Supervisor cohen thank you supervisors, i mentioned earlier i was here at the six hour meeting. I have a leg brace and a back brace and i stayed throughout today. I want to tell you that the years and years of my environmental work are not going to be in vain. I have thousands of articles that i have written. I go before the bay area air Quality Management district and you have some representatives. They dont Pay Attention when you go to the board. The bay area air Quality Management district has employees who want to work very hard and they are told destroy the documents and we have not heard anything from our supervisors and we have not heard anything from our board. So on another level, an important level, you all know that at Hunters Point, equipment was put so that they could register the very, very high levels of asbestos structures. What did they do . Which some of you supervisors have taken money from, they removed the batteries. I know. In any project, and more of dubious projects, that supervisors, including mayors take a lot of money. Illegal money. They think they can use a mechanism of this money or whatever, but that is blood on your hands. So i dont mind suffering, but i dont like to take painkillers. I will suffer. But i will speak up. I make statements, but there are supervisors that have their hearts in the right place and those who get my blogs, they know they have to do what is right. Thank you, very much. On the 19th of this month, you heard from 90 black skinned coloured people, both male and females pertaining to discrimination based on race. By all of the departments here in the city, i submit to you that you are running a correct and organize enterprise in the city and county of San Francisco you originate by ethnic cleansing in the fillmore area by justin herman. Any further compound the problem years before them in the forties , with chemical warfare, by using hazardous chemical materials, and the Hunters Point area which kills thousands , probably millions of black people. It just flows. As a result of your employment discrimination against blacks, and every department within the city, and numerous testimony took place, i find it odd that the two black females in the authoritative position failed to appear. And they have the audacity to tell us about employment and about how you dont appreciate us talking about employment and people who are making 184,000 for sweeping up shipped off the street. And you say it was 80,000 and i was being disrespectful. It is not 80,000 a year they are making. They are making a hundred and 84,000. I appreciate you talking to me like that. It just flows. S. F. Glove , gov, please. The bay area has an increase in modern rent. Given the neighborhood sponsors with more than 30 of the decrease in the number of low income africanamericans, latinos and asians living there. It says in the agenda we have three. Ok. My name is anubis. Good evening to madam president and the fellow board of supervisors. I am a San Francisco native and i was homeless for six years on the streets of San Francisco in the city that i grew up in. I have come here today for the general Public Comment to talk about homelessness and the attitude that the city seems to have taken towards the Homeless Population. More than ever, we see that the city is trying to house Homeless People but on the same token, it punishes and it criminalizes the Homeless Population for simply sleeping on the street. I am a person of reason. I understand that people and your constituents have fear of people who commit crimes or perceived to have committed crimes. I understand action seem to be taken when true crimes are committed such as robbery or violent crimes, et cetera. The people should not be criminalized for the simple act of sleeping. And it has become very common in the city for d. P. W. To cave into businesses and even to put barricades on public property, but not only dampers, it dampers the ability to survive on the street but the ability for the general public to use public spaces. One example of this would be the u. N. Plaza. In summary, i just want what im asking for is i want this board to send a message to the entire City Government and the current mayor, that you will not stand for decriminalized of the criminalization of homelessness. Supervisor cohen thank you for your comments. Next speaker, please. Tom gilbert d. I mentioned earlier about gavin newsom running for governor. He is the man that pressed court against the washington vote. He was saying we need a new formula. So the people of San Francisco said to1 margin, we dont want eight washington. I am wondering, where is he coming from and what his new formula is going to be . Again, financial profits. From what i understand, the world dash the word is fire, now. Financial, insurance, real estate runs the world. We have a situation here that we are going to leave behind 25 or 30 Affordable Housing starting at hundred 20,000. And yet we have social needs in our community. The weave is wearing apart. Where are we going to get Senior Housing . Where are we going to get foster kid housing . Disabled housing . Section eight housing . People that are on the margin that cant afford their own homes anymore. People in the margin who cant afford their rents anymore. We need dignity homes. They dont have to be large, but they can be they should be placed in every format. Especially what we are talking about today in this 15 15,000 or 1500 homes, again. We think 25 is great but how can a teacher make a hundred 20,000 and afford a home here . We need to reweave our society. We need to bring the Government Back home. Times are changing. If we can do this and set this model up here, it can be multiplied into every other community. We need a new direction. Thank you. Supervisor cohen thank you for your comments. Next speaker. Yesterday Michael Savage made a very interesting statement about christine forward and how she works at some christine forward and how she recruits ford people for the c. I. A. Everything that the American Public believes is a lie. What is his name . He was there talking about that. Do you remember that guys name . What ever. This is big. I dont know why Rush Limbaugh did not say anything about it or sean hannity. I cannot listen to 12 hours a day talk radio. This is big. It makes perfect sense. Christine forward ford is lying about sean kavanaugh. You cant have one big mouth lady bringing down one guy. Where are the four people who were in the room. They all said it didnt happen. Jesus is unique. He can do that. He said if i bear witness of myself, my witness is true. He said in the law of moses that it is commanded that two or three witnesses, everything will be established. Not just one lone witness legacy to. Jesus said, i am want to bear witness of myself and my father bears witness of me. Do you realize what he is saying there . Jesus stands alone. There is no one remotely close to the man, the god to man. He said his father bore witness of him. He said i have greater witness than john the baptist. John is much more than a prophet because isaiah spoke of him. Malachi spoke of him, but all of the prophets profits bear bore witness of him. Supervisor cohen thank you next speaker, please. Thank you. Good evening ladies and gentlemen of the board. I am going to try for the third time to talk about 911. You will recall back in 2001, involuntary outpatient psychiatric treatment was a huge issue in california. It was hotly debated in the state legislature and in the past. And then 911 happened. What is the connection . The patriarch act was passed. It modify the Foreign Intelligence Surveillance Act of 1978 in order to get rid of the requirement that electronic surveillance be conducted for foreign intelligence purposes. Also, there is still a requirement that the target of intelligence be an agent of a foreign power. However, that is a low bar to meet. All a person has to do is meet the requirement for civil conspiracy, which can mean encouragement. Someone who encourages terrorism i could make that. I could meet that by. I am not saying that i ever encourage terrorism but it is such a low bar to meet. There is a lot of grey area. One somebody once somebody is under electronic surveillance, what can be done . They can be entrapped into the commission of crime. Once they are entrapped, then they can be subject to incompetency to stand trial. They can be designated as incompetent to stand trial. This is a backdoor commitment to root for involuntary outpatient treatment. These people can then be committed and here is the proof. San francisco t. V. , please focus on the laptop. [ ] the cultural started at arts mission. This was the first set of grant money that the Arts Commission had to give away. By 1998, it was not only the Cultural Equity Grant Program but the cul Actual Center that happened. It meant that communities of color went from zero to like four or five million a year. Just over a very short period of time. Instead, we focused on building the arts community. The queer arts community. And out of that came fresh meat and radar and queer women of color media arts project and the transgender Film Festival and those organizations, some of those people are like part of the landscape now. Whereas, in the year 2000, they didnt exist. It was artists who raised the questions about equality, about gender, sexuality being different than gender. We think about it in our own life what weve seen go on here in the last 30 years. To see why the arts are important. Theyre worth investing in. [ ] i think it really is important to have government funding that is specifically targeted at people who live and work on the margins. Its so easy to overlook what those. Before they can start the race, just getting to that starting block can be very, very difficult for cultural reasons, the Queer Cultural Center asked me if i wanted to apply and they would help me apply. If you are white and you work in a black community and you are racist, you need to be i thought ok, well, im doing a writtenning. San francisco is so full of writers. What are the chances. I wasnt banking on it but when i found out, that i got the grant, it meant one, a group of people who were experts in the field, believed in me. For an artist, thats the hardest thing. Cities flourish when they have a creative class. When they have a layer of artists who are creating space and energy that supports other artists and attracts people who are fans of the arts. As long as there are young people in the city who are interested in our future, who are going to have strong and progressive and van guard arti artists. I cannot imagine my own work and organizations work can be possible without the support from San Francisco Arts Commission. I feel like to share those voices and to be the voice for those and to be the neighbor of those voices is something that we can be very proud of for the city. Im very grateful and at the same time very proud that we are are among our peer organizations. I feel like if i imagine 25 years from now how this San Francisco Arts Commission will be, the San Francisco Arts Commission has become a peoples commission. I think that would be a huge legacy to leave behind. [ ] [ ] [ ] i actually knew when i was young, when i was in high school. It was the iconic dancer. [ ] the hula that he did was what im totally accustom to. The extensions that he did where he left hula flavor of the rest of his dance and performance was almost like stepping into a new sphere. Its not just the physical, the movements and the tempo and the lyrics, its that he keeps it, i think, philosophically connected. [ ] he was young. He was ready to be molded. He came with a combination of fear and respect and awe many of its a Perfect Place for a new student to be because it offers you that opportunity to mold them. With patrick, when he came to class, he was like a sponge. Like a sponge. And he kept true to it. You know what im saying. When it was starting to study, he was so intense. He had to be told to relax. Patrick is a sweetest, kindest, most loving man i met. He is charismatic. He is motivating. He is inspiring. He is brilliant when it comes to choreography. Youve got the whole package. I think patrick is a good example within the whole world of being able to have a firm grasp on past traditions while shooting forward. The First Time Ever i kissed your mouth with hula songs, theyre in hawaiian. Not Everybody Knows hawaiian. When you watch a hula, you dont understand the story being told. He can use ledge songs and put a hula do it and everybody understands what its about. [ ] when they came out in that black and that one simple hairpiece, less is more. You get to enjoy the dance. You get to enjoy the faith. Those are the things i look for. [ ] i think he is one of the best risk takers. And he makes me braver, to try things. I love thinking of an audience going, what the hell. What . [ ] i think its all about variety. He looks for Something Else that could relate to other cultures, other people other than just hawaiians, it allows him to explore other cultures. They are so loyal to him. Whatever he brings, they know that they will be surprised, entertained. A part of something that is inclusive rather than exclusive. [ ] he loves San Francisco. San francisco embraced him when he needed it most. And he is on a constant give back. He has built such a nice inga tral working relationship with the community. His passion for it is, i think what touched me most. Theres a drive there. Theres this energy that comes from him that motivates you to do better. It motivates you to do more. It gave me that encouragement to start my own group. To do what he is doing. I want to replicate that. I have some young hula students that are excited to be a part of that lynn age where it falls back and goes all the way back. It motivates them to want to keep doing it. Im very proud to be the fly on your wall. To know that you have made me proud and that you will carry the legacy with you. He is so deserving of this legacy and it will carry on. With everything that he has given. You do leave a legacy in passing. You go. You go catch your legacy. And you continue to teach hula. You come back and you learn more stuff and you keep teaching me about that kind of stuff. And then, with all of that, laugh. [ ] [ ] president cohen all right, good afternoon, ladies and gentlemen. Clerk item 8 to increase the minimum Hourly Compensation rate for employees of city contractors other than nonprofit corporations or other public entities to 17 per hour, 17 an hour, and followed thereafter by an annual costofliving increase, also to increase the minimum Hourly Compensation rate for employees under contracts with nonprofit corporations and public entities to minimum wage and to require that the city contractors pay the minimum hourry Compensation Rate to employees who perform any work funded under the applicable contract with the city. For item 9 section 724. 1, the temporary street space occupancy permits in connection with tree maintenance by the Greater Rincon Hill Association within that Community Benefit district, also known as the east cut Community Benefit district, and item 10 suspends item 18478 for 100 banners be placed on cityowned utility poles by the Filipino American arts exposition publicizing the pistahan festival and parade. Clerk item 11 is an ordinance to add provisions to administer the early care and education commercial rents tax to increase the payment required to obtain an extension of time to file business tax returns and to make other nonsubstantive changes. President cohen passed. Next item. Clerk item to urge Kaiser Permanente to protect messenger driver, parking attendant, licensed vocational nurse, and Department Secretary employees from being outsourced. President cohen thank you. Supervisor safai . Supervisor safai thank you, i want to thank my supervisors for supporting this resolution, and basically my concerns has always been whether our Union Workers will be protected, which is why i first agreed to sponsor this resolution. Since then theres been some movement in terms of taking care of certain employees of kaiser, and i met with kaiser representatives yesterday, and i guess we had a discussion about whats happening with the workers that are impacted, in particular the workers in San Francisco, and they laid out their agreement and how they would handle the workers. They want to theres 15 employees that are either drivers or parking attendant folks, and they are right now under seiu, and kaiser wanted to contract that out to make it more flexible in terms of services, and one of the main concerns i have with that is, what do you were going to lose union jobs, and they assured me that the company that they are going to work with is a union shop, and, in fact, i confirmed that with the teamsters who are the bargaining unit for that company. And so we wouldnt be losing necessarily union jobs. Now, what happens to these workers, do they get would they be able to get the jobs back from these companies from, you know, moving from kaiser employee to be this companys employee, and there was assurance that they would, and, in fact, that they wouldnt be starting at a beginning rate, but actually would be grandfathered to whatever they are making now. And the rates themselves in terms of starting rates, i believe they are one cent apart. The other option that these 15 employees would have, my understanding from kaiser, is that they would be able to work if they didnt want to leave kaiser and wanted to continue with kaiser, kaiser would help them look for positions within kaiser that would be similar. And they would have about a year to get that done. So theres a guarantee oneyear pay, place of benefits that will roll over for a years, so given my understanding with this, they follow up with a letter that i think i pass it out to some, if not all of you, a letter from kaiser confirming what we just spoke about. I wanted to make sure that we heard the same thing, and the letter does say that given that, and elaine, my main concern is were going to lose union jobs in San Francisco. Im willing to at this point table this item. Now, there are some outstanding issues in this. For San Francisco issues, for me, they are taken care of. Theres other positions throughout california that might be impacted. I dont know the specifics of that as much, but for San Francisco, you know, i think were fine, and i really want to urge kaiser to take care of the rest of the other impacted employees in california like they did with the employees that they have in San Francisco. So if the i hope that my cosponsors dont mind, but id like to table this item. President cohen thank you, supervisor yee. Supervisor safai . Supervisor yee we just heard the gardeners are also being outsourced and we got a number, have gotten feedback from them. A lot of them are San Francisco residents, they are not covered in this particular resolution you put forward, and i know this is kind of an evolving situation. I just wonder if youd be open continuing this item for one week so we can continue conversations with them to understand the situation with landscape. I think you were there, three or four of them had just found out after the resolution was drafted, so if youd be open, i would request a continuance for one week so we can continue conversations as it pertains to the gardeners and how they are being impacted. And those are also significant number of employees, San Franciscobased, as well. President cohen supervisor peskin supervisor yee, before you answer, hear from supervisor peskin first. Supervisor peskin thank you, i just want to second the makers motion to table the subject resolution, and as to the issue that my colleague from district 11 just raised, obviously, the item that is before us does not speak to that, it only speaks to lvns and parking attendants and secretary employees being outsourced, so its probably just as youd probably open that back up to Public Comment, so i think a new resolution to that effect would be in order, so i would support the motion to table, and i see the deputy City Attorney nodding his head. In affirmation of my comment. President cohen thank you, supervisor peskin, and City Attorney, deputy City Attorney is in agreement, so supervisor safai, if this is something that interests you, youll have to draft something and it will go through the normal process. Supervisor yee supervisor safai, i would be supportive, if you were to come up with a resolution, but i agree with supervisor peskin that the item that youre talking about or the issues that youre talking about wasnt addressed in my resolution at all, so i didnt want to mix it. Clerk amend the modified use fees in Film Production to expand the Film Rebate Program to 2028 to authorize the funding cap for the film rebate project account from 4 million to 13 million and add administrative penalties for violations of requirements for Film Commission programs. Supervisor stefani this extends the sunset date of the San Francisco Film Rebate Program and currently the Film Rebate Program sunsets in june of 2019 and is capped at 4 million. These amendments will actually extend the sunset date through 2028 and increase the program not to exceed amount to 13 million. Weve continued this program several times over the years because of its success and ive worked on it several years with supervisor mark farrell, and its a program that really strengthens San Franciscos draw to film and television and provides local economic opportunities. Continuing this program is vital to keeping San Francisco competitive in the film and Television Industry and really provides good unionpaying jobs. And id like to thank the rules and budget finance committees for passing this out with positive recommendations, and i also want to thank susanna robins, who has been instrumental in leading the Film Rebate Program. Clerk item 14 is a resolution to improve a 2011 lease and use agreement to conduct Flight Operations at the San Francisco International Airport between Thomas Cook Airlines limited and the city. Clerk resolution to retroactively authorize the department of the environment to accept and expand an approximately 199,000 grant from the California Energy commissions alternative and renewable fuel and Vehicle Technology program to develop any electric vehicle ready blueprint to accelerate regional vehicle electrify for the period of july 1,2018. Clerk resolution to authorize the lease amendment to extend rentable space at 25 van ness lower level to the new Conservatory Theatre Center for a Monthly Base Rent of approximately 8,000 for a total annual based rent of approximately 96,000 through september 30th, 2023. Authorizing 1. 3 million in grant funds from the Governors Office of Emergency Services for the county Victim Services program through december 31, 2019. Item number 22, authorizing accept and expend with an authorizing of inkind gift from the urban institute for data analytic and research support, and item 23 authorizes accept and expend for 150,000 inkind gift for code for america, a pilot for new approach to automate criminal record expungement for eligible convictions. Clerk item 24 is an ordinance to establish a process for review by the Building Inspection Commission of legislation proposed by the board of supervisors and to affirm the determination. Clerk item 25 was referred without recommendation from the land use and transportation committee. President cohen supervisor peskin. Clerk the Affordable Housing act on the november 6, 2018 ballot and reaffirm the citys report of appeal of the costahawkins rental housing act. President cohen thank you very much. Supervisor peskin, floor is yours. Supervisor peskin thank you, madam president , colleagues. I want to thank you for your indulgence. I think this is the third time this item has appeared before the board of supervisors and is very consistent with a previous resolution that this body passed in support of Assembly Bill 1506 authored by Assembly Member david choo, which would have repealed the costahawkins act at the state level. As we know, ab 1506 couldnt get out of committee in the state assembly, and a broad California Movement then turned to the Initiative Process and qualified proposition 10 for the ballot, and i thought it appropriate that San Francisco, that adopted rent control in 1979 be on record in support of proposition 10, which is on this novembers ballot. And i want to thank the members of the land use committee, who listened to plenty of testimony on the resolution, which is before you, item 25 today, on our agenda. I am rising to make an amendment, specifically to remove items 11 and 12 on page 3 of the resolution, as well as the clause and or Single Family homes at lines 13 and 14, and i do so, obviously, this is a nonbinding resolution, but i do so because i think it is a conversation we should not restrict ourselves from having, should proposition 10 pass. There are 125,000 singlefamily homes in San Francisco. As we discussed at the last board meeting, obviously, rent control does not apply to an owneroccupied house, but there are many homes that are rented out, and i think that we should at least be able to have a conversation about how to appropriately, if at all, think about rent control solutions and everything should be on the table in the middle of the housing crisis that we find ourselves in. I want to point everybody to the study commending proposition 10 as one of the quickest things that if local governments have the ability to use would positively impact rents and Community Stability in San Francisco and the state of california, and with that i would like to make move to remove lines 11 and 12 in the clause and lines 13 and 14 that i mentioned. Supervisor yee question i have is, in looking at the amendments that you would like youre introducing, it crosses out the word on line 13, page 3, and or singlefamily homes. If you were not to cross it out, im trying to understand it better. You dont cross it out, does it mean that there wouldnt be any discussion . Seems like leaving it in there you would have a discussion. Supervisor peskin no, it does not mean that at all. It just means that we are not the previous clause says singlefamily homes should be exempted from rent control and then goes on to say that application of rent control in new construction and or singlefamily homes should be adopted only after Economic Analysis. I see no reason to tie the boards hands around that issue going forward. I mean, this is kind of all semantics in so far as this is a nonbinding resolution thats going to be voted on by millions of californians, but i see no reason to include those words that were put in at the committee level, and i think theres broad public sentiment that is expressed at least to my office that that should be removed. I think the first clause is very clear, which is a policy statement we want to exempt singlefamily homes, but youre asking should a singlefamily rent control be adopted only after an Economic Analysis, frankly, 61, half a dozen we did Economic Analysis when we did inclusionary. Not the end of the world one way or another. I would fight hard for the previous clause, but whatever the will is of this body and i would defer to my colleagues. President cohen thank you. Supervisor tang thank you. I think i agree with supervisor yee in his comments in that i think part of this discussion came up in land use committee, as well. I dont think it hurts the study, the singlefamily home issue, and whether you go that way or not, i think we should analyze it. I totally understand why youd want to take the previous clause out. That is fine with me, that well disagree on that point, but i would say, again, as per the discussion, i would love for the second clause words to remain asis, and i also, as has been stated many times, dont know that we as a policy body will actually be able to craft whatever local measure will pass. Certainly, i wish we could, but i think it will probably be in the hands of folks who will bring it directly to the ballot, so in that case, that is why i wanted to in committee put in lines 11 and 12 just given the district that i represent. Supervisor mandelman yeah, i guess as i sit here at this particular moment, i am not particularly inclined to think the city ought to be imposing rent control on singlefamily homes. I also think that whether or not this body takes position on prop 10, that is irrelevant to that, and i think that its not appropriate for us to be trying to have that fight about singlefamily homes right now, so i am inclined to not include discussion of singlefamily homes in this resolution. President cohen all right, thank you. Just as a point of clarification, you dont need a motion to divide the to divide this matter, this item. Is there any other discussion . Sorry, madam clerk, before we go further, i want to acknowledge supervisor safai. Supervisor safai thank you, president cohen. I agree, i think what we were trying to do is strike a nice balance. I think that part of the conversation is and this is not to tie into some of the conspiracy theorys as it relates to singlefamily homes, but its really about whats happening in realtime on the ground. There are existing people that are renting out singlefamily homes, who are concerned about that conversation about rents being adjusted and raised on those as a result of anything happening, so this is really an acknowledgment of people that are living there and also respecting the fact that we do want to move forward with the resolution to support proposition 10, so i would be in support of leaving in the language as it is proposed, as well. President cohen that last part you said you would be in support supervisor mandelman as originally written in committee. President cohen thank you. Supervisor brown . Supervisor brown well, if youre going to if we agree on leaving the language as it came out of committee, i just want to say, you know, i agree with that, because i support prop 10. I think it does untie our hands in San Francisco, so we can strive to address the housing and affordable not affordable crisis that we have in this city, and im concerned about any changes made to this legislation in committee that seek to tie our hands in the issue of singlefamily homes, even before we know the outcome of an election. From a process perspective, i think this type of carveout is wrong, and especially so preemptively, and i want to go on record saying that i feel strongly about supporting prop 10 as it came out of committee.
