few months. the do you surged 749. the s&p 500 was up 87. the nasdaq jumped 245. markets enjoyed their best week since june. the dow was up 5 points. the s&p gained 4 3/4. the nasdaq finished ahead 5 1/4. leading off tonight's mid-term spotlight, philadelphia's progressive district attorney talks about efforts to impeach him over the city's crime problem. that issue has been a key talking point in the hotly contested pennsylvania senate race. bryan llenas takes a look tonight from philadelphia. >> john fetterman wants to release convicted murderers from prison. >> public safety is why i ran for office. >> the pennsylvania senate race could come down to crime. according to philadelphia's district attorney, larry krasner, the current bipartisan effort to impeach him has nothing to do with his progressive policies and everything to do with republican efforts to elect dr. mehmet oz. >> they only want to look at pennsylvania. we're looking right now at philly. >> republicans say it haas everything to do with krasner. since he was elected d.a., the city's murder rate is up 70% while retail theft, armed robbery, property and violent crime all continue to surge. no wonder why dr. oz's campaign is reminding voters today that his opponent, john fetterman, endorsed krasner saying fetterman said he was excited about krasner's criminal reforms and call his new conviction integrity unit ground breaking. jameer larry was convicted of murdering a 45-year-old man in 2012. under krasner's regime, he was released after saying he was "likely innocent." tonight harris is accused of shooting charles gisset in the back of the head last month. >> this system right here proves that this doesn't work. this does not work. they need a program nor the victims of people like jameer harris. >> harris turned himself in today. as for his 2012 murder exoneration, the judge involved in that decision last year was very critical of larry krasner's office's handling of that case and as well on top of that, they were very skeptical of the investigation that led to harris' release. rich? >> bryan llenas live in philly. thanks, bryan. conservative groups are asking why federal prosecutors are going after anti-abortion protesters and ignoring pro life and pregnancy counselling center attacks. david spunt has more from the justice department. >> the supreme court overturned roe v. wade, fbi officials began seeing an increase in attacks specifically on pro life-related businesses. this includes pregnancy resource centers. broken glass and spray painted warnings covered these centers across the country. while the fbi has seen an increase in attacks, prosecutions are nonexist tent under a law called the face act passed in 1994, it punishes people that use or threaten to use force to injure, intimidate or interfere with anyone seeking either abortion services or pro life pregnancy counselling services. this year 26 people were indicted but none for attacks on pro life centers. over the summer, christopher wray told fox news the increase of pro life businesses is notable and concerns. >> there's a right way under our first amendment to express yourself. violence and destruction of property is not it. we have seen a number of attacks against faith-based organizations, pregnancy resource centers. >> the lack of prosecution has pro life organizations concerned with a message for attorney general merrick garland. >> i would say he should do his job and apply the law fairly and equally and look into these many dozens of attacks and see that, you know, groups are saying they're coordinated. >> rich, no comment from the department of justice on this story. we're told the department or the fbi, rather, across the street from doj is still investigating, rich. >> federal prosecutors did press charges on former trump adviser steve bannon for defying a congressional subpoena. his sentencing was today. could they use that same playbook with the former president? >> the house committee investigating january 6 actually lived up to its promise and formally subpoenaed the former president today. if he ignores that subpoena, we'll have to see if the department of justice would file charges in court as it did with steve bannon, the former presidential adviser. steve bannon was sentenced today to four months in federal prison for ignoring a doj subpoena and ignoring a congressional subpoena from last year. he doesn't have to serve that now while his appeal plays out in the lower courts, rich. >> david spunt from the justice department tonight. thank you, david. there's a report tonight that the documents seized from former president trump's florida estate contained classified secrets about iran and china. that's according to "the washington post." it writes "people familiar with the matter say the information could expose intelligence gathering methods." lindsey graham is asking the supreme court to step in after lower courts ordered him to testify to a georgia grand jury about efforts to overturn the 2020 election. graham contents his status as a senator gives him immunity. so far that argument has been rejected. in tonight's report on the border crisis, we have shocking pictures showing massive groups crossing overat night to smuggle migrants in the country with this woman's small child in the vehicle. bill melugin has the story from eagle pass, texas. >> exclusive images from the fox news thermal drone reveal a huge group of illegals entering into texas in the predawn morning. hundreds surrendering to the texas national guard amount scene that plays out every day. the migrants are single adult men from all around the world. the number of venezuelans crossing illegally has plummeted following a new dhs policy to expel them. as a result of that policy, the democrat-led city of el paso has announced it will no longer bus migrants to new york city or chicago. cite ago decrease in venezuelans crossing into their city. over the past several months, the federal government released more than 40,000 migrants in to el paso. that caused the city to spend millions of its own dollars to bus almost 14,000 migrants to other democrat-led cities. many of those migrants, venezuelans. >> the mayor stated he would no longer send buses to new york do to the decompression strategy. i think the team responded to this crises. >> the texas highway patrol. >> in the rio grande valley, a mother with her baby in the car was caught smuggling other immigrants. troopers popped the trunk and find another man crammed into a compartment underneath a stroller. the mom told the troopers that she was struggling them to san antonio. she was arrested and charged. >> as you can see from our live fox news drone, we have another small group of migrants crossing illegally in eagle pass as i speak. it's important to point out that we're 21 days in to the month of october and the federal government still has not released the border numbers for the month of september. those numbers are expected to show that we closed out fiscal year 2022 with 2.3 million migrant encounters, the highest numbers ever recorded. back to you. issues, extremely or very concerned about according to fox news polling. inflation and higher prices. well-outpacing everything, 89%. higher crime, 79%. political divisions, ukraine, school, abortions, border security. it seems that message for republicans is really breaking through and these polls are tightening. >> it does. our polling shows on the top issues about inflation, the economy, crime, voters give a double digit advantage in favor of republicans. they want to keep talking about those things. the president had to meet it head on. we saw him talking about this around warning people -- he used the words crash, republicans will crash the economy if you give them a chance in november. he know what's the top issues are. they're not good issues for democrats. the polling has showed us that voter a sign blame at the white house. they think the president and his policies are to blame. his speech trying to tackle that head on knowing it's at the top of voter concerns. >> over the summer, democrats had motivation. that has waned from now. they have gotten criticism, but focused too much on abortion and not the other issues. >> that will drive their base. they're trying to get to female voters. they think that will be a big help. i spiked over the summer. we saw the congressional ballot, the flip in their direction. abortion has ticked down on the list. it's out of the top five for voters. we'll see if that momentum lasts. >> these seem like good topics. what do you have? >> i have rich edson. so excited you'll join us. we'll have these topics and more. we have senator mike lee that is in an interesting more contention race than republicans had hoped they would have to defend. he's running against evan mcmullen. he's made serious charges. >> molly line, thank you. tonight in our spotlight races, we take a look at other big races involving gop's divorce candidates. this fall, republican air force veteran jennifer ruth greene is hoping to unseat the incumbent. the race is a toss-up. and the federal election commission shows james has a big cash advantage in michigan. this race is likely republican. and we may be in the final months of the nancy pelosi era as house speaker. if republicans gain control of the chamber, she will lose the gavel and may decide to retire as well. tonight congressional correspondent chad pergram looks at some of the big changes that could be in store for the next congress. >> it's an understate to say that nancy pelosi is coy about her political future. >> do you intend to be here in the new congress as the speaker, the minority leader? >> i'm strictly focused on winning the next election. do you want to talk about that? >> democrats are in the dark. >> i think people are looking for a cue from the speaker. she probably wants to get through this election. >> pelosi sticks to a singular montra. >> first we win, then we decide. >> pelosi hinted this would be her last term when democrats talk ant term limits for leaders. >> whether it passes or not, i will abide by those limits that are there. >> but nothing is locked in. >> she's a master of using words that will mean certain things to specific people in the room and then say hey, check the receipts. i didn't say that. >> kevin mccarthy is look toing become speaker if republicans win the house. >> will you be speakner january? >> well, you know, i hear a little desperation in the president's voice. what he's saying, yes, we democrats had a surge. yes, that surge seems to have disappeared. but there's still time for another one. hoping that things might change just again. the problem was the abortion surge ended, the late summer abortion surge ended because economic issued reasserted themselves. it was a terrible inflation report on september 13. we've had more after that. people realized it was not going to go away. the federal reserve was going to keep pushing and probably lead us closer toward a recession. and there's simply no good news on the horizon. the next 18 days that can help democrats. that's why i think you saw the president coming out today say if you elect republicans, they'll crash the commit. >> olivia, do the democrats have an impossible hand here? it's a mid-term. they have a tough economic picture on top of it. are they focusing on the right things here or are they just really playing an awful hand? >> democrats saw this sort of shift of the issues that they were focusing on. gun control and gun violence, they thought that would be big. they thought january 6 was going to be big. we see it shift away and to issues where voters have more support for republicans. there's a 10% advantage for republicans that think that republicans can handle the economy and inflation better than democrats can. that is a number 1 issue. so if there's a trust fall happen there, it's in republican's favor. >> rich: josh, we talked about how republicans -- democrats were focusing on the abortion issue. senator lindsey graham coming out with his 15-week abortion ban. perhaps the expense about talking about other issues how much has that hamstrung them? >> it's been an issue. they were very reactive on the economy. when gas prices went down, they thought they could take credit for that and that would hold them through november. clearly that's not been the case. it's not just gas prices but the price of other goods has gone up. inflation continues to be a top issue for voters. the other challenge is that the democratic candidates that are just talking about abortion, a lot of democrats have just thought abortion was the only issue that they needed to talk about because that's the only issue they had a big advantage on. a lot of voters care about the economy. the democrat that are not talking about the economy are finding themselves in a tough challenge. >> rich: byron, i want to focus on the pennsylvania race. it has all the national issues but this issue now with the democrat john fetterman suffering a stroke. that race has tightened substantially the last couple weeks. is that a product of what we're seeing nationwide or is it specific to his stroke issue? >> there's some specific issues. one, there is the question of his health. also the race is also tilted more towards some actual issues. dr. oz has gotten a lot of good response from an ad hitting fetterman on crime. obviously there's a debate next week, which will probably be certainly after the walker warnock debate the most watched senate debate this year. that will be a huge thing. you're right. dr. oz has been ticking upward, upward. latest poll show them tied. a lot of republicans were a little worried he could -- oz would climb, climb but maybe not quite get there. now it does appear he's almost there. >> olivier, you cover the hill. we were talking a little bit earlier about republicans only need a handful of seats to take control of the house. you saw chad pergram's piece. it's not a given this will be a seamless transition, that the republicans have their top leadership in place if they win control of the house. what does that look like? >> you're right. right now we're under the general assumption republicans believe that kevin mccarthy will be speaker. steve scalise will be the majority leader and then we get to the whip. that is interesting. you have three candidates with great resumes who are all competing after each other. let me tell you, it depends who you ask who has the lead. it's going to be very close. but then there's the conference chair race where you have elise stefanik and donalds. stefanik looks like she has a lead but has a challenger to her right. >> josh, back to the mid-terms. do democrats have any good stories that they can point to over the past week or so? >> the abortion story is one that got them a sugar high over the summer. that sugar high is fading. they need to have a good story on crime or at least a response to crime. because in many races including pennsylvania senate race, that is the biggest vulnerability. it's because many candidates, democrats nominated, are to the activist wing of the party when it comes to criminal justice reform. fetterman in pennsylvania, barnes in wisconsin. an oregon race where the democrat is in that spot. democrats can play defense effectively but they have to talk tougher on crime. they haven't had a story other than talking about funding the police. >> and they risk angering their base if they talk wrong about these issues. >> absolutely. we spent all 2020, much of 2021 hearing and alleged police abuses from democrats. even though many of them say i never supported defunding the police, many of them supported cutting funds for the police. maybe not zeroing it out but cutting funds for police, this is a record and republicans are hitting them over and over and over because they really did say that. >> rich: olivia, the president spoke about student loans today. how much do you think that moves the needle? >> it's beene democrats have do things to try to push for their agenda. there was the inflation reduction act, the child tax credits. doesn't look like it's moving voters. we'll see if this helps with the momentum heading into the final weeks. as of right now, the final pushes have not gained momentum. >> rich: it's friday night. let's go to the casino. place your bets. place your bets. we're looking at the mid-terms here. where are you allocating your $100 in very real money chips?
