Went disappointed and that ise way it goes. Im very disappointed. I fought very hard for them. I was disappointed with a number of rulings. So professor, whats if anything, does this prove about him, about the court as an institution, about the justices that he appointed . Well, first, its suggest that the framers of the constitution imagined and independent judiciary that did its own bidding rather than dancing to the tune of the president. Irrespective of that, i think its still early days to assume that the recent term appointees are not exactly of the character that he intended. That they are staunch conservative. Its early days yet and while the court has seen a number of quote unquote, victories, theyre not robust victories for progressives, they are often very narrow decisions that the aca case was a jurisdiction issue, it didnt broach the merits of whether the individual mandate was unconstitutional whether the entire aca had to be struck down. It was a jurisdictional decision. Although the court has posted a few winds for liberals, this is really early days and there is still more to come, and we have a big Voting Rights case that will be expected next week. We can see more of that conservative element in some of those really pivotal cases.
