The project before you is shadow determination for proposed fourstory, vertical addition, located within nc1 neighborhood commercial Zoning District and 50foot height district. Under planning code section 295, Building Permit application for a project exceeding a height of 40 feet cannot be approved if there is any shadow impact on a property under the jurisdiction of the rec and Park Department unless Planning Commission in consultation with rec and park makes a determination shah the shadow impact will not be significant or adverse. The existing nonconforming building enroaches to the rear yard and covers the lot. The building is not considered historic. The maximum density is three dwelling units based on the lot size and adjacent Zoning Districts. The project will add three familysized dwelling units to Housing Stock and preserve the existing ground floor retail space the proposed addition will result in a fivestory building measuring 50 feet high at the flat roof. The storefront will be modified and three residential units added above. Each dwelling unit will have decks to provide private open space, one parking space, and one bicycle parking space, located in the garage, which is accessed on frederick street. An environment evaluation application was reviewed and resulted in a ceqa categoric alex em shun determination for the Building Permit. The recreation and Park Commission adopted resolution recommending that the Planning Commission that the proposed project will not have a significant adverse impact on the use of Golden Gate Park for the following reasons. One, all new shadows cast by the project would occur in an area used as a parking lot. Two, all new shadow would occur in the morning with all shadows gone no later than 10 00 a. M. And, three, the duration of the proposed project generated new shadow would vary throughout the year with new shadow being present for maximum of 127 minutes and on average 104 minutes. The only other planning entitlement required are variances from the rear yard and active use requirements on the ground floor. The Zoning Administrator will review this project immediately following the shadow determination. 10 letters were in support to the project and 3 opposed, based on height and massing. Staff recommends that the commission adopt the shadow finding made by rec and Park Commission. The new shadow resulting from the project would not effect any recreation aal uses and would fl on the parking lot. This concludes my presentation. So 858 can we sorry. 858 stanyan is an addition to three residential units at the Northeast Corner of stanyan and frederick streets. Its a small neighborhood commercial district, centered around just this intersection. These images show you the before on the left and the proposed on the right. The commercial space at the ground floor is being redesigned to provide four times the transparency existing on the old american cyclery building and designed to be a storefront design that includes three familysized residential units, two with three bedrooms and one with four bedrooms, over four floors. The building is in scale with the neighborhood. This corner includes buildings between three and five stories. And these images show kind of the profile of the new building in that area the onestory building is the one thats significantly out of scale with the neighborhood. So were here today to talk about the shadow. Its an interesting process to go through a year of time where the shadow basically is amounts to 1 40,000th of a percent on Golden Gate Park. And the shadow is on the parking lot. So we think as the rec and Park Commission acknowledged that this is a minimal amount of shadow. This is from the report about the shadow, between 7 30 a. M. And 9 00 a. M. On october 25 is the maximum shadow and its off the site by that time. So its really kind of a diminimous amount of shadow, again, on a parking lot. So the variances are there are two. One is that section 134 requires that rear yards shall be provided at grade level for this nc1 district. This is unique because the other nc districts have rear yard can be at the first level of residential use. So thats a little bit unique. Again, the existing building is one story and covers the entire site. So the literal enforcement of this code section would require us to it would essentially require us to tear down 27 1 2 feet of the existing building. So this would allow for including theres an existing twocar parking garage thats there. So were expanding that to add one additional car and the three bicycle Parking Spaces. From the neighbors point of view, there is no different as to where that yard is located, as well as the fact that theres no impact to midblock open space because the area is not connected to the midblock open space. So the variance is in harmony with the intent of the code. It allows for three additional residential units. It allows for the required parking and an expansion of the transparency of the ground floor of the building. The second variance is about street grade parking, set back 25 feet. Any facade facing the street. This is particularly interesting because the lot is only 25 feet wide. So the literal enforcement would mean that were putting parking in the next yard. I started my career at park station when it was bombed, killing the sergeant on duty. And i was there when the old horse stables were converted to a community room. So weve come a long way. And towards the end of my career, i was four years as Commanding Officer at park station and i have seen improvements in the community and the neighborhood through projects like this and i wholeheartedly support this in the neighborhood. I pass this corner quite often, actually, on my bike and ive had a chance to look into this project and i think its exactly what the city needs. Were in dire need for family housing. I have my own comments to make and have Kristin Evans comments, president of Haight Asbury merchants association. There is a statement that hate asbury Merchant Association had attended a meeting about this project and thats not true. Furthermore, they advocate, much more than three units be built. Merchants have a great deal of trouble getting staff because they have to commute from the east bay. My own this is huge. An average size San Francisco lot, it could have 10 units on it. There should be at least six. The Planning Department has gone out of its way on other projects, at least i heard about at the lucky penny to say, more units, more units. Why not on this one . The only thing i can think of why you are accepting this is because of the arcane, old rule of one unit per 800 square feet of lot size. This is a perfect lot on a corner to put in more units and i, as a neighbor, and strongly encourage that at least six to nine units be put on this lot. I frequently pass by this building and this block and im excited to see a new use and more housing in the neighborhood in general. One thing that i would like to clarify before i say my final comments. There was the issue brought up of whether more units can be put on this lot. I would love the staff to address that comment. As i understand, the lot is zoned for three units, which is why three units are there. Please clarify. The property zoning and even when we look at the adjacent Zoning District to see if more units could be added as a benefit because of adjacent zoning, unfortunately, does not add any more units to the potential maximum dwelling count of three. Unless the project sponsor elected to the home sf program, there is no way to add more units. A. D. U. S are not possible either. Commissioner johnson generally speaking, im in full support of this project and would love to hear what other commissioners have to say. Commissioner moore i have been also thinking about the density thats being brought to this lot and my question is as to whether or not and im not speaking against this project but if this commission is prepared to start really talking about changes in policy regarding density and bringing sufficient units to a lot like this, is the issue. I believe that the nc1, 800squarefootper unit is backwardslooking, when were being pressured to bring units and sufficient density to sites like this. There is a huge issue. This project is trying to get something, allocation for shadow, and given the constraints in the nc1 zoning, it cannot really give back in any form or shape, nor can it do an a. D. U. So there are two major missed opportunities. The project on its own is a fine project. I do, though, question as to whether or not in this area, the dwelling unit size, 2,700 is the right mix given what we need. If you would take 6,400 square feet of residential space in this unit and divide it up differently, i think you could do well. I also question, though were not judging on that, as to whether or not the roof deck on the building next to Golden Gate Park is the right answer. Those are all questions that are kind of not in front of us unfortunately because weve been relegated to simply vote on the shadow and variance issue, as Zoning Administrator sanchez, across the room. I have questions, but i encourage the commission that we spend time with citywide planning and everybody else to look at these questions and start to really make some inroads of how we can look differently at these types of opportunity sites. Thank you. Commissioner richards im in full support of this project, but i think the policy question that commissioner moore raises is a good one. I would like to add that to the action item list for this commission to consider around den denseification in the socalled fringe areas. The only absolute number we have to work on on unit size is the average unit size is 1,600 square feet. Thats what staff tells us. Its the only thing we have. Were up here week in and week out. And when commissioner antoninni was on, we had 800 square feet per family unit. I have no idea. I know that 2,700 is less than 3,000 and thats reasonable, given the way were super sizing everything. I think we need it look at unit size and density moving forward. Before i turn it over to commissioner johnson, i would just say, i wholeheartedly support that. The Public Comment period closed july 27th and the comments and responses document was published and distributed on september 27 th, 2018. Since publication of the draft e. I. R. , the proposed project has been modified slightly. The revised project would have the same height and building footprint as a draft e. I. R. Project and therefore the environmental effects would result in the same impacts that were identified in the draft e. I. R. For all environmentalists topics. The revised project would not avoid the significant and unavoidable Historic Resources impact. The project level and cumulative construction related Transportation Impact on the cumulative wind impact. Therefore the commission would need to adopt a statement of overriding consideration pursuant to the findings of the commission choose to revised the findings. Andrew perry from Planning Department. This tree project before you is located on the west side of the intersection of otis and wall 12 th street at south van ness avenue. Is comprised of five parcels and in addition to being bounded by otis on 12th street at the front of the property, it also has frontage on chase court at the rear. In total, the site has a lot area 36,000 square feet. The project site is located within the downtown plan area and the market and octavia plan area and within that portion of market octavia. The proposed project would demolish the five existing commercial structures and construct a new 319,365 gross square foot mixeduse building. The second floor and above would be residential with 416 proposed units. Roughly 50 studios, 25 to one and unit units each. It would contain 2200 of grounds for commercial retail space and 60,000 square feet of arts activity space. The latter space is intended for the City Ballet School and is comprised of rehearsal studios, in addition to a theatre and Performance Space. The City Ballet School currently operates at the site on the sponsor has worked with the organization to find a temporary home during the construction phase of this project. The project would contain two basement garage levels, access of a single entry along 12th street and would provide 95 residential Parking Spaces, a ratio of 0. 23 and three car share spaces. It would provide 224 class one bicycle Parking Spaces not predominately located at the second floor level, however due to existing site topography, this is at grade level at the rear of the site thats providing a convenient and safe dedicated access route for bicycles. The project would provide a bicycle workshop room and additional Storage Space for large bicycles and other bulky items. The building massing is characterized by an 85foot tall , nine story podium across the entire site and a 250foot tall, 26 story tower at the intersection of otis and 12th street. The project would provide private open space in the form of terraces and balconies for one 07 of the units and additional 19,000 square feet out, usable open space throughout the building. Predominantly on the roof of the podium and including areas on the roof of the tower. In total, the project would provide slightly over 31,000 square feet of usable open space within the Property Line itself. The project intends to enter into an inkind agreement for the expansion of the sidewalk to create an approximately 7200 squarefoot public plaza at the corner of 12th street and south van ness avenue. Deposit will fulfil the public art requirement as well. The inkind agreement and details regarding the public arts will come before this commission at a future hearing date. The items before the commission today and the actions that must occur for the project to proceed are as follows. As julie mentioned, the certification of the final eai. Second, adoption of sequel findings. Adoption of a statement of old overriding considerations and adoption of mitigation monitoring program. Third, approval of a downtown project authorization with exceptions to requirements of ground level wind its coverage. In short, department feels that the requested exceptions are warranted and meet the requirements established in the code. The project requires adoptions of the shadow findings consisted just consistent with the general manager of the recreation and Park Department that the net new shadow cast by the project on the future park will be insignificant to the east of said park. Additionally for consideration by the Zoning Administrator, the project seeks variances from planning code for requirements pertaining to awning projections, ceiling height and exposure. The rear yard modification for a portion of the project and a height exemption for the elevator penthouse structures. Commissioners calculate find a letter of support from the project of the project by the City Ballet School. Staff is not received any other letters or comments by the public either in support or operation opposition. There Department Finds a project is consistent with the objectives and policy of the general plan and those of the downtown and market octavia plan areas. The project adds more than 400 units in proximity to downtown and robust and robust project transportation options. The estimated fee payment at this time would exceed 32 million. The project would pay an additional 3. 5 and 3. 7 million in a portable housing fees through that market market octavia in the van ness and market residential Affordable Housing market. The project is compatible with the neighborhood character and the changes envisioned for the area under the plans. The project incorporates a number of streetscape prevents most notably the creation of the new public plaza as was envisioned by market octavia. Good afternoon, commissioners we are proposing a 416 unit mixeduse project at 30 otis street. We have been working on this project since spring of 2015, working closely with planning staff on the design and meeting with neighbors about the project and its benefits. A major of the project process design and benefit has been well received by the neighbors where the 147 total supporters including 46 letters earned 101 signatures of support a major benefit of the project is the creation of a permanent home for the City Ballet School. The City Ballet School provides classic russian ballet training for youth and adults ranging from four years old to 90 years old. The foundation exposes City Residents and children to the arts through free tickets to performances and tuition assistance. The City Ballet School has been located on the project site since 2001. As part of the project, a line is proud to be building out over 15,000 square feet of new space for the City Ballet School including studios and a 227 person theatre for performances. We have worked with City Ballet School to secure a temporary location for the school over the next few years. Paying to build out a temporary space, covering relocation locations expenses, and helping with the rent. As a part of the project, we will have an inkind agreement with the city and we will design and construct a new 7200 squarefoot plaza at the corner of 12th and south van ness. We have engaged someone to design the prominent plaza and public art. She is a wellknown round well renowned architect. We look forward to presenting the design later to the commission. Thirty otis will provide for 16 muchneeded units and below the. 25 parking ratio allowed. We will pay over 30 million in impact fees to the city and provide a permanent home to the City Ballet School and foundation plus provide a large plaza through an inkind agreement. To begin with context, situating new threats within the urban fabric, the hub is undergoing a transformation. We need to look at stops on the ground but to the citys vision for a new pedestrian friendly neighborhood. For us, that hub is familiar territory. It has been located on brady street since 2,000. We know the challenges of the area but also see the potentials we intend to remain here for many years to come. We designed it is not working we designed the current home of the city ballet and we are their neighbors and friends. We have seen a positive impact of an involved Art Organization on a local community. We are thrilled to be designing their new home. This time as an integral component of the new 30 otis community. The city ballet will be a significant part of the neighborhood. Enter from the plaza, connected to the building lobby and adjacent retail. These connections will be part of an Overall Network of intersections, featuring other pedestrian spaces and a south facing outdoor space adjacent to the new bike lane and bus island this complexity incorporating a major cultural facility within a highrise structure. We have been careful to import urban design goals. Active spaces inhabit the street frontage is. The corner, extending the details of the tower from street to sky, is featured within a nine story podium which continues the urban street wall around the site. This corner corner emphasis provides focus to a new urban plaza which will anchor the intersection of two major streets and become an exciting new pedestrian space in the heart of the hub. Particular emphasis has been given to wind mitigation, projecting slabs, concrete cones with recessed glass at the lobby level and a fourth floor canopy all help to mitigate wind impact as mandated by the zoning, the towers located at the corner, with a nine story podium extending to the west and north. Stepping down from new taller buildings to the smaller existing structures. The facade treatments reinforce this modulation of scale. The Northern Edge of the site faces chase court. Here is the building that steps down forward it further. Courts and terry says allow scale reduction and allow sunlight to penetrate. The project previously approved features a 65foot Tall Building across chase court to. It will be a short stroll from the rear entrance of 30 otis to the new brady park. The building will connect to the adjacent network of alleys at a reduced scale. Returning to the corner where the building faces one of the largest intersections in the city, the emphasis is on the height of the tower, strongly reinforced in its role as an anchor with sufficient visual wait to draw out the i upward to the sky and connect to an important urban space at the street. The configuration of street level provides enhanced pedestrian interest along active street and plaza frontages. The Ballet School takes advantage of the grade change. Chase court is 13 feet above otis street. To maintain privacy for young students, while featuring a public plaza entry lobby for theatre patrons. As mentioned previously, the architect is working on the plaza design. This light demonstrates the potential for this plaza with the prominent entry for city ballet and its integration with other active spaces. Account to be, for floors up, reinforces the corner statement of the massing and provides a sense of urban scale and helps to mitigate the wind impacts. The view from Mission Street features a composition of elements emphasizing the scale of the corner, and announcing the importance of the urban space created at the corner, and at the same time, integrating nine story elements that connect it to adjacent buildings. Along otis street, active spaces will enliven and contribute to pedestrian environment already activated by the new bike lane and bus island. The variety of facade treatments and streetscape improvements will enhance the sense that this is a space where people live and enjoy neighborhood amenities. It is exciting to think that right here in the middle of the city we can create something new but still distinctly a San Francisco neighborhood. The material palette reinforces the massing approach. The corner curtain wall makes the connection from street to sky. The punch expression of the podium strengthens the residential strength of the building. They break down the scale and provide wind mitigation and integrate private open spaces. The color scheme is a mix and sophisticated neutrals, mostly light coloured like our city. The contrast between the sculpture of the projecting slabs in the flatness of the curtainwall will provide visual visual interest at a play of light and shadow which will catch the eye and at the same time, integrated integrate within this exciting new neighborhood in the centre of San Francisco. Training alone is not what makes it unique but it is the dedication and discipline that we learn intern that makes makes us passionate dancers. The love for ballet that i have is in great part due to the principles i have learned from, exceptional teachers, and students denied the privilege to dance among. Ballet has taught me sorry. Ballet has taught me to be the confident and resilient person i am today. From the classrooms, to performances, they developed talented dancers ready to take on the stage and the world. This new building will only make the arts stronger. They committed to drive to and a half hours one way every day so i could attend classes. Ballet has always been one of my Top Priorities and passions. And city ballet has helped that passion as well as my dance ability to grow. I left ballet for its beauty and grace and how it allows me to express my emotions. I started as a student at city ballet when i was seven years old and in the lowest level. Last year, i was invited to join the Preprofessional Division and i spent my waking hours at ballet than i do at home or at school. City ballet has set a major influence in my life. It is not just providing training in one of the most challenging art forms, it is equal parts artistry and athleticism, but it has taught me discipline, selfregulation, tenacity, resilience, and humility. City ballet has not just trained me to be a classical dancer but it has provided lifelong skills. It is likely i will have graduated and hopefully be dancing in a professional Ballet Company when the new studio opens. I am here today on behalf of all the young boys and girls in San Francisco who arent old enough to speak to you but who i hope will benefit as much as i have from this incredible training that city ballet provides. My name is john and i am a local San Francisco resident and a local Business Owner in San Francisco. I support the project. I wanted to make three key points. Im really happy with the project in terms of the transit oriented development. As a local neighbor, i really support additional density, especially near transportation. Also i applaud the team for working with the local communities. It is great to see these types of partnerships come together where developer can work with local groups such as the city ballet to find a win win situation and support the arts and its longevity. And thirdly, im really happy about the new plaza. Both my great grandma and my mom were professional ballerinas. And so City Ballet School has given me the opportunity to carry on the family heritage by training me towards becoming a professional dancer myself. Additionally, city Ballet Foundation has come alongside my family with financial support, making it possible for me to continue pursuing my love of dancing for the past eight years because of San Franciscos rich history of ballet, im exciting dash excited to see how this building will provide a place for the City Foundation and the ballet to continue to make excellent dance training accessible to future generations i urge your approval of the building plan. This is an Incredible Opportunity for the arts and i just feel fortunate to be in partnership with this group that is so supportive of the arts. They have paid for a home for us to be in and as you have heard before, there are some of our contemporaries that have left the city because it is just not viable to be here. It is very difficult in this economic environment. We have a unique opportunity to support the arts and make this a very real thing. Most of these kids travelled to russia with us earlier and studied there for a week at the old troy bolshoy academy. I am passionate about it and we want to support the art form. If anybody else would like to speak, line up on the screen side of the room. Hello. Obviously, i am supporting the arts. It is something i believe in very much. Having the Arts District expand anyway it can to provide more opportunities, especially for our young artists, is something we can get behind. I think that we have an opportunity here to be as creative as possible, as well. When we looked at the building for the housing for the conservatory of music on van ness, they did the most Amazing Design where, not only did they provide housing and practice based, but they engaged the street beautifully to really make sure that the arts were reaching the public and engaging the sidewalk and enlivening everything in the environment. So the issue here isnt do we want housing . Of course, we do. It isnt do we want strong support for the Ballet School . Of course, we do. It is how do we deal with this in terms of most creatively creating the environment that really is outward looking and provides the greatest benefit. We all know that many of the retail spaces in secondary and tertiary locations often go begging. In fact, they go begging in prominent locations. We have looked at other locations. Having a real groundlevel presence in the tone of what was accomplished with the conservatory of musics groundbreaking and excellent design, is something that could possibly be incorporated into the thinking here to make this a very worthy project even better. I spent almost every day at the studio. Between classes and rehearsal. And the community that is there, with the teachers and students, alike, is truly unique. Ballet is a thing that gets me out of bed in the morning. The thing that brings me joy. The thing that inspires me and makes me smile. When i entered the old studio at 32 otis street, i felt transformed and ready to take on any challenge going ahead for me i look forward to all of the experiences and opportunities that this new studio will bring. I know that this project will be a great addition to the city of San Francisco and the rising Arts Community in the neighborhood. Thank you to everyone who turned out today and we will open it up to commissioner comments. Commissioner moore this is a lovely project. It is exciting to hear this is becoming a cornerstone in the Arts District. It would not be better to package housing with ballet, obviously there is a question about affordability. There is on site that is a concern for the commission. I believe this particular part of the city needs Affordable Housing on site. That is my own thinking about houses and transforming. The second thing is i would like to ask if you wouldnt mind coming up to the microphone. I would like to ask a couple of questions about why is the Ballet School not becoming the seam of the building . And that perhaps goes handinhand with what is going on with the conservatory. Where really that particular function because becomes the theme. In this particular case, i feel like the Ballet School is relegated to the back door. It is a little bit too close to the garage entry and loading dock. Is there a possibility, i know you talked about changing the grade kahco to bring the Ballet School further to the intersection, further, visibly as a lantern, to the intersection at the seam of the building . It is a multipart question. Not to go to a team much around, but on the location of the loading dock and auto entry, we worked for quite a bit about the department and m. T. A. On that. It seemed at first we have many options but they became limited pretty quickly. On chase court, the neighbors really did not want to the intensity of vehicles. The streets are so narrow and the alleys are narrow there is no room for it back there. And then on otis, which was what we thought would be the ideal location for it, because of the interaction with the bike lane and the bus islands, that really became something we couldnt do. We configured those auto entries , the vehicle entries as carefully as we could and it seemed to work well from a traffic traffic pattern flow. Just to put that aside for a moment, that is why they are there. The Ballet School is a balance. As you have seen, there are a lot of Young Children as well as teenage and young adults. There is some sense that the studios themselves had some need for privacy. So with the location what we try to do is create something where the plaza and to the entry of the applause that would be a really dramatic thing and the plaza design that is not yet in front of you, i think it will become something very special. The location of the Ballet School at the northern end of the plaza where the plaza is much larger and wider, it really gives us a much better chance to create a cuing space out there. May be some informal Performance Space out there, adjacent to the ballet entrance. We havent completely finished with some of the signage things. I think we can give the Ballet School more prominence. I should also point out that the area of the plaza which is closer to the corner gets narrower. What is located there is a bar and cafe space, but it will actually
