Now, you put that together with some information cnn is also getting from other Law Enforcement sources says that richard matt had fallen ill either from drinking bad water or eating some bad food while they were on the run for about three weeks. He had fallen ill, and david sweat now telling authorities from his hospital bed that he left him behind. Now, richard matt was caught and then shot and killed on friday in an area about 16 miles from where his partner david sweat was caught yesterday. Soshgs so you know, we now know that they were walking. Their plan a, to run away with the prison seamstress Joyce Mitchell, to mexico fell threw when she decided not to show up. This was their plan b. They were simply walking. Both of them found in one county over from the prison where they escaped, about 30 miles to the west and in some cases to the north. We know david sweat was about two miles south of the border with canada when he was arrested and now really quickly brooke hes been upgraded here at the hospital, david sweat, from critical to serious condition. Hes being very closely watched in this hospital. He will not have to have surgery, but he will be here for a few more days. The beginning of perhaps more talking. Sara ganim, thank you so much. Well take you live to my colleague Pablo Sandoval standing next to the field where this bloody picture of david sweat was taken, the field where his 23 days on the run came to an end with two gunshots to the back. Polo this Police Officer who spotted him, who shot him, he is being hailed a hero. How did this all go down . Reporter like a hollywood movie, brooke. Thats how it was described t. Was a dramatic ending that took place yesterday. The Police Officer that spoke to Governor Cuomo said he was driving down the roads identified a suspicious individual. He claims he was able to identify him as david sweat, at which point sweat immediately makes a break for the tree line you see in the distance there, brooke. Two main concerns on the mind of this police sergeant, one of them sweat was wearing camouflage clothing so the main concern is if he was able to make it intoed wooded area he could lose sight of him and he would slip away. The other concern, brooke ohm about a mile and a half beyond this tree line is actually the u. S. canadian border. Thats when this officer jay cook drew his weapon, got down on one knee according to what hes telling the governor and shot two times hitting this cop killer right in the back. He was taken into custody and with those two shots it really was the beginning off the end of this manhunt that has so many people in upstate new york living in fear. Art, before we get into all the nittygritty details the fact that we now know its not even been 24 hours since sweat was was taken down in that field. Hes been in the hospital the fact that he ditched his buddy matt about five days ago, two days before he was killed by fleece apparently sick because matt was slowing him down. Do you think that was actually the beginning of the end for sweat . Yes. I think theres a couple of issues here, brooke. I mean, number one when they did the identification of the dna in that cabin down in dannemora where the guards apparently owned that particular cabin, i knew at that point they had cut the gap that two weeks from when they were in jail. And i thought they were getting very close. The fact that matt got sick doesnt surprise me. Bad food bad water can do that to anybody. Youre out in those woods. Im sure it was dysentery that he probably had, and he became literally dead weight for sweat. I think thats probably either at that point in time or shortly thereafter that they ended up splitting up. When you look also too were showing pictures on loop, pictures of sweat being taken down in this field, bloodied in the camouflage, apparently on him just some nuggets poptarts, repellent, mosquito repellent. He had maps on him. But he was unarmed and he was near the road. When you look at the field, its not that densely wood. To be so near a road knowing everyone is looking for him, do you think he was near giving up . I dont think so because he bolted. I mean, he took off from the state trooper once the trooper identified him. I 50 he thought he was so close to the border that he was making a run for freedom, which to me was kind of odd in and of itself because he would have just been out of the frying pan into the fire if he tried to cross the canadian border. Our friends on the other side were ready and waiting. But the fact that he bolted i think, you know means he was still looking to get away. But also i was very surprised he didnt have a weapon on him. Right. Perhaps he did at one point in time but totally unarmed. Richard matt, by the way, a couple of days ago when he was caught, he was shot in the head. And david sweat was hit twice in his torso. Im wondering you tell me if youre a member of this task force, do you think these officers were directed if you have eyed on someone, try to take them alive . Absolutely. You always try to take somebody alive. In this particular case this fits into whats called a deadly force policy. This individual was a murderer. In fact, he had killed a Law Enforcement officer brutally. And that there was an imminent danger to the public. Fe got away and got into the woods, who knows what would have happened from this point on. So he was right within his rights, Sergeant Cook from the Ny State Police to make that shot. Its a clean shooting and i dont think theres going to be any issue regarding this shooting, anybody questioning why he pulled the trigger in this particular situation. Personally having been in segregation myself although not having escaped, i dont think theres that much in it at all to be telling what happened. You know, as you know he had a prison staffer, two, involved in his escape. At least. People that we know of. Yes. I mean the investigation continues. But their colleagues still work there and theyve lost at least two of their own. Theres a very severe bunker mentality, a very strict cohesion amongst guards and since theyve lost at least two of their colleagues, theres going to some resentment toward sweat for what has happened and that he involved guards and Staff Members that really had no business getting involved with any inmate business whatsoever. You call it a bunker mentality. Ive heard its a brotherhood, this brotherhood of corrections officers. So if he does break and Start Talking about this guard or potentially other guards who were in on it for who knows how long the planning happened and lets say he doesnt go back chandra to this facility, goes somewhere else will the word still spread whenever he lands . I think the word probably has spread, in my experience within a state correctional system the guards transfer around a lot of times. They can move throughout the state and then switch to a prison or facility closer to their home. Sometimes there might actually be a problem where theyre working, maybe a problem with an inmate they know one of them. So theyd be transferred to another facility. So the likelihood that hell never see another guard that worked at dan dimora i would say would be low. I wont say hell see all of them but hell see some of them. But if hes in seclusion solidary, for lets say the rest of his life how could a guard even make that life even more of a living hell . Well, when youre in solid solitary, you are totally depend dpent on the guards to meet your every need from smings as basic as food toiletries toilet paper, toothbrush toothpaste et cetera. Also if a guard is somewhat abusive or hostile towards you in seg gra gaigs, you have nowhere to explain or ask for relief or assistance. Youre stuck explaining to the exact person who might be giving you a hard time. Its very hard. They control everything that will go in and out of his cell which might i say is very little. He will get food. Hell get the bare minimum of what he needs. But other than that david sweat has a very very long road of ahead of him in a tiny little cell. What about inmates . Does he even care how other inmates may treat him . At this point, he may have contact with inmates. A lot of inmates assist guards, help them handing out food things like that in the segregation unit. Hell have a little bit of contact with inmates. Generally, i mean if an inmate is professional in taking their job, work assignment seriously, within the prison they wont act adversely toward sweat. If theyre angry because they lost privileges or theres continuing punishment for the people who remained after the escape then they might give him a hard time. Buff but i doubt hell ever be alone enough to be physically assaulted by another inmate. Hell be watched so closely for the rest of his life. Having spent time behind bars if you were to have david sweat sitting in front of you, knowing what you know and what we really dont know whats the one question youd ask of him . Well if a default causes wider panic in Financial Markets we saw some of that today. I mean the dow is down about 250 points. Huge. So if it precipitates broader concern about the state of the global economy, then it could have a direct affect on you. Not so much because you have your Holding Stocks that are closely related to greece but because it creates a psychological spillover effect. What about the eurozone . Thats a big deal. Youre saying they doernlt want out of the euro but no. This is lkook its clearly a problem for the greeks. You have 30 unemployment. Whether they do the austerity deal or not, its going to get worse in greece before it gets better. But its also a profund also existential question for the european union. Greece probably didnt quite belong in the eu to begin with. But if greece doesnt belong what about portugal spain . Are where does the attention turn next . Does this precipitate a cascading sense of europe falling apart, which would obviously have profound impact on europe and the rest of the world. So thats why its really hard to judge the path ahead. People are coming into our country. We have no idea and theyre from all over the world who they are. We have to have strong borders. If we dont have strong borders, you dont have a country anymore. So i told nbc, i cant change my stance. And this is one of the things i do. I say anybody thats very successful, its hard to run for Political Office because youre going to upset people. Investigators are working on the premise that in fact one of the reasons richard matt wanted to take that camper van, remember he shot at the von, very carefully not as to blow out a tire not to make the van crash because he was getting weaker. Thats the premise that theyre operating on. He had also apparently been drinking, had found alcohol in one of the cabins. Apparently one of the investigators said that the smell was extremely strong. Supreme court today upheld the use of the controversial drug for lethal injections and executions. This sparked bitter words, including a renewed debate over the legality of capital punishment. Reporter brooke this case was brought by three death row inmates challenging oklahomas lethal injection protocol specifically the controversial drug that is supposed to render a person unconscious, so that person is not having pain. This was used in the botched execution where the inmate died after 40 minutes. The suit claims the drug doesnt work effectively and it violates the cruel and unusual punishment clause. The Supreme Court ruled that the plaintiffs failed to show that the drug violates the constitution. As you point out, brooke this is an issue that has sparked contentious debate among the justices during oral arguments that is reflected in the fiery dissent. Judge sotomayor says the petitioners are left exposed to what may be the chemical equivalent of being burned at the stake. Justice breyer brought up the fact that he says its highly unlikely the Death Penalty violates the eighth amendment. A dramatic way to end the term today, brooke. You know that same Sex Marriage Ruling may be etched forever in the history books, but the fallout as well from this landmark decision is startling. The weekend marking the celebrations of same sex weds in cities all across the country, but for other its awaiting games as several officials in states are vicing their concerns and holding off on issuing marriage licenses. A Country Music star who is gay spoke about those resisting this decision. I promise you all of these people who are trying to stir the pot of hate about People Like Us they have gay children. They have gay siblings. They have gay neighbors. They may not know about that because their neighbors and children and employers perhaps are reticent to tell them who they are. But i can assure you those gop nominees hoping to get the nomination in 20 years will look back and i really firmly believe this will be a regret for them. This will go down in the anals of history as one of the great days of civil rights. We know that long after the ink dries on legislation it takes a long time for hearts and minds to change. Let me bring in our senior legal analyst jeff toobin who, you know friday was a big day for a lot of people and if you lived in new york we saw the celebrations through the weekend. Sure. But not everyone is celebrating. I think my first question and i could cite is examples texas mississippi, alabama, there are folks to put it in your phraseology with religious scruples who do not wish to lets say, if asked, participate or mary a samesex couple. Would he or she have that right . The answer is at this point we dont know for sure. But what we do know is that, if lets say in county x in alabama a person a says i dont want to perform this samesex wedding, almost certainly the courts will say, person a, you dont have to do it but somebody has to do it. That every place that performs weddings is going to have to give samesex couples the opportunity to get married. Theyre not necessarily going to have every individual who usually performs weddings, but they are going to have the right to get married in every county in the country. That thats what i think the ruling means. It may not be probate judge a but judge d who will marry the samesex couple. Correct. Although i think there will be litigation because some counties will say, you can go to the next county or the county two over. And the courts are going to be forced to say when does the right become really compromised . And that will be one of the potential fallouts. Indeed. Let me ask you about this because i was reading in the New York Times talking about potential implications with conservative religious schools that currently have policies on the books where you cannot be a samesex couple or be taking part in their married Student Housing if youre a samesex couple. With this ruling how would that affect those policies or perhaps their losing their tax exempt status . This is a real unknown. This comes from the Bob Jones University which doesnt allow interracial dating back in the Reagan Administration the Supreme Court said you lose your Tax Exemption because thats a violation of public pol policy policy. So the question is if a university has religious scruples involving discrimination against gay people, do they get to keep their Tax Exemption . And the slis ter general was asked that question during the oral arguments. What did he say . He said good question, i dont know the answer. We dont know a lot of things yet. Its just beginning. And what really moved me was just all of my training and background and all of the lessons ive learned in life and most importantly letting god just lead me in that moment. You obviously knew the president was coming. He was delivering the eulogy. And it was such a moment for all of us to watch it. But for you to be sitting there, to feel it what was that like in person . To see the president in person and to hear such a stirring and moving eulogy given for such a great man that was senator Clementa Pinckney it was a lifetime experience that i will never forget and my spirit was so moved on that day. Did you get a chance to shake the president s hand talk to him at all . I did not. You know, a role as a musician we have to kind of not be in the moment too much and i had to get ready for the next choir selection that was coming with the rest of the musicians. So it was just an inthemoment type of thing, and you had to kind of switch gears and still be in your profession to do what youve been called to do. Understood. You had a job to do. Thats precisely what you did. But, charles, if you had the president in front of you and especially listening to his entire message to really all of us what would you have said to him . I would say, mr. President , i thank you for the words of encouragement that you have given this city this state, this nation and to the world, reminding us about gods Amazing Grace, how it is unfailing and it continues to be with us and bring us together at this time. We are much stronger now than we were three weeks ago. How, charles, were you chosen to play that day . I am a former musician from mother emanuel. I used to play at the church. And the minuteister of music Wayne Singleton is the person i reached out to just offer my condolences anything i could offer being that i work for fox music house. He said, i really appreciate that and i will be in touch with you because i would need some musicians to help me out on that day. Could you, for people who have never sat in on a church such as this explain the significance of the organ. The organ has been around for centuries, in cathedrals in churches, despite denomination. The organ and any instrument of that nature really is a help to undergird the message of any service. It goes hand in hand with the word of god, and it just drives home the point that god is in the midst of everything, and he is controlling our actions and everything that we do. As long as we give him glory and give it all to him, that he would honor that. You talk about grace, the president talked about grace. I want to end with you just speaking about your mentor, reverend pinckney. You lost him. I also know you lost your cousin. Would you like to share some words about them before we let you go . I definitely am grateful to god for this platform that has been provided and at this time i just definitely want to bring focus back to those nine families, one of which im a part of. Reverend pinckney was such a great man and mentor to me throughout my upbringing in the ame church. And my cousin reverend dan simmons was a wonderful member of the family and we just saw him three weeks ago at my grandfathers passing. Charles miller jr. , thank you so much.
