i'm faster than an airplane on that. i'm giving it my best shot. anderson cooper 360 starts right now. >> thanks good evening everyone. tonight on the program, gabby giffords back on capitol hill today. she spoke on a subject that was difficult. keeping them honest tonight. why figuring out what the right thing to do is so difficult. and a terrifying moment at the winter x games. another incident your a snowmobile went kareening into people. right now a 6-year-old with asberger's syndrome who needs medication being held by a suspected killer. he is said to be a 65-year-old man, due in court today in connection with a run in last december with neighbors. instead, he is in that bunker in the yard. he stepped onto a school bus demanding two boys. he shot the driver. he is thibeing hailed as a hero tonight. the gunman got away with one child. also with us. former fbi hostage negotiator and because the suspect allegedly holds extremist views, george, you are on the ground there, what is the latest? >> reporter: anderson, first and foremost the welfare of the 6-year-old boy. investigators came out to announce that they don't believe that he has been hurt or harmed in anyway. that is very good news. they say the >> yeah, with the charge, not in court today and this bunker has been there going on day two and three. so as the gauchetiater you talk about trying to build repore. how do you do that with someone that neighbors say is paranoid. where he allegedly shot at somebody. >> the gauchetiaters need to recognize that but set it aside that you can't let that, you can't be predisposed to put a character to this individual and let it manifest itself through dialogue. if he has these kind of issues pair noi thea and so forth, he has a story. obviously he would until have initiated this action and taken the course of action that he has done unless he wanted to put across some sort of statement. it will be the negotiator's responsibility as they try to get this emotionality down and allow him to be more realistic. >> does time work in the law enforcement's favor? this is a true hostage situation. this is not a pseudohottastage situation. this boy has been taken for leverage purposes. the passage of time is important. frankly i think the family can take a little positive aspect or positive hope from that fact that he has allowed them to deliver medication. he has provided them if the boy requested the coloring book and so forth and allowed that to be delivered, those are huge indicators of progress. that is good news to end on tonight. appreciate your expertise. thank you very much. let us know what you are thinking. we'll be following this over the course of the hour. just no shortage of passion from others testifying. where are the solid facts and why are they so hard to come by? ray kelly is talking about the strategies in his city. and later ray louis, another chapter to the ray louis story. we'll tell you about it when we continue. aches, fevers. and i relieve nasal congestion. overachiever. and are both sides building their cases on shaky ground? former congresswoman gabby giffords spoke of the need for action. >> thank you for inviting me here today. this is an important conversation for our children and our communities and for democrats and republicans speaking is difficult but i need to say something important. violence is a big problem. too many children are dying. too many children. we must do something. it will be hard, but the time is now. you must act be bold, be courageous americans are counting on you thank you. >> she spoke from handwritten note that is were posted on the facebook page that she and her husband markety founded. commander kelly at one point answering that background checks don't need to be made universal. >> my wife would not be sitting here today if we had stronger background checks. >> banning high capacity magazines, now there is one problem, both sides in the gun debate use them to make their case. independent studies including one from the clinton justice department -- >> the report as a percentage of gun traces which shows a 70 percent decline. >> while armed security works guns do not. >> i have seen an explosion of fire power since the ban expired. >> to reinact a law that according to the department of justice did nothing to reduce gun violence. the assault weapon ban did not stop columbine. >> the department found the ban inhe effective. >> there is no clear-cut way of telling who is. because each side accuses each of cherry picking the data. there is not enough good research to draw a solid conclusion. take a look at what the research report concluded. none of the existing sources of statistics provide comprehensive timely or accurate data with which to assess defentively whether there is a cause of connection between causes and firearms. congress doesn't pay for it. from 1993 through 1996, congressional located millions of dollars to study gun violence. since 1996, the money has dried up. over $100,000 a year and a budget of nearly $6 billion. having said all of that, that has not stopped community makers from doing what they can from learning as they go. ray kelly joins me now. you pint to the fact that handguns on the streets is a problem. will anything in the current debate whether it is limited high-capacity magazines will that limit the lethality? >> i think it can help but there is no easy answer. i think the background checks if they are done properly can make a difference. the major problem for new york city is the concealable handguns. >> everyone is focusing on assault type rivals. are you - poseed to ban on that? >> no. but the impact in new york city will be minimal the nra says clearly existing laws are not being enforced that the number of people who lie that limits that. the federal government is restricted on how they can do an investigation. >> is it a fair argument? they are saying criminals will never submit to gak ground checks. you need to execute existing laws greater. they are saying it is either or. you can do both and it makes sense to me to do both. >> what do you make of their argument that criminals will not submit to background checks? >> how critical is this? >> sit is not just in gun shows. it is estimated that 40% of gun that is are sold are sold without any sort of registration or background checks. it amounted to six million guns last year. i think it will deter criminals from buying guns. not an easy answer. there is no magic bullet here. i think each one of these pieces can help to reduce the problem. where do the guns come from? >> 90% of our guns come from out of state. we call it the iron pipeline. they haven't been giving drug data to the mental health database. >> some states think that there are privacy issues when there aren't. but we know now, some states have held onto 600 thousand records. now that flow is beginning to move as a result of all of the attention on the issue. >> do you think something has changed after newtown? do you think there is enough will and there will be some sort of legislation or early stricter gun background checks. i think there will be something. you can see as long as the can is kicked out in the road we are going to have less and less of a chance of getting significant change. >> do you see a reason why some folks should have semiout automatic military style weapons or clips with 30 rounds of ammunition. i think the so called assault weapons scare people. they are weaponing of war and went to kill people. having said that, i think we'll have them with us for a long time to come. >> what about the idea of arming people in schools do you worry about that? >> i didn't. >> how did he end up with stab wounds if you were fighting him. >> hey, you have to read the book to find out. >> and they piled into the limo and sped off. >> i was never clear about how they fight two guys and two end up dead. no one is ever convicted and how did they end up with stab wounds? is. >> you end up with stab wounds what does that mean? somebody stabbed you. right. >> so who could have stabbed you? >> you have to read the book and find out if i know it or not. >> you have to read the book and find out. >> a lot of people think you got away with murder. >> you know everyone watching this is going to think this is a weird answer. >> no, it is not. >> i think it is an appropriate answer. >> we'll come back to oakley but there is another element of this story that you probably never heard before. there was a blood trail and cover up of lies and the limo driver said he heard oakley and sweeney admit stabbing the victims. they told those inside the limo to keep their mouths shut and that quote my football career is not going to end like this. someone took the bloodstained knifes and suit and threw them away. >> where is the white suit that he was wearing that night? >> it went to the cleaners and was in the suits that were in this closet and the prosecution didn't do the things that they needed to do to get access to the system. >> i don't know. >> prosecutors denied our question for interviews of this story. > murder trial crumbled on live tv it got so bad that prosecutors had to drop murder charges in the middle of the trial. offered him a plea deal. louis plead guilty to a charge of obstruction of justice but that didn't help. both of those men were acquitted. ray louis said he was the peace maker but he said that was not the case. >> was ray involved in the fighting? >> in my opinion yes. i know he was right in the midst there with everyone else. >> his side has said hey, he was trying to be the peace maker in that situation. >> i didn't see that. when the police asked him what happened. he wouldn't come clean. >> he was not involved in the fight. i didn't take an step, a statement to make this happen. he was no more guilty than 100 people on the street. it angers him to see him involved. >> stop acting like you were one of the people to come out of the bible. >> only he knows what happened that night. >> i hope that it haunts them for the rest of their life. until they die and burn in hell. >> the most painful irony of all is that in a few years he will likely be immortalized in the hall-of-fame. >> he joins me now from atlanta. he said he didn't kill them. who does he think killed these guys? >> you have to remember. the story has been convul luted. the versions of the victim's family have to remember that he was telling the truth. he points to two people that he said were never properly vetted by prosecutors and investigators at the time. they were pushed out that way. and perhaps louis themselves were involved with bae baker an lawler and those two were left dead in the streets. it tells you that there were never witnesses that saw anyone brandish a knife. many of the witnesses were on the stand. there was never anyone who came forward and said i saw the knife and saw who had the knife. >> this guy doesn't do himself any favors. i mean they are not answering the questions. >> no question. it was a rough interview. and it was interesting. he hasn't spoken publicly about that night in 13 years. he says he is trying to clear his name. he walks away and says look. they feel vindicated. the jury acquitted them and the prosecution dropped the charges. >> appreciate it. coming up, video of a snow mobile accident at the winter x games. the run away snow mobile didn't hit anyone else. it could have been worse. we'll hear from the guy who was on that snow mobile next. wow! what exactly is a cashback concierge?
