For people to come out of the woodwork from 36 years ago and 30 years ago and never mention it, all of a sudden it happens, in my opinion, its totally political. President there calling those allegations totally political. Lets get right to cnns abby philip at u. N. Headquarters. Abby, for days the president had held his tongue. We saw that change the end of last week. With developments over the weekend now, the president here clearly doubling down on his Supreme Court nominee. Absolutely, jim and poppy. The president is fully going at this issue in the way he would like to. Over the weekend, he was briefed on some of these new allegations regarding Brett Kavanaugh, according to his aides, but they also say that the president is Still Standing by his nominee, that he has no plans to withdraw kavanaughs allegation. And, as you pointed out, on friday the president sent out a series of tweets, suggesting that Christine Blaseyford should have gone to the fbi 36 years ago. That prompted Mitch Mcconnell, the Senate Majority leader, to call the president and warn him, they are not helpful in this effort to confirm kavanaugh. Clearly, the president is leaning in on his nominee. He has long been a skeptic of these me too allegations that have, frankly, embroiled him and many people around him. Now earlier this morning, the second allegations that emerged last night in that new yorker piece, ronan farrow, one of the two authors in that piece, explained key details, questions about whether or not this womans new allegations were corroborated by anyone that she knew at that time or who might have been present at the party. Here is what he had to say about that. There is a strong evidentiary basis. Her claim is corroborated, as you said, to the extent that is not always possible by people who did not know her, have not interacted with her yet recounted the same fact pattern. Some people are on the record so i point you to the piece. And the other reason she decided to speak, john, which is this is a story thats out there on the hill. Its being investigated. Its a matter of news, whether she tells her own version of this story or not. And, jim and poppy, we are already starting to hear from white house aides, questioning whether there are people corroborating this story. I think what ronan had to say is pretty important. Youll hear from the white house this week that there are not enough people to corroborate that this event happened. Theyre calling into question this entire series of accusations against kavanaugh. Yesterday, we saw kavanaugh put out a statement, calling this a Smear Campaign against him. So, clearly here the white house is trying to change the thrust of the story, making it less about the accusations and more about what they consider to be a coordinated campaign to bring down their nominee. By thursday, we will have a hearing, including ford where she testifies before the Senate Judiciary committee. Clearly, this issue not going away at all. Poppy and jim . That is the plan for now. Although the ranking democrat on the Judiciary Committee, dianne feinstein, has said delay, delay, after this second accusation came forward. Abby, thanks for the reporting at the u. N. So many more questions this morning of who knew what and when and what the Judiciary Committee plans to do with all of this. The plan now remains, right . Have this public hearing with only these two witnesses, ford and kavanaugh, 10 00 a. M. Thursday. Is that right . Thats what were expecting at the moment. Last night i reached out to the Senate Judiciary chairman Chuck Grassleys office in the wake of the new yorker article. And an aide to grassley told me they would look into these allegations and also denied having any knowledge of what the new yorker published before it actually did. And then they attacked democrats for what they said was, quote, actively withholding information from the committee about these allegations. When i reached tout Dianne Feinsteins office about this, they said they had no prior knowledge about the details of this story before it went before it was published last night. In that article, it does we have since learned that the woman who is making that allegation in that article did reach out to some staff member from a member of the Senate Judiciary committee, democratic staff member who then put her in touch with the colorado senator, michael bennet, a democrat, who connected the woman making the allegation with a colorado attorney. And thats where it kind of went from there. These all the question remains for grassleys staff whether or not they will bring forward Debbie Ramirez, the woman making that allegation, or how theyll pursue this further. At the moment, no plans to change that thursday hearing between Christine Blasey ford making that allegation and judge kavanaugh, no word, no expectation of any outside witnesses, poppy and jim. We heard from the president there, questioning the motives of the accusers, questioning the attorneys. You heard the president speaking there moments ago, he said you should look into the lawyers here. Hes clearly pointing to politics. What do you make of the strategy shift . I dont think its helpf fufo them. What youre looking for to tell if a witness is telling the truth is corroboration. Its very hard for the president or anyone else to say someone is or isnt telling the truth before youve had a hearing or any investigation. I hope that thats kind of where this is headed. Well see. He is obviously not thinking that way right now but thats the only way well get to the bottom of this. And it raises the point that we raised, which gives Brett Kavanaugh the opportunity of answering to this and having a fair hearing as to whether there are facts behind this. Molly ball, i wonder if i could ask you, the politics, of course, central to this, the president doubling down, tripling down, i suppose you could say, on Brett Kavanaugh. Does he believe that he has gop senators with him in that . Of course, if this hearing goes ahead on thursday, he needs several key swing republican votes. That is the key to the politics of this. I think theres two keys to the politics of this. Number one, does kavanaugh have the votes . At this moment, i dont think he does or they wouldnt be holding this hearing. Theyre holding this hearing because those on the fence republican swing vote senators feel like they cannot go through with this vote until they hear from her and the second part of the politics of this is the backlash from female voters when we are just a few weeks out from an election, when women motivated to vote have already been the central dynamic of this election season. And that is whats making a lot of those republican senators nervous. In addition to, you know, a sincere desire to get to the bottom of this and to find out to the extent that its possible whether or not these allegations are true. Errol lewis, are there not risks for democrats here as well that because there are republicans who believe the president s line and other republican senators line that this is driven by politics, right . Is there a risk for democrats if this becomes a motivating factor for republicans in the mid terms, which had been a concern for republicans, right . Weak enthusiasm. Look, the question is, whose politics will prevail on the republican side . That will determine where the democrats end up. The president is suggesting that the republican senators do what he would do, what he has, in fact, done. In the closing weeks of the 2016 campaign, over a dozen women came forward and made all kinds of accusations against the president. What did he do . He insulted them. He threatened to sue them. He never acknowledged any kind of a process. Of course, he never did after the fact. It worked out for him. Hes the president of the united states. Hes trying to put that kind of steel in the spine of the senators. They have an entirely different set of concerns. It is possible that the democrats could fumble this. If the witnesses are not all that credible, if their testimony kind of falls apart. If theyre not as impressive as, say, anita hill was 27 years ago. The case starts to maybe flounder a little bit. Also if the republicans just force it through, which appears to be the strategy the president wants them to follow, and holds the vote regardless of whats heard in the testimony, it starts to fade as an issue that they can run on. Not only did Clarence Thomas get does he still sit on the Supreme Court but also his Approval Rating went up after americans heard her testimony. Lets listen. Molly, this one to you, to kellyanne conway, counselor to the president , just this morning. I personally am very agrieved for all of them. Are we going to put decades of pentup demand for women to feel whole on one mans shoulders . What exactly is the standard for ruining one mans life based on decades old allegations that have nothing to do with him . I think one mans shoulders should bear decades of the me too movement. She says, molly, one mans shoulder should not bear decades of the me too movement. Kellyannes words. You wrote the time piece, comparing today to anita hill and Clarence Thomas. How the kavanaugh drama plays out could be the ultimate test of todays struggle for political and cultural power. Where are we this morning, hearing from kellyanne and what we just heard from the president . I think what shes saying is another way of saying what i was saying. You cant ignore the context in which this is happening. You cant ignore the fact that this is happening in a moment when so many of the men in charge of political and cultural power in the society have been revealed to have had, you know, perhaps decades old misconduct. And we dont know if thats the case for judge kavanaugh. It is true that if he is innocent, he shouldnt have to suffer for other mens misdeeds, but it is also true that i think the way this is being handled speaks to our cultural moment. The way that dr. Ford is being treated and potentially the other accuser, the difference between that and the way that anita hill was treated is going to tell us, in a sense, how far weve come when it comes to giving women authority, giving them a voice that acknowledges them as equal to men. Jennifer rodgers, of course, theres a Legal Standard and theres a standard in the court of public opinion, as it were. Ronan farrow was pressed on this this morning about the differences between the latest allegation and the one by dr. Ford. Have a listen to his answer. We held this to the same careful standard but i would say this exceeds the evidentiary basis that we used in the past in several cases that were found to be very credible. As a lawyer, how do you look at the evidence here . What strengths do you see . What weaknesses, as youre trying to assess these . This raises a great point. Were not in court. This not a criminal matter nor a civil matter. Its not a right to serve on a Supreme Court. Its a privilege. Whether this is the person they want out of the thousands of qualified lawyers, right . Theres no beyond a reasonable doubt or any other standard here. Anything that comes into play that calls into question this is the one person you want to choose from this slot is fair game. So to me anything, right . Yes, its not a Legal Standard. Doesnt a person retain some right to due process, right, outside of a courtroom . Or some right to defend themselves . Technically, no. Theres no Due Process Rights attached to this proceeding. The point is, yes, if you had someone come forward and say an alien came down and told me hes a bad guy, yes, youre not going to proceed on that. Credible allegations by women, these are reasonable people, truthful and honest people, i think that those claims ought to be heard, if what theyre saying is serious enough. Errol, jim is speaking about ronan and jane mayors reporting in the new yorker and what Debbie Ramirez alleges happened to her in college at yale from Brett Kavanaugh. How does this play into thursday . If the only two witnesses remain dr. Ford and judge kavanaugh, you cant imagine even a scenario where senators dont question him about Deborah Ramirez and shes not going to be there, at this point. You can expect the level of pressure from democrats on that committee to say we have to delay it even further. Feinstein already calling for that. The president is right to say this is a very political process. Its political in the following sense. Justice kennedy announced his retirement 90 days ago and they have been rushing like crazy to get him on to the court, in advance of the midterms, for the next sitting of the court which starts in early october. That, too, is a political timetable. Theyve now sort of, i think, reaped the whirlwind. They pushed so hard, so fast, without a proper vetting. Now were going to see one or more cases and i think well hear the democrats say you cannot properly do all of this in the next 100 hours, without the fbi i might add. At some point, molly, it just doesnt matterifitsjustthe democrats saying that, right . Lindsey graham, before this ronan story came out, but lindsey graham, lets have everyone listen to what he said just yesterday morning. I dont know when it happened, i dont know where it happened and everybody named in regard to being there said it didnt happen. Im just being honest. Unless theres something more, no, im not going to ruin judge kavanaughs life over this. A republican who sits on the Judiciary Committee. This is about dr. Fords allegations, but unless you have republicans agreeing with democrats that we need to press pause and wait, nothing changes, right . Yes, the democrats dont have the power to delay this hearing and the democrats do not have the power by themselves to defeat this nominee, even if they all ban together. However, the republicans majority is so thin that even with the filibuster standard being removed they can only afford a single defection. If two republicans decide theyre not satisfied with this process or even that theyre politically vulnerable because of it, then the votes arent there. That is certainly what Mitch Mcconnell is conscience of, what chairman grassley is conscious of. It was scheduled, despite the resistance, the fact that it was scheduled for thursday, despite the senators desire to do it on monday tells all you need to know. Dr. Ford has the leverage here because there are some votes that are not there until she gets heard from. And a lot of deadlines have already fallen. Reporter thats right, poppy. One of the first headlines that the president made was talking about north korea. He was here at the United Nations a year ago calling kim jongun the rocket man. Today he is strike a much more optimistic tone. Moving very well. The relationship is very good with north korea. We have made things in store. Looks like well have a second summit quite soon. As you know, kim jongun wrote a beautiful letter and asking for a second meeting and we will be doing that. Secretary pompeo will work that out in the immediate future. Reporter he has been eager to set up this second meeting between him and kim but there are real questions about the key issue, denuclearization. It will be a key opportunity this week when well see it han hear much more from President Trump. He is meeting with south korean president today. North korea is on the agenda and he has already tasked his secretary of state with setting up this meeting. The issue here, denuclearization. Are we getting closer to that . Its not at all clear that we made that kind of progress. Poppy and jim . Nic robertson and analyst david rhode. Nic robertson, the standard that the administration set for these negotiations were verifiable and irreversible i forget all the steps. What steps have been taken as far as denuclearization is concerned that would justify a second summit . Nothing. If we go back to that first summit in singapore where President Trump said kim has agreed to get rid of scrap, take apart this missile engine Test Facility, in fact, he implied in his language it was happening right then and there but he just couldnt get it on the paper, this very short agreement they got. Well, president moon of south korea just came back from a threeday summit where again kim has said yes i will dismantle that Test Facility but you can have International Observers from relevant countries. We still dont know who those countries are. Which would be very significant were it to happen. And theres no date on it either. None of what he has said has been laid out, set in stone that would give you confidence that if you had another summit you would get something. Of course, the concern is, what concessions might be made . The thing about missile testing, you could test missiles in a whole host of places, right . North korea has a whole host of mobile launchers. You could destroy this one facility and not, david rhode, impede your ability to test missiles. It seems that the president is being played by north korea and by kim. You need unhindered inspector access across north korea and, to be blunt, President Trump needs a better deal than the iran deal. He has criticized inspections in iran as too weak and so far he has nothing close to what barack obama did in iran. Its all talk unless you can look around on the ground. President trump later today will meet with his south korean counterpart, president moon jaein. And this is after that at least the souths account of meeting with kim jongun last week was very successful, right . But again there was nothing you could really sink your teeth into. What theyre going to talk about today is not just, of course, peace on the peninsula but also a new trade agreement, which is very important economically, but arguably more important when it comes to security in the region. And this is something that kim jongun has said in his statements coming out of this summit, that he wants to get beyond this denuclearization issue so he can get to building the economy. Going back to singapore, remembering that video played for him saying all this could be yours if you play the game right. He is playing the game his own way. I think from a south decreeian perspective, there was a huge, long list of agreements, military agreements to deescalate and work at zones where there would be less troops, less border posts, easier access to fishermen. But when it comes down to the very specifics that are key to the united states, it was very, very skinny on details. So the aspiration can be for this better economic package for north korea and greater economic benefit for all koreans, but were not at that stage yet. Essentially you look at that agreement listen, punitive agreement, it looks like a Peace Agreement between those two countries than denuclearization involving the u. S. Thats a success for kim and north korea. They dont want to talk about the Nuclear Weapons and want to play this out and keep them. Thats the danger. White house aides fear the president will be too open to this kind of summit if the summit happens, he will be seen again as being sort of too weak with kim and being played, in essence. I think the singapore summit raised hopes. There hasnt been a delivery on that summit. Go ahead. I was going to say, pursuant to that point that david makes, go back to the singapore summit, President Trump surprised even the pentagon, certainly surprised his ally, japan, seemed to catch the south koreans unawares by saying he would suspend these key very important joint military exercises. What might this is a concern for allies now. What might he then concede again . If there is a second summit, david rhode it looks like there very may well be, the president said because he got this very, in his words, beautiful letter from kim jongun, there would be a second summit. What are the lessons to be learned from summit number one that the Trump Administration should look back at and say here is x, y and z that needs to be done differently or here is what we want to walk away from summit number two with . To be honest, better notes. Its not very clear to trumps own aides what was agreed to in the summit, a formal end to the korean war but thats not clear from the notes. There should be more people in the room. I think that would help. Its a concrete announcement from north korea of some kind of concession, allowing inspections, dismantling more facilities. Its concrete results because this could backfire on the president. Another big show and lots of cameras and nothing really substantive that comes out. It could hurt him politically. Thank you both. The New York Times report that rosenstein suggested wearing a wire to record President Trump and discuss the possibility of invoking the 25th amendment to remove President Trump. Rosenstein, we should note, has forcefully denied the reports, saying they are, quote, inaccurate and factually incorrect. This comes as republican allies of the president are urging him not to act too quickly. Certainly not to fire rosenstein if he plans to do that before kavanaughs confirmation vote and also before the midterms, saying it could complicate a lot of things. If you cant be on the team, if youre not supporting this mission, maybe you ought to find Something Else to do. We need everyone who is engaged in helping achieve President Trumps mission and i hope that everyone, in every agency, doj, fbi, state department, is on that mission. And if youre not, you should take this time to go do something more productive. And i assume talking about wiring the president , talking about the 25th amendment has not been on the table. Not remotely. How can or can rosenstein survive this at this point in this role . He has an incredibly important job and, by the way, he oversees muellers probe. Regardless of the voracity of the claims in this bombshell story, whether or not he said it sarcastically or whether it was in earnest i dont then theres any possibility that it was in earnest. Everything we know about rosenstein, hes a by the book guy. The idea of him wearing a wire is preposterous. Since the early days of this presidency, he, in my opinion, could be both a witness in this investigation as well as overseeing the investigation, which is not a good place to be. Theres been rumbles about reaccusal since the beginning. If anything, that highlights that potentially Rod Rosenstein may need to recuse himself. He has been in this precarious position yet still is the Deputy Attorney general, overseeing this investigation that the president dislikes strongly, to say the least. Theres a lot of reporting that the president is getting internal advice not to take that action because firing james comey unleashed a whole host of actions that the president doesnt like, including the assignment of a special counsel. The special counsels investigation is not only into collusion but obstruction of justice. The pillar would be the firing of james comey and the intent there. We know rosenstein drafted what what is known to be a largely pretext memo, firing comey because of the way that he handled the Hillary Clinton email scandal. He was shocked that the reason he fired comey was because of this memo. Then he told lester holt it was about the russia investigation. If the president fires rosenstein at this point, it will be a disaster for the midterm elections. Rosenstein went to the appropriate folks who oversee the ethics of all of this to check, could he still adequately, when sessions recused himself, what was their independent guidance on whether he could appropriately oversee the russian probe because, to your point, he could be a witness in it. It was found that he could. If he is, for any reason, no longer overseeing it, what happens . Who is then in charge of the Mueller Probe . Right. It goes down the line. First of all, it depends, if he accuses himself or if he is fired. The question is, a lot of people felt like Rod Rosenstein was the lesser of two evils. Thats the reason why he hasnt been recused thus far. Democrats thought he was overseeing this probe at least with integrity and wasnt going to back down to trump. If trump gets a yes man in that position it could be dangerous to the Mueller Probe in general. He could be or she could pump the brakes on the investigation in unseen ways. That wouldnt be so transparent to the public but could have disastrous effects on the investigation. Thank you so much. The judge will decide today if he will have to register as a sexually violent predator. Athena jones joins us now. Five of his accusers testify today. We could also hear from them during the sentencing today . Thats right. We could hear from them again, Andrea Constand herself and others with substantially similar stories about being drugged, incapacitated and assaulted. We could hear from them today on the victim impact statements. The defense side would get a chance to cross examine them. We could hear more testimony about them being drugged and penetrated. And we could hear from cosby himself. He did not testify at his trial. Ooshly during the sentencing phase youll have the convict arguing for leniency and thats one thing we expect from his lawyers as well. We have heard some important things from cosby in his own words that came from deposition that he gave, admitting to some things. Were talking about visiting individual home, shelters. Even a delivery to a farm that needed hay and feed for their animals. About 20 boats loaded up with supplies. I hopped in one, a 16foot bass fishing boat with two military veterans and travelled about 50 miles up the Cape Fear River. I was struck not just by how vast this flooding was but also the stench of that water.
