>> trey, you covered many of the major flaws with this prosecution. first, with the facts, what president trump did, if true, is just pay for a nondisclosure agreement. those are not illegal. they are standard practice and a lot of different industries. what bragg has do is rely on the testimony of a convicted federal felon, michael cohen, who is already prosecuted for this by u.s. attorney office, and tried to show using cohen's testimony that trump intentionally sought somehow to use the bookkeeping changes to defraud, not clear who? the american people, people of new york, that is a significant problem. the other factual problem is over charges, bragg does not explain what crime he claims was covered up by the bookkeeping changes. at the same time he claims 34 instances, but all of those 34 if you break them down is mic michael cohen said he was going to pay stormy daniel, he sent trump a bill, and the bookkeepers sense it and they sent a check. that another one, why didn't bragg just charge him 130,000 times for each dollar he sent allegedly to michael cohen. even if this gets to a courtroom, i don't believe it will, it might not be something that bragg can prove. trey: the likely way it would not ever get before a jury, if the judge says something to the law, my guess is that judge will not get involved in the facts but may say from a legal ststand point there are fatal deficiencies, look, people don't love lawyers and use the worth technicality a lot, but in this case, it is not a techtechnicality. i want h hopeful you know when the additional crime is. >> people do not like lawyers, you are right. what is going on, bragg might be violating president trump's 6 amendment rights that is the first major constructional problem. under the constitution every criminal defendant, big or small has a right to know what the charges are, not just repeating what the law says but describing how he or she violated that law. otherwise, you can't put on a defense. and how can you ever get double jeopardy rights? what prevents the government from prosecuting you again for the same change charges. >> then second suppose bragg says, as expressed in his press conference, trump violated the federal campaign law. by trying to keep this affair, if it happened secret, there is a huge constitutional problem there the supreme court reiterated, that state officers cannot prosecute federal law,only the federal government can, president and attorney general are charged by the constitution with enforcing federal law. supreme court has struck down efforts of states like arizona for example triening to force immigration law. i believe this could get to the supreme court and dismissed on law. trey: thank you so much for joining us. on easter sunday, look f for forward to your analysis. >> thank you. trey: there was a time when a mug shot might hurt you politically. not any more. no mug shot was taken of former president trump, his campaign raised money off of a fake mug shot. there was a time when being arrested and indicted and handcuffed might be a political liability. not any more. some members of congress want to be arrested. they want to be in handcuffs. at least one faked being in handcuffs during a protest. there was a time when payments to actresses and pornographic movies might hurt you politically when payments to playboy playmates might hurt you with self scribed e voter. not any more. in some circuits it worst to be -- what happened? joining me now a former rnc chair reince priebus. what do you thinks that changed in politics. >> happy easter, it is great to be on today great day for christians across the world. i think that our politics have become more divisive. there are few people in the middle. i think that division is very profitable in america. i think unity is a loser as far as financially that goes. and that say pretty -- that is a pretty sad case, in this particular matter, i think people realized that many folks in the law enforcement are political, trump has seen a 10 to 12 % jump in his polling. clearly when you look at the case of donald trump and this manhattan d.a. you have a party that in some ways can be very divided whether it people pro trump or never-trumpers, in this case, you have a party that is unified around the idea that what this manhattan d.a. has done is wrong. and there are very few even democrats that put together a coherent case to what the manhattan d.a. is doing as being right. when you have all of that unified behind you and people running against you, namely ron desantis. nikki haley and others all defending the former president, when they are out there trying to make the case there is room for someone else. then the result is a pretty unified party behind the president because people have seen that what this d.a. has done is very political. when the federal election commission took a pass, u.s. attorney took a pass, doj took a pass and all of the the reasons that people like and you others have laid out it is completely changed the way these things are viewed in america. trey: you are correct, i have laid out, i think on the facts, the law and t jurice prudence. legal stuff aside, i think there has been a shift what the e evangelical voters are looking for in a candidate, do you think there is a shift toward elect pillty over what used to -- elect pilability over what used to be values? (laughs) - [announcer] sorry fernando! our prices are staying low. so switch today and save! call or go online. jon: welcome to fox news live, i am jon scott, more protests are expected in nashville tomorrow after expulsion of two democratic tennessee makers. justin jones and justin pearson say it is a power grab by the republican controlled state house, and their white colleague who also participated in the protest of the not loaded out. republicans insist they were expelled for breaking house rules, they demand to be reappointed and re-elected to their seats. >> pope francis appearing to fight back after fighting bronchitis, he underred global community to end dialogue to end riding attentions, i am jon scott, back to "sunday night in america." trey: welcome back to "sunday night in america." sometime people don't support you because they don't know you. and sometimes it is because they don't know where you stand on the issues. sometimes voters know who you are. and where you stand. and they just disagree. the republican party does not do wheth with young voters, is it the message? the messenger? or just a disagreement on the issues? kayla mcgee white with washington examine and emma lembke the founder of log off, thank you for joining us. we should diagnose the issue, do you agree young voters do not typically vote republican. if that is true, why not? emma we start with you then kaylee. >> you know, trey, i think young voters are not specifically just tailored for the democratic party, i think it is a generation that is open minded. i have met conservative progressive moderate gen-z individuals, but democratic party is adapting their messaging to meet young voters with where they are and engaging in social media, they have to look at where they can engage to reach the young people. a 30 second television ad on a network television station will not reach a generation that it has been brought up on 3 second video reels on social media. trey: all right kaylee, emma raises a good point. she is noting that republicans are not great at the communication part. the venues mode of communication. that may very well be part of this. i think the republican party would be kidding itself if they did not also acknowledge there is a message problem. not just the manner of communication but maybe a message problem. what do you think? >> i think it is deeper, i think that it equ it comes down to a difference in cultural value. the best way is look at a "wall street journal" survey found values like patriotism, religion, hard work, community, family are all on the down. they are decreasing in importance ayou among the younger generations, i think there are two reasons, education system is one of them. then the culture is another one, young adults have been flooded with liberal values in education system and pop culture and entertainment industry. on social media as emma mentioned the values of religion and culture and things like, that conservatives prioritize those, they are no longer emphasized in the spacings where young adults of dominant. this is really a different in values, not even just so much as message as is finding a -- a way to to bridge the gap. trey: if there is a value or issue problem with republican party how best to move or persuade your generation, kayla then emma. >> i think that first and most important thing is to pick candidates who are going to appeal to not just young adults but all adults, november midterms of a great example of what happens what you don't choose good candidates, not loofno can not only can they not win elections but they are ppolarizing that driving the young voters away. candidates who are able to appeal to a large spectrum of voters across the political aisle and age gap. and finding the scan dates as key. trey: emma, what about you? >> you know, i agree, i think also gen-z has been brought up in a media environment that is participatory, we engage and self generate content spread to reach user and young activists and voters, you need to engage with them. as active constituents that you want to reach and engage with it needs to be a deeper level of discussion that needs to be intergenerational by focus. >> thank you for joining us on sunday night. >> thank you, happy easter. >> thank you. trey: meanwhile progressives had two wins this week in wisconsin supreme court moved left in chicago mayor's office moved left more. "wall street journal" calls wisconsin loss a 5 alarm warning to republicans. i wonder if they can hear that alarm going off. kim strassel is joining us now. i think you wrote about -- either you did or "wall street journal" wrote that the wisconsin voters were tough on criminals, they were tough on requiring people who can work to work. yet overwhelmingly voted for the most progressive candidate for the supreme court, i think i have that right. you correct me if i i am wrong. >> you have to correct. mixed message in some ways out of wisconsin, it delivers a clear message to republicans, which is, they voted to put a very progressive judge on a swing seat in wisconsin supreme court. she won by 10 points. she ran almost entire leo ted on the issue of abortion. she suggested if voters do not put her on the court there was a high likelihood a 1849 law in wisconsin banning abortion would stand unless the court struck is down with her vote. give than republicans in the legislator they run both chambers had done nothing on this, did not put out a position, voters were left to believe she was only thing to protect abortion. we know this state has not suddenly turned blue. they voted for a number of ballot initiatives that got tough or crime and the question of whether or not you need to work for welfare benefits. this just shows the power of abortion and need for republicans to get their ducks in a row before 2024 election. trey: you know, dobbs sent the issue back to the states there are people who thought it was the correct constitutional analysis. now back in the states, kansas, i would describe as a red state, i think that voters spoke overwhelmingly on issue of abortion no in cans kkansas. where are the voters on this issue, why is it this republican state lawmakers are having a hard time figuring that out? >> you know, put me in the camp of people who believe that that was the right correct legal decision to return it to the states. the republicans made the mistake of fist pumping that legal victory, not thinking flethrough the political consequences, this is not 1973 anmore when roe v. wade was passed. majority of americans are somewhere in the middle, they would like to see abortion legal with some type of restrictions. you get states that call for out and out bans or doing nothing in legislators and allowing the trigger laws to ping back, voters are clearly saying that is not what they want, voters are saying, look, land somewhere in a moderate common sense position. i think that is where republicans have to figure that out. trey: i can tell you, i know a lot of conservative voting women, i don't think a single one who thinks that rape or innocent victims should carry their preg npregnancy to term, i never met anyone but one lawmaker in south carolina that wants to seek death penalty for women who have an abortion. there is the middle ground and buyout there on the fringe, you will never win another national election, 5 alarm fire, you think that is -- i don't think about fires, but i guess that is big alarm. you think that is where the republican party is right now? joining us now is the lsu women's basketball coach, national champ again, kim mull key. -- mulkey. i knew you could do it. but i did did not see it done in two years, how did you do it? >> trey there is no way i could tell you that i saw this coming in two years. you know that. that is impossible to put a time table on anything that quickly. what i did know, i was coming back to a place that loved me, i was coming back to a institution that had s with final 4s in women's basketball. i knew if we could get it going in right direction we would be supported. but man did i -- there no way, i could not explain to you how this happened. we got in the transfer portal a little bit got great players, but two years. we're on top of the world. trey: coach there was so much noise still is after the iowa game about matters under related to rebounds and assists. i wish the world could listen in on your conservation with caitlyn clark after the game, that to me is beauty of competition, not the other stuff that others like to talk about. is it just -- f frustrating to you. >> i don't ever get it. when you what you do, you use the word accept or ignore, a don't may much attention. i have an interview yesterday with coach k, all we talked about was x's ando's on his podcast, you talk heart warming, i never talked with coach k, it was all about what took place in the game and asking me things from a player's perspective and a coach's perspective. this is the world we live in hits, clicks, negative stuff. i love that, this was highest rated final 4 and national championship game for women's basketball. i understand a lot of the outside stuff contributed to that. but i will always believe that talent on the floor was the most important contributor. i said to clark after the game, you are j generational type of player, you took your team, put it on your shoulders played for a national championship, i understand how it feels to lose a championship game. but don't forget, how good you are, and what you have done for that program. and i would say the same for the players i coach. they are reaping all kinds of benefits, they are very much independent young women that speak their mind but now, stop all the noise, concentrate on what is important and what is not important and it is my job to help them with that and to guide them and to lead them. trey: all right coach, i'll let you go by asking you, a happy note question. people ask me from time to time, where you get your jackets. my question, do they make them in men's sizes?
