Thats the question before the Supreme Court<\/a> and the stakes could not be higher. The census determines congressional representation. How many representatives each state gets. Also it determines who gets billions of dollars in federal aid, which states, which communities. This idea of including are you an american citizen is very controversial and raises all kinds of constitutional questions. Does it discriminate against undocumented immigrants who tend to vote democratic . Do you need to prove intent . Is the fact that this discourages these people from participating, is that sufficient . Those are fascinating constitutional questions. The questions before the Supreme Court<\/a> arent so exciting. The argument in the Supreme Court<\/a> is whether the commerce sector violated the administrative procedures act known as the apa when he included this language. The apa requires the Commerce Department<\/a> to submit these proposed changes to congress three years before they are implemented. It also requires if the Commerce Department<\/a> needs this information it requires the department to get it from administrative records, not to directly ask americans these questions. So the lower court found that on that basis largely on that basis alone that this language cannot be used. Bill wall street journal writes this. The justices should be wary of letting courts overrule an executive officially acting within the boundaries set by congress. Some of the lower courts ruled against the administration. If the administration were to win, what would change, tim . Well, i think it would be a go ahead for increased administrative power, executive branch authority. I think if these regulations are upheld and it is a close vote, you have the five republican appointees on the court. The court will be criticized for acting politically which might be unfair. The fact is the argument that executive Branch Officials<\/a> have discretion is a valid one the court has signed onto for a long time n. This case secretary ross said the idea came from the Justice Department<\/a>. Now clear it came from here and asked the Justice Department<\/a> to ask for this change. That sort of scenario sometimes can affect how much discretion the administration will get. Sandra there is some data out there depending on what the Census Bureau<\/a> came up with, with their own analysis. They found adding this question would likely lower the initial selfresponse rate among households with at least one noncitizen by nearly 6 . That translates to two million households, 6. 5 million persons. How will that play into the picture . Sandra, thats a big issue in this case. In fact, one of the constitutional arguments the court is taking up adding this language defeats the purpose of whats called the census clause in the constitution. The census clause requires the government to undertake this census and get an accurate count of the number of people in the United States<\/a>. By the Census Bureau<\/a>s own figures you may have as many as 6 1 2 Million People<\/a> who will not participate and therefore it violates the census clause of the constitution. So that is another area in which the court could decide this case. But the central focus really isnt discrimination. It really is procedural and whether the administration followed the apa, administrative procedures act. Bill can they win this case before the justices . Thats a very tough case for the administration. Can they win . Yes, they can. Like so many court cases you know, bill, there is not so much a right or wrong answer. What gets five votes its in a gray area. And i think that its possible the administration can win this. I see it as an uphill fight. Thats not addressed really here at all. Weve noticed that the cost of college keeps going up and up and up every year. We certainly have a problem here in cook county because the states attorney has dropped all charges. Leads to other problems.
