Active crime scene. One person was shot and critically wounded and is on life support. The victim was shot by another civilian, not by police. Four officers are injured. Lets bring in cnns nick valencia who is on the streets of charlotte right now. Nick, what is the scene this hour one minute at three in the morning . How many protesters remain on the streets there . Reporter rosemary, it was certainly an ugly night here in downtown sharcharlotte. What began at 7 00 p. M. Or 8 00 p. M. Local time turned violent quickly. It was in the matter of the last hour or so that the final protesters dispersed and a semblance of peace returned to the downtown area. This is the aftermath. We want to walk and we can show you this is one of the properties heavily damaged. Windows smashed out. The general manager of this hotel is having to clean up after the mess here. Matt, you want to talk to cnn here quick and tell us what happened last night . What did you guys go through . We had a lot of protesters that came out, and it was a little frightening. Our biggest goal is the safety of our guests and employees and really everybody here in the city. So i hate to see Something Like this happen in our city, but i still love charlotte. Why hayat . Its just where it is in proximity to the demonstrations . It was every business on the block. They hit the team store, the epicenter. A lot of damage up at the nascar hall of fame, a lot of the restaurants. Reporter from what you saw, we were talking to demonstrators and they said it didnt turn violent until the tear gas. What did you see . Early on in the night, it was peaceful. They seemed like they were in good spirits. There seemed to be good camaraderie, and i dont know what happened. They marched up the street a little bit, and then things got ugly fast. We know you have a lot of work. Take it easy. We have to watch ourselves. Lots of glass here on the streets. Rosemary, tear gas canisters. There were rubber devices fired. The protests were up and down about a half mile up the street. Its the site of one of the main stadiums for the sports teams in the charlotte area. When we got out on the streets at 2 a. M. , things started to calm down. Theres a heavy police presence. You see members of the North Carolina Highway Patrol with long guns, riot gear. We witnessed at least one arrest. One individual said he was just taken into custody. Im sure the police have a different story about that. Four officers injured overnight, and news crews as well were attacked. Our own cnn correspondent was knocked over by a demonstrator who told him to tell the truth before he knocked him down. There was a local affiliate crew assaulted. Those two members are in the hospital from our understanding. There was a bit of a indication early on yesterday that there would not be a demonstration and local Community Leaders would focus on a Community Town hall. That was not the case. Last night was just as violent, perhaps even more violent than the first night. This is all surrounding the shooting death of keith scott, a 43yearold black man shot by police on tuesday afternoon. People here, individuals, frustrated over what they say is a lack of transparency by the police department. No one has seen the body cam footage from that shooting. That resulted in a growing anger toward the police department. A live stream video by his daughter in the moments after where she alleged her father did not have a gun, was carrying a book. Investigators say they did not find that book on the individual. Rather, they did find a handgun. They say he was armed when they opened the fire. The family telling a different story. That encouraged demonstrators to come out and confront Police Officers and last night we saw more violence on the streets of charlotte. Nick joining us from the streets of charlotte in North Carolina. Were going to catch up with you again just in the second part of this show. So stand by. Christian summers was an eyewitness at the scene for several hours. Hes a student at the university of North Carolina, charlotte, and is back on campus. He joins me now. Christian yk thank you for staying up late to chat with us. Any time. What all did you witness while you were out on the streets during the protests . It was an interesting night. I got in to what is it called, caldwell and east trade street. By the arena around 8 45. When i got there, this was two hours after demonstrators started showing up for the initial protest. Everybody was pretty peaceful. And then as i kept awalking up toward college street, toward the epicenter, there were waves of people just running and yelling after loud noises and stuff like that. People throwing the police throwing tear gas. So youre saying everything was peaceful until the tear gas was dispersed . Yes. But the people were running and saying someone had been shot, but somebody is dead in the street. At this point living in charlotte, the past two days everybody has been really downtrodden because of the events, because our community of color like, the people of color in our community are just beaten. Its just another hash tag, seriously. We cant stop this, but its actually come to our city. So were you there at the worst of this when the protests got violent . I was there i dont understand what everybody is referring to as the violence. I actually had seen not in person but on cnn reports, like reporters getting tackled and thats not cool, but from where i was, i have not right, but the breaking of glass for many of these businesses. The vandalism of the businesses and the streets and landscape and stuff like that, that happened, and i witnessed that. I was walking past a ritz carlton toward, like, what is it, pretty much the center of where everything was going on where i saw the line of police and riot gear and a lot of protesters. I was standing on an elevator next to the epicenter taking video, and they started throwing tear gas. Everybody wanted to get out. Im running back. People are stopped and all kind of just sort of, hey, thats it. So the looting started there, i think unless there was other looting somewhere else. It was like this about at the epicenter, and there was talking, a period where i was doing a lot of talking between that and right before they went to the team shop at the hornets thing, and it was an interesting situation, for sure. So, christian, why did you decide to be a part of this protest, and what do you think theyve achieved here . As far as the more peaceful end of the protest that was going on earlier, i think that our community is trying to achieve it could be a lot of things. People of color are really just trying to attain awareness and attention at something thats been going on so long and people have been giving them the boot and not listening to their needs and wants. But instead, people are they have an issue of speaking for people of color and on the experiences of people of color which they dont have. Im sorry. I just lost my train of thought, but i dont know. My goal was to go there and just show my support for the black community and the black lives matter movement, because black lives matter. Its not that complicated. Everybody says all lives matter. Black lives are a part of that. All lives cant matter if black lives dont. All right. Christian summers, thank you so much for talking with us, an eyewitness there at the scene of the protests. Many thanks. Video of the shooting that sparked these protests has not been released as we heard from nick valencia there, and this is really why were seeing these people out on the streets. The officer who shot Keith Lemont Scott did not have a body camera but three other officers did. Investigators are reviewing that footage. Earlier cnns don lemon spoke with charlottes mayor. We are working very hard to bring peace and calm back to our city. We know that this is not who we are, and we are thinking of the words of the family of the scott family when the wife and family have said to please have peaceful protests, for people not to be violence, that violence will not help bring our community together, and were urging people to stay home and stay off the streets. We are urging people to listen to their Community Leaders, to their faith leaders. There was a Statement Released that said we do not support violent protests. You said earlier that you wanted Community Leaders to be able to view the video of the shooting so everyone would have the same information. Has that happened . We intend to do that tomorrow. Have you seen the video yourself in. I will be seeing it tomorrow. When she says tomorrow, she means thursday, just a few hours. Its 3 00 in the morning or just after 3 00 in the morning on the east coast. So well just hear more on this in a few hours from now. And don lemon also spoke with North Carolinas governor about the body cam videos. He warned they dont always tell the whole story. The one thing ive learned in this business for now 25 years as the city councilman, chairman of the Public Safety committee, as a mayor for 14 years and a governor for three. One viewpoint of a video doesnt always tell the whole story. The angles can make a difference, and not hearing often in the video the complexity, the video is one piece of evidence, and we have to be very careful, and then i go back to the Constitutional Rights of our Police Officers. Which you also have to protect. Yeah. And its a very delicate line that we as a society are dealing with with all the new media that is available. In one respect it can be used to a very great, positive thing for our public, in the other way the video can also be abused. You havent seen this video have you, governor . No, sir. The North Carolina governor there speaking to don lemon earlier. And as we mentioned, people are angry over the decision not to release the video of the shooting of keith scott. In tulsa, oklahoma, authorities almost immediately made public video of an officer shooting and killing an African American man. In that video, Terrence Crutcher can be seen with his hands above his head before he was shot in fact joining me now is a criminal defense attorney and constitutional attorney paige pate. Thank you for coming in and talking with us. As weve been saying, these new protests on the streets of charlotte, North Carolina, people are angry. Protesters are on the streets showing enough is enough as far as it comes with the Police Shootings of black men, and we saw with Keith Lemont Scott, the situation is that were getting two narratives here. The police are insisting he was armed, and witnesses and his family and those others who were present there are insisting he wasnt armed that instead he actually had a book. How do you reconcile those different stories . I think the only way you can reconcile the stories is to look at the evidence. I understand theres at least one video of what happened, but the police will not release that to us yet. To me, that suggests that the video does not necessarily support the polices version of what actually happened. While the police do not have to release Video Evidence when a case is under investigation, in many jurisdictions, theyll do that, especially if they think releasing the video will reduce the tensions, answer some of the questions and perhaps prove the officer was asking reasonably at the time he used excessive force. Thats interesting. The day before, and we were covering this in tulsa, oklahoma, we saw the Police Shooting, another black man, Terrence Crutcher. There was a lot of video. From the helicopter, video from the ground level, and people were able to make an assessment of what had happened. Now, again, different versions of events. Police insisting that he was reaching through the window to get a gun and so the officer shot him. We can see, and as his attorneys pointed out, we can see the window was closed. In that instance where you have that footage, people can make their own conclusions. But, again, how do you resolve that situation . It is so different now than it used to be. Before we had Video Evidence of what happened. Just several years ago before you would see all of this on a patrol camera or body camera or helicopter camera, you would just have the officers word, for the most part over what happened. And the officer would say well, the person had a firearm or i thought he may have had a firearm. I was in fear for my safety. That would have been the end of the story. Most people would have accepted the officers version of what happened and would not have made any further inquirienquiries. Now people can see for themselves what actually happened on the scene, and theyre second guessing the officer. That can be good and bad. As an officer you have to make a split second determination whether to use deadly force or not, and after the fact youre going to be judged on whether your decision was reasonable based on what was happening. Now other people can see that. We can investigate it and hold officers responsible when they jump the gun or when they acted inappropriately. And perhaps through these videos and looking at this evidence, we can improve police zit accident encounters to the extent theyre not as deadly as in the past. Right now the pendulum is swinging to the opposite end. Weve attentive and responsive to the incidents, and hopefully well reach a middle ground where officers behave appropriately and citizens reacting behave appropriately. Analysts pointed out the discrepancy. What were seeing in the wake of the new york and new jersey bombings, and with ahmad khan ra rahmmy, they needed him alive. They needed to question him and see if he had links to larger terrorist cells. People are saying why not do the same thing when it comes to black men getting shot and killed by police . Why is the same effort not applied . I think in some situations you have investigators who are better trained. You have federal agents focussed on terrorist investigations. Theyre working toward the same goal. They know what theyre supposed to do and share a Common Objective into getting the person in custody, investigating what happened and finding out as much as they can. On the flip said patrol officers may not be that experienced or properly trained just acting instinctively. Thats not a good thing in Law Enforcement. When youre encountering someone in an investigation, you have to rely on training and not necessarily split instant sort of reactions based on fear or insecurity. So i think were missing out on the training from forces across the country that we have in the federal level. I know Hillary Clinton proposed today the idea of National Standards for Police Officers in use of force cases. That would be a welcome change. We dont have that now. We have a ton of different policies around the country, and what may be okay in one jurisdiction is not okay in another. Page, thank you so much for talking with us. Appreciate it. Welcome back to our breaking news. Violent protests have died down from now at least in charlotte, North Carolina. Protesters smashed store front windows and vandalized businesss throughout the downtown area. Some even broke into the hayat hotel and assaulted the desk clerk and valet. Others threw rocks and bottles at police, injuring at least four officers. And one man is in Critical Condition after he was shot by another civilian. There was a lot of chaos, as you can imagine, in the thick of the protest, plus violence against our correspondents covering them. Take a look. Why cant you as a captain hold this officer accountable if what he does . It started as a peaceful protest outside the police department. Things were somewhat tense, but there were conversations being had. At this point people are kicking the tear gas at the Police Officers who are sending it right back. They just started shooting tear gas. The crowd of people broke up, and we are running from the scene. They were agitators getting pulled in police. A couple people started sitting down. Police grabbed one and thats when everything went out of control. Were trying to get various people, agitators out of the crowd. As other people came in and tried to grab these people [ yelling ] yeah. Were fine, anderson. Were fine. Just someone taking out their frustrations on me. Theyre throwing tear gas at you and me. Why did we get tear gassed . We werent being violent. We responded in a way that was frustrated aun and upset saying thats enough. That doesnt mean im violent. That means ive had enough. Scenes from earlier in the night. Charlottes mayor said theyve considered setting a curfew for the city. Earlier in the evening we spoke about whether that would work. Sometimes curfews work. They did not work very well in ferguson. I know that for a fact having been on the ground in ferguson when the governor put curfews into place in missouri, they didnt work. Because youll find those who are out to destroy property and to not exercise the First Amendment right in a way in which it was written, they dont care anything about curfews whatsoever, and it becomes more of a challenge for the police. That becomes a decision theyll have to make. The mayor is also trying to assure people that the investigation of tuesdays shooting will be transparent. Now, another matter up for debate is what the protesters are taking issue in with. The circumstances surrounding the shooting of Keith Lemont Scott remain unclear. Earlier we heard from the president of the North Carolina chapter of the naacp, an African American civil rights group. Take a listen. One scenario is that an unarmed African American man who had a book was shot and somebody planted a gun on the spot. Thats a possibility. The second possibility is that an unarmed armed African American who had a right to carry a gun was shot and the third is that an armed man was acting in a way toward the police that caused to be shot. We do not know. The tapes and the transparency has to come forward. And so thats why im holding comments until we see the tapes. We get the facts. Were saying to the protesters, its right to protest for the transparency. Those using violence, youre not serving the family or the cause of justice. Protests seem to be calming down for now in charlotte, North Carolina. Earlier the second night of demon strags turned violent. People have been protesting the Police Shooting of an African American man on tuesday. The clashes led officials to declare a state of emergency. We are about to show you a video that is very graphic. We feel the images show just how violent the situation has been. We dont know exactly how that man was injured or his current condition. But we understand that at this stage there was a man taken to the hospital in serious condition and on life support. Now, the deadly Police Shooting of Keith Lemont Scott sparked these protests. The police chief says scott was armed. His family says he was reading a book in his car when officers approached and shot him. The police shot my daddy four times for being black. They tazed him and then shot him. They just shot my daddy. My daddy is dead. My daddy is dead. S t scotts wife released thi statement quoting directly here. Keith was a loving husband, father, brother, and friend who will be deeply missed every day. As a family, we respect the rights of those who wish to protest, but we ask that people protest peacefully. Please do not hurt people or members of Law Enforcement, damage property, or take things that do not belong to you in the name of protesting. Nick valencia joins us live from charlotte. Nick, it looks quiet behind you there after an incredibly violent night. Talk to us about what has happened there and what the scene is there at 3 33 in the morning. The situation was incredibly ugly just a couple of hours ago. Were in front of one of the string of businesses vandalized by demonstrators. What began as a peaceful protest at 7 00 or 8 00 local time turned violent quickly. This is whats been left behind. You can see some of the businesses are just beginning the cleanup process within the last hour. Cleaning up the glass. There was graffiti, black lives matter, protesters painting blm on some of the businesses. As we walked up this block here, about a half mile up, its more of the same. We saw evidence of looting. Evidence of vandalized businesses. We also saw these left behind tear gas canisters or smoke flash bangs the police were launching at the demonstrators to try to disperse them. News crews were attacked. Police officers were injured. Some of them remain as they continue to block the guard here, North Carolina Highway Patrol. As we swing around the other side, we cant tell if these are protesters. They are folks that are continuing to stay around in the area. The last remnants of people here who are not dressed in full riot gear and not dressed in Law Enforcement gear. By and large the streets here are quiet again in charlotte. Nick, as with all protests in this modern age, social media has shown us some of the worst of what happened in charlotte wednesday night. Lets take a look at one twitter feed that shows young men trashing and looting a souvenir store, of all things. To what extent are local Business Owners suffering as we look at these pictures . We saw that souvenir shop just up the road here, and local businesses are scratching their heads, trying to understand how and why they were targeted. They didnt have anything to do with the shooting death of keith scott. Why it escalated to that point, i covered a series of demonstrations throughout the country after black men have been killed by police. When you ask them when they looted their own town, they say because you didnt Pay Attention until we did. Thats the answer, and im sure its one of the answers we can find here on the streets of charlotte. Organizers early yesterday had said there was not going to be a protest here last night. They said theyd rather focus on a Community Call to start the Healing Nature ke healing. That clearly did not happen. Social media, it was a live stream video from the daughter of keith scott that contributed to a lot of the confrontations with police. The video has been views hundreds of thousands of times. Its raw emotion as she finds out her father was shot and killed. People began to emerge on the streets on tuesday night into wednesday and confront Police Officers yesterday. We saw more of the same here in charlotte. Now, of course, keith scotts family is asking people to stop this. This is not the way to protest. They want to see more peaceful protests. This is the problem. This sort of thing moves away from the message. Its lost somewhere, and protesters want to see the body cam video of the shooting of keith scott. Why have the city leaders avowed releasing that . The mayor and governor admitting they havent seen it yet themselves, though they will in the coming hours. Why the reluctance to make it public . We know theres body cam and dash cam footage of the incident. According to police chief, it doesnt make sense of what happened at the scene, unfortunately. Also adding to the frustration among demonstrators of keith scotts family is a law signed into effect by the governor over the summer. The law makes Public Access to body cameras and Police Footage virtually nonexistent. You need a judges order to release it to the public. Thats a fact thats not lost on the community here. They want more transparency and want to see the video. They think the video would shed answers and light on what happened on tuesday afternoon at 4 p. M. When keith scott was shot and killed. The police chief says it doesnt show much. I think the public wants to see that video, and until they do, we might anticipate more of the same here in charlotte. That certainly seems to be the case. Christine, as you join us, we want to bring up that photo we showed our viewers earlier. Youre kneeling before the police. Talk to us about what was happening there. Yes. Hi. Thank you for having me on the show. Basically on tuesday evening i was told about the protests, and from there i decided that it was the right thing to go and see what was happening in and around my community. By going there, i realized there were other members of my Community Outraged and wanted to be a part of the movement. While i was there, i realized this was one time my voice could be potentially heard. I felt it was right and what i needed to do. I knelt down in front of the policeman and from there i went onto not necessarily give them a speech, but to talk to them as people. And talk to us about how that turned out. Some of the things i said included things such as thanking those policemen and women who do understand the fight that we are currently fighting. I want to thank them for those who respect us. Members in the black community as we respect them, and those who would rather fight with us instead of against us. Things of that nature. Christine, how do you feel when you see the violence later on as the night progressed . A lot of younger men came out and things got violent, and there was a lot of looting and destruction on the streets. How do you feel that and how it impacts the message youre trying to get across as a peaceful protester . To me, it hurts my heart to see it to know these are my fellow citizens who i also live in the city of charlotte with. And to know theyre buildings that other students of the university of North Carolina at charlotte use. It hurts us to see that these buildings are being vandalized and damaged because of the anger and outrages of other citizens when there are clearly other ways to get the points across. What do you think will happen on a third night, and if a curfew isnt put in place, would you plan to go out and protest on a third night . If there is a curfew put in place, i wont go out. I hope theres nowhere near as much violence as tonight, i cant predict what people do. Whatever happens, i pray everyone is safe and uses their knowledge and common sense when participating in these activities, but if there is another event tomorrow, as long as its peaceful and not as violent, i might possibly be in a ten danc attendan attendance. Theres still much we dont know about what happened in both inciden incidents, but we have two more names to add to a list of African Americans killed by Police Officers in these encounters. Its unbearable and needs to become intolerable. Reporter donald trump addressing the killing in tulsa questioning if the female officer may have choked. People that choke, people that do that, maybe they cant be doing what theyre doing, okay . Reporter trump made those comments at a church in cleveland where he invited don king to proentro deuce him. King using language unheard of in modern politics from the podium of a president ial mom kn nominee. If you have an intelligent intellectual, youre an intellectual African American. Trump did not acknowledge kings word choice. In a fox news town hall taped after the event, trump stressed his law and order message when asked how he would handle violence in black communitys . Stop and frisk. We did it in new york. It worked well. Reporter his trip to ohio, part of his latest pitch to black voters with whom he has historically low support. Our African American communities are in the worst shape theyve ever been in before ever, ever, ever. Reporter a false claim that vastly defies all of the facts of american history. Trumps comments spawned outrageous, including from john lewis, a Civil Rights Movement icon. I dont know where this man is coming from. Is he saying the conditions are worse than slavery . Clinton is leading trump among black voters. Shes struggling with younger African Americans many of whom supported Bernie Sanders and are considering a vote for a Third Party Candidate now. Demonstrators are furious that a Police Officer shot and killed an African American man on tuesday. The family of Keith Lemont Scott says he was unarmed. Police say he had a gun. Cnn has been reporting from the middle of these violent protests. Earlier we had a live report when a protester knocked our correspondent down. Reporter they were trying to get various people out of the crowd and other people came in and tried to grab these people [ bleep ]. [ yelling ] were fine, anderson. We spoke with one demonstrator about why he was there. Reporter why are you here . Im here to support the black movement. What is happening that you think that theres a movement that needs . Its justice. Were concerned about when something happens theres no justice. People are getting away with murders, and we want to know why theyre getting away with it. Reporter now, in this case the police are showing a picture. Theres a picture circulating that shows that mr. Scott had a weapon. Does that change your opinion . If he had a weapon or not, if he didnt point it, all the training the Police Officers have, why do they have to go to shoot . Why couldnt they taze. Why go to shoot instead of talking in person and putting the gun down if he had one . As soon as he had the gun, the first reaction is pull the trigger. He might have had something on his mind. Instead of trying to talk and get the problem resolved, went right to the trigger. Thats not the answer. Its to try to talk the person into if he had a weapon to put it down. In the coming hours were expecting charlottes mayor and other officials to watch the video of the shooting that led to the protests. Three of the Police Officers were wearing body cams inspect state officials are sending more Highway Patrol troopers to help keep the peace and protect property.
