"cnn newsroom" begins right now. good morning to you. happy tuesday. i'm carol costello. thank you so much for joining me. we begin this morning in florida. much of that state is underwater, including parts of interstate 10 east of tallahassee. tropical storm debby is clinging to florida's gulf coast, dumping more than a foot of rain on some areas and threatening to wipe out another 12 inches before it moves on. many lifelong floridians are seeing their worst flooding in a generation. george howell is there in the panhandle, south of tallahassee. >> reporter: carol, good morning. i'm standing in about a foot of water right now, just outside this convenience store. and if you pan over here, you can see this is the situation. a lot of water fell very quickly. a lot of rain in a very short amount of time. and this is what people are dealing with. this water at this convenience store, it has been receding very quickly. in fact, when we got here, it was a lot higher. in fact, it got into the store overnight. came up to about right here. when we got here. but it's been dropping substantially. so that is good news for people. people dealing with the flooding conditions in the low-lying areas. now, this county was the hardest hit, one of the hardest hit so far in the storm. the county has seen 25 inches of rain in the last several days. again also the winds associated with the storm knocked down trees, knocked down power lines. and right now crews are restoring that. we did talk with a few people with emergency management, with the sheriff's office. officials have been going around surveying the damage. here is what one person had to say about what he's seen. take a listen. >> if you're not prepared, you can really get caught and pushes up a real bind. in my own personal case, it came up on my house, within three feet of the front of my house, and i'm not in any kind of flood zone or anything. so you can see it coming, and it comes fast. it was amazing from about 5:00 to, oh, about 10:00 or 11:00 last night how quickly it came up. >> reporter: a live picture here back at this convenience store where the owner there, the owner did put sand bags out in preparation for what she expected to happen overnight. still the water did get inside the store. caused some damage. but again, she says at least, you know, she can start over. the damage not so bad. so she will start over. >> yeah. our best to her. george howell from wakulla county, florida. a dozen wildfires in colorado are sweeping across the state. more than 140,000 acres have burned. the denver post reporting military planes are now dropping flame retardant on the waldo canyon. that fire is burning out of control just north of colorado springs, and is now within 10 miles of the u.s. air force academy. fire officials have backed off earlier warnings that the academy could be in danger. evacuation orders have been lifted for about half the 11,000 people chased out of their homes. for those still in shelters, the wait is agonizing. >> i know where the fire was. i've sooeen it up close to my home. and i'm thinking there's no way we don't have structures damaged unless there's a miracle. that's what i'm praying for. >> fire crews warn that hot, windy conditions will give them problems for at least a couple more days. as you know by now, arizona's immigration law was gutted by the u.s. supreme court. yes, the show me your papers part of arizona's law stands, but only because it has not been enforced. once it is, you can bet someone will file a lawsuit, and then it may again wind up in the supreme court. but in some people's minds, the bigger story here is justin antonin scalia, now accused of being a, quote, politician in a robe, and that's not a compliment. here's why. justice scalia voted against the majority. he believed all of arizona's law was constitutional. since states have the right to protect their borders. but scalia went one step further and criticized president obama in his written didssent. here is the quote. but to say as the court does that arizona contradicts federal law by enforcing applications of the immigration act that the president declines to enforce boggles the mind. end quote. our expert on the u.s. supreme court is here, jeffrey toobin. hi, jeff. >> hi, carol. >> so when you read this did dissent, did your eyes bug out? >> it was even better than that. because when the justices are very agitated about a decision of their colleagues that they disagree with, they read their opinion from the bench. they don't just file the written dissent. so justice scalia dissented from the bench, and even his colleagues were sort of looking up at the ve hemmence of his rhetoric. at another point in his dissenting opinion, he said, you know, if this decision had come about in the 18th century, the entire united states would never have been formed. the states would never have agreed to join. and i'm thinking to myself, there can't be another of the 300 million people in america who think this decision is that big a deal that it would have cancelled the entire united states of america. but that's the way justice scalia talks. he is a very enthusiastic person. >> well, specifically, when he was criticizing president obama, he was talking about obama's executive directive allowing some young illegals to stay if they came here through no fault of their own. would you consider that partisan? >> well, i don't know about partisan. it is legally irrelevant to this case. this case was argued in the supreme court well before president obama even issued that order. so it's not evidence in the case. it was not part of the case. it was obviously just something justice scalia wanted to get off his chest. you know, this is the way justice scalia is. he is very engaged in the politics of the day. you may remember in the health care case, he asked a question about, you know, could the federal government force you to eat broccoli? that is a question that had come up on a lot of conservative websites. something he is obviously very much in touch with. i don't think it's improper, but i think it tells you a lot about justice scalia's orientation. >> but justices aren't supposed to insert themselves politically into issues that could wind up at the u.s. supreme court. right? but that's exactly what he did because president obama's, you know, executive elective decision or directive, rather, could wind up in the u.s. supreme court, couldn't it? >> it could. but i think justices have some flexibility in acknowledging what's going on in the world. you know, they are allowed to cite newspaper articles, and they recognize that the political context of what's happening. look there, is no doubt what's going on here. justice scalia is a very conservative man. he is very much opposed to president obama. there is no mystery about that. you know, whether it's judicially improper, i'm inclined to give him the benefit of the doubt. but it is worth all of us taking note of just how conservative and just how anti-president obama justice scalia is. >> so thursday should be a mighty interesting day. >> oh, i can't wait. even though i have a seat in the courtroom, i may camp out in advance just to kind of soak up the vibe. >> i would not be surprised. jeffrey toobin, many thanks. >> thank you, carol. >> thursday the u.s. supreme court is supposed to hand down its decision on president obama's health care law. now let's cross the border to southern ontario. rescuers are venturing back into the ruins of a collapsed shopping mall where at least two people remain trapped. search and rescue teams say they have heard possibly sounds of breathing, but crews are moving cautiously because they fear the entire structure could collapse. we'll have a live report in just a few minutes. also this morning, tensions are ratcheting up after syria shoots down a warplane. turkey says it will treat any future approach as a threat and will take action accordingly. also new this morning, nato condemned syria's attack. the military alliance met to discuss the danger flare-up between the two armed regional powers. a new chapter in the showdown in the government's controversial fast and furious gun running sting. house oversight committee chair darrell issa has fired off a letter to president obama. issa is asking the president to reconsider his decision to cite executive privilege in that investigation. this comes just days before the house gets ready to vote whether to hold attorney general eric holder in contempt for not turning over documents related to the case. the vote will happen on thursday. two veteran capitol hill lawmakers face bruising primary challenges today as they try to hold onto their seats. orrin hatch appears poised to win. hatch has mitt romney's support. and harlem congressman charlie rangel is hoping to be re-elected to his 22nd term. rangel thinks voters will support him despite being found guilty of ethics violations in 2010 by fellow lawmakers. here's what he told our soledad o'brien a short time ago. >> i got 83% of the vote the last time out. but the most important thing, if people would read the website of the ethics committee, read "the new york times" about a month ago, where sam roberts put an expose out against the conduct of the committee that right now as you and i talk, that committee is under investigation by private counsel for wrongdoing. now, that's behind us. i have been elected overwhelmingly. >> we'll see. the former house ways and means chairman is in a locked five-way race in a newly drawn district. ? >> in you use a mac and search orbitz for the cheapest travel, you may not be getting it. n in fact, the site is showing you a more expensive hotel. alison kosik is at the new york stock exchange. so mac users are being taken advantage of just because they use macs? >> looking from the outside in, it looks that way. travel website orbitz has found that mac users spend as much as 30% more a night on accommodations versus a pc user. so the "wall street journal" says that orbitz is steering mac users to more expensive hotels. what they found is that depending on the city, the results interestingly enough come up very different between pc and mac users. as you can imagine, this is not sitting very well with many people. some are actually accusing orbitz of charging mac users more. but orbitz tells cnn this is not the case. prices are the same. results are just displayed differently. rbitz says that the story g hotels more than pc users. we make recommendations about hotels along a number of variables, such as traveling with or without children. regardless of what type of computer you're using at home, you can still sort your results by price, carol. >> how common is it for websites to do this? >> well, rival sites, expedia, priceline, and travelocity say we don't base suggestions on the type of computer a customer is using. but the ceo of rue-la-la says they pay very close attention to ipad and iphone users because they account for a huge chunk of mobile sales. and analysts say that's likely to become more common. it makes sense. if someone is willing to spend $600 on an ipad, probably a lot more likely that they'll have extra money to spend elsewhere. carol? >> reporter: yeah. that was yesterday morning at 4:00 a.m. they have some specialized equipment that can monitor whether or not somebody may be buried underneath the rubble. and they detected signs of breathing by someone underneath giant concrete slabs inside of this mall. when the roof came crashing down, and this was saturday afternoon at 2:00, you know, big concrete slabs and metal came crashing into the mall. they are not sure how many people were trapped underneath that rubble. but they have detected signs of life yesterday morning of at least one person. they also say that one other person is now confirmed dead in that disaster. and there may be many other people trapped underneath the rubble. and the rescue yesterday temporarily at least at one point was called off because of safety concerns. however, they decided late last night after people in this town reacted very angrily to that decision, they are going to try again using another method, heavy machinery, to try and dismantle sections of the building to get to where people may be trapped. >> i was going to ask you what kind of equipment they're using because the whole thing could go down. >> yeah. i mean, and the hope was yesterday at least earlier in the day that the rescuers could sort of pick their way through the rubble and get to where the signs of life were detected. but at one point, the engineers just looked at the situation and said, look, guys, this whole thing could come down. we just have to pull out. so last night the decision was made by officials that we're going to try again, but perhaps using some unconventional methods here. so they are going to bring in heavy equipment. they are not sure how long this is going to take, but they say they'll try and get in from the outside and dismantle the building to the point where maybe they can get rescuers in. maybe they can look lithrough tt rubble to determine whether anyone is still alive three days later. >> thanks so much. in washington, the pentagon is making history today. their first-ever gay pride event. the pentagon hosting a gay pride event. that would be history making. and history will be made today. it was just last year don't ask don't tell went away. the controversy remains, though, but the pentagon is moving on. today, gay and lesbian service members will be recognized for their commitment to the gay community and their service to this country. the pentagon is hosting its first-ever pride event since the repeal. defense secretary leon panetta had this message. >> i want to personally thank all of our gay and lesbian service members. lgbt civilians and their families for their dedicated service to our country. and now after repeal, you can be proud of serving your country and be proud of who you are when in uniform. >> serving openly in the coast guard is lieutenant commander zach matthews. welcome. >> carol, good morning. thank you for having me. >> thanks for being here. lieu, this must be an exciting day for you. did you ever think you would see this day? >> well, it certainly is. and i think there are quite a few of gay and lesbian service members who are very excited to see this day come. >> it's a rather subdued event, including a roundtable discussion. certainly not the festive raucous street parties we usually associate with gay pride evens. why do you suppose that is? >> i think it's important to focus on the service of gay and lesbian service members around the world today. like the -- even before the repeal of don't ask don't tell, gays and lesbians came to work every day and did their job. they did what they were trained to do. and now that don't ask don't tell has been repealed, they do the same thing. nothing has changed. they continue to come to work every day. they drive tanks. they fly helicopters. they protect this nation's freedoms. and it's -- it's important because it shows that gays and lesbian -- gay and lesbian service members serve with the same enthusiasm as any other service member, regardless of sexual orientation. >> you say it hasn't changed, but, it's changed. tell me how it's changed for you. >> well, it's a big change. it's a big change because i can be open and honest with my co-workers. integrity is important to me. and as a leader in the military, that honesty and that communication that i have is important. and that is the biggest change. but other than that, it's all in a day's work, so to speak. i continue to come to work and do my job. >> your fellow service members are -- if they're gay, are they coming forward now? do they feel comfortable enough to do that already? >> i think that each service member -- or each gay and lesbian service member's to come out is their own individual decision. but i think it's important that as leaders in the military we stand up and give a good example to others that gay and lesbians serve in the military and also to dispel any negative stereotypes as well. >> and as far as gay people signing up, is there an increase? [ all ] i'm with scottrade. opening bell on wall street just about to ring. stocks are pointing to a higher start as investors are keeping a close eye on europe, of course. leaders are holding a summit this thursday to address the euro debt crisis. ringing the bell this morning, members of the sinax corporation based in california. this morning, parts of florida are closed due to flooding from tropical storm debby. debby could dump another foot of rain on florida's south coast. floodwaters have trapped some people in their home since sunday. the house is set to vote this thursday on whether to hold attorney general eric holder in contempt of congress. last week, holder refused to give all of the requested documents in the government's controversial fast and furious gun-running sting. president obama used his executive privilege, allowing the justice department to withhold some of those documents. it is hip to be mormon. really? maybe you've seen one of these billboards while driving around town whiched reads, i'm a mormon. or maybe you bought a broadway ticket to see "the book of mormon." whatever the case, "the new york times" best selling author who wrote a book about the faith of president george w. bush is out with a new bestseller, "the mormonizing of america." you say mormonism has emerged as one of the fastest-growing religions. how do you explain it? >> i think that even if you don't accept, like, or believe in their supernatural doctrines, the fact is they just have a dynamic society of investment, of family, of social impact that has just increased their numbers. there were only 1 million of them in 1950 in america. now there are 7 million. that's phenomenal growth. and faster than almost any other religion in america. >> what's attracting people to the mormon faith? >> well, in an unfathered generation, with the breakdown of the family, they promise a heavenly father. they have unbelievable community. they ooze around people. they know how to have a big porch so to speak and invite people in. and then there's just that tight community, belonging. the community and the family are eternal things. and they believe in everybody having gifts, and awful the males having an office in the religion. so there's a tremendous amount of belonging, connection, heavenly father orientation, and a society that's very fragmented and relationally broken. >> ok. so why isn't mitt romney talking more about his religion if mormonism has become so popular so quickly? >> i think both campaigns are staying away from it right now. and mitt romney, the scuttle but the politically as you may know is that he has been urged by senior advisers not to talk about it in this campaign. they think he talked about it too much in 2008, that it hurt him. and now they are sort of holding him back. i don't think that's going to work. i think we're still heading towards what i call a mormon moment in this election, where there's going to be a conflict. somebody is going to make an allegation, and we're going to have to air it. >> you said there could be a collision in this election between romney and obama over their faiths. what might it be like? what would it look like? >> well, you know, you have to realize 20% of republicans say they will not vote for a mormon. 27% of democrats say they won't. you have mr. obama with his nontraditional brand of christianity many people think. the polls show us they think that. and then you have mr. romney who is a mormon. so it will only take an outliar criticism for both of them to come center stage. i think that's yet ahead of us. >> ok. let's say that doesn't happen. if it doesn't happen, you know, then we always believe during the primaries that religion is an important focactor when it comes to politicians we choose. but it doesn't come up in the general election, does that show us that religion is not so important anymore in electing the president of the united states? >> well, we might conclude that except the polls show otherwise. the number of people who won't vote for a mormon, the number of people who tonight believe it's christianity, according to some surveys. the number of people who think it's in conflict with the american mainstream. if we go silent on religion during the final phase, it will belie everything the polls are telling us, which means people are intentionally going silent on the subject. i don't think that's healthy. >> steven mansfield, thank you so much. >> thank you very much. good to be with you. as the morning show wars heat up, "the today show's" co-host could be in for a multimillion dollar paycheck to leave. we have the scoop. i'm the second owner. the what? i will own this car after you. look, i'm not telling you how to drive our car. our car? nor where to park her. maybe under a tree with less sap. if you're gonna have a latte in the car, keep a lid on it. it's a cappuccino. still needs a lid. [ male announcer ] the exceptional certified pre-owned program with the highest quality cars. good news for the second owner. take care of my car. ♪ d you've probably heard the rumors about "today show" host ann curry. she could be paid up to $10 million to leave the show. cnn's alina cho has more on the morning show wars that could force curry from her job. >> this is "today." >> reporter: on the set of "the today show," it's business as usual. >> and good morning, everyone. >> reporter: matt lauer and ann curry co-hosting the show as they have for the past year. but if you believe all the recent media reports, there could soon be a change. >> now there's this very strange situation going on where she is on the show every morning acting like nothing is going on. >> reporter: behind the scenes amidst declining ratings, reports are rampant that curry is negotiating her exit and that she could leave "the today show" as early as this week. why? insiders say it all comes down to chemistry. >> if it does rain, we're going to be dancing both of us outside. >> well, let's just make that you. >> research showed that ann was great on her own and the viewers love her. but being paired with matt may have not been the right thing. >> reporter: "new york times" media reporter brian stelter broke the news that curry could be leaving. why now? and so soon? for one, the competition. >> hello, everyone. everyone is stepping up their game. >> reporter: the numbers don't lie. though "the today show" has been number one for 16 years and still is, in april, abc's "good morning america" took the lead and has won the ratings battle several more weeks since then. >> maybe that's because those people on "gma" now are people you want to hang out with and spend more time with. right now, "gma" feels fresher. >> and "the today show"? >> it feels sail. stale . >> nbc isn't commenting but in a recent interview matt lauer said this. >> when people start to write articles about what might be wrong with "the today show," do you know where you should point the finger? point it at me. i've been there the longest and it's my responsibility. >> reporter: as for curry, in an interview for the august cover of "ladies home journal" when asked about the ratings decline, she said, it's hard not to take it personally. you worry. am i not good enough? am i not what people need? >> this isn't nonprofit theater. it's advertiser supported television. >> i'd rather do a good show for 100 people than a bad one for 1 million, if that's what you're saying. >> reporter: the problem is viewers count. the more people watch, the more money morning tv shows make. which is why who sits in that anchor chair is so closely watched. >> actually, we have alina cho with us live. and i know she makes a lot of money. but she is still a human being. and to sit there day after day while rumors are swirling around, that cannot be easy. >> you're absolutely right. in fact, i happen to speak with somebody over at "good morning america" over the weekend. and congratulated this person. and said, you know, congratulations on your ratings wins preently. and this person said to me, yes, thank you. and in the same breath said, i feel very badly for ann curry. having said that, carol, as you know, this is about the news. this is about chemistry when you're talking about co-anchors. but it really is about money. and a lot of money. "the today show" generates an estimated $300 million a year for nbc in profits. a year. and that makes it one of the most profitable shows, not just in the news business, carol, but in the television industry as a whole. and that underscores why we are paying so much attention to who sits in that anchor chair. >> i'm going to say this. it's just -- it's just amazing that nbc allowed these rumors to leak out, because there had to be a way to put a lid on it. and to make ann curry go through this. i know it's a business decision and all, but still. why -- where did the leak come from, i wonder? >> well, that's a very good question, carol. but, you know, i mean, we work in the news business. it is quite possible that -- >> it's cold, and cruel, and who cares. >> no. it's possible, you know, that someone wanted to float this as an idea and to see how people would react. i can tell you that we've been watching the blogs, we've been watching twitter, and there's been a lot of support there for ann curry. >> she's been there a long time. alina cho, thank you very much. one of wimbledon's legends fell hard and fell early. we'll look at venus' eclipse at wimbledon. ♪ ♪ ♪ ♪ ♪ 43 minutes past the hour. several colorado wildfires are raging out of control this morning. hot, dry, windy weather is expected to last through mid week. the largest fire has already destroyed nearly 250 homes. another fire has forced 11,000 people to evacuate. tropical storm debby still drowning parts of florida in rain. i10 east of tallahassee is closed because of flooding. debby could dump another foot of rain on florida's gulf coast. some people have been trapped in their homes since sunday. in money news, some states are considering higher fines for those caught texting and driving or calling and driving. aaa says seat belt studies show more drivers obey laws when fines go up. but the president of a drivers rights group says higher fees for distracted driving won't do the trick. he says education is the solution. in the world of entertainment, the prop head of former president george w. bush that appears on "the game of thrones yes has been removed or at least altered. this is what viewers saw when the video aired. now this they stream it online, they will see this image, all blurry. the show's creators says they did not mean it as a political statement. they just used props at their disposal. this morning, there are rises tensions just days after syria shot down a turkish warplane. >> translator: the engagement rules for the turkish armed forces has changed. any military approach deemed to be a risk from the turkish border from the syrian side will be perceived as a threat and dealt with accordingly. >> ivan watson is in istanbul. so what's syria saying about this? >> we haven't really heard a formal response from syria yet, carol. about you thbut this is a stern warning from turkey in light of the fact that the turks have really tried to play down past problems that have erupted along this troubled and turbulent border between turkey and syria. turkish officials are telling me, listen, we've had a number of syrian aircraft violate our air space in recent times. at least five syrian helicopters have done that in recent months, the turkish officials tell me, and we didn't choose to shoot any of them down without any warning fire. that approach will change now in light of the fact that the syrians shot down this turkish warplane without any warning message, without any warning shots. and the fact that the two turkish pilots of this reconnaissance jet are still missing and it's feared they will not survive now some five days after being shot down. >> so what could be the big worry here, ivan? >> reporter: well, i mean, this is already a tinder box in the region. we have a conflict inside syria that has claimed the lives of probably more than 10,000 people at this point, and shows no signs of ending. a civil war, some people are arguing. and the fear is it could draw in neighboring countries. turkey has provided a safe haven to the syrian opposition, to rebels. the syrian government has accused the turkish government of arming the rebels. the turks clearly don't want to engage in a war with their neighbor, but they are under pressure to respond to the loss of their plane and to the loss -- potential loss of two of their pilots as well. syria has very powerful supporters. iran and russia. and this would put turkey directly at odds with those two countries. as turkey has tried to build its international case in the world court of opinion on this shooting down of its plane, it has also reached out to syria's foreign patrons, russia and iran, to try to share with them their argument where the coordinates of the plane were when it was shot down to explain to them, listen, syria is in the wrong here. the syrians of course, they have been saying they shot this plane down in self-defense. carol? world's record, a whopping 50 seconds. engineering students at the university of maryland have been chasing the $250,000 price for 3 1/2 years. it doesn't sound that hard to win the prize, the flight just has to last ten seconds and reach an altitude of ten feet. for more than three decades, no one's been able to win the socorsky prize offered by the american helicopter society. nom polytechnic tropical storm debby, right now much of florida under water including parts of interstate 10 between tallahassee and jacksonville. tropical storm debby dumping nearly two feet of rain on some areas and threatening to wring out another 12 inches before the storm moves on. >> reporter: we're following a family as they got the order to evacuate. left on her own because the water was up to her knees and she was concerned that it would get into her home. she just came back and we're with her, she's very thankful the water did not get into her home. but that's the story we're seeing around here finally people are coming home to see what's left over after the flooding during the big storm. what a difference a day is making hire in the western part of the florida panhandle. again, this area saw a lot of rain. this county saw at least 25 inches of rain over the last several days, now we're just dealing with the remaining floodwaters, the water is receding here, but in live oak, also looking toward the eastern part of the state, you are seeing flooding occurring as this storm slowly moves off into the atlantic. >> george howell reporting live for us. let's head over to alexandra steele, the problem with this storm is that it's slow moving. >> tropical storm debby was stuck in this dead zone, two areas of high pressure. that area of high pressure has been the one scalding the west with high temperatures. but now it's responding to the jet stream, it was too high before, too far north, kind of like a driver driving this thing and it's finally beginning to move. stationary debby is now beginning to be on the move, now it's east at 20 miles an hour. you can even see all the convection with this, meaning the rain, severe weather, thunderstorms, are on this side. you heard george talking, he's driving east to get into the rain and all the rain and thunderstorms are pushing eastward. 25-mile-per-hour rains are still expected today. by tomorrow, we're going to watch the center of circulation make landfall, and as it does make landfall it will weaken. but as it moves into the gulf and into the atlantic, will it strengthen in that's a little too far to call. but we are going to finally see it again weaken. so this is what we have seen and this really has been the bull's eye, south of tallahassee, that was the bull's-eye with the rain, now we're going to watch the rain move farther eastward. so finally, some momentum in the offing. >> yeah, get out of there. >> it's going, it's going. in colorado, the conditions are hot, dry and dangerous. you heard alexandra talking about that, a dozen wildfires sweeping across the state, more than 140,000 acres have already burned. that's mind-boggling. right now some of the most you are negligent effo are -- urgent efforts are being spent on the waldo fire. >> reporter: we just got word from fire officials that overnight this fire grew, it's over 5,000 acres, there's 600 firefighters in there working, in difficult conditions, temperatures high winds and low humidity. just in the last hour or so, we have already seen the winds pick up a little bit and the fire start to get a little bit more active. they only have 5% containment on this fire. they hope to get more today, but it's really difficult to establish the fire line separating fuel from the fire with these conditions like this and there's always the chance with these conditions that a new fire could break out. just yesterday some new fires popped up in colorado and they were able to get them out pretty quickly. now let's cross the border into southern ontario, rescuers are venturing back into the ruins of a collapsed shopping mall. we have confirmed at least one person is dead, at least one other is trapped. crews are working cautiously because they fear the entire structure could collapse. >> we are moving to more extreme measureses to move this forward. those drawings and plans are being drafted now as we're talking. what this will do, it allows us to take a little bit more drastic measures than we were able to go. >> rescues say -- that could produce the risk of a catastrophic collapse. also this morning, tensions are ratcheting up after syria's shootdown of a warplane. turkey says it will now approach any aircraft from syria has a threat. nato has condemned syria's attack chkt. there's a new chapter in the showdown in the government's controversial fast and furious gun running sting. outside oversight committee darrell issa has fired off a letter to president obama. issa is asking the president to reconsider his use of executive privilege which allows the justice department to withhold some of the documents pertaining to fast and furious. the house will vote thursday on whether to hold attorney general eric holder in contempt for not turning over all documents. six-term senator orrin hatch is set to win the election. and charlie wrangle is hoping to be re-elected to his 22nd term. hartsfield-jackson international airport. >> president obama has been collecting donations from smaller done nations this year. and mitt romney is raising a lot more money than president obama is right now. president obama has turned to gimmicks, he's auctioning off lunches with sarah jessica parker and even with himself. some say that seems kind of desperate. >> i don't think it's desperate at all, if you look at the president's first campaign, ordinary people, small donors are an important part of what launched him into the presidency. i don't think that's different from 2008. i think the fact that many on wall street are turning on romney isn't shocking at all because he wants 20% across the board tax cuts. he wants to continue the bush policies of the previous eight years so that's not shocking to me. >> doesn't president obama need those kinds of donors, though, because they say money wins elections. >> it doesn't matter how many millionaires and billionaires that romney has propping him up, the fact of the matter is that he can't sell it and the american people are not going to buy it. obama has a far is superior record and he's going to win. >> he talked about the money mitt romney is making and what it means in boston yesterday. >> they will spend more money than we have ever seen in american history. and their message is very simple. they will just tell you that the economy is not where it needs to be, the economy is bad, and it's all my fault. >> if you look at the economy here in georgia, the housing market is not that robust, it's suffering. >> it's improving. >> it is, but it's not exact ll robust. what plan does president obama have, though, to, like make that unemployment rate go down farther? what specific plan does he have for the people of georgia to say, hey, your life's going to be look better. >> the people of georgia don't understand is that when this president took office, the unemployment rate was 10.2%. we have moved down to 8.4%. but the fact of the matter is that we're moving in the right directions. what the president is going to fight for is investments that make real job creation. >> you could talk about ohio in the exactly the same way, but the people of ohio don't feel like it's getting better economically, and they're still blaming president obama. so what part of his message needs to be clearer and stronger to make people believe that it really is getting better. >> the president also needs an advance partner. you know that congress is not active in major infrastructure in the united states. that would have brought down unemployment a point to a point and a half. if the president had a partner in congress, as opposed to a republican-led congress that's doing everything they can to stifle growth and recovery, we would have unemployment below 8%. >> it could change for the worse for the president in the next couple of months. >> but the fact is that america is going to force the president to get on with it and get a deal. historically we have been able to have bipartisan cooperation around infrastructure and that's where the opportunity is to bring down significant unemployment. and i'm confident when president obama defeats mitt romney in november, we will get some kind of a deal done to bring down his unemployment numbers. >> the supreme court is supposed to make its decision on obama care on thursday. do you have any guess as to the way it's going to come down. >> i think the court will uphold the law and shock a lot of americans. the fact of the matter is, when mitt romney was governor of massachusetts, he put forth an individual mandate because it's essential to bring costs down. you got to have healthy people as a part of the system, that's what mitt romney thought when he was governor of massachusetts and that's what we need for the united states of america. >> if the supreme court does that, how will it affect president obama, that's his signature legislation. >> i actually think it's going to energize the american public. they like that they can't be thrown out of a hospital or thrown out of their insurance coverage because they had a preexisting condition, and they like having their children covered. >> the president is a constitutional lawyer, he always said it was constitutional. >> i think it will be a worse moment for the supreme court. i think that it will be the power -- i think it will move a long way towards the decision that was so bad for america in bush v gore, you've seen the continuation of that in citizens united. and if the supreme court makes an argument to intervene in this process, it's going to be a more dark day for the u.s. supreme court. >> if this decision doesn't go president obama's way, he'll start campaigning against the supreme court? >> i think every american citizen who cares about having adequate health care should care about it. the fact of the matter is, there are 30 million people who need access to adequate health care that we need to provide. and if you stiff away the original mandate. when mitt romney was governor of massachusetts, he agreed with that approach. but since he's been running for few accounts across the country generally in the united states to see if it works, when they test it, then they turn it off again. that was just a testing, not a product announcement. >> it's just a test, and everybody hears about it, why don't they just be transparent and say hey, we're testing this, do you like it? >> this one may be disturbing if you think -- they call it the stalker act. but if you think about it finding friends with like interests. you're at a reunion football game, you want to see who else is around. you're at a concert, and you want to know who's around. my advice will be to make sure that no teens are using it. my guess is that facebook is not even considering that. >> some people say that the line is getting blurry on facebook between connecting and invading. control this morning. hot, dry, windy weather, fuelling the flames will last through midweek, the largest fire has already destroyed nearly 250 homes. the u.s. house set to vote this thursday whether to hold eric holder in contempt of congress. last week holder refused to hand over all the government documents in the fast and furious gun running sting. sugar hill is now open only 30 minutes a day monday through saturday. residents in the small town of white mountains say they knew -- city officials plan to challenge this decision. in a related story, ten current and former postal workers are also fighting back against cuts to the postal service. they're staging a three-day hunger strike on capitol hill so americans won't lose a national treasure, their local post office. here are the changes ahead for the postal service, plans are in place to close or consolidate 48 mail processing -- 229 plants will be consolidated or closed and 28,000 jobs will be gone. tom dodge is one of the worker who s who want to get -- you've taken your fight right to the nation's capital. you called your post office a national treasure. i'm sure many people like their post office, but a national treasure? >> well, it's been around since the beginning of this country, since the revolutionary war, where 13 colonies came together and fought against the british to form the united states. the first postmaster general was benjamin franklin. it's been a dependable service for almost 236 years now. >> but the day is coming when post offices will go away just because the world is changing, is that an america that you don't want to be? >> there's a place for the internet, there's a place for cell phone service. there's areas in the country that don't have high speed internet and don't have access to cell phone service. once you get about 40 miles outside the city, it becomes spotty. this is affecting poor intercity who are least able to afford a computer. >> of all the things you could do to protest, why a hunger strike? how many days have you gone out eating now. >> well, actually a little over a day, this is actually a four-day hunger strike. and we will be wrapping this up on thursday around 6:00. >> so why a hunger stripe? why choose that it's to the point where if something isn't done soon, the postal service isn't going to survive, you can only build up so much debt for a certain amount of time before there's a point of no return, and we're getting close to that. that's why we're in d.c., to ask congress to stop the overpayment into retirement and health care systems. maybe congress can come together right now on restructuring the postal service and coming up with a bill, but at least stop the overpayment. >> i think the postmaster generals say even if congress moved to do that, it wouldn't get the postal service out of hot water. >> a lot of the problem is, which came first, the chicken or the egg? the postal service has responded to what they say is less customer demand. but what i have seen over the last 12 years is it actually cut service and drove customers away. they have done that over and over again. a few years ago, they took stamp machines out of every post office in the country. you can go in after hours and mail a letter, but you can't buy stamps there anymore. you c you can buy a whole book of stamps, but what if you need only one stamp. you have to go back to the post office to do the mailing. they have made it very inconvenient to use the post office anymore. >> i know you have some -- hopefully you'll get more attention from other lawmakers, we'll see. >> at long last, home -- allison kosik is at the new york stock exchange. >> normally people who are buying homes that are getting all the good news. but today i've got an ounce of encouragement, if you're a seller. a report from indicate schiler, says that home sales came in quite a bit higher in march than what wall street was expecting. if you look at the big cities, it showed the biggest increase in home prices in washington, phoenix and atlanta. of course here comes the bad news, overall prices are still down almost 2% from where they were a year ago. it's going to take a long time to make all of that lorsz value up. >> so, prices, i hear you allison, i do. so prices are finally moving higher, does this mean we have hit the bottom, though? >> one report doesn't make a trend, but we are starting to see more and more positive signs, most economists say that prices are going to fall a little bit more this year eventually bottoming out by 2013. we learned yesterday that new home sales jumped 26 points in may. those actually indicate future buildings, so that's a good sign. but here's why we're not out of the woods just yet. there's still this huge massive inventory of unsold homes on the market. it's really tough for a lot of people to qualify for that darn loan. if it's not one thing, it's another. were they boog or were they sayi saying -- during a fund-raiser at symphony hall in boston, president obama could not help teasing red socks fans. >> thank you for youkilis. i didn't think i could get any boos out of how the supreme court will rule on obama care, cnn is going in depth this week on health care. our chief medical reporter dr. sanjay gupta is going into hospitals to' how much they charge for basic items and why. >> one of the questions that comes up all the time, is these hospital bills, how do you break them down. how do you make sense of them? this is the hospital where i work. and just having an operation performed in a room like this costs about $3,000 an hour. that's for starters. come on in. if you look at a hospital bill, you might see an iv bag charge, an iv bag like this, $280, that might strike people as very high. this is a stapler that is often used in surgery, something like this costs about $1,200. this is a chest tube, if someone has a compression one of their lungs, a chest tube costs about $380. a suture that's used in every operating room in the world, this costs about $200. if you look at devices like, this is a needle used for biopsies, they would use a needle like this and this is goington to cost about $800. if you ask the manufacturers about this, why so much money? they'll say well it took years to develop something like this, the research and -- but something may you didn't know. when you look at a hospital bill, it's not just the cost of the supplies, there's also administrative costs that are built in. there's the cost of covering people who simply don't have insurance or current pay. that's built into these costs as well. keep in mind, what is charged and what is ultimately paid are two very different numbers. >> the typical hospital collects about 4 cents of every dollar that they bill. so it's not coming out in massive profits, it's coming out as a result of underpayment from the government. >> the cost breakdown like i just gave you on lots of these different supplies, a lot of people never see. a lot of people don't care as well. if you're inshurd, some people may not even open the hospital bill. but there are about 50 million people uninsured and they care very much about bills like this. you can call the hospital and get a detailed breakdown. and while you're on the phone with the hospital, if the cost seems too high or just hard to understand, you might be able to negotiate some of these prices down. >> i don't mean to smile at that, sanjay. negotiate prices down. >> it's a laborious process. >> those things cost so much because there's so many uninsured people in the world? >> the needle you buy -- but also because people who are go to the er who are uninsured and they get care, if they don't pay, it's uncompensated care. that cost is passed on to the hospital, it's passed on to yours and my premiums. which did some analysis and we found that about half of the hospitals in the united states are unprofitable, which is surprising to a lot of people and $56 billion a year is the price tag for uncompensated care. this is part of the impact of all this, the consequence. >> how does this relate to the health care bill that the supreme court will make a decision about on thursday. >> the mandate that everybody have insurance. at the state level, they have had laws in place that said look, there's not going to be a mandate, but we're going to require all people to not be discriminated against based on preexisting conditions, they can get health insurance just like everybody else. and eventually the premiums for everybody went up. in kentucky they went up 40%. if you watched a health care law without a mandate, it's possible that it will affect everybody, not just people that don't have health insurance. >> the reason that there's a requirement for every, nearly every american to buy insurance is so that insurance companies can afford to take on people with preexisting conditions? >> i don't think most people understand that. but you make a very good point, in the end, insurance companies actually -- they get a bunch of people into the coffers, many are young and healthy and aren't using the health care system at all. i don't think that people understand that the insurance companies are using that mandate and all that extra money to help pay for people who are ill, people who pay way too much for premiums or people who are uninsured. >> when the government is forcing you to do something that you don't need to do. >> if the mandate doesn't go through, his lawsuit. jonathan wall from north carolina claim s he was put int a head lock and forced out of a bar in downtown raleigh because of his skin color. he claims people who work at the downtown sports bar and grill are racist. attorneys for the club dispute that. in an interview on an affiliate, wral, they claim that on any night, 20% to 30% of the membership at that bar are minorities. so who do believe? jonathan wall called the whole thing demoralizing. he and his attorney are here to share their side of the story from raleigh. welcome to you both. >> good morning. >> good morning. >> jonathan why do you think that this was racially motivateded, the way you were treated in that bar? >> first of all, thank you for having me on the show. i believe that it was racially motivated mostly because in my vicinity i was the only fami african-american there, and the stories that came after my story kind of opened my eyes to the scope of the problem. and it wasn't just me. >> let's go to the beginning, that night you were standing in line to get into this bar, and tell me what happened. >> at the door, the first bouncer who was not the same guy, told us that we needed a membership to get in. and we looked at him like, a membership? we thought it was a bar. and he was like no, i'm sorry, you can't get in. and eventually he let us in. he said go ahead once he saw a cop out of the corner of both of our eyes. so i was allowed in the bar. and the details that happened are still posted on the letter online and because of the legal implications i really can't go into details right now. >> can you give us a little bit of detail about why you feel you were discriminated against. >> yes, ma'am, as i said before, it has to do with what happened that night and the other people who were in my vicinity, i was surrounded by white people who also did have drinks, their original argument was i was being kicked out because i didn't buy a drink. but there were people all around me without drinks and i felt targeted. and after he approached me the first time, he sat back at the bar and sized me up. and after i posted my story, it was the amazing response that i got from others that experienceded similar treatment that opened my eyes to the cope of the problem. >> how many people had a similar experience at that bar? how many people posted on facebook? >> facebook, e-mail, tweets, over 100 right now. the stories are still rolling in as the story spreads and so like i said, that's what really helped open my eyes to what's going on. >> alicia, you're jonathan's attorney. the -- the club said that your client sneaked in there and he wasn't supposed to be in there and it's a membership only club and they tossed him. >> first of all, he was allowed entry into the club, that's based upon information that we have from other individuals that were there at the time, part of his group. so far as this membership piece, i think it's important that we, individuals know that they're just slapping a label on to the situation, there are certain guidelines by north carolina laws and statutes saying if you're going to operate a private club, there's certain things that you have to do. and based upon the information we have, they haven't been operating in the realm of a private club. it's just something they have put out there, whenever it was convenient, when they wanted to say to an individual, hey, you can't come in because you have to have a membership. it's parent on the social media, that the people are of african-american descent. it's a pervasive problem and i'm not sure if you know that wral did a story a couple of years ago based on the same issues. >> are you going to file a lawsuit? >> we're in the early stages, we're
