You guys are very welcome. Thank you. Thank you. Truly heart breaking moment. A father grieving for his son, Jason Coffman speaking beautifully about his son, cody, only 22 years old who was in the bar at another mass shooting in america. Our hearts go out to that family and all of famil the families. It was College Night in a bar in Southern California. Heres what witnesses heard. [ gunshots ] investigators say the gunman entered the club and opened fire. Witnesses all describe the same series of events. A night out with friends ending in a terrifying hail of bullets. It was a normal wednesday. We were at the bar having fun, dancing. Then all of a sudden you hear like the bang, bang of gunshots. It started going crazy. He was shooting everything from the speakers to anything. All we really saw was just smoke and the shots taking off. We tried to get down and get out of there. Everyone screamed get down. Everyone on the dance floor ran off the dance floor and got behind something or dog piled on the floor. Sorry. Im freezing and shocked at the same time. We hear people were trying to get out of the window. The gunman went behind the cash register. There was probably 12 shots before i got out the front door. Right now police are in the process of telling 12 families that their loved ones are never coming home. Jason coffman, we heard from him. His son cody is not coming home. Some victims have been identified including sergeant ron helus, a 29year Law Enforcement veteran. 29 years as a Law Enforcement veteran. He owned a personal gun Safety Company where he taught firearms safety. Live pictures we are following a procession as Sergeant Heluss is moved from the hospital to the medical examiners office. Outside the bar where the shooter was. What have you learned about him . Reporter well, he was 28 years old. He lived in the local area and he was a u. S. Marine corps veteran. Served for 4. 5 years and did one tour in afghanistan in 2010, 2011. He was an infantry machine gunner. From eyewitnesss he was wearing all black and know from authorities that he was armed with a glock 45 with an extended magazine. He shot the Security Guard outside and walked in and shot the pate republicans arons and e grill. Sergeant helus was hitting in his cruiser when the call came in, on the phone with his wife. He was here within minutes. He and a highway patrolman decided they had to go in. They could hear gunfire and knew people needed help. As the sheriff explained, since columbine, the way authorities approach these events as changed. It used to be they would keep a perimet perimeter. Now the direction is go in. Thats what these two men did. Sergeant helus was hit in a hail of gunfire and dragged by the highway patrolman out and taken to the hospital where he later died of his injuries. He is getting a heros parade from the hospital to the medical examiners office. Now, also authorities are trying to figure out why ian david long did this. He had minor brushes with the law in the past. He was apparently a victim of a bar fight in 2015 and a couple of traffic things, but this year deputies were called to his house for a disturbance. He was described as irate at the time. Mental Health Specialists were called in and ptsd was considered an issue, but he was not detained at that time. Last night he killed 11 people in the club plus Sergeant Helus. Nick, thank you. Nick watt on the scene for us. I want to bring in josh campbell, a former fbi supervisory agent. What about this profile of the shooter . Anything stand out to you . Reporter when these things first happen is what was the motive. A lot of questions that were unanswer and they are getting details about what Law Enforcement is describing as the person who once served in the marine corps. Someone who is familiar with weapons and knows how to fire we assume proficiently. We have know he did go in shooting people that did succumb to wounds afterwards and the brushes with the law he had that nick described. That will be of great concern. Authorities will try to determine if there were warning signs that could be missed. Both from the department of department to recently when he actually had that contact with Law Enforcement. A lot of that will be involved. We go back to build to get the motive. You heard nick watt report that Police Officers were called back in april, but they wont say what for. A neighbor told cnn it took police several hours to get the suspect out of his home. How important could that event be in this investigation . In hindsight, it could have been incredibly important. Here in california we have the 5150 law. If authorities believe someone is experiencing Mental Health issues that make that person a danger to the public, they can confine them up to 72 years and longer if need be to protect themselves and others. It doesnt appear that the contact they had with this person met that threshold where although he was described as being irate, they didnt decide at that point that he warranted confinement. A lot of potential missed signals. Thats the debate we see potentially involved. Were there the warning signs that could have been picked up. What is the line between someone who is just acting with violent rhetoric and experiencing or exhibiting signs that are threatening and pose a danger to the public. There are no good answers, but something all Law Enforcement will be looking into. They will be. The sheriff said he used a glock hand gun designed to hold 10 rounds, but he had an extended magazine. Are you surprised he was able to kill 12 and wound several more with that type of firearm or would that be expected . Wolf, the extended magazine which is in military and Law Enforcement circles. It wouldnt be surprising with this person because he was in the military. We are learning details that he was involved in firearms as a hobby. I think as i do the math, we are going to probably learn that there was an additional magazine. With the number of people kill and injured, it appeared this person would have to reload at some point during the course of the gunfire. There were too many rounds fired than just one magazine. This crime scene is being processed and its going to take a long time as officers work through and gather the evidence and account are for every round. What kind of firepower did that person bring to the bar behind me . A mass shooting in a synagogue 10 or 11 days ago or so and now at a bar with college students. 11 People Killed in the synagogue and 12 People Killed in the bar. Awful, awful stories unfortunately coming forward. We will continue to cover this and come back to the story later this hour. Thank you very much. The new acting attorney general of the United States, Matthew Whitaker has no intention of recusing himself from Robert Muellers probe. The story adds that people close to whitaker said he would not approve any subpoena of the president as part of that investigation. Lets discuss this and more. Cnn justice correspondent, evan perez. Its significant because mueller wants to subpoena the president , he has to get approval from the individual who is overseeing the investigation. Thats no longer Rod Rosenstein. Its the new acting attorney general. Rob whitaker is the man who makes any decisions and all important investigative steps have to be approved by the person overseeing the investigation. Its Rod Rosenstein until now, but now its Matt Whitaker. He intends to run the department in a fair manner. Hes a gregarious, nice guy, but there is a lot of concern because of comments that he made clear that he views with skepticism the steps that Robert Mueller has taken in the investigation. Last year before he became the chief of staff that he was a contributor. He made several statements that are raising concern that maybe perhaps he should recuse himself from this russia probe. Right, exactly. People close in the white house who reviewed this appointment, one of the things they tell us is there is no reason here for a recusal because even if you consider that the statements he made while he was a private citizen last year when he was not read in on the investigation and didnt know anything about it, those may present an appearance of conflict under the rules of the justice department, he is not required to recuse himself because of an appearance. This is something that if he were to go to the Ethics Officer and they say he can ignore that. Thats what they intend to do. Sessions went to the Ethics Office and they recommend he recuse himself and the president never forgave him for that. Mueller and his team are getting ready to prepare a final report. Theyre have begun writing the final report for the mueller investigation. We dont know when its going to end, but all indications is the expectations are that this is winding down. Perhaps by early next year. One of the things they are waiting for is the return of these written questions that the team that the mueller Team Provided to the president s lawyers. The president has been meeting with the lawyers to review the answers and get them ready. When he comes back from the trip to france, he will have a meeting with the lawyers to go over the answers. This is a take home test where he has been getting the written questions. Once they provide this to mueller, the president s legal team believes that mueller will have everything they need as part of this investigation and we will see whether this wraps up soon after. Excellent reporting. Thanks for all of that. And joining us now, democratic senator chris coops of delaware who is a member of the Judiciary Committee from georgetown, delaware. I want to get your reaction to this latest report that this Matt Whitaker is the acting attorney general of the us and has no intention of recusing himself from the russia investigation despite all the public statements he made, questioning it and suggesting that he has limited credibility. What do you think . Im very concerned by that, wolf. Matt whitaker made public statements where he suggested ways in which the president could interfere with Robert Muellers Ongoing Investigation by doing whats happened. Firing or forcing the resignation of the attorney general. Replacing him with a partisan like Matthew Whitaker and having him squeeze the resources of the investigation. He should recuse himself f. They followed the appropriate process, the Deputy Attorney general should be the acting attorney general. Im going to be calling on my colleagues to act as soon as we return next week to pass the bipartisan bill that cleared the senate Judiciary Committee to protect the special counsel. Why do you think that the president rejected moving up the Deputy Attorney general, Rod Rosenstein, who used to be the u. S. Attorney in baltimore . Why do you think he rejected that advice and went to this man who was the chief of staff for sessions . Im not sure, but im very concerned it was for the inappropriate purpose of trying to interfere with the mueller investigation. We dont know that for certain yet, but its highly suspect that someone like Rod Rosenstein who is a longserving, well respected career federal Law Enforcement leader was not made the acting attorney general. Instead, Matt Whitaker who has recently run for office as a republican and only served briefly as the u. S. Attorney in iowa and briefly in the u. S. Department of justice was put in place instead. It raises real concerns. Do you believe it was a calculated effort to remove rosenstein from overseeing the Mueller Probe . Now whitaker will oversee the Mueller Probe and make decisions on whether or not to go forward with subpoenas or anything along those lines. Thats my concern. I was encouraged that there were statements from Susan Collins and Lamar Alexander and saying the president should not use this as a means to interfere, but we will have to take strong words and translate them into action in session next week. Senator Richard Blumenthal said this is a break the glass moment. An emergency where democracy is under attack. What is congress in general democrats in particular, you will be in the minority again in the senate going to do to protect Robert Mueller in the russia investigation . The best thing we can do is pass the bipartisan bill in the Judiciary Committee and i think we should call whitaker in the Judiciary Committee. Majority leader mcconnell said it would be inappropriate for the president to interfere with the investigation. Im hopeful we will find a bipartisan strength to take action to defend the investigation next week. On a different subject, you were celebrating what they call return day where they literally bury the hatchet. Tell us about that and whether you think that could could learn a lesson from return day in delaware. Thats right. This is danny short who is the Republican House minority letter here in delaware. We on tuesday had candidates up and down the state fighting hard against each other and here in georgetown on thursday we gathered for return day. Danny, what can you tell us about return day . Its a tradition that has hundreds of years of tradition. Its a day like after the big game we played hard and we are on the field to congratulate the other team whether they win or lose. We will enjoy each other and have a great time with constituents. The university of delaware will be here. My alma mater along with the school to celebrate the day for the first time. It will be a great day. Lets hope that politicians in washington will learn lessons over there in delaware. Thanks to both of you for joining us. Good luck. Thank you. Appreciate it. Thank you very much. Other news in florida, two recounts may be mandated. One in the senate and one in the governors race. The democrat just hired a lawyer from the bush recount team. My heartaches to learn about the horrific shooting. Praying for the injured and those families of those killed. Leader in Congress Must act not some day, but now. Florida democratic congressman ted deutsch is joining us from fort lauderdale. Thanks for joining us. Whenever there is a tragedy like this, opponents say its not the time to discuss gun control. What are your thoughts right now . Wolf, thanks for having me on. Thousand oaks like parkland and like newtown is one of the safest communities in america. Here we are again with another mass shooting in a place that people always thought it could never happen. It can happen. It has happened. There have been four Mass Shootings in two weeks. Yes. Congress needs to act. Yes. We need to talk about this. Its not just one piece of legislation. Its not just talk. We have to move forward on a comprehensive proof to keep the communities safe. Thats what is require and required immediately. This latest tragedy as you pointed out comes on the heels of the synagogue shooting that left 11 people dead a week and a half ago. In your own state, we have seen the Parkland School shooting in your own district. The massacre at the pulse nightclub. What has been done since all of those shootings to prevent more . Well, i can tell you, wolf, about all of the pieces of legislation we have introduced and a com of minor pieces of legislation that passed. You know what has been done since then . Thanks to the march for our lives activists, thanks to the families in parkland, there was an election that happened. Dozens, dozens of my soon to be former colleagues who had always believed that it was possible to simply sit back and take their funding from the gun lobby and ignore the needs of gun safety in their communities wont be coming back. There is no an opportunity in the democratically controlled congress to move forward to advance the Bipartisan Legislation that we have always known would pass, we just havent had leadership willing to bring it to the floor. We need bipartisan support, wolf. I know the senate is not controlled by democrats. We need the senate to acknowledge when the house passes legislation that it is just as important in their communities to keep people safe as it is in ours. Thats what has to happen. There is change. We saw it start on tuesday. We are going to see it accelerate in january. Even if you get that legislation passed in the now house of representatives which will have a significant democratic majority. You have to get 60 votes for anything important to pass in the senate and then you have to get the president of the United States to sign it into law. Are you hopeful any of that will happen . The president is on record stating publicly and loudly that he is going to be the guy who signs legislation of background checks and to take other action. It was one thing for him to say that and he can back away and none of it mattered because he knew there wouldnt be legislation. Now there will be. It will come through the house. When it comes to the senate defending their position against the people in their community against keeping them safe. We need to create an organization that focuses on the issues all the time. Just like the national Highway Traffic Safety Administration works to keep our highways safe and prevent accidents with cars. We have a national gun Safety Administration that focuses resources on all of the things that we can do to prevent shootings in our communities. Thats one of the ways we can help keep our people safe. While i have you, i want to ask you about the firing of the attorney general, jeff sessions, yesterday. The appointment of Matthew Whitaker as the acting attorney general. Whats your reaction . Well, its consistent and shocking, but consistent with everything the president has done. This is one more step that the president has taken to try to influence the investigation into what happened in the last campaign in the 2016 campaign, the role the russia played with ties to the Trump Campaign and administration. We have seen this throughout. We saw it in the firing of comey. We have now seen it not just in the firing of the attorney general, but the decision to bypass a Career Justice Department official and the Deputy Attorney general and instead replace the attorney general with a political operative who called for the defunding of this investigation. This is a big problem. We ought to have emergency hearings and ought to pass Bipartisan Legislation to protect the mueller investigation. Rest assures, if these things dont happen because my republican colleagues refuse, in january, a democratic Judiciary Committee, if mueller is fired before then, a committee will be more than welcome to welcome mueller before our committee so the American Public can understand all of the decisions and the impacts by the president on the investigation and so we can finally start to have a conversation about obstruction of justice and whether the president s actions constituted obstruction of justice. You are a member of that committee. Thanks so much for joining us. Thanks for having me. Whoops sorry 12 people are dead after a shooting at a bar in Southern California at a College Night event. Con victim was 22yearold cody coffman. His father was calling him all night hoping he would answer his phone, but his son did not make it out alive. I talked to you all this morning. I thought it was my honor and my duty to let you guys know that we found him. I talked to him last night. The first thing i said was please dont drink and drive. The last thing i said was son, i love you. That was the last thing i said. Our hearts go out to Jason Coffman who lost his son, cody. This is sergeant ron helus, one of the first Police Officers to respond and he was also killed by the shooter. He was expected to retire within the next year. A sergeant worked with him at the Ventura County sheriffs office. We are so sorry for the loss of your friend and colleague. Our deepest condolences. What can you tell us about your fellow officer. Thank you, wolf. Ron, he was a cops cop. He was the guy that im not surprised he was the first in the door last night. He spent years on the s. W. A. T. Team and he was a tactition. He trained and worked hard and served this community and the residents here. Absolute professionalism and compassion. He was a fo phenomenal investigator. There are no words. No words to describe how we are all feeling. Its just an awful tragedy for his family and certainly for the families of all the victims last night. This is just this will affect this community indelibly for a very long time. I know Thousand Oaks supposedly was one of the safest communities in the country. Had you ever seen anything like this at all . I have been on for 29 years. I started the same year that Sergeant Helus did. I lived in this community all my life. We never experienced anything like this. How are you guys reacting and dealing with this awful situation . 11 people plus a Police Officer and 12 people all together. Simply gunned down when a guy walks into the bar with a pistol and starts killing people. Its a very tough situation. We are all feeling it. At the same time we have a job to do. Its going to be a long drawn out investigation and a lot of methodical steps that have to take place. A lot of moving parts to it. Everybody is just really stepped up. We have a lot of assistance from our partner agencies. Our partners from the fbi and atf. We are working through it and at the same time we are grieving for ron and his family. What can you tell us about the shooter . Um, hes a 28yearold local resident and my understanding was he served some time in the marines, the marine corps. Four years of active duty and several years of reserve time after that. He was a machine gunner. Outside of that, we have had a few contacts with him. But nothing that even would remotely suggest this kind of behavior. Yeah. Its an awful situation. I know you guys are going to come and learn about it and hopefully lessons will be learned for all of us to try to make sure it doesnt happen again. Sergeant, thank you so much for joining us. Pass on our deepest condolences to everyone in your community. Thank you, wolf. I appreciate it. Thank you. We are going to have more news coming into cnn, including in georgia. This is where it stands right now. Democrats have taken control of the house of representatives. They have 225 seats while the republicans right now have 199. But 11 seats are still undecided. The gop still has the majority in the u. S. Senate right now with 51 seats, the democrats have 46. Three races are still too close to call. Lets start in florida. Both the senate and governors races appear to be headed for a recount there. Our chief correspondent dana bash is joining us. Lets start with republican governor rick scott. He has the edge over the democratic senator bill nelson. Im sure youre getting texts like i was from republicans saying why arent you calling the race for rick scott in florida yet . The reason is it is incredibly tight. The state law in florida is that if the vote is within half a percentage point,. 50, its an automatic machinery count. Look at where it is right now. Its not only that is correct its even tighter,. 26 as of this morning. So thats a quarter of a percentage point. If it gets down to. 25, that means there will be an automatic hand recount, manual, statewide. Thats the reason we havent called it. Its incredibly close. It could take a while. Of course youre getting the jockeying, back and forth, the trolling of rick scott and his people of bill nelson saying this isnt the way to end a career, you should just concede and give up. But its understandable that it is this close, hes not going to give up. Its going to take a little while. Well see what happens in florida. Weve been through those recounts in florida. At least i have, you were in El Salvador Elementary School at the time. And the race with ron desantis and Andrew Gillum is also very close. It is. And andrew gill um and the same law applies as in the senate race. Right now its. 52 . If it goes down to under half, thats it, its going to be a recount. So, again, he conceded, his office is saying and his campaign is saying its because thats based on the information that he had at the time, but theyre not fully giving up. Talk about memories. That is probably the most exact memory, a concession than never mind concession. Saturday at noon is when theyre going to figure it out. Lets go to georgia. Stacey abrams and brian kemp. Hes given up his role as secretary of state of georgia. Stacey abrams has not conceded, even though shes behind. She is behind. Shes only behind by a little bit more than 62,000 votes, but again, she is arguing that there are still provisional ballots, that there are still outstanding ballots that have yet to be counted that we dont even see there that could make a difference, and that is why she is not giving up. Brian kemp, on the other hand, is arguing the opposite, that the way that they see it there arent enough votes that are outstanding that have been cast to make up the difference. But this is incredibly contentious for many reasons, the biggest of which is that brian kemp was the secretary of state, which means that he has been in charge of the very election process that he was a candidate for. Hes resigned as of today so that Going Forward he wont be, but that is a big reason why this is incredibly tense. Excellent reporting with all those key race alerts the other night. You, too, wolf. Meanwhile, the u. S. Supreme Court Justice Ruth Bader Ginsburg has been hospitalized in washington, suffering three fractured ribs after she fell in her court office last night. Lets go to our Supreme Court analyst. Joan, what else do we know about what happened . Do we know, most importantly, how shes doing . Yes, wolf. This all unfolded just an hour before Brett Kavanaugh was going to have his ceremony. This has happened to Ruth Bader Ginsburg before. It happened in 2012 and in 2013. But this happened at the court. In the earlier instances, it happened at home and she knew what was going on. Recovery came. She fell in her office, she thought she was all right but at night the pain was such that she knew she needed to go to the hospital. Im not sure exactly whats happening right new but the prediction is shell be as resilient as before and be able to resume her original schedule. Lets hope for a speedy recovery.
