And Briefing Materials on topics including ukraine, iran and the u. K. All of this at the center of a Special Counsel investigation. Lets get right to cnn senior justice correspondent, evan perez, who is following all of this. Evan, what more can you tell us about these classified documents that were found . Not always a good thing whenela saturday. Not always when you fix a statement that was provided a day earlier. What the white house is now confronting, they have had to explain multiple times in the past week about the finding of these classified documents. And a lot of it, frankly, theyve known about the documents since at least december, that there were additional documents they chose not to disclose it. What we know is there was an additional five pages of classified documents, that they were found in the president s home in williamington. Thats in addition to one document they had disclosed just yesterday. And the issue for the white house is that now were talking about around 20 documents, that have been handed over to federal authorities, to the fbi. The u. S. Attorney in chicago, who has been doing a review of this, this all began back in november, when they first found the first batch. And this is now in the hands of a Special Counsel, rob hur who was appointed by the Attorney General just this past week. Hur is going to bring in a team of prosecutors and lawyers and the fbi, who is going to try to make sure that everything out there has been found. And thats part of the issue for the white house, jim. The issue is, you know, are there still possible other documents out there . Certainly, i think thats the concern ive heard from Law Enforcement officials. Has everything been searched . How do we know theres not additional documents out there . Ill read you a part of what the president s personal attorney, bob bower, explained why this has come out in drips and drabs. He says the personal attorneys have tried to balance the importance of public transparency, where appropriate, with the established norms established necessary, to protect the investigative integrity. The Justice Department did not tell them not to disclose all of this. As a matter of fact, we learned a lot from the Attorney General, when he had a press conference on thursday. And has the president s team said whether this is everything . This is it . Or is that hanging out there as a possibility this may not be it . Thats the issue. They previously did tell us that they searched they completed their search. Thats the impression we got from that statement was, that there was nothing more. It turns out that almost as soon as they said that, they had additional documents that they had not yet accounted for and had then been turned over to Justice Department officials who accompanied the white house counsel, Special Counsel, who went to wilmington, to hand over the documents. The issue for this that at some point when rob hur has his operation up and running, theyre going to want some kind of statement, some kind of attestation that theres no aduditional documents. This is something were seeing play out in a parallel and separate investigation of former President Trumps handling of classified documents. Theyve been trying to get trump to say for sure theres no other documents. They want to try to interview the people who did additional searches. And thats been a point of contention in that investigation. Evan perez, thank you very much. Joining me now, cnn senior Law Enforcement analyst and former Deputy Director of the fbi, Andrew Mccabe. Whats your classification of these pages found at bidens wilmington, delaware, home . Its a classic example of the doubleedged sword that is tranls pa transparency. You have to give the biden team credit for being transparent. They werent fully transparent at the beginning of this and theyre taking some reasonable hits over that. The problem is, every time they turn up another document or someone else turns up another document, that continues to erode their credibility. This is a complicated process of searching every single place the president might have been or his staff might have been or things might have been delivered or brought to. They would probably be welladvised to refrain from saying this is it. Weve done everything, until they actually have done everything and looked in every cubby hole. One of the things i was asking, i was talking to Bakari Sellers and joe walsh about this in the last hour. And one of the two mentioned it would probably be a good idea for the president to come out and talk about this. I suppose that might make good political sense. Does that make good legal sense at this point . Not at all. Not at all. This is why, in any normal investigation, an attorney would advise the person being investigated, dont say anything. Do not discuss the details of this. Dont make predictions. Dont give out numbers and things of that nature because youre just setting yourself up to be contradicted by the facts later, which is uncomfortable legally and from a political side. So, thats a tough decision for, you know, the president of the United States is not your average subject of investigation. He has political obligations for an entire country thats watching and following this thing. You can understand why he would provide them with reassurance. Its a razors edge that hes standing on. Andrew, some new cnn reporting also gives more context in how the documents were packed up. Sources described to season season the chaotic final days for joe biden when he was Vice President back in 2017. Aides scrambling to pack up his work spaces and residence and what they call a muddled and hurried process that left aides packing boxes and documents and papers late into the night. How much does that matter . As the Justice Department tries to figure this out or the Special Counsel tries to figure this out . It matters enormously. Those are the exact sort of facts that investigators and rob hur are going to try to establish from the beginning. What was the process . Who was involved . When did they do it . What containers did they put things in . How did they seal up the containers . Where were they sent next . The chain of custody approach how we went from the Vice President s office to these two locations. Its important for folks to remember that theres a different experience of dealing with classified information at the principle level. So, heads of agencies, cabinet secretaries, certainly the Vice President. Folks like that have a while theyre in office, have a need to have access to top secret, sensitive materials. H24 hours a day, every day, hen theyre home, at the office, traveling domestically or abroad. They have Staff Members and security folks that are constantly following them with classified documents and they immediate those things to be ready for meetings or briefings and those sort of things. The opportunity for making mistakes, for any member of the staff or the principal themselves to set a Document Back in the wrong folder that leads it to be misidentified later and maybe left some place where it shouldnt stay by itself, those opportunities are literally daily, when youre in one of those jobs. I know that from having served as the Acting Director and head of security detail. So, its conceivable that places where he was, like his residence, might have ended up with classified documents that were there when he had his clearance and his position and remained after that was no longer the case. Andrew, how does this impact the investigation into the former president Donald Trumps handling of classified documents . Obviously you have the trump people coming out and saying, see . Aha. Why are we taking it on the chin over what happened out at maralago . Obviously, theres differences between both cases. Thats what they are saying. How does this impact the trump case . Well, it shouldnt impact the case at all. And with jack smith leading that case, as the Special Counsel, i doubt that any of this biden stuff is going to impact either the way he approaches that investigation or what he ultimately concludes based on the facts and the law. They are two entirely different unrelated issues. I know its hard for folks to see him that way. Theres certainly a lot of opportunities for politicians to make hay out of the similarities. But what it comes down to is, right now, at this point, and neither investigation has concluded, so we cant be final about it. But we, on the biden side of things, have absolutely no indication or evidence at this point that any of this poswas intentional. On the trump side, you have a lot of evidence and indicators it was intentional. The most persuasive being the former president s own statements where he talked about these were his and he declassified them and he knew he had them and refused to give them back. Very different investigations. I expect they will come to totally independent conclusions. All right. Andrew mccabe, thank you very much. Joining me now former republican congressman and chairman of the House Intelligence Committee mike rogers. Mr. Chairman, great to see you, as always. Appreciate the time. As a former intelligence guy yourself, what does it say that we now have two president s, one current, one former, under investigation by the Special Counsels for how they handled classified documents . And i guess that you can pick up if you want, off of what Andrew Mccabe was just saying a few moments ago, which is basically, you know, yes, this doesnt look all that great, to have additional documents surfacing on the biden side of things. But theres differences between the two cases. Well, think of this is bad for a whole host of reasons, especially now that you have Case Officers all over the world telling people, well keep your secrets safe if you cooperate with us. You have to ask a question. This goes back to the sandy berger case. And you had classification of a server under hillary clinton. And the Trump Problem with classified documents in his home. Theres a bit of a Culture Problem here. Were going to have to fix it. You dont have to be a republican or a democrat to get to that conclusion. This is bad. Now, were relying on the lawyers to tell us what it is or what it isnt. One document, thats what is so important about this. One document in the hands of an intelligence professional can cost somebody their life. You can reengineer the information on the document. Thats why theyre classified. You have documents about foreign nations. My understanding is theres some top secret special compartmented information, meaning the top level of security and concern for the documents. So, the first thing we ought to be doing candidly is figuring out how much damage was done. We dont know who had access to the documents. People would be better off to let this play out and get the Special Counsel. I believe if you had a raid on maralago looking for documents, you probably have to have agents looking for documents in the president s places. They found documents in his library. The penn library, where a lot of people had access to that. Those are the things we have to get right first. And then, we need to reinstate this culture of a secret is a secret for a reason. And you dont have the right to take documents out. Theres no library card for that in classified space. Youre not permitted to take that information out of its appropriate area. If im hearing you directly, you believe that the Special Counsel handling the biden case, should initiate some sort of search. Heres the problem. Perception is reality in Law Enforcement. You have a search going on where there is personal lawyers finding documents saying we found another one. I get concerned about the perception of that. It wouldnt take much to say, come on in, fbi, you can do this with us. I would be for that. The president should be bold and say nothing was intentional, have at it. Lets secure the documents. If you dont, think about jim, the fbi has been under just a Massive Attack for the perception of them not being having their thumb not on the scale of lady justice. And my argument is, we got to get that part right. The public needs to feel that they arent being treated differently by who is in power. Thats hard to say in the highprofile political investigations in the last few years. Let me ask you, chairman. When you were the chairman of the House Intelligence Committee, did this type of situation arise when you were the chair . And what is it . What is your sense as to why people would want to take classified documents or these top secret documents back to their homes and offices and so on . Is it a matter of wanting to have a personal keepsake . Someone, something that might have a sentimental attachment to it . What do you think . I think its all of that. We had cases where somebody went in and downloaded not in the committee but the community, the intelligence community. Downloaded a bunch of stuff on a thumb drive and snuck it out of this particular facility. And when this was discovered and caught and by the way, hes in jail, the answer was, i just wanted a safety valve if somebody accused me of something at work and i had a stash of material. I saw people accidentally walk out the door with things and we were able to retrieve it and get it fixed. They brought a Electronic Device into a space that youre not supposed to do. There is malicious intent. They take it out to move a political point or other. Weve seen that. When you put it all together, you dont know until you get there. Sometimes it is. I just want a keepsake. Im going to stuff it in my search. The sandy berger was, he wanted to keep information away from investigators that were doing the 9 11 investigation after 2001. And so, everybody had their own motive for how they got here or candidly, it is plausible, that staff was in the middle of the night, throwing stuff in boxes, shouldnt have had access to it at the time, either, but they didnt know any better, and threw it in boxes, stuffed it up and sent it off somewhere. Thats also plausible. You dont know until you get to the bottom of it. Thats what the Special Counsel will do. Mike rogers, good to see you again, sir. Thanks for your time. We appreciate it.
