election case and fighting his gag order in the hush money trial. plus evan dershowitz has now spent one full year in a prison. what the biden administration is doing to bring him home. then, rebuilding baltimore's key bridge. the cleanup is just beginning and so was the fight over federal funding is the 11th hour gets underway this friday night.rs b good friday evening to you. we are now 221 days away from the election, and it has been another busy week for republican presidential candidate donald trump, but not on the campaign trail. he is managing four upcoming criminal trials plus dealing with massivem mp financial penalties and multiple civil suits. today, his attorneys continue their flood of pretrial motions and challenges to delay the process. in georgia, trump is appealing the judges decision to let the a fani willis stay on the case now that the prosecutor she had a relationship with has stepped down and in new york,e his lawyers are challenging the partial gag order in the hush money trial. the judge in that case has been the target of several trump attacks on social media. just this week alone, trump is also gone after the judges daughter, who has no connection to the case whatsoever. today, the d.a. asked the judge to clarify that trumps partial gag order applies to family members of the court. the d.a. and all othersngne tapers ur me gag order and it was those attacks from transit lead to something incredibly rare, sitting federal judge going on national television. u.s. district judge reggie walton thought it was important to explain why what trump is doing is so dangerous for all of us. watch. >> it's very uddisconcerting to have someone making comments about a judge and it is particularly problematic when those comments are in the form of a threat, especially if they are directed at one's family. i mean, we do these jobs because we are committed to the rule of law and we believe in the rule of law and the rule of law can only function effectively when we have judges who are prepared to carry out their duties withoute le the th of potential physical harm. if we don't have a viable court system that is able to function efficiently than we have tyranny, and i don't think that would be good for the future of our country or the future of bl democracy in our country.y tut >> judge walter noted that his daughter has also been threatened in connection to a case he was involved with. he also said that threats against him used to be very rare, but since he began prosecuting or presiding over cases related to january 6, they have become much more common, and with that, let's bring in our leadoff panel. john allen, senior national politics reporter for nbc. barbara, tt, andcos ha, g co veteran federal prosecutor and former u.s. attorney for the eastern district of michigan and her new book, attack from within, how disinformation is sabotaging america is out now. barbara, i will start with you in these public comments from reggie walton. first, give us some context from what it means for a sitting federal judge to speak out like this in this manner, and what do you think of what he had to say about what him, his family and other judges are experiencing, all because of the cases they are taking? f >> well, judges traditionally think of their comments is coming only through their orders. now, they are typically pretty loath to make public comments about any particular case, because they don't want to suggest anything other than impartiality, so i think it isk quite extraordinary for the judge to be speaking out here but i think only judges know what their experiences are like in the kinds of threats they are gettingao on how new this phenomenon really is. we can look at some examples of judges who were on the receiving end of threats to their lives. there was a judge in new jersey whose son was killed with all it's meant for her. there was a judge in chicago whose husband and mother were killed by someone looking for her, so these threats can be very dangerous, and i think the fact that the judges choosing to speak out, keep in mind this is a judge appointed by republican presidents, both ronald reagan and george w. bush, and so for him to be going out there, this is not a pro republicannd pro-democrat type of a comment. this is a comment about the state of our judiciary and the rule of law. >> speaking of that, eugene, donald trump has publicly attacked so many people over the last nine years it is stuff we cover on a regular basis. he has never faced any real consequences for those verbal attacks,co and that has obvious been devastating to the state of political discourse in this country because it is really set new parameters, created a new culture where this seems to be acceptable for some people in trumps circle.usrs what does it say about our justice system that this judge is now publicly raising this alarm? >> well, it says that this is an issue that is worthy of attention from the highest levels in our country. there has been a report that came out this week from reuters the sense since 2020, attacks on federal judges have more than doubled. since 2015, they hear that former president trump ntr ekncs launched his first presidential campaign, that number has more than tripled and you've seen republicans in the judicial system come out and say they believe in this because in part, the norms that have now been set by donald trumpt th tp have not seen many republicans on capitol hill, if any, come out and say this is something that needs to stop and if it does not, we could expect it to continue and there could be even worse consequences than some of those we have already seen, which have been quite severe, in some cases. >> barbara, you pointed out judge walton was appointed by republican presidents. the washington post points out that other republican appointed judges have spoken out about this. it is clearly not a democratic or republican issue at this moment, no matter what donald trump says or what he tries to portray it as, but what can be done, and is the fact that he has been given so much leewaye where he is not been held to account just for the rhetoric of what he is said about judges, clerks of the court, daughters of judges, family members of judges -- is that in and of itself unprecedented and dangerous that he is not held to account? >> yes. you know, historically you did not have to tell people not to make death threats about judges and their family members are not to say things that were likely to inflame the public such that they would become the subject of these kinds of threats so we have really crossed over into a new eraclth and donald trump is going to look for any loophole he can find in these gag orders. the one that was issued by judge mershon did not include the judges family, and sool that is who donald trump goes after. who is left? who is outside the scope now the judge can amend that order, and i suspect he will, to include the judges family to make the next go around prohibited but you know, donald trump will look for somebody else because judges have been careful to exclude themselves n the prosecutors from thesell gag orders to allow donald trump to criticize the prosecution and the judiciary in these cases but i do think the way to at least curtail some of this is through vigorous prosecution. you may recall that when merrick garland was asked to use attorneys around the country together their law enforcement partners and be sure to have a program in place to prosecute peopleumasus engag threats at school board meetings, health officials with election board officials and when he testified before congress, members of the senate cracked down on him, suggesting that he was violating the first amendment rights of parents and other people in communities. threats are not protected by the first amendment so we have to make that very clear here, that this is a serious crime and it threatens to affect the rule of law in this country so those people who give any serious discussion to this as if prosecuting threats is in any way violate of of the first henoreanlain absurd and obe enabling those who communicate these threats. >> took a big stories that are connected this week, the bond trump has to pay in the fraud case reduced to $175 million in stock for his social media platform, truth social, going public. the value of that public stock in the billions, even though the company does not really maka any money, and all of this against the backdrop of the clock still ticking for trump to post his bond. where do you see all of this heading? >> let me just go back for one second if you don't mind. i just want to say, we don't have to theorize about what the effect of donald trump's words are when he goes and attacks people. we have seen it. he's seen it himself.orha w he told his supporters that mike pence was the problem with the 2020 election and they went to the capital and chanted that they wanted to hang him. they sought out mike pence. they sought out lawmakers so this is not an obstruction or something donald trump can pretend he doesn't understand because the best argument for him on january 6 as he said something that people took him more seriously that t -- then h wanted. as far as what's going on with the reduction of bond in his truth social stock, it is a very good monetary week for donald trump. it could've been a very bad and it looks like he is going mpto significantly wealthier at the end of this tothan we might've expecteds . >> eugene, according to the washington post, some of the gop billionaire donors who backed away from trump after january 6th are suddenly rediscovering their support for him.io add make that make sense for us. what should voters be taken away from it? why are they suddenly pivoting to a guy that many had distanced themselves from for what we did on january 6 to suddenly embracing him in the span of less than four years. >> it is. -- pretty simple. t is tax cuts. ffo trump when he was in the white house put forward legislation that made things very lucrative for many of these billionaires and president biden hasinfo sla advanced legislation and laws that could see these individuals experience a decrease in their wealth, so despite being very upset inwith former president trump after january 6, or vocalizing that, you've seen a number of billionaires attend fundraisers and planning to attend the one the trump campaign is suggesting next week will bring and $33 million if trump ope thatr er gets to the white house, they can remain the billionaires that they currently are, and hopefully make even more money, something that is at risk if biden is to win the election. >> for the most part, trump has been able to choose when he wants to be in court, and once his hutch many trial starts april 15th, he will actually have to be in court a lot. president biden and the democrats are already out raising trump. they're definitely out raising the gop. what is this campaign going to look like when this trial starts in a couple weeks time? >>n g onals ar'rutn w you talk republican officials, senior campaign officials for trump, they said i don't need to raise as much money as biden in order to win this election. that's good news for them because they are not going to raise as much money as joe biden if things continue along this trajectory. once this trial starts you're going to see a lot of trump in court and some trump on the campaign trail, you know, see him on the campaign trail on the weekends and basically see one day a week or so of court not in session where he gets out and does some events. we're going to see surrogates out there for him in algntone t family members or other people closely identified with his brandon he's going to make the argument that the trial is impeding his ability to campaign. obviouslyot wdi some are going have less sympathy for that than others but we will see trump on the campaign trail. in some ways it benefits him because he does not like to be out there all that much and now he has a ready-made excuse. >> barbara, i will close this out with the same we opened with.he that is the outlook of the fani willis situation. is this appeal likely to go anywhere? >> i don't think so. first, we have to see a certification from judge mcafee although he has indicated that he will do that. i don't think this appeal is likely to either delay the case because it is not an issue of substance, it is an issue about the qualifications of the prosecutor, and i don't think it's likely to succeedthilpp an her removed from the case. remember that judge mcafee found there was no actual conflict of interest. what he found was the appearance of impropriety so he sort of went above and beyond d so nathan wade t should be removed from the case, so i don't see any success resulting here. i think this case is finally on track to go forward to trial after these motions get decided. >> barbara, eugene, john, thank you to the three of you for getting us started off this hour. when we come back, one year stolen.als reporter evan gershkovich marks 365 days in a russian prison. his crime, journalism. now he is being remembered for efforts to try and free him. and remember, one of the biggest selvage missions is underway in nd baltimore but as the cleanup begins, so does the fight over federal funding, the 11th hour just getting underway on a friday night. fting under on a friday night. do you have a life insurance policy you no longer need? >> we knew it was going to be a marathon but still had hopes. >> do you think they are doing enough? >> we have a commitment. we know they are working hard and just want them to continue doing. >> in a statement, president biden renewed his commitment to secure evans release adding we will denounce and oppose costs for russians appalling attempts to use americans as bargaining chips and we will continue to stand strong against all of those who seek to attack the press or target journalists, the pillars of free society. the wall street journal that point home with a 24-hour redesign of evans past coverage of the region because here's the thing, his reporting, his perspective on russia is invaluable. that is something his colleagues stress today on deadline white house. >> reporter: there are many times i think wow, i would really love to read evans reporting and insight. he is such a gifted reporter, and he is an american reporter raised with a russian heritage. his parents fled the soviet union and taught him how to speak russian and he has this amazing ability to connect russia and the west and help us understand what is going on on the ground in this country. >> a singularly unique talent and a stark reminder of what we are all missing, the paper left an entire section of today's front page blank with the headline, his story should be here. ambassador, it's great to see you. again, i hate that it is on this occasion but it is important that we have this conversation. evan's pretrial detention was just extended for another three months. is there anything more the u.s. could be doing to get him out? is this even common in russia, that a year-long detention, illegal detention shows the beginning of the trial date and nothing on the horizon? >> first, everyone needs to remember there is no rule of law in russia under vladimir putin. there is no rule of law, so what is common and what is not common, he decides arbitrarily and that is tragically what has happened with evan. and, it will be that day -- way for as long as he wanted to be that way and i think sometimes we get trapped, not us, but viewers and listeners think well, what about legal procedures, what about his rights? there is no rights for anyone in putin's russia today. this is purely at the discretion of the kremlin and he will be released when the kremlin decides to release him, not when a court of law decides whether he is guilty or not. >> is there anything the u.s. could be doing to increase the attempts of securing his release and some kind of negotiations or any other leverage they may have? >> they are certainly committed to it. they say it frequently. i'm glad they said what they said today. certainly, the biden administration has done swaps. they've done that before, and there have been released from time to time that might be true in the case of evan. most recently, putin himself even alluded to it in a press conference he was giving. he talked about a quote unquote russian patriot who it is actually an assassin. he went to germany. he went to germany and assassinated a georgian of chechen dissent, and putin alluded to maybe we could trade this patriot, in his view, for the american journalist. the problem with that, of course, is that he is a real killer. he is a real criminal and been held in germany, not the united states of america, so that very much complicates the story but it does not mean there is not something to be done. of course we won't know what is being done, because if we did, that gets in the way of private diplomacy, and i have something is being done to free him. >> you have worked within the system and understand russia better than most. what did this signal from the kremlin today about the need to have silence in order for negotiations to progress signal to you, if at all, anything? does it mean anything? >> well, they came close on some other deals before with other americans, including some that are still in prison with evan, and at one point, american officials were talking about it, and the russians said don't talk about it. let's do this deal behind closed doors, so that makes me cautiously optimistic that there might be something going on but did you notice they really put the emphasis on cautiously? these are very difficult things to do. what putin wants is not something we have to give, and i just think we need to be modest in our expectations about how easy it is to put one of these deals together. >> given the lawless nature of russian as you have pointed out, and as the president pointed out, putin making a habit of arresting americans whether they be basketball stars or wall street journal us, he takes them to use them as bargaining chips. should americans avoid russia now at all costs? >> i believe so. i know there are some very courageous journalists working there. i admire what they are doing, and i think it is important that we know what's going on inside russia. remember, that is why evan was arrested. he was a fantastic journalist. i've been reading journalist from the russia and the soviet union on my career. he was one of the best. that is what got him in trouble and that is the paradox journalists face. on the one hand, you can't do your job as well from lithuania or germany, reporting on russia. on the other hand, you face these risks, but no one should go to russia believing that if they get into some trouble that the united states of america or the ambassador to russia, my former colleague and friend, can get them out, because there is no rule of law in russia today. >> can you expand on that for us a little bit, the culture that exists in russia? the wall street journal wrote a headline, evan gershkovich loved russia, the country that turned on him. you live there, you left russia then you got sanctioned by the kremlin. can you explain a little bit of what that is like for reviewers? >> well, i share a love for russia. tragically most russian friends live in exile in one has been recently killed by this regime. what it is, it is back to the soviet days. it is actually worse than the late soviet days. i actually lived in the soviet union. putin fears anybody that has independent wealth, independent political power or independent information, and he is extremely paranoid these days. think about the election that he just ran. he removed anybody that was a slight challenger to him and then insulted, in my opinion, russian voters by saying he won 87% of the vote. that harkens back to the old days of the soviet union and that means it is extremely dangerous for anybody with independent thought but it also means people who love russia and have roots with russia, as evan did, are tragically, for him, in jail or for many thousands of others, living now in exile. >> yes, one year too long for evan and all the others being held in russia illegally. thank you for your time. we appreciated as always. when we come back, as if congress does not have enough to fight about, mother is a new battle brewing over who should foot the bill to rebuild the collapsed bridge in baltimore. we get into it as the 11th hour continues. the 11th hour continues. repair breath freshener. clinically proven to help reverse the four signs of early gum disease. a new toothpaste from parodontax, the gum experts. president biden is making good on his promise to visit baltimore after the catastrophic bridge collapse. today he confirmed he will be in the city next weekend he arrived just after the process to clearing the wreckage and reopening the port had begun. >> reporter: arriving at the site of baltimore's bridge collapse, the biggest floating crane on the east coast, able to lift 1000 tons for one of the biggest selvage missions ever, just part of a flotilla now en route, including the crane that lifted the miracle on the hudson plane out of the river. in all, seven floating planes, 10 tugboats, nine barges, eight selvage vessels and five coast guard boats. 8000 local jobs are waiting. >> we need to clear the channel an open vessel traffic to the port because the health of maryland economy in the national economy depend on it. >> on the water, the army corps of engineers is using underwater drones and sonar to map the precise location of the wreckage, then lay out a coordinated selvage plan for divers. >> how we can cut it up into the pieces we need to be able to lift. >> ntsb investigator still interviewing crew members and gathering evidence on the cargo ship, now trapped under the weight of twisted steel, a piece of highway lying on top. take a look at the bow of the ship and you see that piece of steel line across it. that is three to 4000 tons that is so heavy it is pushing the bow into the water, down into the bottom of the river and then it is lifting the stern up out of the water. below the waterline, the river death is roughly 50 feet. all of the debris must be gone, the sand on the bottom completely clean. >> what an incredible operation there. there is a ton of work to be done to get the bridge replaced, but before that can happen, the president has to convince republicans to fund the project in that battle, as you can imagine in this current climate, is just starting to heat up. executive director of the democratic state party and nbc political analyst and strategist are here to discuss this. there is not a surprise that this is heating up already. in fact, the hill reported that has been covering this had a really interesting quote from republican congressman ralph norman, which was basically, robbing peter to pay paul, and i find it very interesting that there is always a fight on capitol hill but this now is happening. >> yeah. i guess in some ways we should not be surprised because everything is such a fight on capitol hill these days but let's not forget we are the united states of america. i mean you talk about something needs to be done for the health of the countries economics, like you want to have money to spend -- >> why would republicans want to be fighting over this right now? >> because they just want to fight. that is all it comes down to. >> republicans are trying to pick up a senate seat. in maryland this does not seem like good politics. larry hogan and wildly popular governor actually has a shot but is about to be hamstrung by his fellow republicans haggling over how to pay for a new bridge, or even this cleanup effort. >> i think you said there were 8000 jobs, potentially and many of them, i would imagine, our union jobs, as well. it does seem to hamstring a candidate that could use this as part of the platform but you know, we are also at a time, and i have to say this, we are in a time when baltimore city's young african-american mayor had to go on tv to talk about the fact that he is essentially been called the n-word and been told that we are having to refute claims that because of his race is why the bridge fell. that is where we are in america and when you consider that kind of climate, it is no surprise that you have people in congress who should just, in a sort of knee-jerk reaction, fix this problem and go to the aid of a very important city in this country, not to mention the fact that there have already been stories about challenges with the supply chain because of this bridge collapse, and so if you have voters that are concerned about inflation, this is one way to actually address that issue that is fixable and maybe not the short term, but is fixable. why they choose not to do it or not to speak on it, is just a sign of the times. >> you bring up a really important point. for biden, he is confident he can sway some lawmakers. ♪♪ why won't scout play with us anymore? he has something called osteoarthritis pain. it's joint pain that hurts him all the time. come on, scout. now, there's librela. the first and only once-monthly injection to control your dog's oa pain. veterinary professionals administering librela who are pregnant, trying to conceive, or breast feeding, should take extreme care to avoid self-injection, which could cause allergic reactions like anaphylaxis. this is the best day of my life! “look at all those snacks, you must be a king!” “i did just pay 60% less for my ticket with the gametime app.” “it's the best place to get last-minute deals on tickets.” “i guess i'm just a better fan than you.“ "(crowd cheering) i've got to get the gametime app.” “download the gametime app to get great deals on last-minute tickets.” my predecessor failed the most basic duty any president owes the american people, the duty to care. before the state of the union, everyone, even democrats seemed concerned about another biting candidacy but you don't hear so much about that lately, at least for the last three weeks. president biden has stressed his political dexterity on the campaign trail, delivering his messages to key states and there is no one better to discuss this with than michael. it's great to see you. thank you for making time for us tonight. the state of the union was meant to be a reset for the biden campaign. it was meant to be a way to reframe the selection for what it really is about, a fight for our democracy. is that message crystallized in the president's remarks going forward? and continuing forward? >> i think absolutely because donald trump keeps on saying things that suggest that if you cast a vote for him this fall and i'm not in the business of suggesting that people vote one way or the other, but if you care about democracy and you hate dictatorship, remember that no major party nominee all the way back to george washington in 1789, has said elect me and i will do things like be dictator for a day, or i might suspend the constitution, or i might hit the defense department and justice department against my political enemies and a great burst of retribution, not to mention, in certain circumstances, disbanding nato and telling vladimir putin, our current enemy, go ahead and do whatever you want. i think people are beginning to see that joe biden is the tradition not only of every other american president back to the 18th century and george washington, but also because of that tableau we saw in radio city music hall where he appeared with bill clinton and barack obama. this is the candidate, if you had to design a candidate who exemplifies the traditional democratic party, it would be joe biden. this party brought america to the space program, medicare, and he is right in the center of his party. you can't say any of that for donald trump. >> to that point, president biden seems to be hitting his stride. there was some concern a couple weeks ago that the campaign was not taking the threat of truck seriously, but they have become very clear about that with the messaging, but then there are also others challenges which seem to be right now, the war in gaza, which presents itself as the biggest threat to his presidency yet. how do you see his presidency right now through that lens? >> it really depends on how this ends and how much he has done to obviously bring surcease and liberation of the hostages to the israelis but at the same time, this is tens of thousands of people being killed in gaza in a war that goes on and on, and now, against the will of joe biden, who has traditionally been israel's friend, people in parts of the united states that are particularly sensitive to the plight of the palestinians, as they should be, they will, i think, given joe biden's stance henceforth, they will think this is the guy who's going to tell the israelis they have to show some restraint. donald trump traditionally has not done that one bit. >> over and over, republicans are asking, and we hear this all the time in american politics, to ask americans to think about whether they are better off now than they were four years ago. you know, on this program and others we often ask you to reflect on much more distant history in our country, but just take us back four years ago for a moment. what do you think of republicans bringing this up nonstop because this time four years ago, things were not looking so good. >> absolutely. i think every day of this year, people should meditate on what it was like to live under donald trump four years ago. how did he do on the pandemic, the challenge that wound up killing over 1 million americans. in my view, trumps leadership, if you want to call that, he screwed up and caused unnecessary deaths in one of the great problems in american history. at the same time, the economy plunged and i don't think that even many republicans felt that donald trump was a steady hand at the tellers. the more the democrats can re- create that time and say that four years ago was not a happy time for most americans well, it was not exactly coincidental that donald trump was president. >> others have pointed out, perhaps the only one in america things today four years ago was better for himself is none other than donald trump, given all the challenges he is facing right now. >> always great to see you. thank you so much. >> when we come back, attest to one of our irreplaceable nbc colleagues from the 11th hour continues. lleagues from the 11 continues. shipstation saves us so much time it makes it really easy and seamless pick an order print everything you need slap the label on ito the box and it's ready to go our cost for shipping, were cut in half just like that go to shipstation/tv and get 2 months free here's why you should switch fo to duckduckgo on all your devie duckduckgo comes with a built-n engine like google, but it's pi and doesn't spy on your searchs and duckduckgo lets you browse like chrome, but it blocks cooi and creepy ads that follow youa from google and other companie. and there's no catch. it's fre. we make money from ads, but they don't follow you aroud join the millions of people taking back their privacy by downloading duckduckgo on all your devices today. after 12 years at nbc news, this man down here at the end of the couch, harry smith, is moving on. you have brought us some remarkable stories that stay with us forever, writing stories with such elegance and beauty that frankly, no one can match it and of course, delivering them in that unforgettable voice and being an amazing friend to us. we love you, harry, please don't leave. >> i woke up as a hospital in high school and there it was. i can take no credit. >> the last thing before we go tonight, wild about harry. today we say farewell and thank you to our beloved nbc calling harry smith. his reporting career began in denver back in local news in 1986. he joined cbs news where he spent 17 years, but for the last 12 years, he has been part of our family at nbc news, delivering heartfelt stories about everyday people, historical figures, and even a- list celebrities. the main thing he says he has learned over all these years -- there is more that unites us than divides us. on the today show today, this morning, harry took a look back at some of the stories over the past several years. take a look. >> oh, how lucky the kids in bynum, montana were who started each morning with dancing, then singing. do you think dancing helps you get along with people?
