And trump posted this video on instagram showing the incredible hypocrisy displayed by sanders who spent months and months bashing hillary. I dont think you are qualified. I do not know any progressive who has a super pac and takes 15 million from wall street. I dont think you are qualified if youve supported virtually every disastrous trade agreement which has cost us millions of decentpaying jobs. [cheers and applause] i do question her judgment. I question a judgment which voted for the war in iraq. Lou so trumps appeal for sanders voters is suddenly a lot more attractive and credible. Trump tweeted this as well to all the bernie voters who want to stop bad trade deals and global special interests, we welcome you with open arms. People first. Trump tonight will be holding a rally in westfield, indiana. At his side will be one of his potential picks for Vice President , indiana governor mike pence. And trade will be high on their list of topics. We take it all up with some of our favorite politicos tonight. Cohost of the five, Kimberly Guilfoyle, and trumps Senior Adviser Kelly Ann Conway. Theres a lot to talk about including trump now calling for an apology from Justice Ruth Bader ginsburg after the Supreme Court justice did what until now had been unthinkable, interjecting herself into a president ial campaign, expressing her preference for Hillary Clinton in interviews with the New York Times and associated press. Ginsburg, who was appointed to the high court by bill clinton, said, quote i cant imagine what this place would be, i cant imagine what the country would be with donald trump as our president. Of course, ginsburg appointed to the high court, as i said, by president clinton. Trump now calling the unprecedented political comments from a sitting justice of the Supreme Court an outright disgrace. Our top story tonight, attorney general Loretta Lynch today refuse to answer the simplest, basic legal questions about the Hillary Clinton email scandal. Lynch told the House Judiciary Committee that she ceded her final decision, the final decision to the fbi this in part to dispel any concern about her meeting with former president bill clinton. But republicans, including our first guest tonight, challenged her statement and her move saying the buck stops with her, not the fbi. When you have a conversation with the former president , the husband of subject of an ongoing investigation, and you have that conversation before theyve interviewed the subject and before theyve reached their recommendations and finished their investigation, thats what triggered you to do this thing youve never done before which is announce i dont care what they recommend, im going to follow it. My concern was that, yeah, the conversation that i had with president clinton would be seen by some as having an influence over that. I felt it was important to clarify not some, ms. Lynch, a lot of people. I think your actions made it worse. I really do. Lou congressman jim jordan joins us tonight. In addition to sit oggen the jewish dish sitting on the judiciary committee, hes the chairman of the freedom caucus. Great to have you with us. Quite an exchange, and i know that the Exchange Went well beyond what we just shared with the audience. But youve said, basically, that she just contributed to the belief, and the presumptive nominee says over and over again the system is rigged. Yeah. , no exactly. So Many Americans feel like theres two systems, one for we, the people, and an entirely different one for the politically connected, like the clinton family. Shes never done it before. She announced ahead of time that shes going to follow the fbis recommendations before she knows what those recommendations are going to be. And yet still claims somehow it was her final decision and that shes in charge. And its sort of like you cant have it both ways. Why would you announce that . Why would you say im going to follow whatever they tell me to do even though you dont know what theyre going to recommend the . Only because case, you treated it different. You treated it different because of who she was and what shes done and what office shes running for. And the American People understand that. And so you had that factor, plus the fact she wouldnt answer some basic, factual questions about the case from so many of my colleagues. It was kind of a frustrating day, i think, for a lot of people and certainly for the American People who follow this whole affair. Lou yeah are. And i think were seeing evidence in polling anecdotally, the American People right now are pretty upset about the way this has been handled, one of most recent polls showing 56 of the folks saying comey or lynch should have brought charges against Hillary Clinton. Thats, that is huge in the Washington Post abc poll, dont you think . Yeah. Of course. Because they know the facts. Remember what took place here. They secretary clinton, according to huma abedins deposition, secretary clinton set up this email arrangement entirely to avoid the information going public. And she stores on this thing, she controls it all, her private information, her work investigation, Clinton Foundation information, and, of course, classified information all on this private server arrangement they set up. They set it up to avoid anything going public and any of the American People knowing about it. Then they get caught. When they get caught, their lawyers say, you know what . Clinton says her and her legal team will decide which ones go to the government and which ones they keep. Once they did the separations, the ones they kept, they destroyed them all. And mr. Comey testified last week they destroyed thousands of documents that should have been made public, went to the government and that people should be able to see. And after they destroy canned those documents, they also the lawyers wiped their devices clean. Now, be that doesnt look like a of making sure evidence is withheld from the American People, i dont think what is. And yet i dont know what is. And yet somehow mr. Comey says to attorney general lynch i recommend we not prosecute, i recommend that no reasonable prosecutor would bring this to a grand jury. Are you kidding me . The American People can look at this for themselves and, i think, infer what really took place here. Lou yeah. The smell test, whatever that is, it certainly did not pass it for millions and millions of americans, the vast majority in point of fact. Now judiciary committee, bob goodlattes committee, House Oversight moving ahead, the committee you sit on, judiciary, calling for what director comey suggested, a formal request to investigate perjury. Hes got it now. What happens . Yeah. Well, therell be an investigation. I think its funny though, lou. Why did the fbi need a referral . Think about what secretary clinton did. [laughter] she testified last october under oath in front of a congressional committee, and she was asked so the subject of your investigation, secretary clinton, is testifying under oath to a congressal committee. She specifically asked about her email arrangement, and you dont go look at the transcript . You dont evaluate that evidence . Why do you need a referral from congress to look at what the subject of your investigation said about the very subject of the investigation . The email arrangement . That boggles my mind. So they said they need a referral, they got one now. They got a letter from the judiciary chairman, mr. Goodlatte, and, of course, chairman chaffetz from the oversight committee. Lou and, of course, they could annotate the transcription of those hearings and show where i she did make false statements four times, lou. I think she made four false statements in front of the Benghazi Committee last october. She said there was i asked her were there multiple servers, she said there was only one server. Mr. Comey said there were several. She said she turned over workrelated emails, there were thousands she didnt turn over, many destroyed. She also said her legal team evaluated every single email. Turns out they didnt. And a number of other statements she made publicly that have turned out to be false, a grand total of seven statements either under oath or publicly that turned out to be false. Yeah, you know, i think its going to be tough ultimately to prove, but it just shows the level of disgust and disdain with the lack of truthseeking, the lack of veracity, the lack of integrity in terms of not being straightforward, not answering the questions and also flat out lying. Lou jordan was pointing out, in some cases unnecessarily, that hover relate9 that lynch wouldnt answer a simple question. Yes. 74 is some of the numbers weve been hearing in terms of direct dodging. Did you expect that . She just rubber stamped what comey said. Comey was the fall guy for it all. It was like a hostage video when hes listing the litany of Hillary Clinton, all the things she did wrong and improperly handled and mismanaged, and then conclusion, and Loretta Lynch going, well, i just went with the recommendation. Lou i want to turn to this report showing that taxpayer dollars were sent to israel to try to oust the man whos become president obamas them nemesis t least for most americans, benjamin netanyahu. And theres no problem with that because there were no conditions taped to the money even though attached to the money even though that was the purpose of the money, to influence a foreign nations elections. Its really bad. You just wonder at what point is there going to be the Tipping Point for ethics and integrity here . If youre sitting at home and youre watching and listening to the all this and youre a viewer, youre thinking i have absolutely a vote of no confidence or faith in the way that these investigations have gone on in the actions, the corruption, the just complete, like, lack of moral judgment and good character. Lou kimberly, it seems to matter not which agency, what quarter of this administration right. Lou we turn, there is no, there is no sense of responsibility, there is no standard to which these people and this administration repair. Yeah, that will go, the level that theyll stoop to. I mean, you saw it. Does it get more flagrant and egregious than former president bill clinton boarding the plane to talk deals with Loretta Lynch. And one of the questions today, oh, by the way, didnt you think you should perhaps recuse yourself seeing as he was your former boss, and youve been promised plungely that publicly that youd with be able to stay on as attorney general . Its unbelievable. She definitely took a play out of the book of holder. You thought the Injustice Department could not get worse, and its sad, because he had a pretty decent reputation before all of this, and i think this was just a really low bar has been set now in terms of the Justice Department and the investigations. Lou i couldnt agree more. The politicization of the obama Justice Department is so complete, so pervasive yes. Lou there is, there is not even a pretense of objective judgment. By the way, speaking of pretense of objective judgment, Ruth Bader Ginsburg unbelievable. Lou never in the history of the United States has a sitting u. S. Justice interfered in, interjected themselves into a president ial election. Didnt that almost make you want to just fall off your chair . You hear this type of thing, and its like, wait a second. It makes me wonder if shes okay, because this is going against every single tenet to say that shes not being impartial, she has this whole predisposition. She goes out of her way to make a statement against one of the candidates, the nominee running for president of the United States. I mean lou whose husband, by the way, appointed her. Right. So there you go. Its really remarkable. Its sad. Maybe its time for her to go, put it that way. Lou she, shes lost it, dont you think . Thats what it seems like. You know what . Lou no one wants to say that out loud. No one wants to say that, but what is she thinking . This is, like, world number one. She just stepped rule number one. She just stepped on the third rail of scotus. Shes supposed to be one of the people thats the ultimate arbiter of fair and justice and the scales of justice, and thousand they just tipped down and hit the floor. Lou in about 10, 15 minutes, donald trump going to given his rally in indiana, and with him will be the governor of indiana, mike pence. There you see the venue. Who may get the nod. Lou do you think pence is in. Hes a strong contender, certainly, but you heard the statement from tony perkins who said lou the head of the Family Research council. Thats going to be problematic. Youve heard jeff sessions, you know, and then Lieutenant General flynn who was also someone that i know does peek with trump quite speak with trump quite often and advise him as it relates to National Security and foreign policy, someone who was an outspoken critic of whats gown on in the obama administration. Lou thats maybe the first time she didnt give us a definitive preference, or you dont have a preference . Oh, i actually like Newt Gingrich a tremendous amount. I think hes fantastic. Lou i get a kick out of the fact of Newt Gingrich out of Vice President. He could get in almost as much trouble as the president. Right . That would be interesting. Lou fascinating. Lou we knew this president ial Election Year would be one for the record books, and its turned out exactly that way. As Hillary Clinton tries to enlarge the number of decades in which a clinton or a bush has been on a president ial ballot, seeking four decades of bushs and clintons a worthy goal, perhaps electing the first woman president as well, perhaps the first president ever without Previous Public Service of any kind in his entire experience. And who would have dreamed history would also this year be made by an 83yearold Supreme Court justice whos become so exorcised about donald trump that she cant contain herself or constrain her invective against trump. Who, in fact, is becoming more heated at hurling insults that are unheard of in american history. It just isnt done. At least it hasnt been done until now. Justice Ruth Bader Ginsburg has gone after donald trump in a series of interviews now, First Crossing the line by making clear her preference for president when asked about the possibility of donald trump winning the white house. Ginsburg said, quote i dont want to think about that possibility. Ginsburg later in a New York Times interview floated the idea of leaving the country if trump wins, saying i cant imagine what this place would be, i cant imagine what the country would be with donald trump as our president. Well, ginsburg didnt stop there. Late yesterday she called trump a faker and a cnn in a cnn interview, and critics will say ginsburgs obvious preference for hillary is itself rooted in history. Hillarys husband, William Jefferson clinton, appointed ginsburg to the high court. It always comes back to the clintons, doesnt it . Donald trump firing back today at the justice calling her criticism highly inappropriate and a disgrace to the court, adding that he hopes she will get off the court as soon as possible. Even democrats acknowledge Justice Ginsburg has crossed a very important line between at least the appearance of an impartial judiciary and partisan politics. I agree with trump. Ginsburg has set a dangerous precedent with her comments that are up precedented themselves unprecedented themselves in the entire history of the republic. Until now the American People were, i think appropriately, critical of both congress and the senate. And, of course, the presidency itself. And now the Supreme Court. Obviously, every bit as partisan. And with that, Justice Ginsburg has assured that our three branches of government are, indeed, coequal; at least in the disregard of the American People. What a year this has become. Our quotation of the evening, this one from Justice Ginsburgs colleague on the high court, justice sotomayor, who said this quote, it is very important when you judge to recognize that you have to stay impartial. Thats what the nature of my job is, i have to up hook myself from my unhook myself from my emotional responses and try to stay within my unemotional, objective persona. Well, ginsburg is unhooked. Were coming right back. The Republican Party will officially support one of Donald Trumps Biggest Campaign promises, building that wall on our southern border with mexico. A Monmouth University poll finds trump leading Hillary Clinton 4442. Clinton has struggled in the battleground state. She beat sanders by just threetenths of a percent in january. Joining us tonight, Washington Times editor or charlie hurt, and Kelly Ann Conway. Kelly ann, how important is this poll in iowa . Its very important for several reasons. One, it shows Hillary Clinton is nowhere near 50 in states that she has to win. And states like iowa, lou, that obama won twice. Its also a state that has a republican senator, republican governor, so the people there are primed to vote statewide for republicans if, in fact, the republican candidates compelling enough to them. Mitt romney lost iowa by six points in 2012 against obama. Its important for another reason. What happened this week before the poll was taken . President obama endorsed Hillary Clinton. [laughter] basically, superglued himself to the her. She escaped prosecution for her email, so all the polls show people really thought that was a bad decision. And she capped off her or 30 million paid advertising spending spree, and what did it get her in twopoint deficit against donald trump in the key state of iowa. Lou charlie, kelly makes a compelling case. Trump, if not building momentum, is certainly holding his own, and there are signs that hillary is, indeed, ebbing a bit in popular support. Just the fact that the polls are this close in so many places that are important for hillary to win if she wants to win the white house, i think, is telling in and of itself. Especially where you have two campaigns, two candidates who could not be more polar opposites from one another. Lou right. You have the establishment candidate and the newcomer, you have the professional politician and the businessman entertainer. And youve got the law and order candidate and youve got, you know the liar. [laughter] the liar the serial liar. Who gave us benghazi. And at some point these, the polls have to break. Voters have to break in some direction. And what weve seen all year long and, you know, going back to last year is they have all been breaking one way, and donald trump is in a very good position to get those voters when they break. They may not love him, but they, theyre preferring that over the hillary option. Lou how much does it hurt trump to have jeb bush [laughter] using public about, you know, what kind of president he will be . I assume theres some positive. At least jeb bush thinks hes going to be president , kelly ann. Well, thats right. Thats really the problem for some of the establishment, they are starting the believe especially if he picks a vp that solidifies his ticket that hes actually going to beat Hillary Clinton. And much of what they said about how unelectable donald trump is and how they can never support him, whine, whitecollar, whine, cry, cry, cry, it makes them look very maul. [laughter] look, i respect the bush family enormously. Beautiful and fabulous americans, but this is a party thats always looking for the next ronald reagan, and they were always picking bushes. And i think what donald trump is this fiction of electability is nonsense. We need electricity, we need to gin up turnout. Listen, even with Bernie Sanders and bill clinton and barack obama at her side, Hillary Clinton will never match Donald Trumps to enthusiasm, and that matters. Lou yeah. Theres no question, charlie, that donald trump has the energy of a man half his age. He outworked 16 candidates, and it appears hes outworking her by a sizable margin right now. How important is that . Oh, i think its crucial, and i think its very much how he won the republican nomination from out of nowhere and by spending a lot less than a lot of the other candidates did. But, or you know, what we saw today with Bernie Sanders endorsing Hillary Clinton, you know, they put the best face on it. It sounded more like a Bernie Sanders rally with three lines after the end where he compliments her. But the big argument that he has in favor of Hillary Clinton right now is that, well, donald trump is a lot worse. Well, that maybe he succeeds at that. Maybe he succeeds at convincing his supporters not to cross over and support donald trump, but he is never going to convince them to love Hillary Clinton. Lou well, as i said earlier on broadcast, i mean, it looks to me like donald trump is going to be beneficiary of his endorsement of her, because for many of those very passionate supporters of Bernie Sanders, the best analog for them is none other than donald trump. Donald trump. And he jumped right on it today, lou and charlie. Donald trump was out there with forceful statements reminding everybody all the things Bernie Sanders has said a about hillary not being qualified to be president , not being a true progressive. That, you know, look, that a wasnt his youthful transgressions at woodstock. He wasnt burning a bra and burning a flag at woodstock, it was last month he was criticizing Hillary Clinton. And donald trump great them all to bear. Brought them all to bear. Hillary clinton is bleeding among young people. She has 29 among men in one of the polls today, 29 among white youth between 1830 and 49 favorability among hispanic youth. She simply cant connect with them. And cool is not transferable. Lou and trump doing better than mccain and romney, and as a number of people pointed out, thats not something to write home about, but doing better than both romney and mccain. Kelly, if you had a choice on no, ill ask it this way who do you think trump will select . I think its going to be mike pence. Mike pence seems to be the yin to Donald Trumps yang. Pence has defined himself as a christian, a conservative and a republican in that order x these are this is a base and a group that donald trump needs the support, he needs to rally in these evangelical supporters. Mike pence is also a little bit more deliberative in his manner. Hes served 12 years in congress, 40 so he knows the hill and congress lou are you saying hes dull, kelly . Hes a little dull, but donald trump is woman baasic. Donald trump bombastic. Donald trump will be the attack dog. He can certain kind of more in the middle and be more moderate and experienced. Lou what doopg, mark . I think its pence, i really do. Knew you need somebody whos a governor, somebody with experience. Kasiching conclude a little kasich conclude a little abrasive and rubbed people the wrong way, including trump. You want to have balance on the ticket, so pence is dull. I dont mean that as an insult, i mean that in a good way. Lou its an interesting contrast, and certainly, golf pence is highly governor pence is highly regarded not only among republicans, but throughout the country as you used the word deliberative, and he is that, and a highly effective governor, and a great career in congress as well. Lets turn to congress and Loretta Lynch who put on a display today that was reminiscent of [laughter] you know, of sam gene can know when he testified. Lou maybe. Thats what i was looking for. She just didnt want to be forthcoming about anything, even the simplest question. What do you think, kelly . It was reported she avoided 74 questions. I mean, this kind of e evasivens from the doj is exactly kind of what has the heavy American Public at an unease. And, quite frankly, or Loretta Lynch has a lot to be defensive about. She met with bill clinton on the tarmac a week before lou wait a minute, kelly, she said that was just social. Whats the problem . Yeah. 39 minutes of talking about grandchildren and golf. Yeah, i dont think so. My father couldnt do that about his own grandchildren. [laughter] lou mark, what do you think . 39 minutes a bit much . No, i believe it. I can see Loretta Lynch saying then i tried my 9iron. It hasnt sunk in how frightening this is, when you see an attorney general afraid to answer a question on the stand.
