this new information is being reported by the "new york times". the deposition cosby gave a decade ago was in a civil suit by one much his accuse engineers, andrea constant who claims cosby gave her drugs and sexually assaulted her. cosby said quote i think that i'm a pretty decent reader of people and their emotions in these romantic sexual things whatever you want to call them. when questioned about andrea constant and how cosby would explain paying for her education the questions and answers went as follows. question and our become who? answer the family. question would your wife know about that? answer that's family. my wife would not know it was because andrea and i had had sex and that andrea was now very very upset and that she decided that she would like to go to school or whatever it is. we can get back on track. question how would you explain to your wife that you were giving this personally as opposed to using the foundation? answer i would say to her that there is a person i would like to help. i want to bring in hln legal analyst joey jackson in los angeles. so joey andrea constant the woman who accused cosby and then settled with him, how did cosby's legal team keep details of this deposition quiet for so many years, yet the transcript of it seems to have been available all along by way of this transcript service, which is how the "new york times" says it obtained it finally. >> sure. good afternoon to you. good morning here. but, you know here's what happened. of course there was a settlement there. the settlement reached in 2006 and as part of that settlement it was supposed to be kept confidential. in light of that the matter was out of public view and only until recently that motions were made in order to release this to the general public. and so a judge, it went through that j-udge the judicial process. cosby's lawyers attempted to keep i want that way. it's out in the public and these major revelations one after another shocking the conscience of us. >> is this considered a mistake made in terms of cosby has been able to maintain all this time not being able to say anything because this was a settlement and no one was to talk about it the transcript or the manuscript the memorandum was kept secret. would this reveal there was an oversight, a mistake was made that perhaps it wasn't to remain secret in perpetuity as cosby and his team thought. >> from a legal perspective i think there were mistakes made because even when the judge decided this would be public and major motion practice in order by cosby's lawyers to keep it secret the judge essentially said and we know very well that the judge balanced the equities between cosby's right, you know, to have it kept private and embarrassed and the public's right in a interest to know particularly when he that is mr. cosby has always put himself as the judge said sorted of a public moralist. the judge also said in response to cosby's lawyers this was meant to be private, the settlement was confidential. wait a minute. that's true. it came to me at the time it was settled and asked me at that time to seal the transcript. i'm not going to hear you say it's up for discussion now and he released it. the lawyers are reeling as a result of this. but, of course, the larger question becomes what now can to be done? and clearly there are two courts there. there's the court of public opinion, and i think certainly public opinion has changed drastically given his own revelations and obviously we live in a country you're innocent until proven guilty. we get that and understand that. but when you have someone making stunning admissions as he has in this deposition that's now out to the light of day it certainly is changing the minds of many in terms of what they thought in public opinion. in terms of what can to be done in the court of law and we discussed this based upon statue of limitations there's very minimal things that could to be done. >> limited remedies but that sounds to me there's an inference there still may be a door open. while we're talking about the majority of the other accusations involving women, the statue of limitations may have been resolved. when you read more about this deposition based on what the "new york times" is reporting, you know at one point the lawyer for the woman who settled in this case with cosby said to cosby that he was making light of something otherwise very serious. hat's right. >> they even used the word he was very cavalier. this is damaging in terms of the court of public opinion but is there opening? am i hearing an inference there still may be an opening as per takes to some other kind of legal road. one may want to pursue against bill cosby? >> great question. that certainly is the question of the day. let's talk about two potential openings. the first one the defamation lawsuits ss ss levied against him. they are not predicated upon or based on the sexual abuse itself which the statue of limitations has gone. >> one involves janet dickerson. the other one would be -- >> yes. well there are a couple -- there are actually three, as i recall. the names i'm not familiar with not coming to me. >> defamation suits. >> defamation lawsuits from three separate people who accused them and there are many. as a result of that what the claims are is that he was besmirching their character by calling them liars. there's problems with that. defamation is a lawsuit that's intended to protect your reputation. of course if it damages your reputation then you have a claim. i think the person whose reputation however, is damaged is bill cosby's and as we look at these accusers the public is seeing they were not lying, if anybody was really misrepresenting, it was him and his representatives. that's the first problem that those lawsuits have because you have to claim damage to reputation. >> there was a second opening. go ahead. >> yes. the second problem to that is that his representatives that were not, who were saying they were liars. not him. in terms of the second opening, khloe goins in the playboy mansion in 2008 she came out with the lapd and filed a claim and there was an investigation. there was a decision not to prosecute him. that could be an opening because there's an issue as to whether that still could be within the statue of limitations. that could be an opening. we'll see if the lapd don't investigate and see if there's teeth here to go after him with a criminal prosecution. >> thank you so much joey jackson. it's very complicated and only gets more complicated. thanks so much. all right. now, to the political controversy surrounding donald trump, the republican presidential candidate refusing to back down after saying senator john mccain is not a war hero. this morning abc's martha raddatz asked trump about his comments and he remained defiant. >> do you owe john mccain an apology >> no, not at all. if you look at cheryl atkinson's report last night four times perfectly i said whatever it was and it was absolutely fine and she thought the press was covering me unfairly. she stated that strongly and i respect her as a reporter and somebody that a lot of other people respect also. very importantly i got a standing ovation, the biggest ovation i've had by far. when i threat room it was a total standing ovation. wonderful to see. no one was insulted. what happened later on the republican candidates some of whom are registering 1% and zero and very upset that i'm leading the polls by actually a nice margin. they are extremely upset and they were extremely upset when the nevada numbers just came out and they are through the roof too. >> there seems to be a pattern mr. trump when you're criticized or attacked you respond by name calling. you even demean some people's physical appearance. is that something you would continue doing if you were president? isn't that language beneath the office of the president? >> oh, i don't think -- look when people attack me i let them have it back. you say physical appearance. it's my hair but people are constantly attacking my hair. i don't see you coming to my defense. my hair is just fine. i don't see you coming to my defense. if i say something about somebody else. yesterday i mentioned somebody was saying mccain is a smart man. i said really? he graduated last in his class at annapolis. people laughed when i said that. a lot of people don't know that. i'm very disappointed. i under john mccain. i raised a million dollars for john mccain when he let us down he ran for president and lost to obama. i wasn't thrilled with that. i will say what i want to say. maybe that's why i'm leading in the polls because people are tired of hearing politicians and pollsters telling the politician exactly what to say. and believe me this whole thing was brought up by a lot of the people that are competing against me currently that aren't even registering in the polls because people are tired of them. >> have you ever said anything you regret? >> yes, i have on many occasions. >> can you tell us a few of those? >> no i wouldn't do that. i wouldn't do that. i wouldn't do that martha. it's not the appropriate time. certainly i've said things i could have held back. but not that often, surprisingly not that often but certainly there have been occasions. >> later on in our broadcast here we'll remind people about senator john mccain's military experience when in 1967 his plane was shot down and why so many people are taking issue with what donald trump has said and indeed calling him a war hero. john mccain that is. joining me right now from the white house is cnn reporter. there's a lot of people who are taking offense to what has been said by trump. >> reporter: that's right. many quickly coming to the defense of senator john mccain and his time of service for the country, the senator as you said a former navy fighter pilot who was shot down imprisoned and tortured in ah-ha notice prison for five years, refusing early release and then went on to earn the purple heart. these comments from trump have ignited firestorm within the republican field sprirksding an opening for some within field, an opening twin field are looking for to come out and criticize trump more openly more forcefully. now we have heard from many of the candidates. they were unanimous in praising john mccain in his service to the country. but others really walked a careful, a fine line like senator cruz who refused to come out and criticize trump. >> this is not just an insult to john mccain who clearly is a war hero and a great man but it's an insult to all p.o.w.s, to all men and whom served us in uniform, who have been captured in battle. this somehow makes the assumption and he's saying that somehow if you're captured in battle you're less worthy of honors than someone who isn't. it isn't absurd it's offensive, it's ridiculous and i do think it's a disqualifier as a commander-in-chief. >> as an individual who wore the uniform of this country i was highly offended what donald trump said about john mccain and his years of sacrifice in a dirty, dinghy terrible prison in north vietnam. donald trump owes every american veteran and in particular john mccain an apology. >> he crossed the line today. that will offend most everyone that i know and in my view the democratic process is going to lead to him hearing what he is so fond of saying you're fired. >> john mccain is a friend of mine i respect and admire him. he's an american war hero. i'll tell you it is a true and a privilege to serve in the senate with an american hero like swrom. >> this is an honorable man. again, you may have a policy disagreement with him here or there or any other american but we should never ever ever question the patriotism and the heroism of someone like john mccain. >> john mccain is a hero. what john mccain did was the most honorable sacrificial a man can give to his country. i'll let donald trump speak for donald trump. >> reporter: the rnc additionally typically doesn't get involved in things like this in the primary. they really took rear step and responded to trump's comments saying there's no place in their party for comments like that. we have not heard from senator john mccain himself but we've heard from his daughter meghan mccain. she called the comments that were horrified and disgusted her. >> thanks so much. talk more about that later on. meantime the family of the chattanooga, tennessee shooter is talking about the attack and their son's state of mind. boris sanchez is live for us in chattanooga. >> reporter: a statement the family of the shooter put out shining a new light on his mental state before the shooting. we're also hearing from the family of one of the victims. we'll tell you more coming up. i already feel like we're the most connected but i think this solo date will seal the deal. sure! i offer multi-car, safe driver, and so many other discounts that people think i'm a big deal. and boy, are they right. ladies, i can share hundreds in savings with all of you! just visit progressive.com today. but right now, it's choosing time. ooh! we have a winner. all: what? [ gustav squawks ] he's gonna meet us there. the name your price tool. still only at progressive.com. back. thanks so much for joining us. i'm fredricka whitfield. we're continuing to follow new developments in the bill cosby saga. moments ago his publicist told cnn no comment in regards to what are some startling revelations from cosby himself. the comedian reveals in his own words in a 2005 deposition that he pursued younger women for sexual relationships and obtained the sedative quaaludes to give to young women he was with all while keeping it quiet from his wife. cnn obtained a copy of the full transcript of the deposition cosby gave a decade ago in a civil suit by one of his accusers. that suit has since been settled. coroner nn is currently going through the 1,000 page deposition. cnn's jean casarez joins us live now from new york. she's been on the story from the start. i under you've gone through at least 20 pages and this is you know this is a lot of reading, a lot of details. we're talking about 1,000 pages in all. what are you learning in just the first few pages. >> what we're learning there were four days of depositions because originally mr. cosby's attorney wouldn't allow him to answer so many of the questions that andrea constant's attorney the young woman who came forward wanting criminal charges not getting that. andrea constant was in the room as he gave that deposition and the "new york times" is the one that got that full deposition. in it they say that bill cosby says that at least five women he had sexual relations with and the headline he says it was all consensual. yes there were drugs, yes there were women, it was consensual. he tried do it behind his wife's back. he talks about how one young woman's father had cancer so to woo her in he acted like he cared about the cancer. he acted as a mentor. if he liked them he would keep wooing them in. he also says something interesting, let's show you one quote from the "new york times" piece and then i'll explain it. he says i think that i'm a pretty decent reader of people and their emotions in these romantic sexual things whatever you want to call them. he says that he would look at a woman and no instantaneously if there was consent. if he saw that green light he would keep going. if he saw a red light that the woman wasn't consenting he would stop. he also says that he did not have full sexual relations with women because he didn't want any of them to fall in love with him. so it would be playful things and of course andrea constant said there was no consensual activity on the part of me. she said this in her complaint in 2005 she was given three blue pills. she woke up and next thing she knew her clothes were off and felt she had been sexually assaulted. that case resulted in a confidential civil settlement in 2006 the terms of which have never been disclosed but now public the full deposition of bill cosby. >> and i haven't seen the deposition but according to the "new york times" article that i read about that deposition you're talking about it also indicated that he did acknowledge giving benadryl pills in the form of benadryl but then now constant said it was likely not that something much stronger that knocked her out. >> a question of fact. also this deposition goes into jane does. remember the other women that were ready to be witnesses when andrea constant would go to trial on this case. there's also questions about them that have never been released before. >> what might come next from the release of this deposition? remind us jean wasn't this sealed and at what point the "new york times" explains how they obtained it that there was this manuscript unsealed but then turn out the entire documentation, the whole transcript ended up being at a service and upon request you could get it? help us understand that. >> there's a court motion in play right now. this is separate and distinct from what you are saying before a federal court in pennsylvania by andrea constant's attorney. asking for bill cosby's deposition and the whole -- the rest of the depositions to be unsealed at this point. they are waiting for cosby's response and then a magistrate in pennsylvania would rule should it be unsealed. it's currently available in another way. separate and distipgt from that there are civil cases all over the country, alleged victims that are suing bill cosby more money damages. his attorney will want to take this sworn testimony of bill cosby, yes he had to swear was the truth, and try to use it in a civil case. these are statements against his interest the defense will try to stop it from being used in a civil case but the alleged victims will want it used. of course you got the current investigation with the los angeles police department we don't know exactly where they are, but the prospect of criminal charges, the potentiality is still there. >> is it your understanding, jean we know the publicist of bill cosby has now said no comment to what success reported but is it your understanding his attorneys thought these documents would remain sealed forever? >> ouch. listen this is bad. i have been trying to think d. other than those two there's nothing else you can say that's worse than to question john mccain's service time. >> everybody's jaws dropped when they heard that. >> wow! >> some people feeling don't they know exactly hat senator john mccain went through. limbs broken. plane shot down. you know, willing to sacrifice himself, you know to save his fellow comrades p.o.w. were released. >> this goes back to the core problem that donald trump has. that's he's not a disciplined man much less a disciplined politician or disciplined campaigner. when he walks out there he constantly insults anyone that he doesn't like. he says you're stupid you're dumb you're not intelligent, you're not smart enough you're not wise enough you didn't make enough money. so in this situation he just did the exact same thing he's been doing all along which is i'll rip on someone and tell you he's a failure because he got shot down instead of hero. >> i have an idea guys. we actually are going to have more time for this topic later on. how about that? because now we're out of time. all right. thank you both. we'll talk again on this because there is so much to chew on here. also coming up the family of the chattanooga shooter says he suffered from depression. we'll talk to a leading psychologist about their revelations next. this is called non-24. learn more by calling 844-824-2424. or visit your24info.com. . family and friends are mourning the loss of those five service members killed in that rampage on the analytic recruiting centers in chattanooga, tennessee. they gathered today at makeshift memorials. meantime investigators are searching for motive for the attack. with me now licensed psychologist erik fisher. the family says the shooter mohammod youssuf abdulazeez was suffering from depression. might there have been any signs. the family knows or acknowledgement there may be some sort of depression or mental illness how is anyone to determine the extent someone would go. >> what we have to look at is the difference between explanation and excuse. to me you can't excuse these actions. we can help to understand them. backing up and looking at these factors is one piece but almost impossible to predict who will be violent or will not be violent or behave in this manner. you want to look for signs ever depression is somebody pulling away. are their behaviors changing. are they sleeping more. are they waking earlier. there's a lot of symptoms and signs. personality change that's a sign you want to look for. you want to talk about it. my concern here is if in fact he grew up in an abusive environment which there are indications he did and he was always smiling he learned to put a face on. and if he learned to put that face on that's smiling for everybody and also in most cultures and especially in male-dominated cultures you don't show weakness. he doesn't want to show that weakness because he felt he might be perceived as a failure. we see the erosion of his life since graduating from high school. pulled out of mma. couldn't get a long term job. he lost a job at the nuclear power plant. >> you're talking about a mountain of things just a piling up of various issues and maybe somewhere along the line there was that breaking point. again you're saying no excuses. >> right. that's where we want to understand these things. unfortunately this is post-morten. we have to look and see the signs beforehand. we don't live in a world or a country where we lock people up preemptively. parents have to speak up and get theirs kids the help they need. >> leave it right there. erik fisher thank you so much. good to see you. it is something so rarely seen. that right there, that moment is unbelievable. professional surfer and he gets into it with a big old charge at a big competition. we'll explain how he punched and kicked his way to save his life. push your enterprise and you can move the world. but to get from the old way to the new you'll need the right it infrastructure. from a partner who knows how to make your enterprise more agile, borderless and secure. hp helps business move on all the possibilities of today. and stay ready for everything that is still to come. wimbledon 2015 finished with a couple of familiar face raising the trophies. serena williams and novak djokovic proved why they are winners. >> i found the necessary motivation. >> williams completed her second serena grand slam. she's looking to make more history by getting an elusive calendar stephen amell at the u.s. open in august. >> it's so exciting to have that opportunity. people coming to watch and hopefully cheer me on in new york going for it. regardless i'm going to do the best that i can. have fun. i have nothing to lose now. i got three this year. obviously i want to win the u.s. open but if not three isn't bad so i'll enjoy that. all right. this is incredible. terrifying moment during a major surfing competition in south africa. cameras caught a shark. you'll see it. the fin is right there colliding with that australian surfer. then you don't see him or the shark and you wonder what is going on. here it is again in slow motion. oh my goodness the shark and this is what the surfer describes later on afterwards. he does survive. the shark coming from behind and then going under the surf board and the two struggle which happened for about 20 seconds and then later on rescuers on jet skis were there within seconds to haul away the surf and another surfer with great relief. he's okay. visibly shaken clearly. this is how he described what happened. >> i felt something grab, like got stuck in my leg rope and i instantly just jumped away and then just kept coming at my board and i was kicking and screaming. >> see some teeth? >> i just saw fin. i didn't see -- i was waiting for the teeth come at me. >> did you get a couple of pinches in? >> i punched it in the back. >> wow, that's crazy. organizers say there were actually two sharks in the area so the world surfing commission called off the competition, understandably for the rest of the day. let's bring in the host of abc's "ocean mysteries" jeff corwin. jeff south african shores and great whites are known to come together. i don't know about being in a competition surfing out there. so help us understand what you think happened there. he actually said he got a punch in to the shark. but what is it about surfers and sharks? they simply look like seals. they look like a meal to a great white. >> that was terrifying to watch. i didn't take a bath today i was so terrified what i just saw. but you're right. your first inclination is correct. the first thing i want everyone to look at is the visibility of the water. the clarity. typical south african waters incredibly murky. what a shark does it looks above and sees the silhouette of potential prey. all along the south african coastline are seals. number one targeted prey for sharks off of south africa, which is the great white. i watched this footage over and over in slow motion trying to figure out what species of shark this is. could it have been a thrasher shark. could have been some sort of a great white, i'll tell you whatever it was, it was huge. i estimate it to be somewhere between 12 and 13 feet long. >> oh, my gosh really? oh my goodness. it's amazing because, i mean you're the shark expert here but usually what great white attack from below up just as you describe murky and looks like a seal. you actually saw the fins just splash around so closely to the board. does it give you the impression it may have taken a little bite a little sampling of the end of the board. the tip goes up. what do you envision happened -- oh boy right there. >> we talked about this before about how sharks will do these test bites. i actually wasn't seeing a test bite. we have a number of things happening here. i think we have mistaken identity. the shark thinks it may be potential prey like a seal. it moves in to investigate. as the surfer just
