meanwhile, denmark on high alert. after two terror attacks in copenhagen that looked like copy cat attacks to the ones in paris last month. mourners laying flowers outside a synagogue where a 37. two police officers were wounded. the attack came hours after a gunman opened fire outside a free speech event, killing a 55-year-old documentary film maker and injuring three police officers. this as we learner more about the suspect who was shot and killed by police. oh officials say he was on their are radar before the shooting. amy kellogg has the latest on the investigation from london. >> reporter: straight away before much information was released at all the danish prime minister was quick to say denmark was hit by terror. she went on to say this is not a battle between muslims and nonmuslims but rather a battle of ideas between freedom of the individual and a dark ideology. when the shooter was stopped by security at a cultural center in copenhagen hosting a seminar on freedom of expression he shot the building up from the outside. his presumed target was a swedish cartoonist who caricatured the prophet mohamed. he killed a danish documentary film paychecker. the killer went on hours late tor a synagogue. today the scene of many tributes. a 37-year-old man who spent years guarding copenhagen's synagogues was shot dead while he stood sentinel outside a bat mitzvah. police identified him as a 22-year-old born in denmark with a criminal record for gang-related activities. intelligence believe he may have been inspired possibly by isis and the attacks in paris last month. he opened fire on police as they called out to him when they spotted him returning to an address at 5:00 a.m. they shot back killing him. police conducted raids across the city looking for further information and contacts of the deceased gunman and the similarities between the terror attacks in paris and copenhagen are that jews those who make cartoons of the prophet mohamed and police were targeteded. >> that was amy kellogg from london. thanks. >> now to iraq where isis has been gaining ground. reportedly seizing a town a few miles from the military base where u.s. marines are currently stationed. >> hundreds of militants said to have captured alberto tomba baghdadi after weekend clashes with troops. the soldiers held isis off for a time but reportedly with drew as the terrorist closed in from two directions. the pentagon said this is the first territorial gain for isis in months. live in washington with more. doug? >> these territorial gains on top of the new video purportedly showing the beheading of 21 christians from egypt. it under scores why we are with seeing broad-based opposition. many congressional critics maintain the authorization the president is seeking is more restrictive than the one that imposes a three-year time limit. war authorizations after 9/11, another in october of 2002, even going back the gulf of tonkin resolution in 1964 were all open-ended. here's speaker john boehner. >> i have always believed we should give authority to the president to win the battles we theed to win. i don't believe the authorization the president asked for will give him the tools he needs to defeat isil. he says the threat is being diminished. well the fact that isil continues to gain new territory. >> u.s. intelligence agencies haven't yet confirmed that isis carried out the 21 beheadings in libya. according to the associated press, the makers of the video identify themselves as the tripoli province of the islamic state group whichle controls a third of syria and iraq. the video lends credence to boehner's fears of a spreading isis threat. even many congressional democrats believed the three-year time limit on the authorization telegraphs the white house's weakness to isis. >> i think the resolution for three years the time limit is not appropriate where we don't want to send a signal to the world that we are there for just so many years. unfortunately the battle will take a long time. some of the fundamental issues are not operational, tactical and military. they are political. >> others said the aumf empowers the military to seek powers beyond iraq and syria because it imposes no geographic boundaries on isis. the series of beheadings in libya suggest the u.s. and the coalition partners may have to take the fight elsewhere. back to you. >> doug, thanks so much. >> in the battle against isis former defense secretary leon panetta is delivering candid and critical views over the president's strategy. >> well, there is no question in my mind that mistakes were made here. presidents make mistakes. they also learn from those mistakes. the president has learned. it's going to take time. i'm hopeful about the effort this in iraq. ultimately, we'll have i think, a good chance at being able to push isis back out of iraq. >> how can we do that? win against the islamic state that's growing with each passing day. major general scaos retired from the army and a fox analyst joins us now. they burn the pilot alive. they behead western hostages. now a new mass murder of christians killed because of their faith. panetta talked about mistakes. is it too late for them to be corrected? >> it's not too late. every time we fail to en gauge against isis and isis continues to grow then the amount of effort and time the united states has to put into this effort continues to grow over time. they are adding about a thousand young men to their rolls every week. the afghanistan army is just not doing well in coalescing themselves and building morale they need and quality of training they need to take on isis. >> you mean the iraqi army. >> of course oh. >> they threw down arms, fled. isis captured the former equipment we gave to the iraqi army. how do we get their morale back to confront isis? >> i have talked to several people who were engaged in the training mission with the iraqi army. they tell memo ral is-- me that morale is low. corruption is rampant. secularism is a problem. the american advisers aren't fully engaged because of the laus and rules of engagement that keep them from completely partnering and getting involved in this war. there is a malaise, let ji, this sense of moral hopelessness among the iraqis. that doesn't portend well for the future if we are expecting them beginning in april or may to take the counter offensive and go after isis garcons and enclaves in places like mosul. >> the numbers are amazing. we have several thousand syrian rebels and others that won't be ready for six months. >> right. >> i have a list of the front line troops of arab neighbors. egypt, saudi arabia have more troops than england and france. if you have more than a million men surrounding isis why don't the arab countries take part of this? we have heard jordan rule out troops on the ground too. wouldn't that take those troops to go in and try to get the battle to them? >> first of all, egypt and saudi arabia have problems. alsisi is fighting against an isis affiliate in libya. the saw diswon't do anything. to their credit the jordanians are trying. jordan has the best army in the middle east -- arab army. but it isle small and the equipment is worn. this is isis that has the will to win. at the end of the day it's not about the numbers. it's about will. war ultimately is a test of oh will. confidence in your ability to win. right now i don't believe the iraqis have much confidence this their ability to win with. it's clear from what we have seen this week isis is on a role and they firmly believe they are winning. >> how do we roll that back? how does the coalition get the will to win and not isis? >> we have to engage more. the iraqis say you are pushing us out to mo sul. where are you going to be? the only answer we can give, well, we are behind giving you moral support. as many have said who wear a uniform or are retired, it takes a commitment by u.s. air power, engagement by special forces. the use of spotters well forward in this coming attack and perhaps even the further commitment of oh u.s. ground forces. when the assault on mosul comes ford to push the iraqis along and give them the backbone they need to retake the city. >> i certainly hope that happens. the president promised that isis will be defeateded dismantled and destroyed. we'll see if that does eventually come. major general bob scales good to see you. >> thank you. >> meanwhile the u.s. security council hold ing an emergency meeting on yemen which is on the verge of collapse after rebels overthrew the pro american government there. the associated press reports a draft resolution demands the rebels with draw from government institutions and engage in talks. the crisis in ukraine may be addressed during the meeting today. fighting between pro russian rebels and ukrainian forces continues in parts of the east despite the cease-fire that took effect roughly 16 hours ago. >> back here at home, we have another weather alert for you. the mayor of boston asking folks to stay home. another winter storm has been pounding new england this afternoon. the fourth one to hit in less than a month. the storms have dropped seven feet of snow in the past three week s. now coastal massachusetts bracing for wind chills as low as 24 below zero. >> repeat that? >> 24 below up if massachusetts. man, oh, man. the governor of mas mass, charlie baker tells everybody it's a good idea to hunker down and stay hem. >> continue to encourage everybody to stay off the roads and let the plows do their job. we continue to thank police officers, firefighter personnel and all of the folks driving plows and manning shovels. >> not staying home and not staying indoors. fox news correspondent rick leaven that will has been out there braving amazing elements in the snow in boston. hey, rick. >> i would like to follow the governor's advice and stay indoors. it's cold out here. beautiful pictures and kids in the snow, having fun out here. it's a difficult circumstance for most people in boston and the surrounding areas. they have been dealing with this for weeks now. more than seven feet of snow hassle fallen in the past three and a half weeks. they are setting records. you can see what it's doing to the roads. the sidewalk is clear but the streets are a mess. there is really nowhere to put snow anymore. it's just piling up in huge dunes alongside the roads. we have video to show how difficult and hazardous it is just to walk down the sidewalk with the winds blowing and snow coming down sideways and the temperatures cold, icy. good time for pets perhaps playing in the snow. not for the people. the airport was shut down. hundreds of flights grounded. mass transit at a stand still. no ferries, trains or buses today. the wind has been whipping with gusts to 60 miles per hour or more in areas. a blizzard warning is in effect through tomorrow morning because of the dangerous high winds t. mayor understands the conditions are wearing patience thin. >> i ask everyone to stay calm, cautious and focused on safety as we move forward. over the last couple of days this has been nearly a month worth of snow we are getting here. one weekend after another. >> reporter: there's been a major economic im pact. a lot of stores are closed, restaurants and businesses can't open because employees can't get in. if they do open there is not a lot of foot traffic because there aren't a lot of people out. it is difficult to get around. it's about to get colder. they are telling us wind chills, the feels like temperatures overnight between 25 and 35 below zero. and there are a coupler more storms forecast for later this week in the boston area. >> wow. no let-up. rick, thanks so much. get indoors, get warm. right in the heart of downtown boston with all the snow. thank you. >> a new deadline under obamacare looms, forcing people to scramble. what happens to those seeking coverage once it passes at the stroke of oh midnight. that's ahead. >> a showdown on capitol hill threatens funding for the department of oh homeland security. who is to blame if the money runs out? >> all i can ask -- >> chris, chris, one more time. the house has done its job under the constitution. it is time for the senate to do their job. and that's it. i prefer real food fruit, nuts, and whole grains. great grains cereal starts whole and stays whole. more processed flakes look nothing like natural grains. let's get real. ah! come on! let's hide in the attic. no. in the basement. why can't we just get in the running car? >> well, then senate democrats should be to blame, simple. >> you're prepared to let that happen? >> certainly. the house acted. we have done our job. >> house minority leader nancy pelosi issuing a statement and response saying with every house democrat now cosponsoring clean legislation to fund dhs it is clear that the votes are present to pass a bill. now if only speaker boehner without would get out of the way. let's bring in rebecca burg, political correspondent for the washington with examiner. good to see you. >> thanks for having me. >> let's start here. what do you make of speaker boehner saying the buck stops with the senate? >> it's an ominous sign. that may have been something that speaker boehner could say when democrats were in control of the senate before this last election. now that republicans are in control of both chambers of congress you say something like that, that senate democrats in the minority are trying to block this legislation from moving forward. it just doesn't sound credible to most americans. so it's probably a sign that the speaker is worried about getting the votes he needs and already trying to place blame on democrats for what might happen here. >> rebecca you describe thises is a nightmare scenario for republicans. why do you say that? >> well this is basically their worst fears come to pass. what many republicans feared when i spoke with them immediately before and following the election when they had the majority locked up, what they feared is they would get to congress, have the majority and not be able to actually act on these promises they made. not live up to the high expectations for them. they made big promises. they said they would get a lot done, that they would end the on oh instruction in congress. but if they shut down dhs and aren't able to get the must pass legislation through it looks like they are reneging on their promise a month after they took control of oh congress. >> is it safe to say that the dhs stalemate provides insight into a gop party divide. >> completely. the big problem this lays bare and it will be an enduring problem for republicans in congress is that they need democrats to come along with them on some of these must pass pieces of legislation. one of the big problems house republicans faced in the past was many of the conservatives in the conference don't necessarily want to go along with the piece s of legislation. so they need democrats to come across the aisle. with republicans in the majority, what many people feared and what looks to be coming to pass is that democrats aren't going to come and help republicans. they are just fine watching them flail and fail. so they are going to just wait and see how far they can push republicans essentially. >> let me pull up a sound bite now from white house chief of staff dennis mcdonagh. he was talking on face the nation this morning. listen. >> it's very important we not take the path that they are suggesting we do take which is congress continues to get paid. law enforcement officials associated with defending our borders, protecting us against cyber attacks, defending our airports and making sure airlines and aviation security is upheld are forced to work without pay. >> valid point. what do you say? >> it is a valid point. it gives us a peek at the message democrats will be taking in the coming weeks as republicans try to pass this legislation and either succeed or fail. you know, it's a message that resonates easier with americans. it is the department of homeland security. the department in charge of protecting us here at home. securing the borders preventing terror attacks. so that appeals to just the basest emotion within people. everyone wants to be safe. republicans, a big message for them has been protecting national security. if democrats are able to say with credibility that republicans aren't doing their job, they are not paying people who are protecting this country that could be a successful message for democrats. >> let's hope politics don't get in the way of something crucial. rebecca, thank you so much. >> thank you. >> midnight tonight happens to be the deadline for the 2015 obamacare coverage. for those who misseded the cut off they can't enroll this a plan this year and they will face penalties unless theyle qualify for an exemptions under the law. obama administration officials say the traffic to health care.gov is up as people try to meet the deadline. >> if you were hoping to one day get your amazon deliveries by drone that looks a little less likely today. the government releasing the long awaited plan for commercial drones. why they could be a blow to companieses hoping to use the devices for home deliveries. >> and the stand-off that could have a huge impact on the economy. why ships that bring clothes, electronics and more from asia aren't able to unload while our vegetables can't get there. what needs to happen before they get moving again . >> don't miss the fox news special. greta investigates vanished without a trace. a look into a teach er and former beauty queen from a barbecue in georgia in 2005. that is tonight on fox news channel at 9:00. >> she was supposed to come to her mother's that sunday morning and tara didn't. her mother and i were worried scared. i think we were hoping for the best. praying she was just tired prosecute are the night before. >> sunday night she was due at your mother's. >> mother started getting frantic when she didn't call back sunday night. can mean lower returns and fewer choices in retirement. know that proper allocation could help increase returns so you can enjoy that second home sooner. know the right financial planning can help you save for college and retirement. know where you stand with pnc total insight. a new investing and banking experience with personalized guidance and online tools. visit a branch, call or go online today. my name is michael. i'm 55 years old... and i have diabetic nerve pain. the pain was terrible. my feet hurt so bad. it felt like hot pins and needles... coming from the inside out of my skin. when i did go see the doctor and he prescribed lyrica. it helped me. it's known that... diabetes damages nerves. lyrica is fda-approved to treat diabetic nerve pain. lyrica is not for everyone. it may cause serious allergic reactions or suicidal thoughts or actions. tell your doctor right away if you have these, new or worsening depression, or unusual changes in mood or behavior. or swelling, trouble breathing rash, hives, blisters, changes in eyesight including blurry vision, muscle pain with fever tired feeling, or skin sores from diabetes. common side effects are dizziness, sleepiness, weight gain and swelling of hands, legs and feet. don't drink alcohol while taking lyrica. don't drive or use machinery until you know how lyrica affects you. those who have had a drug or alcohol problem may be more likely to misuse lyrica. having reduced pain... is great, and i'm grateful for it. ask your doctor about lyrica and visit lyrica.com to learn about our $25 co-pay offer your daughter has a brilliant idea for her science project. and you could make it happen. right? the government is issuing new rules for flying drones. the f.a.a. has regulations for commercial drone operators with the goal of making the skies safer for unmanned and passenger aircraft. there is already some push-back. brian yenis has details. >> hi. the f.a.a. new proposed rule prs the commercial use of drones are seen as a big step in lionelly lifting the unmanned aircraft industry into the air. companies are closer than ever to using drones in areas like aerial photography, mapping, crop monitoring and fertilizing to even inspecting bridges and cell phone towers. its estimated drone business could grow to $82 billion by 2025 and creator more than a hundred thousand u.s. jobs. under the new proposed rules commercial drones must weigh less than 55 pounds, fly below 500 feet in the air at less than 100 miles per hour. they can only fly during the daytime. operators are required to keep drones in their eyesight at all times. operators have to be at least years old and pass a test. drones won't be allowed to drop things from the air, fly over people and must stay five miles away from airports. >> although there are a tremendous number of operations which can happen in those areas and under those operating characteristics today -- pizza delivery, getting packages likely is not. >> that's right. the proposed rules are seen as too restrictive for companies like amazon which has been testing aerial drones to deliver packages in less than 30 minutes saying today the proposed rules would not allow amazon's drone service to operate in the united states. that's what the company says. in a statement, the f.a.a. says we have tried to be flexible many writing the rules. we want to maintain today's outstanding level of aviation safety without placing an undue regulatory burden on an emerging industry. on sunday less than three weeks after a drone crashed into the white house, president obama signed a presidential memorandum today prohibiting federal agencies from violating privacy and first amendment rights while using drones. experts say it is likely to be another two years more or less before final rules are made and commercial drones are finally allowed in our skies. thanks bryan. >> the ships aren't moving either. the white house trying to avert a shutdown at ports hit by a strike. the president is sending tom perez to meet with both side this is this ongoing contract dispute. the idle ships are piling up outside the ports already where operations have slowed. experts warn a prolonged shutdown will ripple through the economy, costing us billions of dollars. joining us now, senior business correspondent brenda butner. you have the ships dock workers aren't working. what happens if it stays this way? >> this is one expensive traffic jam. as you said there were some 30 ships yesterday morning just outside of l.a. and long beach which are two of the nation's busiest cargo hubs. stuff can't come in. the stuff that isn't coming in -- toys electronics clothing from china these ports comprised two-thirds of china's imports coming in. that could make prices go up. then the stuff going out a lot of the agricultural exports -- you have a ba if a that it will rot if you don't get it out. >> the lettuce is souring. the broccoli will go bad. sadly if you can't get it out it continues. in terms of what's coming in do you think we'll see shortages in stores. is that a possibility? >> the negotiations have been going on for months. a lot of stores stocked up on the shelves. you may not see that. but things that uh you may have order ed from china, it will take a while longerer.. who knows if it comes at all? >> how do you know it's from china? go on the internet and order it -- >> made in china. >> i know that, but it's all sorts of stuff. you have apple stuff and gizmos. >> absolutely. this could hurt the consumers. prices might go up. and the thing is this is in tandem with another shutdown at the oil refineries. this is a huge labor issue. we haven't seen this kind of union fighting since the early 1990s. >> you have the oil refineries in the south. on the west coast the ports are stuck. if this isn't resolved, what happens. >> one estimate says what's going on at the ports, what they bring in and take out accounts for 12.3% of gdp. that's all of our economy. that is huge. if this keeps going on -- i mean, that's why the white house is moving in. >> do they have a time period? they have to get it done in the next couple of weeks? >> let's hope they do. the last time it happened president bush had to step in. now we see president obama moving in as well hoping to broker a deal. >> all right. hope they get it done. thank you as always. catch brenda on "bulls & bears" saturday mornings at 10:00 a.m. eastern right here on the fox news channel. thanks. your label says made in new york, right? >> first and foremost, monster energy is a little bit of a bully and i say that as polity as i possibly can but there are a lot of trademark holders that are bullies. that being said i think they have a valid legal claim here. they have a mark that they protected over the years and they do have federal registrations. and the problem for the individual in this particular case is that they have to fight against a corporation that does plan to protect that mark. so while it mig necessarily be the very best case to be bringing as far as sort of the ethics of it, they do in fact have a legal claim. >> go back to you, josh, does ashley hanson have a case? >> oh, i think they absolutely have a case. again, they have been using the trademark since the 1930s. and what monster is basically claiming here is they're saying look our hansen trademark is a famous trademark. everybody knows about it. that's something they would have to establish in court and i don't think they -- i'm not even sure they could here. what they're trying to say is they have a famous trademark. therefore if somebody else wants to federally register their trademark they shouldn't be able to. there's over 50 other trademark registrations on the word hansen for various different products and services in the united states. so to say that monster energy owns the right on hansen i think is going too far. i think when it comes to ms. hansen and her business, they should be able to register their trademark federally and use it anywhere they want as long as they use hansen sno-bliz. if you and i walked up to that stand i don't think there would be any chance there's confusion with the monster product. at the end of the day that's what matters would consumers be confused. >> eric, what's the solution the resolution? >> one thing that's very important to understand is in the trademark world there are many, many opportunities for settlement, for agreement, for getting along. and for me personally in this type of case, i think you can effectively have both sides get their way. for me, i would personally say, look monster energy go to the plaintiff in this case and say, listen, we appreciate that you have this business for a long time but we have a million dollar trademark here, so we will allow you to continue to use your mark with a disclaimer or something along those lines. and to me that's the clear solution in my mind in this case. i don't know if the parties would agree on that. >> what kind of disclaimer? it's her last name? it's on her driver's license? >> i grew up in western pennsylvania and we had two types of potato chips. snyder's of berlin and snyder's of hanover. one of them always had a disclaimer. it sounds silly, but believe it or not that helps to solve the issue of consumer confusion. >> but those two stores you're talking about, they are in close proximity. listen monster's energy drinks have nothing to do with hansen's sno-bliz, period, that's my opinion. >> and i can appreciate that but i think unfortunately it is a different case. >> okay. >> i don't agree at all, eric. i think they certainly have a legal claim to get this registration. i don't think there's any doubt about it. >> so you're saying that ashley hansen and the hansen family they have a legal claim to get the trademark registration. is that what you said? >> absolutely. they have been using this since 1930. remember, they have been using this longer than the hansen brand has existed for beverages. so if anything else, they have priority here. and they should be able to get the federal registration, no question about it. >> i've got to end it there josh, eric, thanks to both of you. >> thank you. >> bye guys. full disclosure, i'm from new orleans, i love hansen's sno-bliz, just letting the record say i love it. >> i'd love to try that. it's like ray's pizzas. howard kurtz comes up next. when you've got somebody that's got your back. having chantix as a partner made it more successful. along with support, chantix (varenicline) is proven to help people quit smoking. chantix helped reduce my urge to smoke. some people had changes in behavior, thinking or mood hostility, agitation, depressed mood and suicidal thoughts or actions while taking or after stopping chantix. some people had seizures while taking chantix. if you have any of these stop chantix and call your doctor right away. tell your doctor about any history of mental health problems, which could get worse while taking chantix or history of seizures. don't take chantix if you've had a serious allergic or skin reaction to it. if you develop these stop chantix and see your doctor right away as some can be life-threatening. tell your doctor if you have a history of heart or blood vessel problems or develop new or worse symptoms. get medical help right away if you have symptoms of a heart attack or stroke. decrease alcohol use while taking chantix. use caution when driving or operating machinery. common side effects include nausea trouble sleeping and unusual dreams. chantix absolutely helped me quit smoking. ask your doctor if chantix is right for you. a. checking your credit score is for chumps. i have great credit. how do you know?
