What the prosecutor will typically say to the jury is that we would be delighted to put pillars of community on the stand to tell you about these stands but they tend not to know about bank fraud. If you want to find out what happened in a bank fraud you go to the fraudsters. I assume what the government will say we didnt pick rick gates, Paul Manafort picked him. Sandra how does it all turn out for manafort then . For manafort, the problem is when you have a witness like gates who is an out and out
liar what the prosecutor will say is where weve corroborated you can and where there is records you can believe what he is saying. If we havent corroborated throw out whatever he said. The problem manafort said mueller indicted this whole case before he got gates as a cooperateor. He was prepared to prove the whole case and all gates is doing is tightening up muellers proof on the intent requirement for these charges. As far as all the acts of fraud are concerned, They Arent Reliant On Gates for that. They have the proof before he took the stand. Sandra were expecting this is underway now possibly a few minutes ago inside that courthouse to hear from rick gates again. Where do you see things going in the courtroom today . That was eventful yesterday. Very eventful. It always is with the governments main witness testifies. Youll get more of the same this morning. You may get some Rehab Testimony through the government lawyer who will point out that all the terrible things that gates did or at least many of them were done hand in hand with manafort. Were in the second week of the trial. What does it mean big picture when we look at Robert Mueller the special counsel and this investigation . Theyre expending a great deal of effort on manafort. So clearly mueller thinks that he is an important witness. I think you can look at this one of two ways. If you are in the camp that thinks he is hell bent on making a case on President Trump, he is squeezing him to get whatever he has on trump. If you think what he is actually trying to do is get to the bottom of what happened, answer every unanswered question, then manafort becomes an important witness for
filling that out. He is expending a lot of effort on him. Sandra as far as a possible sitdown between President Trump and Robert Mueller, where do you fall on that . Is that a good idea for that to happen . It has always been a bad idea from trumps perspective. You can see why mueller would want it. His lawyers are telling him not to. I think whats happening is mueller needs to show that there is some area that he needs to get testimony from trump rather than all the thousands of documents and hundreds of witnesses or scores of witnesses that he has already gotten. The one issue i can think of that trump alone would have testimony about would be trumps own state of mind. The operation of his mind. What was going on in his mind when he did things like firing the f. B. I. Director. Now, mueller is pursuing this theory that a president can be investigated, maybe even cited for obstruction based on lawful
actions within his constitutional prerogative if he does them with corrupt intent. I happen to think thats a flawed legal theory. If you buy it, then obviously President Trump is an important witness in terms of the operation of his mind when he took these actions. Sandra trumps lawyers leaning towards no on the sitdown. sandra Breaking News from just a moment ago. Republican new york congressman Chris Collins has been arrested on f. B. I. Charges related to a Securities Firm australian biotech company. His son, cameron and the father of camerons fiance are also charged. Joining us now by phone is chad perg rum, fox news capitol senior producer. What can you tell us about the charges . This goes back a couple of years. Chris collins and his staff have had some legal issues for a while now. There was a raid in may of 2015 of his chief of staffs home in upstate new york, Christopher Grant regarding improper fundraising activities. And then there was a very muddled release by the House Ethics Committee looking into this in october of 2017. The late congresswoman from new york Louise Slaughter sent to the Office Of Congressional Ethics a complaint against him. The outside group that then
refers things to the former Ethics Committee. The Ethics Committee came back with a muddled opinion on whether or not he had done anything wrong with the Insider Trading. You might remember Louise Slaughter authored the stock act that bars Insider Trading, using proprietary information to members of congress and their staff might acquire to make money on the stock market. In release of that report i interviewed Chris Collins about this and Louise Slaughter died earlier this year. Chris collins called her a despicable human being. He is accused of sharing nonpublic information important to investors. In that Ethics Committee complaint last year it was alleged that he had helped the Immunotherapy Company here get access to the nih. There is a lot of question about what Chris Collins ethics may have been. In my interview with him last week he made the referral he
called slaughter a disgrace and went after her saying i always follow the ethics. He has a criminal complaint against him. Sandra he has been arrested and the charges being formally against him. And in michigan there could be a new political star rising. John james after a big boost from President Trump winning the Republican Senate nomination by a country mile. We have Fox Team Coverage for you this morning. Mike tobin is in the motor city. We beginning with dan springer in kansas. What are things like on the ground there this morning . This has been unbelievably close, sandra. The votes were still being
counted late this morning because of a Technical Glitch in johnson county, the biggest county in kansas. Because of that they were still counting as of a couple hours ago. When they completed that count, the leader was kris kobach and he was the candidate who was endorsed by President Trump just hours before the polls opened on tuesday. That endorsement came by tweet on monday and when it was done the count at least this morning kobach led by one tenth of 1 . An unofficial result until the state canvas is done. There could be challenges to some of the ballots and a likely recount. For now Secretary Of State kris kobach is sitting on top. He is a polarizing politician cut from the same mold as President Trump. Very antiillegal immigration and made wild claims about voter fraud. He spoke to supporters last night before the count was
completed. I want to ask all republicans across the state regardless of who the winner is to stand together, to join this has been a very tough scrimmage between really the five sides but i want everybody to join together regardless. Stand for the principles we all believe in and come together quickly so we can advance our principles against the democrat and independent in november. Finishing second for now is collier who took office in january of this year who served under lieutenant governor. Collier was ahead by two points in the final poll done on the race. He was clearly not happy on monday when trump, who won kansas by 20 points endorsed kobach. When the dust settles whoever wins they will take on Democratic State senator laura
kelly. Kelly easily won her primary last night. The pundits say that she will have the best chance against kobach because he is such a polarizing figure and unpopular with many people in kansas. Bill dan, thank you. In michigan trumpbacked republican john james winning the primary facing a tough race in november against a threeterm democratic senator. Mike tobin is standing by there. With the president in his corner calling him a future star of the grand old party the 37yearold political newcomer john james marched to a convincing win in michigan. James a former apache pilot who served in iraq made his Victory Speech in the warehouse of the Family Business he has been running since 2012. He told supporters he wont advocate a black or white message but a michigan messages and turned his guns on the
fight with Debbie Stabenow who he said her time is up. She has been living on the taxpayer time with many years with nothing to show for it. She is in for the fight of her life. Stabenow is the first woman elected to the u. S. Senate in michigan and easily fended off challenges in the past. The polls give her an advantage and she has more money than james. Political experts at the University Of Michigan and Michigan State predict agriculture, manufacturing and female voters will show up for stabenow. James has President Trump in his corner but the endorsement might not mean as much in the general election. Trump won michigan but the margin was thin. The results would have been different running in a pack in a midterm. Were in august. People are checked out. More motivation has to be made at the local level to draw people out. The president could have had the luxury of doing the hands off. Thats not donald trump. He rolls up his sleeves and does what president s pretty much have not done before, get involved in primaries Sandra Michael what do you say . Thats comical right now. You had to spend money in a seat that you have held for more than 35 years, a seat where our candidate Danny Oconnor, not conceded. 3,000 ballots havent been counted. Great progress in delaware and franklin county. The notion its a good night is ridiculous. You were showing michigan now. The fact there with is a conversation about james is ridiculous. Stabenow is up by 18 points. Lets talk about how you have four women that are going to be leading the ballot in michigan. By the way, this morning Chris Collins being indicted. The notion that republicans are having a good day on elections and what is happening electorally is surreal. Bill i guess you guys found neutral ground. I think it was really a mixed bag, if anything. It gives republicans cause for concern. Frankly ohio people are focusing on it because it is a key swing state. Affluent suburb of ohio columbus rural areas and republicans have held this district for a long time and trump won in double digits. The president has made a tactical decision that he will get involved in these races. His supporters will say look, he may have won this race for balderson if the race goes the republican way. On the other side he may have
motivated an already energized Democratic Base to come out against the republican. So it is a mixed bag. Bill what i find interesting, the democrat ran a campaign you go to his website. No mention of donald trump. All the positions he takes are pretty Traditional Democratic positions, Climate Change, healthcare, etc. He doesnt mention ocasiocortez and wont support pelosi. I think cortez will suck the oxygen out of the room because she is so far to the left. Then you have democrats like you are speaking of who tend to be more moderate, that is the who are you . Are you going to be socialist democrats . A significant part of your Candidate Base seems to be
pointing to. What are you going to be . Well be not going the jail and avoiding trial the way you had gates, manafort and collins. About what happened last night. Bill is that the kind of candidate you need in three months to win . It varies every place. Lamb made his decision. It varies from district to district. Im an Assembly Member myself. Notion of me telling someone what to do in their district. What happened with Danny Oconnor . When we look at what is happening now theyre the reason we have flipped 44 state legislative seats. Something is going in our direction. The president and local candidates arent explaining what republicans have done for the economy. They are choosing to talk about base issues, immigration, the
trade wars, tariffs. To me thats a losing strategy. Look, republicans have plenty to discuss. Theyve broken out of the secular stagnation of the obama years. Weve had energy reform. Weve cut red tape, unleashed this economy and guess what . All those voters that democrats are trying to motivate have come out have benefited the most. Women, minorities, youth. So there is a story here to tell. Again, the gamble that trump is taking is he is trying to nationalize the election and turn in a bannonlike direction. A Winning Strategy is localize the elections and talk about the achievements. Sandra you brought up the socialist part of the party which gained momentum. Ocasiocortez, lets hear the latest from her and her strategy. Joe manchin faced a little to no talked about primary from a woman on the left. I know paula very well. A coal miners daughter. She ran on no money. She was out there knocking doors herself no money, joe manchin dropped 2 million against her and she still got 30 of the vote. In West Virginia, which went almost every county in West Virginia went for bernie in 2016 who was further to the left, you know . That to me tells me that we need to start reframing our issues instead of left and right to top and down. Bill the important point about this interview she is getting so much national attention. Rightfully so for the victory she had in new york. She didnt have a good night for candidates in michigan and places where she campaigned for. Did the far left, Progressive Left have a bad night last night . Real bad night. And if you make cortez the poster person of the campaign in the midterms. She will be, the press will focus on her because she is outrageous. She painted you guys into a corner and nobody is standing up against her. She is traveling around the country. She won a district here in new york that is not the banner of your party. Cant get out your talking points. Mobilizing of the Democratic Base is happening. The candidates you endorse or not endorse is irrelevant in the grand scheme of november. The notion is this. Would i rather be on the side where momentum is the case on the democratic side or the republican side where they hope to win races that shouldnt be competitive. Last night, 17 seats in the midwest alone more competitive than the seat in ohio theyre vying for. 60 seats around the country. Bill the question is whether the far left. We cant ignore that. It mobilized the base. Look what happened in franklin county. 11 point greater turnout in
franklin county last night. We talk about an individual candidate. Lets talk about what is happening. The base. Bill you are making the case for moderate democrats. You think donald trump was showing up on saturday because he wasnt trying to mobilize the far right . Its like were having a tactical game. People are trying to mobilize our base that happens in a special election and again i want my base mobilized and have independence coming up with. Ohio is a special case. You have a governor who is antitrump and a Swing District there that in terms of character and personality is unlikely to go for a character like President Trump. It was unusual that trump won the states he won in the midwest. The trade war may be hurting trump because it will hurt imports of steel and aluminum. She is a good arbiter between you guys. As bill said im chair of a group called united against nuclear iran, a Bipartisan Group focused on trying to convince businesses as congress, led by people like me and republicans and democrats adopted sanctions, economic pressure on iran. United against nuclear arms put pressure on businesses to stay out of iran saying it was Risky Business and wrong to deal with this extremist regime. At the negotiations, the
socalled p5 plus 1 including the Obama Administration gave away all the pressure for a very inadequate agreement. Temporary pause in Nuclear Weapons development. Nothing about limiting Missile Development or other bad behavior of iran. It looked like how to figure out how to live with it. President trump comes along and does exactly what he said he would do during the campaign. A whole new world. Sandra he reimposed the sanctions the other night took vehicle tuesday. More coming in november. Will they work . I think theyll help because i think particularly theyre coming at a time when there is more instability in iran than there has been for a long, long time. Probably since the protests after the fraudulent elections in june of 2009. What i mean is the economy is tanking. The currency of iran has lost 80 of its value in the last year. Unemployment is sky high. Almost every day somewhere in iran there is a protest to the government. And it is mostly about the economy, about corruption in the government, about extremism in the government and some of it, interestingly, is we dont want to be in lebanon. We dont want to be in gaza. We want our money to be spent in iran on us. Thats what the iranian people are saying. These sanctions from President Trump and the administration will squeeze the iranians more and maybe force the government to come back and negotiate a better Nuclear Agreement or it will lead to a new iranian revolution. Bill we dont know whats behind door number two. The latest tweet from the president on this on screen. The iran sanctions have been cast. These are the most biting sanctions ever imposed and in november they ratchet up to another level. Thats when the Oil Sanctions kick in on november 5 and
anyone Doing Business with iran will not be Doing Business at the United States. Im asking for world peace, nothing less. In contrast, nancy pelosi came out and basically slammed this this agreement. This is what she said. You just said something. You believe this could lead to a second revolution in iran. I do. Bill what is that leadership without the mullahs in charge. It wont be easy. Im afraid the mullahs are behaving like assad in area. Theyll turn their guns on their own people. But maybe not. What i see is a country where the majority of people are really fed up with the government. And there is every reason for them to be fed up. No freedom. But no Economic Opportunity. A lot of corruption at the top of the government. And i think these sanctions businesses the european governments are clinging to this iran Nuclear Agreement. We have to try to if that happens, i think its in our interest to help them. Listen, the government has an
opportunity to negotiate reasonably and i think the only way this group of extremists will really negotiate to end their Nuclear Program and stop the other bad behavior is if they think its the only choice they have to keep their regime in power. And they may be coming close to that moment because of the pressure economically. Sandra you talk about our european allies, though, mike pompeo making it clear in a tweet today saying the regime in iran is at odds to world peace. That being said, last night the president had this meeting with Business Leaders at his golf clubs in bedminster. When speaking, he seemed to be taking a bit of a victory lap when it comes to his policies on north korea and that meeting in singapore with kim jongun. Watch this. President trump some say

Well, he is making more progress than the last couple of predecessors have. But not as much as there is not as much change in behavior by the north koreans as we need. The congressman is being charged with federal Insider Trading related to an australian biotechnology company. Representative collins served on the companys board of directors, his son, Cameron Collins and the father of camerons fiance also face Insider Trading charges. Prosecutors accuse collins of getting Insider Information about a new drug the company was creating and illegally shared the information with the other two men who made timely trades based on that insider info preventing them from losing over 768,000 they would
have otherwise lost had it not been for the information provided by collins. According to the indictment this all began june 2017. The company was developing a drug to treat a form of multiple sclerosis. Prosecutors allege representative collins knew the drug failed trials five days before the news became public. They know this because collins received an email from the ceo of the company at a congressional picnic at the white house and proceeded to call his son immediately after. Cameron then traded his stock the following morning. In a statement the lawyers say this. It is notable even the government does not allege that congressman collins traded a single share of the stock. We are confident he will be completely vindicated and exonerated. Prosecutors say its true mr. Collins lost millions of dollars in stock but they argue the only reason representative did not make trades himself was because his stock was held up

I spoke with Rudy Giuliani a short time ago saying there was a 90 chance the president s legal team will send its response about the parameters for a potential interview with the president to Robert Mueller and his team by later on today. Maybe the close of business. He wouldnt go into details he told fox news it is not a
refusal but at the same time its not a completely unreasonable position. I can see a way in which they, muellers team, may agree with it. He says the chances of mueller accepting the offer depend on two things. First, how much they want an interview with the president and b, the degree to which they are willing to say to themselves this may be our last chance to get it. Giuliani acknowledged that mueller could try to subpoena the president if an agreement for an interview cant be worked out. The attorneys have stated they will fight in court any attempt to subpoena President Trump. Giuliani added that they may be willing to allow the president to answer some questions that go to the issue of obstruction of justice if mueller would give them a couple sample questions that arent red flags, things that dont look like he is trying to lay a trap. Last night on hannity jay sekulow said the team is very reluctant to allow mueller to ask questions about actions the president took after taking
office, issues that fall under article 2 of the constitution. Listen here. Its the position of the legal team and pretty clear on this in the last couple weeks that our position is that there is not a constitutional basis to move an interview forward. What i mean by that is the article 2 power of the presidency is very clear and the idea that you would have a series of questions involving the president s motives for particular actions as it relates to article 2 power would frankly be inappropriate in our view. Unconstitutional. Giuliani told fox news even if muellers team agrees to the parameters theyll be sending back likely today there is still a lot of talking to be had before the president sits down with mueller or even answers any of his questions in writing. A new development today. Well see where it goes. Sandra thank you. Bill lets get some insight on all this harvard law professor Alan Dershowitz with me now. I see you are in the car there, thats okay. I love to talk to you any time any way we can. Giuliani going the write a report today or tomorrow. I thought they were waiting on muellers team to write their report so that the president s team could see whether or not there was a crime involved in this. Where are we now, sir . Well, i think the tactic is emerging and fairly clear. The president wants to testify, his lawyers dont want him to testify. The lawyers will set up a series of conditions to put it in terms of the godfather. Make mueller an offer he cant accept and in the end mueller will say i cant accept this offer so well subpoena you. The president will be able to say i wanted to testify, it was mueller who turned me down. I wanted to tell the American People what happened and then there will be a fight over the subpoena. That fight will end up months from now as a draw. The president will win some issues, he wont be able to be questioned about why he fired comey. He wont be able to be
questioned about other issues governed by article 2 of the constitution but he will be able to be asked about questions involving meetings in the trump tower before the election, involving his son. So in the end it will end up either mueller will have to say in the report the president wouldnt do it and therefore he should infer guilt from that or have to wait until he resolves these issues in front of judges. So i think that is the strategy that seems to be emerging and seems like a clever strategy. Bill you are dividing the calendar in two. Precampaign up to election day. Anything after that is off limits because it is protected by the constitution under article 2, correct . Thats what you are saying. Not everything but many things. He cant be asked about his motives. Why he fired comey any more than a senator could be asked why he voted or a judge could be asked why he issued a
decision. The constitution gives breathing room for the exercise of article 2 powers of a president. But he could be asked probably about whether he knew about the meeting prior to being elected president in the trump tower. That seems at its very heart to come up with a constitutional argument against that although im sure his lawyers will try very hard bill giuliani will say show us there is a crime. Show us that the crime cannot you cannot gain information about said crime from any other source. In other words, you just cant come and interview the president any day of the week. He has other things to do. Thats a very smart thing to do. First of all as a guy who taught criminal law for 50 years i dont see a crime that mueller can come up with. I dont think you can obstruct justice by exercising your article 2 powers under the constitution and second, it is awfully hard to show the president s testimony is needed. Comey said in his book you
never call a witness unless you know exactly what he is going to say. If you know exactly what he is going to say you dont need him as a witness except to spring a perjury trap on him. Giuliani has sprung a trap on those who would have sprung the perjury trap and its a smart tactic. Bill if you were teaching law this is the way its explained to me. If you cant get the evidence from another person you come to us and say youre the only witness. If we see a car crash you and i, they can talk to me or you, right . Right. But the problem is this. You have already cohen saying trump knew about the meeting. Trump said i didnt know about the meeting. If trump tells the truth as he believes it that he didnt know about the meeting he jumped into a perjury trapped. There is another witness saying the opposite. Thats what bill clinton did. He walked into a perjury trap or his lawyer did and i think President Trump learned the lesson of the bad representation that bill clinton had and by robert bennett, not by his other lawyers. It was bennett who walked him into the perjury trap and he will try to avoid it at all costs. He wants to say i have no fear, i want to testify, but it is mueller who wont let me testify under the conditions that my lawyer has properly set out. That way he has bill let me clear up one thing. John roberts write giuliani is writing a response to the counteroffer. Final question, thats right, correct . Yes. Bill on the Paul Manafort trial your key witness is rick gates on the stand. A jury there. He admits he lies, cheated and stole and you have to believe him as a witness. Is that what this case hinges on . If that case hinged on only the credible testimony of gates the prosecution will lose. The accountant was given immunity because she committed crimes by knowingly filing by her own testimony a false tax return. Unless the prosecution has documents that corroborate the two live witnesses, i think there is a very weak case. Juries dont convict on the basis of the uncorroborated testimony of witnesses that has incentive to sing and compose. These are witnesses who had every incentive not only to sing and tell the truth but to elaborate on the truth in order to get a better deal. So if the prosecution can come up with corroborating evidence they have a good chance. If they cant, i think the probability of a conviction is weakened. Bill wow, you say a weak

security finding more than 700,000 foreign nationals overstayed their visas last year. That figure could actually be even higher because it only counts people who came through ports of entry by boat or plane. Joining us now is Francis Rooney on the Foreign Affairs committee. Thank you for your time this morning, sir. Can you tell us what you can conclude from this . These are some staggering statistics. First i want to thank you for bringing this up. It is an amazing asymmetry. When i talk about the need for securing our borders and protecting our sovereignty i mention almost half the people in this country came in here legally on a visa and overstayed it. People look at you like okay, what did you say . Well, thats a big deal. Youve highlighted it. 700,000 a couple years ago including the San Bernardino killer and a guy that killed a policeman in fort myers in and
out of the country several times. We need to bring visibility to the need to use the biomet i ic tools we have to police visa overstays. Sandra were talking about it. What do we do about it . We need to deploy a biometric enforcement system. We let them go to school, go to work or see their family. They have to comply with a different level of scrutiny than an american city. Sandra the number 701,000 overstayed their visas is the new dhs number. From where they came by country. Number one, canada. You can see that number is 92,000. Mexico number two, venezuela number three. United kingdom four, columbia five. What are you able to conclude from that . What i conclude is that we
have a Border Control system, whether its by air, land or sea thats leaky as a sieve and needs to be tightened up. You arent much of a sovereign if you cant control who is coming into your country and where they are when theyre there. Sandra a lot of these are students, Foreign Exchange visitors. 4 of them stayed after their visas expired. Thats a drop of 5 from the Previous Report from the previous year. Go ahead. Evidently student visas are a lot higher percentage than family and work visas that overstay. Sandra that would lead to that number being bigger. How does it fit to the big picture what you see as far as the policies by the Trump Administration and tightening up our borders. The focus has been on the southern border and building more wall. Thats important. People can cross the border too easily and often. We have to focus on the visa overstays as well. When you go to europe or asia, they check when you check into a hotel or something they take your passport and notify the authorities. Everybody knows where you are. We have to get some kind of enforcement mechanism and from what i understand from Homeland Security people there is you can use biometrics to do it. Sandra give us size and scope. The president pour his attention wanting all this funding for the border wall. Are you drawing attention to what you see as a bigger problem with the visas . Im doing my best. Every time i talk about immigration, border security, etc. , etc. , i mention this statistic that almost half of the people that are in this country illegally came on a legal visa and overstayed it because we have no way of knowing who is here legally overstaying their visa and who is not. Sandra are you suggesting that the Trump Administrations
border enforcement policies, are they misguided and addressing the real problems . I think there is so much focus on the wall that the idea of policing visa overstays has kind of been swept under the rug. A lot of people in Homeland Security and the committee in the house of representatives that are acutely focused on the need to police visa overstays. Sandra an estimated 40 of the roughly 11 Million People in the country illegally stayed past their visas. This is a number that you are drawing attention to likely were talking about it right now. It will get a lot of attention. Is the overall trend, are those numbers rising . What are you seeing as far as the longerterm trend . I dont know if theyre rising right now but over time as long as people know they can come in on one of the student or family or work visas and just stay, you have to assume more people will figure it out. Look how they figured out the daca thing. That if they got here they

expansion will get it. We spoke with one woman who said it cant come fast enough. Donna wall of maine really in a difficult situation. She spent her waking hours in constant vigilance caring for her three Adult Children with autism. Her kids depend on her but without healthcare coverage she fears what could happen if she gets hurt or sick. It would mean everything to me. I have struggled so hard. It seems like nobody cares. Nobody. I mean, you know, im sitting here trying to do this job trying do the best i can, you know, it is a thankless job, you know . And you dont get any support. You dont get any help. And nobody cares. She is among tens of thousands to become eligible approved at the ballot by 60 of voters in 2017. The states republican governor vetoed a bill funding the
expansion and has stalled implementation citing concerns of fiscal responsibility. We would run out of money in october of this year before the election. Its a gimmick. They are playing games. Supporters of the expansion have sued the administration. Ultimately theyve been obstructing, ignoring the law, obstructing the bill of maine voters and doing nothing to get Health Coverage to people. Coverage people are waiting for. The governor is not up for reelection but it seeped into the race for his replacement. What are the candidates saying . The governors Daughter Campaign manager important the republican candidate had this to say. As governor sean moody will enforce laws on the books with funding from the legislature. The democratic candidate state
attorney janet mills promises Medicaid Expansion is the law and as governor i pledge not only to fully implement it but protect it from anyone who would attempt to undermine it. There is a question before the Court Whether the present Administration Must move forward toward implementation. That decision is expected to come out soon from the maine supreme court.
