and parents back inside the school for safety. there are a row of shops here so lots of people would have been around, particularly with the school coming out. the man was attacked by the two dogs. witnesses have described the attack. i will not go into too much detail but the man suffered from serious injuries and sadly did not survive. the police have announced that the man originally arrested has been arrested on suspicion of manslaughter. the dogs themselves are both dead. one died whilst being restrained and one after an injection was administered by a vet. it is believed that the breed is the american xl bully, a controversial breed recently. it was in birmingham last weekend where a ten—year—old girl was attacked by one, and the two men who came to help. the dog was kept in secure canners. —— is being kept in secure kennels. let's get more on this now with our political correspondent iain watson. there's criticism that the governemnt has been dragging its heels over banning this breed of dog. what does no 10 say? the premise is very clear, he does now see this dog, the american xl bully, is a danger to communities. this was the final straw and he told us this morning that he is trying to go ahead with this band. he was under pressure from his own government. if we remember, the home secretary leading the way, saintly dogs are a lethal danger. it is not responsibility, it is the responsibility, it is the responsibility of the environment secretary. she has been working on a band behind the scene. labour party also ban mac support the ban. this is not as straightforward as people might assume. this is not a breed of dog, officially recognised breed of dog. defining these dogs may take some time. the prime minister says he wants the ban by the end of the year. they want to make sure people with similar dogs do not get caught up with similar dogs do not get caught up in this ban. the rspca are suggesting that government, politicians, should be far more focused on the actions of dogs and their owners, rather than a particular type of dogs, and they think that some dogs who are not harmful may be restricted to. when it comes to how this will be implemented, looking at how the dangerous dog act works in the past, the list dogs that are banned, there is a transition period with the sale of dogs being banned first. not the possession of dogs. that usually comes at a later stage. it gives time to adjust or in some cases, the animal would pass away, rather than being dealt with are being put down. you may see those animals muzzled, rather than removed entirely from society. rather than removed entirely from socie . . ~ rather than removed entirely from socie . ., ~ , ., ., rather than removed entirely from socie . . ., rather than removed entirely from socie . ., ., ., society. thank you, ian watson, from westminster — society. thank you, ian watson, from westminster with _ society. thank you, ian watson, from westminster with that _ society. thank you, ian watson, from westminster with that update. - some breeds of dog are already banned in the uk. with more on that, in our newsroom here's our reporter there are four types of dog on the banned list but it also includes... now, as well as being illegal to own that dog, you also cannot sell any banned dog here in the uk. you are not allowed to abandon a band dog. also, it is illegal to give away a band dog and you are not allowed to breed from a band dog as well. whether your dog is not allowed as not down to its breed. if a dog had lots of characteristics of a pit bull terrier, it may well get put on the list. any of the authorities can take away such a dog from an owner but often police have to get court permission to do that. the court can decide that the dog is not a real risk to the public and allow the dog to be given back to the owner. that is under strict conditions. they include the dog must be neutered, it also has to be micro—chipped and when it is out in public it has to be kept on a lead and muzzled at all times. also, the dog has to be kept in a secure place so that they cannot escape. you cannot keep it in an open cannot in your garden. it has to be kept locked up so it cannot escape. it is the department for environment food and rural affairs that is working on bringing this ban in on the american xl bully by the end of the year. they will bring together a group of experts who will decide that it is a breed so that it can be added to the list. right now, no final decision has been made on what happens to those people who currently own an american xl bully when that ban does eventually come in. thank you for that insight. i'm joined now by lawrence newport. he is a legal academic and has been campaigning on banning the xl bully dog breed for the last four months. thank you forjoining us. you've been tracking the rise in fatal attacks by xl bullys — how dangerous are they? the shocking statistics speak for themselves. the american xl bully is responsible for for over 70% of all deaths since 2021. it only arrived in the country in 2018. it is behind 50% of attacks on humans and dogs. there was one dog a day killed by a american xl bully. they are a uniquely dangerous dog. there are around 270 times more deadly than the rest of the dog population. really interesting. do you really think we can blame the breed itself? yes. unfortunately, these dogs were bred from fighting stock in the late 80s and 90s and the claim was they were crossbred with other large breeds. we have not than that. if you trace the pedigrees they are slightly inbred fighting dogs that were bred with inbred for larger incisors and strength. this is what you would expect to see if you take a fighting breed and bred it multiple times overfor a fighting breed and bred it multiple times over for exaggerated characteristics. the multiple times over for exaggerated characteristics.— multiple times over for exaggerated characteristics. the government have decided they — characteristics. the government have decided they want _ characteristics. the government have decided they want to _ characteristics. the government have decided they want to ban _ characteristics. the government have decided they want to ban this - characteristics. the government have decided they want to ban this dog. i decided they want to ban this dog. do you think they have been slow in doing this and implementing this? i think the onus was very, very clear. there was a very large lobby against this led by the rspca and dogs trust. they were against any ban and wanted to bring back the pit bull, and getting rid of legislation. there was a large effort to try and stop this. it took a great deal of effort from a small number of people to actually just effort from a small number of people to actuallyjust put effort from a small number of people to actually just put forward effort from a small number of people to actuallyjust put forward the facts and figures and short that as we know, retrievers retrieve and fighter dogs are going to fight and thatis fighter dogs are going to fight and that is what we are going to see. ads, that is what we are going to see. a lot of these dogs have been crossbred with other dogs. if the american xl bully is being banned, want breedersjust find american xl bully is being banned, want breeders just find another way to breed potentially other aggressive dogs? the to breed potentially other aggressive dogs? to breed potentially other a: aressive dos? ., , aggressive dogs? the ban on pit bulls has been _ aggressive dogs? the ban on pit bulls has been remarkably - aggressive dogs? they can't seize any dog in a public place if they think it is a dangerous dog. they can approach the courts to get a warrant, if it is in a private place. courts to get a warrant, if it is in a private place-— courts to get a warrant, if it is in a private place. what rights does an owner have?
