powerful rivals in china and russia, eric. but again, the trick here even as we move forces away, is to find real reliable, local partners who we can work within a sustainable and cost-effective way. christians? >> that is a problem eric, and it happens as you said around the world. the united states has gotten huge responsibilities, we can't be everywhere at once. but so we really have to be able to find in places local partners who are prepared to shine a spotlight on this. to hold national governments to account, to protect these local communities. and then as i said, i think the time has come, particularly for christians and who are very vulnerable areas throughout africa, and parts of asia, as well as in the middle east. those declining communities of christians, we've got to find a way to empower them the way that we empower local kurdish communities in the middle east. to be able to organize, arm themselves, and train themselves to defend their own local areas when their national governments are failing to do so. we've got to look for some fairly far-reaching solutions here. because christians are being targeted, even as muslims, and other faiths around the world are being targeted by christians, more than any other driven by this ideology of islamic extremism. there needs to be an international effort, and i think that's where u.s. leadership can really come into play, to shine a spotlight on this and to do something about it. using all of the instruments of national power, not just military at our disposal. >> especially as we are reminded of this time of support for medicare for all had a direct impact on her poll numbers. and now in her political donations too. so the first question i have for you, could this be a holiday slump? it's the end of the year or this truly a troubling sign for the worn campaign? >> she still has a couple more days until the end of the quarter. we will have to figure out what other candidates got to. but it really comes as no surprise that someone who is been engaging in class warfare and slamming her competitors for taking donations from billionaires and millionaires would be having trouble fundraising now. it's a little bit ironic though. she is really slit in the polls in recent weeks, after basically giving biden to run for his money in the fall. she slid down to third nationally, i think it 8% and the real clear politics average poll, and it's next to sanders and biden. when you look at the early primary, she is now fourth behind buttigieg, sanders, and biden. so i think she is suffering that she got hit from the left and the center for her medicare for all plan. it's going to cause 20 to $50 trillion depending on the economist to talk to. and that, she has really suffered from that. and also i think a little credibility problem here. when she went on the attack against booted judge, a lot of people said that was effective right "after words" but it opened up and uncorked backlash with this wine cave can't meant. she hit him over having a fundraiser for having a fundraiser and fought wine cave, and all this and in america was looking at all of the event she had in her run. it looks like she had a few high dollar fundraisers herself including one in new york that had wine selling for $6000 a bottle. >> and i heard too that there were some souvenir bottles too, and somebody mentioned running neck and neck with a former vice president joe biden during the fall, her level of support is taken a hit. with her recent shift in language on the trail is well. she has been using the word choice mark, saying it's the public's choice if we transition to medicare for all. so it's the momentum, it's the money, and it's the language. what are you reading to that? >> why think if you're talking about choice, she is going to allot of wasted limited choice and eliminate private insurance when she moves everyone chewed the government medicare for all plan. so i think that's a little bit disingenuous on her part and could be alienating boehner's, mainstream voters that are going for buttigieg and biden. and that would be in iowa and new hampshire. and sanders is also surging in the early primary voting states. and he is of a native son in new hampshire, representing vermont. so he comes out of those early primary dates with a big surge, it could be a biden sanders race. and she could be pretty much knocked out. and you could have come it's not surprising he ever represented from the left and the more mainstream party emerging from these primary states. sanders has a real chance in the vetted too. so it could be interesting, we are gonna see in the next five weeks how it shakes out, but i will put my money on sanders at this. and elizabeth warren is fading because of these credibility problems she has been having. >> and going back to how the money is coming in whether it's coming from the big donors are not, it's always a hot topic in politics when it comes to driving donations. i worn asked her supporters on friday to chip in, for anything, for $2 or anything. then today we just got this in a few hours ago have another e-mail with the subject line a good choke behind in reference to her numbers being down. adding in her e-mail to her supporters if we don't pick up the pace right now, we won't be in the strongest possible position heading into 2020. an obvious.she is making, but when you hear that language going to her supporters, will we see some kind of push in here? we have some numbers up on the screen for the worn campaign fundraising looking at the quarters today. the fourth quarter of 17 million you look back at the third quarter of 34.6, will she see the number she needs? >> as i said before, i think she made a tactical air in competing or trying to compete with sanders for the left lane of her party. he really has a loyal following and even despite his heart attack, we've seen his fundraising numbers basically outpace hers. that's in the third quarter he had 25.4 million and so he is in the last few weeks surging and those early primary voting states. and that is attracting whoever has the momentum, usually tracks a lot of the donations. especially when you're talking about more of the grassroots individual donors rather than these big millionaires and billionaires. >> now you've been tracking the numbers for very long times obviously, 70 look at the big picture, which democratic hopeful do you see rising to the top here polls, donations, and who is gonna pull it out? what you think in the few weeks. >> if you look at iowa and new hampshire, it's a biden, sanders race. even though buddha judges in the lead there, i don't think he can pull it off when it comes to south carolina. you have biden in double digit leads in south carolina. when you get to the other primary states, the national polling averages are going to start setting in and biden is still in the lead. he is around 28.8% there and elizabeth warren is fading. sanders is coming in around 19%. elizabeth worn at 15.4% and buttigieg is behind that. so i think you are really seeing this come down to a biden, sanders primary contest with representing both lanes of the democratic party. biden has had a bit of a free lane for himself, he's going to get some competition from bloomberg and buttigieg a little bit. but i think those are only on the margins for now. his obviously household name recognition from the obama presidency, and i think it will come down after the early voting states and fight weeks you're going to see it. [♪] laura: the long arm of the law kached up with a hit-and-run suspect in texas. a fort worth police helicopter showing the police chief arresting the suspect after chasing him over a couple of fences into a backyard just like in the movies. witnesses say the suspect caused a multi-car crash before take off on foot. the chief is a 26-year veteran of the police department. way to go. eric: amazon is facing a lawsuit over cyber-security concerns. it alleges the company failed to protect the privacy of its customers. he said somebody hacked into his ring camera, watched his kids play basketball and commented on the game while he was using the ring doorbell's microphone. laura: robert kraft pleaded not guilty to soliciting prostitution at a florida a. a judge ruled surveillance videos from the a cannot be used in this case. but lawyers are questioning that and suggesting kraft could be facing a felony charge instead of two misdemeanor counts. what is the argument for his fourth amendment rights. joining us, a former prosecutor and trial attorney. prosecutors turning you have the heat. as a form prosecutor, walk us through what that means. it sounds like an unusual move. how would this change how prosecutors proceed in the case. >> this is a surprise to me. there is a suppression issue. kraft's attorneys got video surveillance suppressed. prosecutors said to the judge there was no human trafficking. so when i read the florida laws i don't see a felony that could be for trafficking. there are misdemeanors he's currently charged with. if they are threatening this, why didn't you charge the third degree in the first place. i think this is disingenuous for the prosecutor to threaten the third degree when they only charged misdemeanors to this point. laura: what do you do if you are in robert kraft's attorney's shoes? where do you think you would dig your heels in on a defense with this? >> the first thing i would do is tell mr. kraft not to be making any public statements. there is a fair probability that if the state does not win the appeal to reverse the decision for the admissibility of the videotape, they will not be able to prove the case. because that judge suppressed the fact he was pulled over and identified. they would not have known for sure that it was robert kraft rsh until they pulled him over and i.d.'d him. there has been no discussion in the media about are they willing to testify? there is a chance this case won't be able to stand on its own merits. laura: when the judge ruled the police did not have a sneak and peek warrant. what do you do with the five days of tape that were rolled on at the day a which caught who knows what on surveillance. does all that go away if the warrant wasn't proper? kraft's attorneys, they are talking about hours and hours of tape. >> the judge's ruling prevents it from being used in a prosecution against the defendant. but it's not that the video will be destroyed. maybe there will be some civil pieces where that could be used. those are great questions. but the greatest impact on the court's ruling is it can't be used in the prosecution against craft. if this video cannot be used by the prosecutor, i don't know how they will prove the case against kraft. are they going to turn to the people giving the sexual favors? will they be able to identify robert kraft without just the media reports? all great issues for kraft and the defense team. they did a great job so far. laura: there is also the issue of at least four people who legitimately received massages with their clothes off when cameras were rolling. you go in and you think you are getting a massage. what can be done about that and where will it go from here? >> that is the exact reason why the judge granted the motion to suppress the videotape. he says that's unreasonable. he's got four people walking into a business establishment for legal reasons, and as they are unrobing for a massage they are being videotaped. that gets to the whole point of the fourth amendment, and the reasonableness. here it was not reasonable. not only this judge, but four other judges in florida ruled in these type cases that that's overly broad. robert kraft's lawyers are doing a great job. laura: the case may be elevated to a felony. what's your biggest takeaway from where the case stand right now? there is still more to come. >> the appeal will be decided. if kraft's attorneys are successful, i think the case will dismiss this. the third degree was in the brief. it wasn't a public statement. i don't any they will go that route. >> i think the judge is making a legally correct move. i think the prosecutors -- they are going after a 78-year-old man who is a widow. married for 48 years, he has done tremendous things for the nfl. i think they are using him for their own purposes. i don't see why if they are not charge other citizens who allegedly go to these establishments for illegal reasons, when they get charged with a misdemeanor, why are they targeting a man like robert kraft who is such a philanthropist. laura: he's certainly the most high-profile one. we'll check in with you later. eric: have you seen the pictures of the streets of san francisco, l.a. and new york? homelessness has risen to record levels and the trend shows no sign of stopping. where we can find common ground... big enough to dance on. for a better us, donate to your local y today. laura: taking you back to our totop story. one of the victims in the deadly louisiana plane crash. one of the victims isn't the daughter of an lsu football coach. the crash happened this morning in an open field next a lafayette post office. local reports say it hit a power line while attempting an emergency landing back at the airport. the plane was en route to a college football game between lsu and atlanta when it went down. one person on board along with three people of on the ground were taken to the hospital and are in critical conditions. ntsb is on the ground and investigators are en route. 2019 s the economy, but that hasn't stopped the rise in homelessness. major to unconventional tactics to reduce the homeless population. it's a big problem. reporter: city council members are weighing a proposal to put some of the city's homeless on a cruise ship in the bay. it's one of a few unconventional ideas californians have been testing out as new numbers show the homeless problem is greater there than anywhere else in the country. they have an additional 21,000 more people on the street than last year. those numbers with other states, homelessness among veterans is down 2%. homelessness among families is down 5%. but the overall rate is up 2.7 percent. ther about an hour ago the president retweeted a parody homeless video saying crazy nancy pelosi should spend more time in her decaying city and less time on the impeachment hoax. according to the coalition for the homeless. new york city's homeless levels are the highest they have been since the great depression in the 1930s. neither pelosi or komo addressed the president's remarks today. mayor deglassio shot back at the president saying this from a guy who spent decades kicking families out of their homes. laura: jackie, thank you so much. president trump: 13 more highly qualified federal judges to interpret the law as written. bring in the total to 187 federal judges right now. one of the things that helped us so much is that president obama left us 142 judges. think of that. who would think that's possible. 142 federal judges. we want to have you have much president obama. eric: in addition to the two supreme court judges, one out of every four circuit court judges happens to be a trump nominee. 187 judicial appointments. that's more than president barack obama at 124 and george w. bush at 169 at this same point in their presidency. we just saw the president is very proud of this record. it's win's use on the campaign trail. how can this potentially help his campaign? >> i covered dozens of trump rallies. i watch most events he does at the white house. president trump almost never fails to raise this issue at his rallies and at the white house. this is an issue whether you are a supporter or not of the president. you have to hand it to him, and majority leader mitch mcconnell or getting these nominees through. in addition to the 1/4 number you mentioned, one out of every four court of appeals judges are trump nominees. he's got 20% of the federal judiciary overall. so it's pretty significant. another data point the white house likes to raise, these are younger judges. the average age of a federal appointee is 10 years younger than obama and bush. >> isn't that record one that's very important to the base and trump supporters? they say he tweets to too much,t look at the judges. that can carry him a long way. >> that's absolutely right. there are conservatives that raised issues with the moral questions, the president's tweeting. the judges is a big issue for that voting bloc with ro rowe coming up. and these journals are having a big impact. look no further than the fifth district case, this past week on obamacare. where a trump appointee judge joined a bush appointee judge to rule the individual mandate and obamacare unconstitutional. there is just a lot of issues like that coming fluid where these journals will have an impact. eric: here is the president on this. marco rubio said, impeachment is better for ratings. but what is going to matter more and longer? a partisan impeachment? or 187 judges including 1/4 of appellate courts. happy sunday. is this an issue that can receive sufficient traction on the other side? >> i thought it was interesting it came up in the last democratic debate. i believe it was amy klobuchar who raised it. appointing more democratic judges to roll back what president trump is doing. i think it will be an issue. we focused on the supreme court nominations increasingly we are focused on these lower court judges. just worth noting as part of the impact here, we are talk about three consider circuits that flipped from democratic appointed judges to a majority of republican appoint he judges. second in new york. a third in philadelphia, and the 11th based in atlanta. all of those circuits have big cases coming up on voting rights and obamacare and other issues. it's a big issue potentially for the 2020 race as well. >> here is what the "l.a. times" said about this issue. trump has parked the courts with right-wing ideologues. this raped rye shaping of the courts should concern all americans. particularly democrats. long after trump sleeves office the partisan judiciary will strike down democratic legislation. the courts can con train policy for decades to come. do they have a point? the republicans are saying the president is leaving a legacy, a constitutional legacy in the court system while his opponents can use it as a campaign issue. >> it's an interesting debate. you have got guys like john roberts, the chief justice on the supreme court who strenuously argued, it shouldn't matter. no party has a monopoly on the constitution. if they are applying the constitution as we all like them to do, it shouldn't matter in some ways. however, i don't think president trump has adescribed to that theory. and certainly he railed against the 9th circuit. the 9th circuit had a number of cases where it overturned the president on asylum and high-profile issues. the president always said we'll go to the supreme court where now republicans have a 5-4 split. however, it is the case that these decisions don't always come down partisan division. we had a few in the supreme court where that wasn't the case, including a redistricting case in virginia. it's not always the case that partisanship matters. eric: the "wall street journal" says the importance of this wave of judges is the courts are less likely to become a political refuge. liberals are right to perceive that constitutionalist judging could frustrate progressive designs. that's why some of the confirmations have become so ugly. will this take out activism they have seen and criticized in the last few years? >> maybe. that remains to be seen. i think what will continue are pretty rapid, pretty rapid confirmations. trump is on pace to continue with this. as one of your clips he talked about obama. he suggests obama left these folks behind. some of these judges are moving through sat lightning pace through the senate for confirmation. so this trend is certainly going to continue throughout the trump presidency. eric: we'll see what happens. good to see you, john. thank you. laura?
