group is saying that the nfl never saw this video. the revel hotel in atlantic city said nobody in the nfl ever asked to see it and the casino people say if the nfl asked they would have given it over but nobody asked. >> one of the biggest questions this morning is were the nfl's investigators not doing their job? are they incapable of doing their job or were they putting their head in the sand on purpose? >> here's the thing. the nfl says we asked law enforcement for the information relevant to the case and the law enforcement didn't give it to them. however, the nfl did not ask for the video and all they had to do is ask. the hotel is now closed. harvey levin, tmz sports and tmz news, he is on with a fox affiliate in washington, d.c. he says essentially the nfl knew the surveillance video existed. they knew this casino had surveillance video and they knew -- says i know they knew and will explain later
why we know they knew that. but they did and they didn't do anything to look at this video. he explains. he's going to expand on that today. >> the nfl, what they're saying is they requested all the information from law enforcement, but because it was a pending case they didn't give it to them. however, the casino people say we would have given it to them. the fallout today is because of this video, ray rice has been cut from the team and he has been indefinitely suspended by the nfl. former washington redskins running back clinton portis can't believe the nfl would have looked the other way. >> i don't think they looked the other way, but it's shocking to know that the nfl ravens hadn't seen this video knowing the video was out there. clearly we had seen before the hallway shot, so of course you knew there was an elevator on the camera. it's shocking that the league hadn't seen it. if the league hadn't seen it, it brings up the question how did you suspend him for two games without having all the

>> in the meantime four minutes after the top of the hour. we turn to heather nauert. >> it's four minutes after the hour and i've got news from overseas. closing in on the terror executioner, american and british authorities may now know exactly who beheaded the american journalist james foley. according to the u.k.'s newspaper, british intelligence had the killer under surveillance long before he joined isis in syria. he was known to them as jihadi john and he was apparently considered a low-level threat at the time. he collected funds for the terror group. f.b.i. agents in the u.k. joined the british task force in trying to hunt down the terrorist. they will reportedly row veal his true identity within a number of days. new fears this morning for americans traveling overseas, and this is such a bizarre story. a u.s. air marshal is stabbed with a syringe filled with a mysterious liquid at an airport in nigeria.
the air marshal flew back to houston, put in quarantine and given a medication as a precaution. >> why did this person target u.s. marshals? did this person knowingly target u.s. marshals? and was it for the intent of producing terror? >> that syringe, we don't know what is in it just yet, is being looked at by the f.b.i. and c.d.c. all eyes on apple in anticipation of an announcement later. the tech giant set to unveil the iphone 6, rumored to have a bigger screen and better camera. also expected to be unveiled the so-called i-watch that reportedly comes in two sizes and can track your health but it may motte be released until 2015. later in the show clayton morris joins us live from where that event is happening. let's talk about football. the detroit lions taking on

congressional leaders in a white house meeting that he's been asking for a $5 billion counterterrorism partnership fund since may, a fund he says will train and build up partners near hot spots around the world to destroy isis once and for all. that is an objective the pentagon reportedly thinks will take three years and that has some lawmakers wondering why we didn't start sooner. >> the committee has known about isis for well over two years. we saw the uptempo probably beginning especially in the fall of last year. well over a year. i do know that all of this information was available to the white house on a daily basis. they knew what we knew and probably even more. >> so far the white house being most careful to announce only what the president will not do in iraq and syria. >> it's important for
people to understand that strategy for our military does not include sending combat troops on the ground into iraq or to syria. but it does mean using the military might of the united states to coordinate with our allies in support of fighters that can take the fight to disiefl. disiefl. -- isil. >> the secretary of state will soon head for the middle east to court more countries in the region for that coalition. >> peter doocy live in d.c. with the latest. yesterday the white house cautioned that the president -- he's bringing in the top leaders today. the president so far has not decided whether to expand military operations against isis. he still has not decided. what's interesting, when you hear the president talk, he's still kind of minimizing the threat. why is that? here's brit hume. >> he tends to minimize
threats. he tends to play them down. and i think, look, this all flows from a foreign policy based on the idea he doesn't want to do anything stupid. as a consequence of that, he looks to play things down. now he's going to ask u.s. allies in the mideast to join him to defeat isis. ask yourself this question: if you were a foreign leader urged by mr. obama to join him in a campaign against a terrorist army in which the u.s. will clearly do less than it could and your ground troops and none of his will be the infantry, how eager would you be to sign up? >> that is a great point. on top of that, the amount of coordination these military minds need in order to get australia, britain, france, turkey, anybody else that wants to help out -- u.a.e. and qatar are also in the game -- think about people's assets and what they're willing to do. you need somebody who is definitive going
to expwowr -- empower someone like secretary of defense hagel. he says i'll help you but don't tell anybody we're helping because it looks bad for our population. you've got to get sunnies to do a lot of acting which brings us to one thing that i think president obama cares about more than anyone else. what do you want him to do? believe it, going by what the american people want the president should act and should act quickly. should airstrikes be used against the sunnis in iraq? 71% of the public says yes. republicans have 83% of that. democrats have close to 70. >> back in 2003 the white house dragged america to war. in 2014 america is dragging the white house to war. >> it seems so strange to pick your tools, as brit hume said last night, pick your tools before you have an exact strategy. no craftsman is going to be doing something like that.

organization already? >> it prevented students from meeting, new students coming on campus because we don't have access to student activity fairs. it's costing individual chapters between $13,000 and $30,000 a year to reserve rooms. it is saying to students we don't need religious groups on campus. >> as a recognized group aren't you able to talk with faculty, not just at these student affairs organizations, recruitment things, doesn't it make you not have as much power on campus? >> i think it delegitimizes you. it says you are a marginalized group and don't have stangt, don't have the ability to talk to faculty and say you're a recognized group. >> you're on some 700 campuses so why aren't you grandfathered in the same way fraternities and sororities are based on gender? >> i think it is a policy that wants to create a safe place for students on campus but they have taken
it past absurd. they're saying if religious groups want to have distinctly religious leaders that's discriminatory against all students who might want to be leaders who don't believe. >> it is like saying the chess club president doesn't have to know how to play chess. here's what the california state university office of the chancellor issued a statement for. they say the student groups which have chosen to not comply with state law may continue to meet on c.s.u. campuses but will not be recognized as official student groups and will not be eligible to receive benefits of official recognition. i imagine this is hard on you guys to deal with. is it trying for anybody's faith? is it testing you? >> i think for most students when given a choice, do you want to give up the clear religious beliefs of your group or get room recognition, they're unwilling to sell out. they're realizing there is a cost to saying we want to be a group that is authentic to our tradition, faithful to what we believe. >> you have no plans to change your policy on leadership? >> we don't think we can

>> anna good morning. in fact, the skull, the remains found of holly bobo were found yesterday by decatur officials. here's the story behind holly. a nursing student 20 years old getting ready to go to school one day. she didn't end up getting there. turns out there were some screams. the next-door neighbor heard them, called holly's mother who was at work. the mother called 911 and holly's brother and said is holly okay? he said yeah, i saw her going off no the woods with a man in camouflage. that was her boyfriend. that was okay. holly's mother said that was not her boyfriend. clint went out to her car, they found blood. that was the last time any friends and family saw her alive. two people, jason autry and zach adams charged with first degree murder. others have been charged most related to a video that the tennessee bureau

in the sense that he understands how unpopular that decision would be with americans. >> i'm deeply dispointed the president hasn't acted where house republicans failed to act. >> honestly the bottom line is of course there's politics going on. >> it's clear that playing it safe is what is going on at the white house. >> what would an executive action after the mid term elections hurt the president if the g.o.p. is in control? or with they be powerless? here to weigh in is fox news senior judicial analyst judge andrew napolitano. let's say republicans take the senate and let's say after the election the president tries to do the executive thing with this executive amnesty, what could the senate ruled by republicans do? >> let's say the president has absolutely nothing to fear because he doesn't have to face the voters again and nobody in his party has to face the voters again while he's still president. if the republicans control both houses of the congress, there's a lot of things they could do. they could of course enact
legislation nullifying any executive order that he issues. >> preemptively? >> no. that is a great question. after he issues it, they could nullify it if it arguably violates federal law or the constitution. he would veto the nullification and have the opportunity to override the veto so they would need two-thirds vote. second thing, deny funds to the agency that would enforce that executive order. they would do it by legislation. he would presumably veto the legislation. they probably would lack the votes to override the veto but they would try. here's the most significant thing they can do. the president lacks line-item veto. he gets a piece of legislation, he signs it or he vetoes it in toto. he can't cross out like governor christie in new jersey can do something he doesn't like and sign the rest. if there is legislation he really needs and the country wants and must have, like funding the defense department, they could sneak in there legislation nullifying these executive orders.

cam, but we hadn't seen what happened inside. the news this morning -- keep in mind, yesterday we told you there is a story that the nfl had seen this video. there was another story that they had not seen it. according to tmz, the nfl says they never saw it. according to somebody who worked at that particular hotel, nobody from the nfl asked. they said if the nfl asked, we would have turned it over. we turned over a copy to the police and to rice's attorney. so now the question becomes -- and the nfl says, yeah, we requested any and all information, but we never got it because it was a pending case. the nfl could have gone another way. they could have asked rice's attorney. they could have asked the hotel. so now there are a lot of people who are wondering just exactly what did the commissioner of this great sport know and when did he know it? >> when did the commissioner know and is it a top down problem or the investigators,
were they incompetent or were they putting their head in the sand and thinking what we don't know can't hurt us and can't hurt one of our players? you hope that's not the case. since this video has surfaced and roger goodell has said i've blown it, he has revamped the domestic violence policy in the nfl. but the global outrage on this story, i had a friend who went to rutgers and said she was planning on going to the game this weekend and said i don't know what i'm going to wear. the only jersey i had was ray rice. and there are reports of the jerseys being burned. >> there is a couple of investigations. why did this come out sooner? tmz is pursuing the fact that maybe the nfl had willful blindness, they knew they could get it but didn't want to see it. the nfl said we didn't know it existed. somewhere the truth will meet. here is the question, ray rice in the prime of his career. he's banned for the year. will he get a second chance? should he? former baltimore ravens head coach who didn't coach him was

day, you can weigh in, should ray rice be banned from the nfl for life? >> you know, one of the things people are talking about, keep in mind, his career pretty much imploded right there with the release of that video. how did tmz get the video and the nfl, with their billions of dollars of assets and the nfl didn't? the new york daily news has an op ed today and says if the league covered this up to allow rice to get back on the field, executive heads must roll. if goodell lied about what he knew, his day is done. >> we did know it was domestic abuse and he did get the two games, people were outraged wasn't enough. so he upped it to six and said i was wrong, i'm going to make the second time, you'll be banned for life. now we see this out and he was instantly banned. another wrote about the question, says he does deserve jail time, but not suspended for life. he needs to get help. >> chuck clark on facebook says, let the legal system handle this. not the nfl.
>> the legal system passed because she did not press charges. >> right. and roy says on facebook, it's time these guys understand the blessing they're given. ban him for life. set the example now. keep e-mailing us as well. let's talk about this, later this afternoon at the white house, the president of the united states is going to meet with top lawmakers, speaker boehner, nancy pelosi, harry reid, and mitch mcconnell. he's going to apparently reveal what he's thinking at this point regarding isis. he's also going to ask them for $5 billion in counterterrorism funds. yesterday we told you we had heard that it would be half a billion dollars. now it is 5 billion. this is a program for counterterrorism the president has talked about in the past and people from both parties said that's way too much money. both parties balked at it earlier this year, referring to it as slouch fund. there is a real good possibility that $5 billion, he's not gog get. >> he's got to itemize and be very specific.
$5 billion, does it go to the military which has been gutted? the ohm thing the president cuts is the military. did the military request that? i'm not sure 'cause i heard they were working with eight other countries. what had are they supplying? are they providing men or an air force? paying for our gas? until you get that coalition together, where do you get that number from? i thought it was very interesting that i think the president in one way is setting us up for syria again. remember? we got to put it to congressional vote golf and it never came to that. vladimir putin said i'll take his chemical weapons away. now the president asks for an exorbitant number that nobody agrees on, he goes to the american people and goes, what did i tell you? i asked for $5 million, congress wouldn't give it to me. my hands are tied. you wanted me to work with the other branch of government, didn't you? >> you also heard of trying down play the threat of isis so somebody else will possibly do something about it. though it's not the president's problem, or so that he doesn't have to act on his own. >> right. also the white house caulked
yesterday the president has not yet decided whether to expand military operations against isis. he hasn't decided. maybe he will decide by this afternoon. meantime, let's head over to het better the headlines. >> good morning. one thing we're getting more clarification on potentially is the executioner and his identity, the executioner of the american reporter. american and british authorities may now know exactly who beheaded james foley. according to the u.k.'s daily mirror, british intelligence have a killer under surveillance long before he joined isis in syria. he is known as jihadi john and considered a low level threat at the time because he collected funds for the terror group. f.b.i. agents in the u.k. have now joined the british task force in trying to hunt down this guy. they will reportedly reveal his true identity within a matter of days. new fears for americans who are traveling overseas. this after a very bizarre story.
a u.s. air marshal was stabbed with a syringe that was filled with some sort of mysterious liquid at an airport in nigeria. the air marshal eventually flew back to houston. he's been put in quarantine and given a medication as a precaution. listen to this. >> why did this person target u.s. marshals? did this person knowingly target u.s. marshals? and was it for the intent of producing terror? >> frightening. that syringe is being examined in the united states by the f.b.i. and the cdc. if you're driving to fort lauderdale, florida later today, no need to stop, look or listen in an effort to make the city streets safer. listen to this. the city is urging pedestrians to wave these orange flags at cars as they cross the street. the idea has been tested in other cities, but it was dropped after people either stole or misused those flags. right now it's only being used on one busy street. this in fort lauderdale.

president obama getting ready to outline his strategy for defeating isis. first to congress and the leaders when he meets with them later on capitol hill today, and
then to the american people in a speech ahead of the september 11 anniversary. >> but one thing the white house is already making clear, there will be no american troops on the ground. >> the president has been pretty clear about what this -- about what he's not contemplating. he's not contemplating the deployment of combat boots on the ground into iraq or syria. >> the president is always telling us what he's not going to do. fox news military analyst colonel david hunt says too late. we're already at war. forget about the declaration. you said you liked the fact that it was going to be a three-year campaign. anything else you like about the strategy so far? >> no. couple things, we're being massively disingenuous about the department of defense said there is 1100 soldiers there. there is over 800 special operation soldiers. they are by definition combat
soldiers. we've had combat soldiers on the ground fighting with the kurds, calling in air strikes, five weeks. we dropped 140 bombing missions. that's thank is war. this feels like after 9-11, 70% of the american people seem to be okay with this. my issue is be careful what you wish for. this is never easy. always complicated. there are always unnecessary, unanticipated consequences. iraq is going to be easy going after isis compared to what's happening in syria. but we are at war and there are boots on the ground. i don't know what that term means anymore. special operations guys have been there from the beginning and they're with the kurds and they're in combat. >> the rhetoric, the wording is tricky. whether we're at war in the headlines or not. president obama made his case back in august last month about not getting back into another
war in iraq. listen to this. >> i ran for this office in part to end our war in iraq and welcome our troops home. that's what we've done. as commander in chief, i will not allow the united states to be dragged into fighting another war in iraq. >> colonel hunt, things change, right? nobody wants another war. does this all come down to politics and the president trying to look good? >> yeah. i'm not good at politics. i just think that, first of all, we didn't abandon iraq. we have the largest embassy in the world still there. over 3,000 government employees are in baghdad. again, we're being disingenuous. we're 140 times, we've dropped iron bombs on bad guys in iraq. by the way, they deserve to have bombs dropped on them and we deployed 1,000 soldiers back into a country we had left three years ago. we are at war with isis.
the issue is how long and what else we're going to go with this like in syria, which is rather problematic. >> real quick, when you were here a week or so ago, you said that we can't kill them off unless there are boots on the ground in syria. >> i did. i also think we're going to need more than a talking coalition in the middle east. the word moderate muslim comes to mind, i don't know where they are, but they've got to come forward and without having combat soldiers into syria, i do not see the air campaign being -- no air campaign could be successful without it. i'm just very circumspect about how we would go into syria considering assad, russia, and iran. this is not a simple operation as it is -- a little less complicated than iraq. >> because we wipe out isis and iran prospers and assad stays. and nobody wants to see that happen. it's got to be something that's

good morning. now to a fox news alert. heart breaking end to the three-year search for a missing nursing students, holly bobo. overnight, police revealing they found her remains ten miles from the house of her accused killer. wztv reporter bob is live in tennessee. good morning, bob. >> reporter: good morning. in fact, there was some hunters out and they found the skull. they didn't know whom it came from and they confirmed yesterday, holly bobo. this is a nursing student who disappeared three years ago, april 13, 2011. her brother last saw her going into the woods with a man in camo. thought it was her boyfriend. found out that wasn't the case. earlier this year, there were two men arrested and charged with first-degree murder. they were charged with murder, but a lot of people ask the question, how are you going to get a conviction without a body
because nobody had found holly. there was supposedly a videotape showing her alive, being assaulted that a number of people had seen. they have also been charged as accessories to murder. so this weekend when they found the skull, they were able to identify that as holly bobo's and now the district attorney has that evidence to be able to connect the killers with holly bobo. that's what's happened this weekend. that's why it's important that they get some kind of confirmation and, again, evidence here as holly bobo, three years after she disappeared. >> terrible ending. thanks so much. live in tennessee this morning. let's talk school. this year 3.3 million high school students are expected to graduate, but under 1.3 million expected to drop out. even worse, 20% of all students are held back at some point in their school career. so with school now back in
session, how can teachers combat those numbers? joseph says more incentives are the answer. yep. he wrote the book "rewards, how they help children learn and why teachers don't use them well." joseph, you're supposed to learn because it's the right thing to do and have that inner drive. what do you mean we need rewards? >> well, many of us are driven by internal motivation to do the right thing most of the time. but most of us need something extra, something outside in order to get us to really work our way through difficult tasks. kids are the same way. so kids respond really well to rewards and incentives in school as well as outside of school. so our book is about how parents and teachers and administrators can use rewards more often to help kids learn. >> you say everybody has their own trigger, their own thing. for example, you have two pretty cool examples. you have the class system which helps teachers improve behavior and the dream box. can you describe them? >> i was in a couple of private schools last week.
saint martini and sherman park in milwaukee. and both of these schools use these programs. dream box teaches math. it's an on line interactive program so it's like play ago video game. kids really like it. they score points when they get the right answer. and it allows kids to track their own performance and for teachers and parents to know exactly where they are and what their problems are. so it's a really effective and a great example of how computer software can make rewards work to help kids learn. dojo is the technological system. teachers use it that reward kids for doing the right thing, like doing their homework on time, showing up, being prepared, answering questions, and then kids are able to see how they're accumulating points and how good a job they're doing. >> another way to get it is kids are told to go to school whether they want to or not to learn stuff they didn't ask to learn.
how do you incentivize them? you keep score. how do you incentivize a teen-ager? parents and cools work together. what do teen-agers care about? >> yeah. teen-agers care a lot about what their peers think. they also care about what adults think, even though they're pretty good at hiding that. they want to know what their next job is going to be. they want their own opinions to be taken seriously. when you create a incentive system for high school kids, you have to take that into account. you say if you take your work serious, we're going to give you the capability to determine where our next outing will be. or you won't have to sit in a classroom, we'll let go to the library, museum or even work from home and do a special research project like on the history of cars, something that really turns on this young guy. >> something that gets a teen excited, something that gets kids excited. i remember when they were going through the coaching course, they said everything you do, you

that's a country in central america. i called my mom and she said everybody was okay. so that's very good news. we do want to take a look at the weather conditions across the country. in the southwestern united states, we've had incredible flash flooding occurring there. you've seen the images out of phoenix. flash flooding across roads and cars swept away. there is still more rain on the way for parts of arizona and utah, into colorado. we have flash flood watches in effect there. farther toward the east, temperatures are still feeling very much like summer. still officially summer. you can see them in the 90s out there across parts of texas and also in places like kansas city. but there are going to be some big changes on the way. we have a cold front that's going to be sweeping across the center of the country and also into the midwest. ahead of that storm system, we do have the possibility for severe weather not only today, but also as we head into tomorrow. we are looking at a risk for damaging winds, large hail and even some tornadoes. behind that system, it's going to get a lot cooler.

video shot last friday shows that reporter, along with a picture maker, driving right through an unmanned guard gate and within 600 feet of a nuclear reactor. they even we want back a second time and realized the unmanned guard gate was padlocked. it sounds like a disaster waiting to happen. so why is the security so lax there and who is defending our homeland from a particular possible attack at a nuclear plants? tucker carlson is the editor in chief of the daily caller. you also see him on the weekends here on "fox & friends" and joins us from d.c good morning to you. >> good morning, steve. we got a tip from someone who had been to this plant last month who said i've never seen anything like this. this is the softest target i've ever seen. we drove right through. i sent a couple of my reporters. they drove through literally the guard gate at 35 miles an hour. there was nobody there and right up to within a dangerous range away from the nuclear power
plant and nobody stopped them. nobody said anything. they saw not a single security guard. as they were there, a civilian truck, a large panel truck drove -- they watched him, drove right in and right up to the nuclear plant. this is crazy. >> there goes the truck right there. perhaps a little smaller than the truck from oklahoma city. it looked like pretty much a ghost town there when you look at that particular approach to the facility. the worry is that somebody has a truck full of bombs or something like that, gets close enough, they could do some real damage. >> well, yeah. or ten trucks full of bombs. hopefully after this air this is morning and on our site, security will improve there. i imagine it will. but as of right now, you could take out this nuclear reactor pretty easily. by the way, i should say this is right outside washington. it's within the fallout zone. 50 miles from downtown d.c
it's an area of almost 4 million people. and you could wreck the area. >> this is terrifying. spokesperson for the nuclear regulatory commission said this based on the security inspections we've conducted on an ongoing basis, security at calvert hills is appropriate to protect the public health and safety. that's great. meanwhile, the plant owner tucker says, quote, the fences and checkpoints you see are only a smart part of the defense in-depth security strategy. in fact, much of our defense lies in the things you don't see. well, that's it. you just didn't see them! >> by the way, one of the points of security is to deter attacks. i'm at the fox bureau, i can't get in this building without showing a pass or my driver's license. you have to get a blood test to get into congress. there is a lot of security in the city and when our reporter called the obama people, they blew him off and said everything

6th avenue. laura ingraham comes up in a moment to talk about the news of the day. but right now we turn to heather nauert who is talking about one of those guys we saw in the video. >> that's right. u.s. authorities and british authorities are closing in on this guy, the terror executioner. we may now know exactly who beheaded james foley. he was american. according to the u.k. daily mirror newspaper, british intelligence had him under surveillance long before he joined the terror group isis. now known as jihadi john. he was apparently considered a low-level threat by authorities at the time because he was collecting funds for the terror group. but not doing anything more than that, or so they thought. f.b.i. agents in the u.k. joined the british task force in trying to hunt him down. they will reveal his identity within a few days. new fears this morning for americans who are traveling overseas. this after a u.s. air marshal is stabbed with a syringe that was filled with a mysterious liquid as he was just about to go through security at an airport
in nigeria. he was flown to houston, texas and put in quarantine and given medication as a precaution. >> why did this person target u.s. marshal as soon as did this person knowingly target u.s. marshals? and was it for the intent of producing terror? >> what is in that syringe is being looked at by the f.b.i. and also the cdc. ebola is on its way to america once again. a fourth american doctor who got that disease while he was working in west africa will be zone to dobbins air reserve base this morning and taken to emory university hospital in atlanta for treatment. the identity of the doctor and his condition or her condition not being released at this point. last month two other american aid workers were treated at emory and successfully recovered. a third is being treated in nebraska and he is said to be improving. they say a picture is worth

additional information about how the nfl could have gotten this earlier and they never asked to see the video. out of this whole scenario, what surprised you the most? >> when the first video of him just kind of dragging her out of the elevator surfaced many weeks ago, a lot of us were tweeting around and brian, i know you were on this as well. what's going on here? what's the other part of the story? so it takes tmz, which does have its way of getting these videos and getting all this salacious information, it takes tmz web site to get the full video? ravens didn't ask for the video. the nfl commissioner's office apparently did not ask for the video either. now, to me, this is so egregious, so infuriating, when you see how he hit her, he basically knocked her off her feet, then kicks her with his feet to get her out of the elevator. the nfl should have asked for that tape. should have demand the tape. and none of that happened.
i find it appalling, disgusting, and it's willful ignorance on the part of the nfl. i certainly hope there aren't other players out there who have similar issues in public the way they treat women, children, whatever. we obviously saw the michael vick situation years ago. but this i think is a black eye for the ravens and for the nfl, unless we're going to learn something different about their desire to have that full footage. >> apparently the nfl, they're saying hey, we requested all the stuff from the cops, because pending an investigation, nothing came out. they could have gotten it from his attorney. they could have gone directly to the casino. this morning we're asking people and our e-mail machine is lighting up -- whether or not he should wind up with a lifetime ban. what do you think? >> look, i'm not the sports expert here. but i find this behavior in a platform that these players get,
the privileges, the great privilege to play in the nfl, to be on that sport stage week in and week out. you must conduct yourself a certain way. i'm sorry. i know everybody is tatted up and they trash talk and that's fineful but if you're going to treat a woman like this, what else are you going to do? we're worried about their getting concussions? i'm worried about the fiance now wife getting a concussion. would i ban him for life? well, michael vick's playing. but this is a person. i'm a dog lover, too, so it all is horrifying to me. if i were the commissioner of the nfl, i wouldn't have people like that playing in the league. >> what do you think the fallout should be for the nfl if it comes tout that it was willful ignorance and not the investigators being incompetent and not being able to do their job, but willfully putting their head in the sand and letting this by? >> look, we've had sports teams go through all this angst recently about owners with their
racist commence and there was a big push to drive the clippers owner obviously out of professional sports. he's out. so the question is, was mr. goodell's office, if there is no e-mail trail, if there is no series of calls, if there are no demands to see the full tape -- and maybe there are. i will say i'm corrected if that exists. if there wasn't an aggressive attempt, all avenues exhausted to get the full video footage, then i think his office has an enormous amount to ask for and the ravens squad and all of the leadership of the ravens, ditto. >> i would add this, the a.p. reported late last night that they were able to see just the -- just the a.p. were able to see a much clearer picture. they were able to hear it and it turns out surprise palmer can be heard shouting obscenities to each other and she appears to spit at him before the knockout blow. after that, he's heard saying
she's drunk, right? no cops, right? no response from rice. >> she had a messed up face, didn't she? so nobody wants to -- it's a famous person, so nobody wants to ask the next question. and he's a great player, so nobody wants to really do the follow-up. look, we all have small children. we want them to behave a certain way. i think we all -- everyone makes mistakes. but this is a criminal battery. the fact that she didn't want to pursue it as a criminal battery, that's the big conversation about spousal or partner abuse. to me, this is so egregious and it was, to me, it was obvious the first time i saw the tape, brian. it was obvious that something really bad happened. okay? we're not able to get -- i don't buy any of it. i'm sorry. it doesn't pass the straight face test. that's my woman's intuition.

the white house offering a very few clues about what president obama is going to say in his speech tomorrow where he's supposed to spell out what we're going to do about isis. what do lawmakers want to hear from our hander in chief? congressman mike rogers is the chairman of the house intelligence committee and joins us today. good morning to you.
>> good morning, steve. how are you? >> i'm doing okay. i now the four top leaders of congress are going to meet with the president today. tomorrow he's going to meet with apparently senators and on thursday he's going to meet with the house of representatives. what does the white house need to talk to you guys about? >> well, it's more important he talks to the american people as well as congress. but what he doesn't need to do is give a laundry list of things that he will not do to try to defeat isis. i think he needs to engage in what the threat is. remember, they have thousands of people with western passports, meaning they can have access to europe and the united states by just buying a plane ticket that are now radicalized. they're part of this isis organization. incredibly dangerous. and this is a terrorist group with an army that's on the march. so we have got serious work to do. he needs to lay out that case and he needs to show that he can be a leader, that he can
coalesce and get nato to do more than they want to do. he hasn't shown that in the past. this is his important moment to do that. >> do you believe that people behind the scenes know what the strategy is? does the intel community know what the white house is thinking yet? >> i have to tell you, we went through a whole series of meetings even just yesterday and it's not clear to them yet where they're going, which is a little shocking, a little disappointing and a little concerting for me. i hope that that turns around here pretty quickly. there is a lot of things to do if the president decides to move forward on a plan. normally you have that done prior to your announcement. i'm a little surprised a lot of that work isn't done. tomorrow i guess will be an important day not only for those of us on the national security committee, but the folks who will do the national security implementation for what that plan is. >> speak of security, here on the channel on friday night we had a one hour special, 13 hours of benghazi. i'm sure you saw part of it. and it's interesting, three of these guys who are special
operators, they came on camera and said that when things were going down the drain, they were talking to the c.i.a. station chief, bob, and he told them to stand down, just hold on. don't do anything at this point. i understand your committee has looked into it and there was no stand down order. yet they were told don't move. so which is it? >> well, it's probably a combination of both. so a former f.b.i. guy, we interviewed everybody in that chain of command, including the individual that they're calling bob on the compound, including the station chief who was in tripoli at the time. so what i think they're referring to is these guys grouped up and they had an unofficial relationship with the mission force, meaning that there was no -- it was not their responsibility to go and rescue them. their job was to protect the annex, because it was a sizable annex. a lot of people there. their job was to provide security there.
but they had this unofficial relationship. why? because when they went to talk to the state department agent, they realized then that they were not in a position to protect themselves. so these guys are heros from the word go. i hope their book sells a million copies. the problem is what happened was the commander on the ground, this guy they're calling bob, when these folks came up, they got in the vehicle and said we made a promise, we're going, he said, wait a minute. i need to figure out a, what's going on. and b, if i can get you any better weapons and maybe even some help to go. we don't know if there ispeopler 500. so that dispute ended up -- it wasn't even a dispute. it was the commander on the ground making the decision. i think it took 23 minutes before they all, including that commander, by the way, got in a car and went over and rescued those individuals. >> this is the first we're actually hearing them talk about what happened. i understand they have gone to washington. they've talked to the intel committee. what's interesting is the attorney for gregory hicks, state department whistle blower
regarding benghazi, she says that these guys who we met friday night for the first time, they've been harassed by your committee. listen to this. >> they were told, they were accused that they were not telling the truth. they were threatened with the committee is not going to pay your travel expense, which committees always do for witnesses who come in from out of town, because you're writing a book and you're going to make money. that chief of staff, the head of that staff that harassed these three brave men a few months later went to work for beacon global strategies. that is a hillary organization. >> what she's saying is they were threatened with perjury for telling their story. is that true? >> no, they were not threatened with perjury. what we do, it's interesting. the lawyers asked that none of their testimony be released until after their book was out and being sold. so this is so horribly unfor nate. i think you have lawyers who have a financial interest in this certainly making allegations that are far from true.
we have professional investigators. i'm a former f.b.i. agent. our goal was to get the facts and put them on the record so that we could have a record. the sad part about this is the state department made some horrific decisions that i believe contributed to the death of those four individuals. that is all going to get lost in these folks -- as i said, i hope everybody buys their book because these are very brave souls who served their country proudly who ended up driving into unknown circumstances and save them. that's all really good. so the only way if people buy the book is with inflammatory comments. these are attorneys who have a stake in this. we asked these transcripts be released and americans can find out the real truth. >> we're looking for the select committee to did he tell get at all the -- get at all the truth. thank you for joining us today from dc. >> thanks. straight ahead, cycling not usually known for its fights, but this slap down is epic.

psychiatrist keith ablow, he became a psychiatrist, which is tougher in my mind. first off t right to hold the parents responsible for the horrifics acts of teen-agers? >> common sense that came out of the mouth of the mayor and the police chief in memphis, tennessee, is exceptional. and so refreshing because they are correct. not only do the parents need to be involved because what's happening is who is paying for all this? we are. those kids are going to get a free lawyer. the taxpayers pay for t. they're going to go into some sort of system that the taxpayers pay for. there is only so much the police can do. there is only so much the school teachers can do. the parents need to be held responsible for the actions of their juveniles. >> one parent did turn their 15-year-old in. ten have been arrested. one is 20 the rest are teen-agers. >> how long can you be this early -- wrong can you be this early in the morning? talk about opening the door to government intrusion. now we're going to open the door, just like the scots want to do and have the government
start arresting parents? >> i didn't say arresting. no, no. >> they say held responsible. >> clearly there is a parenting problem. >> sure, there is. but these aren't dogs. you can't chain them in the backyard and pre-- >> no one says chain them. teach them basics. >> when they start school, why don't we start teaching empathy? >> the video shows a human being lying on the floor in distress and these kids picking up pumpkins and smashing them on their heads. >> and just to add to that, two kroger employees come running out to help. >> they get knocked out. >> we're talking about arthur's desire to make the parents pay a penalty for the actions -- >> i didn't say pay. >> hold them responsible. >> very simple. >> hold them responsible is what the law enforcement people said and arthur said brilliant. not brilliant. you can't be held -- what, is there a new class of law in town? >> give me a breck. there is juvenile courts and

well, if you're an iphone fan and there are millions around the globe, the big day is finally here. apple is about to unveil its iphone 6 and perhaps one more thing. what is that? don't know. but one lucky guy is clayton morris, outside the flint center in california. why are you in cupertino and not san francisco? >> that's odd, isn't it. the flint center, they haven't been here since steve jobs rolled out the original macintosh. but they also built this giant
building. apple built a three-story white cube building. in fact, there is an aerial live shot. they put up a drone to fly over this thing. what in the world is this? what is apple building? they've got table saws still going. they're still putting the finishing touches on other structures. i have a feeling this could be what the thousands of journalists descending on where we get the hands on with the iphone 6s, how many of them will there be? 4.7-inch iphone, 5.5-inch iphone. this will be the big room where thousands of journalists will get to go through and play with the new devices. one of the features i'm most excited about, i'm sure your wallets are larger than mine, you didn't even disagree with me on that, sure, it's gigantic and you can't sit on them, is the paying for groceries with your iphone, being able to add your credit card -- >> how does that work? >> the idea is that with touch i.d., it would be even more secure than using your credit
card. how many credit card breaches do we hear of on a regular basis? so you get the new iphone 6, type in your credit card information, and able to go up to some of the partner stores, whether it's target, wall walgreen's. rumbles that other major retailers are on board so you don't have to carry your wallet. a dream world. >> it's also about a partnership. they must have gotten other companies interested in this. they all have to be on board for this to work. i'm sure that's part of the announcement today. >> absolutely. think about it, $2 trillion in credit card transactions in 2012 in the united states of america. if apple can get a slice of that, that will be a big win for them. all the buzz is what this watch will be. what will this be today? last night i tweeted, i said, i think this event could be bigger or as big as the ipad launch. rumors i'm hearing this morning is going to be much bigger. in fact, there are even rumors that the band you2 will take the
stage at some point. who knows? but will they be here for whatever wearable device is shown off on stage. a watch that you could track your heart rate, every step you take and have that interaction with some sort of device on line. so it's a new frontier. this could be a new product category for appearle appearle d shake things up. >> a lot of folks don't wear watches anymore because you have your phone next to you. this is going to have to outdo the iphone somehow, right? >> or ipad. >> right. think how big the iphone is. huge product category. and the ipod was dwarfed in comparison to the iphone. so what new product category can apple has that much of an impact, that has everyone talking like that? we know of some big designers coming on board apple recently. so it would have to be compelling enough that it would rival some of the big watches we've seen that you would go in and pay maybe $1,000 for at one

just discovered her remains ten miles from the house of her accused killer, zachary adams. he's one of the two men who have been charged in the killing of the 20-year-old in her disappearance and murder. her family is expected to make a statement around noon later today. a potential breakthrough for helping children suffering from autism. there is a small study at the university of california-davis and it is providing families with new hope this morning. the results reveal that signs of autism may be a race to -- erased if babies start therapy before they even begin to walk. the study tested just seven infants, so it's considered very, very small. between ages of six and nine months old. by the time they reach their third birthday, five showed no symptoms of autism. a sixth child had mild symptoms. researchers hope to begin a larger study. one of the country's most iconic roller coasters going up in flames. look at this. watch as the highest point,

quarter 'til the top of the hour. the baltimore ravens suspending runningback ray rice after shocking video shows him punching his fiance. but is the punishment enough? why isn't he in jail? here to weigh in is peter johnson, jr., fox news legal analyst. good morning. thanks for being with us. >> not enough. maybe he should be in jail. today the nfl, the ravens, rice and the prosecutor in new jersey are all big, big losers. mr. rice is going to benefit from a diversionary program where if he keeps his nose clean for a year, he will walk without a conviction. the arrest will be shown for aggravated assault for what happened in the elevator in the hotel.
but there will be no conviction going forward. >> what is this diversion program? >> basically says you'll attend a program, 'cause you're a first time offender and the d.a. agrees to it. the d.a. agreed to it here. so the question becomes, did the d.a. have this tape? did the nfl have this tape? did the ravens have this tape? and if none of them had the tape, why didn't they have the tape? we see a woman being dragged by a 200-pound man, a six-year nfl player, a huge star, a big strong guy out of an elevator unconscious. >> your first question is what happened in the elevator? >> so the only reason you won't know what happened in the elevator is if you weren't really interested in finding out what happened in the elevator. >> so is this a case of the nfl's investigators not being able to do their job well enough because the casino in atlantic city, new jersey, said we would have given them the tape had they asked for it. >> professional sports, including the nfl, reaches out to some of the best security and police minds in the country.
former police officers, former federal agents. they're part of the nfl security team. so it can only lead to the conclusion and the inference that maybe someone wasn't really interested in finding out the truth. what happened in that elevator? now we know as to what actually happened. so should mr. rice continue to be in the diversionary program now that we've seen this? what should happen going forward? we know the nfl has indefinitely suspended mr. rice. is that enough? should he be banned from football for his entire life? we know what's happened in terms of football players mishandling and abusing beautiful dogs. but here we have a man apparently striking in an aggravated assault a beautiful young woman who he eventually married. she said maybe it's okay. the ravens even put her tweets up on their twitter feed. but how are we feeding this and what do we do as a nation, as a
