way down to texas. we're going to check in with our reporter who we'll say drew the short straw covering the storm. while the newscast is on the air, you will see lindsay lohan appearing in front of a judge, this time accused of stealing that necklace. we even have an arrow pointing to it just so you're not confused. that particular piece of jewelry. all that news, plus the positive headline from congresswoman gabrielle giffords' staff today. she is talking, and she wants toast. we'll get to all of those stories here. i want to begin in philadelphia with some fast-moving developments in a case that certainly shocked the country. philadelphia dr. kermit gosnell was back in court today along with his wife and several of his employees. gosnell is charged in the death of a patient and authorities say he performed illegal abortions in a filthy clinic with untrained staff. sarah hoi has been following the case. she just got out of court and she's joining me on the phone. i want to begin with the fact that apparently there were so many people in the courtroom today they were pulling chairs out of the closet. set the scene for me. >> brooke, that is right. this was nearly standing room only in the courtroom and also because of the large number of defendants. you're talking about ten defendants. they were moving around chairs to accommodate these defendants, plus their attorneys. so before things started, you had a bit of musical chairs going on just to accommodate the sheer amount of people who are being charged in this case, not to mention also in the audience poshgs, if you will, that was full as well. so the benches were full up front with the defendants was full as well. busy day, busy room. >> quickly, why was he in court today? was this an arraignment? >> today was the preliminary hearing, which the judge granted motion to bypass so the next hearing, the next arraignment, is going to be march 2nd. in the meantime, all of the defendants will be given their discovery evidence to make sure they have read everything that is coming down the pike. and also to note, gosnell and his of wife both have attorneys now. something that they did not have last week. >> you know, we know his medical practice, if we want to call it that, purportedly made him a millionaire. so the judge denied him access to a public defender and so he and his wife now have defense attorneys. who are they? >> that is correct. they now have defense attorneys, and they are retained by the gosnells, which means they are not given to them by the city. so they have retained these two attorneys, one is mark mcmahon, the attorney for the doctor, mary moran is the attorney for pearle, the doctor's wife. >> sarah hoye, thank you. i want to continue with a reporter from the "philadelphia daily news." let's show the story's latest headline. we have the picture. it reads butcher's beach house. abortion doctor's blood money retreat. stephanie is on the phone with me. stephanie, there's your headline. this is a man, stephanie, who ran this women's clinic for decades. it's described in the grand jury testimony as filthy, stained, reused equipment. just going with that headline, doesn't seem indicative of how he lived. lived pretty well. >> oh, sure. it seems that he put his money into his lifestyle and not into fixing up his clinic or treating his patients correctly. he's got a shorehouse valued at around $984,000 and then five properties in philadelphia as well that we've determined. >> wow. so he had multiple properties. what about his children? i was reading they're in private school. not cheap either. >> no, not at all. some of his adult children went to very prestigious colleges. we can't confirm that he paid for their tuition, but it could be the case. >> now, one could look at this and -- let's pull the picture back up of the headline, this beach house of his. you mentioned several other properties. one could say, this is a pretty ostentatious way of living, as though he wouldn't think he would get caught. what are you hearing from people who know him? >> you know, i think that he lived a lifestyle that he didn't believe he'd get caught. he also didn't pay his taxes and he obviously didn't think he'd get caught on that. he owes more than $27,000 in back-taxes. and given the amount of properties, he took very poor care of them. they're in quite a state of disrepair. and his neighbors around the shore property, didn't really like the way he kept up the house there. >> let me ask you one more question and then i'll let you go. we've been reporting on this story. we talked to the family of one of the victims outlined in this case. just describe if you will, is there outrage among people within philadelphia over this guy? >> oh, yeah. this case has brought amongst the most outrage i've of seen as a reporter in the city. just the conditions and that he did this in his own community. he did this with people that he -- >> he's accused of doing this. >> accused of doing this, of course. he allegedly did these things and really didn't seem to have any remorse. you know, he smiles when he's in court even now. >> stephanie farr, sarah hoye thanks to you ladies. we'll continue to cover the story for all of us. now to this. take a look. the protest in egypt, they are getting bigger and bigger today. and they're spreading. we will take you there live to egypt coming up next. plus, we are just now getting word that congresswoman gabrielle giffords is talking. we will tell you what it was she asked for. and we're live at the courthouse in los angeles. here we go, live pictures. look at all the live trucks, imagine the media circus around there. lindsay lohan expected to arrive shortly to face charges for allegedly stealing a necklace from a jewelry store. got all that coming your way, next. [ speaking spanish ] ♪ [ male announcer ] old el paso stand 'n stuff taco shells. old el paso. feed your fiesta. crisp, clear, untouched. that's why there's brita, to make the water we drink, taste a little more, perfect. reduce lead and other impurities with the advanced filtration system of brita. basic. preferred. at meineke i have options on oil changes. and now i get free roadside assistance with preferred or supreme. my money. my choice. my meineke. welcome back. i want to bring you up to speed on egypt, the uprising not going away at all. not today. thousands of demonstrators continued to hold parts of of cairo, you see them there, chanting, waving flags in that picture. here's what we're also seeing today. the unrest is spreading to other parts, other cities within egypt, including the cities you see on that graphic. in fact, i want to show you a cnn ireport. this was in alexandria, egypt's second largest city. peaceful demonstration. but we are also getting reports of violent clashes in other parts of the country. arwa damon is with me now, live from cairo. arwa, how significant is that, this unrest that seems to be spreading outside of cairo today? >> reporter: well, brooke, it's most certainly disturbing, although we are not entirely sure if it is directly linked to these ongoing demonstrations and the demands that president mubarak step down. we do know that in port sigh he'd a government building was attacked according to state tv. and in another city clashes with police left three people dead. here in cairo, the demonstrations thus far have remained peaceful. we hear music blaring from the demonstration ground, people down there trying to keep up their morale, determined to wait this one out. what we have also seen is that these demonstrations, a small group, around 100 demonstrators, have also set up camp in front of parliament. it looks like they plan to stay there for the long haul as well. they have begun setting up tents. they have blankets, getting ready to spend the night. this location ended up being taken by the demonstrators yesterday just as a meeting was taking place by the cabinet in a building across the road from the parl yam building. that forced the ministers to be evacuated, moving elsewhere. the demonstrators on site saying that they are not moving, they're willing to sacrifice their lives until president mubarak steps down, brooke. >> so the demonstrators are moving in on parliament, they won't leave. but it was yesterday they heard from vice president suleiman essentially warning these demonstrators, don't make us use the police. but given some of these pictures we're seeing there today, arwa, do people see that perhaps as an empty threat? are the protestors becoming emboldened? >> reporter: brooke, these protestors have become emboldened from the very start. they have already faiced off wih the police and in their view despite all the casualties they won. they have really weathered this one out, and they are determined, especially since all of these lives have been lost, they're saying not to have these deaths be in vain. at this point in time, there really is nothing that the government can threaten to do that is going to see these demonstrators give up this hard-fought ground that they have managed to win and hold onto. that's where we enter this standoff. as so many egyptians have been saying, look, we're a stubborn people, the president is equally stubborn, but we're going to be more stubborn than he is and hold out for longer than he can. but meanwhile, brooke, the implications of these demonstrations are being wide felt throughout the country. there are great concerns for the millions of egyptians that survive on less than $2 a day receiving basic things like food. with one volunteer warning that if this issue of the impof impofrnished is it not dealt with, this could turn from a democratic revolution great for egypt to possibly a downfall. >> arwa damon, i can't get over the pictures in the square and on parliament. arwa, thank you. for months it has just been a vague call for cuts in spepding. now republicans are drilling down, getting very specific. they're putting their money where their mouth is, if you will. so what exactly have they just proposed to cut? we have ten items on the list next. also, a milestone for this woman, congresswoman gabby giffords. now she's regaining part of her ability to speak. we will tell you what it was she asked for, coming up. >> well, these are the early steps in the negotiation over the budget and spending. notice they all used those code words, a number of them spoke, and then robert gibbs did. they said it was a constructive, row bebust dialogue. those raise your eyebrows and generally means there are a lot of disagreements. they say they can probably find common ground, but republicans tell me the disagreement over spending is so great that we could face another government shutdown in the coming months. >> here's the big news, though. just before that meeting the house republicans put out this proposal for deep budget cuts. they've been asked to name which popular government programs they'd take a knife to. we're getting the answer. today they've issued this list. i have part of the list here. they're targeting 70 government programs. i'll give you ten, job training, big priority, $2 billion, women and infant children, cut $758 million, high speed rail, 1 billion, amtrak, 224 million, nuclear energy, cut $169 million, and even more, the list continues, flood control and coastal disaster relief. they want to cut 30 million bucks, state and local law enforcement, $256 million, environmental protection agency, $1.6 billion, i'm almost done, fbi $74 million, nasa $379 million there. so, jessica, i mean, ten programs right there alone, that's really just the tip of the iceberg. >> that's right. that's music to a lot of people's ears who want to see the federal government size shrink and there is more detail to come tomorrow. dana bash is reporting that they're going to announce the outright elimination of 60 federal programs. keep in mind, brooke, we're just talking about spending for this year. that's what that list was. the discussion the president had with house republicans today, that's over next year's budget and republicans are demanding even deeper cuts next year. that's why we're fiacing a comig tandoff. >> let's talk about the standoff, really broadening this out, there is a bit of a game of chicken between some of the republicans and the white house. and we're hearing all of this concerning the debt limit, right, jess? >> exactly. and this is the linchpin of the fight. so congress has to raise the debt limit so we can keep making good on our ious to our lenders as a country. if congress does not act, we would be in default as a country, our credit rating would be downgraded. imagine what that does to the markets. republicans see this as leverage for negotiation. they're saying democrats better agree to their spending cuts for next year's budget or they'll refuse to raise the debt limit. as you say, it's a game of chicken. today treasury secretary geithner, he was unusually forceful when he was asked about this at a panel he was speaking at sponsored by the atlantic magazine. listen to him speak this morning. >> i think the markets should understand -- i can say this with complete confidence -- that the u.s. will meet its obligations, that congress will act as it always has to make sure we meet those obligations. there's always a little political theater around this. it's always the case. but congress will act -- >> okay. so that's geithner being forceful and emphatic, i promise you. what he said there is, there's no question here, it's going to happen. they're going to raise the debt limit. but you can see how -- given how tense this is, it's going to be a big fight. >> the u.s. government in default? that would make some news not in a good way. jessica yellin for n washington, thank you. i know it's february, which means snowstorms not exactly unusual. but in places like oklahoma? look at these live pictures. look at the roads. they're covered. i'm talking a foot of snow in some places, and that is pretty rare. that's why we stuck ed lavandera and his crew out in the snow. we'll talk to him in a moment. also, more live pictures. look at the reporters and the photographers lining up to see, guess what? just one month after a gun pman shot her in the head, giffords spokesman says she is regaining part of her speaking ability. and what did she ask for? apparently she's hungry for some toast. her office says she spoke her first words before this morning but has been speaking even more since then. authorities have charged jared lee loughner in the january 8th shooting that killed six people and injured 13 others, including giffords. and now to the snow. look at this. this is an ireport we got from a snowed-in viewer in arkansas. i think those are garbage cans. you saw that chunky snow on top. then this is why it's news, folks. they got a foot of snow in arkansas. ireporter barbara says she teaches math at a local community college, but thanks to technology, sorry students, she still gets to work with her students online. classes will likely, though, be canceled she says for the rest of the week. that's the view from someone who is snowed in. but here's what happened to the folks who went out. this is an interstate in dallas of all places. look at the snow there. and look at the pickup trucks and 18-wheelers trying to move or maybe not so much of like that suv in the snow and ice. in southern states we simply are not prepared to drive in this stuff, and i don't know if ed lavandera is good at driving in snow. let's ask. he's our very own texan. there he is live in oklahoma. he's been on tv all day freezing. how are you? >> reporter: oh, yeah. you can see it. i bet you can probably feel it, too, brooke. you've been in these situations before. and also that sound in the backdrop, hovering above us, all the choppers, you know that's probably a good indication that lohan may be close. we're standing by for that. she's expected to be in court about an hour from now. you know in the past she's arrived late on several occasions. this a big one, though. this a criminal case, felony grand theft. so you bet her attorney is saying, we're going to get there early today. we're standing by and also standing by, look at this crowd, all of this media here, photographers, reporters. lindsay lohan always commands quite a draw, and this case is no different. as for what is going to happen procedurally later on today, she'll show up, face a judge, hear those charges, the complaint filed by the d.a. earlier today. she still has to go through the proceedings. after that she'll be booked. she'll have a booking photo taken, then be able to post bail with another court date set. also hinging in the background, that other case, the dui case, the one that involves her violation of probation from thatty 07 incident. she'll be back in court again february 25th. this is it a big one, brooke. judge eldon fox back in october in court said, you have to do the rehab thing. by the way, she was released from rehab in january. all she had to do was stay out of trouble and perhaps when he saw her again he would remove her from supervised probation. but not looking too good for her right now. in fact, she may be facing jail time. he threatened her with 180 days perhaps if she screwed up. big question. we'll have to see what happens the next time they's in court. >> let's bring this back to the court that this massive media presence, this is over a necklace. the jewelry store dl-- there's e picture. the jewelry store says lohan stole the necklace. what does lohan say? what's her side? >> reporter: her side, they're not saying much. that's a problem here. some say her attorney needs to speak up more. she's being crucified in the press, but all she says is we vehemently deny these allegations. the jewelry store owners contacted the authorities, reported the necklace missing. this is crucial here. they say not only do they have surveillance video that shows lohan, the last person wearing the necklace in the store, the paparazzi snapped her days after that, january 22nd is when she visited the store, sporting the necklace around town. >> not reportedly just the surveillance video. but paparazzi pictures. this is huge because this is a felony here. so this could carry serious prison time. >> reporter: it's huge, up to three years in prison. they are not taking this lightly. even if it's knocked down to a misdemeanor, she could face up to a year in prison. this is not something that her attorney is taking lightly. lohan, i don't really -- i don't know if she realizes the implications of this. she'll show up here, probably thinking this another court date, i'll get off the hook. this is huge, brooke. absolutely huge. by the way, the next time we'll see you, we'll try to get the photo of her sporting the necklace we obtained from a celebrity web site. >> we've been showing it. >> reporter: it's invisible, it's tiny. you have to look to really see it. >> we have an arrow on the graphic. >> reporter: they're denying that lohan stole this necklace. was it given to her on loan? maybe that's what they'll be asking. it's a tiny thing she's sporting around town causing this drama. by the way, someone close to lohan, don't know exactly who, returned the necklace, handed it over to authorities before they were able to exercise that search warrant. that's where things stand. >> kareen, i know it's loud there. you have helicopters buzzing over your head. but let's talk, you mentioned how lohan has been late to court in the past and she's also been unpredictable inside. we all remember she had -- we'll call it colorful language painted on her perfectly manicured fingernails at one point in court. what kind of lohan should we expect? should we expect a lohan on time? will she be more subdued today? oh, she can't hear me. kareen wynter, i appreciate you walking me through at that. i know it's loud. massive media presence over this felony charge lindsay lohan is facing after allegedly stealing this necklace. we'll bring you her big arrival as soon as we see it live right here on cnn. now to this. ask any mom or dad and they will tell you it's the happiest moment of their lives. of course, talking about the birth of their little one, their child. but in our cameras are everywhere society, some hospitals are making labor and delivery a no cameras allowed zone, which is not sitting very well with parents. elizabeth cohen joins me on that controversial topic next. picture this. you have a prime minutester, a prostitute and a possible sex trial. i know it sounds like a paper back plot. it's not. reality is playing out right now in italy. the story is definitely trending today because prosecutors just asked this judge to fast-track a trial in the case of prime minister silvio berlusconi. they allege the prime minister had sex with a 17-year-old hooker, her name is ruby. dan rivers has the story. >> reporter: brooke, just when things seem they couldn't get any worse for the italian prime minister silvio berlusconi. they have. prosecutors have put forth a file to the judge in this so-called rubygate case, asking the judge to fast-track it. they feel the evidence that he abused his power by intervening in the prostitute's arrest after he had sex with her is so overwhelming there's no need to hold a preliminary argument. instead, they want the trial go ahead much more quickly. the judge has five days to consider that file before she must make a decision. but this clearly is dominating the media in italy. berlusconi himself has come out fighting again, furiously denying the allegations, basically saying that they're politically motivated. he said they're groundless. the only aim is media defamation and on the specific allegation that he abused his power by calling up this police station and asking for this young girl to be released, he says, well, i intervened as prime minister because i was concerned there could be an international diplomatic incident because at the time he thought this young woman was the niece of the egyptian president hosni mubarak. brooke? >> dan rivers, thank you. and we read a story recently about more and more hospitals banning cameras in the delivery room. we had the question why. why is this? we put elizabeth cohen on the case and she's hear with the controversy pitting expectant parents against hospital administrators. this is such an amazing moment for parents, moms and dads. you can understand why they want the camera in the room. >> especially this generation. they want it on facebook immediately. they want to tweet it. >> i know. what are you learning about this back-and-forth? >> some hospitals do indeed allow cameras in the delivery room. some hospitals are allowing people to skype the birth as it happens. >> skype it as it happens? >> skype it as it happens, especially military families, which is really nice. dad can watch the birth from wherever he may be stationed. but then there are plenty of hospitals saying no thank you. bring in the camera, but you will be able to press "record" once the baby is out and everything is fine. they don't want you recording as the baby is making his or her way out. >> because they're worried about something bad happening and possible lawsuits? >> depends on who you ask. the doctors in the hospital will tell you something like births are busy times. a lot going on, a lot of people in the room. dad there with his camera trying to get in there can be kind of tense. on the other hand, people could say, dad could be in the corner and no one would know he's even there. it's not bothering anybody. really what they're scared of is you're going to catch something bad happening if there's something bad that goes on and you could use that in court. and that has happened. >> what are you finding? is it a trend more and more hospitals are saying no to cameras? >> yes. it does seem to be a trend more hospitals are saying no. but we found plenty of hospitals that say yes. what i would tell empowered parents to you, if this is important, ask the doctor and hospital if it's okay first. if you really want this, go to the right hospital. >> can't let you sit here without talking about this new study i heard about this morning. it shows that in some breast cancer cases it may not be necessary to go in and remove the liymph nodes in the armpit. >> let's talk about what happens now. you've got a tumor in the breast. the breast is near the armpit and the concern is that some of that cancer might sort of get into one or more of those nodes. they look at the nodes most likely to be effected. if it's cancerous, they'll often go in and take 12 to 18 nodes, cancerous or not, just grab a bunch just to be safe. >> now they're saying they don't need to? we will hear from him, get his answer, next. well, there is a huge story developing now out of l.a. you see aerial shots zooming in. not quite sure what they're zooming into. let's go to the ground shot and show what's happening on the ground. live pictures, photographers, reporters, dozens and dozens of people lined up to see lindsay lohan. we are minutes away from her court appearance there today in los angeles because today she's formally charged on a felony count, felony grand theft. and this is all related to a necklace, this one single gold necklace that was allegedly taken. in fact, the jewelry store is alleging she took from a venice, california, jewelry store last month. so she's going to face a judge there in l.a. it is quite a circus, a lot of activity there. we have kareen wynter. we're following the story for you here out of l.a. we'll get to that in just a moment. i want to move on to tiger woods here. let's get straight to it, cnn's exclusive interview with tiger woods. it comes as he gears up for this tournament in dubai and tries to regain the title of world's top-ranked golfer. since returning to golf last april after admitting to transgressions in his personal life and taking a couple of months off, he has not won a single tournament. so personal life speaking how is he doing now? >> no, no i'm not. >> you have said that running for president steals the soul or something along those lines. >> i've probably said that but more importantly i said i'm not interested in leaving the best job in america. >> reporter: texas governor rick perry and south carolina senator jim deminute and governors bobby jindal of louisiana and chris christie of new jersey, most people couldn't pick any of them out of a lineup. all say they will not run for president in 2012 and in varying degrees all are hot in the circles of political power. so much so that ten months into his first term as new jersey governor, christie, a republican it boy, got sick of answering the question. >> what do you want me to say, like i'll jump off a building if they nominated me? i can't say this anyother way. i am not a candidate for president. >> reporter: well, he could have said if nominated i will not run. if elected i will not serve. that's what general william sherman said in 1886, definitively eliminating any freak presidential scenario that might arise and giving birth to the term shermanesque statement. jindal got the test on nbc's "hardball." >> i'm absolutely not running for president. a lot of guests are coy with you, no caveats in that statement. can you book it. >> shermanesque. i'm not running for president. >> reporter: and if there are 50 ways to leave your lover, there are 100 ways to ask the mayor of new york if he aspires to a different zip code. >> mr. mayor, in your speech about the national economy yesterday led to a lot of speculation about you're thinking about the white house. are you surprised at that speculation? are you pleased about it? are you -- >> look, number one, i'm not running for president, okay? couldn't be clearer about that. >> reporter: there are solid reasons to wonder about new york mayor bloomberg's appeal beyond his own city limits, but, still, he's a billionaire. he's been a republican, an independent and a democrat. can you spell coalition? that's enough intrigue to keep the question coming. >> are you saying that you're not even looking at the possibility of runing? >> no, i'm not looking at the possibility of running. >> reporter: and coming. >> would you change your mind? >> no. >> reporter: and coming. >> no way no, how? >> no way, no how. >> reporter: and if you're wondering, yes, iraq commander david petraeus said no to commander in chief when asked by a "vanity fair" photographer during a photo shoot and no, no, a thousand times no from the country's top diplomat. >> are you planning to run for president once again? >> no. no. i am -- i am not. >> reporter: really? no kidding. she repeats it early and often. here she is on fox news. >> i have said it over and over again, and i'm happy to say it on your show as well. >> so you're done with elective office? >> i am. i am very happy doing what i am doing, and i am not in any way interested in or pursuing anything in elective office. >> reporter: the constant pursuit of an answer other than no is a mixed blessing for politicians who need the limelight but seem to hate the tedium. >> i'm asked this question a lot. you would think ten times, you'd be done with it, but i keep answering it, honestly. >> reporter: still, it's hardly fair to blame a reporter for asking when jeb bush's own mother took months to convince. >> i think he would be a great president, but he's chosen not to run this time and i finally have believed him. >> reporter: so you're getting some place. >> thank you, brother. >> reporter: hear that. chosen not to run this time. that's why it's hard to take no for an answer. no often has a shelf life. this is the newly elected senator from illinois late 2004. >> so why have you ruled that out, running nationally? >> you know, i am a believer in knowing what you're doing when you apply for a job, and i think that if i were to seriously consider running on a national ticket, i would essentially have to start now before having served a day in the senate. >> thank you, iowa. >> reporter: over a year later, he was in iowa at a high-profile political event. a year after that he was running for president. the rest is history. >> candy crowley, leave it to you -- >> reporter: that's why we don't take no for an answer. >> leave it to you to bring in general sherman and have it all make sense and i love how you said no doesn't -- doesn't have a shelf life. makes for just such great sound bites, don't they? >> reporter: they do, they do, but, you know, i hear so many people who say to me why don't you all just listen to what they are saying, and i say well, actually you ought to listen to what they are saying because there are very few of them who totally rule it out, and besides, you know, it's the beginning of the season. this is what we do. >> yeah. it's always what they are not saying, but before we let you go, candy crowley, got to ask you about senator jim webb. big announcement. says he won't run for re-election but for jim webb it's one term and done. does this surprise anyone? >> reporter: doesn't surprise a lot of his colleagues. he's not -- does not -- i don't know how to put. it doesn't seem to have the zest for the job, particularly the fund-raising part of it. this was going to be a tough race for jim webb even though virginia went for obama the last time around, two times around i guess if you count the congressional elections, this was going to be you have to, and there's a possibility that george allen works used to hold that senate seat, might run again making it even tougher. he's never liked the fund-raising part of it, and i think, you know, he has spent most of his life not in this realm, so he knows there's another life out there. he's not a lifer, as they say, and the people around him have said that they sensed, you know, his frustration, and they sensed that he was ready to go do something else, and lots of times i think you find people, as jim webb has, has been the boss of something or secretary of the navy, very difficult to be one of 100 where it's hard to get something done unless 59 of your colleagues agree with you. >> candy crowley, thank you, and thanks for your piece. that was fantastic, and now top of the hour, watch this. right now terrorists are plotting to attack the u.s., and that threat is now the greatest it's been since 9/11. that urgent warning coming from the u.s. government. i'm brooke baldwin. the news is now. >> the threat continues to evolve. >> the people who hear the plots tell congress what they know, and they are naming names. find out who is most dangerous and where they are hiding, and it's not osama bin laden. they already own the city square, but now protesters in egypt are marching straight to government headquarters. the only thing standing in their way, armed troops. plus, does the muslim brotherhood want power in the group now has an answer. also, a young woman walks into a hotel to get surgery to enhance her rear end, but hours later she dies, so who is responsible here? and somebody pointed a laser light into the eyes of a pilot just as he was landing a plane. now a teenager is in custody. is he behind dozens of other laser incidents? here we go. kicking off hour two. hi, everyone. i'm brooke baldwin. rapid fire is minutes away. first, i want to get to two stories unfolding this very second. story number one, lindsay lohan. she's about to get yet another mug shot. the actress is expected in this l.a. court any minute, and you can see the media presence. look at it on the ground there. dozens of reporters and photographers. lohan is accused of stealing an expensive neck late, but will she land behind bars? that is what we're about to find out. also, we're going to take you back to egypt, and as we reported today, the uprising appears to be spreading, so right there, look at these crowds, you see thousands upon thousands of anti-government demonstrators back on the streets of cairo, and that part is key. the unrest appears to be spreading to other parts of egypt. take a look at the map. see all the different cities there, certainly beyond cairo, and precisely who is protesting and against what still isn't quite clear at the moment, but just in case you had not heard, many people seem to believe that this resurgence of the movement may be linked to the release of the man you just saw on the lbds of your screen. his name is wael gonil. he's the activist whose efforts helped spark the protest going on more than two weeks. what's today? day 16 now. ivan watson is the one who spoke with ghonim. he's live for she in cairo. ivan, is he surprised by his sudden fame now that he's out of custody? >> reporter: absolutely. he says he's proud of what he saw, because he had been in solitary confinement for a week and a half. he'd been blindfolded the entire time, and was brought out, released on monday and realized that a protest that he helped organize on january 25th had turned into a full-fledged revolution. now, i asked him was there any room to negotiate with the egyptian government now? listen to his answer. >> i just post it had on twitter yesterday. this is no longer the time to negotiate, unfortunately. we -- we went on the street on 25th, and we wanted to negotiate. we wanted to talk to our government. we were, you know, knocking the door. they decided to negotiate with us at night with rubber bullets, with police -- police sticks, with, you know, water hoses, with tear gas, thanks, and with -- and with arrest begun 500 people of us. thanks, you know. we got the message. now, when we escalated this and it became really big, they started listening to us. >> so ivan, i mean, i heard him say. i wrote it down. no longer time to negotiate. you talk to people in tahrir square and elsewhere. do they share that same view? >> reporter: many of them do. they say also -- they go on to say that this isn't about mub muk the president anymore. now what they want is this regime that's been in place to be dismantled completely. >> how significant also, ivan, because we've talked so much about tahrir square, liberation square in cairo, but now we're seeing other points on the map in egypt where the protests tend to be spreading today, and how significant is that spreading? >> reporter: well, so much attention has been focused on the square here, but, yes, there are ripple effects for us to see some of our colleagues in other news organizations were detained and turned back by the military trying to go to another key city suez, but there's definitely unrest in other places that shows there's not just one loud and vocal minority in the square behind me, that this idea has spread much further than really has shaken to the core the government in this country. >> ivan watson in cairo on this day 16 of the demonstrations, ivan, thanks to you. also breaking this hour, lindsay lohan. she will appear in court really in just a couple of minutes to face this felony grand theft charge. she is accused of stealing this necklace worth, they say, about $2,500, and this is the worst serious legal challenge the 25-year-old actress has faced thus far and she has faced quite a few thus far. quinter is outside the courthouse in l.a. when are we expecting lindsay lohan, and just set the scene for me. >> reporter: well, she better be on her way and be close because she's expected here, 1:30 local time, and, you know, we spoke the last time you can see the choppers hovering above me. i think there are four now in the air. look at the media activity here. all the photographers, all the reporters waiting in line. this is the type of crowd you know you can expect whenever it comes to lindsay lohan and her legal troubles. the entrance you're probably seeing right now. this is the back of the courthouse where everyone is stationed here. there's also another shot that will take you to the main entrance where i'm told there's quite as much activity on the other side. there's a third entrance that one official told me earlier today that they take prisoners through. it's not sure. it's not clear whether or not they will lead lohan through that. you can't see that, but it's basically an underground driveway and what, of course, would restrict our opportunities to take photos and someone is yelling there she is. brooke, we'll try to get that you shot of lindsay lohan coming in. >> we have that shot. >> reporter: hearing she's here. >> we don't know for sure if this is her but looking at live pictures of a helicopter shot, black suv, tinted windows, seems to be escorted right around the courthouse by police or maybe members of the sheriff's department. there they go, pulling up, and let's just sit on this shot. we'll sit on the shot. we lost that shot, but we'll sit on it and we'll see if lindsay lohan steps out of this suv. a couple of people taking a peek inside. while we're waiting on this shot. tell me, what should we expect inside this courtroom? >> reporter: we're told it's going to be very quick, a matter of technicalities. about ten minutes. the d.a. filed those charges earlier today, so we know that's official, so she will just appear in court, face the judge and will hear the charges. she will be booked and have her photo taken. i believe this will be her fifth photo, if you can believe it, and then she will post bail, and then she will be free to go. we'll have to see when that next court date is, but something that we found that's also interesting, we traced a time line, brooke, and if you can believe this. within the last four years there have been 25 incidents where lohan has either been in court, rehab, jail or arrests. that's huge, significant, so that could have some bearing on this current case, whether or not they look at this grand theft felony case as a felony or a misdemeanor. a felony, she's looking at about three years, at least, and if it's a misdemeanor, if they decide to rule that direction, about a year, so it has big implications for this actress either way. >> and just for people who are tuning in and wondering what we're looking at, we could be looking at tinted-windowed black suv that is carrying lindsay lohan. today she faces felony grand theft charges. this is all related to this $2,500 necklace and there we go. the doors are opening. there we go. there she is. a lot of people in the way of our camera shot. can you see the blond pony tail, and there she is in a white dress and sunglasses, walking. >> reporter: and brooke, if i could just -- >> go for it. >> reporter: if i could just chime in. i don't know if we have the chaos. we have photographers falling all over themselves right behind me. this is really typical, what you can expect when it comes to lindsay lohan, the madness. someone just fell. as for lohan, i was able to catch a shot her. she was wearing a fitted wise dress. someone yelling, you look gorgeous. so, again, absolute madness out here, brooke, absolute madness, as can you see the photographers jockeying for position trying to get a shot at lohan, and this is really a good thing for her. she arrived early. there was some speculation because it's happened in the past that perhaps she would not make it on time for court here. her defense attorney, probably giving her some much-needed advice. let's show up early to avoid this madness. and my producer is telling me now it appears she's in the elevat elevator, and she's headed up, headed up to court, and i'll try to not get run over here. >> yeah. please don't get run over, kareen wynter, but we saw her just moments there in a pretty tight-fitting white dress. we're going to go. kareen, we'll check back in with you in minutes. lindsay lohan officially in "k" on this felony grand theft charge. we'll get more from you, kareen and also talk to mark geragos, but let's move on. there's a video game causing a big, big store. why? to philadelphia, police there are investigating the death of a woman who died after receiving a butt implant in a motel. huh. the dead woman is a 20-year-old college student who traveled to this country from britain for this particular procedure. doctors blame her death on a botched silicone injection. investigators are looking for two women who gave that injection and whether those women are licensed. in houston, take a look at this sinkhole, a public works dump truck ended up with its nose there in the air after the ground opened up and swallowed the back end of that thing. the crew have been trying to fix, of all things, a pothole. no one was hurt. the sinkhole is blamed on a broken water main. and take a look at this. a new video game on illegal immigration causing an uproar. here's a story. a player has to round up immigrants and then get them across the border. the images show people flying from the truck and dying in the desert. critics, they are fearious blasting this saying it trivializes human life. the people behind the game say they are listening to the concern, but the public has only seen a preview. it could end up on iphone next month. speaking of ithings. apple is hard at work on the new ipad. that's according to the "wall street journal" today. the new model was reportedly -- will reportedly feature a camera. so far apple has sold nearly $5 billion worth in ipads. no word on a release date for the sequel. in iowa school wants to get rid of traditional letter grades so no more letter grades like a, b, c, d, e or f. they want to use letters like "e" or "x" showing whether kids are meeting expect actions. a headline coming out of a congressional hearing is that the country is at a high level of terror threat. jeanne meserve has been listening to the details and has the details from. what you've heard today, is the united states making progress in the fight against terrorism? >> reporter: well, brooke, the officials today say that there has been progress made in the u.s. ability to detect and deter terrorists, but secretary of homeland security was very frank in assessing the current terror threat. >> there is no question that we have made many important strides in securing our country from terrorism since 9/11, but the threat continues to evolve, and in some ways the threat today may be at its most heightened state since the attacks nearly ten years ago. >> reporter: napolitano talks specifically about the growing issue of home-grown terrorism, noting that terror groups are increasingly recruiting and training americans and other westerners to carry out attacks. they are also encouraging individuals in the west to do their own planning and act on their own, and when these people have no known ties to terror groups and minimal or no communication, they are very hard for law enforcement to detect. the director of the national counterterrorism center actually said quite bluntly we do our best, but we cannot guarantee 100% safety. brooke? >> jeanne, why is the terror threat high? is it -- does it have anything to do with al awlaki? >> reporter: well, he was mentioned today and the head of the national counterterrorism center said al awlaki and the group he belongs to, al qaeda in the arabian peninsula, is probably the most significant risk to the homeland, one of the reasons al awlaki is a threat. of course, he's american-born. he speaks english, and he's very effective on the internet, so he's inspiring an unfortunate number of people to acts of violence. >> so that's obviously frightening, but one other major concern here also is home-grown terrorists, and there is some news today about one of and tell me about daniel boyd. >> reporter: yeah, daniel patrick boyd, 40 years old, u.s. citizen born in new york. when he was arrested two years ago along with two of his sons and others who authorities allege were part of a terror cell, they said, they alleged that this individual had some 27,000 rounds of ammunition, possibly a sniper, and a lookout perch in his backyard. jihadi literature. what authorities allege is that he had gone over to afghanistan and gotten training at terrorist camps there and fought in afghanistan in the late '80s and early '90s, and then they say he came back here and was training others. today he pled guilty in a courtroom to two charges, one to providing materials, support to terrorism, and the second charge, conspiracy to murder, kidnap, maime and injure persons in a foreign country. potential sentence, life in prison. >> jeanne meserve, thank you. big, big news on a major scandal unveiling right now. the prime minister of italy accused of having sex with an underaged prostitute and now prosecutors want to fast track a trial. they say they have evidence. we have that. plus, we're getting ready to take you inside the courtroom where lindsay lohan is about to face a judge. coming up next, high-profile defense attorney mark geragos joins me. there he is live, right here. %ee watching the courthouse there in los angeles. quite the media presence. all of this over lindsay lohan. she's now inside. a live picture of her walking inside with that quite dress facing felony grand theft charges. we'll take you inside the courtroom here in a moment. but first i want to go straight to mark geragos, a hoe-profile defense attorney general, know you recognize his name. mark geragos, you're lindsay lohan's attorney and you're walking into court with her. what's the first thing you tell her? >> you tell her be calm. don't do anything that's going to antagonize the judge, and let's go. let's go inside and be ready that they are going to try to seek to put new jail, because that's always a possibility when you've got a new charge and you've got a probation violation. >> if you look at lindsay's previous accusations, there are allegations that she has sticking fingers. reports she swiped an $11,000 ming coat, dior jewelry went missing, accusations, never proved, but can these accusations be brought up against her in this particular court? >> they can try to do it. the d.a. will try to do it, and they generally do it under a code section which says kind of a modus operandi pattern, so to speak, that's what they will tell the judge why they want to bring it in. then it's up to the judge to make a decision. he'll look at each or she's going to look at each one of those instances and see if it really truly is -- will help a finder of fact or a jury to hear about it. i don't know, however, if they are ever going to get to that point, because this is a case where the probation -- potential probation violation in judge fox's court may end up driving what happens in this case. in other words, if he decides that he's had enough or he wants to take this case, and they want to combine this case with his existing probation matter, he may just say, look, i'm going to find new violation or do a hearing on the violation, and you may never ever see any kind of a trial on this matter. >> never see a trial. what about the fact though that she was at least -- she wasn't even on time, she was ahead of time today, but we watched her walk in. i don't know if we have the shot. turn it around. she's wearing -- there she is getting out this suv. very what we'll call form-fitting white dress. i would have been wearing a suit, but, you know, different strokes for different folks is this appropriate though for court on such a serious charge? we're talking felony here? what do you think? >> i don't -- i generally give a limited fashion advice to the clients. i don't mind the white. white is always good, white, pure, innocent in terms of the clothing. >> wow. >> itself, but that's generally what the thought is. you don't want to come in -- >> wearing black. >> like you're going to your own funeral. looking like you're dressed for a funeral. >> every little thing perhaps could sway a judge, but if she is convicted, we're talking, you know, potentially several years in prison, correct? >> yes. if she's convicted of a felony grand theft, she could do up to three years in state prison. likelihood of that is infinitesimal. nobody is going to sentence her on a $2,500 jewelry escapade to a state prison sentence that i can think of unless somebody really decides they want to hammer her. >> so what do you think will happen? you think she won't be booked on that? >> actually -- well, i think that they probably will ask for bail. the d.a. will ask for a bail. they may ask to have this case sent over to beverly hills to judge fox's court since he's been dealing with her. it doesn't make much judicial economy sense in having one case at the l.a.x. court and another over at beverly hills. the sheriff will probably encourage that as well to combine both cases and my sense is that the judge will not both cases go back to l.a.x. he'll instead ask that the new case comes over and gets combined with the probation violation. >> trying to get all this straight here, mark garkos. >> right. >> mark, thank you so much. live in l.a. trying to sort this whole thing out for us. >> you're very welcome. >> we'll take you inside the courtroom because there are cameras, and we can, in just a minute. take a look at the officer here in this story just wants to talk, but the driver slams on the gas dragging the guy with him. you will see how it all played out. also, does president obama dye his hair? still making suggestions now. are they being heard? well, not yet. >> second story, silvio berle scony. >> he's a character. >> there appears to be allegations that he had these sex parties and had sex with an underaged girl and now prosecutors want to fast track the trial. >> the judge has gone away to think about that for a couple of days and decide whether that's a good idea or whether there should be more investigation or whether there should be a shift in jurisdiction. the case itself is remarkable. this happened back in december. he's famous or infamous for having these sort of naughty parties, and he's prime minister of a country. >> right. >> anyway, the allegation was that young lady there. >> ruby. >> ruby, or ruby of the heart depending if you want to be formal enough, she -- she was 17 at the time, allegations that there was sexual misconduct there. she's now 18. she denies it. he denies it, but she did tell a friend allegedly that there was a little bit of funny business going on. that's not the big issue. she gets arrested. she's locked up in a jail, at a police station. apparently mr. berlusconi picks up the phone and says let her go. now, that's where a charge of abuse of power comes in, far more serious in terms of the political implications. >> but he says or his party is saying he thought that she was hosni mubarak's niece, she's not. >> the niece of hosni mubarak. >> of all people. >> no, she's not. >> why did he think that? we don't know. >> because then he could say he's trying to avoid a diplomatic incident and that's why he picked up the phone. she is not his niece and apparently silvio berlusconi has faced so many charges. facing a bunch of other unrelated charges at the moment from bribery to all kinds of things. he'll still in power. i love the italians, their attitude. there were two recent surveys that are had more than 50% of people who said he should step down, and then the second question was do you think he will? and more than 50% said no. he won't. >> it's amazing. >> thank you very much, michael holmes. >> good to see you. we've been talking about the first lady. she's in the atlanta area promoting her let's move campaign and there she is speaking in suburban atlanta. she's bragging about the changes in eating and exercise the program has inspired. in fact, let's listen, just for a moment. >> you see, you asked for more fresh nutritious food in your communities. so that's why we're working to bring more grocery stores into underserved areas. you wanted healthier more aff d affordable options on those grocery store shelves. so food manufacturers have made a healthy way commitment pledging to cut 1.5 trillion calories a year from their products. and walmart has promised to sell products with less sugar, salt and trans fat and to reduce the prices on healthy items like fresh fruits and vegetables. >> michelle obama in atlanta just moments ago. now to jessica yellin who joins me with the latest news from the political ticker. jess characters i hear president obama had lunch with several, several top republican leaders, did he not? >> reporter: that's right, brooke, and it seems they left all singing from the same sheet music, or what's the phrase, singing the same tune. he met with top house republicans to talk about the budget, about spending cuts. it's this big looming fight, and both -- from the white house and from the republicans afterwards, there were common words. they said there's plenty of common ground and they can work together to bring down spending, but, of course, brooke, this is all before the president releases his big budget next week, on monday, and we'll see if there's as much of a kumbaya spirit after they get down to the specifics and the jury is out on that one but it seems like a promising start. other spending news, one of the republican heroes for his cost-cutting, straight talk, take no prisoner ways is new jersey governor chris christie. he has some new poll numbers that show that even though he is taking the ax to all sorts of spending and interest group needs in his state, he -- his poll numbers are actually going up. his approval is above 50%, and he has new wind in his sails today, in some sense, but not necessarily good news for the state. smp has downgraded his state's rating, his bond rating, which is bad news for the state in a fiscal state, but it gives chris christie new reason to say, listen, we've got to get tough and slash our pension and benefits, and that is something that's coming to that state, but he's one to watch in the political world. finally a story you've been waiting for. you tease it had earlier. president obama, does he dye his hair? >> i know the answer. >> everybody wants to know. >> i watch this morning, and i watch every morning. >> matt lauer. >> his wife, told matt lauer, no, he does not dye his hair and she said something. right. it looks like it's a different color. >> looks like it's a little sketchy. >> though he looks grayner 2011 than he did in 2009. >> british newspapers -- >> reporter: we can look at it in all different sorts of ways. mrs. obama said if he knew he would be president he would have started dying his hair ten years ago. >> and she was also asked weren't you eating hamburgers and kielbasa for the super bowl? >> and she said everything in moderation, everything in moderation. >> live pictures to los angeles. the media circus continues, of course, because lindsay lohan is officially inside that court, but she is facing some pretty hefty charges. i'm talking felony here, so will the judge put her behind bars? we'll take you there live inside the courtroom next. okay. let's take you back to the story. lindsay lohan, she's back in court. this to imshe's accused of stealing this $2,500 necklace from a jewelry store in venice, california. there she was just from a couple of minutes ago walking inside this l.a. county courthouse. her lawyer says lohan is innocent, and she's ready to fight the case in court. i want to go to kareen wynter. she's been in the midst of this media circus out there in l.a., and kareen, i know we're waiting for the signal and the camera to be switched on inside the courtroom to get the live pictures inside. >> yeah. >> now just set the scene for me and tell me why she's in court today. >> reporter: yeah, and we're also keeping our eye on the live feet, and she's in court because the d.a. moved forward that involved charges against her for grand theft for allegedly stealing a $2,500 necklace, one that we've been showing you all afternoon, from a jewelry store in venice, california. we're told it's a rare piece of jewelry, a one of a kind, and the way this all went down is lohan apparently visited the store on january 22nd. the store owners allege when they contacted police, they say she walked out with the necklace, that there's surveillance video that shows the her trying it on in the store, that she was the last person, not just that, the paparazzi snapped photos of lohan around town a few days after that, so that could be some incriminating evidence, if presented in this case. as for where things stand right now, we do know from our cnn wire reporter alan duke that lohan is, of course, in court. a short time ago her defense attorney john chapman hole, as well as the d.a. on this case, they went behind closed doors. they went in the judge's chambers for a conference, and we're told lohan is sitting at her defense table smiling. don't think this is a case that involves any laughing matter, because if convicted here, if she's found guilty, she faces up to three years in prison. i heard your conversation a short time ago with mark geragos and while he said that's unlikely, whatever happens here doesn't look good for the actress if she's found guilty and also the other dui case that still hangs over her for violating her probation. she will be back in court on february 25th, brooke, and we have no idea what's going to happen on that end. >> kareen, thanks so much. waiting for that live picture inside the courtroom. we'll bring it to you as soon as we get it. kareen, for now, thanks. to crepac, where republican get together. did you hear what one fellow republican said about sarah palin and her decision to skip the conference? >> reporter: well, you know, you were just talking about food and the first lady and all. this is great stuff for political junkies. it may be junk food to some degree right now, but at the end. day, it's a big deal because this conference is seen by many as the kickoff to the 2012 presidential race for republicans. a bunch of potential white house contenders are expected to be there. top names on the conservative and republican side. there will be something like 15 names on the straw poll that cpac takes at the end of the week, and 11,000 attendees, many of whom are likely to vote, so the straw poll at the very least will get some real bragging rights >> i know the straw poll, of course, always makes news and also the person who makes news is the person who gives the big speech. people were hoping that was sarah palin. we know she won't be there, but do we know who will give it? >> reporter: yeah, that big speech was supposed to have been given by sarah palin, at least some people were hoping. turns out she had some scheduling conflicts. there's controversy about that, and it turns out they went to congressman alan west. african-american congressman from florida, just a tea party darling who really raised his profile in the last election. he's going to be giving the speech at end of the week, and he's quite happy about it. actually tweeted it out several hours ago letting people know. i think you can safely say alan west is still a rising star in the party right now. >> giving that big star, he would be. and then though, joe, you touched on some drama this, boycott. has it taken any kind of foothold yet on the eve of cpac? >> reporter: well, you know, it really hasn't. this is talk about a boycott at cpac over social issues, gay marriage, abortion, and whether that should take a back seat to the fiscal issues because the economy has been suffering for so long. well, that hasn't gone anywhere, but what they have basically settled on, the people who were talking about boycotting to make sure that social issues remain at the forefront, what they have settled on essentially is things like internet ads and an open letter to conservatives calling on them to keep social issues in the forefront, basically an acknowledgement that at cpac the show is definitely going to go on >> i want to get to this, some news from our cnn political unit, that they just found out that one of the key people at whole cpac is actually leaving. who is that? >> reporter: right, okay. not exactly household names but in the conservative universe these guys are a big deal. david keene, the outgoing head of the american conservative union, is just a real fixture in conservative politics. there he is. been around a long time. very much connected to cpac. he's now being replaced by a guy named al cardenas who has been around a long time, too, but frankly our people had a tough time finding pictures of them in the background file. >> yeah. >> reporter: because it's been so long. there they are. this is a big deal for cpac and the country as it changes, and there's been a lot of swirl around the organization. people are hoping that might come to an end. >> joe, quickly, most definitely a household name, michelle obama. >> reporter: oh, yeah. >> talking about her super bowl party, and the super bowl menu, hamburgers, kielbasa, et cetera, et cetera. what's new with that? >> reporter: she has, taken a lot of criticism. on the one hand pushing americans to eat healthier and just did this thing in atlanta today, and i think that might still be going on, in fact. >> there are live pictures. shaking some hands. >> reporter: sure. yeah, at the super bowl party, i mean, listen to the menu, bratwurst, kielbasa, cheeseburgers, deep dish pizza, buffalo wing, german potato salad and twice baked potatoes. >> yum. >> reporter: sounds great to me, but -- don't you think?
