President obama today, with tensions still simmering in baltimore, he addressed conditions that exist in many communities of color. Heres what he pointed out that a lot of young people, especially boys and young men, dont feel that society gives them a fair shake. Here he is. Too many young men and women feel like no matter how hard they try, they may never achieve their dreams. And that sense of unfairness and a powerlessness, of people not hearing their voices thats helped fuel some of the protests that weve seen in places like baltimore and ferguson and right here in new york. The catalysts of those protests were the tragic deaths of young men and a feeling that law is not always applied evenly in this country. In too many places in this country, black boys and black men, latino boys latino men, they experience being treated differently by Law Enforcement. In stops and in arrests and in charges and in incarcerations. The statistics are clear, up and down the criminal justice system. Theres no dispute. In every community in america, there are young people with incredible drive and talent. And they just dont have the same kinds of chances that somebody like me had. Theyre just as talented as me. Just as smart. They dont get a chance. The president made his comments here in new york while relaunching his program, my brothers keeper as a notforprofit foundation. The Program Mentors young men and boys of color. So just as the president spoke, another eruption of violence in baltimore, one week after the city exploded in chaos. Brian todd was on the scene with that today. He joins us now. Things got tense on the streets of baltimore after a false report of a police shooting. Tell us what happened. Well, don, there were some false reports of a police shooting. Some news outlets reported that. There were some people on the street saying that. They turned out not to be true. It was a real point of tension, because the gun incident that did occur happened near here the intersection of north and pennsylvania avenue. Its know about a real flash point for tensions, where so many of the protests occurred where some of the street violence and looting occurred. This gun incident happened a few feet away from the cvs pharmacy that was burned out. Police did observe a man walking with a gun through closed circuit camera. When they approached him, a brief chase ensued on foot. At some point as they approached him, his gun fell according to police and then discharged. He was not hurt. No one was hurt. And the Baltimore Police quickly sent out a tweet dispelling any rumors of a shooting. It reads as follows. The reports of a man being shot at north and pennsylvania avenue are not true. Officers have arrested a man for a handgun at the location. The Police Quickly told us this man did flee on foot. They pursued him. At some point, his gun fell onto the pavement and did discharge, but the bullet did not hit the suspect, it didnt hit anybody. The suspect had no injuries. He did not want medical attention. He did not want to go to an ambulance, but they insisted that he go in an ambulance out of an abundance of caution. He was arrested on a gun violation, don. But that was the except of the drama. The problem was, it happened just a few feet from here. Again, this intersection where so much tension has unfelded. So after it happened a cordon of Police Officers came out and blocked off this intersection. They were in riot gear. There were people jeering at them. It drew irritated crowds. But just as quickly, it ramped down. The police kind of folded up and left. We saw it playing out live. I need you to put the mike closer because im hearing the background noise better than im hearing you. Sorry. This is from fox news. Take a listen. The police got out the car and started chasing the boy. He ran down to the metro pcs. The officer shot that boy in his back. That witness was wrong. The officer had not fired a shot. The man is in custody, and police shot no one. But they were convinced the police had shot someone. Thats right, don. There were some rumors that the police had shot someone, even when the police came out and gave their version of things there were people on the streets who were telling us they didnt believe the Police Version was correct. So it really kind of accentuates the fact that theres still tension at this intersection in these neighborhoods here even after the mayor has lifted the curfew that the National Guard has announced that its withdrawing from the city that the mayor wants to get things back to normal as quickly as possible. Still it doesnt take much of an incident to ramp up the tension in this neighborhood. Brian todd thank you very much. Im joined now by liz brown, criminal defense attorney. And alan desh wits professor of law at harvard law school. Alan just a Quick Response to that very passionate eyewitness. And people so often think that they see things that never happen. This just shows you how unreliable eyewitness testimony can be. As we saw in mike brown and other cases. And theyre not lying. They honestly believe they saw it because theyre used to the narrative thats gotten into their head ask they confabulate. They fill in the blanks by the narrative that theyre been brought up to believe. She honestly believed that she had seen a policeman shoot. She saw a policeman running and somebody else running. And thats why videos are so important. Because videos dont have any history or culture or background. Theyre objective and neutral. And thats why the call for body cameras on Police Officers across the country. Right. Theres so much anger just under the surface, liz. How do people in the community and the police learn to trust each other, so this doesnt happen . The police need to be lawful in their actions. The police need to be honest when they fill out their police reports. The police need to not abuse people and not cause harm to citizens. This trust, this mistrust that people have of police in their communities, didnt appear out of thin air. We have a city of baltimore that has spent tens of millions of dollars paying for, paying people who have been brutalized by the police in baltimore. So how does it change . The behavior the actions, the honesty, the transparency of the Police Department must change. Lets talk about Marilyn Mosby now. She says she has all the evidence she needs and independent investigators working around the clock. She said she started during the shooting before sadly mr. Gray had died. They were collecting video Interviews Police statements medical examiners report found the cause of his death was homicide. Why wait now . Why the wait . Did she act too quickly . She acted too quickly and too provocatively. When you say, i hear you, no peace, no justice and telling young people this is your time. She made it seem it was more of a concern on how to prevent riots. And he doesshe did that particularly rushing in on the murder charge. Maybe she has the evidence but she never mentioned due process for the policemen. You cant just give justice to the victim the family and the city. You have to also do justice for the people who are accused. And a prosecutors job is not to keep the crowd from rioting. Its to make sure she looks at all the hard evidence. What i am afraid of, is if you have a jury in baltimore and theyre fearful there could be another riot if they acquit the defendants even if theres not enough evidence they might be inclined to worry about what impact an acquittal will have on their safety. Thats why i think there will be a change of venue. Do you think its a rush to judgment. Murder manslaughter the officers have to be convicted beyond a reasonable doubt. So do you think shell get convictions on such serious charges on a rush to judgment . Well lets step away from emotional hyperbole and talk about the facts in this case. We have a prosecutor who started her investigation a day after freddie gray was taken into custody. Before he even became a hash tag. And the notion as alan desh wits is saying, the notion that a prosecutor is supposed to provide justice for the defendants, flies in the face of hundreds of years of jurisprudence. I dont think ive ever heard someone say that a prosecutor is supposed to speak to the justice for the defendants. Thats like saying maria clark should have said, we need justice for o. J. Or the prosecutor for the boston bomber saying lets get justice for the people who bombed people. Thats not what a prosecutors job is. A prosecutors job is to look at the evidence and charge bad people that are that have committed crimes. This prosecutor has been working on this case a day after freddie gray was taken into custody. Right. In fact this prosecutor we have to also remember that this prosecutor is an elected figure. This prosecutor ran on the notion of i am going to pursue i want alan to be able to respond to what youre saying. Shes an elected official and she was campaigning. She was saying ive heard people say unless theres justice there will be no peace. So im going to give you justice. Not the kind of justice the law permits, but the kind of justice you demand. That is convictions regardless of the evidence and in exchange for that you have to promise me there will be no riots. When you make a Statement Like that then you have a special obligation to make sure that the people understand that the police have Due Process Rights and theres a presumption of innocence because a prosecutor cant be simply trying to respond to mob demands for their definition of justice. That turned out not to be the case according to police. Some local officials and residents say the outsiders are agitators. The perfect example, during the protest, when everyone is saying lets get the voice out, he gets up there and said lets shut the city down. They have an agenda thats dear to their heart and i dont fault them for that. They dont care about the results of what they say because they dont live here. Whitt says thats not his intention. He said residents here open their door to him. And even though whitt and others call protesting their profession he says hes not making much of a living off of it. The unemployed electrician said his travel expenses are paid by Community Members who believe in his cause. When i was coming out here somebody got my ticket for me. Im not part of an organization. But if youre out there covering it, did you notice where the protesters are from . Im going to talk to you about your piece, no doubt, but did you notice any of that or that wasnt part of your experience at all . No i didnt really notice that. No i didnt. Lord of the flies is a book about what happens to a group of young men who crashland on an island and all the adult men are killed. So they have to kind of grow up without any kind of male super vision and create their own society. So when i came back to west baltimore, i saw that similar situation. You have all the young men coming up without the older men in existence, theyre not in the community. So these men, as one told me theyre onthejob training trying to figure out how to be men, but they dont see other older men around them to show them. And the lord of the flies is like that. You spoke to a man. And he said this is old here pointing to himself. Where you been . They got big numbers, or theyre in pine boxes. In street syntax that pleant long prison sentences or death. So what happens when theres this vacuum of older men in the communities . I think we saw we see what happens a little bit this past week in baltimore. I think theres a lot of misdirected rage. I mean what that guy told me is one of the saddest things ive ever heard as a journalist. I think when you dont have men, a guys internal moral compass doesnt really develop. I think at a certain point, young men tune out women. They wont listen at 15 or 16. You need a coach or mentor or uncle or a neighbor to really reach that guy. If they dont reach him, they can do so many things that could almost be barbaric. Like what Elijah Cummings is trying to do on the streets of baltimore. John blake, thank you. One of the gunmen tweeted his loyalty to isis right before the attack and a source tells cnn that the other gunman lived for a few years in pakistan. Aleapileenlina is in garland, texas tonight. What is the latest on this investigation . Reporter well don, weve learned more about the alleged gunmen. Police say they showed up heavily armed with assault weapons and wearing body armor when they showed up on the mission to kill. According to a federal Law Enforcement source we know the identities of both men. One is elton simpson. Police believe simpson lived in an apartment in phoenix arizona, with the other gunman identified as nad ir soofi. Authorities say this all unfolded very, very quickly, in a matter of about 15 seconds. Thanks in large part to the actions of a quickthinking officer, who typically works traffic, but was at this event here last night working security. I want you to listen to what police say how this all unfolded. Both of them had assault rifles came around the back of the car and started shooting at the police car. The Police Officer in that car returned fire and struck both men, taking them down. We think their strategy was to get to the event center into the event center, and they were not able to get past the outer perimeter that we had set up which was part of that security. Reporter now, its worth noting that the organizers of this cartoon drawing contest paid thousands of dollars in extra security costs because they knew that what they were doing was extremely controversial and that it was going to be very offensive to some don. So he was an isis sympathizer. He was also convicted in 2011 of making a false statement involving terrorism. Reporter Pamela Geller is well known to american muslims. Shes a mascot of such a movement. The movement muslims say, against their religion. We list that group as a hate group. I would rank pam geller at the top of the list for antimuslim figures in this country. Certainly she and her very close ally Robert Spencer at the top of that list the ones who influenced anders and his antimuslim rage when he did that norwegian rammage in 2011. Hes a norwegian mass murderer who set off a car bomb in oslo and opened fire at a youth summer camp, killing 69 people. Geller and spencer were cited multiple times in gellers manifesto, the killer defending geller as a decent human being. Gellers group has spend upwards of 100,000 on bus and subway ads in new york san francisco, and chicago, ads, against jihadists. Attempts to quash the ads were unsuccessful. A federal judge in manhattan ruling they were protected under freedom of speech just like the prophet cartoons says geller. My event was about freedom of speech, period. If you ban geller you would have to ban much of the antijewish hate speech. Hate speech is protected speech under the constitution. It isnt even a close case. Take a listen. The First Amendment protects all speech not just ideas that we like but even core political speech ideas that we dont like because who would decide whats good and whats forbidden . The Islamic State . The government . Inoffensive speech, alison needs no protection but in a pluralistic society, you have exchange of ideas. You dont shut down discussion because im offended. She sounds like what alan is saying like she was mimicking alan. But do you think she was really after free speech amani . I really dont think this is an issue of free speech. Honestly. I dont i or anyone would argue with her right to say what she has to say. She can draw the Prophet Muhammad all day and night and it doesnt affect me. But theres a reason why she continually targets islam and muslims as a whole. She doesnt say radical extremists or any of that rhetoric. She talks about muslims. In 2010, she was quoted saying that western muslims, even when they pray five times a day, they are cursing christians and jews five times a day. She just won against new york courts to put up these advertisements that, you know allude to muslims hating jews. Maybe her behavior may be despicable to some but still, she still has the right to do it. And listen i want to youre not condoning what happened. Youre just giving context to her actions, correct . Absolutely. I mean no one is saying that she shouldnt be doing what shes doing, and no one is saying that the type of violence that we avoided last night is justifiable by any means. What were talking about is the way that shes going about this. Right . Shes choosing to ridicule Prophet Muhammad as a way to offend 1. 6 billion peaceful muslims around the world. And im not sure if this is really a freespeech issue. To me, it seems more like she has an antiislam issue. I want to play this. Take a listen. Groups which i refer to as hate groups such as Pamela Gellers group, they try to stretch the meaning of free speech to its outer limits. There is a difference between hate speech and incitement to violence. Which you take certain actions, and you know that the results of those actions will result in violence in this country, in this secular country, that is a criminal act. Imam before i get you in here i want to get the attorney on the panel. Hes just dead wrong. If you incite people to act against other people. If i were to make a speech saying go get don lemon, thats one thing, but if you make statements against other people and they then respond by trying to kill you, thats called hecklers veto or the fighting words concept. And those are constitutionally protected. You should stop the people who are trying to attack you. You have to protect the gellers even though you dont like what theyre saying from the people who are trying to kill her. You cant bring into the concept of incitement that other people are trying to stop geller otherwise we would have no free speech. You could always then by threatening violence end free speech. Imam i want to get you now. You told the members of your community not to protest it. Why is that . Yes, we were aware of it three months prior to the event taking place. We prohibited people from going, told them not to go and the reason we told them not to go, first of all, we didnt want to give this woman any more publicity, and we also respect the issue of free speech. The whole agenda that she has and the argument that she has is that the muslims dont approve of free speech, they dont like free speech. There wasnt a single muslim protester out there, out of a quarter of a million muslims in the dfw area. She said it to my colleague, its not about muslims. Its about violent jihad. You dont get that distinction when shes talking about those issues . Whenever she talks, she uses the word islam and paints everybody with a broad brush and gives the opinion that muslims do not approve of free speech. And the reality shows that none of the quarter million of the dfw muslims were actually there at the event, to protest any of her caricatures or cartoons she was trying to portray. So the question is, and i heard amani say this she talked about doing this and insulting, you know theres a book of mormons on broadway there are all kinds of things. There was a musical back in the 70s that was about jesus christ superstar. Of course. You live in a pluralistic society, you have to develop thick skin. You have to understand that youre going to be insulted all religion is going to be insulted. Argue back, make a better case win in the marketplace of ideas. So the degree of danger should not play into no. The degree of danger if somebody is inciting their own people to attack thats one thing. But if you attack the speaker, police have an obligation to protect the speaker. If a few people had been killed in this would you still feel the same way . Yes, i would. And i felt the same way with Charlie Hebdo, where 11 people were killed. You go after the killers, not the speakers. You dont let the killers stop the speakers from speaking. You dont let the threat of violence stop political speech from occurring. Amani, what do you say to Pamela Geller . So if were going to talk about inciting hated red, look at the speaker, wilders, who is a dutch politician. His own government brought charges against him for inciting hatred and discrimination. So they know whats up. And were defending Pamela Geller. Last night he was quoted as saying, no more islam, no more mosques, no more islamic schools. If we want to talk about pluralism, lets talk about it. Its about vitriolic rhetoric that were allowing to fly by under the umbrella of free speech. We have to get real about the consequences of that. We want to talk about protecting speakers but what about american citizens who are targeted because of the hatred that Pamela Geller incites . Like this morning, i was afraid to step out of my house with a headscarf because of the result of potential hate crimes because of last night. Because of Pamela Geller . The situation last night and event was recorded. An soon as one of the security personnel came in the first exclamation that was made was he muslim . We only care about the religion of the perpetrators when they happen to be muslims.
