Called this another fake news story out there. Well, is that how it ended up . Friday morning the president delivered a series of contradictory talking points and insisted the conversations he had with ukrainian officials under scrutiny were, quote, totally appropriate and beautiful. Then later said he couldnt remember them and said he had not read the whistleblower complaint. Then in the next breath claimed that, quote, everybody had read it, they laughed at it. By the weekend however the president was largely confirming all of it. Even defending it. Here he is. I had a great conversation. The conversation i had was largely congratulatory, was largely corruption, all of the corruption taking place, was largely the fact that we dont want our people like Vice President biden and his son creating to the corruption already in the ukraine. Okay. So there it is in his own words on camera and all of this while he attacked the whistleblower for what he called spying at the same time continuing to suggest with no evidence that biden has acted inappropriately. Joining us at the white house with more is joe johns. I want to reiterate no evidence at this point in time that joe or hunter biden did anything inappropriate here. Right. I think thats very important to underline because the president has been trying to shift the narrative, when this is really a question about what the president said and the timeline of all of this. The president , as you showed in that clip, said this conversation with the newly elected president zelensky of ukraine was largely congratulatory, but the president also said he talked about corruption and also said that he talked about joe and hunter biden. While theres no evidence they have anything to do with wrong doing or corruption. So the best evidence of all of this obviously would be the release of a trips of that conversation to at least attempt to clear the air or show people what the president did, in fact, say. However, there are some of the president s lieutenants who are opposed to releasing such a trips, including the secretary of state and the secretary of the treasury, both saying that conversations between World Leaders ought to remain private. That is an internal debate that the administration has to continue working with, even as we move closer to that thursday deadline when the speaker of the house wants to get the complaint from the whistleblower to try to detail what specifically it was that individual was concerned about. And we look forward to trying to get the white house to give us any clarifications they can, even as the president is up at the United Nations this week. Back to you. The white house is going to make that claim on president ial conversations being private, but on the whistleblower complaint, the law is clear. So clear. It has to be reported to congress. Joe johns, thanks very much. The latest reaction from lawmakers on the hill. Lauren fox joins us now from capitol hill. Lauren, the division on the hill has been between 150 some democratic lawmakers who support impeachment, resists being resisted by the leadership, nancy pelosi, adam schiff and others, tell us, speaking to democrats now, has this shifted the dial sufficiently for democratic leadership on the question of impeachment . Well, over the weekend, jim, House Speaker nancy pelosi sent a stark warning, basically arguing the administration needed to hand over that whistleblower complaint by the end of the week, in a letter, rare letter over the weekend, she wrote to her colleagues quote if the administration persists in blocking this whistleblower from disclosing to congress a serious possible breach of constitutional duties by the president , they will be entering a grave new chapter of lawlessness which will take us into a whole new stage of investigation. We also heard from the intelligence chairman adam schiff who has so far been trying to keep things pretty even when he talks about impeachment over the weekend, he told our colleague jake tapper impeachment may be the only remedy if they cant get Something Like this whistleblower complaint. Heres what he said. If the president is essentially withholding military aid at the same time that he is trying to browbeat a foreign leader into doing something illicit, providing dirt on his opponent during a president ial campaign, then that may be the only remedy that is coequal to the evil that conduct represents. Of course, this underscores a larger debate that the Democratic Caucus has been having for several months now. Liberals who say this is the time to do impeachment. You saw alexandria ocasiocortez tweeting at this point the bigger National Scandal isnt the president s law breaking behavior its the democratic partys refusal to impeach him for it. Expect this week there is going to be more calls on capitol hill to move forward with impeachment. We will be watching what Speaker Nancy Pelosi has to say about it. Dana, begin with you, adam schiff and nancy pelosi both chose their words carefully, but there is a shift, okay, i just wonder how significant you think it is, is this a shift that will result in both of them finally saying, now is the time to move forward on impeachment . So i have two different answers for two different parts of that question, poppy. All right. First, the significance. Hugely significant that these two people, obviously especially nancy pelosi, but including adam schiff, have been very reluctant to even go there on impeachment. Adam schiff with jake tapper went much further and used the i word. Nancy pelosi for her, more a shot across the bow at the administration while also a message to her people, i hear you, important for her to do this weekend given everything that happened last week, which we can get to in a second, but whether or not this will get to that point is still to be determined because pelosi and even schiff and others who have been more cautious, still look at two things one the broader is Public Opinion and is Public Opinion there yet and two, even sort of more micro on the Public Opinion, is that the case in places that are not alexandria ocasiocortezs district or the west coast in, you know, urban areas in california, meaning in areas that will decide not just the house of representatives if she continues to be speaker, but the president ial election, whether that is seen as a bridge too far and could help the president in 2020 as opposed to hurting him. You have the politics, this is a political process, impeachment is a political process, but the substance two. For two years the special counsel investigated whether as candidate President Trump was willing to accept foreign help in the election. The circumstances of this is the president asking for foreign help in effect, to attack a political opponent, and possibly, we dont know this yet, possibly demanding or pressuring and somehow tying military assistance . Qualitatively, thats a step up, is it not . Look at the timeline here. July 24th was the day of that big mueller hearing where the special counsel testified on capitol hill and made all the details and his pronouncements about that report. The phone call thats in question came july 25th. Of all the reporting bears out and we have no reason to believe that its incorrect, in one day after essentially the close of the special counsel investigation, that has just created such a cloud over his presidency for the first two years, he goes and makes this exerts this Pressure Campaign against the ukrainen president. What youre hearing from republicans with a couple of exceptions, were looking for more information, no explicit quid pro quo and well, you know, defer to what the president is saying at this point. But you cant lose sight of the fact and democrats are pointing out the president was actively, you know, using the power of his office to try to dig up dirt on his political rivals and that cant be underestimated. Eight times according to the wall street journal. Dana, mitt romney, kind of on an island now, i dont know if that island will get more populated but heres what he said if the president asked or pressured ukraines president to investigate his political rival directly or through his attorney, it would be troubling in the extreme. Critical for facts to come out. Does he remain lonely on that island . Right now he is lone hi. Its significant that he is one person on that island for the Republican Party because he has been very critical historically of the president , but since hes been a senator he has chosen his public criticism carefully and the fact that he decided to come out and put this tweet out saying i want more information is telling. Its also if you kind of marry that with the letter going back to the letter that nancy pelosi sent over the weekend, it was Dear Colleague letter not just to fellow democrats but to all house members including and especially republicans saying this is not this should not be a partisan issue. Republicans, you should be asking the president of the United States for information. That is really important and just if you look at the kind of the numbers among house republicans, you do have a significant number who are saying theyre not going to run for reelection, theyre retiring, so they dont have political they have Political Capital to spend if they see this as something that is necessary and im told that adam schiff and nancy pelosi did have consultations over the weekend as they found the pressure mounting by their fellow democrats they wanted to take a step not just to talk about democrats but remind people this should not be a partisan exerci exercise. Try that again. Speaking in terms of islands historically it hasnt been. Were in different territory. Islands, the far more populated islands are the silent one and frankly the one getting bigger are youre right. The president said this weekend he hopes details of the call will be released. That statement at odds with what secretary of state mike pompeo and treasury secretary Steven Mnuchin are saying. We dont release transcripts often. Those private conversations between World Leaders and wouldnt be appropriate to do so except in the most extreme circumstances. Theres no evidence that would be appropriate at this point. I think that would be a terrible precedent. Conversations between World Leaders are meant to be confidential. Joining us now cnn political analyst john avalon and elliott williams, a former federal prosecutor and cnn legal analyst. Elliott, let me begin with you because i want to get a legal question here, we know because the president has admitted it, he discussed joe biden, a potential rival for the in the general election with the foreign leader, bringing up investigating that person. Legally, does that meet the standard for conspiring with a foreign entity to get something of value in a u. S. Election and then i guess the followup question is, if he also tied military assistance to that, what is the legal difference beyond that . Well, you know, were i wouldnt focus too much on the legal question as to what the crime would be. We know that president or at least we believe that president cant be charged criminally for conduct committed while in office. He cannot. But congress can pursue impeachment based on a perceived violation of the law. Thats exactly it. It doesnt need to be a violation of the law, what it needs to be is a violation of the president ial oath of office. If it is seen the president is acting to his own benefit or, you know, engaging with a Foreign Government in a matter not in the United States interest thats an impeachable offense. The problem here is that the definition of what constitutes a high crime and misdemeanor the language in the constitution for whats impeachable is vague and its up to congress to decide. If they decided today to file an article of impeachment they would have a basis for it. John, what do you think we learned from u. S. V nixon in all of this . There you had articles of impeachment filed in order to obtain tapes and transcripts and documents, could that be the avenue for democrats at this point to obtain the documents that they cannot yet get their hands on. Thats one avenue open to them and thats one of the arguments this should be about a deeper investigation into the outstanding questions that surround the trump presidency, for example, the Mueller Investigation did not get to. The second article of impeachment against nixon was about abuse of power, using in part domestic agencies to get information on his political opponents. So there is a precedent that people should be wide awake about. The larger issue, one, in that high crimes and misdemeanors, the word before it is bribery, questions around the withholding of the ukrainian aid could that be thats interesting this is a festival of projection that the president of the United States accusing, you know, a political rival of corruption and dealing in trying to influence elections and outcomes with foreign powers. This occurs a day after the mueller hearing. Hes doubling down on the same sin. Theres an easy way out, folks. Its not about the transcripts. Its about releasing the whistleblower report as the dni is required to. You heard that argument being made by officials too, it would be a bad precedent, the law states. The impeachment process is a political process and a political question, do you have the political will in both parties to pursue. To impeach the equivalent of indicting you need a majority of the house you could have based on democrats but for it to go anywhere you need twothirds in the senate. Has this moved the dial on that political question . Its hard to know whether its moved the dial. You saw the tweet from mitt romney this morning. I know you were covering it a little bit earlier. This has become a question of democrats versus donald trump, when really its the institutional interests of Congress Versus the office of the presidency. I think the failing here is even highlighting mitt romneys tweet gives the republicans a free pass. They are part of congress as well. What were seeing here once again is a presidency or a president ial administration that just doesnt respect congress authority and this whole thing as you were talking about with john about the release of the whistleblower report is about the administration versus congress. And so again, maybe its a question of political will but this exposes the fact that republicans in congress are der ril elect in a basic duty to look at this objectively and fairly. John, do you think that because of what has preceded this in terms of what has been the basis of democrats calls for impeachment, a number of things, first it was, you know, conduct with russia, then emoluments and then this, does that hurt the democrats public case here, simply by those who would say to them your method is kitchen sink . Those things didnt work and now youre using this . That may on the level of perception, but you could also say theres an accumulation of data points that demands an escalation. You could see it both ways. I do think that, you know, for democrats part of the key question is the principle over the politics. Everybody knows cut to the chase that senate as currently constituted is not going to convict donald trump. But you got a basic problem which is that flies against americas sense of fairness and common sense. Republicans treating the basic idea that if a republican president does it, it doesnt matter. On something they would scream bloody murder appropriately about if a democratic president did it. Situational ethics. Thats the underlying issue. We cannot divide on basic questions of right or wrong. Thats where were at. Situational ethics. Good way to put it. Elliott and john, thanks very much. It is important to emphasize again that despite what were hearing from the president and, of course, his personal lawyer Rudy Giuliani there is no evidence whatsoever of any wrongdoing by joe biden or his son hunter in ukraine. Pressured to fire there, the question from the obama administrations point of view was that that prosecutor was not effectively rooting out corruption in the country. What strikes me that is big, no clear leader, joe biden and Elizabeth Warren are within the margin of error and when you look at the Favorability Ratings she has a lot to be happy about. Look at the trend line in the pollrs right. Shes jumped from march up to 58 in june and up to 22 now, joe biden going the other direction. Bernie sanders falling off. What you pointed out is key look at the internals of the poll. If you look at the favorable ratings shes up to 44. Actively considering voting for, even if shes not your first choice shes up there. Overall its a very good poll for help. My question honestly is why isnt she doing better despite the fact that her favorable ratings are high if . Even better. Thats interesting. One thing that struck me is 48 of very liberal likely caucusgoers, because we know the rules here they have to get up and go say they prefer warren versus 20 who prefer Bernie Sanders. If you are Bernie Sanders or running his campaign what are you thinking and what are you going to do . Thats a tricky question for the Bernie Sanders campaign because they have been saying for months that they dont intend to go after Elizabeth Warren, right. There is this nonaggression pact between them and one of the arguments, though im curious because i havent always seen this play out, they feel some of their supporters will potentially pull away from joe biden whereas Elizabeth Warren is pulling from folks like Kamala Harris or pete buttigieg. They say theres not always going to be overlap in support of where folks are with their second choice. I will say this poll suggests maybe thats not entirely true. As weve seen Elizabeth Warrens momentum cease weve seen sanders decrease. I mean i would just look at the numbers and take a look at how these people voted in 2016. Sanders versus clinton and apply that to 2020 and you see Elizabeth Warren has gone into Bernie Sanders camp and leads among those caucusgoers who said they were going, they went for Bernie Sanders in 2016, but the interesting thing shes pulling from the clinton camp while sanders isnt and it shows that Elizabeth Warren is relying on those Bernie Sanders caucusgoers from 2016 to build her support. I think this poll indicates that the Bernie Sanders camp made a miscalculation. If you ask the biden camp theyre not worried about this. A podcast that is called campaign hq and his first guest is greg schultz running bidens campaign. He said, quote, the actual path to a nomination is not necessarily to win states, although thats very important. He says, its actually the path to delegates and earning delegates and a very prescribed way by district by state. He is playing down, sounded to me, like the importance of these first states for biden. That is a smart strategy . I mean the Biden Campaign has done that even on press calls with reporters. They certainly have played down the importance of iowa and New Hampshire and part of that is the demographic makeup of the two early states. They are overwhelmingly white and look at where joe bidens support comes from part of why he remains resiliently popular because of the overwhelming support he gets from africanamerican voters. Thats where senator warren has struggled. You know, as biden seems to be very popular with most specifically older black voters she doesnt seem to have those levels of support. Why we see her do really well in iowa and New Hampshire and the Biden Campaign strategy is theyll do well in south carolina, carry through to super tuesday. All right. Finally, cory booker, harry, raised a lot of money over the weekend, 500,000. The goal his team said we have to raise 1. 7 million by september 30th or were done here. Part of that might be a campaign stump but also part is, its not just about getting to iowa, its about winning iowa. You need an organization on the ground. Elizabeth warren spent a lot of money early on with the hopes shuflds be able to raise the money and back it up. The fact is if you dont have money to build an organization to get ads on the air youre not going to win. Booker doesnt just want to limp in iowa but win in iowa. He was below 5 . Hes not there yet. The iranian president taunting the United States saying that President Trumps new sanctions shows america is desperate and out of options. Right now iran is holding its annual holy defense week with a huge set of military parades and it is also showing off its Ground Forces and weapons including the one that took out that u. S. So lets begin with the president. Iran has carried out really a series of provocative acts. You have the attacks on tankers, a shoot down of the u. S. Drone and the u. S. Believes an attack on saudi oil facilities. The president has not authority rised a military response and called one back minutes from it happening. Has he, in effect, emboldened iran . I think, jim, the president s problem going to the u. N. Is that he appears weak in response to these actions by the iranians over the last six months. In the hard bitten world of middle east politics, with both the sunni arabs and the iranians, the president doesnt appear to be standing up to the challenge. Now hes got a little bit of time. He may want to use this week to see what kind of support he has out there. I think its very little, frankly, with the europeans, the russians and chinese, but he has to do something because iran, jim, is posing a major threat to the free flow of oil and gas in the middle east. For 45 years the United States, working with israel, working with the arab states, has tried to keep the gulf open. Iran is trying to shut it down, show that it can shut it down. There has to be a stronger response, whether its covert, cyber or a military, in my judgment from the president. But then what happens next . Lets say he carries out a strike and you saw Lindsey Graham who says that president needs to restore deterrence as youve been saying there, so theres agreement. Lets say he were to retaliate in effect impose some costs for the military action by iran, what next . Because the president has pulled the u. S. Out of the nuclear deal, hes continually ramming up sanctions which is biting with the iranian regime, but he has not been able to get european allies on board for that. What is the next step . The president talks about speaking to the iranians but what would they speak about i dont think theres much theres always used to have a diplomatic channel to the iranians to pass tough messages and warnings. The administration gave that away. John kerry established it with the Iranian Foreign minister and secretary pompeo does not want to talk to them. Thats a problem. I think, jim, there has to be a tough american response, but what has to happen with it is a diplomatic effort by the administration to try to get the europeans to support us, at least in sanctions. Thats tough when weve walked out of the nuclear deal and weve threatened secondary sanctions against european countries, so i think the Administration Needs to build up this diplomatic option and needs to keep the russians and chinese at bay if, in fact, were going to try to reestablish deterrence and we have to against the iranians. As you know, the president runs every one of those decisions whether iran, china, russia, ukraine, through a political lens as to how it affects his own political fortunes as 2020 approaches here. Given that drive from his perspective but i imagine a regeenl like iran asking the question will President Trump still be here in a little over a year, does that give you the conditions for substantive resolution to this . No. I think this is a longrunning problem thats going to fester but youre right, the problem in iran with iran policy is the president appears to be putting his shortterm political interests ahead of what many people think is our national interests, the same thing may be happening on ukraine, of course, where he asked the ukrainian president essentially to investigate joe biden and interfere in our election, the president puts his president ial, political interests over the national interests. We have real interests in the middle east. The president has to act on behalf of those interests and of all americans. I dont think hes standing up to it right now.
