Net income in the quarter rising more than 5 to nearly 700 million. Dupont also in the headlines. The company cutting its fullyear earnings forecast citing disappointing decrease in herbicide sales. And gopro gaining 30 in its initial day of trading. The company raising 427 million yesterday selling nearly 18 million shares for 24 each. Today the stock closing over 31 a share. And i think that worked out to about 10 in terms of what they sold at the company. Thats a look at the headlines. Back over to you. Thanks very much, carol massar. Speaking of initial Public Offerings ali babba will list its shares on the New York Stock Exchange under the Ticker Symbol baba. For more baba lets go to bloomberg coast editor at large Corey Johnson from San Francisco. Corey, this listing on the nyse, of course gopro listing on nasdaq. Does it really matter what exchange they list on . No. The exchanges are perfectly willing to sell those listings. And get those listing fees. The way stocks trade today it maybe doesnt matter much at all. And just a way for them to try to make a little bit more money on those exchanges. Its possible, however, that the sort of industrial street cred that the New York Stock Exchange has carries over to ali babba and one of the things they wanted to be listed with the heavyweights there and certainly is a giant company. What could be if the prevailing notions hold, the largest i. P. O. Ever. Corey, just a little bit more on alibabba and structure of the company. If you buy shares in this i. P. O. You dont necessarily own shares in alibabba. You own shares in an offshore entity that has an agreement with alibaba, right . Not exactly true. If youre in the Cayman Islands it would be on the shore. Because it is the Cayman Islands Holding Company that holds shares of a hong kong Holding Company that holds shares. Its a structure called a v. I. E. Or variable interest entity. And its something thats required by the Chinese Government because the Chinese Government wont let outsiders own their companies. And it does in fact isolate those companies in a slight way from u. S. Investors or from the actual owners of the shares. In ways that other companies dont. And i think it represents more risk than other companies that have more direct ownership. We do have to watch what happens to yahoo stock when alibaba starts trading. Because alibaba and yahoo are joined at the value hip. Yeah, they are. And with respect to alibaba and take the money they gained from the i. P. O. To cash yahoo out. Indeed they are trading or Everybody Knows yahoo has been responding to the filings of alibaba and the fate of yahoo seems currently or at least the stock price seems to have a lot to do with the financials of alibaba. This will not be a taxable event for yahoo unless they sell the shares or is that incorrect . You know, the yahoo chief Financial Officer ken goldman has taken this question just about every Conference Call hes done for the last year or so. Saying that theyre looking for a way to get this done. So it will not be such a agsing position. And i ran into him a month ago and one of the last Golden State Warriors games and some great courtside seats. And he said he hasnt figured it out. But they have every advisor under the sun trying to find a way to get them to repatriate that money without paying the taxes what is a terrific gain for yahoo. The United States Supreme Court has curbed the president s power to make temporary appointments. The justices ruled unanimously that president obama exceeded his Constitutional Authority when he appointed three members of the National Labor relations board. That was back in 2012. Bloombergs greg storr joins us from the steps of the Supreme Court. Tell us about this ruling. Hi, pimm. Well, as you said, unanimous in the outcome that these appointments were unconstitutional. But the court divided sharply in its reasoning with four more conservative justices basically nullifying the recess appointment power. And five more liberal, moderate justices saying were not going to go that far. Even though as a practical matter, this ruling today will mean that the president will be able to make very, very few recess appointments. Greg, is there any indication about any of the decisions that the national the nlrb made with these appointments . Does that mean that they are grandfathered or do they have to be revisited because there was that big case with boeing that came before the board. Yeah. Those cases in this period where you had recess appointees serving on the board are going to have to be reheard. And some of them may actually be reinstated. The board will just reach the same conclusion. But its a different board now. You have two republican members there. These cases get heard by threemember panels. And so you may have some panels where you have people who are more skeptical of the claims against the company. So some of these cases may turn out differently. And were talking about hundreds of cases that the nlrb will have to look at again. What is the administrations response . Well, the administration is disappointed. It says of course we will comply with it. The nlrb says its still looking at the decision to see what it means. Unquestionably this is a blow to the president. And stay with the Supreme Court for a moment. It delivered a blow to areo yesterday but is that blow fatal . I bring in rob barnett the founder and chief executive of omnivision entertainment. Omnivision produces and distributes original ogramming such as my mydamnchannel. Com and others. Lets start out with the areo ruling, what happens next for this company . What happens next is theres some very powerful technology that got a lot of attention in the minds of the most powerful Media Companies in the world. My prediction that technology will be sold to the highest bidder. And sold to whom . I would imagine a major who realizes that one of the most dangerous disruptions that theyve seen since cable almost came and bit them in the butt. So buy it instead of build it yourself, buy it and put it out . Thats my best. How much money do you think . I have no idea. Any way to monetize the actual number of subscribers . Theyve been paying what, 8 a month to have these aerials in the warehouse and connected to the internet for people to receive over the air free tv through their Internet Connection . Yeah. Youre absolutely right. I think its proving yet again that Consumers Want the best content that they can get at the cheapest price. And they want it fast. And they want it in the palm of their hand. So the majors are going to have to figure this out. And aereo woke them up. How has omnivision trying to figure this out and you have a career from mtv and vh1 and produced all kinds of specials and programming, reality tv. What about omnivision . Well, i sat in those board rooms at viacom for a long time. And saw the business cards change with a lot of people here to digital, new media, my thought in 2006 was the disruption was going to likely happen more from the garage than it was from a lot of those board rooms. And we set tout make the best original content we could. Original series online, free to the consumer. Supported by advertising. But in all honesty, weve been doing this for seven or eight years. And when i met ted serandos at netflix thats the moment now where most people get in their minds that the best original series can come online and not just from the major Media Companies. The best original series, whether its online or from a big media company, costs money to make. You nailed it. So if you can give the best artist the kind of creative freedom that they dont get in major Media Companies, then youve got them hooked. Then you give them the fair and best Business Model possible. But youre seeing a lot of Companies Like ours produce the highest Quality Content at a fraction of the cost that we used to spend in broadcast television. What accounts for the decrease in the programming costs for you . Well, for us, i mean, we started with short form series. So i spent most of my life making 30minute shows. 60minute shows. The biggest question we were always asked when we launched our first videos with david wayne and paul rudd and Elizabeth Banks was how long should it be . We used to always say as long as its great. But now the answer of course, the short form online is keep it short. So some of the best original series on there and episodes that we make are sometimes two to three minutes long and thats what the Consumers Want. So is that notion of the hourlong clock or any clock for any day part, for any viewing experience, is that gone because the content is what rules the experience . No, its completely valid. But i think youre seeing a lot of Disruptive Companies prove that you dont have to stay fixed in that old formatic box. The best content is going to be shared onetoone, person to person, regardless of its length. Tell us a little bit about reality tv. And how this has played into the change. Because talking about scripted drama, that seems to be most popular thing around now. Well, some of the biggest stars in the new world, great stars that weve worked with and others at places like youtube, prove that a compelling personality can turn that camera on in their very room and reach millions of people, sometimes larger than television audiences. We recently hired a lady named Sara Forsberg based in finland where she uploaded a video that within two weeks had over 10 million views. What does she do . She spoke most of the worlds popular languages in perfect language and dieelect but shes messing with you and a comedy video and it in gibberish. We saw it and sent a deal and Ellen Degeneres put her on television. These are the kinds of new stars like Sara Forsberg that are able to break in this new world. If you and i were having that meeting at a Major Media Company we would be debating it for six months. Have you noticed that there are many talented people who are now getting their first crack at stardom, at getting a popular audience because of the internet . Because of all these social media experiences . How are they going to get compensated . A lot of money or a little money . Thats the big debate. Youtube is a rev share for most of them and put your video up and split the revenues. We started by paying people up front for the best content that we could find. Keel has been making and selling cosmetics since 1851. 160 years ago. We are joined by the president of keels u. S. A. Thank you for being here. Thank you for having me. Tell people about the history of keels and how you came to join the company. It started in new yorks east village and we are still in the original store weve been in nor 163 years and been around before lincoln was president and survived the depression, the latest recession, killer bees the whole nine yards and all new yorkers could come to for their health remedies. Anything that ailed them. And weve been making kiehls skin care since the 1950s. Ive been a kiehls user for 25 years. And ive been with the company for 14 years. Well, the biggest seller that weve had has been our the first foray into oils which is the big trend for three years. Midnight recovery. Midnight recovery. So for a guy like me who rides a motorcycle, a couple of drops on my skin after i am on my bike and then better skin in the morning. Selling for both men and women . Men and women. Have you noticed any changes in the profile of what men are buying and how much . Definitely. I think that the mens market is huge. About a 2. 2 billion industry and since 2008 grown about 222 million. Last year thats the biggest thing were seeing is antiaging. So we like women want to look our best. Ome of us want to turn the clock back and an antiaging and eyes are what men are focused on. And it is summer now and warm. People are out. S. P. F. Protection. This is something that everybody thinks about. Whats kismes role . S. P. F. Protection is probably the easiest and cheapest way to protect your skin. Everybody should be out there with at least an s. P. F. 50 on their face. 50. 50. Because anything else youre not getting the true protection. Sort of after promoting it and setting up the broadway version. And i ended up taking all these transatlantic flights every few weeks and fell in love with new york and wanted to set a story here. And sort of went back into the back catalogue of ideas. And aid thing about an a r man and in band when i was a kid. Thats ok. We wont hold that against you. Thats all right. James, you mentioned broadway. I want to talk adjust a little bit about you and broadway. You got a tony, dont you . I have. And you earned it, didnt you . Well, i dont know if thats true. Come on. What were you in and i was in a play called one man, two governors. It did very well here and in the play while i shot the film. John came to see the play. With our producer anthony bergman. And judd apatow came and john said after the film, do you after the show do you want to shoot this film . So for me it was amazing to be shooting in manhattan and doing a play on broadway and working with a director like john and mark ruffalo and Keira Knightley and all these people. It was really amazing. And youre also a star when productions, gavin and stacy. A big series. What does this world of new media mean and ability to reach people that you could actually go directly to the consumer . Have them actually just download the episodes . Do you like that idea . I think its great. I think anything that gives people choice. So long as the people who are creating the work are being rewarded and paid for it. Compensated. Like the aereo agreement. And the last show that i wrote for the bbc is a show called the wrong man part financed by a Company Called hulu. And amazing for us. That we would make a show, a very small show in the u. K. That within then people would be able to watch on the other side of the world. Its amazing. Through those streaming services. Its great that essentially what our film is about really. Is a big message in the film. Is an artist wanting to put her music in the hands of people to listen to it. Without all of the sort of machine that goes in between it really. John, financing a movie. Certainly not a lot of money. And americans tend to spend a lot of money on movies. And i made the last film for a couple hundred thousand and this film in terms of american money, its not a lot. Shunning barclays after the attorney general booted for lying to clients. All of the trades for all the customers they took in were executed in their own dark pool and when they saw that number, they knew it would scare away Institutional Investors and they actually after they fired the guy who wouldnt reduce the number to 35 , they presented this false information to the investor anyway. But one team that wont be drafting a player in the first round, the Golden State Warriors. Why . Well, the fault of my next guest. Andre iguodala was traded for their first round pick last year. Andre, welcome to taking stock. Great to have you. Thanks for having me. Its all your fault, theyre not going to get a first round pick, are they . Im not the only one. You got to share a little of it. Got to share, yeah. Lets talk about free agency before we get to the draft, right . Carmelo anthony. Lebron james. Both now free agents. What does that tell you about the change thats gone on in the nba and also about the economics of the business . Well, you go through different trends throughout different generations of nba. And you had where one guy would be in one city with one team for the duration of their career. And now were in a different mode where with the salary cap, the c. B. A. , theres a lot of movement. Theres a lot of player transactions. Teams are always vying for positions to move up to try to win a championship. All or nothing at times. And you make a lot of splash or make headlines with some moves. So in a situation where you have two guys who can possibly make huge impacts on other teams. Where do you think theyre going to go . Have any idea . If i had to guess, lebron goes back. Goes back to miami . Yeah. Hes been to the finals four times. And only been done three times in nba history. And carmelo, thats the interesting case. He wants to win a championship. And with the new age social media, theres more pressure on players to perform. Not just statistically but in the wins column. And how many rings you have. So im sure thats the priority on his list. Now, you mentioned just a moment ago, you mentioned this idea of obviously free agents and players staying with specific teams. You wanted to play specifically for the Golden State Warriors. You wanted to be near silicon valley. Why is that . Well, the combination of things. Silicon valley was a big influence. Ive been able to make a lot of contacts. And network with the right people who have given me a lot of knowledge. Ben horowitz, right . And dreessen horowitz. And jeff jordan. Theyve been instrumental me in gaining the knowledge that i need to obtain to have a life after basketball. Because, you know, father time there is a life after basketball . Yes. Father time is undefeated. And athletes have to realize that life doesnt stop at 35, 36. And im really interested in putting the same type of work in and same type of hours and conquer life after basketball. You would like to own maybe a Basketball Team yourself, right . Yes. But its going to take a lot of dollars with the way the teams are being evaluated, youve seen the clippers got sold for 2 billion. Michael jordan a billionaire now based on the clippers valuation. So ready to put the work in. Start the business. And that will be the ultimate goal. Talk a little bit about the Los Angeles Clippers and in fact you were the Golden State Warriors were the opposing team at the game that was really the centerpiece of the dispute after the comments by Donald Sterling that have led to the fight to then sell the team. Uhhuh. Well, i think as a testament to the players, to be able to look past one persons opinions and views upon a race or people and look past that and give ultimately our fans what they pay to see. Because without them, you know, were not on this platform to be able to show our talents. And the nba doesnt exist. You dont have these enormous valuations for these teams. And you put 12 million into the team, and you sell it for 2 billion. Incredible investment. You dont see that centuries. So were going to continue to play for our fans. Were going to continue to raise the level of play. And we want to be the known as the best sport in the world. Watching a team like the New York Knicks has been frustrating for many years. Phil jackson now. Taking over. New coach. What do you think of their chances and then who replaces the coach from the knicks . At the nba union . The Players Union . Well, you have a guy in phil jackson whos whose body of work is tremendous. He has nine rings. Or no, he might have more than nine. I think he has 11. He has 11 rings. I read his book. So and hes also won as a player. So thats 12 rings. So he has a body of work that says hes successful. He has the blueprint on building a successful franchise. And just at different level. And im pretty sure he will be coaching through derek fisher and as far as our union, we just have meetings two days ago interviewing candidates. We have another would you be interested maybe in taking over as president of the union . You are already Vice President . Im not ready for that role yet. But ive had the opportunity to learn the ins and outs. We have some amazing people, advisors, and counsel helping us to make this decision from the outside. And theyve come onboard. And theyve been an addition to helping us get to wherever we want to be as a union. Do you have any thoughts on who you would like to see as executive director . We know we want somebody whos well versed in negotiations. But also unifying players. We look at sports, and you look at baseball players, mlb has done a great job of really coming together a union. And theyre able to dictate their own future as opposed to Major League Baseball and the owners telling them exactly what they want them to do. Lets talk about players. Because we got the nba draft. Lets start with andrew wiggins. Andrew wiggins. Probably the highest ceiling as far as potential and talent. If hes become the player everyone expects of him, hell be the best player in the draft. Hell be the superstar. Hell have the endorsements. Hell be on a wheaties box. But in terms of whos ready right now, you got jabari parker. I compare him to carmelo anthony. The impact hell be able to have on the floor. He has a high ceiling as well. So you got some guys who have the opportunity to take the torch and take it into the next decade or so. Wouch any guidance or thoughts for both of those players as they come into the nba . What would you say to them . I spoke to them today actually. What did you think . Those two in particular, theres a lot of pressure on you guys. You got to perform at a certain level. Its not like it was 15 or even five years ago with social media and the pressure and the fans actually weigh in on the game more than ever. With the social media. So the first thing you want to do is enjoy the game. And respect the essence of the game of basketball. When you put the work in, and you treat the game you reap what you so. Sow. Weve all come from Humble Beginnings and your family is in an awesome position to really embrace all the if you reach for yourself, so just enjoy the game. Joe lakub of the Golden State Warriors you mentioned that hes helped in as many ways to be a mentor in the world of business. And so on. Do you think theres that trend that the owners, that the managers, theyre going to take more of an active role in having those conversations with players . I think theyre doing it. Owners are fans now. And theyre really active. With transactions. With personnel hirings. So you got to have a good balance with that. Because sometimes a person thats playing the game longer might have a little bit more expertise. But without their knowledge, and the hard work they put in they wouldnt be able to obtain the team. So theres a good balance there. And i think were headed in the right direction to try to win a championship. Is there one particular thing that we dont know about, andre iguodala, that maybe you want to share with us that you carry around with you that you dont get asked often . I downloaded a book in the club in my last week. And i shocked myself because i dont go out, dont drink. Im pretty plain jane. Im interesting. But as far as what was typical basketball player, its called quiet. Exploring introverts and exontario verts. And extroverts. Im getting to understand the difference of the two and which one i am. Which one are you . Theres two types of introverts. So i think im introvert. But with society and the way it is now, you always have to sell yourself. And thats what part of the draft is. The draft is this big hype machine of the next michael jordan. And this pitch, you got to pitch yourself and exert a confidence about yourself to these teams. So they invest a lot of money into you. Technology platform uber is disrupting the way we hail transportation. But what happens when the drivers cause a bit of disruption . Some drivers in los angeles want more cost sharing from the company. This as the state bill gains steam a. New bill would provide primary insurance to drivers from the moment a participating driver logs on to the app. Well, with more im joined by Joseph Dewolf sandoval, cochairman. Vers and part of a fleet of vehicle that is operates with the uber platform. Thank you for being with us. Explain about whats going on with uber and the drivers . What is the conflict . Well, there are three different platforms on the Uber Technology number one is the uber black. Those are the town cars and the luxury vehicles that you see driving the streets. Theres an uber s. U. V. And uberx. The uber black and uber s. U. V. Platforms are selfinsured by the owners, partners and drivers in some cases. With commercial insurances up to 1 million per incident. This is required by the state of california. The California Public utilities commission. And also for a t. C. P. License as well. The uber x platform is a little different. This is the ride sharing platform that uber introduced about a year ago. And those cars are generally ensured primarily by the driver in a private insurance, at least thats the research that weve done. And when a car is running in a commercial endeavor, like an uberx, and it has private insurance, generally the insurance wont cover an incident. So the definition of in service, its something thats in dispute. Its ambiguous and uber has taken a position that our Drivers Association doesnt agree with. Specifically, that when the driver is driving, and has the app on, but doesnt have a ride that theyre going to, or actively engaged in taking a client somewhere, that their insurance is the primary insurance. And it should cover any incident that happens on the street. What would you like to see happen . I mean, what about the bill that is in california . Well, our association fully supports ab2293 which was submitted by assemblywoman susan vanela. We believe that its a fair way of sharing the costs and the risks. We believe that right now, uber shifts the risks of insurance to the drivers and the owners and operators. Whereas it reaps the benefits. This bill would have Uber Technology and other transportation Companies Like uber, for instance, lift and side car, to be the primary insurers rather than secondary insurers. And that it would also up the amount during this period. When a driver is driving but doesnt have a client or is not on the way to pick up a client. So that would be according to the way that the bill has presently been amended, 750,000 per incident rather than the 50,000 to 100,000 coverage that uber presently provides. That was being discussed yesterday in the legislature, and the Senate Insurance commission which i was lucky enough to be there and testified as well. And it was passed on a 91 vote. Joseph, just hang on a second. Because joseph, just hang on a second because i want to just describe to read what uber has said in response to all of this. It says while uber is focused on a great experience for riders and Economic Opportunity for drivers, the teamsters local 986 is focused on recruiting membership and filling their coffers. Partners, drivers, grow successful Small Businesses thanks to the freedom, flexibility and Economic Opportunity afforded by the uber platform. Uber partner drivers have a direct line into the uber team and we will continue to work with them to ensure their Small Businesses thrive. You have any response to that . Oh, im very happy to respond. In fact, i was hoping you would ask me that question. This is the same talking points that Uber Technologies used when the teamsters assisted in seattle. They were known for their formula one and only recent r recently have they sold production cars again. And did one in the 1990s and so basically theyre trying to take on car makers like ferrari and lamborghini. They came out with a car the 12c a couple of years ago and fell a little flat. I drove the car and i think its one of the best cars ive driven ever as a sports car. But it isnt as sexy as a ferrari and didnt sound as good as a ferrari and some of the drivers were disappointed. So now theyre introduce being the 650s which is sort of like its a shift in strategy. 75 same car as the 12c. Costs about 20,000 more. Or more. And looks much cooler. The total price for Something Like this . Say 20,000 more than what . The coup at 265,000. 265,000. I drove a convertible which came to 350,000. All in. This is not your first or second car this is your sixth or seventh. Fourth or fifth and hard core very fast sports car somebody who bought the ferrari 458 would be cross shopping with this car, for instance. Cross shopping with a ferrari 458. With the 458. How many do they expect to sell . Any idea . They sold 3,500 12cs over since 2012 model. Which actually isnt that bad in the supercar world. But i think they wanted a bigger hit. They were a little disappointed with with the reaction from actual buyers. Ferrari keeps a residual value so high. And really right now, you could buy a 12c for a lot cheaper than the original. We put our Heads Together and came up with this product and hopefully we got this on the product. What are the results so far . The results are fantastic. Weve done two clinical studies. In children. With eczema. And we should have shown great safety. Great improvement of the skin. And first study published last year. Second study was finished in march of this year. They got humans and anything for animals next . Actually, we do believe it or not. We have something called splash and splash plus.
