>> no. vanished. >> sergeant ernst heard a detail that was curious. when the 911 call about the shooting came in, the situation immediately ring a bell with the dispatchers. >> greg mulvihill called the dispatchers earlier in the evening to ask advice. he received a phone call from an when a person stating that person was a private investigator and had some information. >> greg said the mysterious caller was a man with a deep voice who claimed to have documents that greg would want to see. he got the impression it was evidence that could be used against him in his custody battle against diana. the man said he would leave a package for greg to pick up. greg asked the dispatcher whether he should go. what was the response? >> probably not a good idea but it was up to him. >> and he went. this was the meeting spot. isolated dirt road near a power pole. greg asked his boss and neighbor jason to join him on this bizarre mission. jason told police around 11:00 p.m., they pulled up to the intersection of the dirt road. the sergeant and the detective took us there. >> the package was supposed to be taped along the power pole. >> greg carried a bicycle light and gave his friend a child's baseball bat, just in case. they walked along the path and looked for the package but could not find it. greg scanned the area with a slight but then noticed in the brush. >> he sees it's a person laying on the ground holding a rifle. >> that's terrifying. the man appeared to be wearing camouflage. greg or jason yelled gun or maybe run. >> they turned into back towards the car. that is when mulvihill was shot. as they are running back, they are hearing multiple rounds whizzing past their head. >> they got in the car and took up but then greg realized how badly he was injured. he pulled over and jason called 911. greg mulvihill was being hunted but he did not know the trap he was walking into. >> correct. nor who was sending him. >> greg survived his injuries. >> he was in the dark and didn't have any idea who would do this for anybody he could think of that would do this. >> greg did say he was nearing the end of it custody dispute with his wife but quickly dismissed the idea that she could've played any role in what happened. >> she's not the type of person. she couldn't be involved in any way. >> police paid a visit to diana, and she had no idea who shot greg. >> there's nothing in his history that would've led us to believe he was involved in criminal activity or any of his acquaintances would've done him harm based on activities he was involved in. >> didn't have secrets from his job? >> it was diana lovejoy. >> diana lovejoy, greg mulvihill's soon-to-be ex-wife. is this a smoking gun getting this photo? of diana lovejoy? >> it points us in a direction but there's more to be done. >> the team searched for more evidence and diana's home. >> we located the clothing she was wearing when she purchased the phone. >> they had enough to arrest diana and bring her in for questioning. at first she denied involvement in the shooting. what's her alibi? >> she was at home and never went out. >> police realize you might be telling the truth just because she bought the tracfone doesn't mean she was at the crime scene. diana was most likely not the person lying in the grass in camouflage with a rifle. >> fair to say. >> did you ask if she hired someone? >> he gets in the car and states things went wrong, and i had to shoot. >> did she say her reaction? >> she didn't know what happened and she did not ask anything else. >> that was diana's story. she hired her shooting instructor to intimidate greg, but that was it. now, police had another suspect. weldon mcdavid. his wife leo was home with her newborn baby when the phone rang. >> i answered the phone and it was wet and they told me to come out of the house with the baby. >> did you have any clue why they were there? >> no. >> they were there to look for evidence that weldon shot greg mulvihill. >> the most striking thing is he had guns everywhere. >> san diego county deputy attorney said they found a number of guns in the house but none was connected to the crime. then, hidden in the garage. >> they found the upper portion of an ar 15. >> noticed there was a suppressor or silencer attached to the weapon and a bag that catches shell casing so they don't fall to the gown -- ground. >> it had spent shell casings and that. the same number of shots of fire that night in carlsbad. >> you think you found the weapon. >> without a doubt. >> but lea had plenty of doubts. >> he has the skills to do that but he does not have the personality are hard to do that. >> police arrested weldon and at the station he initially denied everything. >> a gentleman was shot. i asked for your were? >> what location? >> rancho -- >> i don't know that location. >> when police told them they had potential dna evidence that would place him at the scene, his story suddenly changed. >> i have a feeling i'm being set up. >> by who? >> i know one being set up. >> who setting you up? >> the prosecutor did not believe weldon had been framed exactly, but set up? in a way, yes. remember the horrible allegations of abuse that diana made against greg that he molested her and their son? they believe she fabricated them. >> all the therapists, physicians, everyone involved made the determination there was no truth to it. when the court system did not believe her, she decided to come up with a way to have him killed. >> the prosecutor said that's where weldon came in. the self-styled protector, a man primed to react to the exact type of allegations diana was making. >>, got. step. >> remember what weldon said when he heard crystal's recording of her husband's abuse? >> i really wanted to kill him. >> the prosecutor believed diana believed he could get rid of greg. >> i think she saw in weldon the exact kind of person she would need to carry this out. it is somebody who has a hero complex and she needed somebody she could manipulate. >> the prosecutor learned something is. diana admitted she has slept with weldon. >> i think she used her sexuality to get him to do what she wanted him to do. >> september 12, 2016, weldon mcdavid and diana lovejoy were both arraigned on charges of attempted murder and conspiracy to commit murder. was diana a criminal mastermind who manipulated weldon? >> no. >> did you molester boy? >> no. >> he said he fought hard for custody of his child and did not want to risk losing this way felt compelled to see whatever information the mysterious caller had for him. greg demonstrated how he was holding the parade bicycle light when he noticed what he thought was a pile of clothes in the brush. >> for a second, i realized i was looking at a barrel and scope of a gun. >> and then a gun shop. >> it felt like i had been hit in the back which was confusing to me because i knew i was looking at a gun, but it felt i was hit in the back. >> in the confusion, greg said he or jason yelled run or possibly gun. >> while we were running i heard six more rapid gunshots. >> the prosecution argued diana paid weldon mcdavid to kill greg that night, and it seemed weldon may not have been the only one diana approached with this goal in mind. there was an unlikely witness against diana, a woman who reluctantly shared her story with prosecutors. her own aunt diana clark. >> diana said they made a promise not to tell my mom or sister. can you promise me that? i said yes. >> aunt diana testified that on christmas day 2015 her niece asked her this. >> she said, can you help me find someone to kill greg? >> she did not help her niece find a hitman. instead, the state argued, diana lovejoy found weldon mcdavid. when it came time for the defense to make its case, he was the star witness. >> you talked about -- >> according to weldon, the only plan was to gather information for diana. >> how much was she going to pay you together information? >> $2000. >> weldon city called greg from the burner phone claiming he had evidence he had abused his child. the idea that if greg actually showed up at the location, that proved his guilt. weldon plan to record greg so diana could take that information to court. >> anybody who's not guilty of child abuse, in my mind, would not come out to meet someone to pick up any evidence that they didn't know where it came from. >> he said he was planning to fire any shots until he claimed he heard one of the men say, i've got a gun. >> as soon as he said those words, i decided i had to do something. >> weldon city aimed his ar 15 at the flashlight and fire. he said he hit greg by accident. >> the shot i missed was the flashlight. >> weldon's proof it was not intentional? he said he was such a good shot that if he had been shooting to kill, he would have. >> i didn't miss a man sized target. it would not happen. >> in a well-meaning way, he came up with a stupid plan and brought a gun. >> he is the former attorney of weldon and didn't represent him at the trial. he believed weldon acted out of a misguided hero complex but never plan to kill or even hurt greg mulvihill. he said he thinks weldon's experience with crystal harris had a profound impact on him. >> that was the first case worry he said no one was listening to the woman and the woman was born to be correct. now, he has a second woman saying nobody is listening to me. what do you do when nobody else wants to help?
