we don't anoint kings in america, we have elections.no and texans deserve the right to vote. >> it really does send a signal if you can't get out to vote tomorrow, get your husband, your wife, your friends, their , friends, we want to send a signal that we're coming, this freight train is coming. we have to do it tomorrow. tomorrow is the big day. >> nikki haley and donald trump making a final pitch to voters ahead of today's super tuesday primaries. we'll break down what's at stake and what it could mean for the race going forward. plus we'll get legal analysis on the supreme court ruling allowing trump to stay on the ballot. and we'll bring you the latest developments out of the middle east as vice president kamala harris continues to press for a cease-fire in gaza. ♪♪ good morning and welcome to "way too early" on this tuesday, super tuesday, march 5th. i'm jonathan lemire. thanks for starting your day with us. voters will indeed head to the polls across 16 states and one u.s. territory today for the busiest day on the primary calendar. republican primaries and caucuses are taking place in 15 states with 865 delegates at stake on this super tuesday. former president trump is widely expected to sweep the races in likely all of the states holding contests today. as gop presidential opponent nikki haley continues to say she'll stay in the race as long as she's competitive. we'll see what that means. meanwhile, democratic contests will be heldco in 15 states as well as american samoa with 1420 delegates up for grabs. president biden faces no real challenge in today's content. ahead of the vote, nikki haley made her closing argument to voters in texas last night at a packed rally in fort worth. she laid out what's at stake today. >> republicans lost the vote on mayorkas, on israel, the rnc chair lost her job and donald trump had his j fingerprints on all of it. at some point maybe we should say the reason that america keeps losing is because of donald trump.ep we can change all of that. but in order to change it, it's going to take a lot of courage. courage from everybody here. courage from me to run, and courage for every one of you to know, don't complain about what happens in the general election if you don't vote in this primary. we are blessed to live in america. and we know that america is better than this. now we have to do something about it. so this is what i will tell you, tomorrow you got a job to do. i need you to vote. and i need you to take ten people with you. >> meanwhile, in an interview with conservative media company right side broadcasting network, donald trump last night expressed confidence headed into today's vote. take a look. >> i just say to the people watching now if you could, go out and vote. because it's not haley, she's not a problem. i think she's very negative for the party but not a problem in terms of winning because we're winning by a lot. the only place we expected to lose was d.c. because that's the swamp. tomorrow we could win every state in record numbers that's what we're hoping for. they call it super tuesday for a reason. i think it's going to be recordt setting. i think, i hope so. >> there was one contest last night and former president trump won it,on the north dakota republican primary. he beat haley by a 70 point po margin. trump will likely be awarded all 29 of the delegates. in response to the win trump noted the large margin of victory and thanked the governor of first lady of north dakota. joining us n now, jonathan alle he appears for us at west palm beach, florida across from mar-a-lago where he'll be attending president trump's victory celebration tonight. a big day, trump expected to win nearly all or all of today's od states. what are you expecting to hear from him or from nikki haley who said all along she's staying in the race through super tuesday, that'sth arrived. what's next? >> it's a day of reckoning for nikki haley one would expect and every time there's a day of reckoning for her she pushes off that reckoning, moves the goal post. it was interesting in the clip you played from last night where she said the reason america is losing is donald trump. there's a choice for her to say if there's a reason that america is losing, you would think it would be joe biden from the republican candidate for president but instead donald trump, that rhetoric is getting harsher as she gets closer to the end. but donald trump will not wrap it up tonight i believe it's impossible for him to clinch it tonight. we expect it to happen this month. >> let's spend more on nikki haley here. she said, a truism, the campaigns stay afloat as long as they have the money to do so. can she push forward beyond super tuesday and keep an eye on the trump trial date a few weeks off, maybe i'll stay in this just in case? >> she can do that if she wants. the question is, a couple questions, how much damage does she do to herself with republican base voters in the event she wants a future in the party and the other question, how much damage does she do against donald trump running against him and levying tougher criticism of him in response to the indictments against trump. a pretty big win yesterday. it is not clear that any of those trials are actually going to happen or happen before this election. so, you know, the window may be closing for her on that front. >> let's take a moment and talk about the democrats. president biden is going to sweep to victories in every contest today. but tell us what sort of message are they hoping to send today as to what it could mean for the general election? >> i think they're hoping to send the message that for all the talk of disunity in the democratic party and the issues where there are democrats who are, you know, upset with president biden that basically it is a unified party and he has a head of steam behind him and he has, you know -- he had some, you know, phenomenal challenges and able to put them aside easily. they had states they didn't love what happened, particularly some of the protest votes in michigan but at the end of the day they want to come t through and say this has beengh a dominating commanding performance as you would expect from a former president and biden ready to turn to the general election. >> as we make that turn, president biden is going to enjoy a massive fund-raising advantage over former president trump he's going to have more resources on hand it appears. we appreciate you starting us off live from south florida, thank you john. in a unanimous decision the supreme court said states do not have the power to kick candidates off election ballots p it comes from a colorado court decision that determined donald trump was ineligible under the 14th amendment anti-insurrection clause. laura jarrett has more. >> the u.s. supreme court dealing a final blow. the justices effectively leaving it up to voters to decide if the former president returns to the white house. mr. trump praising the ruling. >> the voters can take the person out of the race quickly but a court shouldn't be doing that. >>be the justices rejecting a colorado state ruling finding mr. trump to be ineligible to be president under section 14 of the amendment. a section o passed after the cil war. an elections official in maine and a judge in illinois doing the same, banning the republican front runner from the ballot in those states in light of his actions on january 6th, the ruling from the high court eliminating all similar efforts. >> while most states were thrilled to have me. there were some that didn't, and they didn't want that for political reasons. >> reporter: the justices saying that patchwork of different rulings across the country cannot stand. finding responsibility for enforcing section 3 against federal office holders rests with congress and not the united states. enn fe same time the three liberal justices saying their colleagues are going too far. writing this ruling will make it harder to bar an oath breaking insurrectionist from becoming president. this court should turn the national temperature down not up from justice berit. next up on "way too early" we look to president biden's state of the union address which he'll deliver later this week. plus vice president kamala harris meets with a member of israel's war cabinet what she had to say about pushing for a pause in the fighting in gaza. those stories and a check on sports and weather when we come back right back.ts ck right back. perhaps you know me as, the kung fu panda. ♪ ♪ ah, you're adorable. huh. oh, whah! with a little kung fu strength and by connecting my devices to the most powerful force of all. skadoosh. hah, huh? cool right? amazing. harness the power of xfinity internet and stay connected to the things you love. ah, they'll be like this for hours. hello dad, hello dad, hello da. uh-oh. good bunnies. ahh! welcome back to "way too early." it's just about 5:30 a.m. here on the east coast. 2:30 out west on this tuesday morning i'm jonathan lemire thanks for being with us. we turn back now to one of our top stories. donald trump will remain on the ballot despite efforts in some states to make him ineligible for the 2024 election. the supreme court rejected the ruling from the colorado supreme court that removed the former president from the ballot based on section 3 of the 14th amendment. the justices ruled that a patchwork of decisions around the country could send elections into chaos if state officials had the freedom to determine who could appear on the ballot. the decision makes clear it's up to congress to enforce the insurrectionist clause against federal office holders and candidates. but the three liberal justices accuse conservative colleagues of going too far but ruling congress must enact new legislation in order to ban a candidate. they wrote this decision will make it harder to bar, quote, an oath-breaking insurrectionist from becoming president. speaking after the ruling was announced. trump as you expect praised the highest court's decision. he also had a message for the justices before they hear arguments in his presidential immunity case next month. >> i want to start by thanking the supreme court for its unanimous decision today. it was a very important decision, very well crafted. and i think it will go a long way towards bringing our country together. you cannot take somebody out of a race because an opponent would like to have it that way. i hope the justices because they'll be working on other cases but one in particular, presidents have to be given total immunity. i don't want to be prosecuted because i decided to do something that is very much for the good of the country, and actually for the good of the world. >> trump appearing at mar-a-lago yesterday and joining us dave aronberg. let's get your decision, it was telegraphed in the arguments a few weeks ago, this was going to be where they rule. did you expect it to be unanimous? give us other impressions? >> good morning, i'm not surprised. the supreme court wanted no part of kicking trump off the ballot during these heated political times if there was any doubt of that, the oral arguments put those to rest. when liberals are skeptical of your arguments you know you're leaving washington d.c. with an l. the court latched onto section five of the 14th amendment which gives congress the power of the provisions of the article. but the five justices here went further than that. they didn't just rule that states candidate disqualify trump or presidential candidates. they ruled that states cannot disqualify any federal insurrectionist candidate and gave congress the exclusive power to implement that section. there's nothing in section 5 that says that congress and only congress has the power to implement section 3. but the court gave congress the most dysfunctional american institution that kind of power. so now even if a federal candidate engaged in insurrection and was charged and convicted a state couldn't disqualify that candidate. if a federal court had the issue they couldn't diskwaul an insurrectionist either short of a law enacted by congress. you know what congress is going to do about all this, jonathan? nothing. because that's what they do best. >> there are some democrats anxious about this. didn't think this was the right way to defeat trump this year. they felt like they had to do it at the ballot box but trump talked about the idea the supreme court is going to hear arguments and make a decision about immunity. that is something that i think everyone is deeply worried about. so dave, give us your sense as to how you expect that will go. >> i think the court is going to reject the idea of absolute immunity, jonathan. but who knows where they go with the opinion and i'm concerned about the delays, because justice delayed is justice denied. what's interesting is the women of the supreme court wrote or joined a concurring opinion here to share concerns that were ignored by the male justices that the country is fractured and it's diminished when the court does more than it needs to. they did not mention the elephant in the room, that is the absolute immunity question. but it's hard to ignore the double standard here when the court expedited the decision in this matter to help trump stay on the ballot before super tuesday and at the same time dragging their feet on the question of immunity while a case is pending in washington d.c. that could wound trump in his chances of election. so, you know, this is why people have lost faith in this supreme court. they continue to demonstrate why we should not expect our democracy to be saved by judges, prosecutors, secretaries of state and not members of congress. only voters can do that. >> fair points about the timing there. state attorney for palm beach county, dave aronberg, thank you. we'll go live for the latest business news including why the european union levelled ari melber -- can european union levelled apple with a massive $2 billion fine. we'll tell you about that when we come back. about that when we come back head & shoulders is launching something huge. the bare minimum. anti-dandruff shampoo made with only nine ingredients - no sulfates, silicones or dyes and packaged with 45% less plastic - giving you outstanding dandruff protection and leaving hair beautiful and moisturized. major dandruff protection, minimal ingredients. job done. new head & shoulders bare. time now for business and for that let's bring in cnbc's arabile gumede, who joins us live from london. stock futures in the red after the nasdaq retreated from the record high. what seems to be driving the market? >> it will with a certain type of voter and it goes beyond what we think of trump red meat voters that this serves. trump is having an issue with understanding the english language he's shown he's not good at it. i can understand why he thinks it may be from mars but putting this aside, this is ugliness. what he's talking about in new york city is complete bs, jonathan. i say this because it's hard to hear, the thing that he went after biden on on immigration crime, that has some -- some go to it, if you will. because crime was the issue in 2022 for republicans, they took back the house with it. immigration being a top issue. it's a link that's not there. it's not in the numbers, it's a lie but it's something that suburban families are concerned about. we have seen a push back, especially, for example, in new york. the new york suburbs which we just saw in new york three. now tom was able to push back and take the seat back but that's because he had a record. >> and crime has fallen across the country in the last year or two and no evidence that immigrants have anything to do with the crime existing. but it's stoking the fears to the point. today is super tuesday, it should be the moment trump is pivoting to the general and wanting to broaden the tent but that's not what we're hearing? [dog whimpers] [thinking] why always the couch? does he need to go to puppy school? get his little puppy diploma? how much have i been spending on this little guy? when your questions about life turn into questions about money... there's erica. the virtual financial assistant to help you spend, save, and plan smarter. only from bank of america. the supreme court ruled today that donald trump could stay on the ballot. i think that was important. >> yeah. >> we don't ever want some elected official in a state or anybody else saying who can and can't be on a ballot. this is america. this is america. look, i'll defeat donald trump fair and square, but i want him on that ballot. >> that was nikki haley in texas yesterday weighing in on the supreme court ruling that donald trump can stay on colorado's primary ballot. joining us now, national political reporter for "the washington post," hannah knowles. good to see you this morning. you have a new piece with the headline, "trump poised to dominate super tuesday as haley makes her last stand." let's start there with haley. she has throughout this process vowed to stay in through super tuesday. super tuesday has arrived. she's not expected to win many, if any, contests today. if that's the case, what happens to her next? >> that is the question. i think there are a lot of people who think, you know, maybe she could drop out pretty soon after this, but she hasn't announced anything. >> so what are her sources -- what are her advisors saying in terms of, you know, it is a truism, right, that these campaigns, they stay afloat as long as they have the money to do so. we know some of her big donors have backed away, but does she have enough cash to keep going for a while were she to choose to? >> that is the interesting thing, right? a number of people have made that point. usually, the campaign would run out of money at this point, and nikki haley still has donors who, you know, they want to see her fight and sort of carry the banner for that old guard, like reagan wing of the party that's still around, despite the trump takeover, but i just can't imagine what she would gain from going further at this point. >> what would be the rational if she were to go forward, right? we know that trump's criminal trial, the one in new york, starts in now under three weeks. is the idea that she could stay around in case something were to happen there or an unexpected event that could derail trump? >> there is a case for stick around and collect delegates for as long as you can to be the person who can swoop in if something happens, but that is also looking less and less likely. we're seeing that we might not have, you know, a lot of these trials could get delayed until after the election. it is looking less likely trump could have the moment of legal derailment. >> you've been writing about how haley, though she's won the one contest in d.c., she's put up pretty good numbers in others. she pulled in a significant amount of the vote in new hampshire, iowa, particularly south carolina. talk about the implications for republicans and donald trump's success in november. >> she'll point out her best showing was in new hampshire. she got 43%. that's not, you know, a tiny minority, is what she says. she says that this is a sign that donald trump has work to do if he wants to win over that part of the party. particularly, independents and college-educated voters. at the same time, it actually looks like the republican coalition is more united right now behind trump than the democratic coalition is behind biden. even though biden is cruising in the primary, he kind of in some ways has more to be nervous about right now. >> talk more about trump, some of the vulnerabilities that republicans, those who support haley and those that don't, see as potential liabilities for the former president in november. >> well, they would point to the 91 felony charges against him. they'd point to what he says every day. i mean, this is not someone who is -- who has the posture of, i am trying to unite the big tent republican party. every day, he says stuff that alienates a certain group. >> we discussed with susan del percio how he said he doesn't want the mitt romney or his supporters. that's the votes you need in what will be a tight, tight election. national political reporter for "the washington post," hannah knowles, thank you for joining us on this super tuesday. of course, we'll have complete coverage all day long and tonight of the election results. important moment here in the 2024 campaign. thanks to all of you for getting up "way too early" with us on this tuesday morning.
