thought and americans are fed up with this and they want it cleaned up. brian: more to come. ainsley: we had people in the show this morning. they created an investigation. this was setup and dan bongino has been talking about the fbi and they find his or her crime. this is america, this is very scary and you're right, if we don't hold someone accountable, this could happen to you. anyone who runs for office. we don't like your politics, we will find a crime that you've done. it's very scary. will people be held accountable? >> jim: i think so. again, all we can do is highlight what happened. the other thing we could do and we have been pushing to do this we can bring in mr. horowitz. he has issued a report of fisa process used on carter page. we have yet to have horowitz in committee and he should come in and testify. that should be step one. as far as holding people accountable, that's the department's job, i trust john durham. i hope someone is accountable. steve: because as you said a moment ago it's worst than we thought. jim jordan from the great state of ohio joining us today from columbus. thank you very much. >> jim: thank you all, take care. steve: businesses in north dakota are preparing to reopen, not reopening today. the governor's executive order shuttering some businesses expires at the end of the day today. restaurants, salons, recreational facilities will open their doors, it will be may first. brian: all right, restrictions are easing in alabama. retail stores will open up with capacity of 50%. beaches are reopening with no more than 10 people per group. elected medical procedures also allow today restart, maybe saves lives of hospitals, ainsley. ainsley: california governor is cracking down and closing all beaches and state parks tomorrow after massive crowds last weekend. today at the white house president trump is going to meet with the governor of new jersey phil murphy, announcing government courses and state park wills reopen on saturday and if you're watching us this morning and you're going to go to the beaches, just social distance. do the right thing. you're going to go to a protest and protesting about getting back to work, do it safely, wear a mask. social distance, don't stand on top of each other or they're going to be consequences or your beaches are going to be closed or not allowed to be out there protesting which is your god-giving right. steve: because as ainsley, dr. birx and dr. fauci and experts said to get where we need to be is by social distancing and that's what we have been doing. the federal social distancing guidelines actually expire tonight and decided not to go forward beyond today, the last day of april. coming up in 15 minutes we will find out exactly what sort of a toll this particular pandemic and the stay at home order and everything has taken on our economy because we are going to get the very latest jobless numbers. we do know according to our experts our economy shrank 4.8% between january and march and remember, brian, we only got a couple of weeks of this particular pandemic in march. you have to figure the next quarter is going to just be awful and the technical definition of a recession is 2 consecutive quarters of negative growth and it looks like that's probably going to happen. brian: yeah, jared told us a degree. as you do that, not only do people go back to jobs, money goes into the state coffers and we could stop writing checks for money we don't have to debt that's too big that we will probably never pay back while we rescue on four package. the house is home, i don't know how they are going to work on this. the senate is coming back monday. i know what they'll do about this, a lot of moving parts and i just hope states don't just talk holistically about an entire state. i hope they substance certain sections to have state that can open like in florida and ones that can't like dade violate constitutional rights this as city commissioners of detroit suburb vote to censor conservative member for attending protest violating stay at home orders when commissioner gibbs gave absolute no and she's fighting back. kim, good morning to you. >> kim: going, steve, thanks for having me on. steve: we talked about how restrictive the stay at home orders of governor whitmer have been in michigan. you know detroit is a much different place than rural michigan and a lot of people in the nonhot spots wants to do things, couldn't do that, that's why they had to protest and you got in trouble because the city commission said you did safe distance when you were at the particular protest. what do you have to say to them? >> well, i attended the rally in support of small businesses that are being destroyed by the governor's draconian executive orders and since that point in time i've been inundated by emails -- >> steve: wow, that is something. why were you protesting governor whitmer's ruling there? what did she get wrong of the state of michigan? >> well, so many small businesses are just closing down. we are not getting the help that we need from the state, from the payroll protection program, from the county. it's just been an incredible challenge to be able to maintain business as usual and great deal of businesses have just decided to close. they can't do it. steve: sure. so as you look at what the president is doing, he's not extending the federal or presidential social distancing guidelines, now it's up to the governors in each state. do you trust governor whitmer going forward that she will get it right in the future? >> kim: well, i hope that she will have it -- have it right in the future. at this point i can't predict. i do understand that the court has sided with her, however, that doesn't speak for all of us that have been -- that have been unemployed for six weeks or more now. it's just far more challenging than it needs to be. steve: you know what, kim, you're not alone. people all across the country are feeling the same thing, very challenging, people want to get back to work, they want to do the same thing -- if they and the democrat majority seized on the opportunity to retaliate of my opposition of financial mismanagement of the city. i was censored by court. i violated no law or no executive order. steve: well, just 3 minutes away from the weekly jobless claims report. we will bring you the number coming up very shortly and also katie to react to that and so muchch more. brian: back with fox news alert. jobless claims have been released. climbing now to 3.8 million as the economy reels over the coronavirus obviously. that's more than economies predicted. so 3.8 million. last week was 3.4 million. let's bring in katie. we know it's going to be bad when you tell the whole country to go home or quit their job or ignore their job, they will end up with jobless benefits, what do you think about this number? >> well, brian, the number gets us closer to 30 million mark of americans who are now unemployed and that does not account for all american who is have lost their jobs and this is when you see local governments in partnership with the federal government racing against the clock to try and get through that phase 1 of reopening their economies that the white house put out because this is unsustainable, unemployment rules at the state level are going broke. you're seeing state governors saying that they may ask the federal government for a bailout and we have seen a lot of the paycheck protection program that republicans have been pushing forward with the white house, however, that is a stopgap measure and will also run out. we saw it run out the first time very quickly. if you keep the economy closed, people can no longer go back to work, so this is a difficult balance governors are trying to strike as more americans lose their jobs. brian: we are at about 30 million jobs, we need money that we have to eastern so whether it's restaurants, gyms, people have to go thank work, there's got to be a way to do it. you have science and economists need to be at the table too. we agree with that. meanwhile let's talk about the presidential election. normally it would be the lead in every hour and every block, let's talk about what joe biden is dealing with while he sits in the basement and makes sense with democratic vp's and other things about tara reade's allegations of sexual assault. biden himself should address the tara reade allegations and release relevant records which we know at the university of delaware, what do you think, katie? >> katie: the democratic party has been holding republicans to for decades now and if they want to be the party that believes women, that the me too movement, joe biden has obligation to respond to his accuser and exwhine why this isn't true. he had hillary clinton come out this week and endorse him, not surprisingly. but if they don't hold themselves to the same standard being prowoman, he's going to have to address the issue. democrats are very good at pushing aside allegations with their party so long as the candidate falls politically on the issues that they believe in. brian: the talking points were published, the democrats were told to used and stacy adams read them verbatim. "the new york times" did investigation and did not find her credible. new york times said we didn't say that. we made no conclusions either way. i want you to weigh in real quick. >> katie: yeah, look, tara reade is just asking for information that joe biden has and if he has the ability to release more information and be transparent, then he should do that and clear his name. brian: think about the humiliation of kirsten gillibrand and amy klobuchar and they were put in impossible spot because joe biden doesn't have coverage to speak about the festering problem. >> katie: they put themselves in the spot. brian: yeah. >> their hypocrisy is very clear on display. brian: the house will now return to washington next week to work on a new relief bill because of concerns about the virus. congressman dan crenshaw is outraged by the decision. he will sound more on that next. steve: it is 8:40 in the east and we are back with fox news alert. just ten minutes ago the weekly jobless claims number came out 3.8 million filed for the past week as the economy reels over the covid-19 crisis. that's more than economists predicted. 4.4 million jobs were lost the prior week. so it's less than last week, however, the bad news is it's a total of 30 million people lost their jobs and applied for unemployment insurance since march, ainsley. ainsley: scary times, heartbreaking for so many families. let's bring in gop congressman dan crenshaw in house homeland security member, form other navy seal and author of fortitude and resilience. that's a word that we heard a lot. that's the american way and we are trying to get through this. as you hear the numbers, it has to break your heart. >> this is devastating and the federal government has spent trillions of dollars trying to stop the bleeding on this but that can only last so long. the only way to stimulate the economy is get money pouring into. we are doing that in texas. we are doing a staged reopening, it's smart reopening. the rest of the country can follow suit. not the entire country is like new york city. we have to start being bold and honest with the people. listen, it doesn't take any courage whatsoever to tell people to stay home or stick the police on them if they disobey, that takes no courage whatsoever. it does take courage to be honest with the american people and tell them about the risks, educate them about the risks and say, listen, we all have a personal responsibility to get back to normalcy and new normalcy and mitigate risks as we go. we can do this as a people and we have to do this. there's a healthcare cost to those numbers. procedures aren't being done, lives are being lost, livelihoods are being destroyed, there's mental health issues associated with that, there's loss in human dignity and we cannot ignore that anymore. brian: all right, let's talk a little bit about something else and that's the raw deal michael flynn has gotten. dirty cop james comey got caught, it's just the beginning. we watched lieutenant michael flynn, i don't know if you know him, congressman, but we have got a chance to know him about a year and a half before he got the job with president trump. now he's gone. paperwork reveals that he was set up. howdies tushed does this make you about your government? >> extremely disturbing and no i never knew him. here is what i do know that the media and mainstream public opinion painted him as russian puppet. why is that? a few fbi agents were corrupt to the core trying to make him sound like that and the media puppet that collaborate with the people did the same thing. we see this over and over again. there's more evidence growing twine fisa warrants, obama-biden administrations to target conservative groups and now this. they keep repeating over and over again that the trump administration is corrupt and yet they provide no evidence even with all of the powers on president trump, with the mueller investigation and the impeachment investigation, they've never been able to prove any corruption and yet we have so much more growing evidence of corruption in that administration and corrupt to the core and the reason they keep calling the trump administration corrupt is because they are trying to project, project and distract what has actually happened and what would happen under another biden administration. this kind of thing is infuriating. the institutions are supposed to be trusted by the american people. i always bushed back against the notion that there was a deep state. i always pushed back and i never liked the language. i see evidence like this and it's chilling. there's no other word for it, it's chilling. steve: now you're pushing back against nancy pelosi because essentially the house, returns next week postponed. >> cowardess. it's more than accountability. let me remind, everybody, if we get paid hourly, you bet nancy pelosi would be there. this is about leadership, leading on the front lines along with the american people who are also on the front lines, nurses, doctors, people still working, grocery stores, people trying to grow food and raise cattle and watching their food production plummet. people are fighting on the front line, they are risk-mitigating and smart but still engaging in life. why can't congress do the same? in this one he also wrote if we're seen as playing games, white house will be furious. protect our institution by not playing games. remember. flynn pleaded guilty to lying to the fbi. he has since been seeking to have his case thrown out. his attorney sidney powell is calling this an abuse of power accusing the fbi of quote take him out. no reaction from flynn yet only this tweet of the american flag flying in the wind. attorney general barr handling of the flynn case. and former u.s. attorney andy mccarthy had this reaction. >> for years a number of us have been arguing that this looked like a perjury trap. we are now seeing the paper trail start to catch up with what common sense has said for a long time. griff: the chairman of the senate judiciary committee lindsey graham said he wants to know more. >> general flynn deserved better from his government. he was willing to die for his country. the people who were involved in this i hope will be held to account. attorney general barr is beginning to right wrongs. there's a lot more coming. griff: we will see what's coming. sources tell fox news that more documents are expected to be released in the coming days. flynn's attorney says exculpatory attorney says it existst but hasn't been able to get ahold of it yet. not commenting on last development. lots to process this morning and certainly a big story and a lot more to come. brian: absolutely. griff has been in more war zones than most around the country. we got a chance to meet him just had his book come out he talked about after 33 years in the uniform one of the hallmark things he has done is work with general mccrystal to take out zarqawi. you read his book and see his ad verse feelings towards the russians it never added up that he would ever collude against this country. it took attorney general barr to fine out what the evidence actually is it took michael flynn to flip his attorney to a new team to realize how poorly he was being represented. look at this. they actually said him oh because you flipped your attorneys, instead of recommending probation and saying you are a model collaborator with us. we are going to recommend jail time because he wanted better representation. flynn responds with i want this whole case thrown out and then these documents emerge. i hear more damning documents about the comey crew of fbi agents are coming our way, steve. steve: well, brian, thank you attorney general barr for this because he ordered the review of the flynn case in january. what he did was ask the u.s. attorney for eastern missouri, a fellow by the name of jeffrey jensen to review and turn over the documents and that's how we wound up with this. this is one of the things where flynn's own attorney says essentially the government tried to set him up and he was framed. here's sidney powell. >> it's just absolutely appalling what these agents and then these special counsel operation did to general flynn. it's abuse of their authority at every turn. i can't thank attorney general barr and mr. jensen and mr. durham enough for having the integrity and fortitude to get to the bottom of this because that's what it takes. these documents weren't easily discovered. the emails have been in the fbi the whole time. but the handwritten notice notes as i understand it may not have been. they had only special violations of every protocol known for him because they were determined to take him out. steve: that is certainly how it does appear to his attorneys. when you read the two pages of emails and they are from lisa page and peter strzok and then there is a handwritten page from we don't know for sure from whom. large asked to clarify whether the fbi policy required them to inform flynn that he was flying to investigate the crime before he said anything or after he said anything and apparently then, ainsley, if he said something, that could have potentially -- it looks to some as if they were trying to entrap him. if he said something that they felt was a lie they would say okay. we think you are lying. here's the evidence that shows you are lying and then the thought was he would come clean. ainsley: right. then they will hand over that information to the doj and it will be up to them to decide. these are handwritten notes that were taken from the meeting. it was bill priestap's handwriting and he was the head of the former counterintelligence unit for the fbi worked for recall james comey and andrew mccabe. those three were meeting and had a plan on that very day. the notes were handwritten. they went over to the white house. the fbi does, and they send in these agents to go and talk to him and try to coerce him into lying so they would have something against him. the question for the experts, why? did they have a vendetta against flynn? is it because he didn't go along with barack obama? barack obama fired him. this is a three star general to your point, brian. this is a man who served our country. he has a family. his representation was tarnished. went through all of this and paid for all these attorney fees and this definitely looks like a set-up. at least that's what his attorney is saying this was an abuse of power. these leaders at the fbi. what a great organization that is. they have wonderful field offices that investigate, to keep all of us safe. and then you have these leaders that are taking advantage of their position it looks like. let's bring in gregg jarrett a legal analyst for fox news who has written books about. this greg, when you heard this yesterday, what were your thoughts? >> i thought this is the most unethical, dishonest and corrupt act i had ever seen. and i have been a lawyer for 40 years. i have never seen such misbehavior by government officials. the fbi and prosecutors for robert mueller knew that michael flynn was an innocent man. they hid the exculpatory evidence, they charged him, coerced him intimidated and bullied him. threatening to prosecute his son if he didn't cop a plea. and so, you know, they covered it all up in a perjury trap that actually failed when the two agents including peter strzok interviewed general flynn at the white house. they walked out. went over to the fbi building sat down and wrote a report. and in the report they said we don't think he lied. so, that invites the question. how in the world do you prosecute a man for lying to the fbi when the fbi agents themselves say he didn't lie? i mean, that should send chill down the spine of all americans. brian: yeah. i have so many different ways can i only imagine what's going through your head because you lived. this you went through the documents and you had your legal mind working towards it which is why everyone bought the book we wanted to see what was next. all of it is coming true. i think about what comey said to grassley and he said to him i don't think we are we are going to prosecute. i know is he a patriot. he told the president is he a good guy. go easy on flynn. he goes yeah he is a good guy. i want to go back to james comey. this guy is going to be, i believe a psychiatrist just a great future information for future psychotic approaches to his job. when you think about what he said and got caught with chris wallace when he came in sanctimonious as if he thought he did everything right and how he just got caught in that interview. and then think about james comey sitting down with nicolle wallace and confidently, braggadociously saying this. >> you look at this white house now and it's hard to imagine two fbi agents in the state room. how did that happen? >> i sent them. [laughter] something we -- i probably wouldn't have done or maybe gotten away with in a more organized investigation, a more organized administration, in the george w. bush administration for for example or the obama administration. it was process the fbi wanted to send agents into the white house itself to interview a senior official you would work through the white house counsel and discussion and approvals and be there. i thought it's early enough, let's just send a couple guys over. brian: and the crowd roars. greg, we are not talking about fat tony is a lear tony with th. he thinks it's funny and did a great thing. what am i missing and where is christopher wray in this to be equally outraged? >> well, i agree that christopher wray and others at the fbi have known about this for the better part of the last three years. chris wray has been the fbi director for two and a half years. why didn't he have the decency to divulge this information? no, christopher wray has been covering this up. and, yes, thanks to attorney general barr and u.s. attorney jeff jensen, wait a minute this stinks like 3-day old fish let's look at it. and lo and behold they discover the exculpatory documents. the key line in this one is what's our goal? to get him to lie so we can prosecute him or get him fired. sings when is the fbi in the business of getting people fired? steve: right. >> that shows you it was all political to damage donald trump. ainsley: good point. steve: it does appear, gregg, in the lisa page email to peter strzok they were trying to figure out what proper protocol was at the fbi. do we tell mr. flynn ahead of time if he lies to investigators that's a federal crime or do we wait until we think he lied and then say ah-ha we got you. it's pretty clear what the fbi protocol was. >> the emails back and forth are lisa page, top fbi lawyer confesses that she doesn't even know what the protocol and rules are. and then, you know, peter strzok responds well, i'm 90% sure we can do this. this is beavis and but th butt d with malice. these knuckle heads don't even know their own rules not that they would ever care about that. ainsley: can he change his plea now he was pleading guilty. steve: withdrawal. >> it's up to judge emit sullivan. given all these exculpatory documents it, seems inevitable to me that he must, in the interest of justice, allow flynn to withdraw his plea to order -- to vacate the plea. and then the department of justice has to dismiss the case against flynn. the moment that happens, i would predict that flynn would file a lawsuit against not just members of robert mueller's team but people like comey and mccabe and peter strzok and ladies ande for abuse of power and for, you know, things like obstruction of justice and so forth. they deprived him of his constitutional rights. brian: defamation. >> under color of law. ainsley: this is just the beginning. this is not over yet. thanks, greg. >> my pleasure. ainsley: now to this fox news alert. businesses set to reopen today in north dakota. that includes restaurants and salons and recreational health facilities. brian: restrictions are easing up today in alabama. retail stores will open with a maximum capacity of 50%. reopening with no more than 10 people per group. elective medical procedures also allowed to restart. but -- steve: meanwhile, on the west coast, california's governor is cracking down. gavin newsom has closed all beaches and state parks effective tomorrow after those massive crowds we saw last week in huntington beach and also in newport beach. today at the white house president trump is going to meet with new jersey governor phil murphy at 11:00 in the morning. the governor announced yesterday golf courses and state parks will reopen on saturday that came just an hour or two after we had a golf course owner right here on "fox & friends" pleading with the governor to reopen them. he divided he would do that. one hour from right now governor murphy is going to be joining us live. there you go right there. you know, he has been very diplomatic during this but then again he was once upon a time the u.s. ambassador to germany. he has lauded the administration for the help with ventilators and other things and gave a shoutout to ivanka trump a couple days ago. you have got to gig, ainsley and brian. it's going to be a cordial meeting but ultimately governor murphy wants money from the federal government. ainsley: yeah. i'm sure they will be talking golf as well because the president has some golf courses in new jersey. i'm reminded of that statement that i think it was a gray charleston when they were talking about reopening the beaches in south carolina. he said, you know, i can't go out and surf in the middle of the ocean by myself but can i go into a walmart surrounded by hundreds of people. brian: makes no sense. ainsley: i agree with you, brian. look at those images in california we keep saying people can make up their own minds if they want to go out. people are smart enough to social distance. look at that video. they aren't doing that house party mom in trouble because she was workin work her son had a he party while she was working a 24 hour shift. not everyone is following the rules. that's the fear. gavin newsom said, brian, he wanted to close all the beaches because he doesn't want to see a resurgence of this. right after those images were released over the weekend. the hospital did see a resurgence. brian: what you do is have someone walk the beaches. treat them like adults. i don't know if you realize it. we only have 10 in an area. we need to you slide over. break it up. the frisbee toss is a little bit too close. back up a few steps. treat people like adults. maybe they went back to their old ways which they have had for 50 years. they need a reminder. you don't just shut the beaches. i think that is way over the top. especially when most of california is not experiencing what los angeles in the most congested areas are. so, good luck with california. soon they will be marching on that state house, too. meanwhile jillian conviction of joe biden here. these are allegations that are serious. this wasn't a drunken a senate party a drunken staffer or a drunken senator. this was an allegation of joe biden probing tara reade with his fingers while they were both sober. that allegation deserves to be investigated and they are choosing to ignore it. you look at all the talk shows last week where potential nominees were on these shows with the various hosts and they were not asked about it. the media has chosen to ignore it. biden has chosen to deflect what the "new york times" story using it as talking points seen before. what advice do you have? >> yeah, brian. it is a tough job market. we have had tough job markets in the past. that's one of the things to keep in mind as you try figure out what your next steps are the first thing have you got to do though is finish your semester well. we have a lot of the college seniors getting right to the end and when they hit the job market, one of the things that employers are going to ask them is how do you deal with adversity? how did you handle your last semester when everything was disrupted? you want to be able to tell a great story there that you thrived. that you finished well. that's going to give employers confidence that you are somebody who can work in this environment. that's step number one. step number 2 is build relationships. look, we can't get together for coffee the way that we used to. but you still have linked. in can you still jump on a zoom call with people. it's important to continue to pursue relationships and, remember, a lot of the people that you are going to be interviewing with came onto the job market after 9/11 or during the great recession. they have been through something like this. they have some sympathy there. use that to build relationships and make a connection that could translate to a job down the road. brian: you have major corporations like disney telling employees you are furloughed. the nfl might be furloughing their employees in a month. these are rock slild companies. so maybe offered, if you get that offer and before an employee calls you up to say hey, i have got to revoke the offer, listen, do you want to delay it? the economy is going to turn around unlike 2008. it's just a matter of us, you know, pulling the cord again and starting the engine up. >> i agree with that brian. look, see what you can imagine. maybe they don't want to do the internship. ask if you can delay and ask if you can come on and do some volunteer work or just get involved with the people that they would have been working with, continue to build those relationships. have you got to be creative here. you have got to take control of what you can control. you can't worry about the uncertainty. do the things that are within your control. brian: brian, real quick, high school seniors got accepted to college tomorrow is the day they have to make the decision. should they be writing that big check to start college when they don't know if they are going to start college in the fall because of the coronavirus? >> they need to ask some tough questions. what are you going to do in the n. the fall if we can't return? what's your plan for remote delivery of classes kick the tires. some have a good plan in place. others will throw you to online program. if that's the case maybe you want to defer a year. ask the tough questions. every school is different. don't assume what one school is doing is what your school is going to do. be a good consumer. if you don't think the value is there, then delay. it's not a big issue in the long term to delay for a year but you want to know what you are getting into. brian: if you go to a g.w. or ithaca college and writing $35,000 check as semester to sit in your room and do online work you might want to take a gap year or gap semester and we will see. very interesting times. there is no wrong or absolute right answer. but, brian, great to get your top officials approach this key white house interview and what their moatizations may have been. steve: joining us right now judge andrew napolitano. judge, you know, you look at this seemingly damning handwritten note from presumably bill prestep, we believe. and it appears to say what i think cops -- isn't that generally what the fbi does all the time? what is goal truth and admission or get him to lie so we can get him fired? tell the truth, admit to something or i'm going to camp you in a lie and i will get you that way the same way they got martha stewart? >> good morning, guys. nice to be with you no matter what we're discussing. anybody who believes in the rule of law, anybody who believes that the laws should be applied fairly should be utterly scandalized and outraged by. this this is a classic case of the fbi setting out to entrap someone and reducing it to writing. you know, early on in law school, law students are taught spirits don't agree in writing. you have to confer the agreement from their behavior. here you have in writing by a senior fbi official that their goal is to get him. whether they like him or not. whether they there he is guilty or not, that's not the goal. the goal must be justice. but they actually plotted to bring him in to a trap. so here's what i think should happen. the justice department should appear before judge sullivan in his courtroom. that's the judge before whom general flynn pleaded guilty. it should renounce and denounce this behavior. should look general flynn in the eyes and apologize to him. it should ask the judge to vacate the guilty plea. it should ask the judge to dismiss the indictment. if all of that doesn't happen, then the president should pardon general flynn within the next day or so because this type of behavior simply cannot be allowed to continue in america. ainsley: judge, if you read the transcript, if you read this handwritten note, is he asking questions. i'm wondering is he saying is this what you are getting at? you want him to lie? almost like he is questioning whether or not and why we write it down? is it because he thought maybe this was not the right thing to do? this is what he says on his note on january 24th. what is our goal question mark? truth? admission? or to get him to lie so we can prosecute him or get him fired? question mark. so, what do you gather by that? >> the author of the note might not be the bad guy. he might very well be saying here's what's going on here. why are we pursuing this? do we really just want to get him fired? do we really want to harm this person? why would the fbi want the president -- at that point the president-elect of the united states to fire his national security advisor. once the fbi was motivated by some political motivation. remember, president obama had fired general flynn as the head of the defense intelligence agency. that's the chief spy for all the military. that's an army general who commands army, navy, air force and marine spies. president obama fired him from that. why would the fbi want donald trump to fire him as well? and why would they do so using the criminal justifiable system? why would they trap him into something like this unless they had his motivation? brian: judge, let's take a step back? what were they were trying to trap him. is he in puerto rico and take as phone call from kislyak at which time reportedly he said don't overreact to the sanctions that the obama administration is putting forward at the u.n. we're going to be taking over soon. that's all he had to do. makes the call. few day respite after a long campaign and after getting this job that he knows is going to be a lot of responsibility and then he is asked did you get a call maybe he didn't remember exactly what happened. so in that moment he might have said yeah, i don't know. i don't remember talking to him about it. but a few days prior somehow this conversation leaked into the "the washington post." the fbi is not interested in who leaked the story. i'm wondering if there is something behind who leaked the story to the "the washington post" that brings us to this moment where flynn is confronted with this story that they're almost hoping he denies so they get him on the logan act or whatever they want to prosecute. brian: look, brian, that's a very interesting theory and probably what happened and the leakers are probably somebody in the fbi or some intermediary with which the fbi works on a regular basis. why did they do this to him? why did they want to get rid of him? why did they care that he had innocent, perfectly lawful conversation with ambassador kislyak and he forgot about it. a real agent would say general, don't you remember that you spoke to him on such and such a day from the transition offices rather than oh, we got you. and, in fact, the fbi agents who conducted the interview nut their notes that they thought he was being truthful. whether he remembered expertly or not he was not attempting to deceive them. this was part of a plot impair the presidency of donald trump before he was even inaugurated. now been discovered. now been revealed in writing and the courts have to remedy it. he doesn't have a cause of action against them. he can't sue them. do you know what his legal bills are according to sources in the d.c. legal community close to $6 million. brian: conversation with ambassador kislyak. the reason that later he said oh, you know, i didn't tell the truth to the fbi. but he said i didn't remember having that conversation. is he a 3-star general. he is a father. his reputation has been tarnished. he got fired from barack obama. so why would these fbi agents, if this is true, why would they want to set him up? what is the vendetta that they have to you. ainsley: good morning. >> good morning. steve: you know, when you read the notes, it does look to andy mccarthy's point like a trap. and it looks like going in they were trying to get him to admit that he had broken the logan act which that never happens. that never gets prosecuted or to catch him in a lie because ultimately, they weren't really interested in investigating his contact with the russians but, instead, they were looking for a referral to the department of justice. and get that guy out of his job. >> that's right. this activity is outrageous. everybody is saying it. but here is why it is. it's predatory. this is not an fbi -- group of fbi agents who are informed there may be a library of investigation they need to look into. instead, they are creating that investigation. and why are they doing it? they see him potentially in the role he was. in they saw him as a threat. perhaps he would be a threat to what they wanted to accomplish through fisa. whatever reason they targeted him. and you can see now it is starting to come out that it was target. brian: we know that originally they said they got him to cut a deal. part of the reason they got to cut a deal, bret. he didn't have a lot of money. he didn't have a huge job. he spent all his life in the military. just had a book out just to make some money in the civilian world. he takes his job again for not a lot of money. and they start charging you a lot. his legal fees start going up. all right. let me cut a deal and sort of limit my exposure. they recommended probation. but then when he switched attorneys he said we are now recommending jail time for him. thought prosecutor is saying we will go back for probation. what do you think does lieutenant general flynn now have some leverage to go for exoneration? >> yeah, a couple of things, very important there. people plead guilty when they're innocent. why do they do it in the federal system? because the federal system has what's referred to as the trial penalty. if you take them to trial, you are risking many, many more years in prison. decades, and they could do it. they could do it in this case. they could create a sentence that he would be facing, you know, decades in federal prison. so enormous pretty much. so he pleads guilty thinking it's going to be probation, he will get this behind him only to learn and realize that his lawyers didn't serve him well. there were conflicts of interest. he is now feeling that he is stuck. he hires a new lawyer. and she aims at one thing. one thing alone. she wants to see the underlying documentation that justified what they did. that's called exculpatory that they found. usually you find that kind of evidence and it suggests some sort of innocence. here it suggests innocence and misconduct by the fbi. it's outrageous. ainsley: it really is we are supposed to be able to trust the system. he tweeted out as griff was saying that picture of the american flag has been to say that the truth will set you free, finally justice in all of this. devin nunes was talking about what flynn should do next. listen to this. >> well, clearly, general flynn is going to have a civil rights case. and i think it's going to cost the government millions of dollars. secondly, hopefully there is going to be some prosecutions for this matter and the judge really has an opportunity here to step in and sanction these lawyers. the house republicans brought you just a snippet of this information back in 2018. we were mocked. we were told it was a joke. now, all of a sudden realized what we told you at that time not only was it true, we didn't even know the half of it. the evidence is continuing to pile up and general flynn's favor. ainsley: thankfully if this is true those handwritten notes were released and found. it could right a wrong here. what do you think will happen to the folks, if this is true, that were involved in that meeting, the handwritten note was from bill priestap and he wrote it all down with question marks. maybe he was wondering if this was the right thing to do. james comey was in that meeting allegedly and andrew mccabe the fbi deputy director. what will happen to them? >> so. a lot of people are lowing out the phrase obstruction of justice, that's not the only issue for these individuals. if they knew going into it that they were setting this up and creating this crime that wasn't actually there, then they made representations to the grand jury and then they made representations to the court, all of those can have criminal consequences. keep in mind, the supreme court in 1971 said that an individual like flynn can go after agents that do this kind of thing knowingly violate someone's constitutional rights. it's called the bivens action i'm pretty certain if this case gets dismissed, that will be the first thing he does. steve: all right. let's see what happens. breadtbreathbretttolman. steve: salons and recreational health facilities and gyms and stuff like that, brian. brian: restrictions also easing today over in alabama. retail stores will open one a maximum of 50% capacity. beaches are reopening. good news for governor huckabee with no more than 10 people per group. elected medical procedures because all these hospitals are empty now also allowed to restart. ainsley: california's governor is cracking down. gavin newsom closing all the beaches and state parks tomorrow after massive crowds last weekend. today, at the white house, president trump is going to meet with new jersey's governor phil murphy. the governor announcing that golf courses and state parks will reopen on saturday. brian i thought of you have yesterday when i saw that gavin newsom was going to close all the beaches. i know this is something that you have just been completely against because people -- you want people to make up their own minds. those people who were not social distancing, they hurt it for everyone else. now the beaches are going to be closed. brian: that's right. they can punish. steve: governor desantis set he was going to reopen most of the state but not palm beach county. he is not going to open miami-dade and he was not going to open broward. things like golf courses, parks, marines and pools will reopen. retail 25% and restaurants be able to seat people outside about 6 feet apart. regarding all these stay-at-home orders, and jillian touched on this a little while ago regarding what elon lusk said yesterday during his analyst call to investors wheres at the are a actually made a profit, he said of these four shutdowns he said, quote: if people want to stay in their house, great, they should not be compelled to leave. but to say they cannot leave and will be arrested if they do this is fascist. this is not democratic. this is not freedom. give people back their g.d. freedom. brian. brian: yeah, so each state is going to make their own decision. my fear is that democratic states and i hope it's wrong, are going to take their time because they don't want to restart donald trump's economy. they want to start joe biden's economy in november. my hope is that people understand the type of pressure and the amount of careers and stress people are under lifted as soon as possible. unlike when this was put in place in march. the president is going to lift restrictions. he is not going to extend the stay in place orders. we are educated with it. we should make our own decisions whether we are taking the subways or walking the streets. when people who are in law enforcement who are put in terrible positions. if they would walk the beach in newport beach and say hey, guys, can you separate here? you five together? do you understand? people will start policing each other and that would work its way out. but to go ahead and say i'm closing the beaches. i didn't like the way you acted last week when most of that state is perfectly fine just some congested areas aren't, this is the foundation for an overreach that i never thought was going to happen in this country as serious as as the coronavirus is so are people's mental health, drug abuse, alcohol abuse, domestic abuse all on the rise with this. not just a matter of showing discipline. people are watching their lives melt away and they can't -- they are at the breaking point. when they think the governors are overreaching, that's when people are going to snap. if politics are playing a role here, that is a bridge too far. ainsley: that beach was open and people could make the decision. the problem is though, brian, they started to seeing more people go to the hospitals after that weekend. after all those images were release new california with corona. i think the governors have to make tough decisions because they don't want a relapse of all of this. that wouldn't make them look good. their residents would be dying. then have you people like my mom is very sick and as much as i want to go out and i -- i still want everybody to play by the rules. when i finally do get to go home to visit her. brian: but is your mom going to the beach? ainsley: no. brian, eventually she will be around family again. i understand both sides. i really do. i just don't want a resurgence of this. i just don't want us to go through all of this. it's been hard for everyone at different levels. steve: ultimately from the very beginning with fauci and with birx and what the president have said the whole idea was to make sure that the hospitals are never overwhelmed. and that's why we had to flatten the curve. so the hospitals would never be overwhelmed. we are going down that hill. and that obviously is what newsom was referring to out there. that's also why desantis in florida did not reopen palm beach county, dade county and broward county yesterday. anyway. we will hear from governor phil murphy in two minutes. in the meantime go to jillian who joins us from suggest kim jong un may be at a luxury coastal resort as rumors continue to swirl about his health. the north korean monitoring website claims the pictures show leisure boats often used by kim near the garden state of new jersey unveiled his road map to restarting the state's economy. this after warning of a financial armageddon if new jersey does not get federal funding, which the state needs. for more, let's bring in the governor of new jersey, phil murphy. governor, good morning to you. >> good morning, steve. thanks for having me. steve: it's good to have you as well. i know you wanted to be on "fox & friends" early this morning because you're going to hop in a car and drive from trenton down to washington. what are you going to say to the president? what do you want? >> very much looking forward to sitting with him and appreciate the opportunity to do so. first of all, thank him and his administration. we have done a lot together in this awful pandemic of the past couple of months. jersey has been hit incredibly hard, 6770 lives lost. the president knows new jersey well. his team knows it well. got a lot of new jersey blood in his team. secondly, talk about the furthering the testing partnership that we have been endeavoring to get to. and that holds a lot of promise. thirdly, we are going to have to talk about financial assistance. not as some would say the legacy issues. that has nothing to do with it. this is to allow us to keep the front line workers, educators, firefighters, police, e.m.s. in their seats and their jobs. and then lastly, i think both of us i n our teams understand this is not going to be over and done tell end of may, for instance. this is a partnership that's going to have to continue through at least therapeutics or a vaccine is with us. a lot of thanks and a lot of looking in the crystal ball and figuring out where we can continue to work together. steve: well, you know, as your former job as ambassador to germany, you are a diplomat. and i know that you are a democrat. he is a republican. and i think he would appreciate what you just said where you said, you know, i'm not trying to fund legacy things like pensions, which here in new jersey has historically been a gigantic problem because it hasn't been funded. and it's just through the roof. so you are saying that what you want is just relating to the pandemic, specifically. and the fact that some local governments, state government as well could have a short fall in tax revenue and so you need a bailout just for the pandemic. >> yeah. i wouldn't call it -- the only thing, steve, you are largely right. i wouldn't call it a bailout. i would just say this is a war. we are at the front lines. we had come into office two and a half years ago. and had made enormous progress. historic pension payments. big surpluses. rainy day funds. everything was going well. and then as mike tyson reminds us, everybody has a plan until you get punched in the face. so we know what we have got to do with the old legacy stuff. we need help with the here and now, educators, police, fire, e.m.s. the front line stuff. we are bleeding resources. helping people whether they have lost their jobs. whether they are sick. small businesses, et cetera. that's where we need a big dose of federal cash. steve: yesterday, at about 6:50 we had golf course owner on and he made an appeal to you to open the golf courses of new jersey and you announced yesterday that you are going to do that effective it weekend. why did you have that out there -- out of curiosity, governor? because as sports go, you know, golf is one of those things where you are so socially distanced from the other players, unless you are in the same golf cart with them but they were not going to allow that. >> yeah. we had shut golf. we had shut state and county parks. we had done that together. and the curves as y'all mentioned have begun slowly but surely. even though the fatalities literally yesterday over 300 new fatalities of blessed souls. the curves have h. begun to get better for us. when you have add the mental health challenges that you and your colleagues were discussing in the last episode, we said, you know what? let's open them up this weekend but let's make sure everybody plays ball. so this is a real test case for us. you know, golfing at distance, no more than one person in the cart. lots of other golf pro-calls in. i would love to you wear a face covering. let's allow folks to take a little steam out of this but at the same time be responsible. if this weekend goes well, the weather is going to be good here. that could portend to other steps we could take not too far down the road. steve: right. well, i hope you were able to seat segment we did. it sounds like you did yesterday. in the meantime, let's talk about something else. we have got a letter from the recreational fishing alliance and united boat men of new jersey to the governor. you're busy. i don't know if you have seen it. i'm going to read part of it to you it. goes like this, governor murphy. the for hire businesses that make up infrastructure for new jersey's recreational fishing industry are essential and necessary to support recreational salt water fishing access. a continued closure jeopardizes the future of that segment of the industry and opportunity of a structured and tempered opening, however, could help save many of the those historic and traditional businesses. so would like to you help open them up. are you going to look at that? >> absolutely we will take something like that under consideration and take it seriously. by the way, i don't blame folks for writing a letter like that at all. we have one of the great shorelines in america. maybe the world. the fishing industry is really important to new jersey. we have allowed a certain amount of marine and boating activity to take place. something like that i would clearly take seriously. no promises about i absolutely will take that under consideration. steve: terrific. final exit question to you, governor, before you leave for d.c. everybody in my neighborhood up here in bergen county would like to get back to normal. specifically they would like to get back to work. how soon? >> yeah, listen, who could blame them? i don't have a crisp answer for you. bergen county as you know you lived it was ground zero for news new jersey. the six counties in the northeastern part of our state that are the big commuter counties into new york city are the ones that are been crushed and hit the hardest. as soon as we can responsibly get the health challenges under control, i put a 6 point plan out on monday, 4 points of those are healthcare related. that's why testing -- our testing discussion with the president, for instance, today will be really important. and i deeply appreciate their partnership on that. so, i hope sooner than later, steve, we are -- we have got to check through the healthcare, the curve has got to come down. the testing has got to get ramped up. we have got to be able to contact trace and isolate. i think when we have that in place and i hope that's sooner rather than later by the way. we can begin to take the steps that we all want to take. steve: governor, does your gut tell you it's going to be in may? >> you know i said the other day it's a matter of weeks and not months. i would leave it there. again, the most important thing we have to do is to keep the social distancing. new jersey has done an extraordinary job. by the way bergen county has led it because it was so severe there folks have really complied. in a state park ask folks to please stay atway from each other. don't congregate and god willing, this curve will continue to flatten. that's the best thing we could do to get businesses back up on their feet. steve: all right. governor phil murphy joining us from his office in trenton. governor, thank you very much. have requirements but restaurants have god be masks and ppp equipment that they need. that's key to them opening. what i'm seeing in georgia is exciting. restaurants are implementing spacing procedures. mask procedures. new sanitary procedures. they are focused on how to keep everyone safe and how to get it done and we are seeing consumers react. and what's exciting to me, brian, is i think about a third of the population is going to come right back. i think the second third of the population is what i'm calling the reserve third. they are going to wait a week or two. they want to make sure the systems are in place that people aren't getting sick, then they will come back. the third element of society i'm calling the certain third. they are probably not going to come back until there is a vacce or some real level of comfort that they can't contaminate anything. the point is i'm seeing an initial reaction. i'm seeing some excitement in the marketplace, brian, for people to come back. brian: you mentioned before, you have got to be thinking about it now. if your state is not ready. you have to be ready i want those booths spasd out. tables spaced out. multiple seattle. 5:00, 7:30, 8:00. cleanliness will sell. touchless car washes people look for little things. if you are a restaurant eur what do people want to hear from your establishment. >> the word transparency is key. when they walk into that restaurant they want to see different things, procedures. they want to see money being handled by a separate personal than brings their food to them. they wanting to see designated food runners. they want to see operational changes around them that make them comfortable. that make them understand this is a new day and restaurants are operating differently. the good news is they are doing these things and restauranteurs and salon operators are. they don't want to get sing and they don't want their employees to get sick. self-policing. each employee is making sure the other employing is doing it right. as we go through this process and confidence starts to build. i'm a little bullish. i think the industry can come back very strongly as long as we don't have any missteps. a lot of responsibility on georgia right now to prove how it can be done. brian: absolutely. colorado is doing the same thing even though it's a democratic governor no one is giving him scrutiny. i completely at every turn. they schemed and planned ahead of the meeting to keep him relaxed and unguarded so that he would not even know he was the subject of the interview. ainsley: let's bring in kellyanne conway counselor to the president. kellyanne, good morning to you. >> good morning. ainsley: the president was hinting around he was going to flynn back in march. now it is reported after destroying the life and the life of his wonderful family and many others also the fbi working in conjunction with the justice department has lost the records of general michael flynn. how convenient. i'm strongly considering a full pardon. if this is true and we do have the records, we have a handwritten note with all of the things that they wanted to do, they were going to walk into the white house. they were going to force him to lie so they could prosecute him or get him fired. what's your reaction and what's the president's reaction this morning? >> ainsley, regardless of your political affiliation, even if you even care about voting whatsoever, every american should feel a chill today that federal government officials in high places can come to the white house four days into our presidency and come here to try to set up the national security advisor to the president and the fix was in, imagine if what was written in the margins of these notes should we get him to lie or get him fired. imagine if anything like that was in the mueller investigation two years. imagine in one of our handwriting in the margin is today collusion monday or russian tuesday? when one is it? they pecked around and hunted around at taxpayer funding for years to find absolutely nothing. this man was set up from the beginning. probably thought they were coming in to be helpful since we had been on the job for four days. the president had made clear for all three years that michael flynn was treated unfairly now we know it was probably criminal what was done to him. may i just add that the man had a three decade plus career in the united states military. and he came here ready to serve his country. was gone within days. and now we see the fix was in from the previous administration's people. steve: right. it is jaw-dropping to many, kellyanne conway. but here's the thing. while those notes were referring to a meeting they were going to have with mr. flynn before the president was inaugurated, for the last three-plus years, this has been donald trump's department of justice. there have been in the department of justice who have known. this they have seen that thing, and, yet, nobody has been held accountable. >> right. january 24th ended up being a very important date in all of the flynn interactions. and i think that sally yates came here on that day or talked to certain people here that day. now we have to go back in time to see what was going on. we were trying to put together a government. we were trying to form a government. we were being told by people in the previous administration we are here to help you. i was told that i came here for lunch one day during the transition to really have a peaceful transition of power which is what democracies have this i is a disgrace for government officials to abuse their power in this exact way. this is what the people fear about the federal government. i think that general flynn has probably phased millions of dollars in legal fees. three years of reputational scorn. and isolation. he obviously had to leave his job here. but the president won't make any decision -- the president will make an announcement like that. he feels clear that people around him were treated very unfairly and in this case worse. brian: so the president had a meeting with a few gosm governors. one republican. governor murphy today from new jersey. yesterday was governor edwards from louisiana. they are all pretty much on the same page. let's open and let's open responsibly. here is what governor murphy talked about when it comes to reopening new jersey which has been really hard hit. >> it's a war. we are at the front lines. we had come into office two and a half years ago and had made enormous progress, historic are already coming forward. would that be an exchange the president would get on board with? >> cece what the leader is saying and obviously this fourth tranche will go to an negotiation like the previous three did. fortunately there was overwhelming bipartisan bicameral approval of relief packages. governor murphy makes a very important point on people's mind we want to make sure people have covid related relief. the federal government probably doesn't want to fund the big black hole deficits that many of these states incurred long before covid. i want to credit governor murphy and his team they have been fantastic to work with here at the white house. we have surged supplies to the state, obviously. the usnf comfort was open to new jersey patients as well. if new jersey were a country. it would be the top 10 or 15. some crazy statistic along with new york in terms of hardest hit and number of cases and the like. solve think they did a terrific job and you see back-to-back democratic governors here republican governors. nobody cares what political heart they are from when they sit in the oval office with the president of the united states. not only do they exchange pleasant trieprevent pleasantri. i think the governors super smarted to come to the white house and present their plans to the financial experts at the white house to look for guidance does this look great ideas. nothing resonated with my soul that would be adequate to somehow feel eve fill a little e void that kids are experiencing. i have been seeing prom dresses for six months. i know there were tuxedos rented and flowers about to be an the arms of beautiful young ladies. school was canceled before our students here got to even have their prom. i just knew i had to do something. i just began to just pray and seek what god wanted me to do here for our kids. and, you know, my husband was even kind of stressing like you need to do something. i said, look, i'm asking god. when he gives meet answer, i will get back to you. so one night, you know, i just went to sleep and i completely cried out to him and said god, i need to you show me how i can fill this void and hurt i see on social media with these students and with their parents. and what i woke up one morning and it was just as clear to me as it could be that our kids, their faces were lining the drive into our school and that, you know, their school colors were surrounding them. i told my husband he is like let's do it. so we immediately set a plan into action. ainsley: it's beautiful. you are being called america's principal now. tell me about this class. i know you have a heart for this class particularly. >> i do. i have a heart for our students most definitely. our school is a community treasure here. this is the best school have you ever seen because it is founded in what i like to think of is how america used to be. we are small town america here. that's where we live. i believe god is in this school because he comes here every day with the people who walk through these doors. god has not been removed from this school here at poplar springs. they were born amidst the turmoil of 9/11. how is that that that was the early days of their life now here they are again they are ending their high school career in the midst of unprecedented worldwide events like no generation has ever interviewing flynn. quote, what's our goal, truth, admission, to get him to lie so we can prosecute and get him fired and then, quote, as we have seen as playing games the white house would be furious and remember flynn pleaded guilty to lying to the fbi and since withdrawn the plea and seeking to have case thrown out. >> there's devastating evidence of links they were willing to go through, they had only special violations of every protocol for him because they were determined to take him out. it's abuse of their authority at every turn. griff: no reaction from flynn only tweet of american reform committee. jim, good morning to you. >> jim: good morning. steve: you have been talking about this for a long time. looks like somebody at the fbi and department of justice was out to get flynn and entrap him, have him tell a lie, charge him on that, prosecute him on so that they could get rid of him and em be razz -- embarrass the trump administration, a gut punch just at the time of the inauguration. >> jim: just worst than we thought. for one of the citizens they go to fisa court, they take the now famous dossier, dossier they knew was salacious and unjustified and not true and basis to spy on one of the individuals. they don't tell the court that the dossier is russian disinformation and paid for by the clinton campaign and the guy that wrote it christopher steele told the justice department he was desperate to stop trump and now we learn they go after mike flynn and set him up. what i want to know why didn't bob mueller tell us this in remember when bob mueller was named special counsel, the greatest guy to come to washington, the most honest guy since george washington. why didn't he tell us this and more importantly where is christopher wray, why didn't we learn any of this from him? thank goodness from sidney powell and william barr, we would have never gotten the information. brian: true, let me ask you when you look at underlying documents that sidney powell requested that attorney general sessions didn't that barr, sessions, i don't know what he was doing, do you wonder, did mueller have the documents and he discovered that strzok was having an affair with page and said these guys got to go because of texts and others documents when they are actually working? >> jim: i have no idea. bob mueller 19 lawyers, 2 years to do this and we are just now learning this. thank bill barr and sidney powell pushing for this or we wouldn't get this information. again, i come back why didn't we learned from chris wray. you can all sleep well at night, we got it under control. guess what, we learned more information about general flynn and importantly mr. horowitz told us 4 weeks ago, he's looked at 29 fisa applications, random applications where american citizens have been spied on and he found that in every single one there were major problems. in four of 29 they couldn't find the woods file, the evidence that they take to fisa court and in four cases they couldn't find and the fbi director say, oh, we can all sleep well at night. again, if they can do that to a three-star general and the president of the united states, imagine what they can do to you and me and what they do to 75 million people and christopher wray needs to tell us what he's been up to as director of fbi. ainsley: this is a man who fought for our country for three decades, has two kids, has a family, this has cost him millions of dollars in attorneys' fees and tweeted out american flag as to say the truth finally justice in this. you mentioned that sidney powell and bill barr they are bringing light and this guy who wrote down the notes if he was asking questions like are they asking me to lie because why would you write that down and when you put question marks on the end of the sentences, is that what they're asking me to do, almost to say i'm sitting in a room with my boss, they're telling me that i have to go and do this and i want a paper trail. what do you think? >> the vast majority are fighting hard for the american people every day. the failure of leadership on the operation of the fbi. the greatest understatement ever. they are the ones that coordinated this thing. that's where the problem was and that's where we need to find out why didn't we learn this before. bob mueller spent taxpayer dollar and did-long investigation, why didn't we learn this before? this is -- this is so long -- wrong what they did to general flynn and so wrong what they did to the president of the united states and he's an interim. he hasn't done his report. this is a major problem. it's why we need a reform in the whole fisa process. steve: in the last 3 years this has been donald trump's department of justice and, you know, there's a new sheriff in town. we've got bill barr. he's been on the job replacing sessions ultimately and -- and in january he came out and said i'm going to appoint a fellow by the name of jeffrey jenson and that's where the documents came from ultimately. explain how this would be part of a bigger picture on how behind the scenes donald trump's department of justice is looking into this with the jenson guy to finally give the american people a picture of what happened in 2017? >> well said. if bill barr is not the attorney general, we don't get the information. that's plain and simple. i hope there's going to be a report. i look forward to that. i hear good things but we will know when that comes out. bottom line is what took place before him, what they did, they did to american citizens, what they did to a 3-star general and what they tried to do to the president of the united states, i keep coming back when the mueller report came out a year ago, he said we would all do well to remember. if they can do it to a president of the united states, imagine what they can do to you and i. and that is the -- that's why this has to get cleaned up and need reforms put in place so this doesn't happen again sew with can all sleep well at night which is what chris wray told us 2 months. doesn't look like that's the case but we want to get to that point. brian: james comey's book writes himself as hero, he continues to be -- has a lock of self-awareness like i've never seen before. here with nicole wallace at 92y reflecting on wonderful career and how he took down flynn. listen to this. >> you look at this white house now and it's hard to imagine two fbi agents in the room? how does that happen? >> i sent them. [laughter] >> something i probably wouldn't have done, maybe gotten away with in a more organized investigation, more organized administration, in the george w. bush administration or obama administration, there was process. so if the fbi wanted to send agents into the white house itself to interview a senior official you would work through the white house council and discussions and approvals and who would be there and i thought it's early enough, let's just send a couple of guys over. brian: those guys had no interest in the story of him talking, they we wanted to get the guy out of the white house. tell me what you make sense of this, jim. why would president obama bring up two things to president trump, look out for north korea and look out for michael flynn, what's going on there? >> jim: arrogance and ego of jim comey, the attitude he had, there was process, they should have notified the white house counsel that they were talking to michael flynn. they weren't square with general flynn, a guy who served our country, 3-star general, it's so hard what they did and the arrogance that comey had, the guy in charge and all of this happened under his watch, mccabe, all of the people in the fbi, this happened under jim comey and he's the guy responsible. so many americans are learning now that everything we have said for several years, the only thing we had wrong is it was worst than we thought and americans are fed up with this and they want it cleaned up. brian: more to come. ainsley: we had people in the show this morning. they created an investigation. this was setup and dan bongino has been talking about the fbi and they find his or her crime. this is america, this is very scary and you're right, if we don't hold someone accountable, this could happen to you. anyone who runs for office. we don't like your politics, we will find a crime that you've done. it's very scary. will people be held accountable? >> jim: i think so. again, all we can do is highlight what happened. the other thing we could do and we have been pushing to do this we can bring in mr. horowitz. he has issued a report of fisa process used on carter page. we have yet to have horowitz in committee and he should come in and testify. that should be step one. as far as holding people accountable, that's the department's job, i trust john durham. i hope you all, take care. steve: businesses in north dakota are preparing to reopen, not reopening today. the governor's executive order shuttering some businesses expires at the end of the day today. restaurants, salons, recreational facilities will open their doors, it will be may first. brian: all right, restrictions are easing in alabama. retail stores will open up with capacity of 50%. beaches are reopening with no more than 10 people per group. elected medical procedures also allow today restart, maybe saves lives of hospitals, ainsley. ainsley: california governor is cracking down and closing all beaches and state parks tomorrow after massive crowds last weekend. today at the white house president trump is going to meet with the governor of new jersey phil murphy, announcing government courses and state park wills reopen on saturday and if you're watching us this morning and you're going to go to the beaches, just social distance. do the right thing. you're going to go to a protest and protesting about getting back to work, do it safely, wear a mask. social distance, don't stand on top of each other or they're going to be consequences or your beaches are going to be closed or not allowed to be out there protesting which is your god-giving right. steve: because as ainsley, dr. birx and dr. fauci and experts said to get where we need to be is by social distancing and that's what we have been doing. the federal social distancing guidelines actually expire tonight and decided not to go forward beyond today, the last day of april. coming up in 15 minutes we will find out exactly what sort of a toll this particular pandemic and the stay at home order and everything has taken on our economy because we are going to get the very latest jobless numbers. we do know according to our experts our economy shrank 4.8% between january and march and remember, brian, we only got a couple of weeks of this particular pandemic in march. you have to figure the next quarter is going to just be awful and the technical definition of a recession is 2 consecutive quarters of negative growth and it looks like that's probably going to happen. brian: yeah, jared told us yesterday that he thinks things will stand up and getting good again in july. tomorrow will be a big day. arizona, arizona, hawaii, idaho, illinois, maine, ohio, a whole bunch of states come online to a degree. as you do that, not only do people go back to jobs, money goes into the state coffers and we could stop writing checks for money we don't have to debt that's too big that we will probably never pay back while we rescue on four package. the house is home, i don't know how they are going to work on this. the senate is coming back monday. i know what they'll do about this, a lot of moving parts and i just hope states don't just talk holistically about an entire state. i hope they substance certain sections to have state that can open like in florida and ones that can't like dade county, jacksonville, maybe orlando that seem to be ready. ainsley: jillian has headlines for us. jillian: calls for joe biden to address allegations are ramping up. respond to claims by former no and she's fighting back. kim, good morning to you. >> kim: going, steve, thanks for having me on. steve: we talked about how restrictive the stay at home orders of governor whitmer have been in michigan. you know detroit is a much different place than rural michigan and a lot of people in the nonhot spots wants to do things, couldn't do that, that's why they had to protest and you got in trouble because the city commission said you did safe distance when you were at the particular protest. what do you have to say to them? >> well, i attended the rally in support of small businesses that are being destroyed by the governor's draconian executive orders and since that point in time i've been inundated by emails -- >> steve: wow, that is something. why were you protesting governor whitmer's ruling there? what did she get wrong of the state of michigan? >> well, so many small businesses are just closing down. we are not getting the help that we need from the state, from the payroll protection program, from the county. it's just been an incredible challenge to be able to maintain business as usual and great deal of businesses have just decided to close. they can't do it. steve: sure. so as you look at what the president is doing, he's not extending the federal or presidential social distancing guidelines, now it's up to the governors in each state. do you trust governor whitmer going forward that she will get it right in the future? >> kim: well, i hope that she will have it -- have it right in the future. at this point i can't predict. i do understand that the court has sided with her, however, that doesn't speak for all of us that have been -- that have been unemployed for six weeks or more now. it's just far more challenging than it needs to be. steve: you know what, kim, you're not alone. people all across the country are feeling the same thing, very challenging, people want to get back to work, they want to do the same thing -- if they haven't been sick, they don't want to get sick. i understand you would one of our producers, though, you thought there could be an element of politics involved because of -- you were only one of two conservatives on that particular commission, but you're running for county commission and you wonder if politics has something to do with that. >> kim: well, that was the reason for my censor. mayor and the democrat majority seized on the opportunity to retaliate of my opposition of financial mismanagement of the city. i was censored by court. i violated no law or no executive order. steve: well, there you go, giving her side of the story, kim gibbs, thank you for joining us and how you were exercising your first amendment rights to express your opinion at a safe distance according to you. by jobless claims have been released. climbing now to 3.8 million as the economy reels over the coronavirus obviously. that's more than economies predicted. so 3.8 million. last week was 3.4 million. let's bring in katie. we know it's going to be bad when you tell the whole country to go home or quit their job or ignore their job, they will end up with jobless benefits, what do you think about this number? >> well, brian, the number gets us closer to 30 million mark of americans who are now unemployed and that does not account for all american who is have lost their jobs and this is when you see local governments in partnership with the federal government racing against the clock to try and get through that phase 1 of reopening their economies that the white house put out because this is unsustainable, unemployment rules at the state level are going broke. you're seeing state governors saying that they may ask the federal government for a bailout and we have seen a lot of the paycheck protection program that republicans have been pushing forward with the white house, however, that is a stopgap measure and will also run out. we saw it run out the first time very quickly. if you keep the economy closed, people can no longer go back to work, so this is a difficult balance governors are trying to strike as more americans lose their jobs. brian: we are at about 30 million jobs, we need money that we have to eastern so whether it's restaurants, gyms, people have to go thank work, there's got to be a way to do it. you have science and economists need to be at the table too. we agree with that. meanwhile let's talk about the presidential election. normally it would be the lead in every hour and every block, let's talk about what joe biden is dealing with while he sits in the basement and makes sense with democratic vp's and other things about tara reade's allegations of sexual assault. biden himself should address the tara reade allegations and release relevant records which we know at the university of delaware, what do you think, katie? >> katie: the democratic party has been holding republicans to for decades now and if they want to be the party that believes women, that the me too movement, joe biden has obligation to respond to his accuser and exwhine why this isn't true. he had hillary clinton come out this week and endorse him, not surprisingly. but if they don't hold themselves to the same standard being prowoman, he's going to have to address the issue. democrats are very good at pushing aside allegations with their party so long as the candidate falls politically on the issues that they believe in. brian: the talking points were published, the democrats were told to used and stacy adams read them verbatim. "the new york times" did investigation and did not find her credible. new york times said we didn't say that. we made no conclusions either way. i want you to weigh in real quick. >> katie: yeah, look, tara reade is just asking for information that joe biden has and if he has the ability to release more information and be transparent, then he should do that and clear his name. brian: think about the humiliation of kirsten gillibrand and amy klobuchar and they were put in impossible spot because joe biden doesn't have coverage to speak about the festering problem. >> katie: they put themselves in the spot. brian: yeah. >> their hypocrisy is very clear on display. brian: the house will now return to washington next week to work on a new relief bill because of concerns about the virus. congressman dan crenshaw is outraged by the decision. he will sound more on that next. steve: it is 8:40 in the east and we are back with fox news alert. just ten minutes ago the weekly jobless claims number came out 3.8 million filed for the past week as the economy reels over the covid-19 crisis. that's more than economists predicted. 4.4 million jobs were lost the prior week. so it's less than last week, however, the bad news is it's a total of 30 million people lost their jobs and applied for unemployment insurance since march, ainsley. ainsley: scary times, heartbreaking for so many families. let's bring in gop congressman dan crenshaw in house homeland security member, form other navy seal and author of fortitude and resilience. that's a word that we heard a lot. that's the american way and we are trying to get through this. as you hear the numbers, it has to break your heart. >> this is devastating and the federal government has spent trillions of dollars trying to stop the bleeding on this but that can only last so long. the only way to stimulate the economy is get money pouring into. we are doing that in texas. we are doing a staged reopening, it's smart reopening. the rest of the country can follow suit. not the entire country is like new york city. we have to start being bold and honest with the people. listen, it doesn't take any courage whatsoever to tell people to stay home or stick the police on them if they disobey, that takes no courage whatsoever. it does take courage to be honest with the american people and tell them about the risks, educate them about the risks and say, listen, we all have a personal responsibility to get back to normalcy and new normalcy and mitigate risks as we go. we can do this as a people and we have to do this. there's a healthcare cost to those numbers. procedures aren't being done, lives are being lost, livelihoods are being destroyed, there's mental health issues associated with that, there's loss in human dignity and we cannot ignore that anymore. brian: all right, let's talk a little bit about something else and that's the raw deal michael flynn has gotten. dirty cop james comey got caught, it's just the beginning. we watched lieutenant michael flynn, i don't know if you know him, congressman, but we have got a chance to know him about a year and a half before he got the job with president trump. now he's gone. paperwork reveals that he was set up. howdies tushed does this make you about your government? >> extremely disturbing and no i never knew him. here is what i do know that the media and mainstream public opinion painted him as russian puppet. why is that? a few fbi agents were corrupt to the core trying to make him sound like that and the media puppet that collaborate with the people did the same thing. we see this over and over again. there's more evidence growing twine fisa warrants, obama-biden administrations to target conservative groups and now this. they keep repeating over and over again that the trump administration is corrupt and yet they provide no evidence even with all of the powers on president trump, with the mueller investigation and the impeachment investigation, they've never been able to prove any corruption and yet we have so much more growing evidence of corruption in that administration and corrupt to the core and the reason they keep calling the trump administration corrupt is because they are trying to project, project and distract what has actually happened and what would happen under another biden administration. this kind of thing is infuriating. the institutions are supposed to be trusted by the american people. i always bushed back against the notion that there was a deep state. i always pushed back and i never liked the language. i see evidence like this and it's chilling. there's no other word for it, it's chilling. steve: now you're pushing back against nancy pelosi because essentially the house, returns next week postponed. >> cowardess. it's more than accountability. let me remind, everybody, if we get paid hourly, you bet nancy pelosi would be there. this is about leadership, leading on the front lines along with the american people who are also on the front lines, nurses, doctors, people still working, grocery stores, people trying to grow food and raise cattle and watching their food production plummet. people are fighting on the front line, they are risk-mitigating and smart but still engaging in life. why can't congress do the same?
