results of what amounts to a side show. a legal circus, a spectacle and a deliberate diversion but here we are. but first we should make clear that today's ruling from john mcafee was actually a victory for the rule of law and for fani willis herself. in matter of the d.a.'s relationship where naman wade, the judge's ultimatum amounted to this. leave wade behind or halt prosecution of this case. it turns out to be a easy choice for d.a. willis to make. remember what she said when she announced the indictment. >> the state's roll in this process is essential to the functioning of our democracy. georgia, like every state, has laws that allow those that believe that results of an election are wrong, whether, because of intentional wrongdoing, or unintentional error, to challenge those results in our state courts. the indictment alleges that rather than abide by georgia's legal process for election challenges, the defendants engaged in a criminal racketeering enterprise to over turn georgia's presidential election results. >> so nothing that happened today changes anything of that. but late this afternoon, d.a. fani willis accepted nathan wade's resignation which means the case will move forward. even in losing, trump's world got most of what it wanted. right now there are emails flooding maga boxes shouting look here, fani willis is corrupt. no legitimacy to that. but it goes beyond those attacks. consider the motion to remove fani willis, filed on january 8th, 67 days ago, and trump's team ran out the clock for two months and exasperation of the crowd, begin what we discussed on this program yesterday, that is how successful trump has been in deploying a tactic of delay at all costs. election day, a potential off-ramped for the disgraced ex president and his legal trouble. and only eight months separate the american people from the prospect of that. above all. we should never forget what this case was about. it is about a -- a sitting president to undermine the results of a free and fair election. and here is what happened when he did. >> -- for back-up. >> i need back-up. [ bleep ]. >> they were peaceful people. these were great people. the crowd was unbelievable. and i mentioned the word love. the love, the love in the air. i've never seen anything like it. >> so despite hours of droning punditry about what did or didn't happen, that is what this is about. and team trump came for the king or the queen in this instance and they missed. game on. here to start us off, on this extraordinary day of news, again, some of our most favorite experts and friends. former lead january 6 investigator, lisa rubin and host of politics nation here on msnbc and the president of the national action network and reverend al sharpton here and special correspondent for "vanity fair," molly yong is here. tim, i am catching up, still. i was out for a little bit. and one of thicks that i'm catching up on is alvin bragg's case about trump having sex with a porn star. while he was married and then paying allegedly paying money to cover it up so it didn't come out ahead of an election. this is about two single people who had a relationship in the middle of prosecuting an ex-president. it feels like sometimes we stare so closely at the trees that we miss the forest. >> yeah. exactly right. this is a distraction because it doesn't touch the core allegations in this case. this was not -- none of the issues at stake in judge mcafees ruling bear upon the conduct, the charged conduct of the defendants. this is a separate issue. it is, however, a legitimate issue. it is a legitimate issue because prosecutors have a higher duty. judge macafee goes on for pages in his opinion about the fact that prosecutors are held to a very high ethical standard. and they can't have any actual or apparent con flick of interest. and there are ethical rules. prosecutors are held to a higher standard. and this issue of the relationship between the district attorney and the special assistant district attorney who is leading the prosecution, or was until this afternoon, has been a huge distraction. really an unforced error, because again it doesn't touch the strong evidence of these defendants' guilt, but it caused the 67-day delay in getting to the courtroom. i think judge macafee has made a sound choice to find that there is no evidence of an actual conflict of interest, miscon duck. but there is an appearance issue that the d.a. supervising a person whom she's had a romantic relationship, it causes potential suspicion about whether she's making decisions strictly if the interest of justice or a personal relationship. so mr. wade stepping away, makes a lot of sense. hopefully it will allow them to move forward and get back to the core issues in the case. whether or not there is a racketeering conspiracy intended to disrupt the election. that is where we need to get to, it is time for the allegations to have their day in court. all of the side shows an the motions to be resolved so we finally get to decide -- a jury, juries get to decide whether or not the government has proven its case. >> lisa rubin, you have the unofficial role of tracking the calendar for us. is there any chance that what tim described happens in this case ahead of the election. >> it is difficult at this point for it to happen. we just wasted as tim said, 67 days, from jarn 8th when ashley merchant filed this motion until today. we have done nothing else in this case other than pay heed to these motions. now, scott mcafee, one that got more press than in terms of the impact on the case, he decided a small motion. but really the bulk of the 67 days has been taken up by what could be characterized as a side show. how you get this case back on track when you've lost the quarterback is really difficult proposition. i think it is really unlikely this case gets tried before the election unless some measures are taken to, for example, triage. he pull off some defendants and try it more than once. a bunch of people plead out. accepting those circumstances, i don't see how this happens. >> fani willis charged a tight set of facts. no one has anything to say about the facts in this case or charges. and again, before i stepped away, every other day someone was pleading guilty. in her sweeping racketeering case. this is, though, as tim is pointing out and others have pointed out, a successful side show on trump's point. he got the delay he may need to make sure no trial happens before the election. >> i think that what a lot of us should look into the other side of that. one side said that he wants to delay it until after the election. but fact is that even if he does, he cannot dismiss or pardon mim self-from state charges. both in new york, with alvin bragg or with fani willis in fulton county. so what i suggest is that maybe he or his attorneys believe he's going to be convicted. why would you stall it, mr. president, unless you know you're going to be convicted and evidence is so overwhelming. because you really are stalling what is inevitable. you're going on trial. whether it is before or after the election. so what you're stalling is trying to go to jail. the other thing i think that are big losers here are some of the co-defendants. because if they had ruled fani willis could not try this and it had gone to another county and it may have never gone to court, giuliani and everybody else charged would have had another day. they had a bad night last night. because when they ruled today that fani willis could stay there, that means rudy giuliani and all of the cohorts that have a day in court and a day probably of conviction. and i think that we're missing a lot of that. so, yes, i would like to see it before the election. but i know subliminally, donald trump must really feel he's going to be convicted. that is what he's stalling for. aside from the election. >> well it is interesting. there isn't anything more to legal strategy and because there are so many cases you can't analyze them across the documents case. and the january 6 federal case and the georgia case and alvin bragg case. and he tried all in the court of public opinion. and there is no pushback on the facts. >> and he put the just system on trial. he said this is a corrupt system. it is them and not me and he made this another campaign event. and he spent millions of dollars trying to delay, delay, delay. and you know, every time, people are talking about fani willis, and nathan wade, they're not talking about donald trump and fake electors. >> that is so interesting. tim, what is the sort of -- take me behind the curtain. what is the private gripe of prosecutors who see trump sort of houdini-ing his way out of accountability on every front. >> look, prosecutors want their time in court. they would not have brought this case, nicolle, had they not believed that their holding cards that will win the hand. i don't mean to suggest it is a game. but they obviously feel strongly that they have very strong evidence of criminal conduct and every day, as everyone in the studio is saying, that we're not talking about that, that we're not putting that to a jury, tested by cross-examination, and the presumption of innocence, makes it more difficult for prosecutors and the cases get worse the more time passes and more things could go wrong and arise, and we get memory fade. so once prosecutors make a decision to charge, they want to go and they want the day in court and move the case forward. we're seeing that with the tactics of special council and with the d.a. office. and as reverend sharpton just said, a wrongly accused defendant who is very anxious for his day in court to clear his name, would be rushing to get to the courtroom. i member senator stevens, do you remember this case where just before an election, he held the government to its burden of proof and said i want my trial within 70 days because i want an opportunity to clear my name. now, he was convicted, but then there was some evidence that wasn't approved. but you get the opportunity to rebut that and that is the route that he took here. someone that has not articulated any substantive cohesive defense and tried to avoid sitting at that table will listen at the table and i think it is telling of a delay. it is a portfolio strategy. not a sound legal one. >> let me push back. as a political strategy, i think he would point to the polls and say is it successful and as a legal strategy, i think he would say there won't be a trial before the election and he has a 50/50 shot of winning. it seeming to be successful on both fronts and what does the rule of law side do to protect the exploitation of delay or is it something that could not be protected. is it like so many other norms rest on the good faith of its participants? >> yes, it does. and the system has built into it a lot of protections for charged defendant. they have an opportunity to bring forth motions in limine and make legal arguments and to of the issues resolved. because we have a system that presumes innocence and gives lots and lots of procedural rights to charge the people, whether they're shoplifters or former presidents of the united states, that builds into the process of a fair amount of potential delay. we wouldn't even be talking about this, nicolle, now, if these investigations had been launched sooner. they could have been launched on january 7th of 2021 or even january 21st. but they weren't. so we're only close to the election because of some reticence on behalf of federal and state prosecutors to pursue this. and frankly sort of a revelation of evidence of crimes for the committee which i worked, i could call this question and forced that attention. if we had looked at it sooner, then i think this -- all of these procedural protections would have been granted well in advance of a trial before the election. be that as it may, we're not there now so the intersection of the campaign and these legal issues is frustrating. but the system gives defendants this opportunity. right. it bends over backwards to make sure that people are treated fairly and have an opportunity to raise anything they think is relevant. >> i mean, you just put your finger on the entire enchilada though. the reluctance to examine crimes. maybe it was so disorienting to catch crimes committed before our very eyes and to watch the criminal carry out those crimes on tv. and then to watch him tweet at the criminals, we love you, quote/unquote. that it made people stop. but i guess, tim, what i'm trying to get at, is an honest conversation for the next eight months. there will most likely be zero legal accountability for donald trump and he's banking on that being a winning political strategy. now the only people who have any agencies in this conversation at this point are the voters. and what fani willis went through, she's been doxed, her kids have been doxed, her ex-husband has been doxed and her personal information is -- there is no glory in actually trying to hold trump accountability. but all they tried to do is treat trump any way of us would have been treated and it didn't work and i don't think it is healthy any more as a host of this program and i'll speak for my own hours to talk about the legal accountabilities on the table. it probably isn't. and what will people who spent their life and careers as prosecutors, what will they say to someone like donald trump, who won and did it and get out accountability and got his get-out-of-jail-free card and what do we do about that as a sort of a voting public? what does that conversation sound like? >> yeah, really good and part question. i don't know. maybe, even though the case has not been tried, the allegations are such that they will influence people in terms of their decision as to who to vote for. i think they should. they say a lot about the character of the person who is offering to serve once again and my hope is that most americans who understand those facts, which have been told and told and told again, that will influence them. so there is one jury. it is the american people. and all of the fani willis and jack smith could do is use the levers at their disposal to hasten this, and the form he president is using ways to try to delay it. i still think there is a chance that the federal jan 6 case might be resolved by the election. i don't know. it depends on the supreme court. but the point is a good one. it feeds in the narrative that the former president is saying that the system is broken or the system is corrupt or it doesn't work. it is generating more cynicism, it feeds that beast that people don't have faith because things take so long. it is an example of how when our system doesn't work or doesn't seem to work. that increases cynicism and that is the argument that he's making, as to why he should be back in there. >> i appreciate you bringing this to a real place. because the best thing that we could do for our audience is have any honest conversation. we have to have a break. but i constantly plead with the national security officials who saw his lack of fitness, i plead for cause, millie put himself on the line. your investigation revealed this quite clearly. to get out there and tell the american people what they thought. you see something, say something became the duty of the american people after 9/11. if you believe that january 6 was another attack on our democracy, you have a duty not just if your a general, but if your a prosecutor. and i hope there are some real soul searching going on among the federal prosecutors that could not bring their cases to a jury to quit and make their cases to the american people. i think that you could argue, that is as much of their duty as anything they've asked to do. i want to bring everyone else in on that. but i have to sneak in a break. chris christie called it a grift. news breaking conversation that you and tim were just having about how we get accountability and one part of that is voters taking this system by its horns and behaving as the jurors that we all need every single person of voting age in this country. to be right now. but the other metric of accountability and forgive me because i was civil litigator, is the civil cases against him where you have seen both letitia james and e. jean carroll get the kind of accountability, not in the context of criminal acts during his presidency. but to illustrate to people who donald trump really is and always has been. because in both of those cases, his conduct in many years past is what is at issue. both of those women are unhinging him. with their ability to get into his wallet. and yes, e. jean carroll has been represented by capable lawyers and she's been at this since 2019. and so, by being ahead of the curve, we talk about the department of justice, waiting too long all of the time, e. jean carroll did not have the concern about the restoration to normalcy that merrick garland and his senior leadership did. >> and stormy daniels could become another woman in this story on this front very shortly. >> no, i think that is true. and i think that as i've not been a civil litigators but a civil rights activist. i think that is where people have been saying there is justice for that's that have needs and that have certain things on their side. and others doan. there is no way, if this was some guy on the south side of chicago with just a regular job or no job, that he could go through two civil cases that he loses and then have four criminal cases and tall this long. that is why people need to vote. because we need to really equalize this system. i can't imagine anyone that ever comes up in that class-action that could stall this. so, i think in many ways the lesson of this is the inequity in the criminal justice system that those with money could play the game and those with money could play the game and those that don't, they have plead to something they are not guilty of or an expedited situation and i think that this is a classic example of showing that. >> it is the case against complacency. nobody is going to save the american people from trump. >> there is no one coming. there is calvary. voters will have to vote against trump and if they don't, i don't know what happens. >> that is a ominous entry to you, tim. you get the last word. because it is a real conversation. we are going to have to take this evidence as the committee successfully did. to the american people, turning democracy into a one two three political issue for voters of the 2022 midterms. we know how to do this. >> we absolutely do. look, facts matters. and the facts are clear. the fact have been consistently demonstrated. and i hope that americans pay attention to this em -- to them and they influence their decisions when they're in that polling place. it may be that the real accountability here is do facts matter to enough people to make a sound decision as to who should be in that very, very important office. there is no shortage of accountability if everybody mays attention to and reacts to those facts as everyone is saying. engagement and participation and use of those facts in manifesting and voting is maybe the only jury that ultimately matters. >> it is just taking people's power back. i talk to so many people who are so exasperated this is the legal state of play. but to your point, tim, the committee did this. the committee didn't have the ability to sentence him. they didn't have the ability to charge him criminally. the committee had the ability to put facts and witnesses in front of the american people and so do every single political actor and citizen over the white house and months later get $2 billion from the saudis. $2 billion from the saudis. you think it is because he is some kind of investing genius or do you think it is because he was sitting next to the president of the united states for four years doing favors for the saudis. that is your money. that is your money he stole. and gave it to his family. you know what that makes us? a banana republic. >> christie versus jared and i'm so there for it, selling tickets. on this front, there is brand-new reporting that broke a couple of minutes before we came on the air in "the new york times." reporting that jared kushner confirmed that he's closing in on a major real estate deals in albania and serbia, the latest example of the ex-president's family doing a lot of business abroad even as trump seeks to return to the white house. the plans have come apart from relationships he built while working for his father in law while trump was in office. and, quote, the first two projects both involve land now controlled by governments. meaning a deal would have to be finalized with foreign governments. joining our conversation, "new york times" reporter eric lipton, and rev and molly are back with us as well. eric, take me through what you and your colleagues are reporting. >> it is just that a pretty extensive deal for jared kushner. one of the biggest endeavors he's undertaken since he started his private equity firm backed by the saudi government and others. and it would involve potentially three different major projects that -- an endeavor worth mol than a billion dollars. it was a small island that was a soefut submarine base and the second is a location in belgrade and serbia which is bombed out by nato and has been sitting vacant and the third is a peninsula in albania that is private land. the first two are public land and would require government permission to do it and the third is private land also in albania and the coastal resort area. there could be resort hotel and villas and it is a project that he's undertaken with rick grenell who was the special adviser for trump for the balkans during the end of the trump administration and involves a real estate partner from california and then a -- there is a real estate and kind of a billionaire businessman from albania who has been advising them who is close with the prime minister in albania. >> and jared kushner and rick beganel, and a billionaire in albania what could go wrong. let me read more of your story. affinity partners has the $2 billion in funding, among other foreign investors, and in a statement an official of the affinity said it had not been determined whether the saudi funds were part of any project kushner is considering in the balkans. kushner said to -- in this story, we're very excited. we haven't finalized the deals so it might not happen, and we've been working hard and we're close. and then you get to what christie was talking about. he set up this after he left his white house job and he capitalized on the relationships from the middle east which includes a close relationship with mbs, the ruler of saudi arabia. and i know your colleague did some reporting on this and kushner an the money. chris christie tried to make it a plaque of his primary candidacy against trump and that this is a grip. and i remember when mnuchin was going the same and he's a much more experienced ip -- experienced investor. what is kushner selling. >> he's asserting that he's a meticulous real estate investor who is able to make profits for people that back him and that he is being careful with how he's going to use this money and he also asserts that he's not going to be a part of any next trump administration and yes, he's a member of the family but since january 6 in particular, he's kept his distance from trump and his political operations. and so, you know, his argument is that he's -- he was a real estate investor before he got into the white house and now he's back to being a real estate investor and he thinks he could make his investors profits. that is the way that they look at this. >> did he before he looks in the white house, was he very successful at doing that? >> he had sort of mixed success. they had a big office building in new york city that was financially challenged. i would say he had nix success. his father started as a major real estate developer and he joined his father's company and then started his own company. it is pretty -- in parts of new york city and dumbo and in brooklyn, he was pretty successful with the project there and jersey city and some other places. he has had his successes for sure. >> what is rick grenell's role in this, eric? >> so, grenell built a lot of relationships in the balkans during his period of serving as the special adviser on kosovo and serbia and he got to know the albania prime minister very well after he left the trump administration. and became friendly with him and began to socialize in the circles there. frequented albania he loved the coastal, the beaches and the luxury and so he became -- and the -- let's see. the prime minister of albania, for at least a decade, has been talking about trying to develop this island called saysan, off the coast of southern albania because it is been sitting there vacant since the end of the cold war and that is idea that grenell ran with and brought it to kushner and got kushner to be introduced to the prime minister and when he was there in july of 2023 with ivanka, grenell and curb mer met with the prime minister and that is deal. so grenell is the nexus of this and he also has a relationship in serbia that i think played a significant role in getting access to this really key site in belgrade that -- i mean getting access to government owned land in some of the most valuable potential tourist properties in those two nations, and getting potentially the concessions to profit off of those is a very big deal. and that is part of the role that grenell has played. >> that is what he said in eric's story. the new york types quote, grenell added in a nearly 90 minute television interview, i've never done a 90-minute television interview that there was nothing wrong with this deal making because he wasn't in government. working on private equity projects and no one has ever apologized for wanting to make money. and i point out that in "the new york times" is this quote, robert wise is a public citizen which tracked business deals that considered con flicks of interest during trump administration said the plans deals were unethical and raise questions if trump is re-elected. jared kushner should freeze any new investment plans that involve the worst of every corrupt tendency in the trump administration and the trump family, end quote. an that is an understatement. we should laugh because there are so many career public officials for whom this is like the nightmare they have. the idea that there are people who serve in government, you'll remember jared kushner was the secretary of everything. he just did everything he wanted. >> everything and nothing. >> so that guy is now going to develop government property with another guy who met -- who met the government officials through the trump administration. oh, and by the way, trump's daughter is married to that guy. i mean, it is just -- it is every level of corruption. and these are the people screaming about hunter biden who bought his art. it is just -- it is beyond the pail. >> what is barely news is in places like russia. this should be in our american autocracy. >> it is happening here and in broad daylight with everybody watching and i think that is really speaks to how we are beginning to let donald trump and his relatives normalize this kind of trading and this kind of -- >> that is a danger. >> just like ha ha ha, jared did it again. and even if i can't see the details, just looking at it on the surface, i mean, it is -- my nose is out here and here is my mouth and here is my breath, i could smell things before i could taste them and before i understand them. this stinks. >> before you dysfunction may prevail. seeing a range of bleak scenes in ukraine including a break down of ukraine lines and the grimmest contingency of massive casualties. and one senior officials say there is nurture that is bright for ukraine without continuing u.s. support. let's bring in lisa yasco joining us from kyiv. and the rev and molly are still here. it is embarrassing to share this news with our viewers, it is even more embarrassing to do it with you listening. tell us what this means for people of ukraine? >> well, you know, as someone who is dealing with the foreign affairs of ukraine, and many them are asking this question that you are asking me. an for me it is very hard to look at the eyes of the ukraine people when i come back from different briefs after the conversations with the foreign politicians, with the republicans, with the democrats, with congressmen, congresswomen. it seems that when we talk, the support is there. but when we are in action, it looks like a different internal problem and unfortunately it is not very helpful for the situation in ukraine. and i want to warn everyone it is not ome about ukraine. it is about ukraine having a terrible life and death situation every day. it is about big geopolitical catastrophic threats where russia is not just winning, russia is becoming military, very, very strong. and we should be looking at the eyes of this and we shouldn't ignore it as the community that believes in the international law and humanity or it will be too late and we will face terrible consequences around all of the globe. >> i know that the people and the politicians in ukraine keep a very watchful eye on our politics. but in some ways are more clear eyed and savvy and prescient than we could be in my experience. but did people predict that even before a presidential election, with majority of the american people supporting ukraine, and the military effort against russia, that aid would get mired in congress because of the republicans. >> no, definitely. we could not predict that. and it is very hard to explain to ordinary ukrainians why there could be any battles, and president biden was in ukraine, we hear so many good statements for all of the time, but what could go wrong that this aid is postponed and when we hear that there are some internal issues, they say it is a political debate, the presidential elections, of course it is not just restraining, it is something that you could not explain to ukrainians. especially also the -- the support of the united states among ordinary ukrainians is very high. we believe that all americans, most of american people are on the side of the truth and the good side, and are supporting ukrainians, so then why is there no political decisions that are made in the right timing. this is very hard to explain. >> and so much of what happens on the battlefield is in comprehensible to people who aren't there. but what is the impact for the men and women giving their lives to fight not just for ukraine but for all democracies when this aid litly is money going to bullets and to ammunition and to the weapons that are needed to prevail in this war against the common enemy. what is the impact of the men and women fighting when u.s. aid is called into question and doubt? >> when we just look at the mathematics of that. it is a question, as you said, it is a weapon, it is about artillery and having the bullets that you could use against the enemy who kills your cities, your lives, your families, and unfortunately very often in the recent weeks, because there is no aid being delivered in time, we have the situation where russia is military stronger -- many times more. i'm talking about not the immense power and the strategy, i'm talking about just the mathematics of how much weapons they have. and what they are capable of. and we still don't have very simple things because we ran out of them. and if we want to win, if we want to have justice, we need to have resources to achieve that. and we can't be just losing our people. and the price that we have paid for this freedom and for this fight for justice is very high. every family has somehow who lost someone. no houses, no -- no normal life in the city. many people don't have their cities any more. like the city life, the schools and jobs, because it is under occupation or absolutely destroyed. it is incredibly linked. and, when we, for me, as someone would always believed in politics in the international relations, for me, the question is why we're not stopping putin as aggressively. why we're not doing everything possible to lead the military of russia to the extent that they will not be able to fight. >> we have the same questions. thank you so much for being republican's attempt to impeach joe biden, it is so bad that that guy, a really, really conservative republican, is leaving congress over it. that is congressman ken buck from colorado. you may have heard the news that he announced he will cut his final term in kog short, abruptly. crediting his party's unfounded debacle of an impeachment inquiry that has turned up no evidence of wrongdoing of the president. white house still have had enough. white house counsel's letter write to you today because it is clear that the house republican impeachment is over. the house majority ought to work with the president on our economy, our national security and other important priorities on behalf of the american people, not continued to waste time on political stunts like this. he continues, quote, the house majority has reportedly collected more than 100,000 pages of records, interviewed dossens of witnesses and held multiple public hearings but none of the evident has demonstrated that the president did anything wrong. in fact, it has shown the opposite of what house republicans have claimed. in response, speaker johnson said, quote, the white house doesn't get to decide how impeachment gets resolved. that is for congress to decide. but, congress has done with their inquiry so far, other than repel ken buck is to find zero proof to back any of their claims. and in a devastating blow this their efforts, just last month, their star witness, former witness, alexander smirnov was indicted about lying about the bidens. can't make this up. and now we reveal how more untrustworthy he is. serious doubts about his credibility were raised almost a decade ago and no now prompting questions why he remains on the phish payroll for as long as he did. his attorneys said they are client, quote, stands behind his years of service to the u.s. and they have not responded to the request for comment and it does underscore upon which republicans face their inquiry. they can't even point to any clear evidence which asked. have you seen direct evidence? because that is what we have not heard. >> well we have to connect the dots. >> there is not been produced a smoking gun, clear-cut undeniable proof of the president's involvement with his son. what do you say to that? >> well, we've never claimed that we have direct money going to the president. >> we've had more potential evidence that needs to be obtained, more hits, more accusations that need to be investigated. >> in an interview with punch bowl news, they called the two republicans saying this, quote, jim jordan and james comer are becoming the chairman who cried wolf. promising a there-there over and over again and producing nothing close to an impeachable offense. and the white house saying enough is enough to house republicans. rolling debacle is where we begin the hour with some of our most favorite reporters and friends. luke broad water is here and msnbc political analyst david jolly is back. and msnbc legal analyst barbara mcquade is with us, a former u.s. attorney and the author of the book attacks from within, how disinformation is sabotaging within, because when it was first out we missed our shot with breaking news. luke, i remember when you were in new york, because i think it was jordan and comer took their traveling debacle on the road. going to be such a boon. they hit the road with it. like a tour. it is so bad that the conservative ken buck is leaving the party early. explain. >> yeah, it was interesting, you should put that clip of ken buck. ken buck is so conservative that he has an ar-15 in his office. he is one of the founders of the house freedom caucus. so, but he's also a federal prosecutor. or a former federal prosecutor and so he's somebody who does care about the law and about process, and about the facts. and so, you hear him lamenting there, what a circus congress has become. the house -- the republican-run house in particular, going after impeachments just for social media likes and clicks and hits and not for the seriousness of what he said should be a constitutional offense. remember the constitution defined impeachment as a high crime or misdemeanor and not because we don't like this guy and we want to get him back because the democrats impeached trump which is what ken buck is saying that the house has become. >> explain, it is complicated to always unpack where they went wrong because it is never really based on anything that went right. but luke, just explain how reliant they were on smirnoff who has now been indicted as their source for alleged corruption? >> well, remember, republicans always wanted to try to impeach biden as soon as they took over the office. donald trump had told them to impeachment the bum, they had wanted to get revenge for the impeachments of trump. so they were looking for anything that they could get. and they started going back to the files and asking for bank records and asking for all of the documents. and finally something that seemed too good to be true came along. and it was this 1023 form from an informant who claimed that not only that joe biden took $5 million in cash bribes, but that he was on audio talking about it and there were two tapes where joe biden was admitting he took $5 million in cash bribes. it sounds too good to be true at the time. nevertheless, they all ran with it. many of them went on tv and did numerous media hits about it and held press conferences about it and mentioned it as one of the foundations for when they had the vote to -- to launch the impeachment investigation. and then, of course, the fbi and the justice department come back later and say the guy made it all up. and, you know, then democrats ask them to close up shop but they are continuing to go on with the investigation and saying never mind that discredited evident, we'll have to find something new. >> which they haven't found yet. so the thing, barbara, about them going on tv is we've got it. let me show you some of it. >> you have the confidential fbi informant who is basically saying that joe biden took $5 million from burisma. >> the informant was a highly valued human source for the fbi. >> a trusted confidential informant. >> they had a -- they had a credible source. one of the good sources. >> there most credible paid fbi informant. >> so the idea that anyone said to marjorie taylor greene that it is the most informant, but here is what the government said in support. the circumstances of the offenses charged that alexander smirnov lied to his fbi handler where the to spoke every day and he cannot be trusted to provide information to pretrial services an the false information he provided was not trivial. it targeted the presumptive nominee. and it continues to be felt to this day. and it is a government memo so we'll excuse the understatement. but it continues to poison the body politics of this day. >> >> yeah, so even casting this in the light most favorable to these congressional republicans who wanted to begin an impeachment proceeding against joe biden on the base of this information. they genuinely believed there was an fbi informant who said these things and they even had a recording. they didn't listen to the recording before they went out and talked about it, is shame on them to begin with. but when they learned that this informant is not only discredited but charged with a crime for lying about the very thing, that they are not pulling the plug and apologizing is really baffling. instead, they're now saying well we don't have that any more but we'll find something. it shows that this is a conspiracy looking for some evidence to support it as opposed tole toing the evidence where it leads. and we see this idea of portraying every government official as corrupt. because if everyone is corrupt, and everyone gets impeached, it takes the teeth out of what is means to be impeached. so i think the effort to impeach joe biden is an effort to rehabilitate donald trump and to say everybody gets impeached. it is just a political act. >> and david joggy, that is exactly what it is. and they didn't plan on ken buck to be the press's eyes and ears on what a scam it all is. >> yeah, nicolle, if this was a serious congress, i'll tell you who they would be investigating today. it is trump and not joe biden. and this story opens up a ton of questions. because of this. go back to impeachment 1. it was impeachment 1 where donald trump was impeached for his involvement in pressuring ukraine to confirm an investigation into joe biden and essentially hunter biden as well. bill barr comes on the scene two weeks after the former president was impeached and said we should look at this information from someone like alexander smirnov, so at the time donald trump was involved by pressuring the ukraine government, there is this asset that the u.s. thinks they have, oh, by the way, has been confirmed had tied to russian intelligence and was not found to be credible and this actor is on the world stage providing information to federal prosecutors at the time when donald trump, donald trump is president and bill barr is the a.g., somehow those two things are totally unrelated. maybe. but you have to be crazy to just assume that. if congress wants to investigate someone, they should investigate donald trump right now and whether or not the smirnoff piece had anything to do with impeachment 1 and congress is not serious and so you see them chasing hunter biden and the tapes. >> it is such season interesting thought. did barr and ray give trump the wave off on smirnov and they're eating the left over garbage. i want to ask you about something else that happened today. and here is mike pence shocking the you know what out of me. >> it should come as no surprise that i will not be endorsing donald trump this year. look, i'm incredibly proud of the record of our administration. it was a conservative record that made america more prosperous, more secure. but that being said, during my presidential campaign, i made it clear there were profound differences between me and president trump on a range of issues. and not just our difference on my constitutional duties that i exercised on january 6. donald trump is pursuing and articulating an agenda that is at odds with the conservative agenda that we governed on during our four years and that is why i cannot in good conscience endorse donald trump. >> i think he's the only one, i quickly tried to see if chris christie had said he wouldn't endorse trump. i know nikki haley said he would endorse and mitch mcconnell has endorsed donald trump. and we've been talking all week about voters looking for permission to not vote for donald trump. they just got a giant, giant, giant one in mike pence. >> a giant one. and any questions about what does mike pence do next, i think mike pence is good for him stepping out and saying he won't endorse, but to suggest the second donald trump administration would be different from the first is a bit of make believe. it would be exactly what the first administration was and the administration that mike pence himself enabled. but set that aside for a moment. i think what does mike pence do next? because i kind of see all of this as three lanes, if you will. you have the lindsey graham lane who said i got beat so i'm going to face plant in front of trump and elise stefanik and tim scott and even mitch mcconnell who said i'll support the nominee. and then you have those who say, like mike pence, i simply can't enforce him. is that the mike pence, jeb bush lane, where they stay out of politics. in that sense, they made their piece and they stepped out and not cute by half and third is those who stay in the arena to say i'm against donald trump but fail to go to say the way we stop him is to vote for joe biden. mike pence is never going to say he's voting for joe biden. so the right lane for him is to go away until november and let the american people decide. and have more respects for republicans that say i don't endorse and go away and than those that say donald trump is a threat to the free world and i'm not willing to vote for joe biden and that is what we should expect more from. >> and i completely agree. i remember having a big fight with joe walsh about, i think years and years ago, on the honest thing to do if you think that donald trump is unfit, is to vote for the person that is running against him. luke broadwater, this puts mike pence at odds with his own colleagues in the house republican caucus. all of them except for former members, all of them have said that their voting for trump. any reaction up on capitol hill to mike pence's -- he started by saying, i think that was martha mccown, you wouldn't be surprised. i'm shocked that mike pence is not endorsing donald trump. >> yeah, it is donald trump's own vice president. this is someone that knows him better than anybody and he's refusing to endorse him. and mike pence is also in a unique situation of being the person on january 6, who the pro-trump mob threatened to hang and tried to storm the capitol trying to get at him and looking for him. so, he may have -- you know, he knows firsthand the danger of donald trump and in a way that some of these people do not. but there are many other house republicans who were there on january 6 who also ran, who fled for their lives who were on the other side of a door with guns pointed, capitol police guns pointed at the mob. so, and many of them do know firsthand what mike pence knows. but they have chosen another tactic. they've chosen to stick with the party and the nominee of the party no matter what. >> it is really stupping. you're right. there is no -- there is no difference between what they saw and experienced that day. although pence running with down the stair was a uniquely haunting image. but they all have access to the same information. it is a really smart point. it is great to see you. thank you for starting us off this hour. david and barbara postponed. it will now start in the middle of april, 30 days from today. according to judge juan merchant who is overseeing the case. yesterday alvin bragg had requested just a 30-day delay. after trump requested 90 days. that request was due to delays from the justice department, actually. in providing evidence to trump's lawyers. but evidence involved the federal investigation into the prosecution's star witness, former trump lawyer michael cohen. judge merchant has already scheduled a hearing on march 25th, the day the trial was supposed to start. we'll stay on top of that. coming false idea that president biden and democrats stole the 202 election from him and are working to do it again in 2024. this time around, the trump wants the rnc to be more aggressive. he's claiming without evidence that democrats are plotting to steal the presidential election. the full throated submission to the cult of the big lie by the infrastructure of the party will turbo charge what is at this point a long-standing threat facing our elections and our democracy. disinformation. our next guest barbara mcquade writesen he emmys of democracy are using disinformation to attack our save rin right to truthful information and election integrity and the exercise of the will of the people. ultimate result over time is a weakened democracy and diminished national security and ape threat to the rule of law. the attack is from within. we're back with barbara mcquade, author of "attack from within", and david is still with us. barbara, untangle this for me. i mean, the ex-president twice impeached and four timed indicted, manufactured and won't even call it data, he parroted a lie about fraud that put in motion 61 lawsuits. he lost 60 of them. that put in motion january 6. people died. he now has an entire party apparatus dedicated to, in his words, the manufacture of a lie. there is no fraud in this country. there is no voter fraud. bill barr said there was no fraud that would have changed the outcome of any of the state results in 2020. what should we be prepared for in 2024? >> i think, nicolle, we're going to see more of the same and then some. because of the increased capacity of technology. to use deep fakes, artificial intelligence and other things to deceive us. so i think there are two problems that go on. one is, there are sp people who believe these false claims. they believe what they want to believe. they are preyed upon through their fear and they want to identify with a particular party and so they're going to believe whatever they hear. but i also think there is another swath of the american public who knows better. people in congress who are harvard educated lawyers, people like elise stefanik in the house who parents donald trump's phrase that people arrested on january 6 are hostages, suggesting that their political prisoners and they care more about their political tribe than truth and it is a vae dangerous place for democracy to be. >> let me read something you write in your book. at it most the most disinformation in u.s. politics are far right members of the republican party. curbly rather than call out lies, a large number of republicans amplify them or they silently indulge disinformation to advance their own careers and policy goals. some conservative news media outlets have profit that are exacerbating the threat. we talked in the last hour, where there will be most likely no legal accountability for trump. a story we've been covering together since the earlier days of creation of the mueller probe. sort of culminating in a slim chance that there is any criminal accountability. what we do have then, is this information eco-system. and you've laid out the tools that the far right -- it is not even the far right but the right and the media outlets will use. how do you do two things? how do you knock down the disinformation and make sure the truth gets out to a large sort of segment of the public? >> well, i think in this election year, the focus really has to be on getting accurate information out to voter. i think we'll see influence campaigns and things to try to taint the republicans rivals and to show them in a good like and talk about stolen elections. but i worry about some of the efforts that are being done here. for one, we know that we have new election laws in several states like georgia, texas, and florida. they were passed in the wake of 2020 election under the false pretext that there was voter fraud in 2021. in fact, as you just said, there was none at all. but i think we know that we're going to see more false information coming before the 2024 election. and i think the biggest concern i have is information that will actually suppress the right to vote, confuse people about what the rules are, or send out things that will cause them to waste their vote. for example, the robocalls that were done in new hampshire, impersonating the voice of joe biden where it sounded like joe biden was urging them to stay home and save their vote for the fall. we could see other scams like that in the november election. and when an election can turn on a very limb margin in just a few states even suppressing a few votes with those kind of calls could turn the outcome of the election. >> you know, david jolly, with the trump campaign takeover of the rnc, and covered even by me as sort of a nepotism play, his daughter-in-law took over, moving it all to mar-a-lago, it is going to be a legal slush fund. the thing to keep an eye on is the operationalizing of disenfranchisement. and let me read this. this is again from "the new york times." the rnc sued michigan on wednesday to make cuts to the state voter rolls arguing that they are >> i have to say that that clip of 2017 may summit sent me into a cold sweat. because it is one of those memories that extraordinarily is difficult and trump was very disruptive during that summit meeting. that is when he put nato on notice that he wasn't necessarily going to live up to the article 5 commitment. that is that an attack on one nato ally is in attack on all and nato has to step in the case that ally asks for help. so that is a very difficult meeting for all of the allies. a shocking meeting for all of the allies. but one other thing i want to say about trump is he is very transactional and he pressured the nato allies unrelentlessly during his first time in order to come up with defense spending and pressure some allies and he was satisfied by that. so in a way, there are some simple ways to respond to the threats that he exerts. but i agree with you, nicolle, it is quite worrying, the kind of rhetoric we're hearing now about withdrawal from nato an the free loading allies and they don't do anything for u.s. security. we need to come back home and defend ourselves. >> what is this damage that someone like trump could do as an american president promising in his own words to rule as a quote, dictator on day one? >> well, i think he is actually constrained somewhat now by u.s. legislation from a full scale withdrawal from nato. but he could, as i say and others have said, undertake a thought withdrawal when he would refuse to put a u.s. ambassador in place at nato and the u.s. ambassador always plays a very important role as a leader in nato. also, he could refuse to appoint the supreme allied commander, the military commander at the top of the nato alliance and that too would be extraordinarily difficult. so this would be meaning essentially that the u.s. was falling away from leadership of the alliance and the other allies would have to fend for themselves. >> trump's affection for putin, i think in america we kind of went through ten stages of deny that it is intentional, look away from it, other he's to ignorant to mean it. we've sort of come full circle and he clearly adores putin. he's admired everything he's done including the brutal and illegal war in ukraine. what would an operationalized alliance with putin look like if trump were to return to the white house? >> okay, this was particularly the case at the hamburg g-20 in 2017. it was very disconcerting. i mean you saw on the one hand trump's very, very apparent distaste for angela merkel, the chancellor and the prime minister of germany. ond the other hand, his fascination with putin and it was an extraordinary contrast. so the -- i mean, his instincts are not democratic. >> we're back with rose garden miller. you saw these events as well and his anti-democratic instincts. i wonder if you have any insight into what preparations our allies might be making for the chance that trump prevails? >> well i'm glad that the australian prime minister brought up that point. because trump really did not get along with angela merkel and she kept insisting that germany could not spend 2% of the gdp on defense as germany had promised all of the nato allies promised to do that when putin invaded in crimea in 2013. so he was angry that she refused to pay off. it is that transactional personality. and the situations that changed now significantly. not because of anything that trump said but because of the fact that putin has invaded ukraine, this time on a full scale basis. this is been a huge wake-up call to germany and other nato allies about the necessity of investing in their own defense. so now chancellor schultz and his whole government say they are going to be spending 2% on their own defense and this is a big change from 2017. so actually, i think partially it will help in nato' dealings with trump as difficult as they're going to be. >> what is the view, just from your former relationship, the v your former relationship, your former perch of america as we seem to be -- liz cheney called it sleep walking into dictatorship? >> well, it's very difficult to say exactly what trump's approach is going to mean for foreign policy because he does like to be seen on the world stage as a leader with influence. i think to be honest with you, the nato alliance is one of our greatest instruments that provides us influence, both in europe but also on a larger stage it allows us to essentially defend our own country, our continental united states forward without ever having to worry about foreign troops setting foot on our soil or approaching our territory. so it's really, i think, a moment at which we'll have to see if trump can be convinced he can be the big man on the world stage and have a certain degree of fame and influence because of his association with the nato allies as well as our allies in asia. this is really the big man and how he looks to the rest of the world. it has nothing to do with american security, which is the disastrous aspect of this. but if he can be convinced that his role will be enbe hansed by this relationship i think it can and will be possible. >> it's an extraordinary, extraordinary place to put pause for today, the world will have to be in in pufg up his ego to ensure security. it's a devastating analysis but it's probably the truest thing that's been said in the last two hours. thank you very much for having this conversation. i hope there are more ahead for us. quick break. we'll be right back. students in a new kind of classroom. ♪ using our technology to power different ways of learning. ♪ harnessing ai to plant new beginnings. ♪ so when minds grow, opportunities follow. type 2 diabetes? results of what amounts to a side show. a legal circus, a spectacle and a deliberate diversion but here we are. but first we should make clear that today's ruling from john mcafee was actually a victory for the rule of law and for fani willis herself. in matter of the d.a.'s relationship where naman wade, the judge's ultimatum amounted to this. leave wade behind or halt prosecution of this case. it turns out to be a easy choice for d.a. willis to make. remember what she said when she announced the indictment. >> the state's roll in this process is essential to the functioning of our democracy. georgia, like every state, has laws that allow those that believe that results of an election are wrong, whether, because of intentional wrongdoing, or unintentional error, to challenge those results in our state courts. the indictment alleges that rather than abide by georgia's legal process for election challenges, the defendants engaged in a criminal racketeering enterprise to over turn georgia's presidential election results. >> so nothing that happened today changes anything of that. but late this afternoon, d.a. fani willis accepted nathan wade's resignation which means the case will move forward. even in losing, trump's world got most of what it wanted. right now there are emails flooding maga boxes shouting look here, fani willis is corrupt. no legitimacy to that. but it goes beyond those attacks. consider the motion to remove fani willis, filed on january 8th, 67 days ago, and trump's team ran out the clock for two months and exasperation of the crowd, begin what we discussed on this program yesterday, that is how successful trump has been in deploying a tactic of delay at all costs. election day, a potential off-ramped for the disgraced ex president and his legal trouble. and only eight months separate the american people from the prospect of that. above all. we should never forget what this case was about. it is about a -- a sitting president to undermine the results of a free and fair election. and here is what happened when he did. >> -- for back-up. >> i need back-up. [ bleep ]. >> they were peaceful people. these were great people. the crowd was unbelievable. and i mentioned the word love. the love, the love in the air. i've never seen anything like it. >> so despite hours of droning punditry about what did or didn't happen, that is what this is about. and team trump came for the king or the queen in this instance and they missed. game on. here to start us off, on this extraordinary day of news, again, some of our most favorite experts and friends. former lead january 6 investigator, lisa rubin and host of politics nation here on msnbc and the president of the national action network and reverend al sharpton here and special correspondent for "vanity fair," molly yong is here. tim, i am catching up, still. i was out for a little bit. and one of thicks that i'm catching up on is alvin bragg's case about trump having sex with a porn star. while he was married and then paying allegedly paying money to cover it up so it didn't come out ahead of an election. this is about two single people who had a relationship in the middle of prosecuting an ex-president. it feels like sometimes we stare so closely at the trees that we miss the forest. >> yeah. exactly right. this is a distraction because it doesn't touch the core allegations in this case. this was not -- none of the issues at stake in judge mcafees ruling bear upon the conduct, the charged conduct of the defendants. this is a separate issue. it is, however, a legitimate issue. it is a legitimate issue because prosecutors have a higher duty. judge macafee goes on for pages in his opinion about the fact that prosecutors are held to a very high ethical standard. and they can't have any actual or apparent con flick of interest. and there are ethical rules. prosecutors are held to a higher standard. and this issue of the relationship between the district attorney and the special assistant district attorney who is leading the prosecution, or was until this afternoon, has been a huge distraction. really an unforced error, because again it doesn't touch the strong evidence of these defendants' guilt, but it caused the 67-day delay in getting to the courtroom. i think judge macafee has made a sound choice to find that there is no evidence of an actual conflict of interest, miscon duck. but there is an appearance issue that the d.a. supervising a person whom she's had a romantic relationship, it causes potential suspicion about whether she's making decisions strictly if the interest of justice or a personal relationship. so mr. wade stepping away, makes a lot of sense. hopefully it will allow them to move forward and get back to the core issues in the case. whether or not there is a racketeering conspiracy intended to disrupt the election. that is where we need to get to, it is time for the allegations to have their day in court. all of the side shows an the motions to be resolved so we finally get to decide -- a jury, juries get to decide whether or not the government has proven its case. >> lisa rubin, you have the unofficial role of tracking the calendar for us. is there any chance that what tim described happens in this case ahead of the election. >> it is difficult at this point for it to happen. we just wasted as tim said, 67 days, from jarn 8th when ashley merchant filed this motion until today. we have done nothing else in this case other than pay heed to these motions. now, scott mcafee, one that got more press than in terms of the impact on the case, he decided a small motion. but really the bulk of the 67 days has been taken up by what could be characterized as a side show. how you get this case back on track when you've lost the quarterback is really difficult proposition. i think it is really unlikely this case gets tried before the election unless some measures are taken to, for example, triage. he pull off some defendants and try it more than once. a bunch of people plead out. accepting those circumstances, i don't see how this happens. >> fani willis charged a tight set of facts. no one has anything to say about the facts in this case or charges. and again, before i stepped away, every other day someone was pleading guilty. in her sweeping racketeering case. this is, though, as tim is pointing out and others have pointed out, a successful side show on trump's point. he got the delay he may need to make sure no trial happens before the election. >> i think that what a lot of us should look into the other side of that. one side said that he wants to delay it until after the election. but fact is that even if he does, he cannot dismiss or pardon mim self-from state charges. both in new york, with alvin bragg or with fani willis in fulton county. so what i suggest is that maybe he or his attorneys believe he's going to be convicted. why would you stall it, mr. president, unless you know you're going to be convicted and evidence is so overwhelming. because you really are stalling what is inevitable. you're going on trial. whether it is before or after the election. so what you're stalling is trying to go to jail. the other thing i think that are big losers here are some of the co-defendants. because if they had ruled fani willis could not try this and it had gone to another county and it may have never gone to court, giuliani and everybody else charged would have had another day. they had a bad night last night. because when they ruled today that fani willis could stay there, that means rudy giuliani and all of the cohorts that have a day in court and a day probably of conviction. and i think that we're missing a lot of that. so, yes, i would like to see it before the election. but i know subliminally, donald trump must really feel he's going to be convicted. that is what he's stalling for. aside from the election. >> well it is interesting. there isn't anything more to legal strategy and because there are so many cases you can't analyze them across the documents case. and the january 6 federal case and the georgia case and alvin bragg case. and he tried all in the court of public opinion. and there is no pushback on the facts. >> and he put the just system on trial. he said this is a corrupt system. it is them and not me and he made this another campaign event. and he spent millions of dollars trying to delay, delay, delay. and you know, every time, people are talking about fani willis, and nathan wade, they're not talking about donald trump and fake electors. >> that is so interesting. tim, what is the sort of -- take me behind the curtain. what is the private gripe of prosecutors who see trump sort of houdini-ing his way out of accountability on every front. >> look, prosecutors want their time in court. they would not have brought this case, nicolle, had they not believed that their holding cards that will win the hand. i don't mean to suggest it is a game. but they obviously feel strongly that they have very strong evidence of criminal conduct and every day, as everyone in the studio is saying, that we're not talking about that, that we're not putting that to a jury, tested by cross-examination, and the presumption of innocence, makes it more difficult for prosecutors and the cases get worse the more time passes and more things could go wrong and arise, and we get memory fade. so once prosecutors make a decision to charge, they want to go and they want the day in court and move the case forward. we're seeing that with the tactics of special council and with the d.a. office. and as reverend sharpton just said, a wrongly accused defendant who is very anxious for his day in court to clear his name, would be rushing to get to the courtroom. i member senator stevens, do you remember this case where just before an election, he held the government to its burden of proof and said i want my trial within 70 days because i want an opportunity to clear my name. now, he was convicted, but then there was some evidence that wasn't approved. but you get the opportunity to rebut that and that is the route that he took here. someone that has not articulated any substantive cohesive defense and tried to avoid sitting at that table will listen at the table and i think it is telling of a delay. it is a portfolio strategy. not a sound legal one. >> let me push back. as a political strategy, i think he would point to the polls and say is it successful and as a legal strategy, i think he would say there won't be a trial before the election and he has a 50/50 shot of winning. it seeming to be successful on both fronts and what does the rule of law side do to protect the exploitation of delay or is it something that could not be protected. is it like so many other norms rest on the good faith of its participants? >> yes, it does. and the system has built into it a lot of protections for charged defendant. they have an opportunity to bring forth motions in limine and make legal arguments and to of the issues resolved. because we have a system that presumes innocence and gives lots and lots of procedural rights to charge the people, whether they're shoplifters or former presidents of the united states, that builds into the process of a fair amount of potential delay. we wouldn't even be talking about this, nicolle, now, if these investigations had been launched sooner. they could have been launched on january 7th of 2021 or even january 21st. but they weren't. so we're only close to the election because of some reticence on behalf of federal and state prosecutors to pursue this. and frankly sort of a revelation of evidence of crimes for the committee which i worked, i could call this question and forced that attention. if we had looked at it sooner, then i think this -- all of these procedural protections would have been granted well in advance of a trial before the election. be that as it may, we're not there now so the intersection of the campaign and these legal issues is frustrating. but the system gives defendants this opportunity. right. it bends over backwards to make sure that people are treated fairly and have an opportunity to raise anything they think is relevant. >> i mean, you just put your finger on the entire enchilada though. the reluctance to examine crimes. maybe it was so disorienting to catch crimes committed before our very eyes and to watch the criminal carry out those crimes on tv. and then to watch him tweet at the criminals, we love you, quote/unquote. that it made people stop. but i guess, tim, what i'm trying to get at, is an honest conversation for the next eight months. there will most likely be zero legal accountability for donald trump and he's banking on that being a winning political strategy. now the only people who have any agencies in this conversation at this point are the voters. and what fani willis went through, she's been doxed, her kids have been doxed, her ex-husband has been doxed and her personal information is -- there is no glory in actually trying to hold trump accountability. but all they tried to do is treat trump any way of us would have been treated and it didn't work and i don't think it is healthy any more as a host of this program and i'll speak for my own hours to talk about the legal accountabilities on the table. it probably isn't. and what will people who spent their life and careers as prosecutors, what will they say to someone like donald trump, who won and did it and get out accountability and got his get-out-of-jail-free card and what do we do about that as a sort of a voting public? what does that conversation sound like? >> yeah, really good and part question. i don't know. maybe, even though the case has not been tried, the allegations are such that they will influence people in terms of their decision as to who to vote for. i think they should. they say a lot about the character of the person who is offering to serve once again and my hope is that most americans who understand those facts, which have been told and told and told again, that will influence them. so there is one jury. it is the american people. and all of the fani willis and jack smith could do is use the levers at their disposal to hasten this, and the form he president is using ways to try to delay it. i still think there is a chance that the federal jan 6 case might be resolved by the election. i don't know. it depends on the supreme court. but the point is a good one. it feeds in the narrative that the former president is saying that the system is broken or the system is corrupt or it doesn't work. it is generating more cynicism, it feeds that beast that people don't have faith because things take so long. it is an example of how when our system doesn't work or doesn't seem to work. that increases cynicism and that is the argument that he's making, as to why he should be back in there. >> i appreciate you bringing this to a real place. because the best thing that we could do for our audience is have any honest conversation. we have to have a break. but i constantly plead with the national security officials who saw his lack of fitness, i plead for cause, millie put himself on the line. your investigation revealed this quite clearly. to get out there and tell the american people what they thought. you see something, say something became the duty of the american people after 9/11. if you believe that january 6 was another attack on our democracy, you have a duty not just if your a general, but if your a prosecutor. and i hope there are some real soul searching going on among the federal prosecutors that could not bring their cases to a jury to quit and make their cases to the american people. i think that you could argue, that is as much of their duty as anything they've asked to do. i want to bring everyone else in on that. but i have to sneak in a break. chris christie called it a grift. news breaking conversation that you and tim were just having about how we get accountability and one part of that is voters taking this system by its horns and behaving as the jurors that we all need every single person of voting age in this country. to be right now. but the other metric of accountability and forgive me because i was civil litigator, is the civil cases against him where you have seen both letitia james and e. jean carroll get the kind of accountability, not in the context of criminal acts during his presidency. but to illustrate to people who donald trump really is and always has been. because in both of those cases, his conduct in many years past is what is at issue. both of those women are unhinging him. with their ability to get into his wallet. and yes, e. jean carroll has been represented by capable lawyers and she's been at this since 2019. and so, by being ahead of the curve, we talk about the department of justice, waiting too long all of the time, e. jean carroll did not have the concern about the restoration to normalcy that merrick garland and his senior leadership did. >> and stormy daniels could become another woman in this story on this front very shortly. >> no, i think that is true. and i think that as i've not been a civil litigators but a civil rights activist. i think that is where people have been saying there is justice for that's that have needs and that have certain things on their side. and others doan. there is no way, if this was some guy on the south side of chicago with just a regular job or no job, that he could go through two civil cases that he loses and then have four criminal cases and tall this long. that is why people need to vote. because we need to really equalize this system. i can't imagine anyone that ever comes up in that class-action that could stall this. so, i think in many ways the lesson of this is the inequity in the criminal justice system that those with money could play the game and those with money could play the game and those that don't, they have plead to something they are not guilty of or an expedited situation and i think that this is a classic example of showing that. >> it is the case against complacency. nobody is going to save the american people from trump. >> there is no one coming. there is calvary. voters will have to vote against trump and if they don't, i don't know what happens. >> that is a ominous entry to you, tim. you get the last word. because it is a real conversation. we are going to have to take this evidence as the committee successfully did. to the american people, turning democracy into a one two three political issue for voters of the 2022 midterms. we know how to do this. >> we absolutely do. look, facts matters. and the facts are clear. the fact have been consistently demonstrated. and i hope that americans pay attention to this em -- to them and they influence their decisions when they're in that polling place. it may be that the real accountability here is do facts matter to enough people to make a sound decision as to who should be in that very, very important office. there is no shortage of accountability if everybody mays attention to and reacts to those facts as everyone is saying. engagement and participation and use of those facts in manifesting and voting is maybe the only jury that ultimately matters. >> it is just taking people's power back. i talk to so many people who are so exasperated this is the legal state of play. but to your point, tim, the committee did this. the committee didn't have the ability to sentence him. they didn't have the ability to charge him criminally. the committee had the ability to put facts and witnesses in front of the american people and so do every single political actor and citizen over the to the president of the united states for four years doing favors for the saudis. that is your money. that is your money he stole. and gave it to his family. you know what that makes us? a banana republic. >> christie versus jared and i'm so there for it, selling tickets. on this front, there is brand-new reporting that broke a couple of minutes before we came on the air in "the new york times." reporting that jared kushner confirmed that he's closing in on a major real estate deals in albania and serbia, the latest example of the ex-president's family doing a lot of business abroad even as trump seeks to return to the white house. the plans have come apart from relationships he built while working for his father in law while trump was in office. and, quote, the first two projects both involve land now controlled by governments. meaning a deal would have to be finalized with foreign governments. joining our conversation, "new york times" reporter eric lipton, and rev and molly are back with us as well. eric, take me through what you and your colleagues are reporting. >> it is just that a pretty extensive deal for jared kushner. one of the biggest endeavors he's undertaken since he started his private equity firm backed by the saudi government and others. and it would involve potentially three different major projects that -- an endeavor worth mol than a billion dollars. it was a small island that was a soefut submarine base and the second is a location in belgrade and serbia which is bombed out by nato and has been sitting vacant and the third is a peninsula in albania that is private land. the first two are public land and would require government permission to do it and the third is private land also in albania and the coastal resort area. there could be resort hotel and villas and it is a project that he's undertaken with rick grenell who was the special adviser for trump for the balkans during the end of the trump administration and involves a real estate partner from california and then a -- there is a real estate and kind of a billionaire businessman from albania who has been advising them who is close with the prime minister in albania. >> and jared kushner and rick beganel, and a billionaire in albania what could go wrong. let me read more of your story. affinity partners has the $2 billion in funding, among other foreign investors, and in a statement an official of the affinity said it had not been determined whether the saudi funds were part of any project kushner is considering in the balkans. kushner said to -- in this story, we're very excited. we haven't finalized the deals so it might not happen, and we've been working hard and we're close. and then you get to what christie was talking about. he set up this after he left his white house job and he capitalized on the relationships from the middle east which includes a close relationship with mbs, the ruler of saudi arabia. and i know your colleague did some reporting on this and kushner an the money. chris christie tried to make it a plaque of his primary candidacy against trump and that this is a grip. and i remember when mnuchin was going the same and he's a much more experienced ip -- experienced investor. what is kushner selling. >> he's asserting that he's a meticulous real estate investor who is able to make profits for people that back him and that he is being careful with how he's going to use this money and he also asserts that he's not going to be a part of any next trump administration and yes, he's a member of the family but since january 6 in particular, he's kept his distance from trump and his political operations. and so, you know, his argument is that he's -- he was a real estate investor before he got into the white house and now he's back to being a real estate investor and he thinks he could make his investors profits. that is the way that they look at this. >> did he before he looks in the white house, was he very successful at doing that? >> he had sort of mixed success. they had a big office building in new york city that was financially challenged. i would say he had nix success. his father started as a major real estate developer and he joined his father's company and then started his own company. it is pretty -- in parts of new york city and dumbo and in brooklyn, he was pretty successful with the project there and jersey city and some other places. he has had his successes for sure. >> what is rick grenell's role in this, eric? >> so, grenell built a lot of relationships in the balkans during his period of serving as the special adviser on kosovo and serbia and he got to know the albania prime minister very well after he left the trump administration. and became friendly with him and began to socialize in the circles there. frequented albania he loved the coastal, the beaches and the luxury and so he became -- and the -- let's see. the prime minister of albania, for at least a decade, has been talking about trying to develop this island called saysan, off the coast of southern albania because it is been sitting there vacant since the end of the cold war and that is idea that grenell ran with and brought it to kushner and got kushner to be introduced to the prime minister and when he was there in july of 2023 with ivanka, grenell and curb mer met with the prime minister and that is deal. so grenell is the nexus of this and he also has a relationship in serbia that i think played a significant role in getting access to this really key site in belgrade that -- i mean getting access to government owned land in some of the most valuable potential tourist properties in those two nations, and getting potentially the concessions to profit off of those is a very big deal. and that is part of the role that grenell has played. >> that is what he said in eric's story. the new york types quote, grenell added in a nearly 90 minute television interview, i've never done a 90-minute television interview that there was nothing wrong with this deal making because he wasn't in government. working on private equity projects and no one has ever apologized for wanting to make money. and i point out that in "the new york times" is this quote, robert wise is a public citizen which tracked business deals that considered con flicks of interest during trump administration said the plans deals were unethical and raise questions if trump is re-elected. jared kushner should freeze any new investment plans that involve the worst of every corrupt tendency in the trump administration and the trump family, end quote. an that is an understatement. we should laugh because there are so many career public officials for whom this is like the nightmare they have. the idea that there are people who serve in government, you'll remember jared kushner was the secretary of everything. he just did everything he wanted. >> everything and nothing. >> so that guy is now going to develop government property with another guy who met -- who met the government officials through the trump administration. oh, and by the way, trump's daughter is married to that guy. i mean, it is just -- it is every level of corruption. and these are the people screaming about hunter biden who bought his art. it is just -- it is beyond the pail. >> what is barely news is in places like russia. this should be in our american autocracy. >> it is happening here and in broad daylight with everybody watching and i think that is really speaks to how we are beginning to let donald trump and his relatives normalize this kind of trading and this kind of -- >> that is a danger. >> just like ha ha ha, jared did it again. and even if i can't see the details, just looking at it on the surface, i mean, it is -- my nose is out here and here is my mouth and here is my breath, i could smell things before i could taste them and before i understand them. this stinks. >> before you nurture that is bright for ukraine without continuing u.s. support. let's bring in lisa yasco joining us from kyiv. and the rev and molly are still here. it is embarrassing to share this news with our viewers, it is even more embarrassing to do it with you listening. tell us what this means for people of ukraine? >> well, you know, as someone who is dealing with the foreign affairs of ukraine, and many them are asking this question that you are asking me. an for me it is very hard to look at the eyes of the ukraine people when i come back from different briefs after the conversations with the foreign politicians, with the republicans, with the democrats, with congressmen, congresswomen. it seems that when we talk, the support is there. but when we are in action, it looks like a different internal problem and unfortunately it is not very helpful for the situation in ukraine. and i want to warn everyone it is not ome about ukraine. it is about ukraine having a terrible life and death situation every day. it is about big geopolitical catastrophic threats where russia is not just winning, russia is becoming military, very, very strong. and we should be looking at the eyes of this and we shouldn't ignore it as the community that believes in the international law and humanity or it will be too late and we will face terrible consequences around all of the globe. >> i know that the people and the politicians in ukraine keep a very watchful eye on our politics. but in some ways are more clear eyed and savvy and prescient than we could be in my experience. but did people predict that even before a presidential election, with majority of the american people supporting ukraine, and the military effort against russia, that aid would get mired in congress because of the republicans. >> no, definitely. we could not predict that. and it is very hard to explain to ordinary ukrainians why there could be any battles, and president biden was in ukraine, we hear so many good statements for all of the time, but what could go wrong that this aid is postponed and when we hear that there are some internal issues, they say it is a political debate, the presidential elections, of course it is not just restraining, it is something that you could not explain to ukrainians. especially also the -- the support of the united states among ordinary ukrainians is very high. we believe that all americans, most of american people are on the side of the truth and the good side, and are supporting ukrainians, so then why is there no political decisions that are made in the right timing. this is very hard to explain. >> and so much of what happens on the battlefield is in comprehensible to people who aren't there. but what is the impact for the men and women giving their lives to fight not just for ukraine but for all democracies when this aid litly is money going to bullets and to ammunition and to the weapons that are needed to prevail in this war against the common enemy. what is the impact of the men and women fighting when u.s. aid is called into question and doubt? >> when we just look at the mathematics of that. it is a question, as you said, it is a weapon, it is about artillery and having the bullets that you could use against the enemy who kills your cities, your lives, your families, and unfortunately very often in the recent weeks, because there is no aid being delivered in time, we have the situation where russia is military stronger -- many times more. i'm talking about not the immense power and the strategy, i'm talking about just the mathematics of how much weapons they have. and what they are capable of. and we still don't have very simple things because we ran out of them. and if we want to win, if we want to have justice, we need to have resources to achieve that. and we can't be just losing our people. and the price that we have paid for this freedom and for this fight for justice is very high. every family has somehow who lost someone. no houses, no -- no normal life in the city. many people don't have their cities any more. like the city life, the schools and jobs, because it is under occupation or absolutely destroyed. it is incredibly linked. and, when we, for me, as someone would always believed in politics in the international relations, for me, the question is why we're not stopping putin as aggressively. why we're not doing everything possible to lead the military of russia to the extent that they will not be able to fight. >> we have the same questions. thank you so much for being republican's attempt to impeach joe biden, it is so bad that that guy, a really, really conservative republican, is leaving congress over it. that is congressman ken buck from colorado. you may have heard the news that he announced he will cut his final term in kog short, abruptly. crediting his party's unfounded debacle of an impeachment inquiry that has turned up no evidence of wrongdoing of the president. white house still have had enough. white house counsel's letter write to you today because it is clear that the house republican impeachment is over. the house majority ought to work with the president on our economy, our national security and other important priorities on behalf of the american people, not continued to waste time on political stunts like this. he continues, quote, the house majority has reportedly collected more than 100,000 pages of records, interviewed dossens of witnesses and held multiple public hearings but none of the evident has demonstrated that the president did anything wrong. in fact, it has shown the opposite of what house republicans have claimed. in response, speaker johnson said, quote, the white house doesn't get to decide how impeachment gets resolved. that is for congress to decide. but, congress has done with their inquiry so far, other than repel ken buck is to find zero proof to back any of their claims. and in a devastating blow this their efforts, just last month, their star witness, former witness, alexander smirnov was indicted about lying about the bidens. can't make this up. and now we reveal how more untrustworthy he is. serious doubts about his credibility were raised almost a decade ago and no now prompting questions why he remains on the phish payroll for as long as he did. his attorneys said they are client, quote, stands behind his years of service to the u.s. and they have not responded to the request for comment and it does underscore upon which republicans face their inquiry. they can't even point to any clear evidence which asked. have you seen direct evidence? because that is what we have not heard. >> well we have to connect the dots. >> there is not been produced a smoking gun, clear-cut undeniable proof of the president's involvement with his son. what do you say to that? >> well, we've never claimed that we have direct money going to the president. >> we've had more potential evidence that needs to be obtained, more hits, more accusations that need to be investigated. >> in an interview with punch bowl news, they called the two republicans saying this, quote, jim jordan and james comer are becoming the chairman who cried wolf. promising a there-there over and over again and producing nothing close to an impeachable offense. and the white house saying enough is enough to house republicans. rolling debacle is where we begin the hour with some of our most favorite reporters and friends. luke broad water is here and msnbc political analyst david jolly is back. and msnbc legal analyst barbara mcquade is with us, a former u.s. attorney and the author of the book attacks from within, how disinformation is sabotaging within, because when it was first out we missed our shot with breaking news. luke, i remember when you were in new york, because i think it was jordan and comer took their traveling debacle on the road. going to be such a boon. they hit the road with it. like a tour. it is so bad that the conservative ken buck is leaving the party early. explain. >> yeah, it was interesting, you should put that clip of ken buck. ken buck is so conservative that he has an ar-15 in his office. he is one of the founders of the house freedom caucus. so, but he's also a federal prosecutor. or a former federal prosecutor and so he's somebody who does care about the law and about process, and about the facts. and so, you hear him lamenting there, what a circus congress has become. the house -- the republican-run house in particular, going after impeachments just for social media likes and clicks and hits and not for the seriousness of what he said should be a constitutional offense. remember the constitution defined impeachment as a high crime or misdemeanor and not because we don't like this guy and we want to get him back because the democrats impeached trump which is what ken buck is saying that the house has become. >> explain, it is complicated to always unpack where they went wrong because it is never really based on anything that went right. but luke, just explain how reliant they were on smirnoff who has now been indicted as their source for alleged corruption? >> well, remember, republicans always wanted to try to impeach biden as soon as they took over the office. donald trump had told them to impeachment the bum, they had wanted to get revenge for the impeachments of trump. so they were looking for anything that they could get. and they started going back to the files and asking for bank records and asking for all of the documents. and finally something that seemed too good to be true came along. and it was this 1023 form from an informant who claimed that not only that joe biden took $5 million in cash bribes, but that he was on audio talking about it and there were two tapes where joe biden was admitting he took $5 million in cash bribes. it sounds too good to be true at the time. nevertheless, they all ran with it. many of them went on tv and did numerous media hits about it and held press conferences about it and mentioned it as one of the foundations for when they had the vote to -- to launch the impeachment investigation. and then, of course, the fbi and the justice department come back later and say the guy made it all up. and, you know, then democrats ask them to close up shop but they are continuing to go on with the investigation and saying never mind that discredited evident, we'll have to find something new. >> which they haven't found yet. so the thing, barbara, about them going on tv is we've got it. let me show you some of it. >> you have the confidential fbi informant who is basically saying that joe biden took $5 million from burisma. >> the informant was a highly valued human source for the fbi. >> a trusted confidential informant. >> they had a -- they had a credible source. one of the good sources. >> there most credible paid fbi informant. >> so the idea that anyone said to marjorie taylor greene that it is the most informant, but here is what the government said in support. the circumstances of the offenses charged that alexander smirnov lied to his fbi handler where the to spoke every day and he cannot be trusted to provide information to pretrial services an the false information he provided was not trivial. it targeted the presumptive nominee. and it continues to be felt to this day. and it is a government memo so we'll excuse the understatement. but it continues to poison the body politics of this day. >> >> yeah, so even casting this in the light most favorable to these congressional republicans who wanted to begin an impeachment proceeding against joe biden on the base of this information. they genuinely believed there was an fbi informant who said these things and they even had a recording. they didn't listen to the recording before they went out and talked about it, is shame on them to begin with. but when they learned that this informant is not only discredited but charged with a crime for lying about the very thing, that they are not pulling the plug and apologizing is really baffling. instead, they're now saying well we don't have that any more but we'll find something. it shows that this is a conspiracy looking for some evidence to support it as opposed tole toing the evidence where it leads. and we see this idea of portraying every government official as corrupt. because if everyone is corrupt, and everyone gets impeached, it takes the teeth out of what is means to be impeached. so i think the effort to impeach joe biden is an effort to rehabilitate donald trump and to say everybody gets impeached. it is just a political act. >> and david joggy, that is exactly what it is. and they didn't plan on ken buck to be the press's eyes and ears on what a scam it all is. >> yeah, nicolle, if this was a serious congress, i'll tell you who they would be investigating today. it is trump and not joe biden. and this story opens up a ton of questions. because of this. go back to impeachment 1. it was impeachment 1 where donald trump was impeached for his involvement in pressuring ukraine to confirm an investigation into joe biden and essentially hunter biden as well. bill barr comes on the scene two weeks after the former president was impeached and said we should look at this information from someone like alexander smirnov, so at the time donald trump was involved by pressuring the ukraine government, there is this asset that the u.s. thinks they have, oh, by the way, has been confirmed had tied to russian intelligence and was not found to be credible and this actor is on the world stage providing information to federal prosecutors at the time when donald trump, donald trump is president and bill barr is the a.g., somehow those two things are totally unrelated. maybe. but you have to be crazy to just assume that. if congress wants to investigate someone, they should investigate donald trump right now and whether or not the smirnoff piece had anything to do with impeachment 1 and congress is not serious and so you see them chasing hunter biden and the tapes. >> it is such season interesting thought. did barr and ray give trump the wave off on smirnov and they're eating the left over garbage. i want to ask you about something else that happened today. and here is mike pence shocking the you know what out of me. >> it should come as no surprise that i will not be endorsing donald trump this year. look, i'm incredibly proud of the record of our administration. it was a conservative record that made america more prosperous, more secure. but that being said, during my presidential campaign, i made it clear there were profound differences between me and president trump on a range of issues. and not just our difference on my constitutional duties that i exercised on january 6. donald trump is pursuing and articulating an agenda that is at odds with the conservative agenda that we governed on during our four years and that is why i cannot in good conscience endorse donald trump. >> i think he's the only one, i quickly tried to see if chris christie had said he wouldn't endorse trump. i know nikki haley said he would endorse and mitch mcconnell has endorsed donald trump. and we've been talking all week about voters looking for permission to not vote for donald trump. they just got a giant, giant, giant one in mike pence. >> a giant one. and any questions about what does mike pence do next, i think mike pence is good for him stepping out and saying he won't endorse, but to suggest the second donald trump administration would be different from the first is a bit of make believe. it would be exactly what the first administration was and the administration that mike pence himself enabled. but set that aside for a moment. i think what does mike pence do next? because i kind of see all of this as three lanes, if you will. you have the lindsey graham lane who said i got beat so i'm going to face plant in front of trump and elise stefanik and tim scott and even mitch mcconnell who said i'll support the nominee. and then you have those who say, like mike pence, i simply can't enforce him. is that the mike pence, jeb bush lane, where they stay out of politics. in that sense, they made their piece and they stepped out and not cute by half and third is those who stay in the arena to say i'm against donald trump but fail to go to say the way we stop him is to vote for joe biden. mike pence is never going to say he's voting for joe biden. so the right lane for him is to go away until november and let the american people decide. and have more respects for republicans that say i don't endorse and go away and than those that say donald trump is a threat to the free world and i'm not willing to vote for joe biden and that is what we should expect more from. >> and i completely agree. i remember having a big fight with joe walsh about, i think years and years ago, on the honest thing to do if you think that donald trump is unfit, is to vote for the person that is running against him. luke broadwater, this puts mike pence at odds with his own colleagues in the house republican caucus. all of them except for former members, all of them have said that their voting for trump. any reaction up on capitol hill to mike pence's -- he started by saying, i think that was martha mccown, you wouldn't be surprised. i'm shocked that mike pence is not endorsing donald trump. >> yeah, it is donald trump's own vice president. this is someone that knows him better than anybody and he's refusing to endorse him. and mike pence is also in a unique situation of being the person on january 6, who the pro-trump mob threatened to hang and tried to storm the capitol trying to get at him and looking for him. so, he may have -- you know, he knows firsthand the danger of donald trump and in a way that some of these people do not. but there are many other house republicans who were there on january 6 who also ran, who fled for their lives who were on the other side of a door with guns pointed, capitol police guns pointed at the mob. so, and many of them do know firsthand what mike pence knows. but they have chosen another tactic. they've chosen to stick with the party and the nominee of the party no matter what. >> it is really stupping. you're right. there is no -- there is no difference between what they saw and experienced that day. although pence running with down the stair was a uniquely haunting image. but they all have access to the same information. it is a really smart point. it is great to see you. thank you for starting us off this hour. david and barbara postponed. it will now start in the middle of april, 30 days from today. according to judge juan merchant who is overseeing the case. yesterday alvin bragg had requested just a 30-day delay. after trump requested 90 days. that request was due to delays from the justice department, actually. in providing evidence to trump's lawyers. but evidence involved the federal investigation into the prosecution's star witness, former trump lawyer michael cohen. judge merchant has already scheduled a hearing on march 25th, the day the trial was supposed to start. we'll stay on top of that. coming election integrity a centerpiece of the 2024 campaign effort. it is not aa coincidence. according to new reporting in "the new york times," quote, trump wants the rnc to share his obsession with the false idea that president biden and democrats stole the 202 election from him and are working to do it again in 2024. this time around, the trump wants the rnc to be more aggressive. he's claiming without evidence that democrats are plotting to steal the presidential election. the full throated submission to the cult of the big lie by the infrastructure of the party will turbo charge what is at this point a long-standing threat facing our elections and our democracy. disinformation. our next guest barbara mcquade writesen he emmys of democracy are using disinformation to attack our save rin right to truthful information and election integrity and the exercise of the will of the people. ultimate result over time is a weakened democracy and diminished national security and ape threat to the rule of law. the attack is from within. we're back with barbara mcquade, author of "attack from within", and david is still with us. barbara, untangle this for me. i mean, the ex-president twice impeached and four timed indicted, manufactured and won't even call it data, he parroted a lie about fraud that put in motion 61 lawsuits. he lost 60 of them. that put in motion january 6. people died. he now has an entire party apparatus dedicated to, in his words, the manufacture of a lie. there is no fraud in this country. there is no voter fraud. bill barr said there was no fraud that would have changed the outcome of any of the state results in 2020. what should we be prepared for in 2024? >> i think, nicolle, we're going to see more of the same and then some. because of the increased capacity of technology. to use deep fakes, artificial intelligence and other things to deceive us. so i think there are two problems that go on. one is, there are sp people who believe these false claims. they believe what they want to believe. they are preyed upon through their fear and they want to identify with a particular party and so they're going to believe whatever they hear. but i also think there is another swath of the american public who knows better. people in congress who are harvard educated lawyers, people like elise stefanik in the house who parents donald trump's phrase that people arrested on january 6 are hostages, suggesting that their political prisoners and they care more about their political tribe than truth and it is a vae dangerous place for democracy to be. >> let me read something you write in your book. at it most the most disinformation in u.s. politics are far right members of the republican party. curbly rather than call out lies, a large number of republicans amplify them or they silently indulge disinformation to advance their own careers and policy goals. some conservative news media outlets have profit that are exacerbating the threat. we talked in the last hour, where there will be most likely no legal accountability for trump. a story we've been covering together since the earlier days of creation of the mueller probe. sort of culminating in a slim chance that there is any criminal accountability. what we do have then, is this information eco-system. and you've laid out the tools that the far right -- it is not even the far right but the right and the media outlets will use. how do you do two things? how do you knock down the disinformation and make sure the truth gets out to a large sort of segment of the public? >> well, i think in this election year, the focus really has to be on getting accurate information out to voter. i think we'll see influence campaigns and things to try to taint the republicans rivals and to show them in a good like and talk about stolen elections. but i worry about some of the efforts that are being done here. for one, we know that we have new election laws in several states like georgia, texas, and florida. they were passed in the wake of 2020 election under the false pretext that there was voter fraud in 2021. in fact, as you just said, there was none at all. but i think we know that we're going to see more false information coming before the 2024 election. and i think the biggest concern i have is information that will actually suppress the right to vote, confuse people about what the rules are, or send out things that will cause them to waste their vote. for example, the robocalls that were done in new hampshire, impersonating the voice of joe biden where it sounded like joe biden was urging them to stay home and save their vote for the fall. we could see other scams like that in the november election. and when an election can turn on a very limb margin in just a few states even suppressing a few votes with those kind of calls could turn the outcome of the election. >> you know, david jolly, with the trump campaign takeover of the rnc, and covered even by me as sort of a nepotism play, his daughter-in-law took over, moving it all to mar-a-lago, it is going to be a legal slush fund. the thing to keep an eye on is the operationalizing of disenfranchisement. and let me read this. this is again from "the new york times." the rnc sued michigan on wednesday to make cuts to the state voter rolls arguing that they are bloated with ineligible voters. whatley outlined the strategy for 2024 and said many more are coming. the republican strategy is now clear, it is lies, about the legitimacy of president joe biden's election in what life long republican chris krebs called the most secure election in our country and it is disen franchisement with a promise to be a dictator on day one. >> none of those things are popular. >> how do you make sure that gets out. >> they might win an election if they could pull it off. but you're exactly right. the whole purpose of donald trump's take over of the rnc and putting his daughter-in-law lara and in senior leadership is the first financial enrichment and the adoption of conspiracy theories that will allow them to repeat them again after this election if they lose. to deny that the '24 election was fair and legitimate and then the third being voter suppression. pause republicans know that the more voters that turn out, the more likely it is that democrats win. the best test case are presidential election where's we see historic turnout, it happens for 30 years but for one time. so that is absolutely the takeover. this piece, though, of adopting misinformation and disinformation and i'm so glad that barb wrote this book. thank you. and the impact because of the adoption by natural leaders and institutions, information and disinformation and misinformation has always been there. with the rise of tech and media and new platforms, it is easier to reach people with it. but without the adoption by elected leaders and important institutions, it always kind of stayed in the shadows. think about pizza gate. you didn't have national leaders and elected office seriously peddling pizza gate but you did have the miss cre ants and it led to a very dangerous situation. move though, to january 6 and november 20 election. what is the difference? what was different was donald trump at bully pulpit said this misinformation is true. don't listen to the true information, listen to the lies i'm going to tell you and now you have the rnc adopting that and other leaders adopting that and it create this is loop that gets hard to defeat. this is an area where the job every day from good folks like you and others is to put the truth out there and let the american people decide. but part of telling the truth is calling out lies and in this case donald trump and his daughter-in-law and the rnc is peddling lies an conspiracy and good for barb for point it out. >> it is called attack from within, how disinformation is sabotaging america. it is (♪♪) start to get yourself back, with bimzelx. ask your dermatologist about bimzelx today. just another election bearing down in front of us, let's take a walk down memory lane. back to the year 2017. at nate ore summit in brussels, you could see the twice impeached four times indicted ex-president pushing his way to the front. and he shoved the prime minister of montenegro. it is a tiny country about the size of connecticut that was just about to join nato to be part of our alliance against putin's whim. and putin was angry that montenegro wanted to join nato because it meant they would be entitled to nato protection under article 5 should anybody, say russia, attack them, so that push from donald trump could also be seen as having your besty bully your arch nem sis and from his friend putin. trump is threatened to pull the united states out of nato or saying he would encourage vladimir putin to, quote, do waver the hell he wants to our nato allies, and this time we should believe him. when he tells us exactly what he wants to do. and when it comes to nato in a second term and what appears he wants to do is kneecap and weaken nato and our alliances, sping that the former prime minister of australia malcolm turnbull told me would be cataclysmic in the world stage. >> this disruptive chaotic approach that trump takes to establish alliances is a real threat to the security of the free world, the security of the united states, and of course particularly the security of america's close friends, like australia, america has no better friend than australia. but we have to look at it from our point of view. if trump's america gone to mach 2 going to be one that we could rely on and the truth is we can't be sure. >> it bears repeating, the disruptive chaotic approach to world alliances is a real threat to the security of the free world. trump's stated desire to potentially shatter the world order is something that we've been exploring in our new series american autocracy, it could happen here. an joining our conversation, the center for international security and corporation and the former deputy general of nato from 2016 to 2019, ross scott miller joins us now, during the trump years. thank you so much for being here. >> my pleasure. >> so i remember covering here from the first trip and i remember his aide, mcmaster was the national security adviser and his deputy dina powell, they were both on the trip. and before every public speech, they are the surrogates that would back channel to the american speech, he's going to confirm to article 5 and then i think in those days we still took trump's speeches life, something we'll be soul searching about the years to come. oh, he'll do it at the next stop. he didn't care that america was only country to call that commitment due in the years after 9/11. but what is it say not just that he could be back in office, but that enough people in this country are either uninterested in or ignorant about or don't see the value of our alliances that they don't care that he would weaken or destroy nato? >> i have to say that that clip of 2017 may summit sent me into a cold sweat. because it is one of those memories that extraordinarily is difficult and trump was very disruptive during that summit meeting. that is when he put nato on notice that he wasn't necessarily going to live up to the article 5 commitment. that is that an attack on one nato ally is in attack on all and nato has to step in the case that ally asks for help. so that is a very difficult meeting for all of the allies. a shocking meeting for all of the allies. but one other thing i want to say about trump is he is very transactional and he pressured the nato allies unrelentlessly during his first time in order to come up with defense spending and pressure some allies and he was satisfied by that. so in a way, there are some simple ways to respond to the threats that he exerts. but i agree with you, nicolle, it is quite worrying, the kind of rhetoric we're hearing now about withdrawal from nato an the free loading allies and they don't do anything for u.s. security. we need to come back home and defend ourselves. >> what is this damage that someone like trump could do as an american president promising in his own words to rule as a quote, dictator on day one? >> well, i think he is actually constrained somewhat now by u.s. legislation from a full scale withdrawal from nato. but he could, as i say and others have said, undertake a thought withdrawal when he would refuse to put a u.s. ambassador in place at nato and the u.s. ambassador always plays a very important role as a leader in nato. also, he could refuse to appoint the supreme allied commander, the military commander at the top of the nato alliance and that too would be extraordinarily difficult. so this would be meaning essentially that the u.s. was falling away from leadership of the alliance and the other allies would have to fend for themselves. >> trump's affection for putin, i think in america we kind of went through ten stages of deny that it is intentional, look away from it, other he's to ignorant to mean it. we've sort of come full circle and he clearly adores putin. he's admired everything he's done including the brutal and illegal war in ukraine. what would an operationalized alliance with putin look like if trump were to return to the white house? >> okay, this was particularly the case at the hamburg g-20 in 2017. it was very disconcerting. i mean you saw on the one hand trump's very, very apparent distaste for angela merkel, the chancellor and the prime minister of germany. ond the other hand, his fascination with putin and it was an extraordinary contrast. so the -- i mean, his instincts are not democratic. >> we're back with rose garden miller. you saw these events as well and his anti-democratic instincts. i wonder if you have any insight into what preparations our allies might be making for the chance that trump prevails? >> well i'm glad that the australian prime minister brought up that point. because trump really did not get along with angela merkel and she kept insisting that germany could not spend 2% of the gdp on defense as germany had promised all of the nato allies promised to do that when putin invaded in crimea in 2013. so he was angry that she refused to pay off. it is that transactional personality. and the situations that changed now significantly. not because of anything that trump said but because of the fact that putin has invaded ukraine, this time on a full scale basis. this is been a huge wake-up call to germany and other nato allies about the necessity of investing in their own defense. so now chancellor schultz and his whole government say they are going to be spending 2% on their own defense and this is a big change from 2017. so actually, i think partially it will help in nato' dealings with trump as difficult as they're going to be. >> what is the view, just from your former relationship, the v your former relationship, your former perch of america as we seem to be -- liz cheney called it sleep walking into dictatorship? >> well, it's very difficult to say exactly what trump's approach is going to mean for foreign policy because he does like to be seen on the world stage as a leader with influence. i think to be honest with you, the nato alliance is one of our greatest instruments that provides us influence, both in europe but also on a larger stage it allows us to essentially defend our own country, our continental united states forward without ever having to worry about foreign troops setting foot on our soil or approaching our territory. so it's really, i think, a moment at which we'll have to see if trump can be convinced he can be the big man on the world stage and have a certain degree of fame and influence because of his association with the nato allies as well as our allies in asia. this is really the big man and how he looks to the rest of the world. it has nothing to do with american security, which is the disastrous aspect of this. but if he can be convinced that his role will be enbe hansed by this relationship i think it can and will be possible. >> it's an extraordinary, extraordinary place to put pause for today, the world will have to be in in pufg up his ego to ensure security. it's a devastating analysis but it's probably the truest thing that's been said in the last two hours. thank you very much for having this conversation. i hope there are more ahead for us. quick break. we'll be right back. students in a new kind of classroom. ♪ using our technology to power different ways of learning. ♪ harnessing ai to plant new beginnings. ♪ so when minds grow, opportunities follow. type 2 diabetes?
