eyebrows yesterday with the president's answer to this question. watch this. >> my desire to increase the u.s. manufacturing and jobs in america is not about china. i'm not concerned about china. >> martha: can that, we break in kayleigh mcenany , co host of "outnumbered" and marc thiessen is with us, fox news contributor and juan williams, senior political analyst for fox news. we start with kayleigh mcenany . great to have you with us. from the press perspective, one thing that got attention about this particular answer is the president had a card in his hand with a picture of the reporter and the question essentially, more or less, that she was going to ask and a list with all of the numbers. we've gone so far from this sort of open back and forth with the president. is this normal, to lay these questions out this way? >> not that level of detail. look, i had a reporter from a wire service and good reporter that was being diligent trying to get information for the american people every morning. he'd e-mail me. these are the topics i'm interested in. that's ordinary. it's unordinary to have the cards scripted out for the president. i was at upper press. they said sometimes we'd have to fight to find out who the correspondent was from a various networks. some networks were coy who they were sending to the briefing room. certainly never detailed questions. i can count on my hand the times somebody would have a policy question. a reporter denies this happen. she went to karine jean-pierre and said i'm interested. karine jean-pierre likely wrote out a sample question that tracked it. that's where maybe the confusion was. >> one of the question this brings up is should the president be just easier about being able to handle the back and forth? i think about president trump coming in and off marine one helicopter and looking into the crowd, you, you, you. there was no predetermined -- he had no problem doing that. does this indicate that this president does and that they're worried about him doing it? >> absolutely. there was a headline from those who talked to people on the biden campaign, they didn't get much press coverage of his announcement and they were happy about it. their whole strategy is to stay out of the press, to govern, to not get in this free-wheeling discourse with the press. whether they can do it? depends on the reporters. >> martha: marc, you look at the numbers. you see where the president ranks on these huge issues. he says in that answer -- i understand what he's getting at. sort of i'm interested in american manufacturing. i'm trying to bring that back. i'm not worried about china. why not phrase it that we're going to beat them at this. we're competing on this and we plan to win where this is concerned. what did you think about that answer? >> it is about china. that's why republicans supported the chips act. we won't normally support republicans 54 billion to support a domestic industry from the federal government from the taxpayers. it's because national security trumps free market economics. we have a situation where taiwan has 90% of the chips. if there's a war with china and taiwan that we might get involved in, it could cripple our economy. that's why we're throwing away our free market principals to support industrial policy to create a domestic chips industry. the idea we're not doing it because of china, that's exactly why we're doing it. it's the only reason why we're doing it. >> martha: juan, here's the nominee preference among democratic voters. the thing that caught people's attention, robert kennedy has 19%. 70% of voters say they don't want joe biden to run again. how concerning are these numbers to you? >> not at all. he got a 60% lead over robert f. kennedy jr. you have names there. i think at this point -- i think you'd be sensitive -- >> martha: a 40% lead. go ahead. >> yeah, but he has 60% of the vote, right? and they have -- robert f. kennedy is second with 19. i'm saying he has 60. that's a 40% difference. but i think you'll be sensitive to the idea that, you know, there's a lot of younger democrats, especially, that don't think that joe biden should be running. even with that, when you ask people, okay, so if he is the nominee will you vote for him, 80, 90% say yes, we'll vote for him. >> martha: it's sad that we're in a situation that people are saying 70% don't want joe biden to run. 60% don't want donald trump to run. on both sides, if he does run, if he's the nominee, i'm okay with it. i want to bring you back to kayleigh. this is karl rove. he believes that joe biden wants donald trump to be the nominee. watch this. >> the white house is counting on two things. that they will have a compliant media to echo their arguments and that the nominee will be donald trump. what if the republicans don't nominate donald trump but somebody that is forward look something we'll see if team biden made a good bet by thinking it's only going to be trump that they face in 2024. >> martha: what do you think about that, kayleigh? >> he's right. he's making a bet that trump will be his opponent. he's trying to slide governor ron desantis in the same image. that's why you saw a brief flash of ron desantis' face in his announcement video. this is where it's harder for trump to move voters. it will be up to him to introduce himself to the american voter. that's where positive optimistic vision must come in to deliver voters a choice rather than the dark maga language that biden used. >> martha: you think he will announce sooner than later? >> i believe it was about 30%. >> i'm a lawyer. i'm not a mathematician. you're talking about seven figures of error. >> that was congressman matt gaetz grilling the i.g. there about that number. so nearly 3.5 million searches, martha, of americans data that includes things like their phones and messaging. this hearing is john going. we'll have breaking news as we get it. >> martha: that's stunning. if you have a phone, you better just assume that the government can tap-in to it if they want to at this point. it's crazy. thanks very much, gillian. as we mentioned, reports breaking today that ron desantis is expected to jump in to the 2024 presidential frey and it may happen in mid may. here's the florida governor. he's in jerusalem and israel. he was asked about this today. watch his reaction. >> was that a resource to anonymous sources? surprise surprise. you know, it would be nice just to do one article where you're naming the people instead of doing the gossip. >> [question inaudible] >> i haven't seen it. if anyone is telling you that they know this or they know that, that is inaccurate. there's not been any decisions made. >> martha: he's under a lot of pressure. his supporters want him to get in. everybody is watching ron desantis in this race that is currently top lined by the former president, donald trump. so we'll see what happens. there's this whole disney saga, which is unfolding. the legal feud and now a suit by disney against governor desantis. jonathan turley says he's underwhelmed by disney's case. he's standing by. first to mark meredith who lays it out from washington. hi, mark. >> good afternoon. florida governor ron desantis says he's not ready to talk about any potential presidential campaigns. given the travel in the u.s. and abroad, all signs point to a campaign launching soon. he met with top israeli officials in jerusalem. this is being built as a global trade tour. he made stops in japan, south korea. it's the battle back in florida which is generating the headlines. on wednesday, disney sued desantis claiming he's using his political power to punish the company by revoking some of the authorities it has. now, this war of words dates back to over a year now after disney criticized desantis over an education policy which limits gender and sexual identity discussions in the classroom. today the governor brushed off the lawsuit. >> i don't think the suit has merit. it's political. they filed in tallahassee for a reason. they're trying to generate, you know, some district court decision. we're very confident on the law. >> it's unclear if the disney drama will impact primary voters. desantis is losing among republicans compared to earlier this year. normer president trump has seen his popularity rise. former south carolina governor nikki haley is teasing desantis over this. she told fox that disney could move to south carolina. this debate is going to keep raging on. martha? >> martha: thanks very much, mark. as promised, jonathan turley joining us. constitutional attorney, fox news contributor. jonathan, always good to have you with us. let's start with this quote from the walt disney parks and resorts versus governor ron desantis lawsuit. they say a targeted campaign of government retaliation orchestrated at every step by governor desantis as punishment for disney's protected speech. now threatens disney's business operations, jeopardizes its economic future in the region and violates its constitutional rights. what do you say to their argument there? >> well, i have to tell you, when i read this complaint, i was expecting more than what i found, which are really thin constitutional claims in my view. they're arguing that their speech rights have been denied, even though they continue to use free speech. but more importantly, they argue that this is a taking. what they're arguing is that what desantis is doing is akin to the government taking your house without paying for it. the problem with this sort of claim of victimization is that disney has a unique status here. no other company is allowed to regulate itself in environmental regulations, workplace regulations on developments. so what the state of florida did, not just desantis, was to even the playing field. what they're trying to do is get a court to say you can't do that. that's a pretty heavy load for a court. it will bring the court deeply in to the legislative process and say, you simply cannot declare that disney must supply with the same laws as other companies. >> martha: it seems like the two things could be separate. you know, the question of disney and whether or not they can be self-determinative as their own government in florida. a separate issue on the freedom of speech issue where disney says look, we're allowed to speak out and say we don't like what they call the don't say gay law, which is really more about teaching certain concepts to kids younger than third grade. why are they bundling everything together? >> this is sort of a hail mickey throw. they're trying to see if they can get a court to sort of end this in one case. they might. they went to a jurisdiction and thought they would get a favorable court. i think they'll have trouble even if they get a decision of sustaining this on appeal. it doesn't wash out. the problem that they're going to face over and over again is not whether desantis was retaliating, but whether the state of florida has a right to do this. the other problem they have in claiming to be a victim is that they have had control of this board. this was the ultimate self-dealing at the last minute. they had the board transfer its authorities to the company. that's not exactly being on the side of the angels. so they may have a trouble in court on that as well. >> just in terms of the conservative take on this, you hear other candidates, nikki haley saying, disney, move to south carolina. we're open arms. we would love to welcome this huge industry and this huge business. governor christie pushing back on his stance as well saying conservatives believe in staying out of the business of companies and letting them run their businesses and, you know, capitalism and free markets. >> yeah, i was surprised by those moves. every indication is that this is worked for desantis. it's the perfect mousetrap. he got the mouse to enter the trap, knowing it was a trap. he's been really quite popular with many people in florida over that. the sort of winning claim here for desantis in florida is that they're not applying a more rigorous standard to disney. they're applying the same standard. they're saying disney should now have to comply with the same laws and the same way that other corporations have to comply with. so it's going to be interesting how this plays out. i was surprised by those moves. >> martha: no doubt we'll hear about this on the debate stage moving forward. i mean, when you look at these polls that we just put up in mark meredith's reporting, president trump seems to be pulling ahead. you know what? i'm going to hop out. jacqui is asking her question. thanks, jonathan. see you soon. let's go to the white house. >> -- how that ended up there and why the president needed something like that. >> just to step back. i'm glad you asked that question. clearly i would let the reporter for los angeles times speak for herself. it is entirely normal for a president to be briefed on reporter whose will be asking questions at a press conference and issues that might ask about. it's not surprising that we would anticipate questions that he did receive on the visit with the south korean president as the south korean president was standing to his right or about 2024. that was completely expected or about the debt ceiling, which he took questions at the end. he shouted questions at the end. of course, we would note those issues to him likely come up. let's not forget, we do these briefings every day. a lot of the questions that you all tell me, that's how we brief him as well. you all ask me. that's how we brief him as well. look, we do not have specific questions in advance. that's not something that we do. in fact, i would point out the questions that were asked were different than what was on the card that you all saw. look, again, we have these press conferences. the president takes questions. we always -- our job is to get a sense of what you want to ask him. that's our job to get a sense of the news of the days, the topics you all are interested to ask of him. so that we are all -- not just him, we're all to take that seriously and in a way that will be reported from our point of view. we know you're reporting out to the american people and make sure you get our point of view of how we see these different issues that we laid out, whether it's 2024, what has been discussed or the agenda with the president of south korea. we take this seriously and we want to make sure we're providing information that is helpful to you and the american people. >> how are the reporters decided? >> so the way that we have moved forward with this type of process is that we reach out to a number of reporters who are going -- who we know will be at the press conference. that's what we did yesterday. also, we try to be really mindful and who has not gotten a question in awhile. so as you know, we can only pick two reporters yesterday. that limits our ability on how many reporters we can call on. mary is not here. i can say one of the reasons that we picked mary is because she was just named chief white house correspondent for abc and had not gotten a question in some time. we picked the los angeles times, which has not gotten a question in some time. i want to add that the fact that california has the largest korean american population in any state in the country and l.a. has the biggest population of any city in america. l.a.t. is the biggest daily paper serving that population. we're mindful on who we pick and who we want to communicate out to. that's how we move forward with mary ann courtney. we thought that is pretty reasonable, wanting to as we have the south korean president with us during this press conference. weless want to communicate with the korean american. that's how we move this process forward. >> is it your contention -- >> i'm not -- jacqui is not done. jacqui, your colleague -- your colleague is not done. >> it's a very reasonable question. >> no -- >> i hear you. can you wait your turn? >> absolutely. >> thanks, john. i do. >> just to be clear, the people, skeptics that saw the card and saw question number 1 and think that that was a signal that it was preorganized. did the president have other questions that he was prepared, had similar talking points in case he was asked something on other topics in that -- >> jacqui, as someone that is part of his -- of the prep briefing with the president for these press conferences, we take about an array of topics that could potentially come up. that's what we do. just at the end, there was shouted questions. he took the shouted questions. we also had a sense that haip, you know, you might get something on the debt ceiling, which makes a lot of sense. so we cover an array of topics. it's the two americans and two south korean reporters that asked questions. we do our best to make sure the president is ready to communicate with you and the american people. yeah, we covered an array of issues. probably the top three, top five items that you're interested in. that's how we move forward. >> the last one on that shouted question that he did respond to on the debt ceiling, having heard your response to the questions that were answered here today, you've had now democrats saying that republicans have come to the table. might not like what they came to the table with, but it's time for the dialogue. how long can this posture from the president last before it feels like intellectually dishonest to say they're holding the economy hostage and not raising the debt ceiling when they did pass a bill and the argument is about the budget cuts, the spending cuts and not about whether or not the debt ceiling gets raised? i think mara is one more athlete joining riley gains to say there is not right. we feel like we should be safe here. we've had success and worked so hard to get to and now it's being trampled on and our opportunities are being stolen away from us because biological men who most times are very mediocre athletes in their honey divisions and they're coming over and placing higher than they would have in the male division in the women's sport. it's not fair what is happening. it's not right. it's very uncomfortable. what makes it more uncomfortable as you saw as well as leah th thomas, oh, the women that don't support us are trans phobic, which couldn't be further from the case. but they have rights that they need to protect. >> martha: it's interesting. espn did a tribute for women's history month. you used to work there. part of their women's history month tribute focused on leah thomas and her accomplishments as a trans woman athlete. here's a little bit of a clip that they use. this is from an interview in 2022. watch this. >> people will say oh, she just transitioned, so she would have an advantage so she could win. i transitioned to be happy. happy and wants to compete aso a woman, charlie. >> the problem is there's so many incredible female athletes that should be celebrated that worked so hard. during woman's time, we're celebrating a biological man, leah thomas. it's not right. leah thomas calling women trans phobic. i feel like we've gotten to the point that if we're labelled as tran foe business for standing up for our rights -- i'm a former athlete myself. i can't imagine being in a situation that riley gaines found herself in, how i would have felt. it's gotten to the point where these words like trans phobic, it's why are we giving so makeup power to them? if standing up for women makes me trans phobic, it means nothing to me. >> martha: because it puts it in a box. this woman who is an athlete is against trans people, but it seems to me they're standing up for fairness. they're saying i want to be on a fair playing field. right? literally. what we're seeing is some reaction -- it's interesting. just reading about this marathoner. there's a lot of the marathoning where this individual would have to register as a male.ot allowe. you have to -- if you went through puberty as a male, that puts you in biological male category. the world athletics council is banning athletes in that situation as well. where is this going? which way is this move something. >> it depends. the story with gleniqe frank that just ran the new york city marathon this past november as a man, it's because their passport said they're a male. so they had no choice but to register as a male. because they are from britain, they didn't have to give their passport in order to enter. this is any man that feels like they don't see a chance competing against their fellow male counterpart athletes, that they're going to just join the women's division and say this is a place where i can thrive and have success. it's going to come at the cost of female athletes. >> martha: thanks, charly. i want to ask you one last question. where -- what is the solution?
