the way. indra petersons is tracking what you need to do. i'm miguel marquez. >> i'm christine romans. i's 5:00 a.m. in the east. let's begin in iraq where secretary of state john kerry is getting a sobering assessment of what's happening on the ground. iraq is facing a new reality. it comes a day after he sat down with prime minister, nuri al maliki. meantime, the isis push toward baghdad is getting louder with conflicting reports of who has control of the largest oil refinery in iraq. more red on the map, the more the extremist footprint continues to grow. let's get to baghdad live with the latest. oil officials are telling us the southern part of the country where two-thirds of the oil output is safe. when you look at the red stain spreading through iraq, clearly is a very, very difficult time right now. bring us up to speed. >> reporter: it is incredibly tense. that tension is ratcheted further with the claims of who actually does have control of the major domestic refinery here in iraq. we are already seeing just the impact translate into stretching hours north into the country. it's pretty, pretty low in what remains under government control in the north of the country. there was one message that iraqis here were looking for in secretary kerry's visit and they got it. that is help is on the way. take a listen, christine. >> the support will be intense, sustained and if iraq's leaders take steps to bring the country together it will be effective. it will be in a way that respects iraq's sovereignty while affecting america and the region's vital interests. >> reporter: the key phrase there is, if iraqi leaders take the necessary steps to bring the country together. this help from the u.s., it doesn't come without strings. they need some movement on the political front. the u.s. knows perfectly well without a political resolution on the horizon to bring the sunni tribes back over from the isis side, any military support is sticking fingers into the dam. it will only help in the near term. the longer term solution that has to come from within iraq itself. christine? billion is not going to be sued from now until eternity by donald sterling. they are trying to get a judge to approve what is in that trust makes shelly sterling the sole trustee and able to sell the team. the defense, donald sterling's attorney says no, no, no, the judge should be looking at whether or not he is truly competent or incompetent mentally. there are two doctors who said he is not competent and that is in the court record. donald sterling's attorney says they have another expert they should be able to bring in to say he is competent. that's what the fight is all about. >> this trust says you give me two doctors who say he doesn't have capacity, we're done, she's the trustee. >> our position is he didn't lack capacity. the two doctors brought in and gave their opinions and were essentially brought in for a particular purpose and they got it. i think, you know, most people would agree that's probably not an equitable way to resolve this. >> reporter: the judge asked them the sunnis seem to be with them. >> reporter: commitment of u.s. military help. that is a very good start. that is what has been promised by secretary kerry. he worries the help needs to go side by side with political commitments from the actors on the ground. take a listen, miguel. >> the support will be intense, sustained and if iraq's leaders take the necessary steps to bring the country together, it will be effective. it will allow iraqi security forces to confront isil more effectively and in a way that affects iraq's sovereignty, while also respecting america's and the region's vital interests. >> reporter: that is pretty crucial, miguel, if they take the necessary steps. it's by no means guaranteed now. difficult to get the sunni tribes to move over with the isis extremists, to move to the government's side without serious commitments from the ruling from prime minister nuri al maliki, that they will be inclusive. the policies being extraordinarily discriminatory. it will be behind them. time is of the essence here. now, much of the ground, this is what we are hearing from security forces, much of what has been already lost to isis is going to be very difficult to retake, even with a commitment from the sunni tripes. let alone they spend time trying to cut the best political deals. time is absolutely of the essence. that oil refinery you mentioned is on the highway to baghdad. if that falls, then isis is another crucial step closer to the iraqi capitol. miguel?
