families can't buy baby formula. >> bill: 40% of brands are out of stock nationwide. one republican lawmaker saying she is hearing from border agents who say their facilities have entire pallets of formula set aside for illegal immigrants crossing the border. >> these agents themselves have families and they have family members that can't get this baby formula in the stores. in texas and arizona, new mexico. the richest nation in the world and we're scrounging around for baby formula? >> the formula crisis is just one of many disasters facing biden's administration. americans scrounging for gasoline money as inflation is running at nearly a 40-year high. today the average price hitting yet another all time high, $4.43. >> bill: crime is another concern. the president will meet with police chiefs and mayors today to talk about it in cities across the country see a staggering rise in homicides. >> let's go to the white house where peter doocy is reporting live from the north lawn. what is the president doing to address the baby formula shortage? >> the president hosted representatives of two other formula companies, gerber and another. they did not have anybody from abbott on the line. representatives of the company that has the factory shut down in michigan and insists that things are safe but still have not resumed operations yet. the president also talked to the leaders of two big box stores. the white house is telling us about that. the conversation with the ceos of wal-mart and target focused how retailers are working to stock shelves. at the discussed state-specific disparities and the president asked what more his team can do to get more product to communities in need. it sounds straight forward. what is getting confusing is trying to figure out when this white house really started worrying about this. was it months ago like jen psaki says here? >> i'm sure there will be plenty of time to take a look if there are any issues that could have been improved. i don't have specific analysis at this moment in time. there has been work ongoing on this for months and how we increased the supply. >> or was it days ago like jen psaki says here? >> i'm not going to get into internal briefings. he has been made aware of it through the process and there have been steps. >> republicans are calling on the president to invoke the defense production act to use all the full might of the federal government to start making formula. so far white house officials aren't committing to that but saying all options are on the table. >> it's also jen psaki's last day at the white house as press secretary. what do we know about it? >> the end of an era after more than 220 briefings jen psaki is stepping down later on today and reflecting now on some questions she got along the way from yours truly. >> i think we have a very good professional relationship. and i understand that he is coming there to ask questions every day that are important to report on the outlet he works for. i respect that and we have healthy debates and discussions. >> she called on us every single time she went to the podium. that's something we hope continues when karine jean-pierre takes over monday. >> bill: thank you, peter. katie pavlich, go back to the baby formula issue. republicans are saying they warned the white house in february. it's almost june. >> yeah, i think there is a big government scandal brewing here. those reports that fda inspections of this abbott plant which provides the country with upwards of 40% of the country's baby formula shut down inspections during covid which delayed this inspection process until now. february was three months ago. the fda is taking a very slow time making sure this plant gets back online when the company itself says their baby formula is safe. they have a stake in producing safe baby formula. the timeline of how the white house was caught offguard is becoming very obvious. jen psaki yesterday said they've been working on this for months. if that's the case they've completely failed to prevent this crisis. but then the day before the incompress secretary said it was asked directly who was in charge of handling this crisis and she laughed out loud and said she would find out who was in charge. which one is it? there is also now the scandal brewing about pallet loads of baby formula going to border facilities. of course babies who are brought over the border through no fault of their own need to be fed. while american families are scrounging and being told at the store they can only buy a certain amount of baby formula for their children i think there are big questions how much product the federal government is buying, whether it's local stores in texas or they have some kind of contract and storing it at these facilities while americans can't find it in their stores at home. >> katie, it's the year 2022 and parents are struggling to feed their babies. that's where we are right now. i will channel dana perino and ask the question is there no one inside the white house who can get ahead of a crisis, a scandal, who can anticipate this? even before the abbott labs plant was shut down in february, there were supply chain problems and shortage problems. back then they could have alleviated the trade barriers and imported formula and alleviated the vast array of regulation on baby formula production here in the united states. >> yeah, yesterday the white house put out this fact sheet claiming they're going to allow wic to be used for baby formula. it is not clear if they are taking off regulations for importing baby formula because the fda does have very high standards. so we're in a crisis where the store shelves are bare and yet the administration is now coming around to releasing a fact sheet about what they plan to do about it. the issue is that the fda is taking too long to get this plant back up and running and the administration doesn't seem to get their timeline straight when it comes to who is working on it, what the name of the person was and how they will manage this going into the future. president biden has talked repeatedly about invoking the defense production act for the pandemic. why isn't he talking about it not just this week but previously to make sure that there wasn't a shortage in the first place given they knew this plant went offline in february as a result of an fda inspection and needing to shut it down to make sure the formula was safe to provide to the american people who need it? babies have to eat multiple times a day. this is something that they should have seen coming and now they are trying to make up for it and even now this plant is saying if they get back on board tomorrow, getting product to the shelves will take at least two weeks. >> bill: put it on the list. katie pavlich. we'll see what answers we get in time. >> julie: elon musk says his deal to buy twitter is on hold. it sent twitter stock tumbling. kelly o'grady has the details. >> the drama continues. friday 13th no less. elon musk sending shock waves the twitter deal on hold pending details supporting the calculation that spam fake accounts represent less than 5% of users. the company had confirmed less than 5% was but twitter stock is plummeting in pre-market trading as much as 11% on the news roughly $15 below the share purchase price, which is 30% below the value of elon's $44 billion deal. a couple of things to highlight. it is part of a routine evaluation once a hostile takeover deal is extended. there is a thorough review. up to this point musk hasn't been able to look under the hood. a couple things the billionaire could be managing. he is raising equity and investors will have a lot of questions about the metrics prompting musk to dig further. with the price plummeting it is clear he holds the power. if the deal falls through twitter may not recover. he could use it to renegotiate a lower price. musk says he is still committed to the acquisition and yesterday the company announced they are laying off some executives. one executive confirming he was let go because they want to take the team in a different direction. seems like the deal is on based on that. what elon's idea for the platform do are serious. managing pushback from fcc investigation and employee frustration. one group of people that definitely seem to be happy tesla shares are up in pre-market trading. >> thank you so much for that report, well done. >> bill: waking up to that this morning. a state smoking kit. many of these federally funded tools contain crack pipes. what is up with that? ukraine down here, you see the land border with russia. this is finland up here. this is 830 miles. you see sweden off to the west from finland. during the second world war the soviet union and finnish military fought a brutal war together and finland is pretty much decided to keep the peace between the west and russia by staying neutral. what do you think about the response from russia so far and where do you see it going? >> well, first off you are absolutely right. finland has been a neutral country since world war ii not by choice but by agreement with russia or the soviet union at the time. they held off the soviets during the war but limited their sovereignty by not joining any alliances in order to not be under further pressure from the soviet union. we see now russia's invasion of ukraine and brutality and war crimes we're seeing committed has con finishesed the finn and the swedes it is not safe to be neutral anymore. anything can happen. russia if they see you are not a member of nato they may well attack especially if there is any kind of nuclear, chemical, or biological deterrents of an attack. finland doesn't have that on its own. it is looking for the nato umbrella to make sure they're safe going into the future. from nato's perspective finland is a highly capable military and there won't be any issues about them joining. >> bill: the finnish head of state said you caused this. look in the mirror. he said, you russia caused this so look in the mirror. the first 48 hours on the war on the 24th of february. what putin did scared the daylights out of finland and sweden and poland and germany. >> exactly. >> bill: that's what bridged nato. it happened within two days i would argue. >> exactly. i think you are completely right and when we hear the russian ambassador of the u.n. talking about targeting sweden or finland they know they were targets anyway. you have had russian aircraft violating their airspace and waters and they know they're on the target list anyway. what they are worried about is their own defenses, which are good, may not be enough to deter russia given what they've seen in ukraine. >> bill: next topic. turkey has already objected to this. we'll see whether or not it changes on behalf of them. the u.k. has made a decision earlier today to sanction putin's ex wife and his girlfriend who apparently has reportedly two or three children of vladimir putin's living a high life in switzerland. she is very famous back in russia. but since london made this decision, what do you think the impact could be on that, mr. ambassador? >> i don't think putin is going to be swayed by any sanctions. he is operating on a different level here. he believes in his historic mission to reassembly the russian empire. money and sanctions on his girlfriend, i don't think any of those will drive him away from the path. what will affect his achievement of that objective of the russian empire is the military pushback he is getting in ukraine now with western help. he sees he doesn't have the military means and economically with the sanctions and energy shutoffs he won't soon have the economics, either. those are things that will change his position. >> bill: a lot to track on this today. former u.s. ambassador to nato. we'll speak again. >> thank you. >> nothing is built, nothing is back and nothing is better. >> dagen: senator john kennedy with that assessment of the biden administration. how might the president's record affect the mid-terms? have we hit a floor or are we ready to drop more, or how would you define where we are today? let's begin. >> when you say a year are you talking about the stock market? i don't know about the stock market. if you are deep in bitcoin i don't know if i can help you. on the economy as a whole, i think you've seen robust growth last year, slowing this year with the best part of the economy being the job market is red hot and the worst part being inflation that you have sectors where it is overheated and you add on top of that the continued supply chain disruptions from covid and the war in ukraine and it's going to be a difficult springtime for sure. >> bill: okay. don't know if i got an answer entirely, austan. give you another crack at it but steve, you go ahead, what do you think the condition of the u.s. economy is? what -- >> i think it's a very dangerous and present care yous time now for the economy. i love seeing a little green on the screen with the stock market. we saw a crash over the last week or so that has caused trillions of dollars of wealth losses. we got another lousy report yesterday on the gdp numbers. on the producer price numbers that showed more than 10% increase. i will make one other quick point, bill. we've been talking about inflation for the last number of months on the show. every time we come up and i say there is 8% inflation, people call me and email me and get angry and think the real inflation rate they're facing for food, for gasoline. food prices are up 25%, gas prices up 60%. airline tickets up 35%. people feel in terms of how it is impacting their own pocketbook that inflation is a lot worse than we're reporting. >> bill: austan ticked a lot of the head winds off. they're still out there for everyone to see and on the screen you see inflation out paces wages. your wages are cut now about about 3%. "new york post" headline says what biden can do to lower inflation but stubbornly refuses to is the title. the quote. biden continues to support a build back better ex -- he constrained oil coal and gas explorations with moratoriums for permitting regulations and economic reforms that discourage investment in fossil fuel companies. unless reversed, this will contribute to long-term energy inflation especially as we import less from russia. austan, what about that now? >> well, i'm a little confused. it has nothing to do with this current inflation and the energy information administration said we're going to set a record of u.s. production of oil this year. we're already on path to do so. i mean, it doesn't make anyone feel better. we're still dealing with these problems, to realize that they are definitely worldwide problems. you have inflation setting the highest levels in more than 40 years in germany, u.k. and eurozone and the producer price index is up even more than it was in the united states in asia and in europe. so we are dealing with worldwide commodity and supply disruption. that said, you can see where people are upset. they are paying more at the pump. they are paying more in the grocery store, and their wages are not rising commensurate with how much prices are going up. so of course they will be irritated and annoyed at that. >> bill: steve, maybe i could have phrased the question better. what do you think joe biden could be doing now to help improve a lot of the things you're discussing here today? >> right. i think what austan is missing in his is the massive spending spree we saw in the first months of biden. over $3 trillion of new spending. biden is still talking about a $1.5 trillion student loan bail-out and 35 billion more for ukraine. in a speech the other day, bill, that he gave to fight inflation he talked about more spending, more green energy subsidies. i don't understand how austan can say this president, who basically said he wants to destroy the oil and gas industry and take us down to zero oil and gas in the next 15 years, is somehow now a big promoter of energy. i think if we were -- trump still was president we would be 15 million barrels a day of production. right now we're at 11 million. that's a huge gap and until we -- to answer your question, bill, you've got to get the spending down. this massive spending spree has got to stop in washington >> bill: thanks to both of you. we'll see which way to go. nice to see green arrows. austan, thanks, thanks for being here. >> dagen: fox news alert. the stock market opened about six minutes ago. we have green across the board. the dow in the first minutes of trading up 214 points. however, the dow has lost almost 1170 points this week on track for its seventh losing week and that would make it the longest losing streak in 21 years. percentage terms the s&p 500 and nasdaq composite have lost 6% plus loss on the nasdaq this week so far. meantime the story everybody is talking about, the collapse of crypto. $200 billion in assets wiped out in just 24 hours. that was through yesterday morning. but you asked me and i have answers. bill hemmer, how big is the cryptomarket? >> bill: i don't know. >> dagen: you asked me and it is about $2 trillion with these losses -- under $2 trillion. the u.s. stock market cap at the end of march was $48 trillion. so it is a pretty small market. ask me anything about the cryptomarket. >> bill: we were talking about 6:00 this morning, right? it's fallen through the floor. >> dagen: right. >> bill: but so far today it looks like it may have found the floor and there was a big investment that came in. you can trade stocks all day long on that. he came in with a big buy today which would appear to give a bit of confidence in the cryptoworld. >> dagen: you need confidence and faith. this is a crisis of confidence and people lost faith. there is a stable coin supposed to act like a money market fund and it collapsed. and its sister token lost literally all of its money. so if it's supposed to act like a money market fund, what happened? >> really accountability. this all started jeremy and i advocating separately. we came to meet at a school board meeting but advocating for our students and advocating for parental rights as we saw a ratcheting up of kind of an oppression of some free speech and limiting what we could say and then it was limiting the number of people in the boardroom and really what we are looking for is accountability so that this does not happen again to other parents and other community members that speak at board meetings. >> dagen: even though they were two separate incidents at the school board meeting, you both were arrested in september of last year on a misdemeanor charge for disorderly conduct. what was the response from all the parents in and around round rock where this happened? >> i would say it's hard to say that anything is monolithic. we have had tremendous support from the community. when we were put in jail there was an overnight prayer vigil outside the jail. everywhere we go people tell us they are supportive. essentially our rights were violated. in my case i was speaking during my lawfully allotted time. i was speaking normally and peacefully. because i actually spoke against the superintendent and the board president who were concealing illegal behavior and they did not want to hear it they actually then commanded police in the middle of my speech, which i wasn't yelling or cussing or anything, to come from behind me, grab me by the arms and yank me out of the room which is the part you just saw. just the basic right of redress to your government was violated. >> dagen: dustin, have you heard from the school board members in the district? what has been their response to what happened to you two gentlemen but now this lawsuit? >> we have not had a response. i'm not 100% certain the school district has been served at this point. the lawsuit has been filed. i did see an article where the district communications director did respond that they had not been filed yet and didn't have comments. we have not heard what the school board thinks of this lawsuit or the superintendent or the district at all. >> dagen: jeremy, what's next for this lawsuit? where do you go from here? >> absolutely. we're wanting to -- this is not ultimately about just us. although it happened to us, we see us speaking up for students throughout the district, for teachers throughout the district, for parents and ultimately we realize we're speaking for parents across the country. we simply were addressing our school board and a very serious situation in our district involving allegations of assault against our superintendent -- not against him but where he assaulted someone else, allegations and yofsh *b cover-ups by our board. the lawsuit can be accessed arise for students.com and see the entirety of it. really, we see the need to stand for students' and parents' rights. we believe you should be able to speak to your school board without threat of being imprisoned. it is amazing that it happened in our country. >> dagen: has any other parent been arrested? you were at a different meeting but have any other parents been arrested by this school board since it happened to you? >> no, no, not since it happened to us. and what's interesting is that, you know, in minor jeremy's cases and we spoke in separate months. he was august, mine was september and three days after the september meeting we were arrested at the same time. what's interesting is that what jeremy and i, what we had been accused of for the arrest, many other community members spoke at different times off topic or when they weren't supposed to and were somewhat disruptive. we were treated much differently and we firmly raising with the superintendent and some of the school board members. >> dagen: jeremy and dustin, thank you. >> bill: so now a new report finding nearly 2/3 of americans are living paycheck to paycheck. how do you right it right in this economy? crime. inflation and rising prices have so many struggling to make ends meet. a new report finds 64% of americans are living paycheck to paycheck. let's bring in ken coleman, host of the ken coleman show. the danger is, i think it was in march, credit card borrowing ran up at a record pace. it is so dangerous. >> very dangerous. people are digging the hole deeper. when times are tight and when money gets really, really squeezed in our lives we the end to look at i'm not making enough money. but i think the relish yu most of the time and we've learned it from ramsey solutions in years of but if you look at the average weekly earnings they're down even more. down 3.4% because the work week is shorter. so is that one of the potential solutions to coping with inflation is just trying to work more hours? >> well certainly if you have to, if you have an emergency situation, you think about this. if you work an extra 5, 10, 15 hours a week for a short season. you pay off one credit card and it saves you $300 a month. that's a quick example how a short-term buckle down, get after it and then you can return back to normal hours. but it is also a function of saying again once i've got my money under control and i have a budget and i know what's going on, we're sitting in the best job economy in the history of the united states. we're hurtling towards 40 million people have changed jobs since august of 2021. they are getting paid more. there is opportunity to get out of this financial mess and create margin by cutting expenses and making more money. >> dagen: real quick, ken, that's the kind of optimism i'm used to from dave ramsey and company. quick some ideas on how to deal with inflation, real quick. >> first, let's get a zero-based budget and pay off debt. when we pay off some debt we will bring in more money to our budget and we start to see margin in the paycheck to paycheck style of living. we have six figure earners doing this. we have to cut our expenses. need to know. meantime the showdown over title 42 could be coming to a head. a federal judge hearing arguments today whether the biden administration can lift the trump era pandemic border policy. arizona's attorney general warning that ending those restrictions will simply open the floodgates to even more migrants. >> if title 42 is lifted, it is estimated the biden administration's own estimate 18,000 people a day will be entering our country illegally and that's like the equivalent of a basketball arena every day coming over. it is overwhelming our social services. it is overwhelming our border communities. >> bill: bill melugin back at his post in eagle pass, texas. more on news and headlines. not good. good morning. >> good morning to you. that's exactly right. not good. we're hearing from multiple sources that four migrants are presumed to have drowned after they went into the river in eagle pass last night and never resurfaced. that includes a 3-year-old nicaraguaian boy. we'll show you where it happened. right underneath the international bridge right here in eagle pass. the exact same area where fox news cameras witnessed a man drowning and where two children drowned last week. close to the same area where texas national guard soldier evans drowned as well. just in april in eagle pass more than two dozen drownings. we also want to show you this video. we shot this about an hour ago here in eagle pass. you are looking at a group of suspected smugglers leading a group of migrants across the river to cross illegally here into eagle pass. rare to see these smugglers working in the river like this. one of them took a life jacket back from one of the women and all a smugglers walk back into mexico presumably to pick up another group of migrants to bring them across later. it is happening in front of texas national guard and border patrol. they can't do anything until the smugglers come to the u.s. border patrol reporting in just a seven-hour span they arrested these two convicted child sex predators, mexican nationals. one with a conviction for aggravated sexual abuse of a child in austin in 2016 and one for felony assault of a child in arkansas in 2016. both men previously deported and tried coming back. thankfully border agents able to catch them. look at the video we shot here yesterday. a large group of 150 migrants crossing at one time. we'll explain what's happening in louisiana. a federal court hearing today on title 42. the fate of title 42 could be decided later this morning. federal judge may decide whether or not he wants to implement a preliminary injunction blocking the biden administration from dropping title 42 on may 23 as currently planned. the hearing set to start in an hour. fox news will be in the courtroom. there are migrants waiting across from yuma, arizona waiting for title 42 to drop. some of them have been expelled via title 42. listen. >> they told me they can't take asylum cases now due to title 42. until that title is lifted is when they will be able to grant us asylum again. >> we got up the wall using a ladder. when it came time to come down border patrol was telling me to hurry up and come down. because i listened to him, i fell. >> there has been a lot of talk about stocks of baby formula that border patrol has in their facilities for migrant infants and migrant babies. cbp is now responding to the criticism about that while american families are having trouble finding baby formula. they are telling fox news essentially they have a legal responsibility to insure the safety of migrants in their custody including feeding migrant babies and migrant infants. they say they have to do this as part of a humane process down here at the border. when it comes to purchasing baby formula, they say they comply with all regulations when it comes to those purchases. we'll send it back to you. >> bill: the next story, bill melugin, eagle pass, texas. >> dagen: no end in sight for the baby formula shortage. retailers say it will take months before parents should see shelves fully stocked again. abbott labs, one of the nation's top producers of baby formula, who had to shut down that plant in michigan, resorting to flying in formula from ireland as they wait on the fda's approval to restart production at that plant. dr. marc siegel on the fda's slow, slow, slow response. fox business east grady trimble is live outside the abbott labs plant in sturgis, michigan. grady. >> still no word from abbott or the fda on when this plant could reopen. the biden administration says it is trying to get more formula on shelves in the meantime. president biden spoke with ceos of major retailers as well as formula makers gerber and others about how to do that. the administration says it is cutting red tape and encouraging manufacturers to simplify formula varieties to boost production. also increasing formula imports from other countries and cracking down on price gouging. the white house says it hasn't decided yet on whether to use the defense production act. >> we know that with one major supplier having part of their supply off the marketplace, one of the easiest and fastest ways to address that is increase supply from some of the other suppliers and to import more, which is a step are we're working to take as well. >> house democrats announced today they are launching an investigation into the four largest manufacturers of formula in the united states. republicans on the other hand are placing the blame squarely on the fda and the president. >> they are facing a crisis that is threatening the very lives of their newborn children. joe biden simply has no plan. >> the white house says it has been on top of this shortage for months. in fact, it points out that the formula companies have made more formula in the past months compared to before this plant shut down but when we asked -- when reporters asked whether and when parents would see that formula on store shelves, dagen, we didn't get an answer. >> dagen: that means that the parents don't have an answer, either. thank you so much for that. >> bill: let's bring in fox news medical contributor marc siegel. nice to see you. how did we get here? >> this has been long in the making. we're acting like it occurred since february when abbott problems occurred. it occurred at the beginning of the pandemic in 2020 because parents began hoarding formula, they started hoarding it because they were afraid the supply lines they wouldn't be able toto the stores. the government has lacked -- as they are busy with their stockpiles of masks they gave out 400 million n-95 masks in january, no stockpiles which is what we need for infant formula. it is not just the fda. they overregulate the area, 486 violations to abbott's plant. we aren't sure the two infants who died were actually due to a problem at the plant. we don't even know that. they haven't reopened it. just one thing we're covering. but what about the usda. they are involved in over 65% of the formula in the united states. they are the ones who should be stockpiling this. what about europe? plenty of formula in europe. we aren't allowed to bring it in because of labeling issues. that's also wrong. they have to take a broad brush and bring in more formula immediately before we lose infants. >> dagen: 98% of the formula that is sold here is made in the united states. we don't use a lot of imports. they are great regulations from the fda on new formula producers. that's why it is a duopoly between abbott labs and another one. the new entrants can't get approval from the fda to make formula. >> gerber is not there for contingencies. we need a national stockpile of formula. it shouldn't be only the three bigies. the hyper regulation shuts everything down. first you can't water it down. you end up with a starving infant. you can't make it yourself. very dangerous. you can't tell women extend your breast feeding. women are -- 85% of women are breast feeding already but 70% of infants need some formula in the first six months of life. >> bill: target, cvs, walgreens limiting formula purchases as of now. >> which is dangerous. >> bill: missouri is out of it and one of a half dozen states suffering a shortage. >> no press conferences, get the usda and fda to get formula. >> they went to the white house in february rear saying it was a problem. we're three months down the line now. could we have figured this out in the last 90 days? >> absolutely. we're hype ventilating on masks and mandates and focus on the virus, which is important but not enough focus on something like this that is hugely important. masking infants in new york city but no formula. >> dagen: they're trying to make sure that every customer can at least get their hands on some formula. >> that's a fair point and i'm glad you made that point. i'm okay with that. the problem is panic buying and going on tremendously now. one family gets all the similac in the store and another family gets none. cvs has no choice. >> dagen: one more quick thing. abbott said after a thorough review there is no evidence to link our product to the infant deaths. they found no genetic link between the bacteria in the plant and the bacteria that infected these children. why is the plant still closed? >> agree. they cited 487 violations. they've been going over and over it. reopen now, now. even if they reopen now it will be months before they get the formula back on the shelves. >> dagen: they make special formula in that plant. >> bill: we'll be talking about this next week and the week after. >> and the next month. it's too slow. reopen abbott. important point about special formulas. prescription. >> bill: what appears to be a legal victory for special counsel john durham. the judge ordering the firm that worked on the steele dossier to cough up nearly two dozen emails related to michael sussman. more from the department of justice as we await a trial on monday. good morning. >> just a few days away from trial. important caveat. the emails may be interesting to john durham won't be admissible in court. the jury won't know anything about them. however they're now in special counsel john durham's position and may use them for a future case. he began his investigation, bill, exactly three years ago may 2019. michael sussman, a former clinton campaign attorney is charged with one count of making a false statement to the f.b.i. sussman two months before the 2016 election went to the f.b.i., said he had information that linked the trump campaign to russia and claimed he had information that a computer server in trump tower in manhattan was communicating with a russian bank. that information turned out to be false. according to the government sussman told the f.b.i. general counsel james baker he wanted to bring the information not on behalf of the clinton campaign or a client but as a concerned citizen. durham claims sussman was working for clinton and billed them. the opposition firm hired to dig up dirt on donald trump must turn over the 22 emails to durham. what they say we don't know. the judge ruled that durham can't show them to the jury but he may use them in the future. the jury will look at whether sussman lied and whether his information was relevant how f.b.i. handled their investigation's. susman's team will say if he did lie will it change the investigation. it's about dirty tricks in washington opposition research happens in the city all the time. the question is what michael sussman did illegal is for the jury to find out. this trial expected to take about two weeks. >> bill: good setup there, thank you. dagen, "wall street journal" writes this today. headline john durham goes to court. a line from that piece. the narrow prosecution of the little known mr. sussman has allowed for a focus on the bigger story. stay tuned for a flood of more information coming out of the trial that on its face is about one lawyer but the reality the continuing tale of one of the dirtiest tricks in modern u.s. history. the story happened in january of 2017. it is may of 2022. i don't know what the trial will show but we'll wait and see whether or not it leads somewhere. >> dagen: i'm a vor arabous consumer of everything kim the governor's mansion. here to talk about it is chicago alderman raymond lopez. good to see you. this will only get worse as we move into the summer and i believe only minimal arrests were made. is that because there are not enough police officers in chicago at this point? >> we have seen, dagen, that the amount of officers leaving the chicago police department has grown exponentially over the last three hours throughout mayor lightfoot's tenure. we've lost almost 2,000 officers. last year we had 900 officers who left and only replaced by 51 recruits. we do not have the manpower to compete with these out of control events and the mass shootings and massacres that have gone on daily this week alone. every other day there has been a new mass shooting in the city of chicago. our officers are leaving because they don't feel they're supported. they know they aren't respected by this mayor and they are looking for opportunities elsewhere. that will only serve to hurt communities that are struggling to keep the civilization known as chicago together despite lori light foot's best effort to defund the chicago police department through attrition. >> dagen: a 43% spike in police officers who were shot on duty so far in 2022. what can be done? again, these police officers in many cases, this is not blaming them, they will not get in the way and not intervene and try to arrest an individual or individuals if they know that when arrested, that individual is right back on the street and is not prosecuted. >> right. in the city of chicago we've seen the complete flipping of what has come to be expected in society where the police now are the bad guys and the criminals are being put up on pedestals as the good guys. we have to reverse that trend. it starts with a change at the top. lori lightfoot has done everything in her power to continuously put the policemen on the wrong side of things even when they're doing their job as we've trained them do to. our officers are very much afraid to do their job because they aren't supported by the mayor or superintendent and that public opinion will always be twisted against them for doing what we need them to do, to maintain law and order and safety in our neighborhoods. what we saw this weekend, what we saw this week has been horrific and it is not even summer yet. we have only had three 90 degrees days and three mass shootings and two major events where hundreds of youth have destroyed property and created mass chaos for the simple fact of getting social media hits. we must grab the reins of this city again, pull back and focus on the basics of safety in our neighborhoods, which means holding people accountable, forcing curfew and parents held accountable for the mischief their children are doing on the
