make it arexvy. now, to one city to cases and a pivotal day for donald trump. he faces a monday deadline to come up with cash in the $454 million judgment. is expected to be in court in new york for hearing and has been a case where a judge can set a date to make him the first former u.s. president to face criminal trial. joined me now, barbara mcquade, former u.s. attorney and university of michigan law professor and msnbc legal analyst in host of the podcast # sisters-in-law. her new book is attack from within, how disinformation is sabotaging america. i am also welcoming josh gerstein, who is a senior legal affairs reporter at politico. good to see you as well. barbara, his lawyers are telling the courts he does not have the cash. trump is limited social media he has cash. $500 million in fact. he says he would rather spend it on his presidential run. meanwhile, trump has not spent any of his own money on his campaign in 2020 or 24. in this case, he is hoping new york appeals courts intervene. what kind of view with the courts take of these consistent statements? his a particular. >> donald trump is not helping himself by claiming he has $500 million when he says he cannot get up the bond for his appeal. the idea of an appeal bond is you can still appeal a case. with the bond does is it puts the money up so that the attorney general or opposing party that prevailed in the court below cannot start seizing your assets. the idea is to put in an escrow while the case were sent away to the court on appeal so that everybody knows if and when you lose your appeal, the assets will be there and will not have been dissipated. all of the effort to relieve himself of the duty of having to put up some sort of bond, especially when he claims he has the money, not sit well with the court. if he is not able to do that, is going to let the attorney general go ahead and put a security interest on his assets. >> barbara, him saying i do not want to use the money to pay for this, i want to use it elsewhere, has to not help him. >> absolutely. imagine a few oat debts and bills and you say i understand of the money, but i would really rather purchase a nice car and have fancy dinners and go on vacation. of course, you would object to that. a judge has made a finding that he owes the taxpayers of new york more than $400 million. we presume regularity with the judgment. and appeals court could tell us otherwise. letitia james has a duty to grab the money. whether donald trump would prefer to spend it on something else or not. >> josh, while trumps rhetoric has been focused on properties, here's what adam reese says is more likely. >> it is more likely we will see some type of attachment to his schwab accounts. he used schwab accounts to pay e. jean carroll. more liquid assets. something they are more likely to take then some of his buildings, which not only have lost value, but our leverage and are already encumbered. >> which means there is not a lot of money to get out of those buildings potentially politico says it could include frozen bank accounts, a sheriff at the door and maybe even a private airplane put up for auction. the judge making the call on all of this would be a judge trump has repeatedly assailed in the courtroom and in public, judge chutkan. how do you sort it out? >> obviously, trump and judge chutkan are not unfriendly grounds. trump must be quaking at the possibility of 220 making these decisions. saying letitia james may go after liquid assets are to be true in a more normal case it is much easier to take a bank account and try to start taking over real estate properties that you may have to sell. do not forget, a lot of his real estate parties have tenants or condo owners in them. it could be a messy process. that said, it is not a normal case i think letitia james will be looking for some sort of optically visible that is not overdoing it, trophy of some sort. we saw that move late last week for them to register the judgment in westchester county, making it possible that she could move against his golf course up there as one of the first attempts to satisfy the judgment. >> trump is expected to show up monday for the hearing and the hush money case stormy daniels met with 88 this week. she also appeared on abc's the view saying, she is ready for the trial she also said this. >> people think i did it for the money. what they do understand is as the >> of a documentary or 60 minutes, which is where just out the first time. i made zero. i did not get paid anything, but it cost me everything. so i wrote the book because i wanted to get a story out and relist a lot of people do not read i should amend a picture book. no, i should not have a. >> that was funny. barbara, should trump be worried about when stormy daniels testifies? >> she certainly has first-hand information in this case. she knows whether there were payments made. when they were made and why they were made and how they were represented to her. i think she is a key witness in all of this. no doubt she is not the only one. so often people try to frame one witness or another is the star witness in the case there are number of furnaces in this case who will be important. she no doubt is one. hearing her story under oath and >> to cross-examination in open court will be very telling . >> michael: as more than ready to testify. here's what he said earlier today on msnbc's the weekend to. >> people are afraid of him. judges are afraid of him. i have been yelling since 2018 when i said donald trump is a fraud. he is a con man. i was right when i said that if he lost the election in 2020, there would never be a peaceful transfer of power. i was right again. when i said he overvalued his assets and undervalue them for tax purposes, i was right again. why people do want to listen, i do not know. >> josh, could the hush money case turned out to be more damaging to trump that he might expect? >> i think it is possible. we have seen an effort by the da's office to reframe the case that you and the rest of us in the media so often call hush money case, as an election interference case. it does have to do with an effort of payments that took place at the height of the last few days of the 2016 presidential election. indeed, the central allegation in the case is that the reason those payments had to be made and the reason the alleged affairs had to be covered up was because it could do damage to him winning the presidency. this will all be brought centerstage. being in new york court and in state court, it will not be a camera. it will be a >>, to be sure, but it will be one told through sketches and perhaps a couple of photos of people going into the courtroom. not one with live television coverage. we will have to go see how it plays out. hanging in the back of everybody's mind is if the trial happens, it may be the only trial of donald trump that takes place before the november election. there is a lot riding on it. >> i like the point you make about the media having dubbed this the hush money case versus election interference. the reason he continues as hush money is because there are so many cases to keep straight in the public eye related to donald trump. it is how this one has become known. just a common vernacular and i agree, election interference is what it can be labeled as well. want to get your opinions and develops that development coming up in judge cannon's courtroom. her first ruling was overturned on appeal. there are open questions and rulings that automatically appear to reverse themselves. then there is the ruling on jury instructions that appears to t up trump for acquittal. legal scholars are calling it mind-boggling you are former federal prosecutor and what do you think is going on here? >> it is hard to know and i don't want to attribute to her any ill motives. the first thing she did in this case in the search warrant matter in august of 2020 was so far off the charts that i think people rightly saw some skepticism about her impartiality just because it was so unusual that it was immediately reversed by the 11th circuit. of course, she regained the case. some of the other rulings she has had may not have been what i would have done. they were not beyond the scope of her discretion. this order about the jury instructions is just bizarre. number one, the idea that we are talking about jury instructions right now which is a motion pending to dismiss the case under the presidential weapons act, it seems that she should decide the motion and then think about jury instructions. that alone is odd. the other thing about it is, it suggests she is leaning toward granting donald trump's suggestion that somehow the presidential records act is relevant in some way. the government's position is it is not relevant whatsoever and this is about espionage act. these are not presidential records there is nothing about them. or, they are presidential records and it was designed to prevent a president from taking government records and converting them to his own use. finally, it seems that she is asking the jersey to make a decision based on law, not fact. the judge is supposed to decide legal issues and the jury decides factual issues. whether he took these things or whether he had them or whether they relate to national defense. those are jury questions. whether he is entitled to rely on the presence of records act as a defense is a legal question she had to decide herself. for all of those reasons, it is an unusual order at this point. it is the reason people are questioning it. >> that is an interesting statement you made. i haven't thought of it that way. josh, you've been in the court where -- courtroom for the last three. what is your reading on her approach? >> she is very measured and deliberate in the courtroom. she will sometimes say things indicated she agrees with the lawyer who is arguing to her at that particular moment. very restrained is another way i would describe her courtroom presents. to me, picking up on what barbara said, it signals a judge who is an experienced. she obviously was only confirmed a couple of weeks after trump lost the november 20 election. she has not been on the bench a long time. if you look back at the last three years or so, about a year that the courts were in relative hibernation in terms of in court proceedings. she is not someone that has a lot of experience with criminal cases. as we all know, the one in florida, my dad once, involves a significant amount of classified information. the special procedures used in federal court for handling not. a lot of indications we've seen in the last week or so are that one of the problems may simply be she is a bit overwhelmed. her clerks and court staff are overwhelmed by the tasks you have in front of them. just the mechanical tasks of dealing with classified information. even a lot of the motions filed in this case, we in the public and press do not have access to them. they were filed weeks ago. she is was to go through them and walk out things that we are not a sissy that is not happened either. it does seem like it is becoming a bit of a tangled mess. and exact reasons for it are little clear. >> robert mcclain and josh, good to see you both. the headline says everything. texas immigration law is on hold, but the confusion is still melting will try to sort it out next. next. no... cashbacking. word. we're talking about cashbacking. cashbacking. cashbacking. cashback like a pro with chase freedom unlimited. how do you cashback? specifically, detained migrants and those in the asylum process who are presumably detected. who are presumably protected. >> you would think. with every thing is bigger in texas perhaps it includes the political grandstanding you just heard from governor abbott . we know it is not an isolated incident. it comes in the wider context of governor abbott's immigration feud with the federal government. operation lone star is something he has invested $12 billion of texas taxpayer money to put up razor wire. those have an impact on the clients we serve a global refuge. tilden and families who are exercising a legal right. the new texas policy training -- sb4 would impede that. we believe it will be struck down as unconstitutional and illegal. in the interim it will have a chilling effect. under the trump administration we saw it policies like this were put into place, playgrounds would be empty because our clients and other immigrants would be fearful of law enforcement coming after them and racially profiling them . it is deeply troubling. >> what ever the feds decide what the status is likely heading before this up in court. your biggest concerns are what? if the texas law goes into effect. >> we know this up in court has considered in 2012, a similar law, like arizona's show your papers which was ultimately struck down. what we are worried about first and foremost is what does the signal to immigrant clients? we know it will criminalize the very act of seeking asylum. we also know it would be wildly impractical. for one, the mexican government has been clear that they will not receive any one turned back in light of this policy. even in the fifth circuit ruling hearing this week, it was clear that texas representatives have no idea how they will implement this. we are concerned about the chaos and disorder this will create. that it will have a domino effect on other states like iowa, who are looking to institute similar rules. there is a reason why immigration is a federal issue. because we cannot have each state implementing its own policies. >> if the appeals court upholds the law, enforcing it is a point of contention among law enforcement agencies tasked with arresting records. some police the permits are concerned about taking on this response ability for many reasons including how to find probable cause. how deportations are coordinated with federal agents. does texas have to answer to questions about how this gets implemented? >> absolutely. it is a case in point of what we saw in the fifth circuit hearing. it was clear when asked questions about the messiness that your samples raised, a texas does not have answers. for example, the judge asked texas lawyers what would happen if a person entered the country from a different border state came to texas? >> eventually you get to a point where has to happen. we are six months into the year where the funding is supposed to cover. the fact that has gotten to this point with so many stopgaps and so much inefficiency and the constant fear of the government shutting down that we've had to live with is ridiculous. it is entirely of republicans' making. the funny thing is, mccarthy was ousted for the exact same deal that ultimately ended up passing. i am sure he is sitting at home throwing things at the tv thinking the exercise is absurd. >> you know what marjorie taylor greene is doing. reminded everybody of that fact. you have to wonder if she will pull the trigger and try to get him ousted. will come in trouble with that create? >> honestly, i do not think the chaos, self-imposed chaos that republicans are toying with will be a bad thing for us as democrats in november. i think they could work out in our favor it is a real shame the american people had to go through that on a constant basis. >> a long time until november and if you want things to get done. new this week, democrats on state and federal level are taking steps to tackle the issue of homelessness. congresswoman alexandria ocasio- cortez and senator bernie sanders introduced a proposal placing public housing at the center of the green new deal. california narrowly passed the measure known as problem 1 that went through this week includes over $6 billion for mental health treatment and housing. you are a big advocate for people who are struggling with homelessness, especially during your time as a company representative. how significant is all of this and can it make a big enough impact? >> my whole career aside from a brief stint in politics is in harnesses and federal housing. that is what i do is my day job. the crisis has hit a point where everybody sees it on a day to day basis. if you are not expecting homelessness or seeing homelessness on the day to day basis, you are experienced the affordable housing crunch. we have 7 million affordable housing unit shortage across the country or to a new report, which is the worst and reported history. 650,000 americans are homeless on any given night. the worst impact happens to people who are seniors. people with disabilities and living on a fixed income. well i am a supporter of prop 1, i do not want us to get into the sense that it is mental illness that causes homelessness . it is the affordability of housing. this legislation that they are working on would make an impact. we stopped producing housing in the late 1990s because of my commitment and it is ridiculous we know public housing has a huge impact on ensuring the people do not fall into homelessness. i am a big fan of it and i think it tackles the twin crises of climate change and affordable housing. i hope he gets traction. the more we can garner support. really, it has to be directed action to have an impact on reducing&. >> let's turn to reproductive rights. donald trump is making headlines for suggesting a 15 week abortion ban with exceptions that would be, " very reasonable.
