Lead impeachment manager adam schiff delivering what you could call a prebuttle of the president s defense. I leave you to your own judgments about the president. I only hate what hes done to this country. I grieve for what hes done to this country. But when they make the argument to you that this is only happening because i hate the president , it is just another myriad forms of, please do not consider what the president did. Whether you like the president or you dislike the president is immaterial. Its all about the constitution and his misconduct. If it meets the standard of impeachable conduct as we have proved, it doesnt matter whether you like it. It doesnt matter whether you dislike it. What matters is whether he is a danger to the country because he will do it again. Heres something you probably dont know. Schiff was still writing his closing in longhand, by the way, on the senate floor during the break, turning it into a powerful plea for a fair trial, a fair trial for america. One of the things that separates us from those people in elgin prison is the right to a trial. Its the right to a trial. Americans get a fair trial. And, so, i ask you, i implore you, give america a fair trial. Give america a fair trial. Shes worth it. Thank you. So heres the question. The question is will that trial include witnesses . Will it include new evidence . Will it be the kind of a fair trial a large majority of americans have said that they want . We wont find out until some time next week after the president s lawyers make their arguments tomorrow morning, after senators have 16 hours to ask questions through chief justice john roberts, only after all that the vote on whether to call witnesses and admit new evidence. Will america get a fair trial . Lets pose some of these questions to our experts here. I want to bring in Mark Mckinnon, john dean and catherine rampell. Thank you for being here. Jeffrey, you have been on a long time. Thank you so much. I want to know what you thought about the closing because i thought it was very powerful. I was trance fsfixed. The constitution of the rule of law was at stake, he said. What do you think . And we live in age where people speak in conversational tones most of the time. It is rare to hear a speech that you just want to listen to for an hour. Very old school. It is very old school. And schiff didnt do it just once or even twice, but he did it three times over the course of these the presentation by that. With notes. Well, with notes. He used a Robert Kennedy quote which was unfamiliar to me, but he said that Robert Kennedy said moral courage is even rarer than physical courage. Yeah, thats great. The ability to go against what your constituents or your peer group or your friends say. He said, i dont have to worry about that because my constituents, they agree with me. Im in a safe democratic seat. But for the senators who are in political peril, i thought that was a very meaningful way to put the issue. As im sitting there watching, i said, i wonder if anyone in that room was embarrassed, but i dont know. Have we moved past that point . I think they left that at the door a long time ago. The interesting thing was the faux outrage about adam schiffs comments head on a pike. My point is they were only doing that because they couldnt argue the points. What did you think when you were sitting there watching this . The first thing that came to my mind was mr. Smith goes to washington. I said, it wasnt quite that, but i thought it was brilliant. What happened to me, there were large gaps of time where i was so captivated, i looked at my watch and i said, my god, its 12 00. My god, its 6 00. It went by like that because it just drew you in. I thought it was very powerful. I think one way to see todays events, not just schiffs closing comments as sort of a pep talk for congress, right . Man up, woman up, reclaim what are your constitutional rights, stop putting up with constitutional kas stracastrati you have been putting up to at this point, trump advising consent on appointment or regulate trade. And in this case, have even the most basic oversight of the executive branch. What they were making the case for today was essentially reclaim your Constitutional Authority and show america that you are still willing to do your duty. Youre not willing to let the executive branch essentially steal it from you. And that was essentially appropriate today because they were talking about the second article about obstruction of congress. If you say to the president , its okay for you to reject every document request and subpoena and every witness, that essentially says, the impeachment power does not exist anymore. Because they cant get evidence. And that you are above if law. Thats right. Standby, everyone. I want to bring in a democrat from oregon. Senator, i appreciate you for joining us. I know its been a very long day for you. Long day. Today was the impeachment managers last chance to lay out their case. What is it like in that room . Did you sense the dynamics changing at all . What did you see . Absolutely. Ill tell you, last night when adam closed, he closed with the what america is about as doing right as opposed to his fathers own country. When he started talking about moral courage and kennedy and lincoln and how this is a big deal. This is about whether or not, one, were going to have full and fair trials in the senate and, second of all, whether were going to toss impeachment out the window and not have a usable instrument to hold the executive, the top executive, the president accountable as envisioned in the constitution. Do you think there will be at least four republicans who will show that courage . I do not think so. You know, as we saw this story unfold, giuliani goes over to kind of do a little bit of work behind the scenes to get the support of the Ukrainian Government to do these investigations. And they run into an obstacle. It is the u. S. Ambassadors. They have to plot to get her out, but they have to plot the u. S. Government to do that. Just as theyre getting her removed, there is this new election in ukraine. A reformer comes in and hes resistant and they have to figure out how to pressure this reformer. Suddenly, there is Communications Going to the highest level of our government. I think all those folks, all those cabinet secretaries, all the folks who worked with them are going to be breaking legs and twisting arms to make sure there are not 51 votes for documents and witnesses. Wow. Senator, poll after poll shows the majority of americans want witnesses. They want more evidence in this trial. Why do you think republicans are so willing to defy what their constituents want to go against Public Opinion here . They are worried because they know the further you burrow into this. Think of it like a bee. It looks pretty good on the outside with a few holes into it. Start burrowing into it and you find out the whole thing is termite infested. Thats what theyre worried about. It will take time and it will do great damage to republican reputation and to this trump administration. Theyre like, no, lets seal up those holes on the outside and say everything is fine. Adam schiff talked about how hard it is to vote against President Trump. What are republicans afraid of . Are they afraid of that . What they realize is that their base absolutely is lined up the majority of their base is lined up with President Trump. They bought the story, if you will, that this is just some partisan assault. Thats nothing really big. It is part of one phone call. And, so, what could what is this all about . It is about nothing. What about the evidence . What about the oath that they took when this all started . What about their commitment and obligation to the constitution . One of that mattered . Well, i tell you thats very troubling for me because weve had these two oaths, one to the constitution, which envisions the senate, not as an Appellate Court that just looks at stuff from the house but as a place where the actual trial takes place. Thats a big deal. Then the oath for the trial itself to do impartial justice and instead were seeing this manipulation to make sure there is no justice. There is no full and fair trial, and its deeply troubling. I want to ask you about lev parnas. We are learning that the Rudy Giuliani associate turned over where trump reportedly demands the firing of then u. S. Ambassador of ukraine marry. I dont know if they could have brought that up yet. Im not sure. What i heard about that tape was that you can correct me hear because i heard it on the way over was that essentially trump saying, yeah, lets get rid of her. That would surprise no one. I mean, that is what trump did. He could do that by recalling her. If the language was to take her out, that still could have just meant, ill give the president credit on this that i dont think get rid of her, and this is according to abc news, that he said get her out tomorrow. I dont care. Get her out tomorrow. Take her out. Okay, do it. That sounds yeah, that sounds very threatening, it sure does. Especially with the earlier language that we have where we saw the dialogue in the Text Messages between parnas and the republican operative who was conspireing to track her. So i certainly hope and believe the president would not resort i cant imagine why he would do anything other than simply bring her back to washington. But it indicates in this respect. The republicans feel very confident that they will be able to hold the Senate Republican conference in line and prevent more than three defections on the key vote thats expected next week to determine whether to subpoena witnesses and documents they will need for democrats to succeed in pushing forward on subpoenas, particularly before john bolton, Mick Mulvaney and others as well as a range of documents. They will need 51 votes. They only have 47 in the chamber. But talking to republican sources, there is a strong feeling right now that they have not lotst more than three votes at the moment. It is uncertain will they will lose Lisa Murkowski who has been critical of the dems this week even as she herself has not said she made a decision on witnesses. Romney declined to comment. Collins says she wants to hear from the defense team as well. Don, i caught up with one potential defaector today. He is also a close ally of Mitch Mcconnell, even though hes a retiring institutionalist, there is a strong belief on capitol hill that he will end upsiding with Republican Leadership which is why there is confidence tonight that the republican conference is mostly united. That means the president could be acquitted as soon as next week. What if there is 50 50 here . Then it goes down. Thats the expectation here. Thats why they would need four votes. There is a precedent, don, back from the johnson trial. The Andrew Johnson trial. That the chief justice could vote and break a tie, but that is not what the Senate People who are dealing with the rules here, the parliamentarians expect would occur. They expect a 50 50 vote means that motion would die. Tomorrow morning is the start of the president s time. What can we expect to hear when the president s legal Team Presents its first day of arguments . It will look different than what you saw from those democrats when they came close to using all of the 24 hours they had to make their arguments. When the president s team gets started tomorrow, you will see jay sekulow making their arguments. But you will only see them there for three hours at the most. It was a trailer version of their arguments tomorrow. Then they say they will wait until monday to make the bulk of their arguments. A lot has to do with the president s tweet from this morning where he said he used saturday as the death valley of television gradings and hes worried his day in court is coming at a chance when people are not going to be watching. Thats why he wans them to wait until monday. The question of course will be how does that affect what the sunday shows look like. Those are political shows the president watches very closely. So they will send out one of his attorneys there on the sunday shows, so someone is making the president s case of course in addition to potentially some republicans. All about the show for him. Think about all the things this president has done and said that shes yeah. Its like it is mind boggling. Adam schiff quotes a news report, and, you know, this and she gets the vapors and has to go to her fainting couch. I wish she were as upset about trump compromising our integrity. I think Lamar Alexander will stick with Mitch Mcconnell who is his best friend in the end. Thats a shortterm win for republicans. But longterm some of these witnesses will come forward in other venues and formats with potential evidence that wasnt heard now. When the public hears that, they will hold those republicans accountable for not bringing the witnesses in. And Chuck Schumer was on earlier, and he said, you know, what vindication do you get from a trial that is not a trial . You know, because obviously the state of the union is going to be next week, and the president is going to treat it as a victor lap and i was acquitted and i was successful and the impeachment was all wrong. If you have if he is acquitted after a trial, the republicans refuse to allow any new evidence in at all. How much of a vindication is that really . Its going to do terrible things to our democracy as well because we have an unchecked president who, if hes reelected will be uncheckable. That will change the whole dynamic. The house manager pointed out how no less than 12 current or former government officials are prevented from testifying. She pointed out a graphic of eight witnesses who denied trumps orders of testifying. We saw trump thumbing his nose at congress. It mistifies me how he gets away with it. This opinion is just not going to survive in any court. So it is a bluff. And congress has not been forceful before this in trying to call their bluff. But this is the problem, is that, you know, they don mcgahn, the former white House Counsel tried to the Judiciary Committee tried to get him to testify. He was willing, apparently. They won in the District Court in december, and now its on appeal in the d. C. Circuit. Thats what it means to go to court. Tonight House Democrats finished up their three days of opening arguments in the impeachment trial of President Trump. Next the president s legal team takes its turn beginning tomorrow morning at 10 00. Back with me mark, john, Jeffrey Toobin and catherine. You know what the arguments will be. I thought it was the smartest thing you could have done because they are going to have the stage to themselves for the next few days, and their arguments are not going to be surprises. I thought shift did a very good job. They are going to say, there is no such thing as a high crime and misdemeanor that havent an actual criminal defense. They will say that the president was really concerned about corruption in general, not just about the bidens. They will say he was concerned about burden sharing, that other countries werent stepping up to give ukraine money the way we were. Shift did a very good job, i thought, of refuting those arguments in advance. Well see if anybody remembers that when they start the problem with that is none of that was discussed before any of that, in any of the phone calls, in any of the right, right. None of that was discussed. When he got caught, he gave ukraine the money without checking what any other country was doing. There is no evidence that he was concerned about corruption any kind of corruption except trying to find out what went on with the bidens. Jeffrey, let me ask you a question. On the abuse of power they laid out substantial evidence on. On the second article, though, wont the republicans say you didnt pursue relief through the courts. Well, thats right. And i think that will be their most effective argument, that this is a legal dispute. Right. Between the president and the congress and the appropriate form for that is the courts. Now, the response to that argument is president s have often contested congresss power over a single subpoena or a single document request. But the idea that you can go to congress and say, youre getting no documents. You are getting no witnesses. That is a level of lack of cooperation that goes beyond what you have to do to go to the courts. Isnt the other issue that the government attorney said elsewhere argued this cannot be adjudicated by the courts. You cant do it in a timely fashion. There is the timely issue, but also the point that once they have gone to court they the congress the administration has argued that it is inappropriate to have it in court. Right. So basically the Administration Says heads i win, tails you lose. And thats but that that argument that you should go to the courts is better than most of their arguments. Lets talk about the one thing that will come up, and thats going to be very frustrating to most of the people in this country, except for the conspiracy theorists and the people at the white house. Thats going to be burisma and biden which really has nothing to do with this and everything to do with this because that Conspiracy Theory is what got us here. I thought the prebuttal on that was good. They addressed how irrelevant it really is and what it will really mean when it comes up and how theyre deflecting. It is a shiny object i dont think will attract the same kind of attention. What trump would like his lawyers to do is make the kind of case in the trial, which is a protected forum where they really cant defame anybody instead of just slime the bidens. But, don, i will say you mentioned about people that support witnesses, including republicans. I assure you both republicans include biden. When you try to explain to people that they got rid of and most of the leaders of the western world wanted to get rid of the prosecutor who was not prosecuting any cases and bring in people, the person who had l let the burisma case drop, they dont understand. They want to bring someone tougher who would begin prosecution. It boggles the mind and they start scratching their head. I think the American Public has not really got an appreciation for it. So this, according to the attorney for lev parnas, is a recording made by actually by igor fruman, the other ukraine born indicted associate of Rudy Giuliani, at a Fund Raising Dinner in washington in april of 2018, only 15 people or so in the room, subject of ukraine comes up and you can hear lev parnass voice, or what sounds to be lev parnass voice talking about ambassador yovanovitch saying that she wants to get she thinks President Trump will be impeached and you hear the president , what appears to be President Trump say get rid of her. And now they have to figure out what to do with it. So and someone gave it to abc news. Yes, joe bondi, lev parnass lawyer has been very clear to say that he has no idea how he does not believe it comes from him or from lev parnas. Its striking to me,ton, earlier in the show you were highlighting reporting that leans against calling witnesses in the impeachment trial, momentum seems to be going in the other direction and now were getting more information from somebody who should be a witness, close to trump and who was involved in this whole crazy scheme to extort ukraine. What were seeing now is that parnas has not been blowing smoke. Hes been making claims, people are skeptical. Is he telling the truth or not. Theres a tape of an hour and a half, something to substantiate his evidence and it would be truly a miscarriage of justice if the senate shows no interest in what he has to say and what the other witnesses have to say because theres more information thats going to come out, whether they hear it or not, its a question of are they going to hear it were they acquit him or not. Trump was asked about this abc report on fox news earlier today. Whats hear what he had to say, alice. Here it is. I wouldnt have been saying that. I probably would have said if it was rudy there or somebody. I make no bones about it. I have every right. I want ambassadors that are chosen by me. I have a right to hire and fire ambassadors, and thats a very important thing. But even if you look at the conversation i had with the president he didnt like her because in there he didnt like her. So i dont know. I didnt hear this. But if they had it, i will tell you right now, i feel strongly that this is somebody that shouldnt be with us. She wasnt popular even in the country. Look, ambassadors serve at the pleasure of the president and when you go around trash talking your boss thats an occupational hazard and the president is right, he has to theres no evidence she did that, theres no evidence she did that, they were making that up. But the reality is thats an unsubstantiated charge. Critical things about the president he has every right to get rid of her. She denied saying that, theres no evidence she actually did that. This seems to be a plot by rudy and his gang to get rid of her by trash talking her and saying things she didnt say. Ive got to go.
