She laid out the chain of events, don. She revealed that she discussed Michael Flynn with don ma gcginn two separate occasion. She called to express the concern that flynn could be blackmailed by the russians. And she wanted to visit him at a secure location. When she met with him, she explained that she couwas conced that flynn could be blackmailed but lied to it to Top White House officials, including the vmt. And then, she said the second time they met, was the next day, when he had several questions, including whether flynn could be prosecuted. And there was a third conversation about allowing white house officials to see the underlying evidence of flynns behavior. James clapper, on the other hand, he stood by the assertion that he had seen no evidence of collusion between Trump Campaign associates and russians. But he acknowledged that he was unaware of the fbis counterintelligence into that matter, don. I know this stood out. Sally yates says she offered the white house the opportunity to look at the classified information she was basing this warning on. But its unclear if that happened, right in. Right. We reached out to the white house find out. Were waiting to hear back. Sally yates said that the white House Counsel called to see the evidence. But she doesnt know if it actually happened because she was fired for not backing trumps travel ban. The fact that the white house officials had the opportunity to look at the classified materials, prompting a concern of d. O. J. , undercuts white house spokesman sean spicers assertion that d. O. G. Gave a heads up. And it took 18 days to take action against flynn, only after a Washington Post report revealing that d. O. J. Report to white house officials. Thank you, pamela brown. Thank you for joining us. What did you think of the hearing today . There was more detail. There was furtherer evidence this white house is not inclined to deal with this issue. They are stalling and sto stonewalling, if you will. He could clear this up so quickly if he wanted to. Thats why everyone thinks theres something there. The way shes responding to it and dealing with it. How can he clear it up quickly . He can say, anybody on my staff who has hinted at being involved, will testify in front of any forum, grand jury, talk to any fbi agent. All documents will be made available, if there are documents. Explain what happened to flynn. Why they didnt move faster. Why it took a leak in the Washington Post. Respond. React to these things. Lal are r by not doing that, you say it gives the impression of something to hide. It does. Coverup 101. You have served in the role of white House Counsel, to mixon. I want to get your reaction. One of the questions that mr. Mcgann asked me, why does it matter to d. O. J. If one white house official lies to another white house official. We explained to him it was a lot more than that. And went back over the same concerns that we had raised with them the prior day. That the concern, first, about the underlying conduct itself. That he had lied to the Vice President and others, the American Public had been misled. And pareimportantly, every times lie was repeated and the disrepresentations were getting more and more specific, as they were coming out, every time that happened, it increased the compromise. So, according to her, don mcgahn, why would one white house official be concerned if another lied to another. He was looking for the underlying crime or activity or interest of the Justice Department was, in a poorly phrased question, if thats the way it came in. Thought being privy to the conversation, we dont really know. Thats her best memory of it, the way the conversation started. And it sounds like he was probing to find out how serious they were, had he lied to the fbi. She didnt get any responses to that. And where this thing might go. All she was doing was trying to alert them to the fact there was a problem here. You have a person who is dissembling to your staff and the Vice President is making that information public. If you were getting if your role, if you were getting a red flag like this from the acting attorney general, about the National Security adviser, what would you do with that information . You know, i vetted a lot of people. We had trouble with watergate. But we didnt have trouble with our vetting. They were thorough. We reacted to this sort of thing. Nixon was a stickler on these issues. The small things were big things to him. He was somebody who wanted all of his staff to be clean as a whistle. Notwithstanding the criminality that later occurred with watergate. Conflict of interest, ethics violations and things like that. They were few and far between in the nixon white house, because of the process that followed. Do you believe that Michael Flynn could be prosecuted, mr. Dean . That question came upped to. A couple of senators were probing as to whether there was a criminal investigation going on, and whether he had committed various crimes, lying to the fbi. Whether he had committed a crime for taking money from russia, as an exofficer without getting clearance. They went through the whole litany. She didnt answer directly. But there appears like theres a prima facie case here. This man is entitled to due process. We shouldnt convict him in court of public opinion. We dont have all of the facts. But it looks like a crime. Or crimes, if you will. You were talking about transpartran transparen transparency. You said the president could clear this up if he put everybody out there saying we have nothing to hide. Is he getting sound advise from his counsel based on everything we heard today . And would it help if he admitted that russians influenced the election . He wont even at mitt that. That would be a wonderful first start. Why he keeps stiffing this issue and refusing to accept it is something of mystery. What he could do is what gerald ford did when he took over. The way jimmy carter handled scandals during his presidency. That was to open the doors. Say, come and talk to anybody on my staff. Put them under oath, if necessary. And cooperate. Trump is doing the opposite. And hes doing i dont know who is advising him on these things, if anybody. You think hes getting good advice . I dont think he is. His counsel is a campaign law specialist. But he has built a Strong Office. The white House Counsel office has very good lawyers. People that left higher paying jobs for government. Theres people in there who know what to do in these situations. So, hopefully, he draws on the best of them to get his advice. What does it say that they didnt go there to to get in trouble. No. What does that say about them . Well, it may be that the way the white house the white House Counsel has always been something of a middlelevel staff person. Only rarely have white House Counsel had direct access to the president. They had to go through the chief of staff or some other staffing system. And that may be the case here. These people who know what to do are not being called on. And theyre not able to get their ideas into the president through the staffing system. I dont know whats happening. This white house, we still know little about. I just know from the announcements that have been made, that they put together a very Strong Office for the white House Counsels office. Could it be they know something that, you know, maybe they dont thats the course the question. The way he is handling it. The way he handles everything, is to deny, say its all fake news. Anything thats bad news is not to be believed. I think thats the wrong way. Youre not going to make this go away by denials that are conspicuously off the mark. Just odd, don. Susan, were going to start with you. Theres a lot to discuss here from the hearing. Lets listen and then well talk. The first thing we did was to explain to mr. Mcgahn, that the underlying conduct that mr. Flynn ebb gaungaged in was problematic in itself. And we felt that the Vice President and others needed to know that the information they were conveying to the American People wasnt true. We wanted to make it really clear right out of the gate, we were not accusing Vice President pence of knowingly providing false information to the American People. Underlying conduct of Michael Flynn was problematic, was more than just him lying to the Vice President , thats key, right . This seems like an old story at this point. But we forget this actually President Trump wasnt president yet. This is in the transition period. In this period of time, we have a one president at a time rule. Its considered highly inappropriate, if not a te technical valation of the logan act, to have the communications with a foreign government. Thats one element of why the underlying contact is problematic. The other piece is, the substantive offer, right . Why was the Trump Administration offering to undercut sanctions that the Obama Administration had just applied for interference in the election. Sally yates warned the white House Counsel, and the first meeting in the oval office, were warnings. Why do you believe that all of the warnings to be ignored . We dont know the answer to the supreme number one question in all this, which is, if Michael Flynn was talking to the Russian Ambassador about possibly lifting sanctions, that president then president obamaed a just imposed, because he authorized to do that by thenpresident elect trump . Did he brief president elect trump on the conversations . Until we know the answer to that, its hard to evaluate everything else, including how don mcgahn was responding to all this. If this was coming from the top, it puts a different cast on everything that took place after that. And thats why todays testimony ratchets up the questions that go to the president himself. Listen to what michael just said. White House Counsel don mcgahn asked why it was concerning to the d. O. J. That one official lied to another. She explained that flynn was compromised. If the white house was looking at this as more of an administrative matter, does that raise concerns of the white house judgment at the time . It seems like theyre saying, this is our turf, you stay on your turf. It is interesting that he seemed to be implying that its actually kind of okay. Well resolve it, its our dirty laundry, you stay out of this. He wasnt going to do anything about it. As susan pointed out. Or he had no influence with President Trump, that he couldnt take this up to him and say, this is what d. O. J. Is saying, what do you think . Michael moore, does this speak to judgment for you . I lost you, don. Does this speak to judgment . I think it denies that the inner circle at the white house doesnt know whats going on. Let me jump to one thing. Spent a lot of time talking about the travel ban, as opposed to talking about the judgment and the process of the white house that may tell us something. This administration is a master at directing the news cycle. They talked to sally yates on the 25th. They talked to her on the 26th and the 27th. And on the 30th, they got rid of her. On the guise she was against them on the travel ban, a ban that has been pushed out without preparation or instruction to the field. It might have been a way at the same time for them to manipulate the dialogue and change the cycle a little bit. It justifies reason to think that the white House Counsel was not talking to the chief of staff or up the line. It was interesting to me. We learn that the white house let the National Security adviser serve while he was compromised. And they talked about the travel ban. Why are they talking about leaking, if there wasnt a leak, we may not have known about Michael Flynn. Thats a big reason we ought to be talking about independent counsel and independent investigation. It would take away the tarnishing of partisanship. What happened in the democracy . What happened in the election . Are there ties that shouldnt be there to the russians . Heres what President Trump tweeted about sally yates in todays hearing. Talking about leaking and unmasking, as i said. As clapper said, important, but he said secondary. Ask sally yates if she knows how classified information got into newspapers soon after she explained it to white House Counsel. What the president is implying here, hes implying that the former Deputy Attorney general, sally yates, leaked. I hate to keep relying on you, michael moore. But youre a former u. S. Attorney. Sure. If this was any other person implying this, would this be considered witness tampering . If it was any other person, if they were implying about, maybe so. This is a clear example of trump trying to go and shift the attention of the investigation, shift the focus of what were talking about. He spent more time tweeting, than listening to his advisers or checking out the background of mike flynn. The suggestion that this investigation is going to turn into sally yates interpretation of the travel ban or an investigation of whether or not she talked to a news source somewhere, about information, i think tells us where it might be doing. But it might be time to have an independent counsel and independent investigation. Youre allowed to that, michael. We have you hear to speak to this expertise. Heres another tweet this morning. General flynn was given the highest security clearance by the Obama Administration. But fake news seldom likes talking about this. Susan, it is important to point out that general flynn was fired by the Obama Administration. And the security clearance is different when you become National Security adviser. General flynn had the clearance when he was head of the d. I. A. And military career. The most troubling conduct occurred in the period after the Obama Administration fired him and before President Trump hired him. Hes not responsible for that per. And trying to shift the selection of the security adviser on to the previous president is a little strange. There was lots of Information Available to President Trump. There was Information Available before the inauguration. And we know sally yates and others brought questionable activity to his attention. President trump is claiming the administration when it comes to security clearance. They didnt trust obama. Are they trying to have it both ways . The security cleerps was good enough but the warning by the Obama Administration was not good enough . Right. The idea that the renewal of security clearance was an Obama Administration move, it would have been done by midlevel bureaucrats at the defense and intelligence agencies. Hardly something that would have gone up to anybody at the political level. And lets also remember, the revelations of just last week, from the white House Oversight committee, indicating that general anyone flynn had not fully disclosed his payments from the russian government through r. T. , in the security clearance renewal process. If he got the security clearance under false pretenses, by failing to report that he had gotten payments, from a russian government entity, even after being warned that in order to accept those payments or e mollmemol emoluments, he had to get approval from the d. I. A. It raises questions about flynns conduct rather than whatever mid level bureaucrats in the pentagon reapproved his security clearance. It is problematic. If you look at this picture, how problematic is it that the former National Security adviser was in the room, Michael Flynn, you see him highlighted there, when President Trump spoke with Vladimir Putin on january 28th, after the warnings from the d. O. J. One second before we weigh in on that, can we say, remember Michael Flynn standing on the stage of the Republican National Convention Last summer and saying, if i had done a fraction of what Hillary Clinton did, i would be in jail. And hes potentially lying on his clearance forms. Potentially lie violating the logan act. If not outright violations of the law. How problematic that he is there . On the call with putin . I think its well, its hard to say. On one hand, its problematic because hes, as sally yates said, potentially compromised. On the other hand, it seems like that whole inner circle, trump inner circle, has been compromised by connections to the russians. So, hes in there on the call. At the same time, he has been advising trump throughout the campaign. Perhaps he is the reason for trumps very friendly stance, consistently trefriendly stance russia, on orchestrating the friendship with Vladimir Putin and the russians. At that point, whether or not i think it is obviously problematic that hes on the call. Theres a larger to some extent, the damage has been done. Go ahead. I was going to say, its problematic, don, because it allows Vladimir Putin to think he has an in the oval office. Part of the problem was that russia knew what was going on the its problematic because it creates the perception in an enemys mind they have an insider in the white house. I think for this negotiation, for any negotiation going forward, any discussions or conflicts that may ham around the world, thats a problematic impression that has been created because of the nonsense thats gone on in this administration. Can i point out, theres another piece of news that came out in the hearing today that has opinion overlooked. But senator feinstein asked, former dni director clamor about a Guardian Newspaper report that the British Intelligence and other european intelligence agencies, had passed along information about potentially suspicious contacts between trump advisers and the kremlin, as early as late 2015. She asked, is that accurate . He said, yes, it is accurate. And he cant discuss the details because theyre sensitive. Thats a stunning acknowledgment. Its the first public confirmation reports that we have that there were reports passed to intelligence. We dont know what the nach over the contacts are. We still dont. We dont know how reliable the reports are. But it gives us additional context about one of the fundamental questions, whether there was collusion between the Trump Campaign and moscow. I want to talk about, today, about how sally yates conducted herself at these hearings. She had a tense moment or tense moments with senator ted cruz. And i think some people thought he may have thought it was a gotcha moment or what have you. I want to play this and get your response to it. Ted cruz dismantled sally yates, show eed her to be the hk that she is, and said you cant rely on this woman. When she goes to don mcgahn, information, its hard to trust when you have sally yates or barack obama to Say Something bad about Michael Flynn. I want michael to weigh in. What do you make of jacks response . Sally yates had an honorable and storied career in the Justice Department. The notion that she is a political hack, that would strike people as absurd. I thought she conducted herself quite well. We talked about the president s tweets and implying that maybe she had leak eed confidential information. I havent had contact with the press shp she was clear on her rationale. She was careful on her care of classified information. She held herself well. Sally handled herself like a pro. She is that. Shes conscientious and professional. The only schooling that happened, was she schooled senator cruz on how to read the statu statute. He needs to read both parts of the statute instead of reading one out of context. She had an honorable career. And she followed through what she fledged epledged to do to confirmation hearing. If the president ordered her to do something she felt like was wrong or illegal, she did that. She lost her job because of what the attorney general asked her to do when she was a sitting senator. I applaud her for that. You can take this and spin it any way you want to and people can say folks are hacks and here again, ill take my liberty here in a few seconds to ring my bell and say, if they think that every democratic appointee is a hack, lets have a special counsel that can move forward in this investigation, where we can take away and all of that tarnishing aside and get to the bottom of what happened with the Trump Campaign, trumps advisers and ultimately the russians. And when did trump know it . That is the formation of howard bakers question about watergate. To what extent was flynn a free agent in talking to russia . To what extent was any russian influen influence, in ambient reality around the campaign and in the transition. And the first number of days when flynn flynn was in office. We would not be sitting here talking about this if, arguably, if the story had not been reported. It wasnt the underlying facts that drove flynn out of office. It was the leaking of those facts into the media. Even though this administration knew from the prior administration, the problems with Michael Flynn. Top Senate Judiciary hearing today. We had a president that was obsessed with leaks and wanted to control his government as much as possible. I think the central question here, is what did the president know about any kind of russian involvement in both the campaign, and then, during the transition, thats the first question. Hes already said that its a ruse, its fake news. He has gone remarkably far in trying to say, that hes not even sure russia did the hacking, which the Intelligence Committee unanimously if you know, you cant get anything unanimous in government, says happened. So, one of the things that one of the reasons we continue to have this conversation, he has not been clear about what he knew and whether general flynn was a free agent. Or whether he was talking to the president or other people around the president about the russia connection. Yeah. No matter what how much challenge control this white house tries to do, they cant really get anything they cant escape all of the russia stuff. Is it just beyond their control now, do you think . To some extent. The great question here. We talked about this before. To me, the russia story is a great test for what some people have called the posttruth era. If we were on another network, i suspect they would be having a different view of what happened in those hearings and what was discovered and learned today. Is in fact are in fact, is the country able to take on facts, to agree to the common facts and then make a decision about the conduct of the president . There are, basically, President Trump has made a bet as a candidate and as a president , that he can speak to his base. He can tell his base what is true and what is not true. And that they will be with him. And that if theres a contrary fact, he simply dismisses it. No matter how selfevidently true. And i think this is a hugely important i dont mean to be too grand about it. But a hugely important political and cultural moment for the republic itself. Can we have conversations and a public life, when we agree, when its dark its night and when its light, its day. And right now, a lot of dusk. Unless youre in an alternative universe. Dont you think even when i speak to some people who are donald trump supporters, when they come on the show, they say one thing on camera and another thing offcamera. You cant get them to say it. If you ever say this, ill deny it to the end. Dont you think at the end of the day, or deep down, people really know the truth. They just dont want to admed at because it could cause a disinnocence because their world would be thrown out of walk. If you take one card out of the house of cards, does it collapse . I think youre right. And youre exactly right, every presidency is like that.
