Untoward in this regard or that the properties were sold to enable the accused to take flight, for example, the state would have investigated this matter long ago. I did not hear state counsel to say that the state was taken by surprise by this information that is the properties of the accused were sold. If the state has said that this information had taken it by surprise, it would have been a different situation. That because the accused there was now a likelihood that he might flee. Lastly, i am in agreement with defense counsel that if in future there was any incident which entitled the state to make or to approach any court to make an application, to have the bail of the accused cancelled, the state would be free to do so. In regard to the above, i have used my discretion in favor of the accused. I grant the application to extend the bail of the accused on the same conditions. Just as we leave those pictures from inside court, what we have learned in those last few minutes before the court adjourned is that the judge has granted Oscar Pistorius bail until his sentencing. He will continue to live at the house of his uncle where he has lived for the last 18 months since he was given bail, and he has not insisted that he spends time in custody until sentencing. In a few minutes time perhaps, some point in the near future, Oscar Pistorius, despite being convicted of culpable homicide in the killing of Reeva Steenkamp, will walk from court through the usual entrance. He will not be spending time in custody. At least not until the sentencing. We heard dates in october being mentioned there. The 13th of october for the process of sentencing to begin. So we think that is going to be agreed upon. So that is the situation. Oscar pistorius will walk from court this afternoon, a conviction for culpable homicide now to his name, but for the moment, at the moment at least free to live at his uncles house just outside pretoria, in a suburb of the city. Im just going to discuss the process now with former judge willem heath about what actually happens when that date comes. How quick how much is satisfied for the actual argument, how quickly is it before the accused knows their fate . First of all, they know the dates. The counsel can prepare for the dates. Called upon by the judge to supplement documents for her to study. So the time it would take in court, at the longest, would be a day. But not even a day. Reporter okay. So theres some process of actually hearing the arguments about the sentencing, and then a pause before the actual sentence is handed down. If they decide to call witnesses, that can take longer. But so much of the evidence is already psychological evidence. So that type of thing, that sort of information so i would think by the third day in october, he would be sentenced. Reporter thats fascinating. So just over a month until Oscar Pistorius knows if he will be going to prison or not. And in the meantime, he continues to live at the house with his uncle. Has he got any restrictions on him . Well, the court doesnt impose his restrictions. If they want to report to the Police Station every day, or once a week, that will continue to apply. Shes just extended the bail. As far as those conditions are concerned. Its not that often. So i think he would like to go. Reporter just to remind you what we are watching, were watching the pictures from just outside court, because we are expecting Oscar Pistorius to leave the building at some point in the very near future. We will see the families of Oscar Pistorius and of the victim Reeva Steenkamp begin to come out. Of course, were going to try and talk to them, or hear what they have to say, if theyre giving any kind of verbal statement as they come out. There is another clamor, of course, of media outside waiting to hear their reaction. Weve seen a very relieved looking Oscar Pistorius coming into court, even before he heard that culpable homicide guilty verdict, not officially being convicted of murder. So he already looked like a relieved man, knowing he was not going to be convicted of murder, but now we find out if Oscar Pistorius well, he found out that he will now be free to live at his uncles house at least until the 13th of november. And we are monitoring whats going on. Barry is declining to comment, but he has a big smile on his face. His client will not be going to prison for murder. Instead, he has been convicted of a lesser charge of culpable homicide. So were going to keep an eye on what is going on outside court now that everybody is starting to emerge. Somebody convicted of culpable homicide, a serious charge. A woman was shot dead. Its quite common, it depends on the circumstances by the judge. And she obviously doesnt concern the evidence of what occurred that serious. Its quite common. Reporter and the fact that Oscar Pistorius is granted bail way back in february 2013 at the initial bail hearing on a charge of premeditated murder, that caused a great deal of controversy at the time. Yes. But at the same time, if she had the confidence at that point in time, it does not apply. So were watching as the media crowd is now fully expecting Oscar Pistorius to emerge. 43 days of this trial, over the course of six months. That same clamor for a comment from him to gauge some kind of sense of what he is thinking as he walks into court and then leaves again. But this is a man who is leaving not with a charge of premeditated murder hanging over him. Not one of murder at all. But now a conviction, a criminal conviction for culpable homicide. So people are even taken to great lengths, sitting up on the tops of the walls. Were watching cameras poking out of high stories up in the Court Building. The media are everywhere on this trial. It has caused such interest given the celebrity nature of the accused. Now lets take ourselves back to what judge masipa said as she pronounced her verdict in this case on the charges that Oscar Pistorius was facing. This happened a little earlier today. Evidence was purely circumstantial. Moreover, the evidence of witnesses who gave evidence on what they heard, in what sequence, and when proved to be unreliable. Although it is not necessary for the state to prove motive, there is no basis on this which court could make inferences of why the accused would want to kill the deceased. As we wait for Oscar Pistorius and the key members of his family and the victims family, Reeva Steenkamps family to come out of court, talking to former High Court Judge willem heath about the implications of this trial and the way the last few days have panned out. This moment came early on when judge masipa threw a lot of the states case out of the window effectively. What sort of reaction has there been about the way this this case has gone . Well, theres a lot of negative comments. Theres a lot of lawyers saying she did not analyze the law character, that she did not analyze the facts correctly. But when you consider the judgment, its evidence that she concerned the facts, that she concerned the law and thats all shes required to do. Theres a lot of criticism. They thought she should have convicted the accused of murder, and therefore theres a lot of unhappiness. Find themselves actually in the same position that she found herself in. Obviously this trial has so much attention on it because of the celebrity nature of the accused and the victim. I mean, does this happen with other trials, that all the other lawyers out there think a judge should have done things differently. Did you have that sense of a backlash at any decision . Me personally, no. It does happen from time to time. Not to the extent of this one. You wouldnt expect those comments. As far as such cases are concerned, trying to get advocates involved in the case. The prosecutor would like to see. That doesnt always result in an appeal. I mean, there has been speculation that the state now will appeal this on a legal basis. What is the process . Well, usually at the moment, a sentence is imposed. If it doesnt happen immediately as the sentence is imposed, then a judge must normally call for argument and postpone to a date. If the presiding judge does not grant the appeal, a petition must be lodged and a number of judges would then consider the prospect and why it should not be granted. Its very common, but thats the process. And by that time, of course, almost a year would have gone. And at the same time, waits for a date. So the timeline is actually about two years before the appeal. Reporter thats a very lengthy process if there is an appeal. Is it an unusual thing for a state to appeal a judges verdict . To take that long . Reporter just to appeal it in the first place. How common is it that that happens . Its very common. Theyre running the risk for a conviction, so they could have to carefully analyze that and consider. Reporter were still waiting here for the key people in this trial to emerge. Weve seen the lead counsel for the defense coming out with a large smile on his face, but refusing to talk, spend any time commenting to the media. Oscar pistoriuss defense counsel whos become so familiar over the past few months. The crowds of media are waiting. There are also lots of crowds of Oscar Pistorius supporters. Weve seen this display of affection for Oscar Pistorius by a certain number of people who have chosen to actually come to court to tell him that they supported him throughout. But weve also seen campaigns for the victim, Reeva Steenkamp, every day in court the anc, the African National congressWomens League is there in solidarity with row rhee and female victims of violence. Varying opinions about the case all the way through, outside and inside court. Im with willem heath, the former High Court Judge, analyzing the implications for Oscar Pistorius now, just going back to where we are, he has been granted continuation of bail, convicted of culpable homicide, and now awaiting sentence we think mid october. Yes, very much so. Reporter and we talked also about the considerations the judge will make, and the fors and the againsts. Judge masipa sentenced someone for over 200 years for serial rape. We cant tell, though. Can you gauge anything from her behavior in court so far . No, shes been playing such an objective role. Probably on purpose. Its difficult to judge it. Shes already found that the accused was actually in selfdefense. Because of those circumstances. So she can hardly ignore that when the sentence is imposed. So the killing happened during the course of that situation. So with that in mind. Reporter we talked when we were discussing this yesterday not knowing what the verdict was going to be about the public pressure on a judge and how much a judge has to ignore that, the clamor on a huge celebrity case like this, for there to be justice. And knowing what public reaction will be if a sentence is light. What kind of judge what can a judge do about this . Do they have to just blinker themselves . They need to toe kus on tfoc case. Shes had many years of experience. A judge is not supposed to read the papers today or watch the tv because it might slightly influence her. Shes a human being. She would probably not be influenced by that. Reporter while youre talking, we just heard a rather loud cheer from the direction of the court. Havent had any indications that that is Oscar Pistorius leaving court. That could be any minute now. Theres certainly been a clamor, but not entirely sure whether Oscar Pistorius has started to make his way out of the building. Im just seeing cameramen pretty much everywhere. Just watching the pictures you can see now. Here comes Oscar Pistorius. There he is, leaving the Court Building here in pretoria, convicted of culpable homicide, but not of murdering his girlfriend Reeva Steenkamp. Leaving on bail to continue to live at his uncles house until he is sentenced next month. But a huge cheer, screams from the fans weve seen turning up every day here at court. But Oscar Pistorius with pretty much a smile on his face. A very, very clear look of relief walking out the Court Building. To get into the car to take him back to his uncles house, just in the suburbs, the leafy suburbs of pretoria. Apologizes for all the movement on the camera. Obviously you understand it is very hard to get a fixed picture in such a situation. I think you get a flavor of the clamor. Over the last couple of days, absolute frenetic nature of the jostling outside court, literally sweeping you off your feet if youre stuck in the middle of it. Everybody and anybody trying to get a picture of Oscar Pistorius, so far remained pretty silent throughout the 43 days hes been coming to court. Barely saying a word. And certainly the last couple of days, absolutely no word at all from him as he leaves court. But Oscar Pistorius has left the high court a convicted criminal, but crucially, not convicted of the murder of Reeva Steenkamp. Instead, a culpable homicide in her killing. What were going to do now is analyze the implications of that conviction of culpable homicide for Oscar Pistorius. He leaves court a convicted criminal. Reporter Oscar Pistorius shortly after he had killed Reeva Steenkamp. From the very beginning, he insisted it was a terrible mistake, that he and reeva seen arriving at his home a few hours earlier were very much in love. I was simply trying to protect reeva. I can promise that when she went to bed that night, she felt loved. Reporter in court, but not shown on the cameras, pistorius maintained that he shot through his bathroom door, convinced an intruder had broken into his home. His grief and regret were compelling. And i sat over reeva and i cried. And i dont know how long i was there for. She wasnt breathing. Reporter pistoriuss defense made much of the athletes vulnerability as a disabled man, confronting a perceived threat. His capacity to walk without his prosthesis is poor. His balance is poor and he could easily be pushed over. When exposed to a threat, mr. Pistorius is more likely to respond with a fight response rather than a flight response as his physical capacity for flight is limited. Reporter the prosecution sought to show there was a darker side to pistorius. His obsession with guns, his quick temper, and his questioned how the athlete could have made such a terrible mistake. She is sitting inches away from you in the toilet. Thats correct, my lady. And she never uttered a word. Thats correct. Its not possible. Its not probable. But at the heart of this case was the question of what pistorius was thinking when he shot four times through the toilet door. I heard this noise and i thought it was somebody coming out to attack me so i fired my firearm. Your defense has now changed, sir. Selfdefense to involuntary action. I dont understand the law, but i can reply and tell the court what im asked and i can reply as to what i thought. Reporter todays verdict suggests the judge believed pistoriuss explanation. I believe that the judge was swayed by his demeanor on the stand. The judge was swayed by the evidence that was procured by the defense, including the psychological impact that his childhood may have had on him as well as the experts that were brought in by the defense. Reporter this is almost certainly the best verdict Oscar Pistorius could have hoped for. It means the prosecution failed to convince the judge that the athlete meant to kill anybody. But it still means the judge found him criminally negligent. System of Reeva Steenkamps friends have already criticized the verdict. It is unfair. But it doesnt surprise me, and in fact, its pretty much what i expected from the outset. Reporter because . Because he can afford the best possible defense and private investigators to support his case. Reporter Oscar Pistorius has yet to be sentenced.
