The documents were found in his Wilmington Garage and a neighboring room. The documents, were told, were mixed in with other papers. Lets get straight to our senior justice correspondent, evan perez. We will hear from the Attorney General next hour. Do we know it is about this . Reporter we anticipate that it is about this. The Justice Department is in a very tight spot here. Theyre in a very difficult position because, obviously, the president and his team did not tell the full story when they issued a statement on monday about finding a batch of documents, classified documents, they said at the time fewer than a dozen. What they didnt tell us was in a subsequent search that there were additional documents that were found, and the question is when did they have that information and why didnt they tell the world immediately . Because now theres a perception that has been created that theyre hiding something, and that has put the Attorney General now in a position where, you know, he might have to appoint a Special Counsel or at least open a fuller investigation of this matter. Just to catch people up, what the white house says happened is that they found a second set of documents, classified documents in a garage and in an adjacent room at the president s home in wilmington, delaware. They also did a search of his beach home in rahobeth. They are confirming the finding of the second set of documents. They arent saying when exactly they found the second set. Did they know this on monday and didnt tell the world . Thats a question we still have outstanding with the white house. So we expect the Attorney General will have to explain what course hes going to take now. Evan perez kicking us off. Theres a separate investigation of donald trump for similar, not exactly the same, but classified documents removed from government property. The president has sort of rolled his eyes at donald trump. If youre the Attorney General of the United States, do you have a choice now . The big question is when did they find these documents and what did the attorney in chicago know . Garland has taken the right first step. He has appointed someone to review the first documents that were found in a former office in d. C. The question is how much of these additional documents were known by how many were known by the u. S. Attorney . Perhaps they expand the review, reup up, because based on our sources that review was done earlier this week. Perhaps he has to expand it or extend it. If you have to tap a Special Counsel, theres a short list of people who are able and an even shorter list of people who are willing. Its very difficult and made further complicated by the fact that we dont have a lot of the facts here. Youve served inside the building. Justice is supposed to be blind. Vest investigation a doesnt have anything to do with investigation b. However, Merrick Garland lives in d. C. , he knows what republicans are saying and the former president of the United States is saying. Does he have a choice . Or is the best course legally and politically to say, maybe its a short list, maybe its hard to find somebody, but im going to find somebody who has the credentials, let them do an independent review, then they will speak . Its not just washington, d. C. , its not fantasy land, john. The simple fact is we live in a world where people ascribe political motivations to decisions all the time. Lets look at whats happening. What donald trump has right now is a legal problem based on that search warrant, based on everything else. What President Biden was is a pr problem. This is something that they have not managed effectively and not really managed well. The way around that is to sort of minimize some of the Political Considerations and probably to appoint a Special Counsel. As i told you months ago, i think the Justice Department is perfectly capable of investigating something in an apolitical way, but its how the public sees it. And i think the risk of appearing to be political, they probably dont have much of a choice here. Arlette, what has this done to the mood at the white house and the president . Remember, the first disclosure, the president was in mexico city at an Important International meeting. He finally talked about it but didnt want to. Today at the white house he wants to celebrate data that does Show Inflation is easing and thats an accomplishment for the American People but good news for the president of the United States. They discovered a small number of documents of classified markings in Storage Areas and File Cabinets in my home and my personal library. The Department Of Justice was immediately notified and the lawyers arranged for the Department Of Justice to take possession of the documents. So were going to see all of this unfold. I get it, it is very sensitive and the president is trying to say i wish i could tell you more, but i have to wait. Are they done . Are they sure they have searched now everywhere where there might be documents and theres not going to be a third day . We dont exactly know if thats the answer. We know he has that home in wilmington, and then at the beach and he had been working out of the penn biden center. The president has been very limited in what he can say, his lawyers have been limited in what they can say. There are so many answers they still need to discuss. He suggests the review is complete soon, hell have more to share. But theres questions about how did documents how did they handle documents when they left the vps office during the transition period as he was setting up those various offices, who would have been responsible for packing up some of these documents, could some of these documents have been holdovers that he had taken to his home in wilmington on a weekend, for instance. So theres so many issues that are at hand right now, this is a political headache thats turning into a lingering migraine. But it gives republicans such an opening to be able to criticize biden on this at a time when the Biden Administration is trying to make distinctions about the way the former President Donald Trump handled it and the way hes handled it. And to that point, lets segue to politics in the sense that if republicans say democrats in the senate, the bipartisan Intelligence Committee says she want answers, in the House Republicans say they believe they should have hearings. It is worth noting at home, they dont say President Biden and President Trump. The republicans are ignoring President Trump and based on everything we know, President Biden has a problem, President Trump has a bigger problem, based on everything we know to date. Listen to House SpeakerKevin Mccarthy saying, ahha. Not once, but now were finding in two different locations Classified Information just out there in the open. I think congress has to investigate this. Here is an individual thats been in office for more than 40 years, here is an individual that sat on 60 minutes that was so concerned about Donald Trumps documents and now we find it just as a Vice President keeping it for years out in the open in different locations. Again, no mention that why dont we investigate trump and biden at the same time and look into the issue of the security of classified documents. People at home can make political judgments on that. But this is tball for the republicans because biden did say what donald trump did was reckless and irresponsible. Hes really given them an opening. And we know voters, if they feel like theyre not getting all the information, the white house is making a strategic decision to allow these details to leak out through the media, and what we saw with the Hillary Clinton email investigation, if voters feel like theyre not getting details or theres a, quote, unquote, coverup, this can metastasize into a serious political liability. But i do have to fact check the differences between the cases. We have classified documents found in multiple locations. But when it comes to the volume of material and cooperation, completely different based on what the biden team is telling us so far. The former president is under investigation for Obstruction Of Justice and other crimes because on the way he and his attorneys have handled that matter. But this biden matter still relatively new to us. The other one has been going on for a lot longer. Elliot, whether its the investigation about former President Trump or joe biden, you take into consideration, was this done deliberately, did you forget to return them. Why cant we keep better track of classified documents and where we are so the archives knows at any given moment or the Intelligence Community knows this document is not where its supposed to be . I think part of the issue is that adding in any new technology is itself a potential vulnerability. If you start adding in bar codes and scanning and screening, you might invite more abilities for hacking. The big picture is we have a problem if and, frankly, this is far beyond trump and biden. Every president has slipped up in some way. What this comes down to is the word intent. Can prosecutors prove that someone willfully or knowingly got documents. That is not president today in the President Biden investigation in a way that with former President Trump, youre just seeing intent and possible obstruction from the former president. So its just a little tricky to compare the two. I get your point about you add more technology, you add more risk. But we have two Different Cases that need to be sorted through.
