right now here is the sunday show with jonathan capehart. donald trump ramps up his post guilty verdict tirade warning that if he is sentenced to prison, that could be a breaking point for americans. the maga republican allies are demanding retribution and in a new interview stormy daniels weighs in on what should happen to trump. disorder in the court with major decisions on trump and january 6th coming up. justice alito is resisting calls to recuse himself. i will talk to jerry nadler, the top democrat on the house judiciary committee about it. and let's make a deal. david ignatius talks about the israel-hamas cease-fire plan. it was drowned out. this is the sunday show. donald trump's 2024 campaign has been light on policy and heavier retribution. now, his conviction is taking revenge to a new level. after two impeachments, four criminal indictments and lawsuits, he has a lot of payback to plot. is not so secret weapons are the republican party and maga followers. the fan base has been trying to expose the home addresses of the new york jury. those threats are popping up on the same platforms where the capitol insurrection was once plans. just as before he has done nothing to discourage violence from his supporters. instead he said today that while he would be fine with going to prison, the public might feel differently. >> i am okay with it. i saw one of my lawyers the other day saying, oh no, you don't want to do that. i said that's the way it is. i'm not sure the public would stand for it. i think it would be tough for the public to take. at a certain point there's a breaking point. >> he's also enlisting lawmakers in his revenge. starting with the chaos caucus. jim jordan has act has asked alan bragg to appear before the subcommittee. he waited less than 24 hours after trump's conviction to summon the da. and alvin bragg will not be the only prosecutor that the gop will pursue according to mike johnson. >> we will look at special counsel jack smith, who we believe is abusing his authority. we have mechanisms to get control of that. we will be doing that within the confines of our jurisdiction and i think it can show the american people we are not to tolerate this. >> then there are the senate republicans. apparently they are so incensed by his conviction that they cannot govern. eight senators have vowed to oppose any democratic appointees or major legislation claiming president biden has made a mockery of the rule of law. that is rich coming from the same cast of characters who stand by as their own party's presumptive nominee treatment of the judicial process is beneath contempt. some of these folks, marco rubio and j.d. vance, nothing says mockery of the rule of law more than threatening retribution because the scales of justice don't tilt in your anti-democratic direction. joining me now is congressman jerry nadler of new york. he's the ranking member of the house judiciary committee. thank you very much for coming to the sunday show. republicans say that their efforts to undermine the conviction is about respecting the rule of law. your thoughts. >> it is exactly the opposite. the rule of law is respecting the decision of the jersey. the rule of law is letting the judicial process play out. the moment that alvin bragg announced the grand jury indictment -- i forget when it was, jim jordan convened a hearing in new york of the judiciary committee for the purpose of dumping on alvin bragg. and now he's saying the weaponization subcommittee will call him and all because he secured a conviction on a mountain of evidence by 12 jurors. people are trying to threaten the jurors and the republicans and house speaker threatening the justice system. this is an attempt to up and the justice system of the u.s. it is an attempt to say you cannot prosecute president trump because he's above the law. it's a terrible threat to free government in the u.s. >> this is not the first time that jim jordan has used the judiciary committee to target trump prosecutors. how do you expect his invitation to alvin bragg to pan out? >> he may even cite chairman jordan's refusal to obey the subpoena of the january 6th committee. this is way outside the jurisdiction of the house committee to investigate a local da. >> meanwhile, you are leading an investigation into samuel alito's potential bias. what information are you requesting? >> the question is not just -- it's also justice thomas. even if you believe everything that justice alito said, that he knew nothing about the flags and he never knew about it. a judge is required to avoid the appearance of impropriety. same for justice thomas. given his wife's role in the january 6th insurrection, he should be recused because of the appearance of anything to do with the cases. if this were any court other than the supreme court, the binding rules of ethics would force the recusal. the supreme court has a not biting ethics code and they should recuse themselves, and if they do not, they are showing their unfitness to be supreme court justices.>> jamie raskin suggested that the justice department could ask the other justices to require justice alito and thomas to recuse themselves from the trump immunity case. how realistic is that? >> i think the justice department should request it. whether you get a majority of the supreme court to agree with that, i don't know.>> one more question. trumps extreme rhetoric has only intensified since january 6th. what do you do or what you trying to do to prepare for the possibility of political violence the selection near? >> well, there may very well be political violence. the former president is in fighting it. every time you see the republican senators or congressmen go on tv and they say, if it is fair and they are inviting violence. justice department has to be prepared to enforce the law. there's something else can't say. have to be prepared to enforce the law against any violence and this time, unlike january 6, understand that there may very well be and prepare in advance.>> thank you very much for coming to the sunday show. joining me now is harry litman. he's a columnist for the l.a. times and host of the talking feds. one of trump's attorneys had this to say earlier today when talking about the former president's conviction. spoke with respect to sentencing, working to vigorously challenge this case on appeal. i don't think he will be subject to any sentence whatsoever. >> what is your reaction to that? >> there is an actual legitimate point or a practical point. whatever sentence judge merchan gives to trump, and there's reason to think it would be justified and they will give a sentence of a few months for these crimes. he will not incarcerate him before the appeals process. so we are talking about a year and a half or two and that is a millennium in american political time depending on where trump is.>> cy vance suggested that the sentencing date days before the republican convention means he is unlikely go to prison. given your answer just now, you agree with that assessment. >> i agree it is unlikely he will go to prison in 2024. there are many people saying this kind of a crime you never go to prison for. that's not true when you consider all of the conduct that he is doing to destabilize the system and be unrepentant and the other conduct with his conviction of the trump organization. i think we will see a couple of months. but they will permit him to pursue his appeals and that will take longer than november of 2024.>> we are still waiting for the supreme court's decision on his presidential immunity claim. which way do you think they will rule?>> i think they will find, based on the way that the wind was blowing, and this will come down in the next 3 to 4 weeks, i think they will find some kind of cases in which immunity from criminal prosecution is justified. that is worrisome in terms of nobody being above the law. but in terms of the january 6th prosecution, it could have the result, especially if there is a remand that the case will not proceed to trial. this most important and righteous of cases will not proceed to trial before november. >> once the supreme court weighs in, how soon could the election interference cases in washington and georgia go to trial? >> the significance is that this plan could mean and and to the war that has been a nightmare for israel and has been a nightmare for palestinian civilians. it's a pathway to terminating the conflict. what is going on now is that joe biden is trying to force benjamin netanyahu to decide whether he's a member of the war cabinet that signed off on this deal or if he is a member of a right-wing coalition, of some members have said they would leave the government and bring the government down rather than accept this deal. by forcing him to make the fundamental choice, i'm not sure we know how he will make that choice, but it's a fascinating and tough-minded bit of diplomacy by the white house. put it on the deal put the deal on the table and say which side are you on.>> john kirby said that the u.s. expects israel to accept the proposal if hamas does. will that happen? >> hamas has been the biggest mystery. their military leader, it's widely thought, it is expected that he will die at the end of this conflict. he's not someone to negotiate a surrender. he wants to negotiate a victory knowing that israel will pursue him no matter where he is. there is pressure now on hamas to accept this deal. i would be pretending to tell you how he will decide. the most important question is how netanyahu will decide. accepting this deal will me breaking up the government.>> given that, what do you expect benjamin netanyahu to do? one of the reasonings has been he's been pushing so hard on this and keeping his government together that it's to keep himself out of jail. do you think those domestic political and personal considerations could get in the way of a vital cease-fire deal like this? >> i have known him for more than 40 years. he's the ultimate political survivor. he would like to remain israel's leader. what he wants to say to israel is that we won this war. and victory is a going to come with the signed document or an unconditional surrender. now it is finessing the terms under which the war would end. there is a roadmap for ending it. what are the terms and how to see presented to the israeli public broadly, but more specifically members of his own coalition.>> let me ask you one more thing. it has been a week since an israeli military strike killed 45 palestinian and where did others. benjamin netanyahu called it a tragic mistake. is that an acceptable excuse?
