monday as donald trump has yet to come up with the cash to cover the bond in his civil fraud case. we'll tell you which properties the new york attorney general appears to be targeting first. plus, we'll take a look at president biden's time on the campaign trail this week which included a new nickname for his predecessor. also ahead the latest on the biden administration's major push to bring a cease-fire in gaza. it comes as secretary of state antony blinken is expected to meet today with israeli officials. good morning and welcome to "way too early" on this friday, march 22nd. i am sam stein in for jonathan lemire. we begin with fast approaching deadline for donald trump's bond in the civil fraud case. he has until monday to come up with the $464 million needed to avoid paying the judgment while he appeals. it appears that new york attorney general letitia james is targeting two of his properties in westchester county, which is just north of new york city. that's if he cannot pay. court records show she filed there more than two weeks ago. it means she could seize trump's golf club in westchester, which is valued at nearly $16 million. he also has the silver springs estate. it is worth more than $56 million. now as bloomberg points out the estate was featured heavily in the civil fraud trial, with the judge ruling the property had been wildly overvalued for years. trump tried to claim at the time it was worth as much as $291 million often by including the value of mansions that did not exist. ahead of monday's deadline the judge yesterday ordered the trump organization to afford the court appointed monitor of any efforts to secure a bond. the language in the order suggests the judge wants to make sure the company does not make any misrepresentations to bond companies. now, a new deal between donald trump and the republican national committee is making it more likely that donor money is spent on the former president's legal bills. according to a form obtained by nbc news, when someone donates to the rnc going forward, that money will be dispersed to a group helping trump pay his legal fees, and that money will be dispersed before the national party gets money itself. this is being done through a new joint fund-raising agreement, which dictates that rnc donations are to be filtered out to the trump campaign first and then to a leadership pac covering his legal fees, and then to the rnc last. in the past the rnc has never funneled donations directly to candidates pacs. the change comes just weeks after trump had his own daughter, laura, installed as the organization's new cochair. meanwhile, the biden campaign has a new nickname for the former president, broke don. the campaign put out a release yesterday hitting trump for his poor fund-raising numbers and lack of campaign event. it's titled not a winning campaign, broke don hides in the basement. echoes of 2020 i guess. president biden also attended a campaign reception in houston on wednesday night where he jokingly said, quote, just the other day a defeated looking man came up to me and said, mr. president, i have crushing debt, i'm completely wiped out. i had to say, i'm sorry, donald, i can't help you. there you go. we are learning new details about next week's star-studded fund-raiser for president biden. the event will be held on thursday at radio city music hall and feature past presidents obama and bill clinton. stephen colbert will moderate a conversation. and a source tells us obama was asked to join the event more than a month ago and happily agreed. hosting the event and other celebrities including lizzo and lea michelle are expected to make appearances as well. the singer is currently being sued by three former dancers who accuse her of sexual harassment and creating a hostm work environment. joining us now is white house correspondent for reuters, jeff mason. he traveled with the president covering campaign stops in southwest this week and secretly i bet a big lizzo fan. >> you got me. >> yes, i know you too well. bragging about outraising donald trump last month. and they do have a clear cash advantage. how to we expect them to use that on the campaign trail. >> i think number one they're going to keep raising money, and they'll use it in some way just to sort of razz the former president who usually is the one that wants to say he's doing just fine financially. and the biden campaign is clearly trying to show a contrast there, even suggesting trump is campaigning from his basement, which is sort of a trump play by turning around a piece of criticism used against him. and now biden is using it against trump. you're also seeing them put some of that to use towards ads, and the campaign is also not just targeting television ads but going to youtube, going to facebook, going to places they say is meeting voters where they are. that's trying to get to the younger voters, some of the biden coalition that has moved away from president biden and trying to get them back. >> yeah, i mean you were with the president this week on his trip to the west coast. he's clearly fund-raising. he's also trying to reach some of the communities that he needs to retain. that includes latino-heavy areas. tell us about that strategy and how interested the campaign is about hispanic and black voters sort of being disaffected or even going towards donald trump. >> sure. well, i don't have to tell you, sam, this is going to be a close campaign, a close race in november. and what the biden campaign is focusing on is bringing back some of those voters who as i said were part of this coalition in 2020, they absolutely need in these important swing states. he was in arizona, he was in nevada. he did a couple fund raisers in texas, and he reached out in one place to latinos. he started or launched a group called latinos and biden and it's still early, it's march to ensure some of these constituency groups see him and start to rally people in those communities. so in states like arizona, in states like wisconsin, which he's not been to since the "state of the union" and others he'll need black voters, need latino voters because the error of margin or the margin of victory i should say will come down to several thousand votes. and he's battling some concern among some of those groups that democrats only come around looking for their votes around election day. and the campaign is saying, no, our message is to say we're coming here early, we're coming here to listen to your concerns, and we want to get people pumped up at this point in the cycle so that they're ready to show up once it's time to go to the polls. >> let me ask you one last question and may seem pretty basic, but i'm curious for your response. what is their mood right now how they stand politically? came off the robert hur report seemed pretty down, seemed jazzed up about the "state of the union" address. what is the mood among the command center there about how they stand? >> well, i can tell you the mood in these fund raisers that biden was at this week was very positive and biden was very positive. he came out swinging against donald trump. he feels energized by the "state of the union" and is raising a lot of money, and so that's put him and i'd say his campaign in a good mood, but you're absolutely right about the polls. they haven't gotten the big bumps they were hoping i think from the "state of the union," so they're looking for more. but i think generally, sam, they're more optimistic than maybe some other people in this party about where he stands right now in the race. >> all right, white house correspondent for reuters, the one and only jeff mason, thank you so much, jeff. really appreciate it. >> my pleasure. polling has former president donald trump in the lead for the november election as jeff just mentioned. but as veteran conservative strategist stuart stevens pointed out yesterday problems for trump are piling up and quickly, and that could lead to a surge for president biden. let's take a look. >> my image of the trump campaign is somebody's walking around with a paper bag full of water. i don't think it's going to leak, but i think when this thing goes, it's going to go quickly. and i think there's a good chance we're going to have a situation of 1980 in reserve. tied with reagan in the middle of october and the bottom fell out for carter. >> now, stevens is an outspoken critic of trump and is no longer affiliated with the republican party. he supported biden in 2020, and he will again this year. but in the past he worked with former president george w. bush and senators mitt romney and chuck grassly. now, still ahead we could all unsubscribe and switch to xfinity. their connection is unreal. and we could all un-experience this whole session. okay, that's uncalled for. during a press conference yesterday attorney general merrick garland was asked about the report delivered by special counsel robert hur. hur investigated president biden's handling of classified documents while he was out of office. while he did not bring any charges against the president, he did include opinions in his report about president biden's mental sharpness. attorney general merrick garland has been criticized for what some see as a failure stoostep in and remove unnecessary language from the final report. here's some of what garland had to say about that yesterday. >> on that special counsel robert hur's report you personally have come enwith ought of criticism in particular from the white house, anonymous officials who say you should have acted to keep him from characterizing the president's memory the way he did in that report, that you should have stepped in. what's your response to that? >> i haven't -- no one from the white house has said that to me. >> did you think that was appropriate, the language that he used to characterize the president's mental state? >> look, i said from the very beginning i would make public the report of all the special counsels appointed during the period of my service. that is consistent with the regulation, which requires a special counsel to explain what the special counsel's decisions are. it's consistent with the precedence, the full disclosure of all especially counsel reports for 20 years which the regulation has been in effect. it's consistent with the practice during the previous period of the independent counsel statute. the idea that an attorney general would edit or redact or censor, that's absurd. >> indicted bob menendez of new jersey announced he will not seek re-election in the democratic primary this year. the stead he says he's looking to run as an independent. the senator is currently facing federal prilaer charges. in a video message posted online yesterday, menendez said he hopes to be exonerated before the general election so that he can pursue his candidacy as an independent. menendez is facing 18 charges for allegedly obstructing justice and taking bribes in the form of cash, gold bars, a luxury car and more, and that he used his power to benefit egypt. he and his wife were indicted in september. menendez has until june 4th, the same day as the new jersey primary to gather the 800 signatures necessary to file for re-election as an independent. he has denied any wrongdoing in the case against him. still ahead, we turn to sports and some bracket busting upsets in march madness. we'll show which teams were knocked out early in the first round of the tournament, those highlights and more. plus a check of the weather and the weekend forecast when "way too early" returns. so this is pickleball? >> good morning, sam. we're look at spring snow, early spring snow and a lot of it in some spots. we have two systems we're watching many of it going to impact us today and then a second storm coming sunday and impacting the early parts of next week. so this is what it looks like today, lots going in the northern tier of the nation in the upper midwest to the great lakes. we're looking at some snow falling, 3, 4 inches in some spots. we're going to see some snow also in portions of of new england to up state of new york. we're also looking at heavy rain falling. that's a big story today along the gulf coast and into the southeast. we're going to see some flooding because we're going to see up to 6 inches in some spots and the risk for hail and gusty winds. another system moving onshore. that's going to create some snow as we go through saturday, look at snow through the intermountain west to portions of of the plains. dry, too, in parts of the ohio valley but look at this mess along the eastern sea board, that's going to slow us down on the roads. also if you're headed out for spring break because we're looking at rain falling from florida up through portions of of the north east. and could see 8 to 12 inches of snow. same story on sunday, significant snow throughout the northern tier of the nation, and lots of snow through the rockies, northern plains, and upper midwest. and on the northern side a chance of severe storms. that's going to bring of tornados and also heavy rain, some hail, gusty winds and sunshine returns to the eastern sea board on sunday. 32 million people under winter alerts and, sam, looking at flood alerts for 30 million people. we're looking at rain and also snow. back to you. >> what happened to that early spring that i felt like last week? he wouldn't say no, would he? >> i guess we'll find out. look, i'm the one that extends the invitations to speak in the house, and if we just have the house, that's fine, too. but i think a big majority of that senate would want to come and stand in support of netanyahu and israel. >> netanyahu also held a videoconference with senate republicans where he denounced democratic majority leader chuck schumer's criticism of his leadership. a spokesperson for schumer says johnson has not yet spoken to him about a potential visit from netanyahu. in a statement the majority leader wrote he welcomes the opportunity for the prime minister to speak to congress in a bipartisan way. the last time netanyahu addressed a joint session of congress was in 2015. back then both chambers were controlled by republicans, and netanyahu yutzed his time to criticize the obama administration for negotiating a nuclear deal with iran. joining us now is congressional reporter for politico, daniela diaz. good to see you. how are democrats reacting to this idea of netanyahu addressing congress? >> sam, i spoke to a dozen house democrats from different factions of the caucus who all had various different opinions how they would receive netanyahu were he to come address congress. they don't think this is the right decision for netanyahu or republican leadership to invite him because tension is just at its highest point right now when its come to how these democrats feel about netanyahu and how he's been running israel and this really tension war with hamas. you know, a lot of them say they would attend a lot of these democrats i speak to and jared said he wouldn't skip the meeting. although we do expect if this were to happen a lot of progressives would skip, which obviously happened last time as well. >> when would a speech take place, i'm curious. as mike johnson the speaker specified when he would like to see this happen? >> he hasn't. they're about to go on a two-week recess and right now they're priority is spending. however, once this is over and they're able to fund the government, which is something we expect to happen in the next couple of hours, they're going to be gone for two weeks when they come back, this is going to be a top priority of speaker mike johnson and senate majority leader chuck schumer is sending aids to israel but also sending aid to ukraine, which is something speaker mike johnson still has not said when he plans to put a stand alone bill to send aid to ukraine will happen. so we expect that to be the biggest conversation in congress once they're back from their two-week recess, sam. >> and then hanging over all this, of course, is a speech that senate majority leader schumer gave in which he criticized the netanyahu government for its handling of the war and called for a change in leadership in israel. i'm curious as you talk to these democrats, how do they feel about that? has that put them in a bind? >> absolutely. there's different opinions from different members on whether they feel that schumer overstepped with making that speech. he didn't give people a heads up he'd be making that speech last week. a lot of democrats do agree with schumer that netanyahu is a polarizing figure and that they don't necessarily believe that he should be the one possibly leading in this conflict against hamas and that he -- they had to have conflicting manns about him. but they are in the end believe the united states is an aid to israel wants to continue to help israel provide support, and that is where when i talk to a lot of tease democrats what they believe is the bottom line. >> all right, congressional reporter for politico, daniela diaz, thank you so much. really appreciate you waking up so early. still ahead we'll go live to cnbc for an early look at what's driving the day on wall street. plus a federal crack down on big tech. why the justice department is suing apple. next on "way too early." >> well, this is a watershed moment with the u.s. justice department accusing apple of monopolizing the smartphone market. now, it is alleging apple took measures to lock in its users and prevent competition by restricting access to its software and hardware. the lawsuit claims apple's noncompetitive behavior and practices extended beyond the iphone but its entire ecosystem including apple pay, apple watch, and face time. apple controls 56% of the u.s. smartphone market. in a statement apple said the u.s. case threaten said who we are and the principles that set apple products apart in fiercely competitive markets. now, this is the latest issue for apple. they're also under hard scrutiny here in europe where they just paid a $2 billion fine because of anti-competitive practice, and those apple shares they did fall more than 4% yesterday on the back of the news. >> and it's hard to overstate what a watershed moment this is in the anti-trust movement. we'll see how the case goes obviously. shares of reddit meanwhile are up after the social media platform yesterday made its debut on the new york stock exchange. tell us what drove up the stock? >> that is the recurring burning question in all of trump's four criminal cases, which is how soon? how much more delay? and the answer is at least for the manhattan d.a.'s case is this one snuck up on us. we were all covering the three other criminal cases. no one really paids a lot of attention to the new york case, and now all of a sudden it may go to trial next month. but here's the thing, in complex especially high profile cases unexpected delays happen. this case is a classic example. a month ago if you had asked me, well, several hundred thousand pages of documents suddenly drop in the case i would say probably not but you never know. if you would have asked me in 2023 if the motion in the georgia election interference case alleging prosecutorial romantic relationships delayed that case for three months, i would have said i doubt it, but here we are three months later and that's exactly what happened in the georgia case. so the answer is you don't always know what will delay a case, but things just happen. they happen in regular run of the mill cases, they're certainly going to happen in the four most important criminal cases in american history. >> you want to take a guess at the crazy thing that will pop up on another case, or we just going to move on? >> i do not want to play crazy delay reason bingo at this point because, look, i would never be able to predict these last two that came up if you'd given me a hundred guesses. >> all right, fair enough. let's talk about what's happening in new york right now when it comes to the former president's $464 million bond. look, he has had trouble getting the money. monday looks like a pretty big day in terms of seizing assets, potentially. how do you see monday unfolding? >> it is a big day, and it also isn't a big day. there's this perception that letitia james is going to march up to trump buildings with a giant gold padlock and lock everybody out and start grabbing money out of the coffers. that's not how asset seizure works when you're dealing with judgment debtors. it's a long process. i've been involved in the process. it is a difficult process to get money out of a defendant in even the most ordinary cases. donald trump's buildings are almost certainly protected by layers of llcs and different ownership. and then you have to talk about what's the equity in each building, how much is still owed on loans. there are so many complicated issues when it comes to judgments and executing on judgments that the practical reality is most plaintiffs firms really shy away from that. they'd much rather go after a defendant who's simply covered by an insurance policy. and once that insurance policy is maxed out, hey, no mas, everybody walksy. in a case like this letitia james doesn't care about an insurance policy. she'd rather go after donald trump and seize these assets. she's willing to put in the time. the reality is it's much more complicated than folks expect. >> daniel, let me ask you one last question because one of the assets she apparently is targeting the sis westchester country club valued at $18 million or something like that. let's say you're a member of this westchester country club, on monday are you no longer in the country club? are you allowed today go in there? i'm not trying to empathize wit? >> look, i'll empathize with the country club members. you join and pay dues at any club, it doesn't matter if it's. if you're a tenant or paying rent, that's a good example. consider the buildings in new york city, which is the easier for letitia james to move against, rather than the florida properties. consider where you have tenants who are in a lease, who are making timely payments, what happens then? >> i'm not going to go there, but i'm disappointed with this. america doesn't deserve this, and it shouldn't have happened. >>. >> jon:ing joining us now, political analyst brendon buck. he was a communication strategist and former aide to house speakers paul ryan and boehner. do you think speaker johnson will be able to get this through the house? >> he probably will, but it is a pretty big test. there is a high bar, actually, for passing this. i think probably viewers of this show realize you need 218 votes in the house, a simple majority, but the house is so broken, the speaker is having to bring it through in a process that needs 290 votes, two-thirds. most democrats will probably vote for it, leaving you needing about 100 republicans to vote for it. it shouldn't be a big lift, but it shows you the conservatives are not happy with it. he's probably going to struggle to get even half of republicans to vote for something, which is never a good place to be if you're a house speaker. i think the most interesting part of this is how mike johnson has become a relatively conventional speaker. he was supposed to be the conservative hero, come in and change how things work, but what they've shown is just changing the speaker doesn't change the realities of who controls the senate, who controls the white house. this deal is effectively the same deal that kevin mccarthy would have gotten, and so it is not surprising the same people who are mad at mccarthy are now mad at mike johnson. >> i was going to say, if kevin mccarthy had moved a bill, requiring almost all democratic votes and half the republican caucus, what would have happened to mccarthy? >> the same grief johnson is getting, he's probably in a better spot because he hasn't had years of it building up. there seems to be some recognition, like chip roy is never going to admit he made a mistake, but there is some recognition that changing the speaker doesn't change your fortunes. they also realize that it is probably not a good look to kick out your second speaker in the same congress. i don't know mike johnson's job is in peril, but if he catches enough grief for this and is in such a perilous position as speaker, it could have significant impacts for what's next. obviously, you talked about funding for ukraine and israel. if he is getting -- if people are making threats against him, it may make it harder for them to bring something up there, even if he wants to. >> i was going to ask what comes next. say they get this through, fund the government. he's talked about bringing a standalone bill to pass the funding for ukraine, israel, and taiwan. do you foresee that happening now, considering the grief he is getting right now? >> it's hard to say. i'm relatively optimistic just because it's hard to restrain a bill for so long, that has such a clear, obvious majority in the house. now, you can certainly do it. but there are a lot of people who have said they'll go to great lengths, whether it is signing a discharge petition or other procedural maneuvers where you can go around the speaker. it's never what you want as speaker. if they're going to jam you, you might as well do it. however, there are enough members in the house who said funding anything for ukraine, even a dollar for ukraine, is a red line for them. someone like marjorie taylor greene. it is not surprising. wouldn't be surprising to see her threatening to take him out with a motion to vacate for doing just that. >> last question, this week, we saw the sort of end, maybe, of the impeachment inquiry into joe biden. i'm wondering how you view this, how they actually do wind it down. clearly, the support isn't there to actually push through articles. >> yeah, put me down as not yet convinced they're not done pursuing this. >> okay. >> it is unlikely they have the votes at this point, but they're going to do everything they can to get there. they've been telling voters for years and years now that this is a crime family, that joe biden has committed an enormous crime. there's scandal here, and they have to do something about it. obviously, they're talking about exit ramps, whether it is a criminal referral or something short of impeachment, but it's hard for me to look at them, come to the conclusion after looking at joe biden for all this time, that he didn't do anything wrong. that'd be the signal they send if they don't move to impeachment. don't give up on them yet. >> we will see. brendan buck, appreciate it. thank you for getting up "way too early" on this friday morning.
