>> so it's sort of is a bit confusing as to why it was that included, that information, in the motion, the lawsuit to begin with. but i want you to listen to something that happened between roy moore spokesperson and dana bash earlier today as to why they thought it was important to put in there. >> can you give me the circumstances of that polygraph test? who administered it? were there witnesses? so and so forth. >> that's all been submitted to the court. i think it's connected to the complaint zb but most people aren't reading all 84 pages. >> all i know it's a renown independent expert that he went before and took the polygraph test, not surprising to anyone who knows judge moore he passed it, he never knew these women and engaged in sexual conduct. what a surprise. it's not. >> why take the polygraph almost a month between the time these allegations came out and his election day? >> dana, we may not agree on much, but you and i agree on that. i would say if i was the rone running the campaign i would see that done. but where we are right now he passed the test. he said all these people made these baseless allegations, you do the same, do a test, and if there is any variation, go to an independent, he's willing to go to someone chosen between the two, both agree upon and let everybody take a polygraph test, how about that. >> yeah, so ana, real quick, it is important to point out that signed affidavit claiming that he took a test and passed it, that was signed by roy moore. the polygraph administrator didn't file that paperwork. so again roy moore word signing it say it all happened. something a bit unusual to include in a voter fraud lawsuit attempting to delay the certification of the election. >> which didn't work. diane, gallagher, thank you for the latest from alabama. joining us now to talk about the politics of all this and any fallout, both republicans here. i'll start with you, ana, does this roy moore move hurt or help republicans politically? >> at this point i'm not sure it's much a republican problem. certainly supporting him in the general was a republican problem. his defeat was a republican problem. his can datdidacy and the race did was a problem. this is a guy that you can add poor loser and baby along with racist, who likes to hide behind the cloak of jesus christ. this guy doesn't know when to quit. look, the president of the united states who supported him has congratulated the new senator doug jones from the night it happened. everyone else seemed to move on. this guy is incomplete denial. he needs a hobby, one that doesn't involve being around children or girls in malls, maybe he can take up under water basket weaving. bull get over it. >> do you worry about the serious question note of questioning election integrity? does that set a dangerous precedent? >> no, i don't think it does. and i actually think this helps the republican party today. this is why. because he's a snake salesman. this guy candidacy from day one was bad news for the republican party. >> but president trump endorsed him wholeheartedly? >> yeah, i understand. and i wish he didn't done that. and i sort of publicly always advised the president this was a bad idea. and they did it. and now roy moore is out of the way which is ultimately, trust us, anna and me it's going to be a good thing for the republican party. but at the end of the day here, at the end of the line we see what roy moore is. we see what they really are. they have degraded themselves into this ridiculous lawsuit that i think uses the word inexplicable than any other word in the lawsuit. you know what's not, how a guy like roy moore lost this race, he was a bad candidate and hurt the republican party during the campaign. thank goodness he's out of the way. they need to let this go. and i hope people see him for what he is here at the end. somebody who could not accept the reality he got beat in the red estate in america. >> and even steve bannon who backed moore, he's having a change of heart at least for a different candidate, tweets that uses the hashtag, it's okay to be white, i'm talking about paul nay lan, running against paul ryan. do you think bannon is backtracking in this case as a result of lessons learned in alabama? >> frankly, i don't know. and i don't care. i think steve bannon is much to do about nothing. i think this is a guy who wants to create his own mess. we have now seen him get beat in alabama despite going out there and giving it his all. he really is hurting the republican party by backing these very hateful device certifica certificate candidates. he's been defeated and pretty badly already. steve bannon. so who cares at this point what he's doing. only reason that guy exists is because there is some secretive billionaires willing to keep funding him. >> do you agree with anna on that, scott, that steve bannon is sort of yesterdayer year and doesn't matter in terms of political influence anymore? >> well, he matters to thes extent president trump keeps talking to him. i think he's been involved in both campaigns and both of them lost the popular vote. but in roy moore case he lost the popular vote in a case where democrats had no business coming within 20 points of a senate candidate let alone winning it. i think bannon needs to rethink thinks strategy after going senate candidates in the 2018 cycle. if what he's going to do going forward they'll lose control. what they need to do is focus on good candidates and in a bad general election environment. if you can lose alabama with roy moore, you can definitely lose other states. so messing around with majorities here is bad news for the trump presidency. if democrats get control of either chamber, it will grind this presidency to a halt. >> let me ask you about what president has accomplished. he was yesterday touting accomplishments claiming to have the most legislative victories of any president since truman. but when we did a quick fact check it's not true at all. actually he's signed fewer bills in his first year in office than any administration dating back to eisenhower. and yet he just passed tax reform. he has plenty to celebrate, he could avoid putting out false claims sochlt why claims. so why go there? >> because it's his hnature and he's a pathological liar. about costing him the popular vote in election. and he has continued lying, exaggerating this entire year. it's just his nature. loorks c look, ana, it's very hard to change a man at 73, this guy is not going to change. he doesn't think truth matters. he thinks him saying something makes it true. he wants to believe it. he wants to put it out there he thinks makes it true. look, facts is facts. history is history. archives are archives. and people who take the time to poe lit fact the things he says. i don't think he doesn't care they aren't true. he likes the high of saying it and hearing himself congratulate himself. >> scott, do you agree? >> well, i think that what we have to think about here are the political ramifications of what they have accomplished. and it has been a great deal. whether you consider a president to be successful by signing bills into law or not, you cannot deny the stock market is up,en employment is really low. we have more optimism in the american economy. isis is on the run. great reports on that. we have drilling in the arctic. supreme court justice. by the and of this year they had impressive round of accomplishments. and i think president trump supporters. >> why not list all of those instead of speaking in untruths? >> look, i'm not going to try to get inside the head of the president on that. but what i would say is republicans right now especially since they got tax reform are generally pretty happy with the policy direction this administration, even if there are days when they are not happy with the public communication direction, of what's going on. they have accomplished most of what they set out to do, even going so far as to strike at the heart of obamacare by repealing the individual mandate inside of tax reform. it's very difficulty think at this point to argue that president trump didn't do anything this year. they did quite a lot and republicans are pretty happy about it. >> so the president has also accomplished another record for turnover rate in his year according to the wall street wa "wall street journal." he has much higher than that of any administration in 40 years. is that cause for concern, scott? >> no, i don't think so. look, working in the white house under normal conditions is a meat grinder. i know, i worked in one for almost three years. working in a white house that's under investigation is even more stressful. and working in a white house under a new president with a group of people who didn't have a lot of governing experience i'm sure adds even more anxiety and stress. let's also be on test, a few people who took jobs in the white house should not have been hired in the first place. they washed out. i think the team they have in staff right now with the chief of staff and communication staff, with the political director, i wrote an article this week arguing he's doing a good job, i think the staff they have in place is a good staff. some of the people that needed to wash out washed out. but make no mistake working in a white house under any circumstance is difficult to do. a lot of anxiety and stress. and for the people who have been caught up in any investigatory issues a lot of legal bills that pile up as well. >> ana, final thought. >> it's been a chaotic year for that white house. but i think it's good he's gotten rid of some problematic people. i think the white house is better place for not strg a steve bannon. for having a more professional staff in it. the problem is donald trump was outsider to politics. didn't really have a team of seasoned political veterans around him that who had worked together and new how to work together and get something done. and he had all of these, frankly, apprentices working in the white house. and, yes, they got fired. and a lot of them deserve to get fired. still a couple there who are hanging on who should be. >> mike? tripadvisor now searches over... ...200 sites to find you the... ...hotel you want at the lowest price. grazi, gino! find a price that fits. tripadvisor. i use herpecin l.re, it penetrates deep to treat. it soothes, moisturizes, and creates an spf 30 barrier, to protect against flare-ups caused by the sun. herpecin l. confrontational and fake news is how russia has labeled a "new york times" op ed by secretary of sta secretary of state rex tillerson. writes he has a poor relationship with russia who has invaded neighbors in the past decade and undermine the sovereignty of western elections by meddling in our election and others. but some of the stage is set for tense 2018 as president trump takes to twitter to shame china as well over its reluck tants to stop propping up north korea. the president tweeting, caught red handed, very disappointed they are allowing oil. there will never be a friendly solution to north korea if this continues to happen. elise laugh it is joining us now, do we know what spurred that latest tweet from the president. >> well, ana, there has been some actions from the treasury in the last month or so about north korea receiving shipments of oil, never fingered china, but in the last week anonymous reports in newspapers overseas and a seoul news organization that have kind of repeated itself on some of the outlets here, including fox news and breitbart. so i think that the president is getting it from that. i mean, that said, there is a lot of question about whether china is going to implement sanctions on north korea. president trump has been looking for china to cut off oil shipments to north korea. last week the u.n. security council passed the toughest sanctions yet to date on north korea. cutting off about 90% of its fuel shipments. so i think we need to see those reports aside from the last month or two, whether china will implement the latest sanctions and that cob a game changer if they do. >> and i imagine world leaders are listening and watching and reading both what the president is writing and saying, what they are hearing from the secretary of state. so how do their two statements today jive given we just had this op ed as well from rex tillerson. >> reporter: look, it's very difficult to ascertain who is making policy and what is the truth f you look at the president's tweets on any number of things, whether cracking down on china trade, or talking about russia, the rhetoric from president trump refuses to recognize that russia meddled in the election while the rest of the administration, and clearly today, secretary of state tillerson did, i think there is a little bit of a disconnect or a big disconnect, actually, between the president's tweets and what is coming out of his mouth and the actual policies of his administration. you know, even though he refuses to criticize president putin and recognize the election meddling, if you look at what this administration is doing on russia, you know, last week the u.s. named a lot of russian individuals that are going to be subject to u.s. sanctions at the end of next month. president trump last week approved the first sale of lethal force to the ukrainian military in his op ed secretary of state tillerson said it will never be business as usual if russia continues action ns ukraine. so you know, it's areally hard o separate the rhetoric from reality bull i think diplomats are starting to realize the tweets, while president trump sees it as good communications tool, you really have to look at what the actions are of this administration, even if pt rhetoric coming out of various mouths of different administration officials is different. >> the state department has also been criticized both internally and from the outside for what some have described as tillerson's gutting of the department. and you and i have talked about the low morale that even his spokesperson has addressed. how is tillerson talking about this issue in his op ed? >> well, i think this is part of effort by secretary tillerson a couple of weeks ago, and ramp in the new year about his state department. look, i think part of the problem is there is low moral. the foreign service doentd feel appreciated and don. and not very good about communicating and how the ideas of the state department are funneling into the policies that he is advocating with the president. so i think when he rolled out his redesign, there was a lot of questions about it. you are going to see a little bit more of that. but what he's saying is, essentially, i want to cut out the bureaucratic red tape and bureaucracy. human resources. technology. that stops diplomats from doing their job. so we'll see if he's able to do that. we'll see if he's going to boost moral. but i think when you have op ed today that comes out i'm proud of the state department diplomacy, that's really an effort by secretary tillerson to reframe the debate and say look it's not all gloom and doom as everyone says it is. this is actually what we are getting done. >> all right. in washington. thank you. up next, president trump takes to the golf course for the third day in a row. today we didn't see that large white truck trying to block our cameras. but we have an update to what has happened regarding that white truck. former secret service agent will discuss what it was all about. another day of golf for president trump the third straight day of hitting the links despite this tweet from monday saying he would be back to work after christmas. take a look at this video. you can see the president here on the golf course. this is today. where there were no attempts to block cnn's view of the president. yesterday was a different story. large white truck pulled up directly in front of our cameras. it appeared to be done on purpose as that truck moved back and forth to block the view of cnn's photo journalist and only left when the president moved on. joining us to discuss cnn law enforcement analyst and former secret service under president obama, and cnn politics dan. so, dan, i'll start with you. help us come full circle with this mystery of the truck. we know the truck was not blocking the cameras today. what more have you learned? >> so our job down here to cover what the president. and what he often does in florida is hit his golf course near his estate in mar-a-lago. because the state doesn't confirm the report that he's golfing, our camera men have been good at getting views of the president through trees through the golf course. as you mentioned wednesday a large box truck pulled into the views obscuring the president as he went by. as our cameras tried to move, that white box truck moved with them to further obscure that shot. now, the sheriff's department here denied that this was directed by them at all. and as we returned to the scene on thursday to get a similar shot, that truck wasn't there, as that video you just showed proved. but we spoke with the sheriff's department, and they continued to deny that this was their truck. bumpy would like to note that one of our producers found a very similar looking truck parked in the sheriff's department parking lot both last night and this morning. now why does this matter? this matters because the president often slammed president obama for his regular golf trips. as abyss man he used twitter to criticize the former president. but as president, president trump has visited his golf clubs total of 88 times according to cnn count. and as you noted has golfed three days in a row after tweeting that he was going to get back to work. this matters because the president said one thing as a citizen and has done something different now as president, ana. >> all right. dan, i want to turn to jonathan now. so the sheriff's office has denied and secret service has denied. but given your experience and inner workings how they operate, where do they draw the line in terms of providing security for the president versus trying to obscure his view from the media. >> well, secret service put out a statement in part they are not trying to block the press. and that's really the ethos of the service. they are not trying to do that. what the secret service is not going to do is talk about current security protocols. and not talk about threats they may have received. threats that they may have identified vulnerabilities. i mean, we are kind of caught in the middle here. mindful that the cameraman is trying to get a precise shot of the president golfing. i get that. but what that does do or potentially does is exposes a vulnerability of that location for law enforcement. now, law enforcement, including the secret service has multiple ways to mitigate that vulnerability. one is blocking direct line of sight with a truck. there are other means they can used that have opinion deployed to mitigate long range threat. we may have seen that happening today. again the secret service isn't going to disclose what they are doing to protect the life of the president of the united states. >> let me read their statement specifically so i didn't mischaracterize it. the u.s. secret service is not in investigation to block the media's view of the president dpofl swing. so golf swing. >> so it wasn't part of that? >> that's a great question. it's hard to say. because you are not really prepage 2018 taxes. paying taxes you already owe from 2017 most likely. so the question is are you doing the right thing by paying them in 2017? right now or next year in 2018? normally you would? >> so if it were you, what would you do? >> so if it were me, depending what state i lived in and what the rules were, i probably would go ahead and prepay the taxes. because there are some potential down side to prepaying the taxes like you have lost value of your money, or you might get a potential audit by the irs. but the down sides are very small compared to the upside is where i get a big deduction in 2017 as opposed to maybe no deduction or limited deduction in 2018. >> is there anyone who wouldn't benefit potentially if they were to pay early? >> so there are some people who might not benefit. and one group might be if the irs recent pronouncement is correct, that if your taxes were not really paid or accrued in 2017, and you paid them in 2017, you might not get the deduction in 2018. and if you wait to make your payment in 2018 with the new higher standard deduction, you actually might get phased out of property taxes that you already would have been able to take had you paid them in 2017. so a couple different groups of people that might be worse off. and there might be some people who are better off. >> so even with this new irs statement, it's not exactly a done deal it sounds like, too. so even if you do stand to benefit from paying early, could there still be legal challenges which make this all a moot point? >> yeah, i mean, i think that's the hardest thing. right now the case law is really unsettled. there are some different cases out there that try to give a little bit of guidance to say what is a tax that was properly paid so you could take a deduction for it. but there is not a ton of case law because this hasn't come up in the past before, at least not very often. so to the extent that people prepay in 2017, and the irs says, no, you are wrong, you should not have prepaid or didn't count, most likely a lot of that, those cases will end up, if they are not settled in audit, go to trial and go to court. so the answer to this question we might not see actually for two to three years in the future at the earliest maybe of really understanding what the rules are for 2017. >> gotcha. okay. david herzig, thank you. still ahead, there are a few people and animals who have found a way to have fun in the record breaking snow in eery pennsylvania but the cold is maki making us miserable for a lot of us. take a look at how long it will last. tripadvisor now searches over... ...200 sites to find you the... ...hotel you want at the lowest price. grazi, gino! find a price that fits. tripadvisor. baby it is cold outside and millions of americans are feeling it right now. the arctic temperatures are sweeping across the country and it is not just the brutal cold, people in eerie, pennsylvania, they're still digging out. they got more than five feet of snow in the last three days. broke an 91-year-old record and there's more on the way. meteorologist allison chinchar is joining us, hopefully that's relief in sight. >> there's not much relief in the cold temperatures, but a temporary relief in terms of snowfall. minus 15 is the feels-like temperature in fargo. one is what it feels like in chicago. minus six is the feels like temperature in boston. and i wish i could tell you that these cold temperatures were going away, but it's just simply not the case. in fact when we look at new york, boston, look at the morning low temperature feels like tomorrow. it's going to feel like it's minus 19 when folks are waking up in boston tomorrow. minus eight saturday morning, look at chicago. notice the difference in that chicago is actually going to keep getting colder as we go into the weekend. that's because we have yet again another arctic wave coming in as we approach the weekend. it will start in the midwest and push into areas of the northeast as we go through the weekend. but also notice how far south it dips. we're talking areas of texas, even georgia looking at temperatures well below average. take atlanta for example, 51 for friday, not too bad, 35 for the high temperature on monday in atlanta, dallas may not even hit the freezing mark on monday. so again, this actually spreads pretty far, not just your usual places. the problem is for folks in the midwest and the northeast, you also have more snow coming. and a lot of the places that have already seen plenty of it. michigan, ohio, pennsylvania, and new york, including the town of eerie which could pick up an additional 10 to 20 inches of snow, but out west, this is where we're talking about the huge amounts of snow. areas of montana, idaho, even areas of washington could be looking at multiple feet of snow. but the big concern that everybody wants to know about, new york city's forecast for new year's eve, i wish i had better news for anderson and andy, looks like the temperatures could be close to single digits with windchills in the negative numbers. >> bundle up. allison, thanks for the warning. and thank you for joining me on this thursday. dana bash takes it from here on the lead, right now. thanks anna. roy moore just won't get back on the horse he rode in on. the lead starts right now. as of two hours ago, the alabama senate election is finally officially over. but accused sexual abuser and vanquished gop candidate roy moore just won't let it go. releasing a new statement moments ago as the state of alabama makes the results official. out of nowhere, president trump takes a break from golf and tweets a shot at china. did the situation over north korea just heat up?
