Couples have to be treated the same as opposite sex couples, when it comes to anything related to marriage. This was a case involving who whether the state could ban sakesex couples from being on the same birth certificate as their child. The Supreme Court said no. It was 63. Justice thomas and Justice Alito and the new justice, Justice Gorsuch is an illustration of where gorsuch is positioning himself. How does this affect the case they agreed to hear, the colorado cake artist that says it violates his religious beliefs to make a wedding cake for a samesex couple. They would be intertwined. Its about the clash of rights. Is the right of samesex marriage like the right to be free of religious discrimination . We have laws on the books that say a business cannot refuse to sell a cake or anything else to an interracial couple or people of two different religions that decide to get married. That is bedrock principle. The question is, is refusing to sell to a samesex marriage in the same cat gore or should we say you have the right not to participate in any way with a wedding ceremony to which you have a disagreement. Thats the clash in the case. The court also decided not to hear either of the Second Amendment cases in front of them, one of which was so significant, it would have been the biggest decision since heller. Right. The heller decision, Justice Scalias famous decision said there is a constitutional right under the Second Amendment for an individual to own a handgun in his home. But, that left a lot of questions. What about larger weapons . What about conceal carry rules . Thats what this case is about, whether conceal carry rules are constitutional. There have been varying decisions on that. Basically, what the Supreme Court is doing is allowing the Lower Court Decisions to percolate around before they issue what the Second Amendment means. What we havent heard is whether they will take up the travel ban case, the president s travel ban. Nor have we heard Anthony Kennedys future career plans. What is why you cannot go further. Seven years of promises from republicans may come down to a few days of frantic armtisting and deal making. Republicans pushing for a vote on the Health Care Bill. President trump weighed in. He wrote republican senators are working very hard to get there with no help from democrats, not easy. Perhaps let obamacare crash and burn. The fact is, republicans could use help from fellow republicans. Five senators say they could not support the bill as it currently stands. That number could grow. The Congressional Budget Office will release their assessment of the bill and how many will and wont be insured as a result of this and what will happen to premiums vuls. Lets go to capitol hill where we find Susan Malveaux . Any indication the five senators are leaning more towards yes this morning . Reporter theres no indication they are leaning toward yes. As a matter of fact, it will be a tough sell. The senators have a good sense of what the cbo score is going to look like or be like because of the process, poppy, that you have the Senate Majority leader, Mitch Mcconnell feeding in the legislation to have them scored and come back and tweak and work on it and massage it more. For some lawmakers, this will be a head cake. For others, political cover. The question is how far its going to be from the house cbo score. That was devastating when it came to headlines and 23 million americans over the course of ten years without Health Insurance coverage. Those are the kinds of things they are looking for. Already, they are preparing for amendments. It is going to be very difficult to actually unite the moderates and conservatives in terms of what they need from the bill. Take a listen. They promised too much. They say they are going to fix health care, premiums are going to go down. Theres no way the republican bill brings down premiums. Its a foolish notion to promise something you cant provide. Its certainly going to be very difficult. For my part, im very concerned ant the cost of insurance for older people with serious, chronic illnesses and the impact of the medicaid cuts on our state governments. So, watch what happens after the score comes out. The amendments that people will put forward, senators and whether or not there is wiggle room there. The president weighing in on this debate this morning. Not acknowledging the deep devids on the republican party, his own party. His tweet saying the democrats are nothing but obstructionists, they have no policy or ideas. All they do is delay and blame. They own obamacare. Expect something, perhaps before dinner time. Mitch mcconnell has a serious math problem. 52 republicans they need. 50 yes republicans to get this bill through the senate. We know of at least five Senate Republicans who publicly said no. Thats not counting republicans who already deciding they are not voting for it and have not said in public. Mitch mcconnell has to win over at least a handful of the Senate Republicans to get the bill through. I want to walk through the concerns that some Senate Republicans, moderate and conservatives have raised among the moderates in terms of what they want. The Biggest Issue is changes to medicaid. Cuts that are made are too steep. They also want to make sure they are preserving opioid Addiction Treatment coverage for constituents and planned parenthood funding is big for collins. In terms of what conservatives are pushing for, the simplest way is they want wholesale obamacare repeal. Gets rid of the obama care regulations. They want faster phase out of medicaid expansion. Set policy, including the option to potential li opt out of obamacare all together. The timing, of course, poppy, is tricky. Mcconnell is pushing for a thursday or friday vote. Thats just a few days to make changes. Thats not to mention the cbo report has not come out. Little time for Senate Republicans to make up their minds. From what i read from a number of republicans is they dont feel like going home over the break is actually going help them. The hearing is going to help them get this passed. Cornyn said the drop dead date is august 1st. Does it behoove them . Is mcconnell right to fast track this . This is a dynamic on the house side. Going home over recess. The town halls are firy, constituents saying, look, we do not believe the house bill is good for us. Certainly, the upcoming july 4th recess is something they are concerned about. The other side, for someone like Mitch Mcconnell, he is loorking at a longer term. If he does not get it done before the july 4th recess, you risk it dragging out for longer, potentially past the summer recess. Theres no indication he wanlts it to go past the summer. There are other things they want to focus on. President trump made it clear, other than health care, he has other big ticket items he wants to move forward with. Everyone wants to be done with health care. Tax reform has gotten no headlines, little attention, at least publicly. That is a big one for them as well. President obama took care of the low income. They have to do something for the middle class that are getting hammered with the high premiums. It was debated on the floor for a month. It had over 100 hearings and included 150 amendments from republicans. That is vastly different than what we are seeing today. If the special election showed us anything, the president s declining poll numbers did not hurt these republicans. Are they looking at their votes, especially on health care as what will give them their reelection chances. What we dont know is if in 2018 that President Trumps ability to elect himself transfers to other candidates. In the meantime, we are dealing with an issue where people have personal opposed to dealing with anger against washington, which is more general or not thinking congress has credibility. Whats going to happen under the gop plan is states will have more power. So, republican senators that are doubters, you cant guarantee what will happen until you know more what your state governors want to do. So, if you say one way premiums can go down is if you dont have the Ten Essential Services defined by the Obama Administration included in Health Insurance. That could have an impact on it and in the future. If a state decides not to have those services, that is a very big policy debate. Here is the most important thing i want to put out there to watch for that could affect the poll sicks. A lot of people dont realize it, but when you talk about the middle class as amanda did, people who end up in Nursing Homes, in the midding class, ran through all their money that they saved and worked for, but lived longer than they thought, people will soon realize its medicaid that helps keep grandma and grandpa or your aunt and uncle or if you are older, your own parents in Nursing Homes, relieving you of financial responsibility. You have republican governor of ohio, john kasich saying the medicaid dollars do not go far enough. In his words, nobody would want to live under that. This is where we are running into a problem. Republicans message, root and branch on the campaign trail. What is a massive medicaid reform bill . What we are seeing play out is what do we want medicaid to be and do. We are seeing subdebating come in. What about people in Nursing Homes . What about people getting drug treatment . We need a discussion about what the program should be serving. Obamacare screwed it up for a lot of stays because they had to cover this massive pile of people and didnt give them the money to do it. Thats why governors like john kasich are screaming. They dont have the money for the people on the program. This is the squeeze obamacare created. We are not going to get out of it until we decide who these programs are serving. Reporter we do, poppy. A flurry of activity at the Supreme Court as we await a potential decision on the travel ban. That, not coming yet. The case is Supreme Court is issued an opinion on today involves a church in missouri that applied for public funds to put a rubber surface on the playground at the church. A big win for that church. Trinity lutheran in missouri was applied that the fact they said no, a church cannot get state funds for this particular grant, that would go to the safety of a playground at the church, saying that is unconstitutional under the free exercise clause of the constitution. This is a big win for the church of missouri to help make their playground safer. This was a 72 decision. This was written by the key justice, joined by the new justice on the court, gorsuch. Whats interesting to note is that shortly after this opinion was issued, there was it was read by justice sotomayer. Saying by allowing state money to go to a religious institution, particularly here in missouri, this violated the separation of church and state under the constitution. It is very rare for a justice to read a dissent, but Justice Sotomayor is doing. People who opposed this decision, who wrote against it, the American Civil Liberties union railed against it saying it could further open the door to states funding religious institution. This is a minor case where the church said this has nothing to do with religion, its a state grant to make our playground safer. Many of these institutions, the aclu saying if you open the door to this, it could open the door for state funds being used for religious purposes. Interesting to note, the provision that does not allow state funding to go to religious organizations, this is the type of clause that three quarters of the states have. Its unclear how widely this case will be applied. For now, it only applies to this case where the church will, in fact, get state funding. Many worrying it could go further to state funding.
