Authority under the a in you have to put boots on the ground and the condo to mcentee said yes. I think there is a way in which when you have this openended authority that nobody has been challenging, it becomes like a self licking an icecream cone. It perpetuates itself, and it exists in order to exist. And that is why there are a number of proposals out there. I think the best proposals involve getting rid of the a. M. You have after 15 years. That does not mean that the president is to wait until something explodes before. But the war on terrorism, wisely going to be a Law Enforcement and intelligence operation. The military force where appropriate, and if it is appropriate in the case of isis, i am not convinced will but this is the kind of thing that, you know, we have a debate in congress about. The congressman, whoever is up, if we were actually and because of the nature that terrorist organizations that are constantly changing, what would it look like . Would it be that we do it every week because there is a new terrorist organization popping up . How would that look . There are a number of proposals. Adam shives bill authorizes limited operations against isis. It repeals the 2002 a u. S. Math right away. Repeals the 2001 a u. N. Laugh in, i believe, 18 months. Again, i dont think there is an alternative proposal by Jack Goldsmith and some others we have rolling authority to add new groups if they meet certain administrative criteria to the associated forces list. Although, i think under the proposal we actually get to know who it said it. I dont personally think that is necessary for their recent i talked about a minute ago, the new splinter groups that are not covered. Frankly most of these groups are not covered by the a u. S. Map by anything other than it could face. Again, i think in the case of an imminent threat, there is some reserve authority for the president to act unilaterally, if necessary and it is imminent. If there is a group like isis that emerges in the claim is that we need military force to deal with the group then we have the debate and we authorize that, but there is not a lot of evidence that i am aware of that these proliferating splintering al qaeda offshoots all represent that kind of threat. If that kind of threat emerges we can get authorization from congress or weekend to you know, in extreme cases there can be some action taken by the president. The only thing i would add to that is, they have strained the definition of affiliated groups past the breaking point here. There is some flexibility, perhaps more than either jeter or would like, but there is some flexibility. Which a good faith and reasonable interpretation would have allowed and has allowed since 2001. In fact, and the legislative history of the 2,001aumf the original Bush Administration proposal was much more openended and included Something Like the future acts of terrorism against the United States. And congress to even in that dramatic aftershock rejected that language and settled on more limited language. But i think if you look at what has happened over the last decade or so, we the president s, two president s are precede proceeding as if the original, broader, openended delegation is what Congress Passed. Did you have a question . Sphere. I was wondering, continue on the current path whether the Syrian Rebels helping us with the isil threat, or if it will bear actually strengthen the assad position in syria. I am always worried about it, but i am particularly worried about in this instance. The political realities on the ground in iraq, but especially in syria are such that every hold to an expansive goal, to reorder the political system and syria then, yes, i am worried that it will not be accomplished from the air and support forces on the ground. I worried about which forces were helping. I am worried about what happens if those forces actually went, whether or not they behave as we want them to where as they say theyre going to. There are many reasons to doubt that is true. Again, but there are reasons to doubt it all the time. For particular reasons to doubt it in syria, in the case of iraq, some by changes on the perceived fairness and representatives of the Iraqi Government which there was a glimmer of hope. But there is still a lot of talk, not a lot of action. Whether or not the groups will turn against isis. So i am particularly worried about these two instances. Semi columnist for the guardian. I wonder if you could talk for a moment how hostagetaking in the age of twitter changes the calculus . Well, we certainly see that Public Opinion toward this mission emphasizing a mission against isis did change the public executions of its american. It is not so surprising, shocking and manuals. And so it is not surprising that the public is supportive of a mission to punish isis. Again, i think there is a key distinction. You know, conducting a full on nationbuilding operation which is what were talking about. So, if anything, if being able to differentiate between inappropriate response to these sorts of terrific acts, and a response that, perhaps, is the one that isis actually intended from these videos, which is to draw us into an increasingly unpopular war that is seen within the region as well as your home as somehow on just whereas the initial mission was certainly not be seen as an just, punishment in response to a particular discreet horrific act. [inaudible question] they need to be in context. So but they do not, however, fell on them on youtube and broadcast them to the rest of the world with the intention of calling attention to those two executions. So that is why. Which you were talking about. Yes. We dont think it was the execution spirit we execute people in this country. There were just executions. So the soldiers lying on the ground with the soldier of this is still alive, the isis officer, the jews, the muslims, going back to the early stages of islam. A lot of topics of the war powers. An opinion. To you mean there is the argument that the war powers act gives president s a 60 to 90 day free pass. Yes, president obama is not the first president to make that argument. They made that argument in the libya kinetic military action. And then when they blew through the 60 day deadline without authorization the u. S. State Department Legal adviser to throw out an opinion that said that bombing gaddafi was not the sort of hostility we envisioned. I am sure we were dropping bombs on them, we were not engaged in hostilities within the meaning of the act. The idea i think that they floated the argument that they had a 60 day free pass early on in this operation. Now theyre relying principally on domestic statutory authority. Mainly under the 2001 a un half in which case theyre saying it is already authorized so they dont need further authorization from congress. It is now it is not already authorized. The other argument is no good either. The war powers resolution itself says that nothing in the resolution is designed to alter the constitution, the president and congress is war powers, nothing in the constitution gives the president 60 days to run amok before it is an illegal war. So it is not a good argument , but it is one that president s have used. Fisher, who would feel very strongly that wars should be authorized has even said that we ought to repeal the war powers act. Has this supposedly ambiguity that president s have seized upon. Just before we close chris give credit for the folks to help him now with this power point, i would be remiss in may be in trouble if i did not mention that my lovely and talented wife prepared my presentation which is technically far beyond my capabilities. Authorization act was passed with the understanding that there is a separate authorization from congress. With the Security Council does is relevant to the status of the operation and International Law but it does not provide domestic legal authority. When we joined the wind we did not congress could not, the senate could not have in perpetuity delegated congressional war powers. So that argument may be relevant to the question of International Law. Would you have to get from congress, domestic legal authorization for the use of force. Just with regard to the war powers resolution question, referenced, congressman Scott Garrett and the bill that would repeal the war powers resolution. The democratic incumbent, senator mark warner. You won the toss. You may begin. Warner i thank you. It is good to be with you did. I look forward to talking about my agenda for Economic Growth which will be a new and better direction for us than the obama policies. One future generations to have the same i opportunities and i have had my grandfather is an immigrant janitor. My parents never went to college. I got to be counsel to the president of the United States of america. I fear that we are losing that kind of Economic Opportunity and upward mobility. And that is why i have put forward an Economic Growth plan. The policies today are squeezing hardworking virginians the twin lost jobs, lower takehome pay, reduced working hours command higher prices for health care, energy, and food. And theyre making us less safe as a nation, less able to meet growing threats to our National Security and our public tells and safety. That is why would seek a seat on the senate armed services. And i would also want to put forward these policies that will create jobs to raise takehome pay, lift people out of poverty, hold down Health Care Costs, and reduce energy prices. My policies will ease the squeeze and make it easier for them, for the unemployed to find work. And we need that in virginia today. For every net job created in virginia to people have gone on to food stamps. There are 65,000 more women living in poverty today. 250,000 of us will have Health Care Plans canceled as a result of the Affordable Care act, obamacare, which the senator still supports. Under these policies the federal government is doing too many things that should be better left to the state and local government and the private sector and failing to many things that should be doing right. What policies will make things better. Thank you. Moderator to two minutes. Warner thank you. Would like to think Fairfax Chamber. Id as been the greatest honor of my life to serve virginia as governor and now is senator. What brought me to publicservice was the notion that everyone ought to get a fair shot. We cannot guarantee success. If we maintain that sense of opportunity we have to have people in politics are willing to Work Together. That is what i did as your governor. We turned the deficit into a surplus, and virginia was named the best date for business. I brought the same bipartisan approach to the senate. That is why i am so proud to have the support of the german who held this office before me and i am so proud that have more former republican legislators supported me this campaign and when i first ran. In the senate i worked on trying to take on the challenges of making sure veterans get the care that they deserve, bringing jobs back and making sure young people are not crushed a student at. And every major piece of legislation i work on i start with the republican partner. My opponent has a different approach. He spent his entire career as a d. C. Lobbyist. He views every issue. He even went on tv and called himself a partisan warrior. His words, not mine. I have to tell you, the last thing washington needs is another partisan warrior in either political party. In these challenging times the world needs a Strong America economically, militarily, and morally. And to make that happen america has to have leaders who can Work Together. Thank you. Moderator thank you gentlemen for adhering to the time limit. Lets start with the news of the last 24 hours. He get the first question. We will begin with you. The Supreme Courts non decision to review the course, it is no legal. You personally oppose gay marriage. Are you comfortable, can you accept this decision by the Supreme Court to not act . Gillespie let me make a couple points. I love people and respect them for who they are. We are all created in the image and likeness of god. As you noted, marriages between one man and one woman, and i believe that. As a center, believe it is the proper part of the state to make this determination and do not support a federal policy. The court has ruled on this. It is the law of virginia today. As i do not believe that a federal law is the proper approach, of course i accept the ruling of the decision by the Supreme Court to not take up this decision of the Circuit Court. Time to respond. On this issue my opponent and i differ. I support marriage quality. I think it is appropriate that we live in the commonwealth that does not discriminate. It was something that i advocated as governor when i had those administrations in modern virginia history. I think back to those times even as early as the early 2000s when Companies Across a virginia including capitol one said we need to change is discriminatory practices. So i think the Supreme Court could the right thing. They will have to ultimately take this issue of. Again, on this issue we have different opinions. Moderator do you want to respond . Warner as a matter of policy, where we disagree in terms of whether or not there should be between one man or one woman, in terms of the role of the United States senator to buy it is not something i believe is an appropriate federal response but should be left to the states. People should not be discredited against in terms of job discrimination based and sexual preference. That was my policy as an employer in the three businesses that i ran. Ten years ago you supporter of federal constitutional amendment. When i was chairman it was the platform that called for a federal marriage amendment. Festive for the platform. Im talking about my policies and the policies that i would pursue as a United States senator. Well i believe marriages between one man and one woman, i do not believe it is the proper role of the United States senate to enact a federal marriage amendment. There are others to believe that it is. The next question. What is congresss shirk its Constitutional Responsibilities and leave town without voting to authorize use of force against isis . Your own colleague has said, you dont ask people to sacrifice their lives until the nation has debated and committed. Is he wrong . I agree with the senator. Thank congress should be called back into session and debate this issue early because of belief i support the of this issue. Im not sure i agree with the authorization of force that he put forward, but that is part of the process that will be debated, amended, and dealt with. I do believe that isil is a real threat to our country, and this is an area where my opponent will make charges. This is where i differ. I believe that we need a more forceful response against syria and iraq. It is important that we have stronger action against russia. Without american leaders there is very little that goes on in the world. No, i will say the president has done two things on this issue that are important. He has pushed out the government. It was important that if we were going to come in and be supportive we have to have a government that is inclusive of all factions. Unfortunate it was supported by both bush and obama policies. And he is building the kind of coalition that includes europeans and others because this is to be a fight that is not just american. Unease to the civilized world. You can respond. Gillespie i agree. There should be congressional authorization for air strikes. I believe that that would be in the best interest of our country and would send a strong signal. As senator, if i were senator, i would support that. Think it would be a healthy debate. Think it is required by the constitution, and i believe it would send a stronger signal to our potential allies and our enemies that the United States is committed to the effort. One of the concerns i have, not committed long term which causes consternation among some of our potential allies. I also think that we need to be stronger as a military. And unfortunately senator warner has voted to cut nearly a trillion dollars out of our military budget. Were going to have a navy that a smaller than world war one levels and army smaller than world war ii levels. According to the pentagon when the 306 ships to meet our National Security needs. Were at 282. That includes 486 billion in terms of the budget control act and another 500 billion in sequestration. I will seek to serve on the committee, i would work to replace those cuts, to repeal them combine to make sure that we are more secure as a country and that we make our military the proper priority that it should be. Moderator you can respond. Warner sequestration. I call this stupidity on steroids. I find it curious that my opponent would not have voted for the actor was supported by the majority of the delegation got democrat and republican of virginia. The alternative was on our nations debt. Economic turmoil. But no one has been a stronger advocate against sequestration. It took an urge from both the left and right on this. They have avoided sequestration. As a matter of fact, compliant and the democratic plans that would have replaced sequestration. Frankly, i was proud to receive the Public Service award. Moderator half. Was the president right to rule out combat troops in this war . Warner he should not have ruled out. Moderator you are open to it . Warner we have to leave the military options. I am not supportive of this moment every intervening redlines the you may have to back off of. Moderator take options off the table . Gillespie signal what youre prepared. Recommending combat troops right now and sang a you are not taking it, you know, not taking it off the table is not the same thing. He should not taken off the table as an option. The next question. He said that senator warner has voted 97 percent of the time. You pointed out, heading up the Republican National committee, the white house, helping in the mitt romney president ial campaign. Can you name a specific example of you standing up to your party, is specific example of standing into the party . Gillespie there are differences not in the white house. My party does not have one thing to stand up to right now, but our will share with you some things where i am probably. I believe in the early 90s when Congress Passed mandatory minimum sentences that we swung too far. I believe that we need to revisit those spirited particular for nonviolent offenders. And allow more discretion for judges and, frankly, more discussion discretion for the states to make determinations in the proper sentencing guidelines. Think we went overboard in terms of federal sentencing, mandatory minimum sentences. I am someone who believes in redemption and and reconciliation. I also believe that we need to look at the prospect of checking after you served your time and have paid your price and terms of time in prison for certain crimes and for certain jobs. You know, i dont think you should be required to check the box as a felon which only increases recidivism. Society needs to welcome you back and make it easier. Again, for certain crimes and for certain positions. I appreciate you asking that question. Gillespie by opponents so campaign has been based on this bogus charge. The 97 percent charge. An independent political analyst and not receptive of my record. The review of all of the votes, not just a subsection ranks me and the sensible center what advice stood up against my party to my support drilling off the coast of virginia as long as we get a share of the royalties. I support the Keystone Pipeline. Haven protested. I sit up repeatedly. As we talked about, but also in terms of being stronger against russia. Early in march for these kinds of stronger oppositions to the activities. But they know my record. It is that reason why, again, and this campaign i am so proud to have the support of more republicans than when i ran the first time. It has merit. I just dont think that would be the case. What is is the kind of political sound bite that comes from somebody who spent their careers. Moderator you want to respond . Gillespie a number of things. 97 percent of the time. Secondly, his press releases of very bipartisan, but as for votes are party line. Again, he supports. And yet on two different occasions when there was an opportunity to move forward, the senator voted to block them from moving forward. When there was an opportunity to lift the moratorium half of drilling, the bipartisan amendment, bipartisan support for it, with senator warner voted against it. And in both of those instances former democratic senator from virginia voted for those amendments, with the bipartisan side. And the fact is, one of the reasons he takes arrows from both sides is because he says one thing and then flows another way. With both of you. The fact of the matter, you have these votes that are partyline. Why havent you fought the Party Leaders . And the question to you, we have not seen many republicans fight Mitch Mcconnell peter you guys all hostages . Warner what he does not tell you is the analysis was mostly confirmation votes. What he did not say as well, when i voted against offshore drilling it was because there were no proceeds coming back to virginia. I have been very clear. If were going to go off the coast of virginia we ought to get the same kind of royalty stream. Absolutely consistent. On keystone we ought to wait until we have the financing. That we export the naturalgas which would free up europes dependence on russian oil and gas. These are all things or think we can make changes. Saudis stop the stranglehold . First of all, i was very simple test for every vote backcast. Will this bill ease the squeeze on hardworking virginians and make it easier for the unemployed to find work . If it does not, i will not vote for it. If it does not ease the squeeze on hardworking virginians i will fight against it and promote policies that do. Now, there are those that make up this 97 percent statistic. Lets look to some of them. A trillion dollars in wasted money. Excessive regulations. He voted for 7 trillion in new debt and nearly one charade and tax increases and has not oppose a single nominee from this president. Last but not least the of voted for the Affordable Care act after telling us he would never vote for a plan that meant losing our care. A segue into this question. As noted in his Opening Statement, and as my own newspaper has reported, as many as a quarter of a million virginians are going to have to give up their Current Health insurance policies as a result of the affordable character. No, i realize that your campaign has disputed the exact figure, but at a minimum thousands and thousands of going to have to give up their Current Health insurance policies in many cases policies that they like to read what do you say . Thank you. What i hear constantly is they want us to fix health care. The fact that 49 years ago when Congress Passed medicare yet to come back and fix it. Virginians actually want to keep the fact that people with a preexisting condition can get insurance and make sure that women are not charged more than men. They like the fact that we can keep kids on our policies. Now, my opponents charge and this figure, the head of the answer is association said that number was completely made up. And his attack has been called simply us. I do things that i do think that people ought to be able to keep their health care. As a matter of fact, this has been moved to a state issue. Their is a bipartisan bill that would allow virginians to have the same rights as north carolinian said. I have gone further. Where else i would change. I have laid out now with sound bites but the spiff to the specifics. Ive laid out specific legislation. I would roll back some of the regulatory burden. Lets go ahead and put in place the ability for an Insurance Company to sell products across state lines. We need to fix this problem, not simply really get it. The fact is that we can have reforms that address concerns about preexisting conditions. I am going to put forward a positive alternative of my own on friday and talk of a refundable tax credits and protection. But the 250,000 figure came up in the hearing. And you dont have to go far to find someone who has had their insurance canceled and lost their doctor as a result of senator warner support for the Affordable Care act. And one of those people is with me here tonight, linda from chesapeake. She told me about her rare degenerative eye disease. She has an eye Care Specialist who is important to air. Found out last year that her plan was canceled because of the Affordable Care act. They went on line and found another plan. They had higher outofpocket expenses, deductibles, premiums, but they signed up. She went in for her next visit. They submitted the bill. The doctor is in the plan, but only for emergency services, not chronic care. Had there paying outofpocket and taking a huge hit, just like the woman i met. She and her husband both work. She has just been notified that her Health Insurance premiums will go up 600 per month. Moderator in your response, where are these bills . Gillespie they have been filed this is one of the things i think we need to do from a vote on amendments and have a more open process. Theres a group that should take that on. Lets go to the question. It was not my question. It was the head of the insurance association. Was cited by an elected official. But the said the number was made up. There are ways we can fix that. Keep the plans like. We ought to do that in virginia. Again, it is in the general assembly. But what i also hope to hear, he has been promising his own Health Care Plan since january. It is now 28 days. We still have no plan, no details. Ive wait out ways to fix. Moderator thank you, senator. At an earlier debate is surprised people when he said that you thought contraceptive pills should be offered without a prescription, behind the counter. But theyre not really onesizefitsall. Sometimes they can be dangerous would like to know exactly which of the brands you think should be available and why you think it would be safe. Gillespie that is not his termination i made the one the American College of obstetricians and gynecologists is made. There the ones who recommended that there is no longer an medically necessary reason for oral contraceptive to be a prescription drug. It should be available. My point was, for adult women behind the counter would be the appropriate step. You know, having it available without prescription would make the pill more affordable, accessible, easily obtainable, will bring the cost down. I am not the one to determine what is the right one to make over the counter verses prescription. That is for the fda and the American College of ob gyn and others to recommend. But theyre recommending, its something we should be able to find bipartisan support, something that women want to, doctors recommend of pharmacists would like. To me it makes a lot of sense and would remove the issue from politics and these constitutional questions relative to religious liberty and freedom. On this issue in terms my opponent does not tell you about his plan which is really a gimmick that is being used is that the existing law right now says that women on Birth Control, there is no copay. His plan for gimmick would actually charge on average about 600 outofpocket for women that currently have no his plan does nothing in terms of other forms of Birth Control. And that is because we have had a very different approach. I trust women to make these kind of decisions. My opponent shared the hobby lobby decision. They ought to decide what kind of Health Care Women should get. He has been supported by the major antijewish groups around the country. He would not answer in the last debate. These groups clearly want to he has not spoken up of all in terms of some of the is supporters who have put forward these invasive or ultrasound legislations. All of us, particularly the Business Community said, we dont like virginia been the subject of ridicule. But yet he has not stood up and spoke out against that. So on this issue again, i look for to the women making their decision. The reason that nonprescription Birth Control this and other nonprescription drugs are not covered is because that is the rule in obamacare. That is the rule that you voted for the said that these plans my point is, if you replaced obamacare, the purchase the insurance of their choice. Many would purchase plans that would cover over the counter nonprescription Birth Control pills. Talk about having faith in the women of virginia, i have faith in the women to make that determination about the best plan and policy for them and their medical needs, not to have a set prescription in terms of what plans you cannot buy. We will tell you. Your response to improving the Affordable Care act is to add a fourth plan. By the way, as i mentioned, the women are seeing their healthinsurance premiums skyrocket and outofpocket expenses go up. Moderator hit the pause button. Bipartisanship is a near impossibility is seems. Number one, why is that . What he won another term . Warner i am just not willing to accept the notion that somehow in america we cant fix problems. My whole career, how you fix things. Do i get frustrated with what is going on in congress yes. Have not found anybody that this think congress is doing a good job. Requires people who are willing to roll the proceeds and get things done. I am proud of my record. At think it speaks for itself. While we can do to change, there was a Court Decision today that said throughout virginia is Congressional Districts we ought to do independent redistricting. That would be a giant step for. We ought to also get rid of our Campaign Finance rules which currently the Supreme Court got it wrong. Think we ought to there was a super pak that supports me. We ought to get rid of all of them and all outside money. The last 28 days, less just have this race between you and me. That would be a step in the right direction earth. Target gillespie do i get to spend . Warner we get to make sure this is about campaigns. At the end of the day youve got to have folks who were willing to check the democratic and republican hands. The fact that we have a porous southern border today is not just an immigration concerned, it is a National Security concern with the growing threat of isis, and it is a Public Health threat and the Public Safety threat with the growing concerns.
